Woolsey Fire spread radioactive contamination Study found particles from Santa Susana Field Lab offsite

peer-reviewed study (1) published in the December 2021 issue of Journal of Environmental Radioactivity (JER) has found that radioactive contaminated particles were spread during the 2018 Woolsey Fire from Santa Susana Field Lab (SSFL) to offsite locations.

This finding is contrary to state reports released in 2020.

SSFL, located between Simi Valley and Agoura Hills, is the former site of extensive rocket fuel testing and where a partial nuclear meltdown occurred in 1959. The event and the resulting radioactive contamination was covered up for decades. Local residents continue to fight for a full clean up of the site today.

The JER study found radioactive particles associated with the fire at SSFL as high as 19 times background (normal) as much as nine miles away from SSFL, demonstrating contamination did leave the laboratory site. The study did note that widespread contamination from SSFL did not occur outside the perimeter of the lab property, where there were certain clustered areas of confirmed contamination from the lab. Those areas were in Simi Valley and Thousand Oaks.

The study summary noted that one sample labeled as 180 A, “collected 15 km from the SSFL perimeter (in Thousand Oaks, CA) had the highest alpha count rate of the entire sample set.”

Seventy mph winds were reported when the Woolsey Fire was burning in November of 2018 and concerns were quickly raised about the spread of radioactive contamination from the SSFL. The state monitored and took samples, and issued a report in 2020, but this new study, based on a much larger sample set, made different findings.

The newly released study is based on 360 samples of “house dust, surficial soils and ash,” with collection beginning in December 2018 and concluding February 2019. Samples came from private residences, with permission, public areas, and public areas along the SSFL fence line. According to the study summary, “community-volunteer citizen-scientists” were trained in “sample collection and safety protocols before collecting samples.” The areas sampled were from a 16 km radius around the perimeter of the SSFL property, including rural, urban, suburban and mountainous open space areas.

taken from “offsite” SSFL close to the property perimeter “had the highest alpha-emitting radionuclides radium, thorium, and uranium activities, indicating site-related radioactive material has escaped the confines of the laboratory.”

The study did not find and does not claim “widespread deposition of radioactive particles. However, two radioactive deposition hotspots and significant offsite contamination were detected near the site perimeter.”

The JER study also cites climate change as a factor in changing the impacts of fires that occur over soil containing contamination.

“The potential impact of climate change on radionuclide transport is two-fold, as increasing drought, fire frequency, and increased precipitation intensity result in greater post-fire stormwater transport of contaminated sediments. This increase is over and above the typical increase in runoff and sediment yield after wildfires.”

This new study’s finding are contrary to what the California Environmental Protection Agency (CalEPA) reported in 2020 (2), which was that no contamination left the laboratory area as a result of the Woolsey Fire.

The Woolsey Fire began at the SSFL site on Nov. 8, 2018 and concerns were quickly raised about the high winds and smoke carrying contamination offsite. The California Department of Toxic Substances Control (DTSC) set up air monitoring equipment on Nov. 10, 2018 to determine whether contamination spread and released a report of the results in December 2020. The state took samples of air, ash and soil from 22 locations.

The findings of that state research “did not identify a release of contaminants from SSFL. Like the interim report, this final report also finds the risk from exposure to smoke during the Woolsey Fire was not higher than what is normally associated with wildfire.”

DTSC is one of the state agencies responsible for overseeing the clean up of the site.

Local residents and scientists say the cleanup has been delayed, and the community is being harmed due to the state’s failure to ensure proper and full cleanup of the contamination.

Local clean up effort highlighted in documentary In the Dark of the Valley (acquired

Recommit to recycling during, after America Recycles Day

onday, Nov. 15, was the 25th annual national America Recycles Day, and this year’s theme was “I want to be recycled.” That may sound more like the promotional slogan for an all-natural funeral services provider, but it’s actually built on a curious phenomenon first discovered through focus group studies conducted by the California Department of Conservation (now part of CalRecycle, the California Department of Resources Recycling and Recovery) and used in its early 1990s campaigns to promote bottle and can recycling. People are more motivated to recycle when recyclable items are personified.

For example, a promotional image on an America Recycles Day web page featured a metal can next to a bicycle. In a dialogue box, as if the metal was narrating its life on a social media account, it said, “I used to be a can. Now I am blazing trails.”

