NEWS “11 years too long” Ixta released, charges dismissed

n the late afternoon of Tuesday, April 13, Ignacio Ixta Junior was finally released from Ventura County Jail after 11 years in prison for a crime he always said he didn’t do.

His family was waiting just outside the jail.

Ixta’s release came a day after a hearing that took place on Monday, April 12, lasting less than 10 minutes, in which Hon. David Hirsch threw out a 2010 attempted murder conviction and ordered Ixta to be freed. His release was delayed, however, by a second hearing that was set for Tuesday afternoon to complete some paperwork related to a separate case from 2009 involving time Ixta served on probation.

Just prior to Monday’s hearing, a group of about 35 people gathered in support of Ixta’s release. The crowd would grow to about 100 people by the time the hearing was over.

Courtroom 26 at Ventura County Superior Court was quiet as Ixta’s parents, Ignacio Ixta Senior and Alma Ixta, investigator Natalie Cherot and a few members of the press waited for the hearing to begin. It was already starting about 15 minutes late.

A tall figure came through the door on the far side of the courtroom: Philip Dunn, Ixta’s criminal defense attorney, accompanied by appeal attorney Andy Wolf.

As Dunn approached Ixta’s parents, he leaned down and said, “This is over.” There

was an exhale. He explained that he had been in chambers with Erik Nasarenko, Ventura County District Attorney (VCDA), who told him the office would not seek a retrial and that Ixta would be released.

The VCDA confirmed the week before that the office agreed Ixta’s conviction should be reversed, but had not yet responded to Ixta’s request that the entire case be dismissed in light of the evidence uncovered by the probono team (“Reversal of Conviction”, Kimberly Rivers, VC Reporter, April 8, 2021).

Ixta was attending the hearing via Zoom, and his image was projected onto a wall in front of the judge. Prior to the judge entering the courtroom, Dunn asked if he could speak with Ixta.

He explained to Ixta that normally he’d be able to meet privately with him before the hearing, but that due to the pandemic that was not taking place. He said that after the hearing, he’d have a private conversation with him.

Hirsch entered the courtroom. Ixta could only see the judge, but he could hear all the attorneys when they spoke.

The first item discussed on the record was Hirsch confirming the victim in the matter had been informed of the pending conviction reversal and potential for Ixta to be released.

Taylor Waters, senior deputy with the VCDA, confirmed the victim had been notified.

Hirsch then granted the relief sought by the writ of habeas corpus submitted on behalf of Ixta in March 2020, resulting in a reversal of the 2010 judgement against him and then to set aside the conviction. A writ of this type is a recourse granted to all prisoners by the United States Constitution to demand a hearing in court to review whether the person is being wrongfully imprisoned.

Waters read from a statement that confirmed the office supported the granting of the writ because information held at the time of the trial by law enforcement was not provided to the defense. Waters confirmed that evidence “should’’ have been provided to the defense and that their “review of the matter confirmed

that the search warrants undermined the credibility of the lead prosecuting witness.”

Next, Hirsch directed a question to “the people - how do you want to proceed on the underlying matter?”

Waters said the office had “carefully reviewed and evaluated all the available evidence in our possession,” which included “both the trial evidence as well as new evidence,” and that “given the state of the available evidence, the passage of time, the people are unable to prove the charges beyond a reasonable doubt at retrial and therefore [are asking] the court to dismiss pursuant to penal code section 1385.”

“I take it there is no objection,” confirmed Hirsch. Hearing none, he said, “That motion will be granted.”

At that moment the judgment was vacated and all charges against Ixta were dismissed.

He would not be retried. “The defendant is ordered to be released by the court.” His mother sobbed.

Waters told the judge the VCDA would work to ensure “Mr. Ixta be released from custody forthwith.” Alma and Ignacio Senior hugged, and then Alma embraced Cherot.

“Hiccup” causes delay in release

All signs indicated that Ixta Junior would be released on Monday. He was in Ventura County Jail, having been transferred from Pelican Bay State Prison in Northern California prior to the hearing. But almost right away there appeared to be a problem. The paperwork was not going as smoothly as hoped.

