Businesses open with caution

After being virtually stopped for more than a month, the West Valley took cautious steps forward last week.

And that’s pretty much the way Gov. Doug Ducey wants it.

Like a lifeguard at a busy pool, Ducey’s message is, “Walk, don’t run.”

Hair cuts were back, at places like Senior’s Barber Shop. And at West Valley shopping areas, including Crossroads at Tolleson and Westgate, people wandered between restaurants and shops over the weekend.

Ducey announced May 12 that his stay-home executive order would end three days later.

“This is not a green light to speed,” he added. “This is a green light to proceed.”

Just in time for Memorial Day: Splash pads, parks open

Though it is still a far cry from “business as usual,” West Valley cities are reopening some facilities —just in time for Memorial Day weekend, in some cases.

Then again, with schools and most businesses closed for two months, the “threeday weekend” concept is a bit unusual during the COVID-19 pandemic.

And, while Goodyear and Avondale are opening splash pads, Buckeye facilities

remain closed. Litchfield Park is mulling what it will open and when, according to City Manager Bill Stephens.

After keeping Arizona in “stay-home” mode since mid-March, Gov. Doug Ducey said May 12 Arizona was in Phase 1 of White House guidelines for “opening up America again.”

Goodyear City Council meetings will reopen to the public starting June 8, also with physical distancing. The Goodyear City Council meeting May 18 was to be the last online only.

Maricopa County Library District libraries, including the Goodyear Library, remain closed.

Avondale Avondale is opening many of its facilities soon.

“Parks are open again, with normal hours. Many park amenities are open again (sport courts),” said Pier Simeri, a city spokeswoman.

She said the Avondale skate park opened last week and the city’s splash pad will open on Friday, May 22.

According to a website announcement, “Avondale parks will resume normal operating hours from 5 a.m. to 11 p.m. Additionally, all park amenities ... are open to residents to use at their own risk.

“Picnic ramada reservations are now available with restrictions. The number of patrons will be limited to approximately half of normal capacity to allow for safe physical distance. Field reservations, with restrictions, will tenta-

tively resume June.”

Avondale has not announced changes to its City Council meetings, which have been online only.

Avondale libraries will reopen on June 1.

Curbside pickup of library materials is offered at Avondale Civic Center Library, 11350 W. Civic Center Drive, and Sam Garcia Western Avenue Library, 495 E. Western Avenue.

Avondale City Hall lobby is closed to the public but will reopen June 1. For information on online water payments and other services, visit avondaleaz.gov.

Senior programs and transportation at the Avondale Senior Center remain suspended. Seniors can pick up meals from 11:30 a.m. to 12:30 p.m. weekdays at the Avondale Senior Center, 1007 S. Third Street. For questions regarding the Senior Center, call 623333-2705.

Buckeye The city of Buckeye was not ready to make any changes as of May 18.

“At this time, Buckeye continues to operate as we have since mid-March,” said Annie DeChance, a Buckeye spokeswoman.

Public access to Buckeye facilities remains restricted. For utility payments and other information, visit buckeyeaz. gov.

“Even though the (governor’s) executive order allows public pools and gyms to reopen today, Buckeye is keeping our Aquatics Center, Recreation and Senior center and both libraries closed until further notice,” DeChance said.

“While these are important amenities to our residents, opening these facilities also requires significant staff to operate and additional costs for disinfection,” she said.

Ducey said as long as they practice physical distancing and enhanced sanitation, gyms, spas, swimming pools and movie theaters could reopen.

But many businesses were not yet ready turn on the lights and open the doors.

Goodyear, Avondale and Glendale movie theaters have not opened. And, though some casinos in the state reopened, Desert Diamond Casino West Valley stated on its website it would remain closed through May. Though most gyms remained closed, Goodyear’s Southwest Valley YMCA reopened its fitness center—“but the pool has not opened yet,” said a staff member who asked not to be identified.

Those looking for “live yoga” also are still waiting. The Wellness Center Yoga and Therapies near the Goodyear/Avondale border continues to provide yoga classes online.

“Although the stay-at-home order has been lifted for gyms, we are not reopening the studio at this time,” said an announcement on the center’s website.

“We will reopen in stages, with social distancing measures and other safety precautions in place. Our first priority is the well-being of our community.”

Ducey previously approved barbers and salons to open May 8 and in-restaurant dining would be permitted as of May 11.

The Wellness Center’s neighbor Senior’s Barber Shop jumped to open May 8.

“The first days we opened were pretty busy,” she said. After that, “We’re almost back to regular.”

Paiz said barbers are wearing masks, which the customers don’t seem to mind.

“They’re very happy, very content with us being back,” she said.

At Romano’s Macaroni Grill, just north of Interstate 10 on North Litchfield Road, regulars had to wait an extra week to eat in the restaurant.

Like many other West Valley restaurants, Romano’s stayed open from midMarch through early May for takeout and delivery, but with a greatly reduced staff. Romano’s planned to start dine-in service Wednesday, May 19.

“We have all the social distancing ready—tables spread out, seating at every other table. And employees are going

to have to be wearing masks,” said Luke Unrein, manager of the restaurant.

“We need to show people walking in the door we’re doing our part to make them feel comfortable,” he added.

Unrein said he is hearing from patrons who can hardly wait.

“They’re excited about it. They’re wanting to come back and get the craving foods they’re used to,” he said.

“We have a lot of employees who have been here a long time and regulars that love coming here because of the people.”

Unrein also looks forward to bringing staff back to help.

“All the restaurants that are staying open are in survival mode, they’re running just with the salaried managers,” he said. “We’ve been showing up at 8 in the morning, leaving at 11 at night. That’s what we have to do to keep the restaurant open. That’s the fight we’re fighting.”

Construction begins on $2 million Aqua Fria Trail

Construction of the Agua Fria Trail will began in Avondale last week.

The project has a total construction cost of $2.1 million, with the federal government paying $1.8 million and the city $300,000. The project will be managed by the Arizona Department of Transportation and is part of a regional multimodal trail system.

The proposed completion for this project is December 2020.

