Editor's Letter Airpark’s Growth Highlighted in 2030 Report
T
he numbers don’t lie. Sales of commercial land in the Airpark totaled $94 million in 2015, more than double the value sold in 2014. It’s a stark contrast to four years ago, in the depths of the recession, when only $4.8 million sold. Jim Keeley, founding partner of Colliers International’s Scottsdale office, paints a robust commercial real estate market in his annual 2030 report, summarized in this month’s issue. His report is filled with facts that may surprise you. Did you know that the Airpark now houses 3,025 businesses on 3,100 acres, employing 55,260 people in 130 categories? Keeley reports that 38% of the 34.1 million square feet of total space in the Airpark’s 1,156 buildings is used for office space, 27% for industrial/flex and 24 % for retail. You can read and learn about what Keeley calls the Airpark’s “centers of influence” and what makes it thrive in his report. As an office broker, Keeley also has listed Bahia 101, a project of developer Jim Riggs of the Scottsdale-based Saxa. This Class A office building is a 40,000-square foot, three-story structure and, as the building’s name indicates, it is located at Bahia and the 101. You can get a preview of the building while driving on the 101 and read about it in this month’s issue. The latest on a stay-shop-live concept in hotel development also is examined in this issue. The model, normally reserved for luxury sanctuaries in Central America and comparable to one used by ski resorts, is now finding its way into Arizona hotel development. Taxiway B Finished
Air travelers at Scottsdale Airport will notice improved lighting, signage and a new surface on Taxiway B at Scottsdale Airport now that a $5.5 million rehabilitation was completed in March. The project included repairing of cracks, reconstructing taxiway connectors, lighting replacement, new signs and pavement overlay. Chris Read, airport operations manager, says the rehabilitation was a “safety project.” “We had some severe cracking and pavement [on the taxiway] was falling apart,” Read says. Travelers will notice new LED lighting, installed for energy efficiency and new markings. Airport officials are awaiting word some time this summer on a grant to help fund a similar repair for next year on Taxiway A.
Facilities Management Company Opens Headquarters
Vixxo, an asset management company specializing in integrated facilities management, has opened its executive offices at 11333 N. Scottsdale Rd., Suite 160. Vixxo is powered by Fusion, a technology platform, to provide clients in the restaurant, retail, convenience store and grocery industries with analytics and mobility to help companies better manage facilities and machines. Vixxo manages 1.1 million assets across more than 65,000 client locations, which results in 3.5 million annual work orders, according to CEO Jim Reavey. First Service Networks and FM Facility Maintenance were purchased and combined to form Vixxo. The company’s clients include Starbucks, 7-Eleven and Michaels. D
r. Art Mollen has spent his life healing patients, serving the community and creating a better life for those around him. His list of accomplishments is tremendous: U.S. Air Force veteran, practicing physician, medical correspondent for “Good Morning Arizona” and founder of Scottsdalebased The Mollen Clinic as well as Mollen Immunization Clinics of North America. Yet, his legacy may ultimately be defined by the work of The Mollen Foundation, the nonprofit he co-founded in 2008 with his wife, Paige, to help underserved youth. “I’d like to be remembered as the patriarch of preventive medicine of the 21st century,” he says. To support the organization’s endeavors, the Mollen Foundation has utilized events such as the doctor’s 40-yearold Phoenix 10K and Half Marathon as fundraising tools. This year, he is adding a celebrity golf tournament on Sunday, May 15, to his fundraising ways. “The golf tournament is simply another vehicle to promote the entire concept of what childhood obesity is all about and what healthy habits are and how important it is for children at any age to understand these are lifestyle decisions,” he says. More than 140 birdie seekers will hit the links at Camelback Golf Club’s Padre Course to promote the message of fitness, well-being and “healthy habits for future generations.” The event begins at 7 a.m. with registration and a continental breakfast followed by a scramble format

The foundation started with a mission of tackling the growing epidemic of childhood obesity, which “has more than doubled in children and quadrupled in adolescents in the past 30 years,” according to the Centers for Disease Control and Prevention. “My husband and I wanted to combine his passion for preventative medicine and my desire, as a former special education teacher, to fill critical learning gaps not generally funded in local schools,” she says. “Our initial objectives were to simply offer more opportunities to get children moving and provide hands-on nutrition education to encourage students to think critically about where their food comes from, while understanding the impact of their choices on future health.” Over time, the initiatives have grown to include “physical activity, nutritionintegrated food education farm to table, leadership skills and emotional learning,” she says. mission and it has grown tremendously over the years. “It all started with a handful of my patients that met every Sunday at Doubletree Road and Tatum Boulevard,” he says. “The group ran at a slow pace because it was about getting beginners started in healthy habits. Over a period of a year and a half, the group continued to meet every Sunday and grew to over 400 people.” At that point Mollen persuaded the Arizona Marathon Society to have a sponsored road race. And as is his nature, Mollen is quick to pass out praise. “Paige is unequivocally the monolith and backbone of the Mollen Foundation.”