Keep America Beautiful, the nonprofit partner of the U.S. Environmental Protection Agency which organized and promoted America Recycles Day events nationally, also employed another clever marketing method for increasing commitment to recycling. At www.kab.org/programs/ ard/pledge/ is the America Recycles Day 2021 pledge. As documented in his book Fostering Sustainable Behavior, Douglas McKenzie-Mohr explains how pledges are part of a good “community-based social marketing” strategy. People recycle more when they publicly pledge to do so, according to the author.

People pledge not only to “recycle more,” and “buy products made with recycled content,” but also to “encourage one family member or one friend to take the #BeRecycled pledge.” Thus, Keep America Beautiful continues to spread the message through “affinity marketing,” sending the message to new contacts through trusted sources.

Bolstering the psychological impact of the pledge, Keep America Beautiful employs yet another marketing method to increase recycling.

The website prominently features two recycling scoreboards. The first is the national recycling rate, which is 34%. The second is the number of people who have taken the recycling pledge this year on the Keep America Beautiful website. As of Nov. 15,

the counter on the website recorded nearly 88,000 people nationwide taking the pledge.

The personification of recyclables, the formality of a public pledge, and affinity marketing do not really increase my motivational level for recycling. But America Recycles Day organizers got me with the scoreboard. “Let’s get those numbers up!”

I involuntarily thought to myself.

Of course, one crucial element of increased recycling cannot be boosted by marketing. People need convenient opportunities to recycle.

In celebration of America Recycles Day, at the Ventura County Government Center, the General Services Agency (GSA) and the Public Works Agency provided one such opportunity with an electronic waste collection event. Cyndy Taschman, a GSA program administrator who helped coordinate the event, is already organizing another electronic waste collection event, which will be open to the public and will be offered in about six months. Recycling electronic waste conserves resources, funds job creation and keeps toxics out of landfills.

Still active in celebration of America Recycles Day is a tool to help the Ventura County Public Works’ Integrated Waste Management Division improve local recycling outreach and education. Complete a recycling survey at www.surveymonkey. com/r/673TZCK and become eligible to win sustainable prizes, such as washable metal straws.

The survey employs an additional marketing technique to promote recycling. It includes suggestions designed as questions. For example, respondents are asked to agree or disagree with these statements: “I have a dedicated place inside my home for recyclables”; “If I’m not sure an item can be recycled, I will toss it in the trash instead of contaminating the recycling by ‘wishcycling’”; and “When making purchases, I try to choose items without excessive packaging and/or packaging that can be recycled.”

Regardless of how you are motivated, America Recycles Day is a good opportunity to recommit to recycling.

In Brief Ventura’s winter plan for the unhoused Preparations are underway for supporting the unhoused during the colder winter months in Ventura.

The city of Ventura is partnering with the River Community Church to provide “stay warm packs” and temporary shelter during severe weather events, including rain, wind or very low temperatures.

The program will run Dec. 1 through March 31, 2022.

Donations requested include rain ponchos, blankets, jackets, hand-warmers, socks, toiletries, soft snacks, tarps and burying bags for items.

The plan also includes providing temporary shelter for up to 20 people in local motel rooms. The plan will be activated at least 48 hours before projected temperatures under 40 degrees or if rain over an inch and a half are expected overnight.

The rooms will be prioritized to those 65 and older or those with chronic health conditions, then the rooms will be distributed on a first-come, first-served basis.

To get in the queue for a room, individuals must arrive at River Community Church between 5 and 6 p.m. on the day of the weather event.

Donations of items can be brought to the River Community Church, 859 E. Santa Clara Street, Ventura.

Harrison awarded for reducing emissions Harrison Industries, a trash collection and handling company operating across Ventura County, has achieved 12 years of Climate Registered Gold for efforts to reduce greenhouse gas emissions from its operations.

The ranking is given by The Climate Registry, a nonprofit organization that monitors emissions and operates greenhouse gas reporting programs globally. The organization is given access to company data to track carbon emissions across operations, identify cuts and track company progress.

Earlier this year, The Climate Registry rewarded Harrison for surpassing net zero in emissions 21 times.

DA seeking more victims of sexually motivated crimes On Nov. 3 Erik Nasarenko, Ventura County District Attorney, announced felony charges against Martin Valdez Arias for allegations related to indecent exposure. Arias has been charged related to incidents with more than one victim.

