Fees “wrongly and improperly” implemented Oxnard ordered to return $34 million to utility funds

n a decision dated Dec. 28, 2020, signed by Hon. Matthew P. Guasco of Ventura County Superior Court, the city of Oxnard has been ordered to return $34 million back to the city’s utilities funds. The money was transferred over several years to the city’s general fund in what the court deemed is a process unsupported by how the city calculates costs of those services.

The decision is the result of legal action filed in 2017 by Oxnard resident Aaron Starr, who is frequently embroiled in city controversy when he raises complaints, funds ballot measures, runs for office and files legal action. In this matter he alleged that the city was charging residents a fee for a particular service, like water, then transferring at least a portion of that fee into the city’s general fund. This essentially makes the fee a tax because, as defined by state law, it is no longer tied directly to the costs of those utilities. Taxes must be approved by a vote of the people.

While the court has ordered the city to put all the money transferred to the general fund back into the funds for the various applicable utilities, the court did so “without prejudice” against the fees themselves, saying the city needs to change the way it calculates the fees, called Infrastructure Use Fees (IUFs), and the amount of any transfers to the general fund, because the current method is flawed, resulting in a violation of state law. The court also said that certain “indirect costs” associated with various utilities can be covered by these fees, but the city has to correct the way it calculates those costs.

“The Court’s ruling...explains that the City’s action was not illegal but rather the City implemented the IUF wrongly and improperly, therefore the City must return the $34.5M IUF funds to the utilities,” said Alexander Nguyen, city manager of Oxnard in a written statement issued Dec. 30.

“The ruling makes it clear that the City can in fact implement the IUF if done so correctly.”

Nguyen expressed frustration at Starr’s methods, “I do agree that this must be done correctly, but that’s entirely different from Mr. Starr’s desire to get rid of the IUF altogether. Intentions and consequences matter.” He pointed out an immediate effect is a reduction “in work, services, and programs for the residents and businesses in Oxnard.”

Fees vs. taxes

The court order cites California Propositions 13, 26, and 218 as prohibiting “municipalities from enacting special taxes in the guise of use fees or surcharges without voter approval.” A use fee may not “exceed the sum required to provide property related services,” and “revenues...from a use fee” can’t be used for anything “other than that for which the fee is imposed.” Use fees cannot be used to fund services like fire, police, street work and other services that are available to all members of the public to the same extent. Use fees must be tied to the cost of services provided to that specific property.

Prop. 218 puts the burden on the municipality to prove “by a preponderance of the evidence that a levy, charge, or other exaction is not a tax, that the amount is no more than necessary to cover the reasonable costs of the governmental activity,” and that how those costs are allocated “to a payor bear a fair or reasonable relationship to the payor’s burdens on or benefits from the governmental activity.”

Starr alleged the city “violated” these prohibitions, and thus the California Constitution by charging residents a “use fee...for water, waste water, and solid waste disposal services,” which was not directly tied to the cost of individual property service.

The court order states, “Starr argues that the IUFs exceed the reasonable sum associated with providing the respective services to property owners,” and that Oxnard “transferred

IUF fees from the utility services budget to City’s general fund,” in higher amounts than it costs the city to subsidize the cost of utility services.

The allegations include transfers of funds that occurred starting in 2014-15 fiscal year through 2017, with some continuing today.

The city argued the transfers were appropriately tied to costs as determined in a 2012 cost-of-services study. The court found that study flawed.

The court found against the city and the order states that the “city has failed to meet its burden of proving that the IUF transfers responsibly represent the cost” of the city providing the various services to property owners.

The order directs the city to stop transferring any more funds from the utility funds to the general fund, “based on the current methodology,” and orders the city to “restore to the respective utility funds all IUF monies transferred to the public safety, government agency and streets and roadway funds” for the applicable years.

The court clarified that the “ruling is without prejudice to [the] City’s establishment of an IUF transfer methodology which reasonably represents the actual cost” to the various city sectors at issue and states there may be indirect costs in those sectors that can be covered by IUFs. “The court simply finds the city has failed to prove its current method of calculating IUF transfers complies” with state law.

The court did not go so far as to grant Starr’s request that the city be compelled to rescind the IUFs, stating “these claims are not supported by the law or the evidence.”

