entura County Supervisor Matt LaVere (Dist. 1) is postponing his appointment of Chris Stephens to the Ventura County Planning Commission in light of “concerns” from the public. Phil White, current commissioner for Dist. 1, will continue to serve in the role for the time being.

“I have decided to continue this item until I have time to do further public outreach,” said LaVere, responding by email to the Ventura County Reporter on Monday, Jan. 11. The item appointing Stephens to the Planning Commission was on the agenda for the Board of Supervisors meeting scheduled for Tuesday, Jan. 12.

Stephens served as director of the Ventura County Resource Management Agency for 13 years after retiring from the post in 2019. The VCRMA includes multiple county agencies including planning, environmental health, code compliance and building/land use enforcement.

LaVere cited Stephens’ “diverse professional background and his ethics” as reason for the appointment but said “many in the community have reached out to me about this appointment and have expressed several concerns, I think it is prudent to hold off on this decision...to do more extensive community outreach.”

If Stephens were to be appointed and confirmed by a majority of the board to sit on the planning commission, he would eventually cast votes on projects and recommendations being made by individuals he formerly oversaw in his role as director of VCRMA — including the current VCRMA director Kim Prillhart, who was planning director under Stephens.

Late in the afternoon of Jan. 11, 16 public comment letters were posted with the supervisors meeting agenda for Jan. 12.

Among the handful of comments in favor of Stephens’ appointment was one by John Krist, chief executive officer of the Ventura County Farm Bureau, who stated, “His background in land-use planning, coupled with his many years of experience in Ventura County and his open-mindedness to

various points of view, make him an ideal candidate for the Planning Commission.”

But a background in land use planning and experience in county government was cited as a disqualifier in 2017 for Bruce Smith, another long-time employee in the county’s planning department. Smith, who had worked years before as a long-range planner for Ventura County, had been appointed by then-Supervisor Steve Bennett, and initially confirmed by the board.

Several objections were later raised to his appointment, however, including those levied by Supervisors Peter Foy (Dist. 4), and Linda Parks (Dist. 2). Parks initially voted to approve Smith, but then revised her position when Foy formally asked for the board to vote again on the matter.

In May 2017, Foy submitted a letter to the board quoting the Ventura County Planning Commission Handbook: “Planning Commissioners are appointees who do not necessarily have a background in planning or related areas, but may have had some relevant experience.” The handbook also states, “The philosophy behind the relationship of the Commission and the Planning Division staff is that the staff provides legal, technical and professional information and evaluations, but the Planning Commission adds to the staff recommendations the view of the ordinary citizen as to how the County will be developed and maintained.”

During that time, the local advocacy organization Coalition for Labor, Agriculture and Business (COLAB) posted information on its website in opposition to Smith’s appointment, stating, “Filling the commission with lifelong regulators would obliterate the purpose stated in the Planning Commission Handbook to add ‘the view of the ordinary citizen’ to the planning process.”

In Brief Vaccine Registration Information Ventura County has a registration process for those eligible to receive the vaccine as part of the current step in the vaccine administration process. The county is currently in Phase 1A, Tier 1 which allows the following people to get the vaccine: All staff in hospital acute care settings including janitors, housekeepers, security, techs and ward clerks; ICU staff; COVID holding unit staff; ER staff; registry nurses in any units listed before; staff at skilled nursing facilities, assisting living facilities and similar facilities for older or medically vulnerable individuals; all staff in hospital support units and ancillary staff. Next in line are all staff at psychiatric hospitals and residential and in-patient mental health facilities; and residents of skilled nursing facilities, assisted living facilities and facilities that home medically vulnerable people. The current phase also includes staff and residents of special needs group living homes, paramedics, EMTs, staff of dialysis centers and vaccinators.

In addition to doctors, nurses and others that typically administer vaccines, the following may also give the injections: nursing students, medical assistants, pharmacists, pharmacy interns, pharmacy technicians, paramedics and EMTs, dentists and medical or pharmacy students.

Ventura County has set up a website to enroll Volunteer Vaccinators in the new program. Those who qualify can sign up online at: www.venturacountyrecovers.org/vaccineinformation/subscribe-volunteer-vaccinator/ County COVID Update On Monday, Jan. 11, Ventura County reported that 17 people died over the weekend from COVID-19, ranging in age from 56 to 96. That three-day report brings the number of deaths in the county attributed to COVID-19 to 351.