he first new office building to be completed in Scottsdale Airpark in more than five years is the project of Jim Riggs of Scottsdale-based Saxa. The Class A office building is Bahia 101, a 40,000-square-foot, three-story structure at Bahia and the 101. At 56 feet high with spectacular 360degree mountain views, the building boasts 14-foot clear ceiling heights and is offering suites ranging from 3,000 to 27,000 square feet, for sale or lease. Marketing for the project has begun, and Scottsdale Airpark specialists Jim Keeley and Phil Wurth, both with Colliers, are the office sale listing brokers. “Now that the building is completing construction, we’re hearing from leasing prospects that the colors, design and impact that the building has from the Loop 101 Freeway are very impressive,” says Keeley. “The interest and number of showings has picked up quite a bit.” The Scottsdale Quarter area has garnered the most attention over the past year, due to new construction there, says Keeley. “Now that attention is shifting to Bahia 101 as a result of its Freeway frontage and proximity to major events, including the Phoenix (Waste Management) Open, Barrett Jackson collector car auction, international motor show and all the events year-round at Westworld,” he added. “The flexibility to purchase between 3,400 and 14,000 square feet in a brand new, high profile office building is an opportunity that has not been available for over eight years,” says Keeley. The marketing effort has already translated into several sales, he says, including a 5,000-square-foot purchase by National Horseman Magazine, which will move its corporate headquarters to Bahia 101. “As the publisher of a progressive, innovative publication like National Horseman, it’s important that our office reflects the same quality and cutting-edge design as the magazine we produce. It Takes A Village Complex will bring business to the Airpark
W
hen The Ritz-Carlton Paradise Valley opens in late 2018, it will bring something Arizona’s prime resort destination areas have been missing. “A ski village,” says Brendan Mann, owner of the Scottsdale-based Solvere Group. “That’s the closest thing I can compare it to.” Mann’s company handles sales and marketing for the preeminent luxury hotel chain. “Generally if you’re going to build a multilevel experience around a hotel, with residential villas and shopping all within the gates of one place, you pick a ski hill for the location,” he explains. “You don’t see this kind of development in golf destination areas.” Mann says he believes the mixed-use model being pioneered at The Ritz-Carlton may well become a “catalyst” for similar stay-shop-live developments in North Scottsdale and the Airpark.

And the Airpark will play an important role in that.” Jerry Ayoub and his company, Five Star Development, have broken ground on the 122-acre parcel on the west side of Scottsdale Road between Lincoln Drive and Indian Bend Road, land that sits on parts of both Scottsdale and Paradise Valley. Along with the 200-room, 352,000-squarefoot Ritz-Carlton hotel that will stand as the centerpiece, Ayoub’s company is also
developing 94 single-level villas and, after that, 45 single-family homes, all branded with the Ritz-Carlton name—and all sharing the hotel’s pampering services and amenities. HOA fees there will get you your own dedicated concierge, priority access to the hotel’s 400-foot-long pool (North America’s longest) and, for an added a la carte charge, even a Ritz-Carlton chef to come cook dinner in your home. In the United States, Mann says, it’s mostly reserved for ski resorts, which are generally somewhat isolated by nature. “Whistler (British Columbia), Jackson Hole, Vale, Breckenridge, Mammoth, Tahoe—in all those places, they create these destination villages for people to come and have a fully-encompassing experience all in one place, with the added opportunity to own real estate there,” he says. “What Jerry is doing is bringing this concept to the suburban world.”

The global hospitality industry consulting firm HVS defines hospitality-driven mixeduse developments as “projects containing three or more significant revenue-producing uses, one of which includes a hotel component, as well as some form of ‘for-sale’ real estate product.” The third component is typically an upscale retail center in some way affiliated with the recognized hotel brand. At first glance, it seems North Scottsdale has several properties that fit this mold. The Four Seasons Resort Scottsdale at Troon North has the timeshare-modeled

Four Seasons Residence Club nearby, which invites residents to “come enjoy the many pleasures of Four Seasons Resort Scottsdale, just steps from your door.” It also neighbors the luxury gated enclave Privada, which for a time offered residents membership in The Four Seasons Pinnacle Club, granting homeowners access to the hotel’s spa, fitness center, pool and concierge staff. But the Four Seasons lacks a connected retail district, and Privada remains a separate development with no formal affiliation with the resort. “When I first joined the property, there were conversations about linking Privada to the resort and extending access to hotel services for the residents,” says Kim Cole, director of public relations for the hotel who’s been at the Scottsdale property since 2004. “But those kinds of things never happened. And we don’t really have a retail component, beyond what you would expect at a resort property, like a sundry shop and so on.” The Fairmont Scottsdale Princess also looks to be a mixed-use development, in that it’s tightly surrounded by an upscale residential neighborhood on one side and a luxury retirement resort, Maravilla, on the other and overlooks what could be considered an enviable third component: the TPC championship golf course. But again, none of those things bear any connection to the resort—beyond the fact that they all settled on the same prime piece of North Scottsdale real estate. Cole suggests that The Westin Kierland Resort may be the closest thing the Airpark
area has to the mixed-use model. “With the synergy they have with Kierland Commons and the villa component they have that is more solidly residential, you could argue a case that they fit this mold,” she says. Still, the Kierland Commons shopping district, considered the Valley’s first “lifestyle center,” is a separate entity that just happened to develop alongside the resort (the retail village opened in 2000 while the resort opened in 2002), and is only actually linked to the hotel chain by name. “There it’s more a case of, ‘Oh, look what happened!’” says Mann, with a laugh. “The Westin Kierland kind of has it, but it’s still different.” While the triple-threat resort, retail and residential model may not have fully arrived in Arizona yet (at least not until the opening of the Ritz), the concept of pairing high-end hotels with at least some “for-sale” villas has become an almost necessary ingredient in funding the development of the bigger resorts. Real estate products branded with the hotel name help pay the upfront development costs of the hotel, and the additional amenities provided by the hotel, in turn, help sell the residences. That much, at least, has become a win-win arrangement. “I don’t know if the hotel-residentialretail mixed use design is a ‘thing’ yet in the Valley,” says Cole. “In this …continues on page 26