Reduce waste and help local species with winter gardening tips

by David Goldstein ardening has always been a popular hobby, and interest in planting and tending plants has surged during the social isolation period of the COVID-19 pandemic. As one measure, “the renowned seed company Burpee sold more seed packets this spring than at any time during its 144-year history” and “Britain’s Royal Horticultural Society has seen a five-fold rise in queries for gardening advice on its website during the lockdown,” according to the landing webpage of goodnewsnetwork.org, quoting news first reported by Reuters.

Locally, the Ventura County Master Gardener program, organized through the University of California Cooperative Extension office in Ventura, is also experiencing high demand for gardening advice. The organization has modified its help line so volunteers can continue assisting the public without endangering their own health during the pandemic. The Master Gardener helpline desk has temporarily shut down its phone service but continues to respond to emails. If you need gardening tips, email questions to mgventura@ucdavis.edu.

Also, you can still bring plant samples to the UC Cooperative Extension office for identification of plant types and analysis of problems. Bring plant samples to 669 County Square Drive, Suite 100, Ventura. There is a bin with instructions outside the main door of the office.

The Master Gardener program is still seeking new recruits, although the next Master Gardener training class is not scheduled until September 2021.

the environment in at least five ways. Planting selection and garden design can help local animal species thrive; planting gardens to slow, spread and sink water reduces runoff to the ocean; planting shade trees and reducing paved areas cools urban areas; plants produce oxygen, consume carbon dioxide, and filter particulates, improving climate and air quality; and food-producing plants can reduce food packaging and pollution associated with transportation.

On the first point, related to the potential for local gardens to benefit local animals, nearly a decade ago, Dr. Reese Halter, who was then on the faculty of California Lutheran University, calculated that bee pollination contributed over $180 million annually to the economy in Ventura County. In workshops titled “Birds, Bees and Butterflies” and “Herbicides and Pesticides Explained,” Dr. Halter taught methods for reducing pesticides without causing infestations as well as the following ways local gardens can help. His advice included limiting lawns; grass offers little food or cover for wildlife. Increase vertical laying, creating plant structure between the ground and the tree canopy. Provide water, but take measures to ensure you do not breed mosquitoes. Replace exotic and invasive plants with native vegetation to provide food and cover.

On the final point listed above as a benefit of gardening, growing your own food reduces packaging. Fruit and vegetables often come from supermarkets in plastic packaging, and transport packaging used to move produce from fields to your supermarket shelves includes pallets, shrink wrap and pad-

ding. Growing your own food avoids this waste.

Of course, Ventura County’s productive soil and sunny climate sometimes result in an excess of food produced by diligent gardeners. Avoid food waste of this type by giving excess to neighbors and friends. To give away food while social distancing, put a box of your excess produce on your curbside with a sign saying “Free,” or list it for free curbside pickup on Freecycle.com, the Ventura County Free Barter and Trade Facebook group, or the free section of Craigslist. For especially large harvests, contact Food Forward or FOOD Share, which glean for the hungry.

With the onset of winter weather in Ventura County, many local gardeners this month, including my wife and me, are planting seeds in raised beds, preparing to grow lettuce, peppers and tomatoes. Others grow celery, chard, spinach, eggplant, radishes, kale, broccoli, beets, cauliflower and cabbage at this time of year. In parts of the county with harsher weather, some start these seeds indoors.

As much as we try to control it, there is part of our business that will always be unpredictable, from the awful California wildfires to newly elected presidents and politicians. . . . We do this because we appreciate the end product so much. Whether it’s helping someone with addiction, an elderly person with chronic pain, or an Army vet that can’t sleep, improving the everyday lives of people is truly invaluable.

Where do you see things going with your business in the near future?

The next 5-10 years?

We are in the midst of an aggressive expansion plan. We are in different phases of licensing all across the country and state. We see federal legalization within the next two years and once that happens, watch out!

Carrizo Plain National Monument celebrates its 20-year anniversary

ying hidden in waist-high coyote bush, green ephedra and Canadian milkvetch, I observed a San Joaquin kit fox pup, the smallest fox on the North American mainland. After brushing a legion of pesky ants off my legs, the curious fox detected my subtle motions and alertly peered at me from the other side of its prominent den mound, 30 yards west of where I sat.

