‘Outdoor dining and seating’ zoning amendment would reduce paperwork

It was not the result of complaints by business owners. This time, a zoning amendment came from City Hall.

At its Nov. 13, meeting, Peoria City Council heard from Planning Director Chris Jacques about a city-initiated proposal to amend Section 21-505.B.3 (Limitations on Uses) within the non-

residential section of the city’s zoning ordinance.

In effect, Jacques said the proposed changes would amend the limitations on “outdoor dining and seating areas” to require a conditional use permit (CUP) only when the exterior walls of the patio (or outdoor dining area) are within 200 feet of a residentially zoned property.

Twelve years ago, City Council adopted the ordinance requiring a CUP

for all outdoor dining and seating patios throughout the city. Council approved the amendment to mitigate noise and other concerns emanating from outdoor dining patios.

At the time, the city was receiving a number of noise and other complaints pertaining to a particular outdoor dining patio in close proximity to neighboring see

Oldest auto service in town celebrates 90 years

Peoria Chamber of Commerce CEO and President Guy Erickson said it in just a few words: “It says a lot for a business to be around since 1928. It’s customer service that’s helped them be successful for 90 years.”

The business he was talking about is Wilhelm Automotive, which celebrated its 90th anniversary Nov. 14 with family and friends — and many customers — at its original location on Grand Avenue.

Chris Garman, president of Wilhelm Automotive, told the crowd who attended the anniversary party, “As I push our company into the future, a picture reminds me of a simpler time. Wilhelm now has nine locations. We work on more than race cars and tractors.”

Garman said Joe Wilhelm and his uncle, John Ansell, started the business and 90 years later, a man (Garman)

and his uncle (Thom Gyder) still run the business. Garman said building customer service and building the community by Wilhelm means the owners are still pillars of the community.

Peoria Mayor Cathy Carlat read a proclamation thanking Wilhelm for its strength and for being a “guiding light” for the community. She told of the company’s commitment to the arts — with hundreds of thousands of dollars to help build the Peoria Center for the Performing Arts — and its dedication to the efforts to bring quality economic development to Peoria.

“You’ve always been there,” Carlat said.

Gyder took over from his father, Charlie Gyder in the 1990s, and now sits on the board of directors for Wilhelm, staying involved but allowing his family and employees to continue the tradition of service. He sat in the audience and smiled as words of praise came from all who came to celebrate.

Peoria celebrates 30th Annual Old Town Holiday Festival

The city of Peoria is celebrating its 30th annual Old Town Holiday Festival from 5 to 10 p.m. Nov. 30. Located at Osuna Park in Old Town Peoria, near 83rd and Grand avenues, attendees can

stroll through the historic streets and enjoy all the holiday activities. The event will feature live entertainment, a visit from Santa, a snow slide with 20 tons of snow, kid zone, roaming high

school choir groups, a crafters market and more. The tree lighting and council ceremony will take place at 7:15 p.m.

Activities and performances will be happening throughout the evening. The Community Center will host a series of dance performances starting at 5 p.m.

The Osuna Park stage will feature performances by Ballet Folklorico, Class Act, Red Dragon Kenpo and others.

The Peoria Center for the Performing Arts will have a free concert by Tres Tenores at 8 p.m.

Parking and admission are free; some activities have a nominal fee. Parking is available at the Peoria Community Center accessed from Monroe Street or 84th Avenue. Additional parking is available at the municipal parking garages surrounding the event. Food and beverage concessions will be available for purchase. Salvation Army kicks off Red Kettle drive

The annual Red Kettle Campaign kicked off Nov. 16 as Glendale Vice Mayor Lauren Tolmachoff kicked off the event at Cabela’s at Westgate.

“I am happy to be here and this is a very important event this morning,” Tolmachoff said. “As a citizen of Glendale I am very familiar with the Red Kettle at 49 locations throughout the community.”

of raising more than $152,000 during the holidays.

“The Red Kettle kick-off is a special time for the Salvation Army because we are well known throughout the community for giving out food baskets, clothes, toys and any needed assistance we can to those in need,” Glendale Salvation Army Maj. Clement Leslie said. “The Red Kettles help fund our programs all year round and our goal is to beat last year when we raised $150,000 in Glendale.”

