The Glendale City Council voted to approve the reappointment of City Judge Manuel Delgado at its Feb. 23 meeting.

Delgado has served as a city judge in Glendale since 2013 and was reappointed back in 2017 by the council.

His current term expires March 25, but with the council’s approval, he will serve another four-year term.

Council also approved an agreement with Axon Enterprise for the purchase of equipment, installation, data storage and software maintenance for Glendale Police Department interview rooms.

is approximately 10 years old and has the potential for failure, requiring immediate replacement, according to the proposal.

Bill Kelleher retires from military committee

Bill Kelleher grew up admiring the military duties of his World War I veteran father, and his brothers who served in the Vietnam War. He didn’t join the military, but he did the next best thing. He supported the families of those stationed at Luke Air Force Base through the Glendale Chamber of Commerce Military & Veterans Affairs Committee. He was on the board for 40 years before retiring in February.

“I was not privileged enough to be a member of any part of the armed services, but my father was a Marine during World War I,” Kelleher said.

“The mustard gas basically took him at an early age. I was 15 when he passed away. I have two brothers who were also Marines.

er was in Vietnam. I fell between the cracks.

Back then, you signed up for the draft. I was too young for Korea and too old for Vietnam.”

Kelleher connected with veterans and military personnel because of his family’s involvement. His favorite shirt is one that bears a U.S. flag that reads, “Stand for the flag.” At the bottom is a cross that says, “Kneel at the cross.”

annual cost is $24,106.29 for maintenance and evidence.com storage, though the cost for the entire term is not to exceed $169,024.

The project aims to improve the efficiency and effectiveness of the Glendale Police Department in its continued mission to protect the community.

The Glendale Police Department will also be receiving new self-contained breathing apparatus equipment.

SCBA face masks are used to protect against oxygen deficiency, dust, gases and vapors.

Specialized equipment, like SCBA face masks, is used by the Glendale Police Department Special Operations Division.

Current equipment is set to expire, requiring the purchase of 33 SCBA face masks and 17 tactical SCBA, according to the proposal.

The council approved the $62,970 cost, which will be purchased through Matlick Enterprises.

The funding for this purchase will come from an Urban Area Security Initiative grant award, which has been received from the Arizona Department of Homeland Security.

At the meeting, council approved an agreement with ADOT that will bring 1GB of network switches and CCTV to be used at 166 locations in the city of Glendale.

The project aims to improve network response time, camera clarity, traffic signal timing adjustments, and the ability to address concerns from the public.

The total estimated cost of the project is $996,000, with the city’s portion of the total cost at $85,062.

With summer approaching, council also approved to authorize the restoration of slide and pool play structures at Rose Lane Aquatics Complex and Foothills Recreation and Aquatics Center.

The cost of the restoration is not expected to exceed $60,550.

Rose Lane Aquatics Complex was previously renovated in 2003, and the Foothills Recreation & Aquatics Complex was built in 2006.

The restoration would extend the life of the slide and structures as well as ensuring the safety of Glendale community members.

“We are very in touch with what the needs are out there,” Kelleher said.

“It’s been a blessing to me. I sit back now and just listen. I’ve been there, done that.”

The committee’s priority projects are Glendale’s military induction ceremony, military appreciation breakfast, Veterans Day ceremony, Luke Shoot Out Golf Tournament and flag repurposing and retirement program.

It supports Stand Up for Veterans, Mayor Jerry Weiers’ Big Dog Run, the Healing Garden and Traveling Vietnam Wall.

“Bill Kelleher is one of the finest gentlemen I have ever met,” Weiers said. “He has always lived to serve the community with absolutely no expectations in return. I am truly blessed to call him a friend, and I know that anyone who has had the honor of getting to know him would agree with me.”

Stand Up for Veterans is a collaborative, community-based effort that honors and supports veterans by providing access to employment, education and community resources to address the holistic needs of veterans and their families.

Attorneys and court representatives are on hand to immediately address and help with legal issues. Employers are in attendance, some of whom can hire veterans on the spot.

One of the committee’s signature causes is Operation Warm Heart, which supports Luke Air Force Base families.

“We thought it would be nice to have some sort of involvement with children or dependents whose parent is deployed someplace else, but the family still lived here,” Kelleher said.

During his tenure with the Military & Veterans Affairs Committee, Kelleher was licensed mortician and embalmer at Glendale’s Chapel of the Chimes Mortuary, from which he retired. He grew up in Illinois, but he moved to Glendale in June 1973 to help his daughter, who had breathing issues.

His love for Glendale translated to volunteer work and strong relationships with the mayors.

“I’ve been very fortunate over the years,” he said. “I’ve been associated with six of the mayors since I came here. We’ve been on a first-name basis.

Glendale is like an old hometown.

“I’ve always tried to stay involved.

