Justifiable homicide Officer-involved shooting of Javier Magaña deemed lawful

entura County District Attorney Erik Nasarenko has determined that the officer-involved shooting death of Javier Magaña on Nov. 5, 2020, was justified and Ventura Police Officer Juaquin Ortega acted within the law when he discharged his weapon.

The shooting followed a vehicle pursuit that began in Oxnard and ended in Ventura.

Magaña was pronounced dead at the scene on Harbor Boulevard, a few blocks east of Seaward Avenue, in Ventura.

In the days after the incident community members protested at the corner of Seaward and Harbor, calling the shooting an “extrajudicial” killing in that a suspect wanted in connection with crimes was not provided with due process, and instead actions of law enforcement led to the events that culminated in Magaña’s death.

The results of the investigation and report made by the Ventura County District Attorney’s office (VCDA) found the shooting a “justifiable homicide” and no charges will be filed in the matter. Ortega’s actions were found to be “reasonable” in that the officer “honestly and reasonably believed that he and others were in imminent threat of death or great bodily injury,” and that “the immediate use of deadly force was necessary to defend himself and others against the danger posed”

by Magaña, who was armed.

The investigation included a review of over 500 pages of reports, more than 30 hours of audio and video recordings and over 500 photographs.

The final VCDA report was released to the public on Dec. 9, 2021. The body camera footage of the incident was released in November 2020 by the Ventura Police Department.

“I’m not going back to prison.”

Magaña was a suspect in a gang-related shooting on Oct. 12, 2020. As part of an investigation into that shooting, Oxnard Police Department had placed a court-authorized tracking device on a car belonging to Amber Donovan, Magaña’s fiance, who was living with him in Thousand Oaks.

Donovan told investigators after his death that Magaña had “told her multiple times he was not going back to prison” and that he had said, “I’m not gonna go spend life in prison and do the things I have to do in prison.”

On the night of the Nov. 5 shooting, Magaña was in Donovan’s car. He was going to pick her up from the restaurant where she worked after her shift. According to her statements to police, Magaña called her at about 7:22 p.m. while being pursued by police on the freeway in Ventura.

Donovan told officers Magaña again told her during that phone conversation, “I’m not going back to prison.”

The VCDA report states that evidence exists showing Navarro and Magaña were members of an Oxnard-based gang.The report does not, however, provide that evidence.

Investigation details deadly incident

The pursuit from Oxnard to Ventura ranged from slow speeds to well over 70 miles an hour on Highway 101 and surface streets.

Magaña drove through red lights and stop signs in his attempt to evade multiple police vehicles. At one point the car slowed and Navarro got out and fled on foot.

Magaña drove over a deployed spike strip, damaging the car’s tires, ultimately causing him to lose control of the car, which came to a stop on Harbor. Magaña got out and fled on foot, heading east away from the now stopped car driven by Officer Ortega.

Ortega exited his patrol vehicle and gave the command to the K-9 dog to leave the car.

The dog, however, never left the car and the investigation did not determine if a remote-operated door opener used to allow the dog to leave the car malfunctioned.

Body camera footage shows that as Ortega pursues him, Magaña is seen tripping and a shot is heard from Magaña’s gun.

According to the report, “Magaña held a loaded handgun as he fled. He tripped and stumbled, and his weapon fired a single shot.” The gun malfunctioned and the spent cartridge of the bullet was not discharged from the gun, preventing the gun from being fired again. The report found it unlikely that either Magaña or Ortega knew the gun could not fire again at that point.

The report described Magaña’s gun as a “ghost gun,” a common name of a mostly plastic firearm that is generally purchased in pieces and assembled. It has no serial number and cannot be traced.

Magaña, who was in a seated position, repositioned after the first shot into a kneeling position and pointed his weapon at Officer Ortega, who then fired three times. Magaña attempted to stand up, turned away from Ortega and tried to run away, but stumbled. After falling, he got up and moved away along the curb, with Ortega following him.

The body camera footage went on to show that Officer Ortega ordered Magaña to “stop moving” after Ortega had fired his weapon 7 times. (2) After pointing the weapon at Officer Ortega, Magaña left his gun on the ground. As Ortega approached Magaña, the officer informed the other officers now approaching that Magaña’s gun was behind him on the ground.