Public contributions to the kettles enable the organization to continue its year-round efforts at helping those who would otherwise be forgotten.

The effects were far-reaching, according to Jacques’ communication to City Council at the Nov. 13 meeting.

He said any business that had an area that could potentially be used for dining or seating was required to obtain a CUP regardless of its location within a commercial/retail center or without consideration of the specific nature of the business. The limitation extended the time for the business to build on a site

because of the length of the city’s development process, which could be several months. This was because the CUP was required prior to receiving site plan/design approval or being allowed to submit building or civil plans. For potential business owners looking to expand or move to Peoria, the deal was “often cited as a significatn barrier,” Jacques wrote in his report to City Council.

The ordinance was approved 7-0.

Two men injured in plane crash at Lake Pleasant Two men are expected to fully recover after the plane they were on crashed into Lake Pleasant Nov. 17.

According to a police spokesperson, just after 1 p.m., Lake Pleasant Patrol deputies responded to reports of a single-engine plane that had gone down in the lake.

Officials said both men, 63-yearold Mahmood Fani Tehrani and 36year-old Fabien Tehrani, were treated for minor injuries. Local people at the lake noticed the crash and were able to pull both men from the wreckage.

It is unclear what caused the plane to go down and impairment is not a factor, according to officials. No further information was immediately available.

Woman turns in boyfriend for child pornography Peoria Police officials said a woman turned in her boyfriend, who was subsequently arrested for child pornography, after the woman recognized a couch fabric in a photo.

According to a police spokesperson, the woman was looking through her boyfriend’s phone on suspicion of cheating, when she found child pornography pictures. As she continued to look, she recognized the fabric on

As officers interviewed the suspect, 31-year-old Laurence Robert Abbott, he reportedly told them that he was drinking with a friend the previous night. At one point, the friend left for a few minutes to get more beer and asked Abbott to watch his preschoolaged daughter, police said.

Abbott denied having any child porn on his phone, but after officers looked through the phone, they con-

Abbott was then heard by officers saying that, “he was drunk at the time and blacked out.”

He also allegedly said, “I’m going to turn myself in for taking pictures of an underage child.”

Abbott is being held on a $250,000 bond on charges of child molestation and sexual exploitation of a minor.

Abrazo adds two new medical residency programs One of the programs slated to be based in Glendale facility Abrazo Community Health Network is launching two new medical residencies in an expansion of its graduate medical education programs. Abrazo’s new General Surgery and Internal Medicine residencies will add to the hospitals’ ability to attract and retain future physicians.

There will be 45 positions for the Internal Medicine residency and 15 positions for the General Surgery residency. The programs are accredited by the Accreditation Council for Graduate Medical Education and are now accepting applications for rotations starting in July 2019.

Addition of two new residency programs demonstrates Abrazo’s commitment to expanding its teaching and research capabilities across the hospital network, according to Akil Loli, desig-

nated institutional official for graduate medical education with Abrazo Community Health Network.

“This represents a watershed moment for Abrazo Community Health Network, as we are able to combine excellent patient care with academic achievements,” Loli said.

Abrazo Arrowhead Campus in Glendale will serve as the primary clinical site for both residencies.

“Expanding Abrazo’s graduate medical education programs will help meet the need for future generations of physicians in our communities,” Loli said.

Commercial Properties Inc./CORFAC International (CPI), Arizona’s largest locally owned commercial real estate brokerage, announced the sale of a retail strip center at 9015 W. Union Hills Drive in Peoria. Comprised of 8,767 SF of retail and office spaces, the property sold for $2,000,000 ($228.12 PSF) and consists of strong regional, national franchise and local operators.

STATE TITLE FROM 16 drive, Tawee Walker broke two tackles and raced for a long run, getting inside the Higley 20-yard-line. Two plays later, A.J. Jackson took a sweep to the left and into the end zone for a 17-yard touchdown run with just under six minutes left in the quarter.

