County continues exclusive rights with Fisherman’s Wharf developer Bennett calls for revote to change his stance

n June 23, the Ventura County Board of Supervisors, after taking two votes on the agenda item, eventually voted to extend the Exclusive Right to Negotiate (ERN) for nine months between the county and developer Channel Islands Harbor Properties LLC. (CIHP) for three parcels at the Fisherman’s Wharf waterfront area near Channel Islands Harbor.

The first vote had the majority casting nos to terminate the ERN. But at the next agenda item, Steve Bennett (Dist-1) asked Board Chair Kelly Long (Dist-3) if the board might revisit the item. The board first voted on revisiting the item and allowing another vote, which was approved with only Linda Parks (Dist-2) voting against allowing a revote. Bennett joined Supervisors Long and Bob Huber (Dist-4) in voting to extend the ERN. Parks and Zaragoza (Dist-5) voted against the extension. The revote is being challenged by community members with Harbor and Beach Community Alliance (HBCA) asking the board to renotice the matter, as they view it as a violation of the Brown Act because the public understood the vote to have occured. HBCA’s legal counsel, Douglas Carstens of Chatten-Brown, Carstens and Minteer, has sent a letter asking as much and putting the county on notice that the group may be forced to resort to legal action if the board fails to remedy the violation. Bennett’s main focus was determining the impact of terminating the ERN on the county’s reputation with developers and whether not renewing the ERN would expose

the county to claims that it didn’t act in good faith. He ultimately changed his vote, saying he wanted to protect the county’s reputation as a “reliable partner,” resulting in the ERN being extended He did want assurance that an ERN does not require the county to approve a project. Ventura County Counsel Leroy Smith responded to Bennett, stating that while the county does not have an obligation to approve the project, it does have a “duty to act in good faith.” Meaning that if the project brought by CIHP met the requirements, the county could not deny CIHP and then give the same project to another developer. The ERN provides “some assurance” that the county will work with CIHP on the project if the developer comes up with a project that is jointly agreed upon. That preference is the “whole point” of the ERN, said Smith. Mark Sandoval, director of Channel Islands Harbor, told the supervisors that he would expect a master vision to be completed within the next six months, and that any developer could participate in that process. After the vision is complete, CIHP will have three months to determine if the vision is something for which it can develop a project. While the visioning process will look at the entire Fisherman’s Wharf area, the ERN applied to only three parcels. Sandoval emphasized that extending the ERN provides an incentive for CIHP to remain involved and that its input is needed in the visioning process; otherwise a project could be developed “that nobody wants to develop.” “I believe the visioning process is going to help us,” said Zaragoza. Community members with the HBCA spoke in opposition, saying that CIHP has had its opportunity to develop a plan, which many feel is too focused on housing, and that the community wants to see the area opened up to other developers. Sandoval described what seemed to be a “misperception of what the visioning is,” clarifying that it is an “all inclusive process” and that it really doesn’t have anything specifically to do with CIHP. He added that CIHP can bring its expertise to the process, but so can any other person or developer. “About five years ago I started asking for [the visioning process], Charrette is what we called it back then,” said Parks, during the initial board discussion for the first vote. She said there were meetings but felt that none of the input was ultimately reflected in the proposal from CIHP. “If you’ve got a

hammer, everything looks like a nail . . . this developer does housing,” and she felt the focus will always be on housing, even though the community wants a different focus. According to the CIHP website, the mixed-use project was modified following community input, cutting the number of residential units in half, adding a park and other public amenities.