The Agua Fria Trail is a half-mile north of Van Buren Street along the Agua Fria River east levee, beneath the

I-10 overpass.

The work includes constructing a pathway, soil cement bank protection, landscaping and other related work.

Access to businesses and residential properties will be maintained throughout the duration of the project, and there will be no impact to travel lanes, as most of the work will be in the Agua Fria River levee.

To be continued: Meeting on cross-dock ends with no vote

Talk about a cliffhanger: The Maricopa County Planning and Zoning Commission heard dozens of protests of a plan to turn the Falcon Golf Course into a “cross-dock” transportation facility.

The commission then heard a representative vigorously defend the project, which would bring hundreds of

jobs to the West Valley.

But a vote ... was not to happen.

The May 14 online meeting was to have a vote on a military compatibility permit for property owner Cowley Companies and developer KW Projects. Falcon Golf Course is just north of Goodyear and Litchfield Park and south of Luke Air Force Base.

and Litchfield Park residents slamming the project, one of the commissioners said she had to leave the meeting.

That meant there was no quorum— the minimum number of commissioners present to continue the meeting and vote on the permit and development plan—and the meeting was adjourned.

“For the public watching, we apologize. This is very unexpected,” said Luke Schlosser, chair of the commission. “We all hate this is happening.”

Dozens of residents were waiting to speak.

They will have to wait until the next Planning and Zoning Commission meeting, scheduled for 9:30 a.m.

At the May 14 meeting, Darren Gerard, a Planning and Zoning staff member, first read the sole letter of support for the project.

Gerard then read 77 emails harshly criticizing the request by Falcon Golf Course to rezone for a transportation facility.

Many emails cited a traffic study that said the cross-dock would bring as many as 6,000 truck trips daily to Camelback Road. “Traffic, traffic, traffic,” complained one email.

Others protested the involvement of Michael Cowley, the golf course owner who was a Planning and Zoning Commission vice chair until March. “All of you look like you are in this for personal gain— which one of you will be next?” one email stated.

There were another 191 emails opposing the project that were not read, as they were received in time to be included in the staff report (an online protest also received 2,300 signatures).

Gerard also noted opposition letters were received from the cities of Goodyear and Litchfield Park—and that Luke Air Force Base rescinded its previous approval.

After reading the emails, Gerard gave a brief summary of the proposal, noting the Planning and Zoning staff recommended approval of the permit request.

Attorney Jason Morris of Whitney Morris spoke on behalf of Kieran West/ KW Projects, defending the request.

“We firmly believe this is not only an appropriate application but a beneficial application for the area,” he said.

Morris also found the critique of Cowley “disrespectful,” noting other members of the commission “regularly recuse themselves” when there are potential conflicts of interest.

Stating that “there is virtually no other use for this area,” Morris displayed a slide showing PV 303, the Goodyear industrial project that spans from Indian School Road to the south side of Camelback Road.

Falcon Golf Course begins on the north side of Camelback Road.

“We are perhaps a movie theater and what we’re looking at across the street is Disneyland,” Morris said.

At that point, Francisca Montoya interrupted to state that she had to leave the meeting, so Morris will have to conclude his argument May 28.

House of Representatives votes for $3 trillion stimulus

After sponsoring what was dubbed “The HEROES Act,” Rep. Raúl M. Grijalva voted for the $3 trillion stimulus bill. It passed by a 208-199 vote in the House of Representatives May 15.

“I’ve heard from my constituents and small businesses in the West Valley who remain in a tough financial situation due to the pandemic,” said Grijalva, a Democrat who represents Buckeye, Goodyear and part of Avondale (District 3 stretches south to Tucson).

The Health and Economic Recovery Omnibus Emergency Solutions (HEROES) Act includes another round of stimulus checks of up to $6,000 per household, plus $100 billion in rental assistance and $200 billion in “hazard pay” for essential workers.

But buying something now and expecting the HEROES Act money to pay it off might be unwise: The bill goes to the Republican-controlled Senate. Senate Majority Leader Mitch McConnell, R-Ky., called the bill “an unserious product from an unserious majority.”

And President Donald Trump said the bill is “DOA.” Grijalva insisted the legislation was desperately needed.

“We’re all ready for businesses to open, but we cannot open our economy in good faith without the robust testing, tracing and treatment needed to keep our communities safe. While congressional Republicans and the Trump administration remain intent on forcing our country to reopen while the virus continues harming people across the country, I’m proud we passed legislation that invests in our health care system, the safety of our workers, the security of our families and the recovery of our economy,” he said.

He also noted that cities and towns are facing budget shortfalls and small businesses have been devastated by the COVID-19 pandemic.

Rep. Debbie Lesko, a Republican who represents part of Avondale, Litchfield Park, Glendale and Peoria, pushed for—but failed to get—amendments to HEROES. Lesko voted against what she called“massive wish list legislation.”

“This bill is filled with flaws and provisions that are extremely alarming,” she said.

One of Lesko’s failed amendments would have removed provisions in the bill that reinstate the State and Local Tax Deduction (SALT).

“The SALT deduction benefits the rich in high-tax states and requires taxpayers in low-tax states, like Arizona, to subsidize the rich,” Lesko said. “We should be focusing on provisions that will help average Americans who are suffering, not the richest among us.”

Another amendment Lesko wanted would have prohibited undocumented immigrants from receiving economic impact payments. Lesko’s failed amendment required Social Security number verification for all disbursements from the bill.

Lesko also wanted limitations on funds being used for abortion services, insisting “taxpayer funds appropriated through the HEROES Act could be used to directly fund abortion.”

All of Lesko’s amendments failed on a straight party line vote.

Board considers Hughes, Cluff disability retirement applications

Allison Braughton submitted an application for disability retirement Aug. 22, 2019.

Kyle Cluff submitted an application for disability retirement Jan. 6.

Justin Hughes submitted an application for disability retirement April 1.

All were subjects of Goodyear Police Department investigations.

Braughton, who resigned from the Goodyear Police Department, was the subject of numerous internal investigations, it was revealed during a firing appeal by former Police Chief Jerry Geier.

Santiago Rodriguez, who had been Goodyear’s acting police chief since Geier was suspended in October, was promoted to police chief May 18.