Officers handcuffed Magaña and then administered first aid until paramedics arrived.

The ambulance could not access the site, and officers had to move Magaña.

The investigation was unable to locate any of the bullets at the scene, although seven police casings were found.

The VCDA report stated that an autopsy performed by Dr. Christopher Young, Chief Medical Examiner with the Ventura County Medical Examiner’s Office, found Magaña suffered from three gunshot wounds. One shot in his upper chest entered from the front of his torso. A second shot entered Magaña’s lower back. The third shot struck his right hand. Two bullets were recovered from Magaña’s body.

The forensic reports determined that two bullets “fired by Ortega struck Magaña.” The third shot suffered by Magaña could not be definitively sourced; however, no other officer fired their weapon. The forensic reports also found high levels of methamphetamine in Magaña’s body. His blood contained 5,300 nanograms per milliliter of the illegal drug.

Levels of 200-600 ng/mL can cause violent or irrational behavior.

Surveillance footage was obtained from all businesses in the immediate area and none of the footage recorded the shooting.

Justifiable homicide

By definition a homicide is “the killing of one human being by another, either lawfully or unlawfully.” The term includes murder and manslaughter as well as “excusable and justifable homicide,” which, as stated in the report, “are lawful” killings. Criminal laws dictate when a homicide is justifiable, commonly seen in cases of self-defense.

But it also applies when a person, such as a police officer, commits homicide in an effort to stop “any attempt to murder any person, or to commit a felony, or to do some great bodily injury upon any person.” (Penal Code Section 197)(1) In addition, California Criminal Code 505 lays out the three tests that together must be used by juries to determine whether a killing shall be deemed lawful, or justified, as in the case of self defense. First, the shooter had to “reasonably” believe that either they or someone else “was in imminent danger of being killed or suffering great bodily injury.”

This includes rape, being maimed or robbed.

Next, the person who committed homicide believed “the immediate use of deadly force was necessary to defend against that danger.”

Finally, the level of force used was “no more force than was reasonably necessary to defend against the danger.”

As stated in the report, “Police officers may use deadly force only when necessary in defense of human life. In determining whether deadly force is necessary, officers shall evaluate each situation in light of the particular circumstances of each case, and shall use

other available resources and techniques if reasonably safe and feasible to an objectively reasonable officer.” (Penal Code § 835a(a)(1) The benefit of “hindsight” is not applicable in determining whether the act was reasonable self defense, and information understood after the fact may not pertain, such as the knowledge in this case that Magaña’s gun couldn’t fire after the first shot.

The VCDA report pointed to the remaining rounds in Ortega’s weapon as evidence that he used an appropriate level of force for the situation.

Retreat or Stand Your Ground?

California is a “Stand Your Ground” state.

This means that a person, including a police officer, is not required to retreat from, desist or otherwise attempt to de-escalate a situation where they believe they are at risk, or another person is at risk of great bodily harm.

In contrast, in dozens of states where retreat is required, a person has a “duty” to and must retreat if they can do so safely.

The VCDA report states this clearly: “A police officer need not retreat or desist from their efforts by reason of the resistance or threatened resistance of the person being arrested.” (Penal Code section 835a(d).(1) Some legal scholars, however, question whether police officers should have the duty to use deadly force when an option to safely retreat exists. In an article from May 2021, Matthew Oliver of Harvard Law School writes that the permission granted to police officers to use deadly force in cases of self defense, “rather than abandon[ing] an attempt to enforce the law…effectively expands the set of law enforcement goals that police may use deadly force to achieve.” Oliver argues against law enforcement officers having this expanded permission, instead showing the duty to retreat should exist. (3) Oliver states, “The argument is moral and philosophical rather than legal. It is not an argument about what the law is but about what it ought to be.”

he Honorable Charles Robert McGrath, a member of one of Ventura County’s most enduring families, passed away on Tuesday, Nov. 22, following a lengthy illness. He was 84 years old.

His wife, Beverlee McGrath, remarked that he was “brilliant, and everybody always recognized it.” She added that he also had “an incredible sense of humor.”

His best friend, Jim Clark, recalled how he loved puns. “I would even call him on the bench when he had breaks between juries and such just to tell him some.”