Churches help prevent evictions

rent relief program is being administered by churches and an application event is coming to Connect Church in Ventura on April 22.

CityServe is a Bakersfield-based organization that works with local churches across the state to have a positive impact directly on their communities. With the great need for rental assistance as a result of job loss related to the pandemic, the organization started the Eviction Prevention Starting Point program aimed at helping landlords and renters get rental assistance through the state and federal COVID-19 Rent Relief program.

and subsequent release.

Following the April 12 hearing, Dunn, Wolf and the Ixtas were in communication with staff at the Ventura County Jail building next to the courthouse over the next several hours pressing for the “immediate” release the court had ordered.

Ixta Junior’s son, Andrew, now 14, said he felt “amazing” knowing that his father was being released and that he’d “give him a really big hug” when he sees him.

Dunn spoke to the crowd and encouraged the public to “care enough for another human being” to help prevent this type of injustice from taking place, and to “love your neighbor.” He made a point of applauding Nasarenko’s role in bringing the reversal about, saying he is a DA who “truly cares about justice.”

At about 5:40 p.m. Commander Rob Davidson with the Ventura County Sheriff’s Office came out to speak with the Ixtas and Dunn.

He told them there was a “hiccup” at the “state” but that their office would do all they could to help the family. Ixta would end up spending Monday night in custody, although his family was taken in for a visit.

“It was 11 years too long,” said Alma as she waited for news about her son’s release.

Reflecting on the path the case took, she added that “it was a team effort,” but that Wolf’s role was key. “He practically sold himself to us, he wanted to help us.”

Wolf helped the family for several years, preparing appeals and the habeas corpus packets submitted — all free of charge. When deciding whether to hire an attorney or work with Wolf, she told her son, “You need an attorney that believes in your innocence. That is what Andy did.”

CityServe working with Connect Church to get relief to renters and landlords

point so they get on the path to stay in their homes,” said Karl Hargestam, executive director of CityServe Network.

The program provides up to 80% of past due rent from April 1, 2020 to March 31, 2021 to landlords. In order to receive that amount, landlords must agree to waive the remaining 20% of rent owed.

The program can also help renters benefit from the protections in newly passed Senate Bill 91, that extends eviction protections to renters who can pay 25% of past due rent by June 30, 2021.

Eligible renters whose landlords choose not to participate in the program may still apply on their own. Those eligible can receive 25% of unpaid rent accrued between April 1, 2020, and March 31, 2021, through a direct payment to their landlord. If a landlord

refuses the direct payment, 25% can be paid to the renter to help them pay the missed rent to their landlord by June 30, 2021.

Eligible renters can also receive help paying future rent, equal to 25% of their monthly amount, to help them stay in their homes, and 100% of up to 12 months of unpaid or future utility bills.

Ventura County Compost Cup competition April 16-19

by David Goldstein Compost happens” is the environmental twist on a more famous, but less positive aphorism about life. Actually, compost does not happen when we put yard clippings and food waste in a landfill. Modern landfills minimize biodegradation to cut emissions of methane, which is created when materials rot without sufficient oxygen; methane is over 20 times more powerful than carbon dioxide as a climate changing gas, according to a 1996 assessment by the United Nations Intergovernmental Panel on Climate Change. Even when waste in a landfill does biodegrade, it does not produce useful compost.

On the other hand, given the right amounts of moisture, air, decomposing organisms and a mixture of carbon and nitrogen, compost not only happens, but quality compost is the result.

Compost recirculates nutrients into the soil, replenishing topsoil, rather than entombing these resources in a landfill. High quality compost also increases plant yields, improves soil aeration, retains soil moisture, prevents erosion and can suppress plant diseases, according to the website of the U.S. Composting Council, a national nonprofit group advocating for increased composting.