“If you truly want other developers interested you don’t extend the ERN,” Parks said, pointing out that the current developer can still participate and apply. But she said that allowing the ERN to expire would be the best way to ensure a “really open visioning” process, without a particular developer being favored in any way. n April 8, 2020, a decision by the California Appellate Court clarified rules for municipal decision makers regarding bias and impartiality, and led to Ventura Mayor Matt LaVere’s recusal from two public hearings last month. On July 7 and July 15, LaVere was compelled to recuse himself on the advice of Ventura City Attorney Greg Diaz to ensure a fair and unbiased decision regarding the future of the St. Junipero Serra statue. In Brief Offroaders rescued in Lockwood Valley On July 30 at 11:24 p.m., the Lockwood Valley station of the Ventura County Sheriff’s Office responded to a call that motorists were stranded on a remote trail used by four-wheel drive vehicles and dirt bike riders to access Sunset Campground in the Los Padres National Forest. The Fillmore Search and Rescue Team (SAR) was activated to respond. The motorist’s vehicle became inoperable on the Miller Jeep Trail due to multiple flat tires. The trail requires considerable ground clearance and proper off-road tires. The passengers had to hike out of the area to find cell phone service to be able to call for help. The Lockwood Valley station mobilized their Polaris RZR utilitytask vehicle and the SAR team with a local deputy located the stranded motorists at about 3:30 a.m. Group files suit to return Serra statue On July 21, a group called the Coalition for Historical Integrity filed legal action in Ventura County Superior Court against the city of Ventura seeking to compel the city to return the St. Junipero Serra statue to its perch in front of city hall. The statue was removed last month following several public meetings and is in temporary storage while the San Buenaventura mission prepares to accept the statue. The first requested action by the coalition, a temporary restraining order to halt the statue’s removal, was denied by the court. Child care options with Conejo Rec. The Conejo Recreation and Park District (CRPD) is offering childcare options called QuaranTEAM Care for families with students enrolled in Conejo Valley Unified School District. Morning care hours are 7:30 a.m.-12:30 p.m. for students in afternoon distance learning programs, and for students with morning learning schedules the afternoon care hours are 1-6 p.m. Multiple day programs are offered. Monthly fees are $375 for the Monday through Friday option, $275 for the Monday/Wednesday/ Friday option, and $225 for the Tuesday/Thursday option. QuaranTEAM Care is open to students in kindergarten through fifth grade and will take place at the Borchard, Conejo, Dos Vientos and Thousand Oaks community centers operated by CRPD. The recreationfocused program includes arts and crafts, STEM projects, games and outdoor activities. Parents should note that this is not a distance learning or assignment-assistance program. Students will be placed in groups of eight to 12, which will remain the same during the four-week session. “All of us will be judged”

County grapples with housing the homeless by Kimberly Rivers during pandemic

A

s we continue to work though this historical moment, holes in the social safety are becoming both more obvious, and wider. How will the response of our local leaders and public agencies be judged from a future vantage point? Did we do all we could to help those who need it the most? Among those most in need are people without secure housing. The Ventura County Homeless Point in Time count for Jan. 29, 2020, identified 1,743 adults and children. Of those individuals, 34.5 percent (about 430 people) reported having chronic health conditions which could make them more vulnerable to serious illness or death from COVID-19. While the coronavirus pandemic has not created the homeless crisis, it has surely amplified it, compelling officials at the state and local levels to provide a remedy.

Project Roomkey

One remedy created by the state of California was Project Roomkey, focused on providing immediate housing to those within the homeless population that were most at risk of contracting and becoming ill from the coronavirus. Gov. Gavin Newsom set a high goal of housing 15,000 homeless people quickly, mostly at hotels and motels across the state. The Federal Emergency Management Agency (FEMA) authorized reimbursement funding, administered through state governments, to counties and cities for housing vulnerable individuals: those who test positive for the virus but do not require hospitalization, isolation or quarantine; individuals who have confirmed exposure to the virus; and people who are high risk but asymptomatic, such as those over 65 with underlying chronic illness. “No one stands taller than those leaders that bend down on one knee to help lift other people up,” said Newsom on April 18, 2020, during a live press conference introducing Project Roomkey’s implementation. “Consider the moment we’re in and the ethical question you’re being called and asked upon. Consider your station in life and in history. All of us will be judged. Homeless individuals are members of our community . . . and I hope we’ll consider their lot and their future as well.” “We had over 350 in Project Roomkey over a three-month period. We had 350 rooms for the high-risk population,” said Tara Carruth with the Ventura County CEO’s office who manages Homeless Grants, Emergency Solutions Grants (ESG) and Continuum of Care. The Vagabond hotel locations in Oxnard and Ventura, the Motel 6 in Newbury Park and the Best Western in Ventura were the hotels participating in Project Roomkey. 8—