If not for its enormous ears — the largest of any canid in North America — I may have entirely missed the curious pup; its four siblings remained hunkered down below. As it strained its neck to keep watch on me, a lone tule elk bull sauntered off my left flank to the south as the morning sun crested the Temblor Range within the Carrizo Plain National Monument.

Nearly entering the annual rut, that solitary tule bull blurted out a bugle call heard hundreds of yards away where his harem of tule cows gathered near Soda Lake Road. The cool, crispy air revealed its breath wafting skyward. That broadcasted bugle carrying across the plain sent the young kit fox bolting down below.

Final frontier

Grassland fauna thrive unfettered here, a small blade of wilderness holding on in the Southern San Joaquin Valley and lying just beyond the northeastern fringe of Highway 33. At 246,812 acres, 50 miles long and 15 miles wide, the Carrizo Plain is the largest single native grassland habitat remaining in the Golden State. It celebrates its 20th anniversary as a national monument on Jan. 17, 2021.

The Carrizo Plain constitutes the last bastion for many species of native flora and fauna, including more endangered species than anywhere else in California. It is also a haven for ungulates like tule elk (Carrizo herds are some of the fastest growing in the state) and the struggling pronghorn antelope.

The national monument is cooperatively managed by the U.S. Bureau of Land Management, the California Department of Fish and Wildlife and The Nature Conservancy. It also relies on a throng of nonprofits seeking to enhance a natural balance across the grasslands.

“The wildflower displays can be extraordinary. But even in years when they aren’t abundant, it is still a beautiful landscape,” said Johna Hurl, monument manager for over 20 years. “In the spring you may catch a glimpse of some kit fox pups playing at their den. They often sunbathe and can be seen playing with each other. Sometimes you may see the elk calves as they run with the herd. Antelope ground squirrel young can often be seen along the roads scampering around by the salt bushes.”

Wandering in solitude

My curiosity won out. I needed to know what was concealed inside the tumbledown trailer resting lonely for who knows how long.

I pulled over, camera pack affixed, and walked over to seek out signs of life, mainly opportunistic wildlife that may have claimed the human relic for their own. Whoever dwelled there previously had left a potpourri of debris, some of it unexplainable: piles of newspapers, a wheelchair, legions of tires walled into a perimeter surrounding the gutted dwelling. Old office desks struggled to stand on their own.

Suddenly, a solitary barn owl took flight, barely clearing an open door hanging by one rusty hinge.

After slowly walking up the steps, I cautiously peered inside. There was plenty of trash strewn inside the entire trailer, but nothing stood out more than the graveyard of giant kangaroo rats piled 6 inches high

on the floor.

It was a horrid sight to behold, these hundreds of carcasses gutted by an extremely efficient barn owl. But it was also a good indicator revealing the health of the grasslands.

Biologists have told me several times in the past that as the giant kangaroo rat goes, so goes the rest of the Carrizo Plain. The rats are a reliable food source for a whole smattering of wildlife across the grasslands, from kit foxes and rattlesnakes to long-tailed weasels and a bevy of hawks, falcons and owls. Their expansive burrows are adopted by nesting burrowing owls, antelope ground squirrels, kit foxes and American badgers, who make them their own, nearly ready-made dwellings for life on the grasslands. Giant kangaroo rats also enhance browsing habitat for tule elk and pronghorn antelope.

As for that gutted trailer, there are certainly a few of those scattered across the monument. There are plans to remove the worst of the eyesores and in turn enhance an already unique landscape.

“We’re working with the Bureau [of Land Management] right now to address a collection of long-abandoned trailers left on monument land by an adjoining landowner,” said Jeff Kuyper, executive director of Los Padres ForestWatch, a regional nonprofit keeping a keen eye on the well being of the Los Padres National Forest and the Carrizo Plain.

Open space required

While dark gray storm clouds broke apart, brilliant shafts of sunlight beamed downward onto the grasslands. A herd of at least 30 pronghorn antelope that had bedded down most of the day felt the warmth of the sun and began browsing.