After the Centennial defense again forced a Higley punt, the offense took over and marched 83 yards on six plays, culminating when quarterback Jonathan Morris hit Walker with a 7-yard crossing pattern and the Coyotes were ahead 21-7 after the first quarter.

Late in the first half, after the Coyotes defense again forced a Higley punt, the Coyotes got the ball back and the offense went to work.

Morris connected with Young on a 30-yard pass, followed by a 28-yard pass to Eric Haney to get the Coyotes to the Higley 15-yard line. After a short loss, Walker scored his second touchdown when he took a hand-off and raced up the middle for a 17-yard touchdown to put the Coyotes up 28-7 at halftime.

“That one also really hurt,” Higley head coach Eddy Zubey said. “We got a quick lead and it was gone just like that.

That is a great team over there and there wasn’t much we could do after falling down in the first quarter.”

“The best thing about this running back group is they cheer for and encourage each other,” Taylor said. “They push each other to try to get better and everyone cheers everyone.”

The Knights continued to move the ball, getting inside the Coyotes 10 for the fourth time, but failed on fourth down when the defense came up with another huge stop.

Early in the fourth quarter, Jackson took a hand-off, raced around the outside, and then outran the Higley defense

Thanksgiving: When you drink from the well, remember the spring Well, here we go again, it’s holiday time. In North America, we start with Thanksgiving, then comes Christmas, and finishing with New Year’s events.

Notice the order of the holidays; it’s thanks first and giving second. Thanksgiving, to be truly Thanksgiving, is first thanks, then comes the giving of Christmas.

However, Thanksgiving was never meant to be shut up in a single day.

There are many things we could note about thanksgiving. For example, Thanksgiving is when one species ceases to “gobble” and another begins.

Here’s something for which you should be abundantly thankful — only you and God have all the facts about yourself.

If you can’t pay your bills, you can be thankful you’re not one of your creditors.

We ought to be thankful we are living in a country where folks can say what they think without thinking. A person

doesn’t realize how much he has to be thankful for until he has to pay taxes on it. Finally, here’s another Thanksgiving tip: Why not be thankful for some of the things you don’t have?

Matthew Henry, the famous scholar, was once accosted by thieves and robbed. He wrote about the incident: “Let me be thankful first, because I was never robbed before; second, because, although they took my purse, they did not take my life; third, because, although they took my all, it was not too much; and fourth, because it was I who was robbed, not I who robbed.”

Great thoughts there and a great perspective. When you think like that, you don’t spend a bunch of emotional energy on bitterness and revenge.

Fulton Sheen wrote something concerning the consequences of ingratitude in children: “A very interesting phenomenon in children is that gratitude or thankfulness comes relatively late in

Pastor Ed Delph Church @ Community their young lives. They almost have to be taught thankfulness; if not, they are apt to grow up thinking the world owes them a living.”

In other words, if we aren’t thankful for what we have, we aren’t very likely to be thankful for what we are going to get.

Someone once said, “The truth is attitudes sour in the life that is closed to thankfulness. Soon selfish attitudes take over, closing life to better things.”

So, what is Thanksgiving?

Neil Strait says, “Thanksgiving is the attitude of the life that acknowledges the contribution from God, from others and from life. Thanksgiving puts power into

living, because it opens up the generators of the heart to respond gratefully, to receive joyfully, and to react creatively.”

Let me conclude with what Richard Douglas says: “The modern person seldom pauses to give thanks for the simple blessings of life. One reason is because we are used to having so much.

We simply assume that we will have all the good things of life. Another reason is that it hurts our pride to be grateful.

We do not want to admit that God is the provider of all good things. We are simply His stewards. Being thankful requires humility and faith in God. When we have these, we can be grateful.”

In other words, when you drink from the stream, remember the spring.

What are you thankful for?

Thanksgiving is a special time of the year when we should take a few moments to remember those things for which we are most thankful. Such as family, friends, health and happiness.

The older I get, the more I recognize how much I appreciate those things.

You may have read my previous article about my family’s Christmas traditions. Let me share with you my family’s Thanksgiving traditions that make this time of year extra special to me.