The Geier investigation started when Hughes, the deputy chief of the Goodyear Police Department, and Marcus Patterson, president of the Goodyear Police Officers Association, made numerous complaints about Geier. Among

the complaints were claims Geier inappropriately promoted Braughton, then did not allow staff members to provide reports to the Maricopa County attorney’s office and Arizona Peace Officer Standards and Training following an alleged April 3, 2019, hit-and-run by Braughton while she was off duty in Glendale.

Copies of the Braughton, Hughes and Cluff disability applications requested by the West Valley View were provided to the newspaper, but with almost all information except applicant names and dates of the applications redacted for privacy reasons.

On Feb. 27, the board tabled Braughton’s application for accidental disability, so “the board may obtain all treatment records ... from the date of resignation, Sept. 3, 2019, through Feb. 27,” according to meeting minutes.

concluded with an announcement that the next meeting was scheduled for May 28.

On May 5, notice was posted via Goodyear’s calendar that the police retirement board would meet the next day, at 3:30 p.m., via a phone conference call (Goodyear, like other cities, is not allowing the public to attend meetings in person).

The May 5 meeting lasted 70 minutes.

The police retirement board was in executive session for all but five minutes.

During the brief public portion of the meeting, the board voted—with Jason Mattie recusing himself, as he had down previously on the Cluff matter— to send Cluff to an independent medical examiner “with questions.”

The Buckeye Police Department seeks assistance identifying the body of a woman found in the desert 10 miles north of Indian School Road and 355th Avenue April 17. According to police, the woman is between 33 and 58 years old, with a protruding jaw and tattoo of “Joe” or “Foe” on her right arm.

Police released a sketch of the woman, who died one to eight months before being found, said the Maricopa County Medical Examiner’s office.

There was no announcement made about Hughes. His case was apparently discussed in the first half of the executive session.

Hughes is also the subject of an investigation into improprieties that has been concluded. But Goodyear will not release the investigation until Hughes has used his personal leave time.

On April 30, the board unanimously voted to “accept the application for disability for Justin Hughes and to send him for an independent medical examination with additional questions,” according to meeting minutes. As it did May 5, the board discussed the Hughes case privately in executive session before making its ruling in public.

The board is scheduled to meet at 8 a.m. May 28. At press time, no agenda was posted.

West Valley’s Benevilla receives funding award

Gov. Doug Ducey announced May 15 that $300,000 in funding from the AZ Coronavirus Relief Fund has been allocated to organizations that support senior citizens, the homebound and those who are medically fragile.

Benevilla of Surprise was one of the recipients.

According to its mission statement, “Benevilla enriches lives of West Valley residents by serving older adults, adults with disabilities, children and the families who care for them.”

Benevilla’s free home services are available to seniors in El Mirage, Peoria, Surprise, Goodyear, Litchfield Park, Avondale, Buckeye and Tolleson.

Buckeye police detectives arrested Joshua Escoto-Cisneros, 28, and charged him with killing a woman last year.

On April 10, 2019, Buckeye officers responded to the Robbins Butte Wildlife area west of State Route 85 near Robbins Butte Game Road regarding a partially buried body. Witnesses found the body while walking their dogs on a

stop along their way to California.

Police later identified the body as Marisa Bell, who had been reported missing in Nevada but was known to be living in the Phoenix area.

Detectives arrested Escoto-Cisneros May 12 and brought him to the Buckeye Police Department for questioning.

“Escoto-Cisneros admitted to murdering Bell and later disposing of her body and belongings. The two were

very casual acquaintances,” said Donna Rossi, a Buckeye Police spokeswoman.

Escoto-Cisneros was booked into the Maricopa County 4th Avenue Jail on second-degree murder, tampering with evidence, concealing a dead body and other charges.

Many not ready for ‘normal’ More deaths from COVID-19

While some are eager for a return to normalcy, others around the West Valley feel extreme caution is still needed in the COVID-19 pandemic.

The West Valley View’s Facebook page took the following poll May 15: “With Gov. Doug Ducey lifting the stay-home order today, I am (choose one): A) continuing to practice strict social distancing/isolation; B) planning to go out a little more but still practice social distancing; C) ready to return to normal.

Of 134 who participated, 68 went with “continue to practice strict social distancing/isolation,” 27 chose the middle option and 39 are “ready to return to normal.”

Among those planning to continue social distancing/isolation was Dana King, who noted, “I have a compromised immune system and can’t risk getting sick nor getting my babies sick.”

Erica Myers is also playing it safe: “I’m going to wait and see what happens over the next few weeks.”

Lenny Quint planned to stay at home for another two weeks: “I will let the canaries in the mines before me.”

Mary Abernathy Monreal said she was staying hypercautious. “Until I see facts that this virus has a vaccine or a different sort of cure, I’m not willing to play Russian roulette with my family’s lives or my life. I will continue to take all pre-

cautions, wear my mask, carry my hand sanitizer, etc.”

Taking the middle ground is Kerry Lyon, planning to continue “what I have been doing since we were informed of this virus, to practice safety guidelines and go out and do what has been necessary to get the essentials for my family and myself.

What is really sad is that we have had such a big push to remind people to wash their hands, a common everyday practice that keeps so many health. Soap and hot water are your best friends.”

Tracey Hollmann-Hertzog also chose the “B” option, noting, “I will respect people’s space and wear a mask if needed. I would love to go to a restaurant and eat, but it has been fun to order out and eat in the backyards with friends.”

Among those ready for a “return to normal” was Bill Gardner, who noted, “All through this, I haven’t changed how or what I do and it’s not going to stop now. The only restriction to my activities has been what is and isn’t open for service.”

Leah Peah agreed it was time to get back to normal: “We cannot sit at home forever. I of course continue to practice being safe like washing my hands and staying home if I am sick.”

John Beggets sounded ready for action: “I’m gonna visit every store just because I can! Plan to be out all day!”

Many say stimulus checks have come … and gone

Last month, the federal government started mailing stimulus checks to millions of Americans.

In response to a West Valley View Facebook post, only a few said they were still waiting for the federal money.