From my vantage point, I could see a wired fence in the way of the pronghorns’ path, a potential impediment for North America’s fastest land mammal. Naively, I thought the pronghorn would leap over it, but one by one they deftly dipped beneath the weather-beaten fencing.

Close to extinction between the late 1800s and early 1900s, efforts were taken to translocate 200 animals from Northeastern California to the Carrizo Plain in the late 1990s. Since then, pronghorn have had a difficult time reestablishing a stable population within the national monument.

Old, rusty fencing is a factor. Although lots of barbed wire fencing has been removed by volunteers, there is still a lot out there, especially outside the monument where pronghorn want to naturally migrate. Drought has been an issue for pronghorn as well. They require open spaces and are therefore specified eaters. Tule elk, by comparison, possess a more diversified menu of grasses, herbs, woody chaparral and trees, and can locate more browsing options from the grassland floor up into the rolling foothills.

“We would like to see more fences removed, to facilitate movement across the landscape by pronghorn and elk,” said Kuyper. “We’d like to see a full-fledged effort to identify threats to the pronghorn population on the Carrizo Plain, which has struggled for the last few years. Pronghorn are an iconic species of the area and we need to Antelope ground squirrel. do everything we can to ensure their survival.”

Today, pronghorn can be seen on the Carrizo Plain National Monument, but their numbers are low, less than 100 individuals separated into small herds.

Mountain high perspective

Crunchy frost clung to my mountain bike like grim death, my hands purple from grasping the grips of my frigid handlebars. It forced me to furiously peddle, keeping warm while ascending to the Caliente Ridge on the west side of the Carrizo Plain.

Binoculars were an essential item required while soaking in all there was to see not only on the grasslands, but also the open-book-shaped mountains east and west of the monument. The first overlook revealed a huge swath of grasslands and then there was Soda Lake, the largest natural alkali lake in Central and Southern California. From that vantage point, I was just entering the first stands of pinyon-juniper woodlands just above impressively weathered sandstone rock outcroppings. Scanning with my binoculars, I caught a rare glimpse of a bobcat surveying the rolling hillsides and a golden eagle soaring high overhead. I also spotted a prairie falcon and a migrating ferruginous hawk, raptors ruling the airways above the grasslands.

As steep sections of the Caliente Road winded upward, my appreciation for this wild place intensified. From here, the 50-mile-long stretch of grasslands broadened while ascending further

toward the summit of the Calientes at 5,106 feet. The immensity of this fragile biome was now in full view. And yet, I attempted to imagine this grassland ecosystem a couple hundred years prior when it once extended 450 miles from Redding south to just beyond Bakersfield. It was a habitat that once teemed in flora and fauna rivaling the sweeping plains of East Africa.

Today, visitors settle for a sliver of that, a dichotomy of woe for what has been lost and gratitude for what remains. Beyond the boundaries of the Carrizo Plain, however, expansion has crept in from the north. The Carrizo Plain Conservancy, a nonprofit, has taken on the task of acquiring adjoining lands, creating much-needed open space and corridors to enhance movement for struggling pronghorn antelope, an animal that easily Yellow goldfields and purple thistle sage. eclipses 50 mph, and for endangered species like San Joaquin kit foxes, blunt-nosed leopard lizards, giant kangaroo rats and antelope ground squirrels.

“Any adjacent lands to the monument do continue to add corridors that could benefit wildlife,” said Hurl.

Finally, at the summit, I reveled over the expansive plain below. Late afternoon cumulonimbus clouds hovered above the daunting Temblors and long shadows gradually crept across the Carrizo Plain. There is no other place like this in California.

The grasslands, however, remain threatened by oil extraction on the west side of the Caliente Mountains. The next decade will determine the overall health and diversity of this stunning biosphere. Much will depend on the ongoing grind of tireless conservationists.

“So much work has been done over the course of the last two decades to restore degraded areas of the monument,” said Kuyper. “Miles of barbed wire fencing has been pulled, invasive plants have been removed, a management plan has been prepared. But so much more can be done, and there is a growing alliance of nonprofit organizations with the will to do it.”