“There were other rooms secured for medical sheltering of COVID and exposed patients (housed and unhoused persons).” Those housed in motels and hotels were identified through community service providers. “Many people left the project during various times, some for successful placements and others because they chose to leave or they were asked to leave because they violated safety rules during their stay,” Carruth explained. When operations ended on June 30, Carruth said that “over 160 people were successfully discharged . . . to temporary or permanent placements.” Those placements included permanent housing, connection with family, emergency shelters, sober living homes, skilled nursing facilities and board and care facilities. There were still 55 remaining in the program, however, due to their vulnerability, and Carruth said that Project Roomkey was faced with “a cohort of persons without a room . . . The motel sites were closing and we did not yet have a voucher program in place.” Project Roomkey got extended through July, but there were complications that prevented Ventura County from keeping the program fully operational. “Our leases with three motels ended in early July and the county had to clean and return the property in the condition we found it,” Carruth explained, adding that funding allocations also ended. A letter from FEMA to the state of California dated June 1 informed the state of the availability of funding extensions past June 30, which would “require submittal of current re-assessments from the public health official and up to date information.” (1) A second FEMA letter dated July 1 announced the extension of funding for emergency housing for those most vulnerable through July 30. Carruth says that the county only found “out that it was renewed on July 3 for the month of July.” In addition, “We could not extend Project Roomkey how it was originally established because the motels would not extend the leases with the county.” The hotels did not respond by press deadline to inquiries seeking confirmation about them not wanting to continue leasing to the county. Ventura County received other funding related to housing the homeless in response to COVID-19. A March 19 report from the California Homeless Coordinating and Financing Council stated that Ventura County received $299,245 and that Oxnard/ San Buenaventura/Ventura County Continuum of Care received another $325,257 in COVID-19 Emergency Homelessness

Funding Grant Allocations. That funding is based on the 2019 Point in Time counts. (2)

Motel voucher program

On July 28, the Ventura County Board of Supervisors approved $3 million in funding to be allocated for a motel voucher program to house 130 people through December 31, 2020. Staff reported that they expect most of that cost to be reimbursed by FEMA. “This includes the 55 that stayed over in motels,” said Carruth. “We have issued 67 vouchers as of right now. Those vouchers are in use. Vouchers can only be used at motels that have a signed agreement with the county.” Hotels participating in the county’s voucher program include the Vagabond Inns in Oxnard and Ventura and Thousand Oaks Premier Inn. Carruth said the county is “still working on securing a Simi Valley motel.” The goal is “to keep residents near their home community.” Carruth explained that “each client is case managed by their service provider who is providing connections to resources to meet their basic needs. Food Share is also providing food resources specifically for people without kitchens.” Services will continue to be provided by county agencies and nonprofit organizations during the voucher program’s duration. County CEO staff will administer the motel voucher program. Vouchers are being distributed through a referral process with countywide homeless service providers. The priority for these referrals are for persons who were served by Project Roomkey, met the high-risk criteria and did not have safe placement. The referring agencies are supporting these clients further by helping them meet basic needs (food, laundry, etc.) and assisting with permanent housing plans. The program does require participants to sign an agreement with rules and expectations, including working with service providers to develop longer-term housing plans. FEMA funding rules restrict monies from being used for some behavioral health services like case management and counseling, but they can be used for certain “wraparound services” that are necessary for operating sites to house individuals. Administrative costs are specifically called out as not covered. In addition, all programs using COVID-19 emergency funding through the state must comply with Housing First policies aimed at reducing barriers to housing the homeless such as treatment preconditions for substance use or behavioral contingencies. Emergency housing should not be “contingent of participation” in services.