Most said they received the checks— and promptly put them to use.

“My dog had to go to the pet hospital. It took it all plus some,” Mary Jo James-Barron said.

Jennifer Bousquet Fish spent her stimulus check on “a new fridge and a new mattress. The rest in savings for my daughter’s college.”

“My fridge went out, the dryer’s going out and my washer started leaking into the wash tub. So... (already) spent,” Stella Harvey said.

The stimulus money also went to repairs for Johnnie Johnson-Moreno: “My AC in my car went out - spent it on that.”

Many said they used the stimulus money to pay down bills. A few mentioned housing costs.

Three of 50 who responded said they deposited the stimulus check into savings accounts.

A couple said they were splurging, like Zac Rocheleau: “Gonna buy me a boat.”

Glencroft Center for Modern Aging in Glendale has taken the unique step of publicly reporting cases of COVID-19 - even as the number who died there more than doubled over the last week.

On May 11, 38 residents tested positive for COVID-19 and seven residents died from complications from the disease, according to Millie Oakeson, vice president of corporate marketing for the facility.

Nine more Glencroft residents died from the disease, bringing the total to 16, according to information at glencroft.com/covid.

According to that site, a total of 98 —52 residents and 46 employees —have tested positive for COVID-19. Of those, 51 are listed as “recovered.,” with 19 residents and 12 employees listed as “active COVID.” Though Maricopa County Department of Public Health reports there have been 223 deaths from COVID-19 at long-term care facilities, the county and state have denied media requests to name the facilities that have cases.

And most other facilities have been ex-

tremely guarded, releasing information only to family members.

“In order to provide factually correct information, Glencroft Center for Modern Aging will provide, by next business day, the (COVID-19) information,” stated Glencroft’s website announcement. “This data (is) reviewed and updated when there are changes.

“Please note that we are required to first notify families of residents who may therefore temporarily see slightly different numbers.”

Glencroft has 1,600 people working and living on its campus, Oakeson said. Five of the COVID-19 death were residents of an assisted-living facility at Glencroft, with 11 deaths from Glencroft’s skilled-nursed facility.

Oakeson said none of the 600 residents in Glencroft’s independent living residences have tested positive.

“From the beginning of this pandemic, Glencroft has carefully followed the most stringent preventative protocols and we continue to do so,” she said.

Small farms struggle to get federal relief funds or emergency help from USDA

Despite the federal government’s unprecedented efforts to aid businesses threatened by the COVID-19 pandemic, small farms are being left further behind, according to one local smallfarm owner.

McClendon’s Select, a family-owned farm in Peoria and Goodyear, normally sells its organic produce, citrus and honey to restaurants and farmers markets. Since Arizona banned gatherings of more than 10 people and ordered restaurants without takeout services to shut down March 19, McClendon’s Select has seen a huge drop in business.

“Literally overnight with the COVID-19 restrictions, we watched our restaurant business drop by 95%.

So 75% of our business—almost all of that went away overnight,” said Kate McClendon, owner of McClendon’s Select.

According to the Arizona Farm Bureau, farms and ranches cover about 26 million acres in the state, and their con-

tribution to the state’s economy is more than $423 billion a year.

The first round of the federal Coronavirus Aid Relief and Economic Security Act, or CARES, which was signed into law in late March, included $376 billion for American workers and small businesses. Through the U.S. Small Business Administration, businesses could apply for an Economic Injury Disaster Loan, known as an EIDL, for up to $10,000.

But there was a stipulation.

“It said on the list of eligibility to apply for a small business loan that you could not be a farm,” McClendon said.

“If we were any other business, we would qualify.”

Instead, the SBA asked farmers to reach out to the U.S. Department of Agriculture, which traditionally has resources for farmers in need.

McClendon kept trying, then reached out to Rep. Debbie Lesko, R-Peoria, who represents Arizona’s 8th Congressional District. Lesko’s office helped McClendon look for potential programs she could access.

“From working one on one with small-business owners and federal agencies to holding conference calls with local chambers of commerce, I’m committed to getting the resources allocated to small businesses in their hands sooner rather than later,” Lesko told Cronkite News in a statement. “I encourage all who are looking to utilize these resources to contact my office for assistance.”

Hickman’s, the good neighbor Editor: I wanted to give a shout out to Hickman’s Family Farms. I’ve lived on the west side of town for the last 51 years and have been buying Hickman’s eggs for that long as well. I happened to be at the store on Jackrabbit just before they closed for safety reasons, and I overheard a conversation between Clint Hickman and an airman from Luke AFB. The airman was thanking Clint for the donation of eggs, which was going to feed some of the families out at Luke.

The airman gingerly asked for 20 dozen eggs, at which Clint scoffed and answered, “You’re not getting 20 dozen eggs; we’re sending you home with 90 dozen eggs.”

I was so proud that a family-owned and -operated company was continuing to take care of their neighbors amidst a growing crisis. My dad used to buy Hickman’s eggs when they were just a small family-run store way out on 91st Avenue. Oh my, how they have grown!

Hickman’s is the largest egg company in the Southwest, but they have never forgotten their small-town roots. During the growing pandemic, Hickman’s is continuing to take care of their neighbors by donating eggs to Meals of Joy, homebound seniors, St. Vincent de Paul, Families at Luke AFB, Desert Rural Firehouses (all 10), the county jail, St. Mary’s Food Bank, United Food Bank - Southwest Valley, School Free Meals, Avondale Senior Center, Buckeye Senior Center as well as nurses and doctors who are on the front line fighting the coronavirus.

At a time like this, we all need to pull together and take care of each other as well as our neighbors. Thank you, Hickman’s, for being a good neighbor and reaching out to those in need. You are appreciated!

Many falsehoods Editor: After reading the editorials in this paper the last couple months, I feel compelled to address some falsehoods that I feel are being perpetuated by the press and some editorial writers in this paper.

• That this is a pandemic.

This is not the Spanish flu. In fact, it hasn’t even gotten to the level of the killer flu that was around in 2017-18. That flu killed 60,000 people, and no quarantines or lockdowns were imposed. I know about that flu because it almost killed me (I was saved by a Z-Pak when bacterial pneumonia set in). This whole episode is more accurately described as a panic reaction by state and local governments resulting in a totalitarian power grab by those entities with no true basis in fact or science for any of it.