McGrath was born in Oxnard on July 6, 1937, to George and Mary McGrath.

He attended Loyola Marymount University and eventually switched his major from premed to law. He received his J.D. in June 1963 and was admitted to the California Bar Association in 1964. McGrath had a long career practicing law, beginning in 1964 when he worked for Nordman, Cormany, Hair & Compton. In 1974, he was appointed as a Ventura County Municipal Judge. He was elected to the Ventura County Superior Court in 1978 and worked as a judge until his retirement in 1997.

vcreporter.com His Superior Court colleagues, Justices Steve Perren and Kenneth Yegan, spoke highly of McGrath’s integrity while serving on the bench.

“He was a fundamentally decent human being,” said Perren.

“He was fiercely independent,” Yegan noted. “He called them the way he saw them.

Whether he called it in favor of a criminal defendant didn’t make any difference. He was just following the law.”

His son, Dan, described his father as a fiercely honest man. “He never lost sight of his sense of honesty and his sense of decency at treating people. His faith and his honesty carried forth in his judgment.”

McGrath’s lifelong romance with Beverlee began in 1957, when Charles accompanied his family to a nightclub in San Juan Capistrano, where she was performing. They were married four years later in Tacoma, Washington, and had four children: Jack (John), Debbie, Dan and Bridget.

Beyond his professional career, McGrath was devoted to his family and had a passion for sports, horses and humor.

“He loved sports,” said Beverlee, “especially tennis, volleyball and basketball.”

Dan noted that McGrath also played football at Mater Dei High School and that the family often joined in volleyball games out at the ranch. In addition, his father was “a ribbon-winning horseback rider in some competitive events.”

McGrath also enjoyed vacationing with his wife and family.

“We had a timeshare in Cancun before Cancun became such a tourist area,” said Beverlee. “We would love going there and just hanging out at the beach. I was also an

Charles McGrath entertainer, and he would go with me when I traveled. We went all over the world — China, Japan, the Caribbean and Puerto Rico.”

Dan remembered how his father enjoyed planning family vacations.

“He would start talking in the spring about where we would go as a family for vacation, whether it was motorhome camping in Yosemite, or down to Mexico, or across the United States to Fishkill, New York.”

McGrath also enjoyed time with his friends, even if it meant occasionally rounding up heads of cattle. As friend Jim Clark recalled: “Even though he didn’t care much for it, I would take him up in the wilds of

Ojai, and he would help me round up the cattle. He was always a good sport about it.”

McGrath had deep roots in Oxnard and Ventura County. His Ventura County family and their agricultural history can be traced back to the middle of the 19th century. He lived his entire life in his 100+-year-old house on the family ranch in Oxnard.

As Dan noted: “His devotion to family was not only to immediate family but also to the sheer volume of his cousins around Ventura County. Being born in a legacy family steeped in agriculture, his commitment to his cousins and this 500-acre plot of land was paramount.”

Also, gift cards can reduce waste if the card is for purchase of an experience, rather than an object. For example, a gift card can be for a restaurant meal or a massage.

If someone really prefers cash, or if a failed effort to personalize the gift resulted in the recipient receiving a gift for a store where he would never shop, gift cards can also be re-sold. For example, the GiftPocket app (www.GiftPocket.com) allows users to upload and exchange unwanted gift cards for desired ones. According to Brooke Yoakam, founder of GiftPocket, “Generally, about 3% of gift cards never get redeemed. To put that into perspective, that amounts to about $6.63 billion lost every year, which is 3% of $221 billion.”

Besides any benefit this 3% loss rate might

provide, retailers have many reasons to promote gift cards with highly visible in-store displays. Retailers seek to reduce returns, so involving recipients in the selection of gifts seems like a good strategy. Until redeemed, gift certificates also benefit companies with interest-free funding, and some retailers charge a fee. As another retailer benefit, gift cards given in December bring customers into stores and restaurants during January and February, when business is usually much slower. Even more valuable, a customer with a gift card is likely to spend more than the face value of the card and may bring a friend who will make a purchase.

Finally, a gift card is a form of advertisement. If you carry a gift card in your wallet, you are exposing yourself to a vendor’s prompt every time you see the card.