Locally, a new group of compost advocates, the Ventura County Compost Network, was recently launched to “help current composters, provide education for those interested in starting [composting] . . . and highlight high quality locally made compost and mulch products,” according to Dr. David White, executive director of the Ojai-based Center for Regenerative Agriculture.

The Compost Network is coordinating the “Ventura County Compost Cup” competition. To participate, drop off compost samples for judging between Friday, April 16, and Monday, April 19, at noon. Entry collection boxes will be at the Ojai City Hall Demonstration Garden; Peach Hill Soils in Moorpark and Somis; Agromin’s office in Oxnard; and Green Thumb Nursery in Ventura. The competition features seven entry categories: commercial facility; agricultural compost; community gardens and schools; residential; vermicompost; anaerobic and fermentation; and open competition, allowing entries from outside Ventura County. Judging of compost will be based on color, smell, crumb structure/tilth, biological richness and use of available materials.

Dr. Ben Faber, Ventura County Farm Advisor with the University of California Cooperative Extension, evaluates compost through analysis of nutrient values. As Faber noted, however, people familiar with compost can often detect good compost through smell, “There is nothing better than good smelling compost!”

Soil scientist Leighton Morrison, a nationally recognized innovator in compost analysis and using microbial extracts to enhance a wide range of soils, is sponsoring two days of microscopy for submitted samples. Morrison’s company, Kingdom Aquaponics, will examine entries at 100x to 800x magnification for biological judging. Finalists’ samples will be evaluated beyond the common range of bacteria, Morrison explained. “We will be noting levels of advanced microbes for indicators of biological richness, such as protozoa, fungi and nematodes.”

Due to the seriousness of environmental problems related to landfilling rotting waste, and the benefits of turning organics into compost, in 2016 the California Legislature passed Senate Bill 1383, mandating a 75 percent reduction in landfill organic waste by 2025.

Local cities and the county are now trying to develop infrastructure, including changes to ordinances to require businesses and residences to recycle food scraps and yard trimmings.

The vast majority of organic waste will be composted at commercial facilities, but composting at the site of generation can save money and reduce transport-related pollution. The new mandates will likely produce much more compost locally, so Compost Cup sponsors are hoping the promotion will encourage local homeowners and professional gardeners to buy the compost produced.

Ventura County Compost Cup organizer and self-described “compost evangelist” Eric Werbalowsky noted, “The cup aims to recognize excellence in the [composting] craft and increase public understanding of compost quality and value.”

In an email response, White noted, “By composting at home and using compost to bring health and vitality to our gardens, we are using a nature-based climate solution to draw down atmospheric carbon and increase the health of our soils and plants.”

In Brief Naya Rivera’s estate seeks damages Ryan Dorsey, ex-husband of Glee actress Naya Rivera, who drowned in Lake Piru in July 2020, and her estate have filed a wrongful death suit in Ventura County Superior Court on behalf of Dorsey and Rivera’s young son. The suit was filed through personal representative Justin Stiegemeyer, and claims that Rivera was not warned about the hazards of the lake and was not given proper safety equipment.

The suit names the county, United Water Conservation District (UWCD) and Parks and Recreation Management (PRM) as defendants.

Jeffrey E. Barnes with Ventura County Counsel told the Ventura County Reporter that the county has “nothing to do with the lake” and that he is working to have the county removed from the suit altogether.

In a motion filed by PRM, which is scheduled to be heard by the court on April 27, the company states that the suit “fails to state facts sufficient to constitute a cause of action.” PRM’s motion states that in fact a floatation device was offered to Rivera, she declined to wear it, but it was put on the boat she rented, and was found on the boat with her son on the day she drowned.

PRM is a private entity that manages the lake and concessions, including the boat rentals.

UWCD owns and operates the Santa Felicia Dam that creates Lake Piru.

Dr. Cesar Morales appointed Ventura County Superintendent of Schools

Dr. Cesar Morales Last month the Ventura County Board of Education (VCOE) voted unanimously to appoint Dr. Cesar Morales as superintendent of schools, the position vacated when Stan Mantooth retired in February.