Scottsdale Realtors Told U.S. Market is Strong
U
.S. real estate values continue to be inexpensive in 2016 when compared with other world cities. U.S. properties in top markets also exceed expected returns in other foreign capitals. Foreign investors reiterated these sentiments of market analysts when members of the Scottsdale Area Association of Realtors attended Le marché international des professionnels de l’immobilier (MIPIM) in Paris, France in March. MIPIM is an international real estate investment trade show and brings together real estate investors from all international property sectors―office, residential, retail, healthcare, sport, logistics and industrial. The expo, which hosted 89 countries with more than 21,000 individual participants, afforded Scottsdale Realtors an opportunity to attend panels and more than 100 industry specific conferences to gain insight from a global market perspective.
“Attending MIPIM was an amazing opportunity for me and my colleagues,” said Suzanne Brown, director of community and government affairs of the Scottsdale Area Association of Realtors. “The size and stability of the Arizona market surprised a great deal of international investors, and we were able to engage discussions regarding investment in our state.”

These projects brought extensive attention to Arizona and provided the Realtors with an opportunity to make meaningful connections, according to the Scottsdale Area Association of Realtors.

p for some treasure hunting? Scottsdale’s got a bounty of historic gems for you to discover, and there’s no better time than May, which is National Historic Preservation Month. This month is a great opportunity to celebrate Scottsdale-area sites and properties

It’s also an appropriate occasion to thank the owners and stewards of these historic properties for their devotion to maintaining them, despite the challenges. There are 11 Scottsdale-area properties on the National Register of Historic Places,
and 25 on Scottsdale’s Historic Register. Their significance to Scottsdale and American history ranges from archeology and ancient peoples, to early community life, to architectural uniqueness, to mid-century modern chic. Their form ranges from rocks, to restaurants and even a railcar.

Since its dedication on founder Winfield Scott’s birthday in February 1910, the “Little Red Schoolhouse” has served as a grammar school, the Coronado Head Start school for immigrant children, Scottsdale Town Hall, Scotts-
dale Police Department (and jail), Scottsdale Public Library, Scottsdale Chamber of Commerce and Visitors Center and, finally since 1991, the Scottsdale Historical Society’s museum. Not a bad lifespan for a building that cost $5,000 when voters unanimously passed the school bond for its construction in 1909. This beloved spot was the first to be listed on Scottsdale’s historic register on May 23, 2000. • In December 1996, the Edward L. Jones House in Paradise Valley was accepted onto the National Register. It was designed by architect Edward Loomis Bowes in the 1920s. • One of the most unusual entries on the National Register is a petroglyph site in northern Scottsdale, with a residence wrapped around its archeological features. It achieved its listing in August 1998. • The George Ellis House at Cattle Track earned its National Register listing in September 1999. Built from recycled redwood and other natural materials in the 1930s, the home is the nucleus for the Cattle Track artist enclave off McDonald Drive, where artists, architects, musi-

• Louise Lincoln Kerr’s house and studio, known as the Kerr Cultural Center, were placed on the National Register in April 2010. A former member of the Cleveland Symphony and a lifelong patron of the arts, Kerr donated her property to ASU as a performance venue, located on the west side of Scottsdale road just north of McDonald Drive.

Although many of the local historic properties are in private hands and not open for tours, many others welcome visitors or customers. Restaurant's Cornbread Sales Aid Charities

hanks to the sale of cornbread, Z’Tejas recently donated $21,238 to the local nonprofit Scottsdale Active 20-30 Club, which was founded to support children’s charities. Cornbread for a Cause is the restaurant group’s corporate giving arm. Its mission is to raise funds for charitable organizations that help people in the communities that Z’Tejas serves. Funds are raised through proceeds from sales of Z’Tejas’ famous, freshly made cornbread. The monies donated to Scottsdale Active 20-30 Club were raised between Jan. 1 and March 31 at the Valley Z’Tejas locations, including the restaurant at Scottsdale Fashion Square. Through June 30, Z’Tejas Cornbread for A Cause is raising funds for Valley militaryfocused charity, Military Assistance Mission. “We are overwhelmed by the success