Through environmentally conscious marketing efforts, some companies forego this final benefit and instead use virtual gift certificates, avoiding the manufacture and disposal of physical cards. For example, Outlaw, a company selling personal care prod-

ucts both online and in stores such as Whole Foods, still offers gift cards made from paper, but is increasingly switching to digital cards online. According to CEO Danielle Vincent, a plastic gift card would be inconsistent with the company’s efforts, which include packaging lotions and body washes only in aluminum bottles, which are contained inside boxes made from uncoated, recyclable and recycled-content cardboard or paperboard.

Locally, another retailer combining an environmental ethos with personal care products sales experimented with a different alternative to plastic gift cards. In addition to offering digital gift cards online, The Refill Shoppe in Ventura had gift cards printed on paper embedded with wildflower seeds. Due to a formatting error, the store’s address did not come out clearly, but rather than waste this waste reduction promotional item, company owner Michele Stevens is in the process of crossing out the error and writing in her address by hand. Her website includes a picture of the card, printed with the words, “Plant and water this card after use to grow wildflowers.”

Cards are generally made from polyvinyl chloride, or PVC plastic. According to the website of Greenmatters.com, PVC is a “harmful material” which poses “threats to both human health and the environment during every point in its lifecycle.” Greenmatters.com cites a Greenpeace report stating, “PVC is the single most environmentally damaging of all plastics.”

PVC cards are not recyclable in local curbside or commercial recycling programs. Putting these cards in local recycling systems can contaminate bales of paper, reducing the value of recyclables and requiring later separation.

For those determined to recycle, cards can be mailed to Terracycle, which charges $167 for their smallest size “Zero Waste” box. Using Terracycle’s prepaid return label, recyclers may send Terracycle not just gift cards, but also identification cards, credit cards and key cards.

Trickle, not a flow Lack of rain means no honey harvest

ffects of the drought, or the new normal of very little rainfall, in Ventura County and the surrounding region, is having a trickle effect across industries, impacting local businesses and livelihoods.

Wendi Mitchell, owner and beekeeper of Ventura-based Blue Ridge Honey, is hoping a plan in the works will help her avoid laying off staff in the coming months.

“Right now I have about 19,000 pounds. That sounds like a lot, but it isn’t. At this time of year drums should be stacked three high to the ceiling,” Mitchell said of the room where she and her team extract honey. “We’ve got 31 drums on the floor.

Nothing stacked. It’s looking pretty scary.”

Dramatic reduction in honey flow statewide

Traditionally, the spring months usher in the all-important “honey flow,” when bees are foraging for nectar and larger quantities of honey are being produced. This is the time of year when beekeepers collect most of their honey. But a poor 2020 season slowed the flow to a trickle: While there was some rain in 2020, spring conditions did not lead to much honey. Sunshine is needed after the rains to get enough blooms and nectar in the flowers for bees to gather and make honey. .

“In 2020, we got the rain, but it was too cloudy, there was not the beautiful spring, the bees did not want to forage . . . we harvested about 40,000 pounds of honey.”

“This year we’ve had no honey at all,” Mitchell continued, noting that honey currently on hand is “reserve from previous years.”

Mitchell pointed out that hobbyist or backyard beekeepers tend to water their backyards, which can help those hives still see some honey production, but that overall, the honey drought is a statewide issue. The evidence bears that out: According to the U.S. Department of Agriculture’s Nov. 29 National Honey Report for the month of October, “Honey production in California and the USA was extremely low this year due to drought.” The National Honey Board found that in 2020 one hive produced, on average countrywide, about 55 pounds of excess honey. That amount is over and above what bees need to eat and keep

the hive warm over the winter months.

Mitchell confirmed that while her hives did produce some honey in 2021, it was just enough for what the hive needed to sustain itself — there was no excess honey to harvest.

There were some buckwheat flowers that bloomed in Ventura County, “but there was no nectar in the flowers. The bees couldn’t pull anything out of them . . . because there was no rain, the ground was dry,” explained Mitchell.

The bees did make just enough honey, “to keep [the hive] going. If we would have taken any they would have starved to death.” In addition to not wanting the hives to die, Blue Ridge also has almond pollination contracts it will need to fulfill with healthy, active hives in a few months.