According to the VCDA, Arias allegedly attacked a woman on a bike path along Highway 126 near Ventura Community Park.

7, 2021 and charged with false imprisonment by violence and attempted sexual battery.

Ongoing investigations by the Ventura Police Department and Ventura County Sheriff’s Office found evidence that supported new charges related to an incident on Aug. 30, 2021. At that time Arias allegedly exposed his genitals to a woman who was walking her grandson in the area near Tanager Street and Swift Avenue in Ventura.

The VCDA is investigating whether Arias may have committed other crimes while he was in the area since July 24, 2021. It is believed that he could have spent time in Oxnard and Ojai, in addition to Ventura and the unincorporated area in between those cities.

Those who may have been victims or witnessed a crime involving a man on a silver and black bicycle, who may or may not have exposed his genitals, are asked to contact District Attorney Supervising Investigator Christopher Borkovec at 805477-1647. Individuals who may not have been directly victimized but witnessed such conduct are also asked to contact Borkovec.

Arias is currently in custody without bail.

Ventura County Community College recognized for excellence Ventura County Community Colleges are included on a list of 150 community colleges across the country being considered for the 2023 Aspen Prize, an award of $1 million.

The Aspen Institute is a global nonprofit organization working toward a free, just and equitable society and through the Aspen Prize aims to promote higher education practices that improve student learning, completion and employment after college, with a focus on students of color and low income students on American campuses.

This is the first time that all three campuses — Moorpark, Oxnard and Ventura — in Ventura County are eligible at the same time.

Local press and statewide free speech org argue for release of autopsy reports In the wake of the tragic 2018 Borderline shooting in Thousand Oaks, an effort to seal autopsy reports of those victims has led to legal action now pending in state appellate court.

The companies that own the Ventura County Star and the Los Angeles Times along with the Associated Press have filed legal action to overturn an injunction put in place by Ventura County Superior Court Judge Henry Walsh that has indefinitely sealed autopsy reports for the Borderline shooting victims.

The First Amendment Coalition (FAC) has been joined by Reporters Committee for Freedom of the Press and the California News Publishers Association in submitting an amicus (“friend of the court”) brief joining in the argument that privacy concerns do not and should not outweigh the public’s interest and right to access public records, including autopsy records, which have always been subject to California’s Public Records Act. At the time of Walsh’s injunction, Assembly Bill 268, authored by Assemblymember Jacqui Irwin, was pending in Sacramento. Irwin pulled the bill prior to a vote in the state senate.

The bill would have allowed autopsy reports from victims of a criminal act to be sealed if certain additional conditions were met.

In a letter on the issue from FAC, the organization states, “Autopsy reports have long been subject to disclosure under the California Public Records Act. While there are reasons agencies may delay or deny the release of certain information or images, that’s not what happened in the Borderline case. Here, the trial judge blocked access completely and indefinitely, depriving the public of information that could shed light on the government’s actions in an unspeakable tragedy.”

FAC and the other entities arguing that the reports be released point to the importance of understanding what occurred, especially in this case, when it allowed the Los Angeles Times to report that the deputy killed in the incident was hit by a bullet from a California Highway Patrol officer’s gun.

The amicus brief states, “There is no law that allows Ventura County to refuse to release autopsy records, which are public records disclosable under the California Public Records Act. Indeed, the court below based their injunction on pending legislation, which did not pass.”

Oral arguments are not yet scheduled in the appellate court.

Community objects to RI-NU’s plans to reopen site of 2014 toxic explosion

P

ublic outcry is reaching a fever pitch early in the application process for the reopening of a wastewater treatment facility at Mission Rock Road. The facility is north of the Santa Clara River in an unincorporated area outside of Santa Paula and was the site of a 2014 chemical explosion and fire that caused the permanent disability of first responders and resulted in a multiyear criminal investigation and several indictments. At the time, the facility was operated by Santa Clara Waste Water Company (SCWW).

Themes of environmental justice, racism and climate change are being pitted against perspectives citing economic benefit and a need to manage waste, all within a broader context of holding local government, in this case Ventura County, accountable for protecting public health, safety and welfare.