Project Homekey

On July 28, the Ventura County Board of Supervisors approved Mercy House as the designated developer to implement Project Homekey, if the county is approved to do so by the state. This project, a continuation of Project Roomkey, aims to convert existing structures like motels into permanent housing for those highly vulnerable in the homeless community. $600 million in funding will be administered by the California Department of Housing and Community Development. Counties, cities and other local entities like housing authorities can apply for funds to purchase and rehabilitate housing, including motels, vacant apartment buildings and other facilities to convert or renovate them into permanent long-term housing. Most of that funding is from the state’s allocations of federal Coronavirus Aid Relief Funds (CRF), with $50 million coming from the state’s own general fund. CRF funds must be spent by Dec. 30, 2020 and escrow on any property acquired in the program must close by Dec. 30 as well. Funding received through the State General Fund must be spent by June 30, 2022. (3) “The state’s NOFA [Notice of Funding Availability] for Homekey requires some local match funding and other hurdles we have to overcome to be competitive for these resources,” Carruth noted. Supervisors approved a county commitment of up to $504,000 each year for three years, with money coming from the Permanent Local Housing Allocation for Capital Development of Rental Housing to the proposed Motel Conversion Project for the Homekey program. A

new source of entertainment is springing up to fill the void left by the closing of stages, movie theaters and concert venues. And like much of the content we’re consuming right now, it’s coming at us from the small screen. NAMBA TV is the latest endeavor from the NAMBA Performing Arts Space in Downtown Ventura. The intimate venue was known prior to the pandemic for an eclectic mix of live music — with everything from folk to hip-hop to jazz to international talent, such as “Bollywood blues” artist Aki Kumar — as well as dance, performance art and theatrical productions. NAMBA is flipping the script by offering similar programming streamed live (and available for viewing afterward) on its YouTube channel. “It’s been essential, in the four-plus months since March, to rethink Olivia Willhite not so much the mission of NAMBA, which remains the same, but the ways in which we convey that mission to the public,” explains Lorenzo DeStefano, executive director. “NAMBA TV arose from that need to refresh the five-year-old NAMBA brand and expand it both locally and as a borderless provider of quality arts content.”

COVID-19 hit not long after DeStefano took the helm of NAMBA, replacing Jeffrey Willerth in January 2020. He is well primed to spearhead this new television project. A seasoned filmmaker (best known locally, perhaps, for his Rachel Flowers documentary Hearing is Believing) and founder of the Ventura Film Society, he’s no stranger behind the camera. 10 —

“NAMBA TV is an original curated idea of mine to combine my skills as a filmmaker wth the existing parameters of my job as executive director,” DeStefano explains. Starting in mid-April and working with Gavin Ames and Eric Crispin, who assisted with light and sound, he was able to film 16 segments. “Within a very concentrated time, we pulled off roughly eight months of programming,” he confirms. “I solicited some people who’ve performed at NAMBA before as well as a number of artists, both local and from Los Angeles, who are new to NAMBA. my experiences being a blues fan and amplifying my depth of knowledge.” It’s a show Ventura has wanted to do for years, and he’s grateful that NAMBA TV has given him a platform to do it — and that NAMBA Performing Arts Space, as an organization, has had such a light hand in its creation. “If a local person has a vision for a show, NAMBA will support them,” Ventura says. “I’ve had an enormous amount of freedom to develop this show.” “Delta by the Beach” is more than just a concert — although performances by Ventura, Sledge and Layman will be an integral part of it. The trio will play well-known blues pieces as well as “more obscure stuff,” sharing some history and knowledge about the works. In addition, Ventura’s own videos of blues artists and photos taken during his Mississippi sojourns will help give a sense of “the current state of the music scene.” The audio/visual production will kick off with a film. The 2012 documentary True Delta by Lee Quinby and Daniel Cowen, which highlights the way the blues tradition is passed down from one generation to the next, will “tell you who the characters are today . . . what the ambience is like.” Ventura thinks of this as a demonstration that “the blues will never die. The generations really nurture each other.” If you are a lover of the blues, you won’t want to miss “Delta by the Beach.” But there’s plenty to enjoy here — music, imagery, cinema, history — for the casual viewer or even (perhaps especially) the complete novice. If there’s one thing that Ventura hopes to do with his show, it’s prove to others just how vibrant, pleasurable and accessible the blues truly are. “I’m trying to give people a place to get on board,” Ventura explains. “And a way to learn more deeply.”