The season is now over, as statewide the bees have stopped foraging and winter preparations are underway. Mitchell said she knew of some beekeepers in the Central Valley who were planning to get a later harvest from some cotton, as it’s an irrigated crop. But then a pest was found in the fields and the cotton had to be sprayed. Hives were relocated to prevent pesticide exposure.

“Without the water, we’re done”

Mitchell is not the only beekeeper seeing the lack of pollen and feeling the impacts of a nonexistent honey harvest.

“It’s really horrible, with no rain nothing grows, you don’t make any honey or nectar.

It’s a bad deal. Without the water, we’re done,” said Mump Kenyon, of Oak View.

Kenyon keeps about 700 to 800 hives, placed around the Ojai Valley and Ventura. He sells his honey to other beekeepers in Ventura and Santa Barbara counties. Every February his hives are moved out to Visalia for the almond pollination. He has to keep his hives healthy and alive. When bees don’t make enough food for themselves, Kenyon has to supplement with a man-made pollen he provides to the bees from a bucket outside the hive.

He has been keeping bees since 1973 and says this is the worst dry spell he’s seen. “Last summer I had to start feeding them about four months ahead of schedule. That costs a lot of money to buy the feed. I never extracted a drop of honey this past summer.”

The lack of honey to sell affects the beekeepers’ bottom line, of course, but this is compounded by the fact that honey is rarely sold for what it costs to harvest from the hives.

This year, “if we’d harvested a pound of honey, it would be worth a million dollars . . . that’s our overhead,” Mitchell said. Looking at the harvests over the last three years, she estimated that the price of honey would be about $23 a pound. So Blue Ridge Honey’s threepound container “should be $70 once you throw

Non-local sources continue to be an issue

Mitchell’s plan, one that is already underway, is to source high quality honey from other states.

“This keeps my team going, so I don’t have to lay anyone off,” she explained.

She has three types of honey coming in from three states, which she will be selling under the new Waxy Boots label. She chose that name because “my husband and son always have wax on their boots, walking through the house,” she laughed.

sale accounts for retail sale in local shops.

The Blue Ridge Honey label will continue to be available at farmers markets, which require that only local honey be sold. She has the idea of perhaps eventually having 50 varieties “from 50 states.”

Mitchell’s honey sources aren’t from California, but they are from the United States, and meet her standards for high quality. But the ongoing issue of honey, sometimes low quality or even fake, imported from other countries (particularly Brazil, Vietnam and Argentina) continues to be a concern for Mitchell. She points to a class action lawsuit filed in May by a group of beekeepers, two from California, against major honey import companies, saying the market is being flooded by cheap, low quality honey. Honey is classified as an agricultural product, and falls under the purview of the U.S. Department of Agriculture. The lawsuit claims that the USDA has failed to act to protect American beekeepers. (2) According to the National Honey Board, in 2020, American beekeepers harvested 147 million pounds of honey (3), with only 11.7 million pounds being exported. But nearly three times that amount was imported (433.5 million pounds) from outside the country (4).

These statistics spell a future for local honey that’s not so sweet. Indeed, Blue Ridge Honey has dropped down to 20 wholesale accounts from their typical 97.

With rain falling in Ventura County over the past week, Mitchell does see some hope for the crop in 2022. “It’s looking hopeful. But even so, we can’t harvest, at the earliest, until June.”

efferson Starship, the iconic rock group hailing from the San Francisco Bay Area, is coming to perform at The Canyon in Agoura Hills.

The group has been consistently touring internationally for years now and will be performing some of its biggest hits along with songs from its latest album, Mother of the Sun, on Dec. 19.

Jefferson Starship was first formed in 1974 by former Jefferson Airplane members Grace Slick and Paul Kantner. The original lineup included David Freiberg, Pete Sears, Craig Chaquico, John Barbata, and Papa John Creach.

Lead singer Marty Balin joined soon after in 1975.

As one of the most successful arena rock bands of the 1970s and ’80s, the group has enjoyed great success, releasing 11 high-charting studio albums and acquiring eight gold and three platinum records with many Billboard Top 40 singles.