Morales had been serving as deputy superintendent of VCOE and was appointed to the new position after a nationwide search.

The superintendent position is an elected role and Morales will complete Mantooth’s term through 2022. Morales has indicated he plans to run for the position in the June 2022 election.

His new position took effect on April 1, and he will be officially sworn in on April 16.

VCOE employs nearly 1,000 people and provides teacher training and administrative support services to all of the county’s 20 school districts.

The agency also operates schools for students with special needs and provides career education for students countywide.

Morales received his Doctor of Education degree from UCLA and his master’s and bachelor’s degrees from Loyola Marymount University. He is also a past president of the California Association of Latino Superintendents and Administrators. Morales is a recent recipient of the El Concilio Latino Leadership Award and was named a “Leader to Learn From” by Education Week magazine in 2017.

Oxnard resolution condemns racism On March 30, the Oxnard City Council unanimously passed a resolution condemning racism, xenophobia, violence and hate crimes against Asian Americans and Pacific Islanders (AAPI). The resolution states, “the city supports inclusion and belonging for people of all races, genders, national origins, and ethnicities; ...and that the City should condemn and combat racism, xenophobia, violence, and hate crimes against AAPI persons and ensure that all persons are treated with dignity, equity, and respect - no matter their race, ethnicity, primary language, country of origin, religious beliefs, gender or background.”

Power Share program, discounted renewable energy The Clean Power Alliance, which is now providing renewable energy to many residents and businesses across Ventura County, has launched a new program offering 100% clean energy with a 20% discount to customers in disadvantaged communities. The discount is for up to 20 years. The program is available to the first 6,500 customers who sign up and will be administered on a first come, first served basis.

“Always remember where you come from”

n our first piece in a new series called VC Voices, we talk with Celina Zacarias of Oxnard. She emigrated to the United States when she was 3 years old and her parents came to the country as farmworkers in the Bracero Program. She grew up helping her mother pick strawberries on weekends and during vacations from school.

Today Zacarias serves as a Commissioner for the Port of Hueneme and is the senior director of community and government relations at California State University, Channel Islands, where she advocates for additional funding and support for the university.

Here she shares her views about growing up in the La Colonia neighborhood in Oxnard, how things have changed or stayed the same, and offers some advice to young Oxnard residents.

VC Reporter: Where in Ventura County do you currently live? And how do you “selfidentify”?

I live in Oxnard. [I identify as] Mexican – I was born in Michoacán, Mexico. My father and grandfather were part of the Bracero Program and my father brought us to the U.S. when I was 3 years old.

What is a lasting memory that you have of growing up and living in the La Colonia neighborhood?

The people… we were truly a community of friends, parents, brothers, sisters, everyone took care of each other. It was very common to have my mom send the neighbor some homemade flour tortillas and vice versa, there was a lot of exchanging of food.

What is something people might find surprising about that neighborhood or your experience growing up there?

We all knew each other and the neighborhood was very safe. Many of us from the neighborhood still keep in touch with each other.

What remains the same?

formed my life; this made me want to excel even more in my job as director of community and government relations whose primary focus is advocate for funding for higher education.

The diversity of people in the city, which I love.

Do you have any hopes for the area and residents looking into the future?

As a harbor commissioner, how do you view your role?

What is a pressing task/ project the commission is dealing with right now or in the near future?

I would love to see the residents of Oxnard and the surrounding areas take advantage of the opportunity to pursue their education, with CSU [California State University] Channel Islands here in the county, this is very much more within reach.

Being very involved throughout the county, state and nation, I think I bring a very unique perspective to the commission beyond the boundaries of the cities of Port Hueneme and Oxnard. We are about to embark on our Port 2030 Strategic Plan workshops; stay tuned.

What are some things that you think have improved for immigrants? What is something that still needs attention or improvement? What do you think is different today for those immigrating from Mexico?

In thinking about the local economy, what do you think is needed in our area for economic improvement? And what are the biggest challenges?

