n Dec. 6, the Ventura City Council will decide whether or not to change how development projects weave their way through planning committee hearings and appeals searching for a clear path to approval.

Developers say the process is onerous and discourages economic investment in the city, while some members of the public say the proposed changes strip away public involvement and transparency, pointing to election campaign contributions from developers to city council members as a reason why so much development is happening in the city.

Peter Gilli, community development director for Ventura, said it was “unfortunate” that community members are framing the proposed changes as attempts to hide the development review process. Indeed, a petition signed by nearly 100 people as of press deadline states that the proposed changes would “shred the checks and balances.”

Gilli countered that if the city council adopts the changes being suggested by staff, both the Design Review (DRC) and the Historic Preservation committees (HPC) would still be part of the review process and that any project with more than five units would still go before the DRC as well as the planning commission (PC), and that any project “that affects a historic resource” will still be reviewed

by the HPC. Projects with “major variances of exceptions” will be reviewed by the PC. Steps in the process today.

One change under consideration regards alterations to the exterior facades of buildings. Gilli said that currently, facade changes are “split between administrative action and DRC review, depending on location.”

An administrative action is a staff review and decision. The proposed streamlining would make all facade changes an administrative action. It should be noted that all city design requirements would apply.

Another change relates to use permits, which property owners must apply for in order to conduct certain activities on their land that are not intrinsically allowed. Examples of uses that require a permit include for-profit weddings and dog kennel businesses.

Prior to the emergency ordinance, use permit reviews “were split between staff hearings and PC depending on the type of use permit.” Gilli said the streamlining ordinance would push all use permit reviews to staff hearings, but emphasized that “these are still public hearings, with public notification, public comment and the ability to appeal.”

ight now every person has an opportunity to participate in a process mandated by the U.S. Constitution in Article 1, Section 2. This is where the requirement of the national census is created, and where it is described how population determines how many elected officials sit in Congress on behalf of the voters in each state.

Ventura County, local cities, school districts and even the state are all on track to meet the same deadline of April 17, 2022. For any election that involves district representation, these entities must adopt new maps by that date pursuant or risk violating federal law.

Every 10 years, when the nation completes the census, boundaries must be redrawn to incorporate population and demographic changes to ensure accurate representation by elected officials. These required changes may mean major, minor or no changes to the district elections that you vote in.

This can include county supervisor, city council, school board as well as state and federal elected representatives.

The state Citizens Redistricting Committee has an online interactive website (www.wedrawthelinesca.org/map_viewer) that allows users to see the current jurisdictional lines and the current draft lines.

homes put the pieces back together, Ventura became inundated with building permits, with some taking a very long time to be processed.

In light of this, the city commissioned a report from an outside consultant to examine the process and recommend ways to improve it.

That resulted in the Matrix Report, which was endorsed by the Ventura City Council in 2019. Based on findings in the report, staff was directed to move forward with making the recommended changes to the city’s permitting process. Then, when the pandemic hit, an emergency ordinance was adopted. In early 2021 the council, with several newly elected members, directed staff to move forward with developing a permanent streamlining ordinance.

In a Nov. 3, 2021 staff report, the three key findings of the Matrix Report are summarized. Projects take too long to get through the permitting process because the process itself is “a complicated process that is difficult to describe,” along with “DRC/HPC acting subjectively or outside their role” and “too many [projects] go[ing] to DRC/ HPC/PC hearings.”

In response, staff is proposing that more projects go to administrative hearings, all of which are public hearings that require public notice and are subject to the appeal process.

But some in the community are expressing concerns that the pro-

posed changes will reduce public input and thwart the influence of various review committees. Nearly 100 people have signed a petition asking the city council to vote no on making the changes permanent and instead take more time to review the proposed changes, while asking the city to develop design guidelines.

The path of development

As is typical in many jurisdictions, there are generally two pathways that a project may take: discretionary or ministerial.

Ministerial projects are generally smaller in scope, and must meet certain criteria, but generally have less review than discretionary projects.

Typical examples of ministerial projects include putting in a backyard gazebo, interior building improvements, room additions, fences or even obtaining a marriage license.