When I joined, I was the new kid on the block. There were these other three gentlemen and me. I thought, ‘Let’s try to get some type of partnership out at the base where we can maybe help on a monthly basis.’”

The Military & Veterans Affairs Committee’s early days — and up until the 9/11 terrorist attacked — it alternated meeting in the Glendale Chamber of Commerce conference room and Luke Air Force Base. Base commanders, and occasionally wing commanders, were affiliated with the committee.

Kelleher said, from an economic standpoint, it makes sense for the chamber to be involved with Luke Air Force Base, as it’s one of Glendale’s major employers.

“They’re partners with us, and we’re partners with them,” Kelleher said.

“Glendale has been fantastic when it comes to the needs of former and present military.

Now was the right time for Kelleher to retire because, he said, he will soon turn 80 years old.

“It’s time to get out of here and let some new kids sit here,” he says. “I’ll try to stay involved, and if there’s a need out there, I’ll help.”

The Citizens Transportation Oversight Commission recently discussed expanding the light rail to ASU’s West Campus and Metro Center Mall, Glendale’s highest-performing bus routes, and complaints that the city’s buses are inconvenient to residents.

Glendale’s transportation planner, Patrick Sage, introduced Valley Metro staff members who discussed the Glendale transit plan.

“I do just want to highlight the really good working relationship we have with Glendale transit and the Glendale transportation team,” said Joe Gregory of Valley Metro.

Gregory handed the microphone to Valley Metro co-worker Matthew Tauton, who presented several charts and maps of the transit service. Tauton’s maps contained the highest-performing routes and boarding locations in Glendale, with 67th Avenue being the highest.

“Another trend is that many of the other highest-performing routes in Glendale, there are some common themes to them,” Tauton said. “They typically intersect with other routes that operate frequently, especially light rail.”

His presentation showed Glendale is heavily dependent on Phoenix’s transit service. Tauton said, “Phoenix is the dominant provider in the region.”

Tauton presented a 10-question survey that was originally posted on the Glendale website between October 2019 and January 2020. The survey showed the predominant comment was the bus service was not close enough

to people’s starting points. The survey also showed residents want more frequent service in Glendale. In the survey, respondents said they were open to the idea to expand/extend the local transit service.

The presentation also listed Glendale Transit Service’s priorities. “First is to bring all the services in Glendale up to what is called the Transit Standard & Performance Measures, TSPM,” Tauton said.

The TSPM are the regional standards for transit service. It’s important to note most service meets TSPM standards on weekdays.

“We want to focus on improving existing service before adding substantial new service,” he said.

Data taken from across the area shows there’s a greater investment on improving service. Other priorities also include making stronger connections with the city of Phoenix and regional transit nodes such as Metrocenter transit center or Desert Sky transit center.

Javier Gurrola of Pavement Management and Street Reconstruction provided a monthly progress update on activities in Glendale.

“Because of rain and cold weather, we have halted any service treatment that’s temperature sensitive,” Gurrola said.

According to Gurrola, due to weather conditions, Pavement Management had a slow January. In terms of expenditures, Gurrola said his department spent a little more than $200,000.

Gurrola also reported more construction will begin in March and that Camelback Road, from 83rd Avenue to 91st Avenue, will undergo extensive renovation.

Lori Norris helps vets transition through her podcast

Lori Norris did not serve time in the military, but she wants to do everything she can to help veterans.

She does this through her podcast, “Lessons Learned for Vets.” Every Wednesday, her guests provide advice and guidance for those about to transition out of the military.

“This podcast series was created to give veterans a platform to learn from mentors,” Norris said. “By interviewing those veterans who have already traveled the transition path before them, we give veterans insight and information on what worked and didn’t work for them, help them prepare for potential obstacles and plan for their own transition success.”

Her goal is to give veterans and current military members actionable ideas every week that they can use to guide their transition, no matter which direction they choose to travel.

Norris joked that she’s “bilingual” — speaking civilian and the language of the military. She’s been volunteering to help the military since 2005, when she taught resume writing to Luke Air Force Base airmen.

“I didn’t need a job, but I didn’t want to quit teaching,” she said. “I taught three days of a five-day transition assistance program, or TAP. It’s a five-day program where, theoretically, they teach you everything you need to know to leave the military.”

Norris can’t keep herself from helping veterans, whom she calls the most “dedicated, selfless group of people.”

It’s something that comes natural to her.

The daughter of an Army veteran, Norris lives close to Luke Air Force Base in Glendale and found a love for showing folks like her father how to “turn that light bulb on.”

“I want to help veterans translate what they’ve done in the military to affectively market themselves in the private sector,” she said. “They don’t have to be an aircraft mechanic if they don’t want to. They can do something else if they wish. I don’t want them to feel they have to keep doing what they trained for in the military. The

Norris launched her podcast, appropriately, on Veterans Day 2020.

Among her guests was Herb Thompson, who wrote “The Transition Mission: A Green Beret’s Approach to Transition from Military Service.”