State records report that the county is averaging 1,251 new cases each week, and the county is reporting a doubling rate (rate at which the number of positive cases doubles) of

26.3 cases. The lower the rate, the higher the strain on healthcare.

Equity tracking Latinx residents of Ventura County are testing positive at a higher rate than white residents with 947.3 positive cases among those who report they are Latinx per 100,000 people compared to 819.0 positive cases per 100,000 people in the white community. State records indicate that those in higher income brackets have a lower positivity rate. There are 108.8 cases per 100,000 people who make under $40,000 a year, compared to a much lower case rate of 30.2 for people making over $120,000 annually. (covid19.ca.gov/equity/) Ventura General Plan The city of Ventura has an online survey for residents to provide input as part of the city’s General Plan Update process. Every municipality in the state is required to have a General Plan that serves as a kind of road map for all land use planning, usually for a 20-year period.

The city did a comprehensive update in 2002. The current update will be a longer-term plan, spanning over 25 years of planning and visioning for the city with chapters on land use, housing, open space, climate change, parks and recreation and more. The current phase of the plan includes seeking public input.

The first veteran to receive the vaccine was Mack Edwards, First Sergeant, who turned 100 on Jan. 10. He is a World War II veteran “I fought in WWII and I am fighting against another war, the war against COVID-19. This vaccine gives me and my fellow veteran residents a fighting chance to live our lives with dignity, respect and a smile,” said Edwards.

The home opened in 2009 and houses senior veterans of WWII, the Korean and Vietnam War and Desert Storm.

The home is managed by the California Department of Veterans Affairs (CalVet).

Eye On The Environment

Native plants for their own sake, Growing Works for others

I

n a recent article, I listed five ways gardening can benefit the environment, including tips on plant selection and planting methods to help bees thrive. Bee pollination, as one study I cited points out, contributes over $180 million annually to the economy in Ventura County.

Critics followed up with me noting an oversight in this outlook. The list of benefits focused on value to people.

Bees were valued for their economic contribution. Even the benefit of waste reduction, cutting transport packaging out of the food supply network and reducing food waste, primarily addresses problems experienced by humans.

In contrast, Bonnie Clarfield-Bylin, a Conejo Valley Audubon board member who viewed the article after the California Native Plant Society posted it on their Facebook group site for review and comment, contacted me to point out the inherent value of native plants for the benefit of native species.

“As you must know,” she emailed me, “planting California native plants… provide(s) food and shelter for birds” as well as being “important for our native pollinators…”

Clarfield-Bylin noted Audubon’s “Lawns to Habitat” program, California Native Plant Garden Tour (virtual last year), and grants. The organization also offers free gardening advice.

Gardeners planting native species may not maximize food yield from their gardens, but the benefit of helping native animal species by planting native plant species has a different value. John Vucetich, an associate professor at Michigan Technological University’s School of Forest Resources

and Environmental Science, in a 2015 paper in Conservation Biology, wrote, “If you think that nature also matters for its own sake, then you’ll approach… decisions very differently.”

Rather than looking at a species and asking, “What good are you?,” Vucetich argues for “intrinsic versus instrumental value,” focusing on traits and circumstances giving humans intrinsic value and likening those to aspects of nature.

Even those whose environmentalism, unlike Vucetich’s, is rooted in the environment’s benefit to humanity, acknowledge benefits outside the economic realm. As said by Robert F. Kennedy Jr., an environmental lawyer and son of the famous statesman, “We protect nature not for nature’s sake but for our own sake because it’s the infrastructure of our communities… We’re protecting it because it enriches us, yes, it enriches our economy and we ignore that at our peril.

But it is also enriching us aesthetically, recreationally, culturally, historically and spiritually.”

These benefits to human civilization, as well as service to nature derived from planting native species, are both derived from a program on nine acres of Ventura County-owned land just outside Camarillo. Growing Works is not just a wholesale nursery for California native and drought tolerant plants, it also provides job training and employment.