acayo’s Mexican Grill & Cantina is taking a bit of the old and mixing it with the new to celebrate its 70th anniversary. The restaurant will recall some of founder Woody Johnson’s recipes from the 1960s and 1970s, such as fried zucchini, shredded chicken flautas and the chicken Maximillian, and introduce new dishes as well. “They’re some of the dishes that customers still request today,” says Ashley Negron of Macayo’s in the Airpark. Most people, Negron says, are familiar with Macayo’s and the red bird, but many are not aware that the dishes are created fresh in-house daily. “Those who have been dining with us for 40, 50 years, they remember Woody,” she adds. “They have memories of Woody checking on tables, and they’re passionate about the experience. But today, we’re on a culinary evolution.” Negron calls Johnson “extremely innovative.” “He used bold flavors but not a lot of spicy ingredients because customers wanted ‘safe Mexican.’ He had things on his menu like chicken fried steak and other offerings for guests.” Part of the spirit is the fun family atmosphere within the restaurant, Negron adds. “In addition to delicious food, we offer great service and great margaritas,” she says. Also in honor of the anniversary, Macayo’s is hoping to show customers that tequila is a well-rounded drink. The restaurants are introducing more premium tequilas, even those that are $300 a bottle.

$25 Million Airport Expansion Set Construction to begin in early 2017 on new terminal, business center by Lee Allen
C
onstruction is expected to take flight in 2017 for a new Scottsdale Airport terminal and Aviation Business Center, a project that is expected to be completed in April 2018. A recent update to the airport’s master plan and a subsequent market analysis made clear that “we needed more executive-hangar space,” according to Aviation Director Gary Mascaro. “As we explored how and where to accomplish that, the obvious choice became a
currently underutilized terminal area, including the terminal building itself and the existing office complex. A new partnership agreement with private parties will allow us to do that with lease payments providing the funding to construct the $25 million endeavor.” The project will be financed through Municipal Property Corporation bonds issued by the City and paid with revenue from the lease agreements and ancillary business permit fees. Those revenues are
expected to cover debt payments for 20 years. Project partners are the aircraft charter company Gemini Air Group, which will lease hangar facilities, and Maza Concepts, which will lease retail and office space for a restaurant to be known as The Brick. “We had a good response to our project request for proposals with nearly 40 attendees at our pre-bid meeting,” Mascaro says. “Of the proposals received,

We’re excited to help them—and us— continue to grow.” Now airport engineers and architects will create a full design based on the preliminary concept by Meade and Hunt along with DWL architects. “Once we finalize the full design process with input from all parties, we hope to start demolition of the existing facilities in February 2017.” Solicitations are already out for a combined demolition/construction contractor with proposal evaluations and a proposed contractor selection award to go to the City Council for approval in June. “We’ll all be moved out in one shot in advance of the bulldozers and wrecking ball,” Mascaro says. “The plan of attack for the terminal area is to demolish the old aviation business center north of the terminal immediately after airport operations personnel have relocated to a nearby office building. That should be our temporary home for about a year. Leases for all other tenants will expire before demolition/construction begins and the U.S. Customs service will move into temporary trailer facilities.” Officials are soliciting for contractors early to allow them to be a full partner as the City goes through the design process in detail, working with City engineers and architects to finalize plans. “When that happens, all partners will have touched it, felt it and know what the costs and timelines will be,” Mascaro says. “If all goes well, bulldozers will appear right after the start of 2017 with anticipated completion in April 2018.” Mascaro emphasizes the project is a proactive measure with an eye toward the future. “Our future forecast is pegged on more and larger aircraft operating in and out of

Not a bad success record for founder/president/owner Tim Carpay, a former Vancouver resident who flew float planes as a teenager. In a previous interview with Scottsdale Airpark News, Carpay noted: “Every client we’ve had started as a charter client. They buy an airplane and put it with us (because) they like the way we do things.” Still pulling occasional pilot duty for owners’ trips, he dreamed of investing in a consolidated office/hangar space and now that wish has come true. “We got our ducks lined up, worked hard on the proposal and presentation, and came out the winner. The next two years will give us a slow and steady climb up the hill to get to where we want to be and we’ll be involved in the process every step of the way.” Each of Gemini’s two 30,000-square-foot hangars will house its own fleet (a Global Express, two Challengers and two Hawker 850s). Part of one hangar will be dedicated to maintenance operations and fuel sales. Caterer Dee Dee Maza is already known to Airpark customers for her terminal eatery, Zulu Café. She’s ready to take that food service to new heights. “We’ve been slowly building our relationships with hangar owners, but with the terminal expansion, it’s time for us to grow, too,” she says. “We’ll lease office and restaurant space for a seven-day-a-week, breakfast-lunch-dinner dining facility (The Brick) and will be the exclusive caterer for hangar banquets. “We’re rebranding as Volanti (Latin for flying) Jet Catering and Hangar Events. Private jet catering is a unique niche. It’s a whole different animal and we’re good at what we do. We have an aeronautical permit and, after 30 years as a caterer, we know the rules. Adding this service isn’t much different from what we’ve been doing. We’ll add some employee hours to ramp up as required to cater to private jet needs for everything from shrimp cocktails to sandwich trays.” Summing up the ambitious endeavor, Mascaro says, “The revenue generated will cover the cost of debt services to build the facilities, so we’re not building and hoping they will come. We’re building because they’re already here.” Reflecting on the City Council’s unanimous vote to move forward with this project, Mayor J.W. “Jim” Lane says, “The airport is an important self-sustaining enterprise that serves both the community and our visitors ‘in the Scottsdale way’ and this project will ensure a quality continuation of that success.”
The Suitcase Party Helps Children
T
he Active 20-30 Club of Phoenix will host The Suitcase Party to help raise funds to benefit The Phoenix Children’s Hospital and the Children In Need Foundation. The Phoenix Suitcase Party begins at 7 p.m. Friday, May 6 at the Signature Flight Support’s private luxury hangar at 15290 N. 78th Way at Scottsdale Airport. Guests will bring a packed suitcase to the event, walk the red carpet, and enjoy an evening of cocktails, dancing, appetizers, a silent auction and casino games for raffle. At 10 p.m., the evening’s grand prize raffle drawing will take place. The two grand prize winners then takes their date, packed suitcases, and board a private plane to