Now a management consultant at a top-tier firm, Thompson, Norris said, has a “great story.”

“He came from nothing and said, ‘I knew I had nothing to go back to,’” Norris recalled. “He said he had to make something of himself. He became drill sergeant of the year and an Army green beret. He likens the transition to deploying to the United States.

“There is nothing more difficult than deploying into the United States.

They have to learn the culture of the private sector. I also interviewed a Marine Corps officer who has always been interested in finance. He started his own financial planning company and teaches people how to set them-

selves up financially.”

Norris has also interviewed a recruiter from Northrop Grumman to get advice for veterans seeking a job and the biggest mistakes they make.

“My podcast is a labor of love,” said Norris, a Cactus High School graduate. “It’s a passion project. It’s just really something I’ve always wanted to do. I have a business where I provide resume writing and LinkedIn. I’ve had veteran clients all along.

“I really thought people could learn from their stories. I decided I’m going to tell their stories. Very few people have said no. My goal is to get this podcast in front of as many transitioning veterans as possible.”

Companies come together to host job fair

Leibowitz reaction Editor: The despicable comparison of deceased media icon Rush Limbaugh to Ted Bundy by columnist David Leibowitz reflects poorly on the journalistic integrity of The Glendale Star.

Leibowitz joins Limbaugh’s many critics who apparently didn’t listen to the show regularly but use out-of-context quotes from liberal media sources to promote a false narrative rather than compete in the arena of ideas.

As one example, the source of a (racist) moniker to describe then-presidential candidate Barack Obama was a Los

Angeles Times columnist. Limbaugh simply played a song parody that was based on the Times’ article. And Limbaugh’s statement that he hoped the newly elected President Obama would fail referred to the implementation of Obama’s clearly stated socialist policy objectives, not the man himself, a fact recognized by any objective observer.

Online floral company finds success is blooming

Whitney Bromberg Hawkings was working for fashion designer Tom Ford when she became frustrated with the cost and inconsistency of the flowers she was buying and sending.

After 19 years with Ford, she decided to start FLOWERBX, an online flower delivery services company that sources the freshest flowers, direct from growers. She specializes in seasonally optimal flowers, like peonies in the spring and in the fall hydrangea, followed by ranunculus in the winter.

“I wanted to create a branded floral offering,” Hawkings said. “As a working mom, I was buying everything online. I bought my weekly farm-fresh groceries online, my clothes online, my beauty online. Yet, I found it was impossible to buy flowers in a simple, chic and fuss-free way online.”

Hawkings said she learned her entrepreneurial skills from Ford, for whom she would have worked for another 20 years. She began her career in Paris working for him at Gucci and later became his communications director upon the launch of his eponymous label in 2005.

“Working with Tom was a dream come true,” she said. “The lessons I learned from him are countless, and I couldn’t have learned from a better teacher how to build a successful, recognizable and powerful brand, among the many other lessons I learned from him.

“He taught me the importance of hard work and perseverance but also about the art of creating desire, of telling a story around a product and setting a scene to make it irresistible. I have tried to apply all of these learnings to FLOWERBX in my goal of creating what I know will be the first global flower brand.”

County sees increase in housing inventory

The first month of 2021 saw 293 MLS listing sales close in Glendale and 289 in Peoria. Today there are 117 active and available listings (not counting properties already under contract or pending close of escrow) in MLS in Glendale and 103 in Peoria. That’s 40% of one month’s inventory in Glendale, up from 30% in December and 28% down from 34.3% of one month’s inventory in Peoria. Today’s Maricopa County inventory is 54.3% of January’s closed sales, up from 49.6% in December. In Maricopa County, the days a listing spent on the market rose slightly from 41.39 to 43.62.

While it looks like Glendale and Maricopa County overall have seen an increase in available inventory, that data needs to come with a little perspective. According to Cromford Report data, the number of available Maricopa County listings in January 2021 was down 18% from December 2020 and over 50% from January 2020.

And Cromford Report data continues to track month-over-month increases in the average final sale price per square foot, with January 2021 sale prices up 1.8% from December 2020 sales, consistent with the roughly 2% monthover-month increases we saw in the last quarter of 2020.

According to ShowingTime, the platform Realtors use to schedule most of the MLS showings, Peoria listings in the $300,000 to $399,999 range had the highest number of showings for the second straight month at 31.64% of January traffic. Listings in the $200,000 to $299,999 range came in second at 26.2%, and listings in the $400,000 to $499,999 range pulled in 21.07% of the showing traffic last month. Glendale statistics show traffic split almost evenly between the $200,000 to $299,999 and $300,000 to $399,999 segments, at 37.01% and 38.82%, respectively. We should continue to see these shifts in showing traffic as prices and demand increase and low-interest rates afford

buyers more purchasing power. Not all showings are scheduled through ShowingTime, so actual numbers are typically higher.