• That government has the legal authority to close private businesses and confine us to our homes over fear of a pandemic.

Such legal authority is nowhere to be found in the Constitution. Never in my 62 years on this Earth did I ever imagine that the American people would have their basic civil rights stripped because of fear. This country has a long, storied history of facing and defeating fear without submitting to panic. I never thought I would see government and its advocates so casually wad up the Bill of Rights and toss them in the nearest waste basket! It is embarrassing and appalling! The recent protests here and in other states are refreshing and provide hope that we haven’t just yet, as a people, lost our passion for liberty and individual rights.

• That it is Donald Trump’s fault and the Chinese are not to blame.

China has consistently withheld accurate information about this coronavirus since last fall, including its origin. The “wet market” story has been debunked, and there is mounting evidence that it escaped from a biolab due to shoddy safety controls. When China was initially con-

fronted, the country doubled down and threatened to withhold critical medicines needed to fight the virus by our country.

Ten days after the first case was detected in the United States, President Trump instituted a travel ban on Chinese nationals to this country. He rapidly followed that with necessary quarantines of infected persons and established social distancing guidelines to the states, correctly leaving implementation up to those states. This occurred when the infection and death rates were low. By contrast, his predecessor, Barack Obama, didn’t do anything about H1N1 until six months after it hit and 12,000 people were already dead and hundreds of thousands infected.

The shutdown was justified first to prevent the health care system from collapsing, which it has not (medical personnel are getting laid off or losing hours). The justification then shifted to “defeating the virus once and for all.” This goal may not even be attainable and conveniently extends lockdowns indefinitely. We didn’t have a vaccine for SARS, H1N1 or the 2017-18 flu, so why do we need one for this? Treat-

ments are being developed that are proving effective. Studies also show that the virus is killed by sunlight, ultraviolet light and warm temperatures. The only people who are interested in prolonging this are politicians and scientists who gain power from it, not to mention the ability to diminish the likelihood of Donald Trump’s re-election .

The American people have a high enough IQ to figure out how to protect themselves, their businesses and those who are most vulnerable to the virus without having their civil liberties and individual rights stripped away by arbitrary, capricious and draconian government action.

American Legion salutes fallen veterans on Memorial Day

Every crisis has new heroes. During the 9/11 attacks, they were the first responders running into burning and crumbling buildings as others ran out. Now, during the coronavirus pandemic, the most visible heroes are the health care professionals who are saving others and risking their own lives while doing so.

These heroes have much in common with the people we honor today—America’s fallen veterans. They are men and women who have sacrificed their own lives so others could live. They are both elite and ordinary. They are elite in the sense of character. Giving your life so others could live is the ultimate definition of selfless.

They are ordinary in the fact that they represent the diverse fabric of our country. They are rich and poor, black and white, male and female. They come from every ethnicity and background. In short, they looked like any of us.

As we celebrate the selfless and untiring performances of the health care work-

ers during the COVID-19 pandemic, it brings to mind the military medics, doctors and nurses who sacrificed their lives while treating others on the battlefield.

One such hero was Pharmacist Mate Third Class Jack Williams. The Navy Reserve corpsman was only 20 years old when he landed on Iwo Jima 75 years ago.

On March 3, 1945, James Naughton, a Marine in Williams’ unit, was wounded by a grenade. While under intense enemy fire, Williams dragged Naughton to a shallow depression and treated his wounds.

Williams used his own body as a screen and was shot four times. Yet he continued.

After he treated Naughton, Williams dressed his own wounds. He then proceeded to treat another Marine, despite his own immense pain. While heading to the rear, he was hit by a sniper’s bullet and killed.

For his actions, Petty Officer Williams was awarded the Medal of Honor.

We also remember Army veterans like Lt. Sharon Lane.

“There, at least, you are busy 12 hours a day, six or seven days a week,” she said in a 1968 letter to her parents.

Her dedication was obvious, even as she treated enemy Viet Cong soldiers who would return the favor by kicking, cursing and spitting at their American captors.

In the early morning of June 8, 1969, Sharon’s tour of duty ended. A Soviet-built rocket struck the hospital. Lt. Sharon A. Lane was killed in action at age 25.

If she were still here, her skills as a nurse might still be benefiting us during the current crisis. But not all of the heroes working during the COVID-19 pandemic are in the health care industry.

Grocers, first responders, delivery workers and drive-thru restaurant employees are just a few of the many people that we rely on to provide vital services for society while risking their own safety.

The military also has heroes in every occupational field. Truck drivers, cooks and administrative clerks have all paid the ultimate price. At sea, on land or in the air, military service requires great risk.

Roy Knight, Jr. was a pilot in the U.S. Air Force. On May 19, 1967, he was shot down while attacking a target on the Ho Chi Minh trail in Laos. He was posthumously promoted to colonel. Last year, a joint team from the Defense POW/MIA Accounting Agency discovered and later identified Col. Knight’s remains.

When his remains arrived at Dallas’s Love Field, a crowd had gathered to witness the dignified transfer of the flag-draped casket from the Southwest Airlines jet into the receptive arms of the military honor guard. One observer reported that the entire crowd fell silent.

The Southwest flight was piloted by another Air Force veteran, Col. Knight’s son, Bryan. Bryan Knight was only 5 years old when he said goodbye to his father as the elder Knight left for Vietnam.

This is yet another legacy these heroes leave behind. A legacy that includes their sons, daughters, grieving parents, grandparents and friends.

Their heroic acts are sometimes performed to protect those with whom they serve. Cpl. Jason Dunham was a squad leader with the Third Battalion, 7th Marines in Iraq.

On April 14, 2004, his squad approached a Toyota Land Cruiser. After his squad discovered AK-47s in the vehicle, the enemy insurgent exited and engaged in hand-to-hand fighting with the unit. The driver dropped a grenade.