If a ministerial project meets the requirements of the municipal code and the required fees have been paid, the permit will be granted.

Furthermore, the city has very little discretion on whether it can say yes or no; oversight is limited to the various requirements that are already laid out in the code.

The ministerial phase still involves building, encroachment and grading permits, but in this phase these do not require public notification and hearings. Ventura issues thousands of ministerial per-

mits every year.

With discretionary projects, the city has discretion about whether or not to approve the project. The project, such as a residential home build or a multi-unit development, must still meet state and local code requirements, but various studies — traffic impact, environmental review, etc. — are included in the review phase. Discretionary projects require public notifications and hearings and include an appeal process in which parties opposing decisions on the project can seek an alternative.

According to a January 2021 report produced by Ventura City Manager Alex McIntyre and Gilli, about 100 discretionary projects are approved each year. Most are minor projects, but a few attract public interest.

Both ministerial and discretionary projects require a sign-off from various agencies including public works, fire and Ventura Water, and the city attorney’s office weighs in when legal support is needed.

“Most simply, the problem with this phase is the difficulty in getting through it. This is not to say that the process should be easy. But when describing past experiences with this phase, developers were pleading simply to be able to get through the process to a hearing, where a decision could be made,” stated the city’s 2021 staff report.

Redistricting is an important part of the democratic process and helps ensure that communities and neighborhoods are able to vote for people who will represent them. Recent redistricting laws emphasize communities of color and lower income neighborhoods not being split up, but keeping them as a voting block to have more power in being able to elect people who will represent them.

Here is a rundown of some of the Ventura County redistricting efforts and how to get involved.

The main consideration for the city is keeping each district close in population, with about 33,769 people in each district, and ensuring there isn’t more than a difference of 3,376 between the largest and smallest district. Maps and information are online at www.oxnard.org/redistricting.

Draft maps for county supervisor districts have been viewable for some weeks and are slated to be finalized at a public hearing scheduled for Dec. 7.

Changes include a shift of Port Hueneme out of District 3 and into District 5.

As previously reported by the Ventura County Reporter (“State law puts city into a corner,” Kimberly Rivers, Apr. 28, 2021) Gilli said that the current process for reviewing development proposals includes a web of various committees, which are restricted in what they can review and act on.

This means a developer must present a project to several committees, none of which have the final thumbs up or down on the entire project, but rather only commenting on and approving a piece of a project.

This can create an onerous appeal process, both for the project developer and for members of the public that object to the project. An appeal could be filed regarding one committee’s decision, only to have the project sail through another committee.

What developers are asking for, and what Gilli said the city is working to achieve, is a process that ensures plenty of public input opportunities, a thorough review of the project, but also a clear approval and/or appeal process, which, as is the goal, would shorten the time a project is in review.

The report continued, “Since the City’s future tax base relies on private investment in property, addressing these internal factors in the development review process has been a City Council priority.”

Summary of changes

Changes included in the streamlining focus on which entity reviews each project.

First, the community development director will be given the authority to route a project to a “different decision maker than is ordinarily required.” This is on a case-by-case basis. According to the city, of 47 projects in the city’s review process since May 2020, only nine were routed to a different decision maker under authority granted by the emergency ordinance.

Second, when a project requires multiple hearings in front of various committees, the community development director will “identify a single final action body,” essentially determining which committee will make the final decision. An appeal can still be filed and heard by the city council.

And finally, public notification would be mandated rather than a “courtesy” and would require that a notice be mailed to all property owners within 300 feet of a project site.

In Brief Coalition forms to block RI-NU A coalition has formed between a community group called Santa Clara Valley Together and the Santa Paula Latino Town Hall in an effort to block a proposal by RI-NU Services LLC to reopen a wastewater treatment facility on Mission Rock Road in Santa Paula.

The group submitted a 17-page document to the Ventura County Planning Division during the comment period for the environmental review of the project.

The county is suggesting a Mitigated Negative Declaration (a level of environmental review that while identifying significant impacts states they can be mitigated) is sufficient for the project pursuant to the California Environmental Quality Act (CEQA). The comment period ended Nov. 30.