According to Freddie Mac, mortgage rates are beginning to increase slightly for a 30-year fixed loan.

As of Feb. 18, National Mortgage Rates reported the U.S. weekly averages of 2.81% for a 30-year fixed, 2.21% for a 15-year fixed rate and 2.77% for a fiveyear ARM. January entry-level prices for a detached home with three bedrooms and two baths in the West Valley dropped a bit for FHA buyers, as buyers using FHA financing saw minimums of $107,000 in Maricopa County, $217,000 in Glendale and $214,000 in Peoria. Conventional financing buyers in Maricopa County saw a decrease to $136,225, as did Peoria conventional buyers down to $235,000, but Glendale conventional buyers saw an increase to $243,000. Maricopa County VA buyers saw an increase to $230,000, and Glendale VA buyers increased to $265,000, with a drop for Peoria VA buyers to $278,000.

According to MLS statistics, the number of Maricopa County buyers financing their purchases in January dipped slightly to 81.1% from 82.7% in December. Conventional financing made up 58.1% of those sales, FHA financing 9.8%, VA financing 5.7%, and the remaining sales used other financing methods. In January, only 8.9% of sellers contributed to buyers’ closing costs.

Dodgers prepare to defend World Series title

Winning a world championship is one of the toughest things to accomplish in sports, but there’s one thing that’s even tougher.

Defending that title.

As the Los Angeles Dodgers return to their annual spring home in Glendale, their quest to repeat as World Series champions is taking shape.

“I’m just excited to be back out on a baseball field and in this locker room with these guys,” said Dodgers third baseman Justin Turner during a Zoom call from the team’s Spring Training facility.

“Ready to get started on another mission to win another championship.”

The Dodgers had a big offseason, bringing in 2020 NL Cy Young winner Trevor Bauer on a three-year, $102 million contract. Two other notable “acquisitions” for the team were resigning Turner after allowing him to explore free agency, and getting starting pitcher Da-

vid Price back after he opted out of the 2020 season.

Price hasn’t pitched since Sept. 1, 2019, which will give the 35-year-old about 19 months of rest by the time he makes his first appearance as a Dodger.

“I think at this point in my career it can be a good thing, just to kind of let my body reset, let my arm reset, being able to use that time to let my body heal,” Price said. “Doing what we do, especially as a starting pitcher, having all the innings and all the pitches thrown, that can definitely take a toll.”

Manager Dave Roberts echoes that sentiment.

“I think if anything, it’ll affect him (positively), as far as on the physical (side),” Roberts said. “I think on the emotional side, I think that there’s going to be some adrenaline, some nerves, which is to be expected, but … I know he’s willing to help us in any way, and just to kind of get him back working with our guys is just a benefit to everybody.”

Even with all that rest, Price admitted

the only way to truly prepare is to get back on the mound.

“To me, that’s what you use Spring Training for. I feel like you really can’t simulate that game action until you get out there,” Price said. “Even whenever I’m playing year to year, those first couple of spring outings, they always feel brand new. You’re out there feeling for things that make you tick. That’s what I’ll be doing, and everything feels really good right now.”

Turner’s return to the Dodgers wasn’t a sure thing, but after testing the open market, nothing was enticing enough to lure him away from Los Angeles.

“Obviously LA and the Dodgers hold a pretty big spot in my heart, I’ve spent the last seven years here making a ton of memories,” Turner said. “It’s a place that’s always been special to me, and going into the offseason and through this free agency process, it’s something that never, never left my mind.”

Turner coming back was also the

and Locke Accardo accompanying her for the first few miles.

Along with stops at the local rinks, the Mesa native and 2014 Olympic silver hockey medalist received rallying cries of support from members of the Arizona Kachinas girls’ hockey program and from fans decked out in Coyotes colors and Accardo mementos.

“The way she was able to bring so many people together, I think we saw that today,” Fry said. “Every single rink, it was rocking and truly incredible.”

Leighton’s spirit guides Fry through fundraiser

Those words from Leighton Accardo served as a guiding light for Lyndsey Fry as she embarked on an inspirational journey.

Fry, the director of external engagement and female hockey for the Arizona Coyotes and the president of the Arizona Kachinas Hockey Association, rollerbladed 96 miles Feb. 21 to raise money for the newly created Leighton Accardo Scholarship Fund.

It honors Accardo, who died Nov. 24 after a battle with Stage 4 cancer.

For Fry and others, Accardo’s fighting hockey spirit is persistent motivation to

“When you get asked to do something like this, I knew this would be a fun one,” Doan said. “I was really excited to hang out with Lyndsey for the afternoon.”

Fry trekked through the toughest part of her journey from Scottsdale to AZ Ice Peoria on rough terrain as the sun set. Even through the muscle soreness and mental fatigue, she strived to carry on Leighton’s joyful spirit.