director Issa a tight little drama set in the heart of an anonymous metropolis. It’s both a fable and a metaphor for the violent darkness that has arisen from the gang violence and drug cartels that have beset Northern Mexico in the last 20 years. But López has broadened this tale with a touch of magical realism and a thought-provoking essay on bloody human madness. López has done the unthinkable: left children unprotected, ripped by cynicism and riddled with mistrust for any hope of justice in the world. In short, she questions faith in adult humanity and leaves the children to suffer for it. The four orphan boys — Shine (Juan Ramón López), Morro (Nery Arredondo), Tucsi (Hanssel Casillas) and Pop (Rodrigo Cortes) — have become brothers foraging

for food and protecting each other against street violence. Shine steals a phone and a gun from one of the local “Huascas” gang members, Caco (Ianis Guerrero), while Caco drunkenly urinates outside a local bar. The phone carries video of a murder. When local gang leader and politician El Chino (Tenoch Huerta) aka Servando Esparza discovers the orphans have stolen the phone, he launches an all-out assault to retrieve it. Estrella (Paola Lara) attends a local school. When a gang shooting occurs outside her classroom, the children duck under their desks. A staff member, fearing she will die, hands Estrella three pieces of chalk and tells her that she has been granted three wishes. When Estrella goes home, she discovers that her mother is missing and her house is haunted. After Estrella catches Shine stealing from her house, she follows him back and, despite the boys’ protests, joins them on the streets. It turns out that Shine and Estrella have this in common: They both tell stories about tigers, monsters and princes. López turns these stories into a film. What draws one into this film

is the realism of the emotions that the children experience. They’re not child actors. They are children asked to provide real emotions: fear, anger, loss, grief and, most of all, faith. There is no script here. López is encouraging them to find their real soul. They’re also not immune from the evils of the city, which raises the question: When children lose faith, are adults to blame? When Shine states plainly that there are no such thing as “wishes,” is he right? Short in time, Tigers packs a lot into its 84 minutes’ worth of frames. Scary? Not in the true horror sense, but the horror of this film is in the death and destruction of its human combatants. The ghosts in this story seek justice. By the end, when they’re finally revealed, the true horror of our world is magnified. There’s no happy ending here. But you won’t walk away untouched either. All of which leads back to Shine’s dilemma: Do you believe in wishes? That, as it turns out, is an excellent question. t never ceases to amaze me when a gem of a restaurant can be found in the most unlikely of places — in this instance, an industrial park off of Rose Avenue in Oxnard. Pacific Cafe (named for the street on which it resides) is easy to miss. It’s buried amidst a maze of identical industrial parks, far from the madding crowd and not likely to be stumbled upon by the casual diner. Perhaps that’s the secret to its success: The breakfast and lunch spot probably sees plenty of traffic from all those office and warehouse employees who don’t have a lot of options in close proximity. (Fun fact: It’s next door to the administrative offices of the California Strawberry Festival, and across the street from the Mullin Automotive Museum.)