Each year, as we gather around the Thanksgiving dinner table, we have a “Thanksgiving prayer.� This is not a blessing on the food, but is when each of us shares what we are thankful for during the last year. Usually, we share things that have happened that have brought us closer as a family.

This is how it works. Our entire family comes together with parents, kids, grandkids and in some cases our grandkids even bring a friend. We set up several folding tables end to end in the backyard and prepare for dinner.

My family has grown over the years and last year we had 27 for dinner at our house.

Each person has a formal place setting that includes glass plates and cups and a votive candle. This includes the younger grandkids. Because of that, we have had a lot of broken dishes over the years. So, at our table nothing matches, which makes it even more special.

To show respect to my wife, she chooses if she will be first or last to share her Thanksgiving prayer.

Last year, new neighbors moved in next door. The dad and his son were home while his wife was at work. He could hear our prayer over the fence and later told me how special he thought it was. We have been friends ever since. They have just had another little baby, so they have much to be thankful this year.

November 23, 2018 RESOLUTION NO. 2018-114 RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, ARIZONA DECLARING ITS INTENTION TO ORDER THE PURCHASE OF ELECTRICITY FOR LIGHTING THE STREETS AND PUBLIC PARKS WITHIN THE PROPOSED DISTRICT AND THAT THE COST OF THE PURCHASE OF ELECTRICITY FOR LIGHTING THE STREETS AND PUBLIC PARKS, BE ASSESSED UPON A CERTAIN IMPROVEMENT DISTRICT TO BE KNOWN AS CITY OF PEORIA STREETLIGHT IMPROVEMENT DISTRICT NO. 1127, THE MEADOWS PARCELS 7 & 8 PHASE I; PROVIDING THAT THE COST OF THE ELECTRICITY REQUIRED TO OPERATE THE SYSTEM BE ASSESSED UNDER THE PROVISIONS OF TITLE 48, CHAPTER 4, ARTICLE 2, ARIZONA REVISED STATUTES, AS AMENDED; AND DECLARING AN EMERGENCY. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, ARIZONA, THAT: SECTION 1. SECTION 2. The streetlights and the electricity, therefore, in the opinion of the Mayor and Council of the City, are of more than local or ordinary public benefit, and are of special benefit to the respective lots, pieces and parcels of land within the real property described herein. The Mayor and Council of the City make and order that the cost and expense for the purchase of electricity be chargeable upon a district to be known and designated as the City of Peoria Streetlight Improvement District No. 1127 and as described and bounded as set forth on Exhibits A and B attached, and declare that the district in the City benefited by the purchase of electricity for streetlights to be assessed, to pay the costs and expenses thereof in proportion to the benefits derived therefrom.

The City shall not assess the costs and expenses for the purchase of electricity for streetlights which are for the general public benefit against the respective lots, pieces and parcels of land located within the boundaries of the City of Peoria Streetlight Improvement District No. 1127 and if a portion of the costs and expenses for the purchase of electricity for streetlights is for the general public benefit, the City shall assess the boundaries of the City of Peoria Streetlight Improvement District No. 1127 only that portion of such costs and expenses which benefits the lots, pieces and parcels of land located within the boundaries of the City of Peoria Streetlight Improvement District No. 1127.

SECTION 3. The costs and expense for the purchase of electricity for streetlights shall be made and all proceedings therein taken; that the Superintendent of Streets of the City shall post or cause to be posted notices thereof; that the City Clerk shall certify to the passage of this Resolution of Intention; that the Engineer shall prepare duplicate diagrams of the City of Peoria Streetlight Improvement District No. 1127 described in Section 2 of this Resolution to be assessed to pay the costs and expenses thereof, under and in accordance with the provisions of Title 48, Chapter 4, Article 2, Arizona Revised Statutes, as amended.

AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, MARICOPA COUNTY, ARIZONA, AMENDING CHAPTER 21 OF THE PEORIA CITY CODE (2017 EDITION), BY AMENDING SECTION 21-503 LAND USE MATRIX AND SECTION 21-505.B.3 LIMITATIONS ON USES, OF THE PEORIA CITY CODE; PROVIDING FOR SEPARABILITY AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission of the City of Peoria, Maricopa County, Arizona, held a public hearing on October 4, 2018 to consider proposed amendments to the Peoria City code, after notice in the manner provided by law; and WHEREAS, due and proper notice of such Public Hearing was given in the time, form, substance, and manner provided by law including publication of such in the Peoria Times on September 14, 2018; and WHEREAS, the Planning and Zoning Commission of the City of Peoria, Arizona at its regularly convened meeting of October 4, 2018 voted to recommend to the Mayor and Council of the City of Peoria, Arizona, that amendments be made to the Peoria City Code (2017 edition); and WHEREAS, the Mayor and Council of the City of Peoria, Arizona, have considered the recommendation of the Planning and Zoning Commission of the City of Peoria, Arizona, and deem it to be in the best interest of the public health, safety and welfare of the residents of the City of Peoria, Arizona to amend Section 21-505.B.3 (“Limitations on Uses”) of Chapter 21 of the Peoria City Code (2017 edition) pertaining to outdoor dining and seating area requirements.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Peoria, Arizona as follows: SECTION 1. Chapter 21 of the Peoria City Code (2017 edition) shall be amended to read as indicated on Exhibit A. SECTION 2. Effective Date. This Ordinance shall become effective on the date provided by law.

SECTION 3. SEPARABILITY. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.

Said notices stated the fact of the passage of said Resolution of Intention No. 2018-114 or alternatively a petition has been filed with the City Clerk having been signed by all the owners of the real property; and WHEREAS, more than fifteen (15) days have elapsed since the date of the last publication of said Resolution of Intention No. 2018-114 and since the completion of the posting of said notices or alternatively a petition has been filed with the City Clerk having been signed by all the owners of the real property; and WHEREAS, no protests against the proposed improvement and no objections to the extent of the District were filed with the Clerk of the City during the time prescribed by law; and WHEREAS, the Mayor and Council of the City having acquired jurisdiction to order the improvements as described in Resolution No. 2018-114; and WHEREAS, the City Engineer acting as District Engineer has prepared and presented to the Mayor and Council of the City duplicate diagrams of the property contained within the District (“the Diagram”) and legal description copies of which are attached and incorporated as Exhibits A and B. NOW THEREFORE IT IS RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF PEORIA, ARIZONA, as follows: Section 1. By virtue of the authority vested in the Mayor and Council of the City by Title 48, Chapter 4, Article 2, Arizona Revised Statutes and all amendments thereto, the Mayor and Council of the City orders the work or improvement done as described in Resolution No. 2018-114 and in accordance with the Plans and Specifications approved and adopted by the Mayor and Council of the City of Peoria, Arizona.

Section 2. The Superintendent of Streets of the City is authorized and directed to prepare and execute the notice of the passage of this Resolution, which is attached as Exhibit B. Such notice shall be posted and published as provided by law.

Section 3. That the Diagram, as prepared and presented to the Mayor and Council of the City is approved by the Mayor and Council of the City.

Section 4. That the Clerk of the City is authorized and directed to certify that the Diagram was approved by the Mayor and Council of the City on the 13th day of November, 2018, and after such certification, the Clerk of the City is authorized and directed to deliver the Diagram to the Superintendent of Streets of the City.

The maintenance of the landscaping, therefore, in the opinion of the Mayor and Council of the City, are of more than local or ordinary public benefit, and are of special benefit to the respective lots, pieces and parcels of land within the real property described herein.

The Mayor and Council of the City make and order that the cost and expense for the maintenance of the landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures be chargeable upon a district to be known and designated as the City of Peoria Maintenance Improvement District No. 1211 and as described and bounded as set forth on Exhibits A and B attached, and declare that the district in the City benefited by the maintenance of landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures to be assessed, to pay the costs and expenses thereof in proportion to the benefits derived therefrom.

The City shall not assess the costs and expenses for the maintenance of landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures, which are for the general public benefit against the respective lots, pieces and parcels of land located within the boundaries of the City of Peoria Maintenance Improvement District No. 1211 and if a portion of the costs and expenses for the maintenance of landscaping is for the general public benefit, the City shall assess the boundaries of the City of Peoria Maintenance Improvement District No. 1211 only that portion of such costs and expenses which benefits the lots, pieces and parcels of land located within the boundaries of the City of Peoria Maintenance Improvement District No. 1211.