Leighton’s battle with cancer was moving for the whole community.

A stomach pain prompted a CT scan which revealed multiple masses on her abdomen, liver and lungs. Biopsies determined germ cell tumors.

She underwent weekly chemotherapy treatments and radiation therapy, spending countless days and nights in hospital beds.

In May 2019, Leighton decided to shave her head. She did not do it alone.

She was surrounded by teammates from the Peaches, an all-girls baseball team from the East Valley Baseball league. Katie and Emily, two of Leighton’s friends, did not hesitate to join her and shave their heads, along with about 200 kids, to show the support of her fight.

Coyotes forward Christian Fischer choked up while describing the impact Leighton made on him and his teammates and remembering the one-day contract she signed with the Coyotes in 2019 on their “Hockey Fights Cancer” night.

“When she came into the locker room and signed that contract with us for the day, I don’t think her family knew how much that meant to us,” Fischer said.

“We would always get little videos and pictures throughout her battle. It was so inspiring just to see her. … It’s tough to talk about her just knowing how much joy she brought to everyone. That’s the one thing that she left behind and the one thing that we wear on our helmets. She’s gone but not forgotten.”

The Leighton Accardo Scholarship Fund will provide financial support to young girls interested in playing hockey in Arizona and carry the memory of Leighton in the Valley hockey community. On the day of the event, the Coyotes surpassed their goal of $49,000 — a special total because Leighton wore No. 49 for the Arizona Kachinas.

“It’s comforting to know that Leighton won’t be forgotten with this scholarship fund,” Carly said. “Girls will get the chance to experience hockey, a game that Leighton absolutely loved, in her honor.”

“This is our way of being able to do that and our promise to her family. She was an amazing, amazing kid that impacted so many of us in so many different ways. This is something we want to do forever. That’s my personal vow.

As long as I’m here, we’re going to do something like this every single year.”

DrivingMBA is helping students master the road

Maria Wojtczak believes in the power of education, especially when teens are working toward their driver’s license. She founded DrivingMBA, which has offices in the Scottsdale Airpark and Glendale, to make sure folks of all ages had top-notch training.

“For any family considering registering their teen for driver training, this is the time to do it,” Wojtczak said.

“We learned early on that standard driving training isn’t enough to keep Valley teens safe on the roads. Our mission is to save lives, and we believe in the power of education and providing our students training and tools based on research and science to help them become competent, responsible and safe drivers for the rest of their lives.”

Beginners are taught the fundamentals in a simulation lab, in vehicles and through online classes.

“We have hundreds of scenarios so they can learn all the basics of driving — hand and foot control, steering controls, getting on and off the roadways, and getting on freeways, for example.

“When we take them on the road, we’re just building on what they’ve already developed,” she said.

The defensive driving lab is more advanced. It has 40 scenarios that introduce the students to hazard recogni-

tion, the dangers of intersections, redlight runners, skidding and adverse weather conditions.

DrivingMBA has graduated more than 15,000 students from the program since opening its doors over a decade ago. Research shows motor vehicle crashes are the No. 1 cause of death among teenagers in the United States, she says.

Most of these fatal collisions occur within six months of a driver obtaining a license.

“We are firm believers in the power of ‘experiential learning,’” Wojtczak said. “Our programs are designed for novice drivers, professional drivers, mature drivers, and drivers who need special attention. Simulation is a perfect tool to allow novice and experienced drivers to make mistakes and learn from them in a safe environment.

In the ‘real world,’ that isn’t possible without significant consequences.”

When DrivingMBA opened in 2003, it was near the Ice Den before moving to a building on Bahia Drive. When COVID-19 hit, the company was forced to downsize due to employees working at home.

“We operate with a much smaller footprint,” she said. “Glendale has two simulation labs, one manager’s office, and that’s it.

“We used to do in-house classes with 12 to 15 students. We had to put it all online. We don’t need this big classroom that we’re using as a waiting room.”

DrivingMBA is opening a second facility to provide its drivers training to students in the Northwest Valley.

The new location is at Il Palazzo at Ar-

rowhead Ranch, 5940 W. Union Hills Drive, Suite D210, in Glendale. At both locations, DrivingMBA will also train those with ADHD or ADD and those who are on the spectrum.

The site in Glendale will be dedicated to Jennifer Hinds, who died after a red-light runner hit the car in which she was riding near Ironwood High School in Glendale. Her parents, Frank and Gail Hinds, co-founded Red Means Stop.

Wojtczak was Red Means Stop’s board president for more than four years. The organization created a scholarship program for children who can’t afford to train at DrivingMBA. “It’s been our dream to make this a national company,” Wojtczak said. “I want to change the way driver training is done. We’re just looking for investors.

“We’ve been at this for 17 years.