“You can’t mitigate racism,” said Laura Espinosa, former Santa Paula City Councilmember and current president of Santa Paula Latino Town Hall, a local nonprofit organization advocating in the community for 25 years.

“We are strongly opposed to the application and the minimal mitigation recommended by the county of Ventura planning staff.”

Espinosa cited the recent resolution adopted by the Ventura County Board of Supervisors that stated “racism is a public health crisis, that means that every department . . . all should be looking at their policies and the way they do analysis with that perspective.”

Espinosa spoke before a crowd of about 85 people on Nov. 8 at the Santa Paula Community Center at a meeting hosted by the Ventura County Planning Division as a part of the environmental review phase of the process evaluating a reactivation of the permit for the facility with a new company.

The county has released a draft Mitigated Negative Declaration document that is subject to public review and comment through Nov. 30. The county identified two significant impacts: incompatibility with nearby agriculture and the risk from hazardous chemicals that will be used onsite to treat the nonhazardous wastewater.

While the city of Santa Paula has little authority over the site as it’s outside city limits, it does control municipal water service to the parcel. In a letter dated March 15, 2021, City Public Works Director Clete Saunier stated that the city would provide water for reopening of the facility, under various general conditions.

The mitigation measures being proposed by the county “to lessen those impacts” from the risk of handling and storage of hazardous chemicals are that the operator will do the following three things: 1. Adopt a risk management plan; 2. Adopt a chemical incompatibility training plan; and 3. Conduct annual tabletop response drills with staff and first responders replicating realistic scenarios that would require an emergency response.

The main change is that the new facility, as part of the Risk Management Plan, would be prohibited from receiving chemicals in totes or drums. It would only receive waste in trucks, and vacuuming of totes or drums into trucks (two aspects of the explosion and fires of 2014) would be prohibited.

To mitigate the negative impacts to agricultural resources, the county is proposing the applicant build a “vegetative screen” around the property, use dust control measures, and create and adopt a notification and response plan.

Many who spoke on Nov. 8 said there are more impacts not being considered, and the mitigations proposed are inadequate.

“It always finds a home”

It is a truism that where there is consumption there is waste.

How that waste is disposed of depends on what it is and where it can go. Basic food waste from our kitchens can go to our backyard compost bins or into our garbage.

But what about the more pernicious waste?

Waste products are generated from all sorts of residential, commercial and industrial activities. Porta-potties and septic systems at homes outside municipal sewage service areas, for example, have waste that needs to be managed properly and safely. In areas with active oil fields, the chemicals and additives used in drilling and production come back up with plenty of produced water that also needs to be disposed of.

Solid waste gets handled generally at landfills. But liquid waste gets treated for disposal at wastewater treatment facilities, and then it can be transported to licensed disposal facilities for permanent disposal.

There are various types and classes of facilities, with different requirements and regulations for each. Local governments determine where these types of facilities are located based on land use zoning rules.

About 60 years ago Ventura County authorized a wastewater treatment facility in the area between the cities of Santa Paula and Ventura, just north of the banks of the Santa Clara River. At the time, it was surrounded mostly by agricultural lands. Since then, more houses have been built in the immediate area, a school was built not far away, and the need for waste treatment and disposal only grew.

Until very recently the issue of environmental justice wasn’t on any planning department’s radar. But often, waste sites and industrial polluting facilities are found closer to lower income communities of color.

“If there is no place for waste to go, it always finds a home,” said Timothy Koziol, CEO of RI-NU Services LLC, the current applicant to reopen the facility. He said he’s been in the waste treatment business for a long time and “the problem is, if there’s not a good home for [the waste], it finds the wrong home.” He said “community leaders” in Ventura County have told him that “illegal dumping” is a problem in the county and could increase without properly permitted facilities like the one he is asking to operate.

“It’s not a scare tactic, it is what is happening across the country when there is no place for waste to go.”

Today these facilities may be subject to permitting requirements from the State Water Resources Control Board, the state and federal

Environmental Protection Agencies, local environmental health and public works departments, Office of Emergency Services, State Fire Marshal and so on. In California, the local land use authority, in many cases the city or county, is the primary gate for getting permission to operate, through a Conditional Use Permit (CUP).

CUPs are discretionary permits, meaning the county has the authority to approve or deny an application, and if it opts to approve, the permit can place various conditions of approval that must be adhered to or the permit holder risks violations with consequences, up to and including revocation of the permit.

