Racecourse Marina Lodge Park – Park Rules

The Park Rules ensure that we are able to provide a high standard of Estate Management which provides benefit to all who use the park. The rules form part of your Leasehold Agreement which is constructed under the defini ons contained within the Landlord & Tenants Act 1985. The Park Rules have not been compiled to place unnecessary restric ons on Leaseholders or other Park Users but rather to ensure that all occupiers may use the property peaceably in unspoiled surroundings.

1. Proper es are to be used as per the defini on of your Lease.

2. Proper es are not to be used for conduc ng business or any commercial enterprise, adver sing goods or services or to carry out trade or operate as an agency.

3. Proper es may not be used for sleeping more than the specific accommoda on it has been designed to accommodate* (pitching tents or sleeping in cars/motorhomes on the Park or Marina grounds is strictly prohibited).

4. You must display an Iden fica on number in such a posi on that it can be seen at all mes from the front of the property.

5. Property owners are responsible for the diness of their property surround extending to the border of the leased pitch.

6. If youwish to privately rent/let your property or are considering doing so now or in the future, you are required to gain wri en permission from us prior to doing so. Permission must be renewed annually. You are required to comply with the Fire Safety Order 2005 Legisla on. A copy of your property fire risk assessment must be provided to the office prior to permission being granted. It remains your responsibility to ensure the accommoda on you provide to your guests is fit for purpose and complies with all current legisla on.

7. In the interest of maintaining a safe and secure environment for you and your family, you should not allow anyone to use or visit your property who is a registered sex offender. Should you receive no fica on (as required under the Sexual Offences Act 2003, or if a proposed visitor is subject to a Risk of Sexual Harm Order or Child Abduc on No ce), you should inform us immediately.

8. Property owners are responsible for the conduct of all occupiers andvisitors of their property. It is the property owner’s responsibility to ensure all visitors/holiday guests are aware of the ‘Park Rules’ and adhere to them at all mes.

9. Traders, building contractors and salesmen are not permi ed access to the park without prior consent. It is the property owner’s responsibility to ensure any contractors are approved in wri ng by ‘Tingdene Marina’s Ltd’ prior to the commencement of any works being undertaken, should any person or contracted firm be found to be undertaking works whilst not approved they will be asked to leave the park immediately.

10. Any trade contractors that you appoint must report to the park/marina office prior to a ending your property.

11. Vehicle speeds must not exceed 5 mph at all mes.

12. Vehicles and contents are le en rely at the owner’s risk.

13. Vehicles on the Park and Marina Grounds must have a current road tax licence, be insurance and they must be in regular use. Vehicles may not be le or stored on the Park or Marina. Vehicles must only be driven by an individual who holds a valid Driving Licence.

14. Only private motor cars are permi ed onto the park; motorhomes, lorries, vans and commercial vehicles of any sort are allowed by prior arrangement only.

15. Motor car repairs may not be carried out on the Park or Marina grounds, but a recognised breakdown service may a end in the event of a breakdown.

16. Visitors’ cars and owners’ second cars may only be parked near proper es if space allows. The company will request that cars are relocated if their posi on is causing a blockage or inconvenience to other park users. In order to preserve the beauty of the park’s grounds, parking a vehicle on any of the grassed areas including the grassed verges is strictly forbidden. Do not obstruct roadways for ease of emergency vehicles if access is required.

17. Bicycles may not be ridden at more than 5 mph; children must not ride bicycles so as to cause a nuisance or undue noise.

18. In the interest of safety, roller skates, rollerblades, scooters and skateboards may not be used on the park roads.

19. Refuse must be disposed of in the bins provided - please help to keep the park free from li er.

20. It is not permi ed for any rubbish / bulky items to be disposed of and le on the roadside or grassed area, any persons found to be fly pping on the park will be re-charged accordingly.

21. Washing lines are not permi ed, to maintain the visual aspect of the park, clothes must not be hung on or over the decking glass par ons. Clothes may only be hung over a standard size clothes airier.

22. If your property has a spa pool or hot tub, it is your responsibility to maintain the unit to a safe opera onal standard. Guidance is widely available online or through the product manufacturer. The Bri sh and Irish Hot Tub Associa on (BISHTA) may provide informa on useful to you.

23. Children are the responsibility of their parents or guardian at all mes and must be supervised so that they are not a nuisance or danger to themselves, or others.

24. A maximum of two domes c pets may be kept in any property on the park and must be properly cared for.

25. Dogs must be kept on a lead at all mes. Dogs must not be le to roam free on the park or marina; appropriate ac on will be taken against known offenders.

26. In the interest of all park users, especially children, fouling must be cleaned up immediately.

27. Noisy dogs or those that persistently disturb other park users will be barred from the Park.

28. Dogs are not to be le una ended such that they cause inconvenience to other Park users.

29. Tingdene Marina’s Ltd has sole discre on as to the suitability of individual dogs allowed on the park and to the number of dogs to each property. Breeds listed under the Dangerous Dogs Act 1991 such as any known as a Pitbull type, Japanese Tosa, Fila Brasileiro, Dogo Argen no, and as of 1st February 2024, American Bully (XL Bully) are not permi ed on park at any me.

30. Please respect all property and the privacy of other property owners and please keep noise to a minimum. No loud music is permi ed a er 11pm.

31. Alcoholic drinks may only be consumed in and aroundthe immediatevicinity ofyour property. No drinking is permi ed in the communal areas of the park.

32. The Park is a non-smoking park; you are not permi ed to smoke unless in the perimeter of your property.

33. Tingdene Marina’s Ltd operate a zero tolerance towards the use of illegal drugs, you or your guests/holiday makers will be asked to leave the park with immediate effect should it be established that illegal substances have been used.

34. Ball games are not permi ed within the vicinity of any property or in an area which could cause nuisance or disturbance to other users of the Park or Marina.

35. Tingdene Marina’s Ltd operate a zero tolerance policy against verbal and / or physical abuse towards employees and other Park and Marina users.

36. All proper es must be fi ed with a smoke detector and an efficient 1.4 litre water mist ex nguisher or fire blanket and kept in such a posi on as to be readily available for use.

37. A copy of your insurance cer fica on, annual gas test cer ficate and an in date fixed electrical test cer ficate must be presented to the park’s office upon request.

38. DO NOT cover or block the air vents that are fi ed within the property; the free circula on of air is needed for the safe use of gas appliances.

39. No open fires may be lit onthe Park or Marina: fireworks and Chinese lanterns arenot allowed under any circumstances.

40. All garden furniture (when not in use) must be stored safely within the property boundary.

41. In the interest of safety, all property owners must be registered to receive flood alerts / warnings from the flood line as per the park’s flood evacua on procedure.

42. No persons are permi ed to li / tamper with the manhole covers or main drains. Should you experience an issue, this must be reported to the Park/Marina recep on immediately.

43. The marina is a working marina with boat hois ng, craning and boat towing occurring at all mes, please be aware of the danger of these ac vi es.

44. If you have a boat in our marina, or plan to have in the future, you will need to familiarise yourself with the marina rules which are separate to these.

45. You must not discharge any pollutants into the Marina basin at any me.

It may be necessary or desirable to update or change the Park Rules from me to me including for any reasons of Health and Safety, the efficient running of the park, environmental issues or regula ons