A Big Draw Light industrial complex sells for $7.85 million By Ken Abramczyk
A
six-building complex at Evans Corporate Park was sold recently for $7.85 million. Greenwood & McKenzie, a real estate investment company based in Tustin, California, bought the complex, which spans 5 acres and 71,463 square feet of building space at 8350 E. Evans. Jim Lieberthal and Rod Crotty, associate brokers with Cutler Commercial, represented the seller Bayport Evans Associates LP. “It’s an older product,” Lieberthal says of the complex located southwest of the Northsight Boulevard and Raintree Drive intersection. "It was built in 1996, and it has higher ceilings, which you don’t see in most of the older products.” The complex’s 16-foot ceiling height in its buildings is higher than most of the other buildings in the area, which fall in the 12- to 14-foot range.
The buildings feature oversized overhead doors, which also helps its curb appeal, Lieberthal says. The six buildings vary in square footage from 7,500 to just over 14,000, according to Lieberthal. The complex is zoned light industrial, has 100% occupancy and contains businesses ranging from service industries and contractors to real estate companies. About 40% to 50% of the space is “built-out,” meaning that companies are using much of the square footage for office space. Lieberthal says when his company originally listed it, occupancy was lower. He adds the triple net leases, in which tenants are responsible for the insurance, taxes and maintenance, were changed to gross leases. “That was a big deal,” Lieberthal says. Since that time, occupancy jumped at first to 90% and today the offices are 100% full. “The property is very attractive,” Lieberthal says. “The owners did a great job, getting it painted, keeping it clean and well maintained. It’s attractive due to its location and the size of the bays. The ceiling height is also very important.” Lieberthal says sites like the Evans Corporate Park are in high demand. “Rents

are going up,” Lieberthal says. Prices per square foot per month went from $1.10 to $1.50, then fell to 70 cents and are now in the 90 cents to $1 range.” Demand to rent space remains strong in the Airpark, Lieberthal says. “Prices are going up. People are paying a premium because there isn’t a lot of it out there. “They love the location there, the ease of getting to the freeway, and the ease of access to amenities, restaurants and golf courses, the shopping and the (similar) companies that they can synergize with.”

Leave Heirs a Windfall Instead of a Crippling Tax Liability By Thomas K. Brueckner, CLTC
O
ver the last 24 years, we’ve acquired many clients with IRA accounts from which they take distributions only because they are required. They have pension income, rental income and Social Security sufficient for their expenses—and no mortgage. They live well within their means, give generously to their churches or favorite charities, and adore their grandchildren. As well as they are doing, many clients tell us that their adult children are struggling financially, with some having lost jobs, homes and even their marriages to the Great Recession and its aftermath. Many of their adult children have spent what funds they had in 401(k)s and IRAs, avoiding foreclosure, paying their
attorneys, or just paying their rents and monthly expenses, while looking for jobs that simply don’t exist. Their parents wish there was something they could do to restore those lost dollars, fearful that their children will never enjoy a retirement of their own some day. By employing the leveraging power of life insurance, there is great good that can come from small amounts of money meant for subsequent generations. Many of our clients have been able to double, triple and, in some cases, quadruple the money in their IRA or emergency reserve accounts, in about five weeks, without market risk, income tax-free to their heirs. What makes this strategy even more consequential is