We have a really good reputation in Scottsdale. We’re leading edge when it comes to training. We’ve had feedback from folks saying we literally save kids’ lives. One year, I had a mom crying just before Thanksgiving, saying, ‘My son’s going to be at the Thanksgiving table because of what you taught him.’”

Pita Jungle launching first food truck

Since it was founded in 1994, Pita Jungle has grown to 24 locations across the Phoenix area, Flagstaff and Tucson. To continue its expansion and provide healthy options to a growing customer base here in the Valley, the Arizona-based Mediterranean chain is taking a different angle with the launch of its new food truck.

“Everyone has been kind of seduced by the notion of food trucks, and that had started a few years ago when food trucks came out of the woodwork as a new thing,” said Bassel Osmani, Pita Jungle co-founder. “Chefs were going on food trucks. Suddenly, it wasn’t just typical ‘food truck’ food.”

Citing a shift from typical “festival food” such as hot dogs to “gourmet” options, Osmani realizes there are opportunities that come with mobile food, especially in light of recent events.

“Now, in the wake of COVID — or while we’re still in COVID — we realized that’s something that we can use in several fashions,” Osmani explained. “Having turned to Uber Eats and DoorDash and all these platforms during this pandemic, we noticed with our brand recognition all that we needed to do is turn on a platform to get sales.”

to mention combos and a few new items specific to the truck. Osmani called the selections Pita Jungle’s “greatest hits” that also work in a mobile format. Plus, he says, the team is leaving room for specials.

“We’ll be testing things to see what works, what doesn’t,” he explained.

Osmani is keeping his eye on opportunities from all angles, and he sees many different ways the food truck could prove useful to Pita Jungle.

Mainly, it will allow expanded access to areas where the chain doesn’t already have restaurants, while also allowing third-party delivery support.

Osmani likens it to a new restaurant and digital storefront.

The truck’s location will be updated in real time on Pita Jungle’s website, with the brand also aiming to engage with supporters on social media, Osmani said.

On the other hand, he said catering is a “huge” part of Pita Jungle, which has always sought a practical way of doing so.

“If nothing else, I mean, that food truck will be a very useful tool just to shape up and fortify our catering operations,” Osmani said. “And then if things work out, the sky’s the limit, right?”

While the goal is to eventually have a fleet of food trucks, Osmani considers the first one “the proverbial wetting the whistle.” It all depends upon results. “We’ll take it from there,” he said.

mani is open to other opportunities for the food truck. That includes a future in which there could be a drive-thru lane, something he says other restaurants have had success with during the pandemic.

“Imagine you have physical location and you put the truck next to it and you create a traffic loop where cars drive up to the food truck, place an order on a microphone or by a human attendant in a parking lot, and then they drive through it and pick up,” he described.

Another opportunity could be going so far as to put food trucks in more remote locations, giving people access to healthy food by such areas as rest

stops.

“I thought about the notion of going somewhere on the I-10 or the I-8 between Phoenix and San Diego, Phoenix and LA, and putting food trucks there,” Osmani noted.

And while he emphasized it’s not in the works, a “summon” feature is on his wish list so the food truck could target high-demand areas.

“There’s lot of cool applications, but we have to figure out the logistics,” he said.

Judgments, generalizations, vows, oh my!

This article is the third of four installments about learning how to trust all over again.

With all we have gone through recently with COVID-19, elections, masks and isolation from quarantines, there will be some trust issues in most people about almost everything.

Here’s a learning-to-trust-again example. Let’s consider Bob, who has put his pastor on a pedestal. He believes that his pastor can do no wrong, that he always speaks the words of God, that he is a perfect Christian, abounding in wisdom and understanding. But when that pastor, as pastors will, makes a mistake in handling a situation or says something that touches an exposed nerve in Bob’s life, or even falls into a moral problem, then what happens to Bob? He feels hurt or betrayed.

Then Bob may think, “All pastors

are alike. I was stupid to trust him. If I’m smart, I’ll never trust another pastor again.” Did you ever feel that way about a pastor, boss, spouse or public official? I have. I’ve met many Bobs throughout the years.

Notice how Bob made a judgment and a generalization about all pastors based on one pastor. Pastors are alike. I was stupid to trust him. Then he made a vow, and I’ll never trust another pastor again. He judged, made a vow, and then generalized. Lions and tigers and bears, oh my!

Judgments and vows are not all bad. If you touch your hand on a hot stove burner and decide not to do that again, that is wisdom. However, if you decided never to touch a stove again, that would be overgeneralizing. Many times, when you generalize, you end up living by self-imposed general lies.

What about Bob? Perhaps he should have been more realistic about his pastor. Perhaps making his pastor and church a God created an expectation in Bob that only God could fulfill. Maybe Bob should get involved in a church again, only this time he needs to focus more on Jesus.

When I broke my leg skiing, I had to put things in perspective. Maybe all ski runs are not evil! Perhaps I should ski again, but this time not on double black diamond runs named Rattlesnake. That’s wisdom, not an overre-

action.