Over the years, the band has gone through numerous changes in personnel and genres while under the Jefferson Starship name. The group retired in 1984, but band founder Paul Kantner led a revival of Jefferson Starship in 1992 which has continued on following his passing in 2016. Today, the band continues to play sold-out concerts all over the world with its current lineup of David Freiberg (vocals, bass, keys, guitar), Donny Baldwin, (drums, backing vocals), Cathy Richardson (main vocals), Chris Smith (keys) and Jude Gold (lead guitar).

Jude Gold, the latest member of the group, joined Jefferson Starship in 2012 after guitarist Slick Aguilar had to step down due to health problems. Building on his love for Jimi Hendrix, Nile Rodgers and Van Halen, Gold had played music with Richardson and Baldwin together in the past on several different occasions. When he first joined the group officially, it was a natural fit as the band created good chemistry.

Having seen Jefferson Starship perform live when he was a young teenager, Gold said, “It’s this constant evolution.

We always try to harken back to the stuff on the famous albums, and put new flavor. We keep the key ingredients that make the original song special, but we build on them to make it memorable.”

The year Gold joined, Jefferson Starship performed in Brazil, Japan, Israel and Canada as well as the United States. Since then, life with the band has taken him all over the world — a particularly exciting aspect for the guitarist.

“Every day, my office changes,” said Gold, describing the band’s worldwide stage. Jefferson Starship has made long-lasting memories, from outdoor shows in New Zealand with Toto to gigs in almost every major city in America, using music to bring people together.

It’s much closer to home than some of their venues, but according to Gold, the

vcreporter.com Canyon in Agoura Hills has remained a favorite location for band members. “We love the Canyon; we play there regularly. It has a melting pot feeling where everyone comes together.”

One major aspect of Jefferson Starship’s live shows is its musical improvisation. Vocalist Cathy Richardson is known for her onstage antics and uproarious energy that make the group’s performances entertaining and fun to watch. The energy from the band members always keeps the audience members on their toes.

“Cathy, she’s always been a wildcard, you never know what she’s going to do on stage. That’s one of the signs of a great front person, they’re kind of unpredictable . . . that kind of energy always makes the fun of the show,” said Gold.

In March 2017, after Kantner’s death, Jefferson Starship announced the “Carry the Fire” tour as a tribute to Kantner and Slick. When asked about Paul Kantner’s influence as a pioneer of rock music, Gold replied, “PK’s spirit was always in the music, always pushing the edge. There was a certain explosivity and magic that happened on stage when I played with him. Paul always had this little spark in his eyes of daring. You never knew what he was going to do . . . He had a certain psychedelic pirate energy that came through in his music as he thundered through his 12-string guitar.”

On Aug. 21, 2020, the group released its latest studio album, Mother of the Sun. The album includes the single “It’s About Time” written by Gold, Richardson and former vocalist Slick. Mother of the Sun also features former bassist Pete Sears on three tracks and a live version of “Embryonic Journey,” a song first recorded in 1966 and performed by Jefferson Airplane.

The foundations for many of the tracks of the album were recorded in Northern California: Some were written in Freiberg’s home studio, some on the road, and they all came together at Prairie Sun Recording Studio in Cotati, just north of San Francisco in Sonoma County. The album was finished before the pandemic, but there was a delay in the release because of the shutdown.

Even with the pandemic, the group was fortunate to release its album with additional music videos, and is excited to be back performing live music.

“We can’t underestimate how difficult it has been for musicians, stage engineers, drivers and stage techs. We’re definitely surprised to be playing again; we’re very lucky to be doing that!” exclaimed Gold.

love Indian food, and there was a time when I’d even cook it occasionally. Yamuna Devi’s The Best of Lord Krishna’s Cuisine has been a faithful companion since my college days. More recently, however, it’s been collecting dust on my cookbook shelf, and I tend to leave curries, saag, korma and other South Asian delights to the experts.

Googling around for Indian food one day, I came across Fresh Curry Chefs in Camarillo — and was surprised to find, prominently placed on the website, meal kits ready to cook at home.

“Designed by us, made by you” was an intriguing concept, so I thought I’d give it a try.