Started three years ago, after Supervisor Linda Parks saw a similar program in San Luis Obispo County and worked to bring it to Ventura County, Growing Works is a program of the Turning Point Foundation, a nonprofit running programs and

Alleged workplace harassment at oil company

On Dec. 14 a lawsuit alleging racial workplace harassment was filed in Ventura County Superior Court against Carbon California, a Santa Paula-based oil and gas company, its parent company Carbon Energy Corp. and employee Ray Price, an oil field manager working in Ventura County.

The complaint filed on behalf of Rodolfo “Rudy” Ramirez includes four allegations of violations of the Federal Fair Employment and Housing Act (FEHA). Those alleged violations include race discrimination, harrassment based on race, failure to maintain a workplace free from discrimination or retaliation, and retaliation. The complaint also includes a claim of wrongful termination as Ramirez, according to the complaint, was terminated on Oct. 29, 2020 after he filed a report with the company about the illegal conduct of Price and others on Oct. 7.

Price is the brother of Carbon’s operations manager, Scott Price, a Santa Paula resident and longtime oil and gas operator in Ventura County.

The instances leading to the legal action began after Ramirez was promoted to supervisor in July 2020. According to the court filing, Ray Price made racial comments to Ramirez denigrating his ability such as, “You only got the job because you’re a Mexican.” The suit alleges also 6—

that other employees and supervisors would send group texts to “humiliate and undermine” Ramirez.

Ramirez reported these incidents, but they continued in what he described as a retaliatory manner, including suspending him without pay. He was ultimately fired. The legal filing states that Ramirez never received a negative job evaluation or any other professional reprimand in his employee file.

In another incident reported in the lawsuit, Price brought a gun target to the workplace that depicted “a cartoonish African American male with the words ‘Official Running [N-word] Target’ on it.” The suit alleges that the human resources officer and Scott Price were aware of these and other incidents.

The filing states that Ramirez worked for Carbon from April 2019 to October 2020 as an oil field supervisor. When he was terminated, he was asked to “release all of his legal claims in exchange for $10,000.”

The case is assigned to Dept. 21 and the plaintiff has requested a jury trial.

Ramirez is represented by the Long Beach-based law firm of Perona, Langer, Beck, Serbin and Harrison.

Officials with Carbon did not respond to requests for comment by press deadline.

offering supportive housing for people with mental illnesses.

Growing Works “members,” who are receiving services through Ventura County Behavioral Health generally for severe and persistent mental illness, cultivate plants for sale to botanic gardens, public agencies and other customers.

Through this “horticultural therapy,” along with other services, they learn job skills and work toward recovery, according to Jenn Rodriguez, Growing Works’ nursery manager.

Although the program generally does not sell to the public, a retail partner, Tiny Plants, is helping the Turning Point Foundation host two retail sale days. The first will be on Martin Luther King Jr. Day, Jan. 18, and the second will be on Presidents’ Day, Feb. 15. Although Growing Works members will not be present, staff, including Rodriguez, will be on hand to offer expert advice. She is eager to help people learn to plant and care for native plants, succulents, and herbs, so more local gardens will benefit both nature and people, including those who do the planting and those who initially propagated the seeds.

Ponsetto on supervised release

Piru resident attacked, falsely accused Black teen over lost cell phone

iya Ponsetto, 22, of Piru, is out of jail on supervised release in New York City pending a court hearing on March 29, after being arrested at her home on Jan. 7. She was arrested on a fugitive warrant related to charges that she assaulted a 14-year-old teenager, whom she falsely accused of taking her cell phone, in a New York City hotel on Dec. 26.

The teen did not have Ponsetto’s phone.

The hotel located the phone after the incident and it was returned to Ponsetto.

On Jan. 7, Ponsetto initially failed to stop the vehicle she was driving near her home in Piru when deputies with the Ventura County Sheriff’s Office conducted a traffic stop. She instead drove to her residence, where police reported that she refused to get out of her vehicle. Deputies then forcibly removed her from her vehicle and took her into custody. She was booked into a pre-trial detention center a until agreeing to be extradited to New York City to face charges of attempted assault, endangering the welfare of a child, attempted robbery and attempted grand larceny.

New York City police officers had come to Ventura County to assist in coordinating the arrest.

