New complaint targets Scottsdale’s top judge BY WAYNE SCHUTSKY Progress Managing Editor

A

local man arrested at a Scottsdale City Council meeting over two years ago has filed a complaint against Scottsdale City Court’s presiding judge for allegedly intervening in the case after being disqualified. In a complaint filed with the Arizona Commission on Judicial Conduct in September, Mark Stuart alleged that Presiding Judge Joseph Olcavage violated an order to stay out of a criminal case stemming from Stuart’s 2017 arrest.

Scottsdale Presiding Judge Joseph Olcavage is the subject of complaint filed by resident Mark Stuart with the Arizona Commission on Judicial Conduct.

Stuart was removed by Scottsdale Police officers during the public comment portion of a Scottsdale City Council meeting on Feb. 7, 2017, at the behest of Mayor Jim Lane, who said he believed Stuart was violating state laws by using public resources – the meeting itself – to gin up support for a citizen initiative he hoped to put on the ballot. Scottsdale Police officers removed Stuart, who was eventually charged with trespassing and refusal to obey a police officer, according to court records.

cottsdale Unified School District must pay a former student’s family over $119,000 to cover legal costs from litigation over its failure to fulfill public records requests in 2017. On August 30, Maricopa County Superior Court Judge Daniel J. Kiley ordered the district to pay John and Mary McCarthy $118,816 for legal fees and an additional $537 to cover other costs stemming from their suit. The couple sued to obtain district records related to alleged mistreatment and abuse of their nonverbal autistic son Sean while he was attending Desert Mountain High School.