To save his fellow Marines, Cpl. Dunham made the ultimate sacrifice. He threw himself on the grenade and tried to use his helmet to shield the blast. Severely wounded by the grenade’s fragments, Cpl. Dunham was taken off life support eight days later.

Cpl. Dunham died so other Marines could live. He, too, was awarded the Medal of Honor for his gallantry.

Approximately 1 million men and women of the U.S. military have lost their lives in defense of our nation since the founding of this great Republic.

Not all have died from enemy fire.

Some have died from diseases that have too often festered around war zones. Oftentimes, deaths from disease and accidents outnumbered casualties caused by enemy weapons.

During the Spanish American War, 60 soldiers of the all-black 24th Infantry Regiment volunteered to serve as nurses. Thirty-six of them would later die of yellow fever or malaria.

A generation later, the flu would kill nearly 16,000 U.S. soldiers in France during World War I. Another 30,000 American service members died in stateside camps. These men and women could have isolated safely in their homes. But they knew they had an important job to do. A mission to accomplish. They were all on a mission to serve.

Even when the enemy is an invisible virus or a microscopic germ, the sacrifices made are just as meaningful. The U.S. military has already lost service members to COVID-19.

This Memorial Day, as we continue to honor those who fell for us in battle, let’s also pause to remember those who have sacrificed their lives while serving others.

May God bless them and may God bless you for remembering them here today. Thank you.

“Risky Business” isn’t just the name of an ’80s Tom Cruise movie—it’s the unfortunate theme for many entrepreneurs, during and after the COVID-19 pandemic.

Keeping a sharp eye out for the legality of things in our litigious society, the Glendale Chamber of Commerce hosted a Zoom meeting May 14 that offered legal tips for businesses reopening in a pandemic.

There was plenty to chew on for patrons, as well.

Christopher Callahan, Alexis Glascock, Mario Vasta and Terry Evans from Fennemore Craig Attorneys took turns talking about “how to manage risk and minimize the risk of claims now that Arizona’s stay-at-home order is beginning to phase out.”

They said as customers return to your business, there are ample possibilities for contract and tort disputes.

Callahan noted Rep. Andy Biggs of the 5th Congressional District (Chandler, Queen Creek) introduced legislation aimed at protecting businesses.

According to a Biggs press release, his bill is “to protect businesses taking reasonable steps to prevent the transmission of COVID-19 from frivolous negligence claims.”

The Biggs bill “requires a specific jury instruction in civil actions in federal court that include a claim alleging negligence arising from the transmission of COVID-19 (i.e., coronavirus disease 2019) and a request for damages.

“Specifically, a court must instruct the jury that negligence may not be found solely on the basis of holding oneself open for business.”

H.R. 6601 was introduced by Biggs April 23 and referred to the Judiciary Committee the same day. Biggs is also on the Judiciary Committee.

Evans then took over to talk about in-

surance coverage.

He stressed for business owners to read the fine print on their policies at renewal time and be on the lookout for “communicable disease exclusion”— which could, theoretically at least, allow an insurance company to wash its hands of any claim during a pandemic.

“I’ve seen two renewals where they tried to slip them into policies,” he said.

And, he added, with so many people working from home, the “workplace” definition has often changed.

“If you’re working from home and trip over your dog at 2 a.m.—technically, that’s workers’ compensation,” Evans said.

Callahan then jumped in to note most insurance policies don’t cover “business interruption” due to COVID-19.

Loss of business income “has to result from physical loss or damage to your property,” Callahan said.

He pointed to exclusionary language in most policies: “We will not pay for loss or damage caused by or resulting from any virus, bacterium or other microorganism. …”

Callahan noted that the most common claim in our litigious society falls in the category of negligence.

Checking temperatures before allowing employees to work is one way to show “duty” if a person alleges they caught COVID-19 at your workplace and sues you, Callahan said.

The attorney stressed it may be important to show “you’ve acted reasonably.”

“That can be you’re following guidelines—state or local official guidelines— maintaining social distancing, wearing masks and gloves, avoiding direct contact with customers as much as possible.”

And, if you find out an employee is sick from the virus, do you tell customers?

“Technically, it’s a good thing,” Callahan said.

“However, there are HIPAA (Health Insurance Portability and Accountability Act) guidelines.”

Meaning: Trying to avoid one lawsuit could be a trap for another.

Another conundrum came up with the idea of having customers sign waivers promising not to sue if they contract COVID-19 at your business.

“That might give them the idea to sue you,” Callahan said.

•Looking at things from all angles is great for lawyers but can leave the rest of us feeling cynical.

State taking steps to reopen economy, but reviving it could take years

Arizona took another tentative step toward reopening the state’s economy when dine-in restaurants were allowed to resume limited service.

But while reopening the economy could come relatively swiftly, experts say reviving the economy could take years.

As businesses shuttered by COVID-19 and resulting high unemployment have led to a collapse in sales and income tax revenues, state and local governments may be forced to slash budgets. That, in turn, could slow the overall recovery, economists say, with fewer workers and services pumping money back into the economy.

Arizona’s Joint Legislative Budget Committee predicts the state could face a $1.1 billion budget shortfall for the rest of this fiscal year and into fiscal 2021.

But that’s just the midpoint of a shortfall estimated to fall between $600 million and $1.6 billion.

The state may be in a relatively good position with a $973 million “rainy day” fund to draw on in emergencies like this.

But if that’s not enough, Arizona – like other states – may have to make budget cuts to weather the storm.

“Unlike the federal government, states can’t deficit spend and they have to balance their budgets, so you know with these types of revenue loss states could face significant cuts without assistance,” said Erica MacKellar, a policy specialist at the National Conference of State Legislatures.

Gov. Doug Ducey, saying Arizona was “headed in the right direction” in terms of new COVID-19 cases, allowed reopening of retail businesses, gyms, swimming pools, barbers and salons, with social distancing rules in place. And restaurants were allowed to resume dine-in services May 11, with limits on the numbers of people who can be served at one time.

But the JLBC still projects Arizona will lose hundreds of millions in revenue this year and next from multiple sources, ranging from corporate income tax, which is expected to decline 39% this year, to income tax withholdings, predicted to drop 15% in the fourth quarter of this fiscal year.