Video footage from Dec. 26 shows Ponsetto at the Arlo SoHo Hotel in New York City accusing a 14-year-old Black teenager of stealing her cell phone. Ponsetto first tried to compel a hotel manager to take the phone from the teen, and then grabbed the teenager to get the phone. The phone belonged to the teenager, not Ponsetto.

The case has garnered national attention amid the teen’s father, musician Keyon Harrold, stating Ponsetto’s accusation and subsequent assault was rooted in racism.

In a Jan. 7 interview with Gayle King of CBS This Morning, just hours before being arrested, Ponsetto denied any racism, stating that she herself is “Italian, Greek, Puerto Rican,” and so she cannot be racist. Ponsetto also claimed that her actions were justified because she didn’t know where her phone was and because ultimately the hotel was able to locate her phone that had been lost.

Groups allege oil industry misled the public

our local environmental groups argue a Sacramento-based political action committee (PAC) has violated state laws by intending to mislead the public during a signature-gathering referendum effort in Ventura County aimed at overturning recent changes to the county’s oil and gas permitting processes.

Ventura County Counsel Michael Walker confirmed that his office has received and is reviewing a complaint letter dated Dec. 18, 2020, from Kevin Bundy, attorney with Shute, Mihaly and Weinberger LLP, representing Climate First! Replace Oil and Gas (CFROG), Los Padres ForestWatch, Sierra Club Los Padres Chapter and Food and Water Watch.

Walker declined to comment further on the matter.

That letter, addressed to Mark Lunn, Ventura County Clerk-Recorder, Registrar of Voters, alleges the process used by Working Families for Jobs and Energy Independence (WFJEI) to collect signatures submitted in support of their referendums violated state law, and therefore Lunn should not certify the signatures.

Assistant Registrar of Voters Tracy Saucedo, spokesperson with Lunn’s office, confirmed that 45,764 signatures were submitted for the referendum against the NonCoastal Zoning Ordinance 4568 and 45,548 signatures were submitted supporting the referendum against Coastal Zoning Ordinance 4567. She said 30,912 valid signatures are required for each referendum. Lunn’s office has until Jan. 26 to certify the signatures.

“Activists are obviously desperate to prevent Ventura County voters from having the final say on this important issue,” said Sabrina Lockhart, spokesperson with WFJEI and vice president of communications for California Independent Petroleum Association (CIPA), a membership-based trade group for oil companies in the state. WFJEI is a regis-

tered committee with the state and lists CIPA and Aera Energy, a Shell/Exxon company, as its sponsors.

WFJEI paid signature gatherers working at various locations throughout the county as part of its referendum effort.

Saucedo explained that all signers “must be a Ventura County registered voter at the address he/she listed on the petition at the time the person signed the petition. Each petition page...is entered into the Elections Division’s voter registration petition module. The system randomly selects 3% of the signatures to be verified and each signature is then compared by Election Division staff against the voter’s registration records.”

If Lunn’s office certifies the signatures, the Ventura County Board of Supervisors will have the choice to either reverse its previous changes to the oil drilling permitting process, or the referendums will be placed on the ballot in 2022 in a regularly scheduled general election. The supervisors also have the option of holding a special election.

Due to the referendum effort, the oil and gas permitting changes, duly authorized by a majority vote of the elected supervisors, are currently inactive. The changes, which WFJEI is working to overturn, subject all new oil drilling and some re-drilling and reworking of wells to modern environmental review. Opponents of the new permitting rules have said it will decimate the oil and gas industry in the county, and cause the loss of thousands of jobs. The groups in support of the changes say they are needed to ensure oil companies are held to modern standards like all other business sectors — something decades-old permits paired with county processes failed to require.

Are ordinance changes vulnerable?

Two of the supervisors who voted in favor of the changes are no longer on the board.

Former supervisor for Dist. 1, Steve Bennett, is now seated as the State Assembly representative for Dist. 37. John Zaragoza, former supervisor for Dist. 5, is now serving as mayor of Oxnard. Newly sworn into those seats are Supervisors Matt LaVere (Dist. 1) and Carmen Ramirez (Dist. 5).

Bennett, Zaragoza and Supervisor Linda Parks, (Dist. 2) voted for the changes last year, with Supervisors Bob Huber (Dist. 4) and Board Chair Kelly Long (Dist. 3) voting against.