This web of agencies creates a labyrinth of regulations that industry operators point to as demonstrative of strict oversight that protects the public. But in many cases, when a crisis hits, the process reveals built-in regulatory gaps that actually put the public at risk.

Interestingly, in the wake of the explosion at the SCWW facility, the county opted to “suspend” the permit rather than revoke it, despite the criminal activity of the permit holders. That fact now allows RI-NU to apply to renew or “unsuspend” the permit rather than having to apply for an entirely new CUP, which could very well have a higher threshold of approval.

What has changed since the explosion?

At the Nov. 8 meeting hosted by the Ventura County Planning Division, over 20 people, all of the public speakers, spoke against the pending application to reopen the wastewater treatment facility on Mission Rock Road.

The operating company at the time of the explosion, SCWW, was run by Doug Edwards, board chairman, and CEO William Mitzel. The criminal investigation found that their actions, along with other employees, led to the chemical explosion and fires at the site that released a toxic plume of smoke into the air and exposed first responders, including firefighters and ambulance personnel, to harmful chemicals, causing two people to be permanently disabled.

The site had been inspected by Ventura County Environmental Health the week prior to the explosion and received a clean check.

As part of the post-explosion investigation, it would come to light that SCWW also had a locked container on site containing chemicals the company had failed to report to the county and state, and which it was prohibited from storing. The county inspectors never asked for that large locked shipping container to be opened.

crowd at the Nov. 8 meeting. He clarified that he attempted to purchase SCWW in 2009 from Edwards. His company at the time was called General Environmental Management (GEM), a publicly traded company with the label GEVI. In the past year, that company has changed its name three times. But the acquisition was never completed. “Yes, I know them,” referring to the previous facility operators, but he stated that “none of them will be a part of what we do . . . whatsoever.”

William Mitzel of SCWW, however, signed his name on a RI-NU meeting sign-in sheet, dated Jan. 2018, as part of the development of a risk analysis report completed by EnSafe and paid for by RI-NU. Mitzel’s 36-month probationary period prohibited him from participating in the wastewater treatment industry during that time frame.

Koziol did not immediately respond to questions about why Mitzel was at the 2018 meeting. Mitzel could not be reached for comment.

On Nov. 8, Koziol emphasized that the RI-NU facility would only accept a “strictly non-hazardous waste stream” for treatment and disposal. But the site would need to use chemicals labeled as hazardous, which are used to treat the non-hazardous waste the site would be allowed to accept.

One of those regulatory gaps comes into play here with waste generated by the oil and gas industry. Chemicals, additives, biocides and other compounds that may be termed hazardous prior to use in the oil field are commonly used in the wells to aid in keeping the wells flowing. As those chemicals are flushed back up with the oil and large amounts of water produced with the oil and gas, they are now legally considered non-hazardous and can be accepted at facilities like the proposed RI-NU site. That water can contain “toxic metals and radioactive substances” according to the U.S. Environmental Protection Agency.

The EPA document that describes this loophole states that these fluids, once they are used downhold in an oil and gas well, “are relieved from regulation as hazardous wastes, the exemption does not mean these wastes could not present a hazard to human health and the environment if improperly managed.” (1) At the Nov. 8 meeting, Franca Rosengren, the case planner for the project with the Ventura County Planning Division, said that as part of RI-NU’s current application, the county hired outside consultant Dr. Daniel Tormey with Catalyst Environmental Solutions to study what was required and it was determined that the “existing safeguards and controls were inadequate.”

FEATURE In response, RI-NU hired EnSafe to develop a risk management analysis and determine the plans and processes required to improve safety at the site. Rosengren said these new “safety measures and controls” will be “added as conditions” to the CUP should it be granted.

Regulation limitations

Part of the regulatory conundrum is that it’s only as good as the implementation. In Ventura County, the planning division operates under a complaint-driven policy. This means that inspections occur as scheduled in response to complaints, rather than periodic unplanned inspections. All inspections are scheduled. In fact, the clean up that was happening at SCWW when the explosion occurred was in advance of a scheduled inspection.

Koziol cited a study done by the Ventura County Economic Development Collaborative (EDC) that he said determined the monthly payroll for RI-NU would put $140,000 into the local economy each month, adding that “that would turn into [$8.9 million] churning back into your marketplace. But we’d have to operate it correctly or it wouldn’t matter.”