Mark Twain once said, “We should be careful to get out of an experience only the wisdom that is in it — and stop there; lest we be like the cat that sits down on a hot stove lid. She will never sit down on a hot stove lid again, and that is well, but she will never sit down on a cold stove lid either.”

Let’s get back to Bob. What happens if the object we place our trust in fails, disappoints, hurts us or does not meet our expectations? We act or react — often more emotionally than rationally. As a result, we make internal vows about what or what not to trust.

In the human reasoning process, individuals evaluate their own experiences, form judgments about those experiences, and then make a vow to guide future decisions. Webster deSEE DELPH PAGE 21

fines a vow as “…a solemn promise or pledge, especially one made to God or a god, dedicating oneself to an act, service or way of life.”

For example, when you experience burning your hand on a stove, you most likely will make the following judgments: “That’s hot, that hurts, and I don’t like it.” These judgments lead to a vow, “I’m never going to touch a hot stove again!” Vowing not to touch a hot stove will protect you, but making a vow you will never trust anyone or anything again can devastate you.

Vows vary in intensity from weak to powerful. The more powerful they are, the more the vow influences your decisions and behavior. Here are three rules about vows: First, the more traumatic the experience, the more powerful the resulting vow. Second, the more often the experience, the more powerful the resulting vow. Third, the more recent the experience, the more powerful the resulting vow.

Intensity, frequency and recency all contribute to the power of the vow.

What does this mean? If something horrible happened to you more than once and not too long ago, you would not let yourself get into that situation again soon. That can either be good or bad depending on what happened and who or what you trusted!

Webster defines generalization as “to infer or derive a general law or precept from particular instances.” Many times, the vows we make emotionally turn into generalizations such as, “I’m

never going to get hurt again.” “I’m not going to be betrayed again.” “I’m never going to be vulnerable again.”

“All men are…” “All women are…”

“All politicians are…” “All liberals are…” “All conservatives are…” “All churches are…” Sound familiar?

It may seem like it or even feel like it, but “Not all pastors are…” “Not all women or men are…” “Not all liberals or conservatives are…”

What’s the problem with the song that says, “I’ll never fall in love again… all men will never phone you…all men have pneumonia…?” The singer will miss the person who would love her, phone her and doesn’t have enough germs to catch pneumonia. Just like that cat will never step on a hot stove, she vowed she would never fall in love again. One experience doesn’t make every experience.

Next week, let’s regain our trust by trusting wisely. If it’s going to be, it starts with me.

Deer Valley honors teachers, rookies of the year

The DVUSD Governing Board recently began recognizing the 2019-20 Teachers and Rookies of the Year and will honor additional teachers during future board meetings.

Deer Valley Education Foundation (DVEF) board President Charly Filipek presented the honorees.

Each year, the Deer Valley Education Foundation holds an extensive nomination, application and interview process to identify the DVUSD Teachers of the Year. The recipients are awarded with a $500 check and a trophy.

The program is sponsored by Discover Financial, McCarthy Building Companies, Valley Schools, Chasse Building Team, Gary and Diana Feldman on behalf of Jonah Feldman, DKG and Grad Photography.

The following teachers were honored at the Jan. 26 DVUSD Governing Board Meeting: • Chef Ryan Mattheis has taught culinary arts at Barry Goldwater High School for seven years. Part of Mattheis’ philosophy is, “When you become a teacher you sign up to be in the business of human beings. Teaching requires you to become a part of a student’s life, and you make connections no other profession experiences.”

• Vicky Muñoz has graced the halls of Barry Goldwater High School for the last 13 years teaching Spanish 3-4 Honors, and both junior and senior IB Spanish. She noted, “My personal beliefs about teaching are to provide to all my students a positive and safe environment, achievable challenges, intentional teaching and reflection.

WHEREAS, the City intends for the bonds authorized hereby (the “Bonds”) to be sold (i) directly to one or more banks as purchaser of the Bonds (collectively, the “Bank Lender”) in the form of one or more bank loans or bank lending proposals, in each case as evidenced by a certificate and receipt of the Bank Lender or (ii) if, based on the determination of the Assistant City Manager or the Budget and Finance Director, an acceptable offer to directly purchase the Bonds is not received from a bank, to one or more underwriters selected by the City (the “Underwriters”), as provided in one or more bond purchase agreements (each, a “Bond Purchase Agreement”), in substantially the same form as that used in connection with the sale of the City’s General Obligation Bonds, Series 2019 (the “2019 Bonds”), with such changes as are approved by the Assistant City Manager or the Budget and Finance Director; andWHEREAS, there have been filed with the City Clerk proposed forms of the following documents: (a) A Bond Registrar and Paying Agent Agreement to be dated on or before the date of delivery of the Bonds (the “Bond Registrar Agreement”), pursuant to which a qualified financial institution will act as Bond Registrar (as hereinafter defined); and+ (b) A Continuing Disclosure Undertaking to be dated the date of delivery of the Bonds to be executed and delivered by the City if any of the Bonds are sold by negotiated sale to the Underwriters (the “Undertaking”); NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Glendale, Arizona, as follows: Section 1.