those same clients have maintained access to their funds, with full liquidity and a guaranteed minimum yield of 3% interest, should their future need for those funds outweigh their children’s, or the latter’s circumstances eventually improve. In many cases, we’ve recommended Indexed Universal Life Insurance for clients also looking for greater returns on their money. Unlike many index annuities, the caps on indexed life are often two to three times as high—approaching 12% and even 14% in some accounts—so when the market goes up, so will your account, by up to that amount. financialfundamentals from all prior years. Clients are often reluctant to shell out for long-term care insurance, at $3,500 to $6,500 per year for traditional coverage. Many have emergency funds of $50,000 to more than $100,000, earning next to nothing in a money market account. When repositioned into an indexed life/longterm care combo account, four problems are solved: Yield is immediately increased to 3% to 14% market-linked interest, the asset is often doubled toward the funding of a longterm care need, access to the funds is maintained, and any dollars still unspent at the owner’s passing are paid out income taxfree as a residual life insurance benefit to their heirs. Important: These benefits should be tailored to each couple’s individual circumstances—and not by someone unfamiliar with such strategies (such as a stockbroker), but by an indexed life and
financialfundamentals long-term care specialist with an equities background. Critical importance must be placed on the tax consequences of the funding, policy design and suitability,
and surrender options should a couple’s circumstances change over time. For those who think they’re uninsurable, a policy can be written on two lives (spouses, parent/sibling, even parent/child), as long as the other insured is reasonably healthy. The key consideration is that each benefit is available when it’s needed, in
succession, tax-efficiently. Properly designed, these solutions have become the new Swiss Army knife of estate and income planning: Liquidity for emergencies, excellent yields, a doubled long-term care benefit, and a tripled life insurance benefit are all combined with taxfree efficiency. Charity Supplies Foster Children With Basics By Mark J. Hiegel
I
was introduced recently to a wonderful charitable organization located right here in the Scottsdale Airpark—Arizona Helping Hands. As a long-time Scottsdale resident, I know that a variety of organizations do good work for children and families. This one makes a difference every day in the lives of boys and girls in foster care. May is National Foster Care Awareness Month and I’ve learned some startling statistics related to foster care in Arizona. Did you know that there are more than 19,000 children in the foster care system or that on average 36 children will be taken today into the
Arizona Department of Child Safety? That’s an entire classroom of children that will be relocated into a new family, a few of them while you are reading this article. I also didn’t know that 45% of children in foster care are in “kinship” placements―with a relative, neighbor or other nonlicensed caregiver. In these instances, the state provides no assistance to cover the child’s expenses. That means that a grandmother living on a fixed income now must strain her limited budget even further to support the extra family members. Concurrently, she is dealing with the demands of parenting once again.
Families in foster care have a resource guide at www.azfamilyresources.org with information from A to Z on where foster families can find help. One charity in the entire state is listed as the provider of “basic essentials” for these children—that’s Arizona Helping Hands. Its warehouse, dubbed by state officials as “The Care Barn,” is stocked with mattresses, cribs, clothing, diapers, personal care products, bicycles and more—anything to lend a helping hand to these children. This small group of people, assisted by numerous volunteers, has impacted so many kids’ lives. They provided

1,515 beds, 468 birthday packages and many other basic needs to 2,713 children in 2015. What a relief it must be for families to learn of this resource. The day I was at the warehouse, multiple pickup trucks, vans and other vehicles left with beds and other supplies to ease the burden placed on families and make life more comfortable, and safer, for the children. Arizona Helping Hands is one of the few charities in Arizona that qualifies for the Foster Care Tax Credit—a dollarfor-dollar credit used to support charities that devote the majority of their
work to children in foster care. You can see by the stacks of mattresses and cribs where those funds are spent. At a cost of $200 per bedding unit, this operation is not inexpensive to maintain and relies primarily on the generosity of individual donors to keep supplies flowing. During this Foster Care Awareness Month, I encourage you to become more aware of the system’s issues in Arizona. ravel and tourism professionals across the country join in unison from May 1 through May 7 to sing the praises of our industry. During National Travel & Tourism Week, we share the value the travel industry holds for our economy. And what a value it is. Each year, more than 9 million visitors contribute to this $4 billion industry in Scottsdale. In 2015, visitors gave Scottsdale’s economy a boost of $17 million in bed-tax revenue alone. Combined with sales tax revenue from visitors, that’s close to $38 million that funds City services like public parks, hiking trails and road upgrades. Without this inflow of

money, resident taxes would increase to cover such services. These visitors generate more than 50% of that annual bed-tax revenue during the first four months of the year. League Spring Training and more. These visitors fill our resorts and hotels, scoop up reservations at local restaurants, and pour into shops, from the malls to the boutiques. Scottsdale residents know when the time of year approaches—all they have to do is look to storefronts welcoming football, golf and baseball fans, depending on the month. National Travel & Tourism week falls
right after the conclusion of those four incredible months. While the weeklong event inspires destinations gearing up for busy summers, for Scottsdale, the event means toasting to the conclusion of another successful peak season. But that does not mean that we are resting on our laurels until January comes around again. Avoid Scams by an Internet Retailer With a Cat Named Misse By Dean M. Dinner
P
urchases of retail products on the Internet continue to soar with estimated quarterly U.S. retail e-commerce sales comprising about 9% of total U.S. retail sales. In the fourth quarter of 2015, this segment of e-sales was estimated to exceed $107 billion. Unfortunately, crooks and scam artists seem to be much more sophisticated at generating illegal profits from Internet sales than purchasers are about identifying real deals. An Internet retail scam recently came to light involving a Colorado sporting goods operation. The company 123 Mountain (“123M”) operated sporting good stores in several Colorado cities. However, almost all of its sales were through its website. As a matter of fact, it turned the brickand-mortar stores into club members-only facilities and tried to discourage people from coming into the stores. The company website seemed to sell quality outdoor goods for unbelievably low prices as well as selling hard-to-find high-end outdoor products at low prices. These included quality jackets by Canadian Goose and Moose Knuckles, Vokl skis, Valandre sleeping bags and precooked couscous. Of course, the problem was that 123M really didn’t have many of the products in stock, frequently couldn’t deliver the ordered product, delivered defective and/ or wrong products on a regular basis and did everything it could to avoid paying refunds. In many cases, the company didn’t have permission to sell the brands that it was advertising. That resulted in numerous lawsuits by vendors seeking to prohibit it from selling their brands. They charged a 15% cancellation fee on all orders—even if it was 123M’s fault for nondelivery. After years of ripping off customers, vendors and landlords, 123M’s assets were frozen by state authorities a few months ago. The customers included a Korean buyer who bought more than $300,000 of high-end sleeping bags for resale to the government.