Some worker’s rights have improved. More worker’s rights and fair compensation is needed. The cost of living has increased dramatically.

Good paying jobs are needed. At this time, the impacts of COVID on businesses, families and homelessness are the biggest challenges.

You gave a talk titled “The Bracero Program, and its impact on my life.” What is a major impact you carry from being a child of the Bracero program?

Growing up in a farmworker famCelina Zacarias. ily, it teaches you a very strong work ethic. My parents were amazing, how they raised a family of five kids and two adults (total of seven) and saved money to buy a home is beyond me. I did not know we were poor until I completed the financial aid forms to go to University of California, Santa Barbara and they said we were not only low income, we were very low income. Who knew we were poor?

We always had a place to sleep, food on the table and clothes on our back. Mom and Dad never had any debt aside from the mortgage payment. Via this example, I learned the importance of living within your means.

You made a career shift from the banking/ finance world to higher education. What is a major difference in the practices/ethos of those sectors?

I have been very fortunate to have truly enjoyed two amazing careers doing completely different things.

Banking/finance taught me how Corporate America worked and higher education has given me the opportunity to learn how the public sector works. Not having a finance background, I had to teach myself banking/ finance and when I got to higher education, I had to learn and adjust to a whole new work environment and set of practices.

Having come from the private sector...I was under the assumption that because I personally valued public education so did everyone else, because this is our future workforce. I assumed that our state legislators also felt that same and were properly providing the

CSU and UC the funds needed. I had a shock of reality when I took my first Budget Advocacy trip to Sacramento and realized that I was having to convince some of our representatives the importance of properly funding the CSU. The CSU’s operating budget has two main funding sources: the state General Fund and student tuition and fees and in order to keep higher education affordable, we are constantly advocating for General Fund dollars, we do not have the guaranteed funding stream that is available to K-14.

What did you learn or carry from the banking world that serves you and your work today?

Because my job as senior director of community and government relations requires me to engage a lot with the external business community, my understanding and knowledge of how businesses operate and the sense of urgency learned from my years on banking/ finance has helped me tremendously in my role at CSU Channel Islands.

Has anything surprised or really challenged you in the world of higher education?

The number one surprise I encountered in higher education is when I learned how the CSU is funded, or not. Knowing how education is funded has trans-

You travelled a lot as a student. How did those experiences influence your education and your life and work over your career and today?

Traveling opened the world to me in so many different ways: the culture, the people, the ways of life, the politics. It made me appreciate in so many ways things that we take for granted here in this country.

Who are your heroes?

My parents . . . were and although they have passed away, they are and will always continue to be my heroes.

What inspires you?

The joy on the faces of the parents, especially farmworkers, on commencement day!

Today, what is your advice/guidance for first generation college students, particularly Mexican immigrants?

Get an education. Keep and polish your bilingualism, always remember where you come from because only then will you know where you’re going. Surround yourself with people of different backgrounds and mindsets, that is where you will experience the most growth.

Any advice specifically for young women in high school or starting college?

Don’t doubt yourself. I know it may seem impossible, but trust me, it’s not.

hat better way to celebrate Earth Day than with an outdoor community art event that invites us to reconnect with the Earth and each other?

6 Feet of Connection: Back to our Roots, opening on April 22 at the Ojai Retreat, was conceived by contemporary artist, curator and Flourish Ojai fellow Marisa Caichiolo, who describes the event as an “open space for local artists and our Ojai Valley community to honor the Earth through the power of artistic expressions.” Caichiolo, who founded Building Bridges Art Exchange (BBAX) in Santa Monica, explains that the project is an opportunity to “celebrate our majestic environment through land art creations that inspire us to imagine our future together.” In addition to Caichiolo, participating artists include Brian Berman, Carol Shaw-Sutton, Greta Lovina and Pamela Grau.

As Caichiolo explains, the project is a “local initiative with a global vision.” She adds that “the pandemic is giving us a pause. For a brief moment in history, humanity has no choice but to reflect on its vulnerability. Through art, we have the power to reach each other, to communicate, and to establish a deeper understanding and emotional connection with our planet.”