Ramirez is widely known to be no friend of the oil industry, with the sector spending nearly $1 million to defeat her in her successful 2020 campaign. LaVere has a thin record on oil drilling issues after serving just one term as mayor and city council member in Ventura, but he “looks promising” according to Tomas Rebecchi, Senior Central Coast Organizer with Food and Water Watch, in terms of taking a strong stand on climate change issues.

Rebecchi points out that during LaVere’s campaign “he took the no-fossil-fuel-money pledge” and said he’d support a ban on fracking at a meeting of the Ventura Democratic Club during the 2020 campaign. LaVere also denounced an oil industry-funded PAC that listed LaVere as a candidate the PAC was supporting (it later dropped LaVere from the list).

According to Rebecchi, when asked whether he’d support a ban on extreme extraction techniques like cyclic steam, LaVere said he’d need to look into it more.

Projects involving cyclic steam and other processes could be impacted by the permitted changes and be subject to more extensive environmental review.

Each referendum addresses one of the changes supervisors made to county zoning ordinances that require modern environmental review under the California Environmental Quality Act (CEQA) for new drilling. The November action of the supervisors, made in a 3-2 vote, amended the Ventura County Coastal and Non-Coastal Zoning ordinances requiring “new” oil and gas exploration and production in any active oil field in the county, regardless of the type of permit that currently governs operations, to be reviewed in a discretionary process by Ventura County Planning.

“The [changes to the] zoning ordinances will only result in more local workers losing quality careers at a time when the county can’t afford to lose a single job or critical tax dollar,” said Lockhart, citing the stresses on the local economy from the pandemic. “We are confident Ventura County residents will understand that keeping energy production local...is good for both the economy and the environment.”

Lockhart called these claims “legally and factually groundless,” without providing further clarification.

Misleading the public?

The objection letter also points to reports from members of the public that signature gatherers themselves provided false information which, if true, would constitute a misdemeanor violation of Election Code Section 18600, which states that anyone is in violation of this section who “as principal or agent or having charge or control of the circulation of, or obtaining signatures to, any state or local initiative, referendum or recall petition, intentionally misrepresents or intentionally makes any false statement concerning the contents, purport or effect of the petition…to any person who signs, or who desires to sign, or who is requested to sign, or who makes inquiries with reference to it, or to whom it is presented for the person’s signature.”

Lockhart declined to comment on the alleged false information being provided by signature gatherers, other than to refer to her comment that the charges are groundless.

James Brehm, 32, of Ventura, was part of a group of concerned residents who responded to a call to action during the signature gathering. Brehm said he saw an email for the Decline to Sign campaign and what most concerned him wasn’t that folks would sign the petition, but that they wouldn’t fully understand what they were signing. He told the Ventura County Reporter that when he went out to multiple locations and spoke with signature gatherers, his concern grew.

“People should be properly informed if they’ve signed this,” said Brehm. He was told by signature gatherers that if he didn’t sign the petition “20,000 jobs would be lost” in the county and that by signing he would help “lower gas and electricity prices.” Neither of which, Brehm said, is true. “It is just misleading.”

Brehm provided recordings and written transcripts of conversations he had with several signature gatherers to those objecting to the signatures submitted. The transcripts are attached to the objection letter.

The groups objecting to the referendum point to a 2019 Economic Profile Report on 2018 data from the Ventura County Community College District that shows there were 887 jobs in the mining, quarrying and oil and gas sector in the county.

Brehm pointed out that the new permitting rules wouldn’t mean the existing oil wells are shut down. He said the referendum effort is a “propaganda campaign” with “infinite” amounts of money to fund it.

“They are not telling [the public] that if they get all the signatures it would make the oil companies immune to environmental laws,” said Brehm. In each hour-long segment, Davis, longtime journalist, author and sometime Ventura County Reporter contributor, will speak with one of the many talented and interesting people that call Ventura County home.

Everything else — including Supper Club combinations, beer and wine — are very easy to order online. Sandwiches start around $12; most entrees are $20-$30; meal deals are $60-$110.

So . . . not a budget dining experience.

But the food is really good, and the combinations are well thought out and generous; we had plenty of leftovers and felt as though our money went far.

The Raven Tavern has a lot going for it, and I hope Oxnard’s fine feathered friend will continue to soar above the complications of this chaotic time.