Planning Division Director Dave Ward misspoke in response to a question about where the waste would be coming from. After the meeting, Rosengren confirmed that there are no restrictions in the permit application that would limit from where waste was accepted.

vcreporter.com When asked whether the planning division “vets” those applying for these permits, Ward said no, explaining that the county is obligated to process the applications it receives and does not engage in “vetting” the applicants. After the meeting, in response to inquiries from the Ventura County Reporter, Rosengren further clarified that the county does not look into applicants to determine whether they are in good standing with agencies such as the IRS or other government entities, even though it is a condition of CUPs that the permit holder must be in compliance with all applicable local, state and federal laws and regulations.

Voices speaking in opposition on Nov. 8 included many local Santa Paula residents, along with representatives from organizations including Wishtoyo and One Step a la Vez. Former Santa Paula Mayor Dr. Gabino Aguirre called out Ventura County, saying past concerns 10 years ago during permitting for the site “seemed like [they] fell on deaf ears . . . Ventura County, the Resource Management Agency were derelict in their responsibility to keep this community safe.” He said the fact that planning is not doing a complete EIR “speaks to the inadequate review of this project.”

Regarding the economic benefits cited by Koziol, Aguirra also stated, “If it’s so great . . . Well, take this project home with you and try to sell it to your community . . . waste always finds a home, you know what? Not in our house!”

“Govern yourself accordingly” Investment firm forces investigator to cancel presentation

n the night of Tuesday, Nov. 2, many of those seated in the full house at the Regency Santa Paula 7 movie theater gasped audibly when attorney Ron Bamieh revealed that the presentation scheduled that night would not take place due to his client Jeff Barry (also in attendance) being threatened with a lawsuit by a Missouri-based law firm.

Barry, who stood to Bamieh’s left, was slated that night to give a presentation about his personal experience as the lead investigator with the Ventura County District Attorney’s office (VCDA) on the multi-year criminal investigation into the 2014 chemical explosion and fire at Santa Clara Waste Water.

“Jeff got a letter . . . threatening him with a lawsuit should he talk about his experience investigating the case . . . He was fully intending to speak and make a presentation about the truth behind the investigation,” said Bamieh, standing at the wooden lectern in front of a bare white screen. “I’ve advised Jeff not to speak.”

Bamieh read the entire letter, interjecting his legal opinion about what it was saying, what it meant, and then responding to claims the letter made.

“Everything he was going to talk about is publicly out there,” including search warrants, said Bamieh.

Barry retired from the VCDA in 2018 following an 18-year career investigating fraud, human trafficking and financial crimes.

He holds a doctorate in management and a master’s degree in business administration focusing on management and organizational leadership. Barry has served as an instructor for the California District Attorney’s Association and is currently working in the private sector as a director of investigations at a publicly traded company.

The letter obtained by the Ventura County Reporter was addressed to Barry, but initially emailed to an address set up by the Santa Paula Times for RSVPs for the Nov. 2 presentation.

Dated Oct. 28, 2021, the letter was signed by Greer Lang, a litigator at the Kutak Rock law firm in Kansas City. Lang wrote that the firm represents C3 Capital, an investment firm and the “senior secured creditor” for Santa Clara Waste Water. She alleges that Barry scheduled the presentation “shortly before” a Nov. 8 public meeting being held by the Ventura County Planning Division about the current application to renew the Conditional Use Permit (CUP) for the wastewater treatment and disposal facility and further accuses him of “using your prior position and presumably information you obtained while acting as an investigator . . . to promote the same.”

Bamieh countered that accusation, saying that Barry had been “invited by the community” to give the presentation several months ago and that he was not involved in planning or scheduling the event.

The letter continues to criticize Barry’s plans to tell his story, stating “there is no legitimate reason for you to intentionally insert yourself into this process and that your sole reason for doing so is to intentionally interfere with Ri-Nu’s ability to secure a CUP Permit for the Facility and its efforts to re-open and operate the same.”

Victim restitution relies on permit approval

Lang goes on to refer to the 2019 agreement the VCDA made with the defendants in the criminal case that tied the full restitution payment to victims to the county approving the permits needed to reopen the facility. In fact the VCDA is listed as an “agent” on the deed of trust for the Mission Rock Road property.