SECTION 3. The costs and expense for the maintenance of landscaping shall be made and all proceedings therein taken; that the Superintendent of Streets of the City shall post or cause to be posted notices thereof; that the City Clerk shall certify to the passage of this Resolution of Intention; that the Engineer shall prepare duplicate diagrams of the City of Peoria Maintenance Improvement District No. 1211 described in Section 2 of this Resolution to be assessed to pay the costs and expenses thereof, under and in accordance with the provisions of Title 48, Chapter 4, Article 2, Arizona Revised Statutes, as amended.

SECTION 4. The majority of owners of all of the real property within the proposed district have executed a Petition for formation of a Maintenance Improvement District and the City Council has verified the ownership of the property. Publication and posting of the notice of the passage of the Resolution of Intention will be completed as prescribed by the State Statues.

SECTION 5. Any Resolutions or parts of Resolutions in conflict with the provisions of this Resolution are hereby repealed.

SECTION 6. The immediate operation of the provisions of this Resolution is necessary for the preservation of the public peace, health and safety and an emergency is declared to exist, and this Resolution will be in full force and effect from and after its passage and approval by the Mayor and Council of the City of Peoria, Arizona as required by law and is exempt from the referendum provisions of the Constitution and laws of the State of Arizona.

Exclusion of Certain Property.

Any public street or alley within the boundaries of the Assessment District is hereby omitted from the assessment hereafter to be made. Any lot belonging to the United States, the State, a county, city, school district or any political subdivision or institution of the State or county, which is included within the Assessment District shall be omitted from the assessment hereafter made.

“Superintendent of Streets” shall mean the City Engineer.

Section 2.

Declaration of Intention to Order an Improvement.

The public interest or convenience requires, and it is the intention of the Mayor and Council of the City of Peoria, Arizona, to order the following work, hereinafter “Work,” to be performed, to wit: The maintenance of all landscaping, including replacement of landscape materials, in the area generally described as follows: SEE EXHIBIT “A”, LEGAL DESCRIPTION OF CITY OF PEORIA MAINTENANCE IMPROVEMENT DISTRICT NO. 1211 The Mayor and Council of the City of Peoria, Arizona designate as parkways, those areas set forth on Exhibit “B” Assessment Diagram in accordance with Title 48, Chapter 4, Article 2, Arizona Revised Statutes. The public interest and convenience require, and it is the intention of the City Council to order the Work adjacent to the designated parkways to be performed as stated herein. All items of the Work shall be performed as prescribed by the Plans and Specifications hereby approved and adopted by the Council and on file in the Office of the City Engineer and no assessment for any lot shall exceed its proportion of the Estimate. The estimate of the cost and expenses of the work or improvements on file in the offices of the Superintendent of Streets and the Clerk of the City are hereby approved and adopted by the Mayor and Council of the City. In addition to the requirements of law, the procedures set forth in the City Code will be followed regarding acceptance of bids and setting tax levies. For purposes of this Resolution and of all resolutions, ordinances and notices pertaining to this Resolution, the improvement as herein described is hereby designated City of Peoria Maintenance Improvement District No. 1211.

SECTION 3. The costs and expense for the purchase of electricity for streetlights shall be made and all proceedings therein taken; that the Superintendent of Streets of the City shall post or cause to be posted notices thereof; that the City Clerk shall certify to the passage of this Resolution of Intention; that the Engineer shall prepare duplicate diagrams of the City of Peoria Streetlight Improvement District No. 1128 described in Section 2 of this Resolution to be assessed to pay the costs and expenses thereof, under and in accordance with the provisions of Title 48, Chapter 4, Article 2, Arizona Revised Statutes, as amended.

The Mayor and Council of the City of Peoria, Arizona designate as parkways, those areas set forth on Exhibit “B” Assessment Diagram in accordance with Title 48, Chapter 4, Article 2, Arizona Revised Statutes.