The comments submitted made references to environmental justice as well as the county’s failure to conduct proper inspections and consider public records associated with the 2014 chemical explosion and fires that occured when the site was operated by Santa Clara Waste Water. Some noted that the documents could be beneficial in understanding the risks and hazards of operations at the facility.

Immersed on San Miguel Island Circumnavigating the CINP’s westernmost isle by kayak

I

left the ranger station at zero dark thirty with stiff south winds and pea soup fog sweeping over San Miguel. Looking over my right shoulder, I nearly hesitated. I almost aborted another solo circumnavigation while paddling what is arguably the most challenging, yet idyllic isle in the Northern Channel Islands, the third largest isle in the Channel Islands National Park.

Much like a northern elephant seal knows it must migrate thousands of miles from the Bering Strait of Alaska and beach itself on a narrow neck of sand at Point Bennett on San Miguel Island, as soon as I touch down on the breathtaking, pearly white, soft sands of Cuyler Harbor on the north side of the windswept islet, I know I need to kayak around 27 miles of coastline. I’m always fearful I’ll miss something if I don’t.

Scouring weather apps for wind, swell, fog, I’d searched for the most optimal weather window for another attempt kayaking around one of the most exposed islands off the California coast. Any knowledge is crucial, especially while trying to pull around Point Bennett, one of the most hair-raising places I’ve paddled throughout the Channel Islands National Park. A lot of times the reports are inaccurate; sometimes I just need to go to know.

Rounding the Castle

As I stood committed on the beach at Cuyler Harbor, nearby Prince Island, about a quarter mile east, was silhouetted in predawn hues. It was time to go. I followed the swooping flight patterns of opportunistic elegant terns and glided northerly along Mordor-like cliffs.

Harris Point is the gnarled, craggy appendage that extends off the northern tip of San Miguel Island. It’s always a great indicator for what to expect during a potential circumnavigation.

On this day, swell and current boiled around its fringe. Turning the corner, I could see all the way beyond barren Castle Rock and Busted Balls Cove. The south wind was proving pesky but not building. The dense canopy of fog was lifting. I was all in, picked up my pace, and aimed toward seemingly lifeless Castle Rock.

At the spur of the moment, I decided to quickly paddle around Castle Rock. The south wind was barely a wisp, and the swell had faded from the day before. The gods 10 — — December 2, 2021

were smiling on me at that point, as curious California sea lions porpoised towards me.

Deep, open water beneath gray skies added to my angst while pulling around Castle Rock, but I needed to do it. On one map, Castle Rock falls within a region known as “Shark Park.” Needless to say, I occasionally peered over each shoulder, hoping not to see anything trolling after me.

Dense kelp forests flourished nearby, a haven for sea life, fish, invertebrates and for me. It’s also a great place to take stock, eat, drink, and seek a path through all the frothy, uneven surf surrounding Point Bennett, which was awaiting me. From there I heard the surf roaring above the faint yelps, snorts, barks and bellows, pinniped proliferation reveling in the pelagic forces of nature.

As I drew closer, the cacophony of sounds (and smells) eventually overwhelmed the honing surf. I snuck inside of several exposed reefs, dodging foamy whitewater, pitching waves, my frenetic, uneven pace just enough to find a smidge of tranquility within a protected cove.

Congregation of epic proportions

San Miguel Island isn’t far away from the megalopolis that is Los Angeles, but it feels far, maybe worlds away. Nowhere else on this weathered isle does it feel like that more than at Point Bennett.

It has to do with the amount of marine mammals on those gritty windswept sands, a Mecca for six species of seals and sea lions carving out a swath of beach to breed and pup unencumbered. It’s one of the greatest wildlife spectacles on earth, and the largest congregation of pinnipeds on the planet.

“San Miguel Island, in general, but especially the west end of the island (Point Bennett) is a great place for pinnipeds primarily because the marine environment around the island is influenced by the California current,” said Tony Orr, research fisheries biologist for the National Oceanic and Atmospheric Administration (NOAA). “Upwelling, and unobstructed prevailing northwest winds, which produce cold surface waters, fog and wind conditions, keep the island cool during the summer months when some of these spe-

cies pup and breed.”