Lisa O. Lyytikainen, chief assistant with the VCDA, confirmed that as an “agent” on the deed the VCDA in effect holds a lien on the property to ensure that the victims receive the compensation they are entitled to, in the event the property is ever sold.

According to documents online with the U.S. Environmental Protection Agency, SCWW also must compensate the EPA for their cleanup response to the incident. An official with the EPA confirmed that SCWW has made an initial payment pursuant to this agreement, and two more payments are scheduled, for a total of $111,000.

The full restitution amount agreed upon between the defendants and the VCDA for the victims is $3,597,621. Some payments have already been made. As of Monday, Nov. 1, the remaining balance owed to victims was $2,633,658, which must be paid within 30 days of RI-NU Services obtaining the required permits to reopen the facility.

The “disposition” agreement filed with the court in June 2019 solidifies that arrangement and states that the parties “expressly [ understand ] and agree[d] that the issuance of such permits . . . and clearances is a condition precedent to the obligation to make payment of the balance of such victim restitution amount.”

Lyytikainen further explained via email to the Ventura County Reporter that while the VCDA did secure the restitution amount during the criminal proceedings and agree to the timeline triggering payment of that amount being tied to the granting of the necessary operating permits for RI-NU, “Restitution is a legal obligation regardless of permitting . . . corporate defendants Santa Clara Waste Water Company and Green Compass Environmental Solutions were ordered by the court to pay victim restitution on August 23, 2019.

Under Penal Code section 1202.4(i), victim restitution is enforceable as a civil judgment in the full amount owed regardless of whether or not a foreclosure occurs on the Mission Rock Road site.”

So in the event that the permits are not granted, the judgment for restitution still stands as an enforceable order of the court. The question now becomes, who enforces the order?

If the permits are granted, then pursuant to the disposition agreement, the VCDA would enforce the restitution payment timeline — which would require the full $2.6 million to be paid within 30 days of the permits being granted.

C3 Capital reports on its website that it has $500 million in invested capital.

However, Dominic Kardum, supervising senior deputy district attorney with the VCDA confirmed that in the event that the permits are not granted, then the victims must enforce the civil judgement for restitution.

“No, the VCDA would not enforce the judgment in that scenario,” Kardum replied via email.

This effectively leaves the victims on their own, to hire their own attorneys to try and recover the remaining amounts they are due.

On Nov. 2, Bamieh challenged the notion in the letter that Barry was somehow required to ask the VCDA for permission to speak. “I find that interesting.” He explained that he also formerly worked for the VCDA, from 1992-2002. “I have not sought their permission to speak here tonight. Do you know why? It’s called the First Amendment, you don’t have to ask permission.”

Bamieh did encourage the crowd to call Lang and ask why their clients want to keep Barry from speaking. “Who decided it was a good idea to threaten Jeff Barry? . . . What are you so scared of?”

Lang’s letter concludes, “You need to be extremely careful with regard to what you do, say and disclose . . . Although you had certain protections while acting on behalf of the District Attorney’s office in your official capacity, as a private citizen, those protections are gone . . . You are hereby advised that our clients and those harmed by your actions will take all actions necessary and appropriate to protect their interests to the maximum extent permissible under the law.” The letter concludes with, “Govern yourself accordingly.”

Bamieh said, “How you respond to this is up to you . . . the truth doesn’t seem to hurt many people who are looking for justice.”

wo whip-smart productions prove that live theater in Ventura County is not only back, it’s better than ever.

Rapture, Blister, Burn at Santa Paula Theater Center through Nov. 28, and Severance Play at The Elite through Nov. 21, signal more than a reopening. They feel like a reset.

A Pulitzer Prize finalist, Gina Gionfriddo’s Rapture, Blister, Burn wrestles with questions about paths not taken and the price we pay for the decisions we make.

During the closing ceremonies on Saturday, Nov. 13, the Ojai Art Center Theater hosted a special screening of Zhao’s 2017 film The Rider. Zhao herself came to the screening — a completely soldout event with an overflow room. Fans traveled from near and far to see the famous filmmaker, who has made waves in Hollywood both with Nomadland and her blockbuster entry into the Marvel Cinematic Universe, Eternals, currently in theaters.