The sea is a big part of our life,” says Adri Howe, executive director of the Channel Islands Maritime Museum (CIMM), as she muses on a painting by 19th century Dutch artist Hermanus Koekkoek, “Mending Nets by the Shore.” “People making a living . . . very mundane activities.

But I like that a lot of the artwork here focuses on people.”

Not just people, of course. CIMM’s vast collection runs the gamut, from dramatic battles on roiling waters to detailed renderings of ship life to serene seascapes, dating from 1622 to the present day.

There are also impressive ship models (many made by the famous molder builder Edward Marple — whose entire collection resides here), a stunning rendering of Ming dynasty mariner Zheng He, exhibits on whales and sailors, hands-on activities for kids, a research library and more.

All this in a lovely two-story building in Channel Islands Harbor with some of the best views in the area.

It’s no wonder that CIMM has been so beloved by the community, which prepandemic showed up in droves to participate in its many special events throughout the year.

In 2021, this expansive and well-organized museum celebrates its 30th anniversary.

The Nelson legacy

The story of CIMM begins with Harry Nelson, a local businessman and owner of Anacapa Isle Marina, who with his wife, Joyce, shared a taste for maritime history and culture. Through the decades, they amassed an impressive collection of ship models,

marine artifacts and maritime art.

“It was a collection that developed over several years,” explains Howe. “They had such a good eye for art.”

To house this collection, share it with the community and create a cultural center, the Nelsons joined forces with Fisherman’s Wharf developer Martin V. “Bud” Smith.

Together they opened the Ventura County Maritime Museum in 1991 in Fisherman’s Wharf. It moved to its present location in 2012, and was renamed the Channel Islands Maritime Museum.

There are works by 17th-century Dutch and Flemish masters like Ludolf Backhuysen (also spelled Bakhuizen), Willem van de Velde the Younger and Adam Willaerts. Willaerts’ “Dutch Men-of-War Off a Rocky Coast with Fisherman on the Beach with Their Catch,” painted in 1622, is the oldest painting in the museum. British Romantics of the 18th and 19th centuries include Edward William Cooke and John Christian Schetky. The museum also displays paintings by French and American artists of the 20th and 21st centuries, such as Eugène-Louis Boudin (a tremendous influence on Claude Monet), Christopher Blossom and David Thimgan.

While the museum hosts traveling exhibits several times a year, and has acquired a variety of new pieces since Harry Nelson’s passing in 2002, the original collection remains the heart — and pride — of the museum. The Nelson family, through the children and grandchildren of Harry and Joyce, remain involved as well.

“We raise or own funds, through private donations, foundations and grants,” Howe says. “But we always have the support of the Nelson family behind us. It’s nice that the people who had an interest in this collection still have an interest in this collection. They love this museum.”

First- and second-place winners in four categories — Best Ship’s Soup or Stew, Kids Crew Culinary Creation (for those 16 years and younger), Best “Hidden Treasure” Cookie or Bar and Best Captain’s Cocktail (must contain rum; for ages 21 and up) — will win prizes, such as CIMM memberships, signed prints and rum from contest sponsor Black Bart Navy Rum. Recipes and a photo of the concoction must be submitted by Jan. 21.

In February, it’s “I Love My Maritime Museum,” when members of the public can share thoughts about what they love about CIMM, and place virtual stickers on an online bulletin board to show their

Howe says that the museum used the downtime brought on by COVID-19 to make new plans, reorganize, digitize the collection and reimagine exhibits with a fresh perspective.

“It’s just expanding the horizons,” she says. “Adding extra touches to the exhibits that we have.”

“It’s been a unique time,” Howe continues. “[The shutdown] couldn’t have come at a better time for us, as we’re thinking and re-evaluating. These last few months let us get a new direction. We are eagerly and excitedly looking toward the future.”

’ve been going back through the many releases from mid-October forward that I hadn’t had a chance to give a spin and finding ones that deserve to be heard. So in the spirit of better late than never, here are some albums that would be worth some of your music listening time.