California sea lions, northern fur seals, harbor seals and northern elephant seals have bred and pupped there for decades, but most recently there’s been a couple of Guadalupe fur seals that have pupped there for the first time in 25 years. Steller sea lions still occasionally visit but haven’t pupped there since 1980. At the height of the year, there can be roughly 30,000 animals or more at Point Bennett.

As I snuck between Point Bennett and Cormorant Rock, it felt as if the hardest portion of the trip was behind me. I entered Adams Cove where the length of the beach was cloaked in pinnipeds, but the turquoise blue waters were also teeming with extremely playful, curious northern fur seals and California sea lion pups.

There was just enough swell converging at the sand spit from two directions inside Adams Cove to allow for frolicking pups to bodysurf chest-high waves, and body-whomp up onto a steep berm where pups were swept upwards toward hauled-out pinnipeds sunning along the shore.

“It is a special place to see the diversity of species, as well as the quantity of each species is absolutely amazing,” continued Orr. “That’s what I’m most impressed by. And to think that this place is so close to a huge metropolis, but few people know about it or have visited the island. Incredible!”

From my kayak it was plainly obvious that most, if not all, the pups in the water had never seen a kayaker before. It was Oct. 17, and all these animals were mostly born in June. Just a few months old, there isn’t much boat traffic around this island, certainly not any kayakers.

So, their inquisitiveness soared. I didn’t see a single vessel the entire day.

Pocket beaches

After leaving Point Bennett and Adams Cove, I paddled southeast, riding a favorable

down-island current propelling me past Tyler Bight. From there I aimed toward Crook Point, the long, prominent finger jutting southwesterly toward the open ocean.

Pocket beaches abound all along Crook Point. Cormorants paraded across a knobby marine terrace. Migrating elegant terns roost and feed here for fall and winter. They enjoyed light, favorable northwest winds as they swooped on and off pristine beaches.

Nearly every beach was an ideal haul-out site for subadult northern elephant seals. At this point in their young lives, they weigh 400 to 600 pounds. While the seals flipped sand on their broad backs, the terns swooped overhead, seeking baitfish on their low, angular flights. I also paddled past surf scoters, eared grebes, and phalaropes before rounding Cardwell Point.

To the east and three miles off my right shoulder was the San Miguel Passage; beyond that was Santa Rosa Island. Paddling was sublime as gentle currents from two directions converged, forcing swells into oblong fringes bound to crash into wave-battered cliffs. The waters surrounding Cardwell and Nichols Points were some of the clearest around the entire islet.

The steep, sandy berm at Nichols Point lay ahead. It was crowded there with western gulls and elegant terns roosting in the late afternoon sun. Harbor seals, California sea lions and northern elephant seals also shared the colossal swath of beach.

As the surf heaved onshore and the swoosh of a surging, incoming tide propelled my kayak northward, there was Prince Island again, just outside Cuyler Harbor and the

completion of my circumnavigation. It had been nearly eight hours since I hesitated to wait out a perfect weather window, taunted

by San Miguel Island once again.

VCAC seeks Artists in the Classroom

The Ventura County Arts Council is currently hiring visual, literary and performing artists for its Artists in the Classroom (AIC) arts teaching residency program. The program brings art educators into K-8 classrooms for eight-week residencies in dance, music, poetry, visual and performing arts. Teaching artists tailor the program to the appropriate grade level, and many incorporate a multicultural and historical perspective into the lessons.

O’Leary wins literary medal

Denis O’Leary of Oxnard, a recently retired teacher and longtime Oxnard School Board member, has won the Gold Medal in the 23rd International Latino Book Awards for his book Esteban’s Caravan: From Hope to an American Cage.

This is the top prize given for the category of Best Young Adult Fiction Book.

Esteban’s Caravan is the story of a 10-year-old boy from Guatemala who becomes separated from his family while seeking asylum in the United States.

Denis O’Leary won the Gold Medal for Best Young Adult Fiction Book at the 23rd International Latino Book Awards for his book Esteban’s Caravan.