Following the screening, Zhao joined Ojai Valley News publisher Laura Ward onstage for a Q&A session. The evening concluded with a spirited closing party, where guests danced to tunes courtesy of DJ Funshine.

Fossil Fool?

My husband died of a heart attack at age 75. On his phone, I saw several unsettling texts from younger women, alluding to improper liaisons and asking for money. We often helped needy families, but I’m suspecting these women tempted and took advantage of a kind, caring old man, or maybe he turned dirty old man (looking for something more exciting than his wife). Before his death, he started viewing pornography online and seemed not quite himself. Could this apparent change in personality point to dementia?

Finding these texts has turned my grieving upside down. I’m often

angry with him for possibly cheating on me. I’m not sure how to put this to rest in my mind.

—Perplexed Widow Sadly, elderly men are often easy prey for young scamstresses. These women sexually tempt or even just flatter an old man out of his money — all, “You remind me of that dude from ‘Star Wars’!” — making him think of himself as a young, hot Harrison Ford (when the “dude” he actually resembles is Yoda).

I’m so sorry — both about the death of your husband and the apparent death of what you believed about him and your marriage. But I’m hoping my frank exploration of what you do and don’t know will help you make your way to peace of mind.

First, it is possible your husband’s apparent behavioral changes were due to dementia. Dementia is not technically a disease but an umbrella term for “a decline in mental ability severe enough to interfere with daily life” (per the Alzheimer’s Association). Symptoms include personality changes, memory issues, and impaired reasoning. “Alzheimer’s disease is the most common cause of dementia, accounting for 60 to 80% of dementia cases.”

My friend Stef Willen wrote

movingly in her McSweeney’s column about the tragic thief of self that is dementia, explaining, “For most of my life, my days with my grandmother had been spent hiking, identifying birds and having beers in a small-town Colorado bars. ...

I’d always thought she’d die of a swift heart attack, but death snuck in the back door and did a real hit and miss job. None of us even noticed until the essential parts of her began to go missing.”

Her grandma’s doctor explained to Stef that her grandma’s neurons weren’t communicating. Some were dead, and some weren’t firing in the correct pattern. As Stef put it: “Apparently, who we are is an electrochemical reaction, and my grandmother had blown her circuits.”

Dementia messes with the functioning of the brain’s “prefrontal cortex” (PFC), the section just behind your forehead. If you think of your body as a factory and your behavior as the workers, the PFC is the executive boardroom of you: in charge of planning, prioritizing, remembering, reasoning, and “inhibitory control” (professor-ese for resisting temptation). That last one, when the PFC’s cells are in healthy working order, keeps us from just giving in

to whatever impulse — sexual, gluttonous, violent, or just rude — flies into our head.

But let’s back up a sec. You don’t know whether your husband had dementia, as he was never diagnosed.

Sure, you’ve pulled together disturbing fragments of information, and they’re pointing you toward a conclusion. But you can’t know whether your conclusion is correct — though I’m guessing you strongly suspect it is, because that’s how our minds evolved to work.

Uncertainty — ambiguous situations, partially answered questions, and other forms of mental untidiness — fill us with anxiety and dread.

This makes evolutionary sense — survival sense — because wanting these uncomfortable feelings gone motivates us to try to get answers and information. Knowledge we acquire (of possible lurking harms) really is power: power to take meaningful steps to protect ourselves.

However, our brain has a feature (that’s also a bug!): a psychological mechanism in the left hemisphere — named “the interpreter” by cognitive neuroscientist Michael Gazzaniga — that works like mental grout. When we’re wading through ambiguities or spot inconsistencies in our behavior

(or others’), the interpreter creates stories to fill in the blanks: stories that make us feel comforted, consistent, and smart. Conveniently, no sooner does our mind spin some explanatory yarn than it turns right around and believes it, as if it were cold, hard fact.

Since you can never know the full story, it’s pointless to torment yourself by rerunning painful bits of information and guessing. However, you could find comfort by using that crafty bugger, the interpreter, to your advantage. Shift over to the story you do know — the happy, loving times you two shared for decades — and focus on that. If you’re gonna go in for torment, make it a healthier class of it — like hot yoga (aka the commercialization of hot flashes paired with stretches easily accomplished by anyone who finds a wizard to turn them into a wire twist-tie).