As revenues are falling, state costs will be climbing in some areas.

Arizona’s Medicaid agency, the Arizona Health Care Cost Containment System, is projecting to see caseloads jump by as much as 30% by the end of fiscal 2021, bigger than the increase the state saw during the Great Recession, according to state documents.

or could start broadly cutting agencies.

But with federal assistance and money from the state’s rainy day fund, Arizona may be able to take the economic hit and “tread water,” said state Sen. J.D. Mesnard, R-Chandler, the chairman of the Senate Finance Committee.

“At this moment, I’m cautiously – but very cautiously – optimistic that everything that will come from the feds and the rainy day fund and other tools in the toolbelt, that we may not have to cut too much,” Mesnard said. “We’re just right now in a waiting game to see where the bottom is.”

But with the bottom potentially as high as $1.6 billion, Mesnard said the gap will be “impossible to budget for” until the numbers become clearer.

Nationwide, state budget shortfalls could total $650 billion, according to the Center on Budget and Policy Priorities.

“States face a fiscal crisis that’s much worse than even during the Great Recession of a decade ago,” said CBPP fiscal director Michael Leachman, during an April conference call.

“They urgently need significantly more fiscal relief from the federal government to avoid laying off workers and imposing deep budget cuts at exactly the wrong time – when those cuts will make an already weak economy even weaker,” Leachman said.

The $2 trillion Coronavirus Aid, Relief and Economic Security (CARES) Act enacted in March appropriated $110 billion to states and $30 billion to cities, but some say it’s not enough. And the Treasury Department said those funds

are limited to use only for “necessary expenditures incurred due to the public health emergency,” limits the critics say are too restrictive for the broad needs of local and state governments.

Mesnard said it’s a challenge “when you don’t know what the rules are for the money that you’re given.”

“We’re still learning about whatever restrictions we have on how we allocate it,” Mesnard said. “Eventually they’ll put some meat on the bones as far as the money usage that’s going to the states.”

In the worst-case scenario, states will have to cut their budgets but Mesnard said that would be a struggle when so much of the budget is essential services like education and health care. He called those “the last place we’re going to cut.

“Those three issues, public safety, education, health care, are the three things that encompass 90% of the budget,” he said.

Cuts to state and local budgets would “make the downturn worse,” said Stephanie Aaronson, an economic director at the Brookings Institute.

“States would end up having to lay off civil servants and cut back on services in a way that will be detrimental to the health of the economy,” she said.

Aaronson said there’s a lesson to be learned from the Great Recession in 2008.

“I think one thing that made it so difficult for the country to emerge strongly from the Great Recession was the fact that state and local government spending recovered so slowly,” she said. “It was really a drag on the economy.”

Regina Holmes believes everything happens for a reason.

When she and her husband, J.J., had the chance to rebrand the couple’s Native Grill and Wings stores, they ran with it.

“Life happens for a reason,” she said.

“We had some opportunities, and it made sense for us to go off. We were able to rebrand, and it was great. We are now J.J.’s Grubb Shack.”

On May 20, their Happy Valley location opens, followed by Avondale on Memorial Day and Goodyear on May 29.

“We’re rebranding with a new menu and a different look and feel,” Regina said. “We’re really excited about it. The concept originates from having family and friends at a backyard barbecue. My husband and I, one thing we love to do is entertain friends. He comes from a family where he’s the youngest of eight.

“It’s customary for us to have friends and family over on the weekend.”

The menu is broken up into sections.

Sticking with the party theme are the “Backyard Burgers”—bacon butt burger, the “Hair of the Dog” and the Grubb Shack original ($11.99 to $13.99).

“Our menu is going to be focused on bar and grill, fun foods,” she said. “People can come and socialize and enjoy themselves. Kids will be running around having a good time. At some point, we hope we can get back to that.”

The couple’s first restaurant is attached to their small liquor store, where they offer catfish platters and burgers.

“When we moved out here (from Colorado), we purchased a liquor store, and we had that for a number of years,” she said. “We added a restaurant onto it. We wanted to offer something that brought a backyard feel.

“This has a very similar feel and the same name. These are sports bars and grills, though, with plenty of televisions.

One of the things my husband said is, ‘I cannot have a bar and grill without sports.’ He’s a sports enthusiast.

“He played sports at University of Colorado Boulder for a little bit. He had a lot of friends play professionally. Allthings sports is his passion.”

In light of the COVID-19 pandemic, the staff had the restaurant sanitized, she added, and doesn’t take anything for granted. She posted on social media that they’re strictly adhering to the Centers for Disease Control and Prevention’s guidance on social distancing.

“We’re longing for the days when we could all hug each other by the bar,” she said. “We’re not there yet. For our curbside takeout, all of our runners wore gloves and masks—same when you dine with us. We’ll have hand sanitizer avail-

Regina admitted it’s a little difficult to open restaurants during the COVID-19 pandemic.

“It was hard, but we have a solid business plan that we feel good about,” she said. “The reality is this is what we do now. It wasn’t any harder than feeling if we walked away, we were going to be a

failure. No one wants that. We rebranded, rebuilt and we recognize it’s not going to be where it was in February. But we’re ready the minute the doors open.

We’re prepared for the long haul.”

Gov. Doug Ducey says it’s now OK to watch movies in a theater.

But don’t pack the kids in the car just yet or fill your purse with candy from the dollar store.

Theater operators contacted by Capitol Media Services say they’re not ready to open the doors just yet—if for no other reasons than there simply isn’t anything new to throw up on the screen.

But they are willing to sell you popcorn, and even bring it out to the curb for you.

The Department of Health Services has released its guidelines for how the theaters should operate, covering everything from seating to butter dispensers for popcorn.

Only thing is, these are being phrased as suggestions and recommendations.

And that leaves a lot up to individual operators—and, ultimately, to customers to see if they feel safe.

As to other recreational opportunities, don’t hold your breath waiting to see the first pitch of the season.

Ducey has said that games can go on, albeit without fans.

“Although we are not planning to reopen our theaters now, we are anxious for the day we can safely and responsibly welcome guests back into our theaters to watch movies on the big screen, where they are meant to be seen,’’ reads a statement from Harkins Theatres.

