PRESENTATION Justice in Mexico is being transformed in order to comply with its basic principles of justice, equity, promptness and expedites, giving a preponderant role to society to achieve it, citizenship justice through their participation through the implementation of the orality, mediation and restorative justice, giving rise to a daily justice, which are based on various methods of conflict resolution, such as mediation, conciliation and restorative justice, although the latter is not specifically considered as an alternative method, if it brings together methods and techniques to resolve conflicts, such as restorative meetings, victim offender meeting, restorative conferences and family circles. The process of instrumentalization has generated the establishment of public policies that will allow the transition from retributive justice to alternative justice and restorative justice. This process is guided by criminal matters, being the spearhead of the transformation of our entire legal system through orality as the main bastion, a movement that is already in process in some states on civil, family, commercial, among other. This circumstance has generated a national movement pro-mediation in the country, characterized by a legislative disorder before the diversity of local laws that assume local customs and practices, and its instrumentalization strategies operates from diverse models and systems, generating vicissitudes in its operation lacking in homologation, with different criteria on issues of procedural validity, as well as certification and accreditation criteria for mediators and institutions that administer MASC services. Fact that has caused a poor knowledge of the society of these methods and consequently of its use or real instrumentalization on the part of its final recipients “THE SOCIETY”. Therefore it is necessary to standardize processes and procedures according to criteria recognized by the judicial and law enforcement system, it is required to demonstrate its functionality according to real and proven experiences, from experienced mediators, it is required to unify the theory and doctrine in accordance to instrumental models by humanist theorists and scientists specialized in alternative methods in a planetary context, as well as taking advantage of synergies, with public policies materialized by the Certification Board at the Judicial Headquarters of the CONATRIB (Comisión Nacional de Tribunales Superiores de Justicia de los Estados Unidos Mexicanos, A.C,), SETEC (Secretaria Técnica del Consejo de Coordinación

para la implementación del Sistema de Justicia Penal), of the CNPJ (Conferencia Nacional de Procuración de Justicia) and of the different criteria of the Judicial Powers of the States, as well as the applicable rules to justice for teenagers and the recent guidelines of everyday justice. This manual assumes the challenge according to the following objectives: • Unify the theory and practice of criminal, civil, family and restorative justice mediation according to national and planetary criteria; • Provide the MASC mediators, facilitators, instructors and service providers with the theoretical framework and legal support of criminal, civil and family mediation; • Provide and generate the necessary skills to mediators, facilitators, instructors and service providers MASC in the operational techniques of criminal, civil and family mediation; • Provide mediators, facilitators, instructors and service providers of MASC catalogs of mediable conflicts in criminal, civil and family matters; • Provide mediators, facilitators, instructors and service providers with MASC practical cases of criminal, civil and family mediation; • Provide the MASC mediators, facilitators, instructors and service providers with the conceptual, theoretical and doctrinal framework of restorative justice; • Provide the MASC mediators, facilitators, instructors and service providers with the main techniques / models of restorative justice • Provide and generate in the mediators, facilitators, instructors and service providers MASC and the necessary skills in the techniques of drafting agreements in the restorative processes and case studies. This manual is based on various laws and criteria emanating from international conventions, as well as best practices observed in the various states of the Mexican Republic and other countries under comparative law. The Manual was based on the National Law on Alternative Mechanisms for Settlement of Disputes in Criminal Matters, the National Code of Criminal Procedures, the Law on Justice for Teenagers and the various Laws of Alternative Justice and Alternative Methods of the States, of the National Law of Criminal Enforcement, and the General Law for the Social Prevention of Violence and Crime. This manual also has as a plus that it has been issued and structured from the research project “Criminal mediation and restorative justice in

Mexico. Development of strategies for its right assessment and interpretation”, and it is presented as one of its main contributions, the project is endorsed and supported by the CONACyT through the Basic Science fund. The participating authors are certified mediators, conciliators, facilitators, MASC service providers, arbitrators, members of the academic community specialized in mediation, restorative justice and peace with great experience of the Judicial Branch, the Attorney General’s Office, the Doctorate and the Master’s Degree in Alternative Methods of Conflict Solution of the UANL, of the RED PRODED of Alternative Methods of Solution of Conflicts, of the Latin American AUIP Network of Alternative, Transitional and Restorative Justice and of academic institutions affiliated to National Association of Faculties and Schools of Law and of the Association of Faculties and Schools and Institutes of Law of Latin America.