Fresh Curry Chefs will deliver in the Camarillo area; everyone else will have to pick it up. But ordering online is pretty easy: Just click on the “Order Meal Kits” tab from the home page, and off you go! Availability varies each week, but usually you’ll find the ever-popular chicken tikka masala and chicken vindaloo on the menu, as well as rice dishes like biryani and a variety of vegetarian and vegan specialities. Less comprehensive than most Indian restaurants (there are no samosas or kebabs, for example), but it’s still a pretty good selection.

We ended up ordering several items, just as we would if we were dining out: chicken tikka masala (a family favorite), vegetable korma, saag chole and vegetable biryani.

Arriving to pick up my order, I noticed that the space is small but clean and well organized. There are few tables, but plenty of customers coming and going for takeout. I had placed my order well ahead of time, but it was a good 15 or 20 minutes before my kits were ready . . . although I did end up adding a few servings of naan to my order, which might account for the delay. Waiting aside, the people behind the counter were very friendly and helpful, and excited to show me just what I was getting into with these ready-to-cook collections.

Indian food, with its elaborate sauces and variety of spices, can be intimidating for the unfamiliar cook. But Fresh Curry Chefs could not make it simpler. Each kit is a tidy little box filled with all the meats, vegetables, sauces and seasonings required to prepare the meal at home. There are even little containers of oil or ghee, for sauteing, and chile paste, for achieving that

ideal spice level. A helpful recipe card provides step-by-step instructions, and every container is labeled by number so you know exactly what to add, when. Pretty easy for even a novice.

If you enjoy cooking but hate all the slicing, dicing and other prep work, Fresh Curry Chefs is definitely for you. Those boring and time-consuming tasks are done: The meat and veg are chopped and seasoned, the sauces freshly made and prepared to perfection, etc. You get to do the fun stuff: heating up the skillet, hearing that satisfying sizzle as you tip something into the pan, frying garlic, onions and spices as they release their mouthwatering aromas. My 12-year-old son was more than happy to help make dinner under these conditions! Serving these creations from your own cookware rather than takeout boxes is a treat. Not homemade, but close to it.

Oh, and every meal includes a nice, big bag of basmati rice — parboiled, so all it needs is a few minutes in a pot with a little water to be served hot, fresh and fluffy with your entree. Having ordered four meal kits, I had mountains of the stuff, so I saved a few bags for some easy dinners later in the week.

The proof is in the pudding, as they say, and flavor-wise, I had almost nothing to complain about. The tikka was absolutely delicious; creamy and rich and flavorful, with hunks of chicken breast meat that were deliciously seasoned and retained all their moisture. I loved the saag chole, made with chickpeas cooked in a thick spinach stew — and Fresh Curry Chefs’ version has no cream, cheese or butter, so it’s lighter than you might expect. With all that basmati rice (which was perfect, by the way), we definitely didn’t need the biryani, but it was so pretty, with its bits of vegetables, cilantro and saffron oil (to be poured over the final dish) . . . fragrant and aromatic. Naan, of course, is always a crowd pleaser.

The vegetable korma was the only item that was less than stellar. This is probably my favorite Indian dish; I love the mix of spices and the satiny sauce bathing the potatoes, peas, carrots and other veg. Maybe I didn’t cook it right; maybe the sauce or recipe needs tweaking. Either way, this korma was somewhat dry, and lacked the smooth texture and heady spice that I have come to expect from the dish. I wouldn’t order it again.

But everything else? In a heartbeat! I’d happily cook up some more tikka and saag, and I would love to try the dal and vindaloo. If I wanted to have a “nice” meal without going out, going nuts in the kitchen, or having a million dishes to clean, I’d order these meal kits in a hurry.

Curry in a hurry, that tastes like it was simmered for hours: That’s Fresh Curry Chefs in a nutshell. All the flavor, a fraction of the work, and designed to be enjoyed at home. My thanks to the chefs for developing such an easy, fun and rewarding culinary adventure in a box.

Bed Over Heels?

I’m a 29-year-old guy with a “keep it casual” relationship history, but I can’t stop thinking about this new girl at work. Beyond not wanting her to date anyone else, I don’t want someone to hurt her or make her sad. No other woman has ever made me feel this way. How do I know whether this is lust or the beginnings of falling in love?