Avoiding Internet scams
So what should someone who is looking to buy retail products on the Internet do to avoid the time, expense and frustration resulting from dealing with a company like 123M? 1. One of the things you need to do is carefully read the terms and conditions. The 123M terms and conditions included: • The seller could have up to two years to fill the orders; • All pre-orders had to be prepaid with Bitcoin, wire transfer, money order or Chase Quickpay, which lack the protection of some other methods of payment; • Purchasers were prohibited from reselling items to “your Russian cousin”; • It stated that the webpage may contain errors in prices or product photos comparable to a cat named “Misse” having an “accident” and the company may refuse to cancel orders; and • They charged a 15% cancellation fee, which they tried to enforce even when they didn’t deliver the item or sent the wrong item. 2. Investigate the seller, especially if you only have an e-mail address for the seller. Look at its Better Business Bureau rating. 123M had more than a 100 complaints in the last three years and an “F” rating, which should be a bright red flag; 3. Examine buyer feedback; 4. You should be cautious of online sellers who require upfront cash or wire transfer transactions. Try to purchase online using your credit card or one of the online payment companies to give you recourse in the event of a dispute; 5. Verify in writing when the product will be delivered and the total cost together with any warranty coverage concerns; 6. Try to obtain a physical address and telephone number for the vendor and verify those before ordering the product; 7. In general, avoid foreign transactions as they are more difficult to correct.
Address scams with action
If you realize that you have been taken by an unscrupulous seller and the seller isn’t willing to correct the problem, you have a number of actions that you can take to try to address the situation including: • Dispute the claim through your credit card or online payment company; • Contact the Better Business Bureau (see www.bbb.org); • File a complaint with the Federal Trade Commission; Contact your state attorney general’s office and pursue a complaint through the AG; and Contact the Internet Crime Complaint Center, which works with the FBI and other government agencies to track and pursue cyber crime cases.
Conclusion
The old saying “If it looks too good to be true, it probably is too good” holds true whether buying in person or through the Internet. In this age of a world economy where your money can quickly find its way to some foreign bank account, it is even more important that you educate yourself about the seller and approach the purchase with a skeptical eye. A Home Mortgage is the Best Kind of Debt By Rod Dennis
T
he term “good debt” sounds like an oxymoron. How can anything be good when you owe money?

The truth is there is both “good debt” and “bad debt.” In fact, much of the good debt you
incur probably will prove to be a solid investment for you and your family. One that’s likely to increase in value over time and improve your overall financial picture. If that’s the case, consider it good debt. One example is when a family member takes out a student loan to pay for a college education. College graduates earn more money over their lifetime. Another good investment is buying a home of your own—the American dream. To purchase a house, most people borrow money by taking out a mortgage. Unlike the exorbitant interest rates on credit card debt—which we’ll discuss later—the average rate on the popular 30-year fixed mortgage loan is at its lowest level of the year and may dip further into record territory. The interest portion of your mortgage payment may reduce your taxable income, meaning more money in your pocket. Historically, homes have increased in value year to year, although there have been periods when they have stayed steady or even declined. Over the long haul, though, home ownership has proved a good investment, so the mortgage you have on yours can be considered good debt. Now let’s look at “bad debt,” and there’s plenty of it. When you finance the purchase of items that are used up or you want but can’t afford, that’s bad debt. Some examples are using your credit card to buy new drapes or remodeling the bathroom in your new home or charging an extravagant vacation. You also might go all out by getting a car loan so your neighbors will drool when you pull up in the current year ’s fully loaded BMW. Sure, you want to customize your home so it’s comfortable and up to date, and what’s wrong with enjoying the finer things in life? If you can pay for them, that’s great. But too many people can’t, and they have remorse later when they find themselves unable
therealdeal to pay off their credit card balance—or even come close—and don’t have the money at the end of the month to make their car loan payment. In most cases, the credit card debt shoots up each month because interest, usually in the 12% to 14% range, is charged on the balance. Miss a few payments on that BMW and the bank’s tow truck will appear in your driveway to repossess it. Here’s a startling statistic: According to the website nerdwallet.com, the average U.S. household with debt carries $15,762 in credit card debt. Yes, you read that right. That’s just the “average.” Many people who have maxed out their credit cards and are getting deeper in debt feel overwhelmed. If they don’t want to file bankruptcy—or are