The public interest and convenience require, and it is the intention of the City Council to order the Work adjacent to the designated parkways to be performed as stated herein. All items of the Work shall be performed as prescribed by the Plans and Specifications hereby approved and adopted by the Council and on file in the Office of the City Engineer and no assessment for any lot shall exceed its proportion of the Estimate. The estimate of the cost and expenses of the work or improvements on file in the offices of the Superintendent of Streets and the Clerk of the City are hereby approved and adopted by the Mayor and Council of the City.

In addition to the requirements of law, the procedures set forth in the City Code will be followed regarding acceptance of bids and setting tax levies. Section 3.

Determination of Need.

In the opinion of the City Council, the Work is of more than local or ordinary public benefit. The City Council hereby orders that all amounts due or to become due with respect to the Work shall be chargeable upon the respective lots, pieces and parcels of land within the Assessment District.

Section 4.

Preparation of Assessment Diagrams.

The City Engineer is hereby authorized and directed to prepare duplicate diagrams (Assessment Diagrams) of the property contained within the Assessment District. The diagrams shall show each separate lot, numbered consecutively, the approximate area in square feet of each lot, and the location of the lot in relation to the work proposed to be done.

Section 7.

Annual Statement.

The City Council shall make annual statements and estimates of the expenses of the District which shall be provided for by the levy and collection of ad valorem taxes upon the assessed value of all real and personal property in the District as provided in A.R.S. § 48-574 and amendments thereto.

The estimate of the cost and expenses for the maintenance of the landscaping on file with the Superintendent of Streets and the City Clerk is approved and adopted by the Mayor and Council of the City.

SECTION 2. The maintenance of the landscaping, therefore, in the opinion of the Mayor and Council of the City, are of more than local or ordinary public benefit, and are of special benefit to the respective lots, pieces and parcels of land within the real property described herein. The Mayor and Council of the City make and order that the cost and expense for the maintenance of the landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures be chargeable upon a district to be known and designated as the City of Peoria Maintenance Improvement District No. 1215 and as described and bounded as set forth on Exhibits A and B attached, and declare that the district in the City benefited by the maintenance of landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures to be assessed, to pay the costs and expenses thereof in proportion to the benefits derived therefrom.

The City shall not assess the costs and expenses for the maintenance of landscaping included within, near, and adjacent to a parkway and related facilities together with appurtenant structures, which are for the general public benefit against the respective lots, pieces and parcels of land located within the boundaries of the City of Peoria Maintenance Improvement District No. 1215 and if a portion of the costs and expenses for the maintenance of landscaping is for the general public benefit, the City shall assess the boundaries of the City of Peoria Maintenance Improvement District No. 1215 only that portion of such costs and expenses which benefits the lots, pieces and parcels of land located within the boundaries of the City of Peoria Maintenance Improvement District No. 1215.

SECTION 3. The costs and expense for the maintenance of landscaping shall be made and all proceedings therein taken; that the Superintendent of Streets of the City shall post or cause to be posted notices thereof; that the City Clerk shall certify to the passage of this Resolution of Intention; that the Engineer shall prepare duplicate diagrams of the City of Peoria Maintenance Improvement District No. 1215 described in Section 2 of this Resolution to be assessed to pay the costs and expenses thereof, under and in accordance with the provisions of Title 48, Chapter 4, Article 2, Arizona Revised Statutes, as amended.

SECTION 4. The majority of owners of all of the real property within the proposed district have executed a Petition for formation of a Maintenance Improvement District and the City Council has verified the ownership of the property. Publication and posting of the notice of the passage of the Resolution of Intention will be completed as prescribed by the State Statues.

SECTION 5. Any Resolutions or parts of Resolutions in conflict with the provisions of this Resolution are hereby repealed.

SECTION 6. The immediate operation of the provisions of this Resolution is necessary for the preservation of the public peace, health and safety and an emergency is declared to exist, and this Resolution will be in full force and effect from and after its passage and approval by the Mayor and Council of the City of Peoria, Arizona as required by law and is exempt from the referendum provisions of the Constitution and laws of the State of Arizona.