Whether fashioned from rocks, leaves, roots or other natural elements, the essence of each work of art is to leave no trash in its wake. As a result, the installation embodies a universal call to action. As Caichiolo explains, “In order to survive, we must mobilize our community to work together in bringing back balance between humanity and the natural order of things.”

Family man Ziggy Marley on music, his famous father’s legacy and projects inspired by his children

iggy Marley, due to touring, does not get to spend a lot of time with his children, but the COVID-19 pandemic changed all of that.

The relationship has inspired him to release a handful of children’s projects — a clothing line in collaboration with Appaman, which launched April 12; a 2020 album, More Family Time; and a book, My Dog Romeo, set for release in July.

“One of the things COVID brought to light to me was how little time we spend with our kids,” Marley said. “They’re in school and I spend most of my time away. I’m getting to know my kids better.

“They taught me that, even if things go back to normal, I’m going to spend more time with them.”

To keep their sanity during the pandemic, Marley and his family exercised, developed a camp idea, climbed trees and gardened around the house.

“As his son, it’s very intimate”

Marley will spend time with Ventura fans during two shows on Saturday, April 17, at the Ventura County Fairgrounds for the Concerts in Your Car series. These will be only the second set of shows he’s played since the pandemic began. It’s not going to bother him that it’s a drive-in show.

I’m dating an awesome woman I see a future with. However, there’s a hurdle: She doesn’t want to have sex until we’re committed, but I don’t feel right about committing without knowing we have sexual chemistry. A previous relationship ended because the sex was subpar, and I don’t want to go through that again.

These differences drive men’s and women’s conflicting “sexual strategies,” explains evolutionary psychologist David Buss. For men, a casual sex-centric “short-term sexual strategy” — hit and run...sex and shun — has the most “reproductive benefits,” increasing men’s chances of passing on their genes. Women benefit most from a commitment-centric “long-term sexual strategy” and look for signs a man is emotionally attached, making him more likely to stick around and provide for any, um, sex biscuits they might create.

Where there are deep-seated desires, there’s often deception. Buss calls this “strategic interference,” describing sneaky tactics used to get the opposite sex to go against their evolutionary best interest. Men, for example, feign commitment to get sex, while women feign sexual interest to get commitment — either long-term or enough to enjoy an evening of free fine dining. However, we have a defense against this:

“negative” emotions — like a woman’s fear of getting humptied and dumptied and a man’s fear that all a woman really wants to “ride like a pony” is his American Express black card.

As for what you should do, Buss’ research might be helpful. Buss finds that men will shift to a “long-term sexual strategy” when that’s what it takes to land a woman of especially high “mate value.” If she doesn’t seem worth the risk of waiting for, it’s probably breakup o’clock. No, sex isn’t everything in a relationship. However, if you like to have sex twice a day and your partner’s up for twice every never, it’s a little hard to meet in the middle — though the less libidinous partner might come up with some, uh, helpful ideas, such as: “Do we really have to have sex when I’m conscious?”

As evolutionary psychologist Steve Stewart-Williams points out, it’s like “a giant billboard”: a huge electric blue and green yoohoo! to peacock-eating predators. Chances are your boyfriend is rude-vertising to the guys: Sure, he has love in his life, but he hasn’t gone all bought, sold, and girlfriend-controlled. The costly signal in this? He’s so secure in his sexual magnetism (like, the hot chicks are lined up and begging) that he can afford to act like a turd to his girlfriend.

Um, no. Or at least, that’s what you need to put out there. In words, not hints. Tell him it’s humiliating when he comments on other women when you’re right there, plus the farting thing is a sexual turnoff. In short, he’s transforming you into an unhappy girlfriend who won’t want to have sex. They bring refreshing rain, and keep the earth in electrical balance. Lightning from storms creates ozone, a vital part of our atmosphere, and it converts nitrogen in the air into nitrogen in the ground, making the soil more fertile.