New releases from Will Kimbrough, Bubble, Bee Bee Sea and more

by Alan Sculley Will Kimbrough - Spring Break

I find most albums that are largely solo acoustic lacking. It’s not that the songs don’t have merit, but I usually feel like the songs would benefit from additional instrumentation. Spring Break is a largely acoustic solo album, but it’s the rare one where a case can be made that this was the right way to treat the songs. On his new album, Kimbrough writes vocal melodies that demand notice, and supports them with guitar parts (and occasional harmonica) that are imaginative, but don’t upstage his singing or his lyrics, which are perceptive and incisive. That’s not to say that I can’t hear a rhythm section or additional instrumentation working for many of the songs, but “My Right Wing Friend” (one of several tunes that touches on our pandemic times), “Philadelphia Mississippi” and “My Sin is Pride,” to name a few examples, feel like they were meant to be minimal with little to get in the way of the song and the story.

Kimbrough’s songwriting and playing talents have been evident for two-plus decades across nine solo albums and with several bands, including Will & the Bushmen and later on Daddy. I still prefer Kimbrough’s full-band work, but creating songs strong enough to hold up in this most stripped back of settings is an impressive achievement.

Dead Famous People - Harry

The history of Dead Famous People dates back to the 1980s when frontperson Dons Savage (back then, she was Donna Savage) formed the group in New Zealand. Despite getting signed to influential label Flying Nun and gaining some notable supporters (including John Peel), Dead Famous People never caught on and Savage ended up dropping out of the music scene for two-plus decades.

Savage, though, started writing music again a little while back and the result is the first proper Dead Famous People album, Harry.

This is a near-flawless ’60s-rooted album in the classic pop tradition of the Brill Building songwriters. Several of the songs (“Looking at Girls,” “Goddess of Chill,” “Turn on the Light” and “Safe and Sound”) rock along at a pleasant pace and possess immediately appealing, well-developed vocal melodies and plenty of instrumental ear worms along the way. The buoyant charm of those songs are balanced by a pair of nice ballads, including the piano-laden title song and “Dead Bird’s Eye.” Considering the consistently excellent quality of Harry, it makes one wonder how many memorable albums Savage might have made before now had success come calling back in the ’80s. Clearly, Savage never lost the touch for crafting timeless pop music.

Bubble - Other Broken Dreams

The beginnings of Bubble date back to the mid-1990s, when the group started out as a folky acoustic trio fronted by Dave Foster. By 2000, the group had evolved into a pop-rock group, releasing an album, Bash Bish, that was produced by Fred Smith of Television. The group hasn’t been prolific. A sophomore album, “Seconds,” followed in 2009 and now, with a new four-person lineup in place, comes Other Broken Dreams.

A few vestiges of Bubble’s acoustic days shine through on the song “There Is Hope,” although the largely acoustic song is quite poppy. The rest of the material is plugged in and has a notable Beatles influence without sounding at all like an imitation. For instance, “Bye Bye” is a slow, dreamy and psychedelic/Middle-Eastern-infused tune that could fit on any of the Beatles’ post-Sgt. Pepper’s albums. Foster and his bandmates also build a good bit of jangle into several songs, including “Don’t It Make You Wanna Cry,” “You Don’t Have To Say It” and “Don’t Do Me Wrong,” which come with strong vocal melodies and sharp chord changes – things the Beatles did exceptionally well. But Bubble also shows a slightly more rocking sound on occasion, as on “Be Careful” and the driving and catchy “Make It Through.” The songs here are multi-faceted and show more creativity and originality than most pop/rock music, all of which makes one wish we’d get albums more often from Bubble.

I Don’t Know How But They Found Me - Razzmatazz

This duo (former Panic! At the Disco member Dallon Weekes and Ryan Seaman) has one talent that makes it stand out from a lot of synth-pop acts: writing some pretty undeniable vocal melodies. When the songs on the debut album, Razzmatazz, have the hooky vocals — as on “From the Gallows,” “Clusterhug,” “New Invention” and “Lights Go Down” — the songs click. When the vocal melodies come up short (“Leave Me Alone” and “Sugar Pills”), there isn’t much else to carry the song because I Don’t Know How But They Found Me isn’t too snazzy when it comes to writing instrumental accompaniment. The beats alone can’t salvage such songs. Fortunately, there are only a couple of duds on Razzmatazz, and the rest of the album is a confectionary treat.