This involves negotiating with credit card companies to pay a percentage of the outstanding balance and get their slate wiped clean. Some people try to do this themselves. Others turn to professional debt settlement companies. Is there a lesson here? Absolutely. Prepare a monthly budget and stick to it. Don’t buy items you can’t afford. New YMCA CEO Vows to Make A Difference By Christina Fuoco-Karasinski
A
s the new president and CEO of the Valley of the Sun YMCA, Bryan Madden said he can change the world. “Every day I go into work and figure out how to make people’s lives better,” Madden said. “That’s a pretty exciting position to be in.” He plans to emphasize the importance of swim lessons in Arizona. Having just moved to the Valley from South Carolina, Madden was surprised to hear there is a large number of drownings in the Grand Canyon State. “How can we be the second-leading state for drowning?” he asked rhetorically. “How does that happen? I have to turn that and make sure there is a change possibility. “I have heard people say, ‘Only worry about the things you can change.’ I think, in my position, we can change the world. If you only worry about the things you can change, and you say you can change the world, that’s a lot of things to worry about.”

One thing that Madden does not worry about is maintaining the legacy of the Y. He’s excited about the opportunity to be a part of a change agent organization. “It’s a 16-branch organization,” he said. “It’s a pretty big Y—one of the largest in the United States. “My position is the president and CEO. I have the responsibility to set the strategic direction along with the board of directors. We have a great tradition. It’s not that we need to tear it apart and build it back. We need to build upon our base. I always say I’m the guy who sits underneath the trees that someone else planted. We have 124 years of history and now it’s time to continue to grow that tradition.” Besides stressing the importance of swim lessons, Madden wants to make sure that all of the facilities are focused on family activities. “That’s our area of expertise,” Madden said. “We are the largest provider of child care in the nation.
Bryan Madden “I read that 1- to 2-year-old males are most likely to drown and most likely it’ll happen in the backyard. Swim lessons are a big part of how we move forward and change that direction. The Y is uniquely situated to be a part of that discussion.” But the Y doesn’t just focus on youngsters. Dubbed the nation’s leading exercise program for active older adults, SilverSneakers is a big part of the Y, as are other wellness programs. “We can’t be everything to everybody,” he said. “We offer child care, programs for older adults, wellness programs, swim lessons. Those are programs that help you raise your family.”

The Real Stuff Lessons from my early days in real estate By Jen Smith

his month’s theme got me thinking about my early career. One of my first jobs was as a leasing consultant. From there I moved into multifamily property management, and then into financial analysis and due diligence. I was fortunate to work with a great company, NTS, and with a fantastic leader, J.D. Nichols. Here are some things I learned.

Nichols showed us the way in his efforts with education and air transport. He was constantly on alert for ways things could work better.
Identity and purpose matter Knowing who we are and why we do what we do is critical to success. A strong corporate culture doesn’t just talk about mission, vision and values. It actually manifests those things in the real world. It’s the way employees treat each other, the way customers and clients and contractors are treated, and the way the work gets done. Nichols held himself and all of us to high standards. Whether it was a walk-through, a loan package or a ground-breaking ceremony, we gave it our best. It was in our DNA.
Great leaders create leaders Being a great leader isn’t about taking all the credit. It’s about creating space and opportunity for others to bring their gifts and talents. Nichols wasn’t afraid to listen to new ideas, to entertain possibilities, to try out new things. I remember saying, “Mr. Nichols, what if...” and the next thing I knew, I had resources and responsibility and some of the best times of my career. Many of the people I worked with from that time went on to start their own companies or become influential community leaders.
Being comfortable with ambiguity is required Rushing to answers is limiting. Stay with the questions, keep digging and do the hard work to find the magic. Yes, sometimes being asked to run another scenario—what if we changed the interest rate, what if we changed the usage mix, what if we could pick up another few acres to the south—drove me crazy. But through it all, I learned so much. And by the time we broke ground or introduced a new partnership, we knew we were bringing the best we could to the world.
Listen to your gut Sometimes, you just know something is right. It’s good. It’s the way it’s got to be. So don’t let anyone talk you out of it. Believe in yourself enough to listen to yourself, to be honest with yourself, to call your bluff when necessary, and to move forward despite resistance when it’s the right thing to do. I found my confidence and my voice at NTS, being able not just to look at facts and data, but to think deeply about what we were doing, if it made sense, or what might work better. My NTS days were years ago, yet the lessons continue to serve me well. Which lessons resonate with you? What lessons have you learned? Flexibility vs. stability
Leasing space affords flexibility, but because lease rates typically escalate regularly, relocating and/or quickly rightsizing comes with an ever-increasing price tag. On the other hand, owning the building that houses your business helps ensure long-range stability. Therefore, for those who can forecast their space needs and who do not need the down payment amount to operate or grow their businesses, owning a building or business condo should be part of a balanced business plan and wealth accumulation strategy.
Benefits of owning
In addition to having pride of ownership, benefits of owning your building include the ability to control the costs of occupancy; The drastic reduction in occupancy costs when the mortgage is retired; Real estate is an asset that can be sold or leased to others; and generally the buildup of equity can be used to generate cash through refinancing.