To be fair, lust is a form of love . . . if you broaden the field to stuff like

In other words, lust is animal attraction, so the “inner beauty” that’s elemental to loving somebody is immaterial. I know this firsthand, having repeatedly been the target of interspecies sex predators, large and small.

A giant male goat chased me across my friend’s parents’ farm, trying to mount me — while my friends looked on laughing. A previous perv was six inches high and green: a friend’s lorikeet (a kind of parrot). He ran after me on his little bird feet all around another friend’s apartment, squawking the oh-so-sensual pickup line, “Otto, bird! Otto, bird!” I bolted into the bathroom, slammed the door, and refused to come out till he was behind bars. #beaktoo Complicating the detangling of “love or lust?” is another important question: “Love or infatuation?”

Falling in love is not love. It’s infatuation — an intense, usually lust-fueled obsession with our idea of who a person is: a projection of our hopes and romantic fantasies that often has little relationship to who they really are. That said, the sheer strength and intoxicating

nature of infatuation — like being blind drunk on romantic possibility instead of Jim Beam — often leads to premature feelings of “We’re perfect for each other!”

People tend to believe the more they learn about a new person they’re into, the more into them they’ll be — a la “to know them is to love them.” However, psychologist Michael I. Norton finds that when we have the hots for someone we barely know, we’re prone to read ambiguity — foggy, partial information about them — as signs the person is like us. These (perceived!) similarities amp up our “liking” for them — at first.

However, as time goes by, we can’t help but notice all the dissimilarities poking up, which leads us to like them less and less — a la “To know them is to loathe them.” In other words, rushing into a relationship of any permanence is the stuff dreams are made of — if you’ve always dreamed of being financially and emotionally incinerated in a grotesquely ugly divorce.

“Buyer beware” in love is best exercised in two ways: The first is “buyer be seriously slow.” Consider putting the person you’re dating on secret probation for a year (or

more). This will give you time to not just see the best in them but give it much-needed company: glimpses of the worst.

Second, explore whether your compatibility with a person is surface — “I love sushi! She loves sushi!” — or sustainably deep. The ideal tool for assessing this is the best definition of love I’ve ever read, and by “best,” I mean the most practically useful. It’s by Ayn Rand. (And no, I’m not one of the glassy-eyed worshippers of everything she ever said or wrote, but she nailed it on this.)

“Love is a response to values,” writes Rand. “It is with a person’s sense of life that one falls in love — with that essential sum, that fundamental stand or way of facing existence, which is the essence of a personality. One falls in love with the embodiment of the values that formed a person’s character, which are reflected in his widest goals or smallest gestures. ... It is one’s own sense of life that acts as the selector,” identifying one’s own core values in the other person.

Using this “values model” to determine compatibility requires some preliminary work: figuring out your own values, meaning the

principles you care most about — the guiding standards for the sort of person you want to be. If you’re in the “gotta get started on that” stage, recognizing what isn’t love — those love fakers, lust and infatuation — should help you avoid sliding into the committed relationship nightmare zone.

Ultimately, love is nautical: It’s both the ship that launched a thousand sappy cliches and, more vitally, a lifeboat. In lifeboat form, it gets romantic partners through the worst of times, major and, um, somewhat less major — like when your bae spends your entire date night searching Hulu for a movie to watch. Defendant executed a contract ("Contract") with Plaintiff, dated October 7, 2016, for legal services to be rendered by Plaintiff and associates of his law firm in exchange for payment 22 based on a schedule of various hourly rates. 6. From October 7, 2016 until November 2, 2017, Plaintiff performed legal services for Defendant. On November 2, 2017, Plaintiff filed a Motion to Be Relieved as Counsel because Defendant refused to pay the outstanding balance on invoices issued by Plaintiff for legal fees and stopped communicating with Plaintiff altogether.

7. On March 11, 2021, Plaintiff sent Defendant a demand letter, which included a Notice of Client's Right to Fee Arbitration, requesting that Defendant pay the outstanding invoices and notifying Defendant of her right to fee arbitration. A true and correct copy of that demand letter is attached hereto as Exhibit "B" and herein incorporated by this reference.

8. Plaintiff requested that Defendant reply to the demand letter within thirty-five (35) 5 calendar days, but Defendant failed to do so.