The company says it is working with public health officials and industry partners to finalize a reopening plan and safety protocols.

Goodyear Youth Commission taking applications

The city of Goodyear encourages high school students interested in learning more about how their city operates to apply to join the Goodyear Youth Commission.

“I’m extremely proud of this youth program and to be able to give these students, our future leaders, an opportunity to provide their input on city services,” Mayor Georgia Lord said. “It is important for our youth to be engaged with their community.”

The Goodyear Youth Commission provides an opportunity for students to develop leadership skills through involvement in city government and creates a format for students to express

their voices on a variety of youth-related issues, such as youth programming, recreation opportunities and special events.

“Being part of the Goodyear Youth Commission has taught me how to serve the community and learn what it means to be a leader,” said Gabriella Burton, 2019-20 Youth Commission chair and Millennium High School student.

The Youth Commission is open to high school students in Goodyear or to students entering high school in fall 2020. Applications are due Friday, May 22.

Littleton schools celebrate ‘Tunnel of Hope’

All seven schools in the Littleton District will host a “Tunnel of Hope” at 9 a.m. Thursday, May 21, to celebrate eighth grade promotion in a drive-thru fashion.

Families of eighth graders can drive through their school parking lot, where there will be balloons and music set up.

Teachers and administration will

be outside to wave and shout encouragement to the students. All students will receive promotion yard signs and a jump drive with a special promotion video made by the school.

The schools: Collier Elementary, Avondale; Country Place Leadership Academy, Tolleson; Estrella Vista STEM Academy, Avondale; Fine Arts Academy, Tolleson; Littleton Elementary STEM Acad-

emy, Avondale; Quentin STEM Academy, Avondale; and Tres Rios Service Academy, Tolleson.

“While this is not a traditional ceremony like we are used to, it’s important to acknowledge all the hard work put in by our eighth graders to be able to promote to high school,” said Dr. Roger Freeman, superintendent of the Littleton School District.

Smithsonian’s website has games, videos and photos of some of its collections in the museum that can be accessed at si.edu/kids.

TedEd’s website has five- to six-minute videos on lessons throughout the different subjects from the arts to physics.

They are free to all and can be accessed at ed.ted.com.

The National Constitution Center has history games and lessons about prominent times of history. From learning through an interactive Constitution to a game about Abraham Lincoln’s presidential decisions, students have free access to these history resources. The program can be accessed at constitutioncenter.org/learn/educational-resources.

The PBS Digital Studios Art Assignment is a video series that teaches art and art history lessons through a series of online assignments and videos. The program is also a way to encourage students to create and express their artistic skills and think of art through a modern standpoint. Rose Marie Eshenbaugh Rose Marie Eshenbaugh, 79, of Buckeye peacefully passed away on May 7, 2020. Rose was born on November 30, 1940, in Natrona Heights, Pennsylvania, daughter of the late John and Theresa (Clouse) Klaes.

She has lived the past 55 years in Buckeye with her husband of 57 years, William Eshenbaugh, and three children, Lawrence Eshenbaugh, Billie Jo Tedder and Jennifer Haymes. Along with her spouse and children, Rose is survived by eight grandchildren, seven great grandchildren and one great, great grandchild. Rose will be dearly missed not only by her family, but by her two remaining furry friends whom she shared a deep connection. Rose was preceded in death by both parents and her brothers, John, Robert, William, Daniel and "Sonny" Klaes; and, sisters, Helen Palyarik, Agnes Parkinson and Margaret Rum. Phyllis Rebekah Peeling Dill Born August 29, 1928, died May 12, 2020 Phyllis was born in Williamsport, PA to Evelyn Daugherty and Clarence A. Peeling.

She graduated from Williamsport High School in 1946 and married James Sterling Dill in 1951.

They raised two children in Somerville, NJ, then moved to Denver, CO in 1972 where they lived until retirement. Phyllis enjoyed volunteering at the Denver Botanical Gardens and was an active member of the Westminster Presbyterian Church. In 2002, they moved to Goodyear, AZ where Phyllis volunteered with KareBears at Pebble Creek and the Southwest Lending Closet and enjoyed spending time with her family. Most recently, she lived at a senior residence in Minneapolis near her daughter, where she continued to make friends and show her concern for others.

Phyllis is preceded in death by husband, Jim, and brother, Bill Peeling. She is survived by her sister, Jean Brady and husband C. L. Brady, daughters Sharon Dill and Marsha (Dennis) Moon, four grandchildren, 10 great grandchildren, a niece and nephews.

Phyllis was a loving and thoughtful sister, mother, aunt, grandmother and friend. We will miss her kind presence and positive attitude.

There will be a private memorial service.

Maggie Dean Porter Ash Maggie, 89 of Buckeye, AZ passed away April 18, 2020 in Goodyear, AZ. Maggie was born July 15, 1930 to Fred and Edna Zoe Keyt Porter in Portland Mills, IN. She married James Russell Ash on October 9, 1948. She is survived by her children; Diana Inman, Tom (Linda) Ash, and Robert Ash, grandchildren; Frank Inman, Dana Inman, Nicole Gibbons, Megan Tanner, Elizabeth Wilhelm, Kristy Vaughan and several great grandchildren, nephews, nieces and a sister-in-law, Ruby Porter. Maggie was preceded in death by her parents, her husband Jim, daughter Carol, grandson Jay Ash, brothers John, Kenneth, Bernard, Rex, Claud, infant brother and sister Reva. Maggie was a Beeline manager in Effingham for many years. In 1976, she and Jim decided to sell their home in Effingham and travel the countryside to various job sites. Before she left, she earned her LPN, graduating with honors from Lake Land Community College. Jim and Maggie finally settled in Buckeye, AZ out in the middle of nowhere and they loved it there. Maggie was a skilled needle-pointer and loved to crochet. She was a past president for the Women's Auxiliary for the VFW. Maggie and Jim were the best in-laws a person could ask for. They were both generous in so many ways. May you both fly high-until we meet again. Memorial services will be held at a later date at Chapel of the Chimes mortuary.