I appreciated the al pastor, with marinated and grilled pork, bits of diced pineapple, a rich red color and slightly crispy texture. But I found the flavor lacking; it really Patio Dining needed more seasoning and heat. Not bad…but not Take Out the best. Ditto with the rice that came on the side — although I was pleased that the side salad was more than Delivery just some shredded iceberg. Well, they’re in luck: Pacific Cafe offers a decentsized menu and, more importantly, serves up some pretty great grub. Arriving on a weekend afternoon, it was quiet and sparsely populated, with just a few groups seated on the parking lot-turned-dining-patio. We walked inside to receive menus and place our order at the counter before finding a seat outside. The menu is made up of breakfast and lunch basics: omelets and other egg dishes, breakfast burritos, waffles and pancakes, burgers, sandwiches and salads. Mexican specialties include tacos, chilaquiles and huevos rancheros. With two orders of tacos (al pastor and grilled fish) and two sandwiches (barbecue chicken and California burger) I feel like we got a decent sampling of the lunch options. For dessert (and because I was delighted to see them on the menu): an order of strawberry crepes.

I’d order that again in a heartbeat (and take those super crispy onion rings over fries any day). Our dessert crepes were equally good: thin, tender pancakes wrapped around heaps of fresh sliced strawberries and topped with cream. So sweet, so simple, so delicious. A fitting end to a tasty and indulgent lunch. Once strawberry season is over, I’ll have to try the tres leches crepes for comparison. Pacific Cafe doesn’t deliver to my area, and it’s far enough from the beaten path that I’m not likely to have occasion to revisit. But that wonderful chicken sandwich, those melt-in-your-mouth crepes and the chilaquiles (highly recommended by staff, although I did not order them) do call to me. Next time I’m up for a drive, I might head out to Oxnard and find my way to Pacific Cafe. Just because I work from home doesn’t mean I can’t join in the fun. August 6, 2020 —

Uncontrolled anger can get us in trouble (sometimes for 20 years to life). However, anger, like the rest of our emotions, is actually functional. Over millions of years, our emotions evolved to be the factory foremen of human behavior, motivating us to behave in ways that solved problems humans dealt with on a recurring basis, such as finding a mate, avoiding a beat down, and getting a friend to be more give-and-take than take, take, take. Evolutionary psychologist Aaron Sell, who researches anger, explains that it is one of a few emotions that serves to regulate not just our behavior but also that of others (as do shame and sadness). When we express sadness, for example, like by sobbing, it evokes empathy in others, which makes them want to reach out and

give us a hug and maybe even let us use their shoulder as a substitute for snotty Kleenex. Sell calls anger a “recalibrational emotion” and explains that it functions as a bargaining tool for us to negotiate for better treatment. When we notice that another person doesn’t place enough value on our “welfare” (meaning our interests, our well-being), anger rises up in us, motivating us to take action to get the other person to correct — that is, recalibrate — the imbalance, to treat us better.

In other words, in anger, you’ve got a fantastic tool to protect you from being taken advantage of...that is, if you use it instead of trying to suppress it. Because anger is triggered automatically, stifling it won’t make it go away; it’ll make it go away and get bigger and uglier. It’s likely to leak out at inappropriate times (like in sniping hostility when you speak), and there can be an eventual out-of-proportion explosion, often at some seriously minor perceived “slight,” like the person you’re angry with not passing a condiment quite zippily enough. Healthy assertiveness, on the other hand, requires the expression of what I’d call “timely, judicious honesty.” “Timely” means expressing that you have unmet needs relatively quickly — as soon as you can after you realize there’s an issue. Being “judicious” means taking an emotionally strategic approach: framing the discussion with how you feel rather than how someone’s wronged you. In practice, this means evoking the other person’s empathy (saying, “I feel bad when...”) rather than

The third step, “honesty,” is expressing, “Here’s what I need...” and seeing whether the other person says they’re up for providing it. Then, of course, there’s seeing whether they actually will (perhaps with a reminder or two from you if they automatically fall back into their old ways). If you accept responsibility for being delinquent in expressing what you want from your friend, it should help you cool off enough to do that now in a civil way. If it turns out she isn’t genuinely interested in your welfare — that is, in being a real friend to you with all the give-and-take that involves — you can downgrade her accordingly (like from friend to “someone I know”).