Bee Bee Sea - Day Ripper

Bee Bee Sea sounds like it may have consumed a lot of coffee before recording the songs on Day Ripper. But let’s thank whatever fueled these guys because the caffeinated energy, combined with the band’s ability to write guitar riffs that are jagged, sometimes herky jerky, yet catchy as it gets, makes for a fairly thrilling and distinctive sound. While most of the songs have similar hyper-speed beats, there is enough variety in the song arrangements as well as the guitar tones – they’re strummy and pleasantly tinny on “Destroy,” plucky and a bit clipped on “Horst Klub” and heavier on “Drags Me Down” – to give the album some contrast and flow.

— Unsettled Be glad your friends are not in charge of airplane maintenance. It’s annoying when a nonstop flight makes an unscheduled stop — especially when it involves going down in flames in a cornfield.

We’re given training in how to read, write, and drive, and if you go on YouTube, somebody will teach you how to do magic tricks with your blender.

Only in our romantic relationships are we expected to be untrained geniuses.

Unfortunately, this expectation pairs poorly with therapist Albert Ellis’ realism on what it means to be a person (in language he suggested to a client): “I’m a human, fallible being who screwed up and may screw up in the future because (of) my fallibility.”

So, though there’s a tendency to see therapy (for individuals or couples) as something you do only when you’re broken, it shouldn’t be that way. It can be a tuneup to help a good relationship be even better. For example, when I do relationship mediations for couples, I help them see each other’s sometimes conflicting wants — he wants this/ she wants that — not as threats but as mere facts to manage (with love and respect). You can find your partner’s request unreasonable or even crazy, but if it’s not a big deal for you to come through, maybe you do it simply because you love them and want them to feel good. (If it is a big deal, you can at least tell them lovingly why you

wish you could but you can’t.)

A relationships researcher I respect, psychologist John Gottman, gives weekend workshops for couples that can be attended online (gottman.com).

Couples on a budget could just get Gottman’s book, “The Seven Principles for Making Marriage Work,” out of the library and read and discuss a section a week. Gottman’s workshop or book would also be a great wedding present. We find wedding vows romantic, but we tend not to consider that “till death do us part!” would have been a great T-shirt slogan for enemy soldiers trying to off each other in the Hundred Years’ War.

I live in California, where there’s outdoor dining. My husband and I disagree about bringing our dog to restaurants. Our pooch has to sit under the table, and I think it’s really dirty and unkind to put him there. My husband thinks we should bring him.

ful little presents: “Wow, Toto, headless dead bird? Oh, good, because a diamond tennis bracelet would be super boring.”

By human cleanliness standards, dogs are seriously disgusting. The “Merry Corpsemas!” gifts on the duvet and the love some breeds have for rolling around in the mud (immediately after you spend $75 at the groomer) aren’t the half of it. Dogs live to sniff poo; they’ll snub their water bowl to drink out of the toilet; and they have the lovely habit of using your Persian rug for toilet paper — especially when you’ve got company over for a chi-chi cocktail party.

In other words, any minor foot dirt under a restaurant table is unlikely to be a problem for your dog. All that’s likely to be “really dirty” are the looks you might get from patrons with allergies or dog-in-dinery issues. From your dog’s perspective, it’ll be simply awesome to be at your feet.

Anthrozoologist John W.S. Bradshaw explains that dogs co-evolved with humans, starting between 15,000 to 25,000 years ago, per archeological estimates. Over all those doggie-human generations ever since, dogs have been

bred to find human contact extremely rewarding. Bradshaw and his colleagues discovered that some dogs — Labs and border collies, for example — suffer intense “separation distress” when they’re apart from their human.

“They find it difficult to cope without us,” writes Bradshaw. “Since we humans have programmed this vulnerability, it’s our responsibility to ensure that our dogs do not suffer as a result.”

As I see it, we’re cruel to exclude dogs from so many areas of our lives.

Take airline travel. Airlines require dogs over 20 pounds — no matter how well-behaved — to be put in a cage and stowed with the luggage in the hold of the plane. The airlines could easily adopt a more compassionate policy: Instead, give the cage space to that baby who’s sure to scream all the way from Dallas to St. Louis, trashing the mental health of everybody from 1A to 32E.