“I wrote this story at the height of the shameful policy of separating children from their parents to punish legitimate asylum seekers coming to the United States,” O’Leary stated upon accepting the award during a virtual ceremony on Oct. 16. “A community activist and fifth grade teacher at the time in the immigrant community of the Rio School District, I believed that the children were being used as fodder in the immigration border policy.” He went on to say that he was dedicating the award to the “children and families who seek legal asylum in a country of immigrants.”

I’m a divorced guy in my 40s using dating apps. I’m keenly aware of what I do and don’t want in a woman and make it clear in my profile. For example, I write, “If you’re in a weird co-dependent relationship with a five-pound dog,” we are not a match. A friend looked at my profile and was all, “Man, you have to delete that.” I see no problem with what I’ve written. Who’s right?

Of course, because a woman has a tiny ridiculous dog doesn’t mean she’s rife with psychological shortcomings. Including that bit in your profile — and especially as you worded it — says a few things about you, none of them lady-magnetizing. And sure, you wrote, “IF you are...” (in some sort of unhealthy relationship with your micro dog).

However, even women who are emotionally together (and maybe even dog-free) are likely to swipe left or knock your profile into the little trash can icon.

Most problematically, this remark and other similarly cutting ones in your profile suggest you’re an angry guy: a big flashing skull-’n’crossbones “STEER CLEAR!” for women. “Anger-prone individuals are volatile and frequently dangerous” — to the point of violence, evolutionary social psychologist Andrew Galperin and his colleagues explain. Women, on average, are smaller, physically weaker, and thus more physically vulnerable than men, which is likely why they err on the side of overperceiving signs that

a guy might be a Mr. Angry. In fact, per the Galperin team’s research: “A single instance of angry behavior” in “new acquaintances” is enough to provoke this keepaway motive — even when their anger seems justified by the situation at hand!

Your sneering about behavior being “weird” and “co-dependent” is another red flag — suggesting you view life through puke-colored glasses and are quick to think the worst of total strangers. That’s Bigotry 101: using one infobit about an individual to leap to all sorts of ugly assumptions about them. It’s toxic, irrational, and unfair — and, if it’s your go-to thinking, perhaps something to work on changing, lest you pay an unintended price (both in an ugly-first view of others and in others seeing you as a person to block, delete, and/or avoid).

By the way, “co-dependent” is an insulting term that’s in need of either retirement or scientific validation. It’s generally understood to describe two individuals in a persistent dysfunctional dance. The “enabling” individual temporarily eases the suffering of the other person (or pet!) — in ways that, in the long term, are harmful to both.

“Co-dependence” was flung on the

public by self-help authors — without any scientific basis: no evidence for the long lists of its supposed symptoms. It’s now promiscuously applied to shame people — to the point where showing none of the supposed symptoms gets used as proof of one’s co-dependence!

That said, you’re wise to try to proactively shoo off women who are wrong for you, as it could keep you from wasting your time and theirs on the phone (or worse, on a happy hour date that flies by like a week of medieval torture). However, there’s a way to tell the wrong women, “Yoohoo, move on!” without coming off scolding or demeaning (and in turn throwing out the babes with the bathwater).

Probably the best constructive yoohoo is subtle fact-stating, like mentioning you’re an atheist to discourage interest from those on Team God. Similarly, in the “who am I?” portion on a dating app, a 40-something, Johnny Depp-alicious hottie of a guy posted, “Living a plantbased life,” suggesting he doesn’t just eat vegan; it’s major in his identity. If, like me, you are committed to “steak-based living,” you know to give a big sad pass to Mr. Pirates of the Cauliflower-ribbean.

It’s tempting to try to escape the emotional toddlers by announcing you’re seeking someone “psychologically healthy” or “emotionally solid.” Probably pretty useless.

Those who have an unhealthy relationship with their dog — or their mom, crystal meth, or tennis — are often the last to know or admit it.

Ultimately, you might simply accept that you’ll likely end up on a date or two with women you’d do anything to avoid. Keep first dates casual — like meeting for coffee for an hour — and your disasters will at least be Hobbesian: nasty, brutish, and short. Finally, I must say — while typing this with my tiny, “My Little Pony”-like Chinese crested curled up asleep in my lap: Five pounds of dog may elicit laughs — till it’s cleanup time and you need a single sheet of Kleenex instead of a backhoe.