Purpose. That for the purpose of providing funds for the 1999 Cultural Facilities, 1999 Open Spaces, 2007 Parks and Recreation Facilities, 2007 Public Safety Facilities, 2007 Flood Control Facilities and 2007 Streets and Parking Facilities and to pay all necessary legal, financial, architectural, engineering and contingent costs in connection therewith, the City hereby authorizes the issuance of its General Obligation Bonds in one or more series which may include bonds, the interest on which is intended to be excludible from gross income for federal income tax purpose (“Bonds”) in the aggregate principal amount not to exceed $16,300,000. Any net premium received from the sale of the Bonds shall be subject to Arizona Revised Statutes, Section 35-457.D. The City Manager, any Assistant City Manager or Budget and Finance Director, in each case, whether interim or actual, (each, an “Authorized Officer”) shall determine the dollar amounts and respective ballot propositions under which each series of Bonds shall be issued.

Section 2.

Authorization of Bonds. The Bonds shall be issued as fully registered bonds registered as to both principal and interest, in the denominations determined by the Assistant City Manager or Budget and Finance Director or any integral multiple thereof, and shall be dated the date of delivery of the Bonds.

Interest on the Bonds shall be payable on January 1 and July 1 of each year (the “Interest Payment Dates”), at the rates to be set forth in the Bond Purchase Agreement or certificate and receipt of the Bank Lender (not to exceed 5.00%) until the principal amount has been paid or provided for. The Bonds shall bear interest from the most recent date to which interest has been paid or provided for or, if no interest has been paid or provided for, from the date of delivery, or such other date as approved by

PUBLIC NOTICE an Authorized Officer. Interest on the Bonds will be computed on the basis set forth in the Bond Purchase Agreement or certificate and receipt of the Bank Lender.

The final amounts and respective maturity dates of the Bonds shall be set forth in the Bond Purchase Agreement or certificate and receipt of the Bank Lender, but none of the Bonds shall mature later than twenty-six (26) years after the date of issuance.

Section 3.

Sale of Bonds. Each Authorized Officer is authorized to determine whether any of the Bonds are to be sold to (i) the Bank Lender pursuant to a bank lending proposal or (ii) the Underwriters pursuant to negotiated sale as described in the Official Statement. If it is the former, such sale will be evidenced by a certificate and receipt of the Bank Lender for each series of Bonds. If it is the latter, such sale will be evidenced by the execution and delivery of a Bond Purchase Agreement for each series of Bonds, if applicable. If the Bonds are to be sold by negotiated sale to the Underwriters, each Authorized Officer is hereby authorized to execute and deliver a Bond Purchase Agreement for each series of Bonds, if applicable, with such insertions, omissions and changes as are necessary and consistent with this Ordinance, the execution of a Bond Purchase Agreement for each series of Bonds, if applicable, being conclusive evidence of such approval. An Authorized Officer may make provision for insurance and/or liquidity support of the Bonds, if such Authorized Officer determines that such insurance or credit support would provide a net borrowing cost savings or enhance the marketability of the Bonds. Such determinations shall be included in the Bond Purchase Agreements.

If bond insurance and/or liquidity support is obtained with respect to any of the Bonds, an Authorized Officer is authorized to execute and deliver, on behalf of the City, appropriate agreements with the bond insurer and/or liquidity provider and the Bond Registrar with provisions concerning, without limitation, any of the following: (i) the terms of the bond insurance and/or liquidity support and the premium to be paid for it, (ii) procedures for payments under the bond insurance and/or liquidity support and reimbursement of amounts advanced including subrogation to the rights of bondholders paid, (iii) voting rights, (iv) remedies and (v) notices and providing of information with respect to the Bonds.

Section 4.

Custody of Registered Bonds. (a) If one or more series of Bonds is sold to the Underwriters by negotiated sale, such Bonds shall only be issued in book entry form, except as provided in Section 9 hereof, and (i) one certificate for each Bond maturity in typewritten form shall be registered in the name of the Depository (as defined herein) or its nominee, as registered owner, and immobilized in the custody of the Depository; (ii) the beneficial owners of the Bonds (the “Beneficial Owners”) shall have no right to receive the Bonds in the form of physical securities; (iii) ownership of beneficial interests in the principal amounts of $5,000 or integral multiples thereof shall be shown by book entry on the system maintained and operated by the Depository and its participants, and transfers of the ownership of beneficial interest shall be made only by book entry by the Depository and its participants; and (iv) the Bonds as such shall not be transferable or exchangeable, except in transfer to another Depository or to another nominee of a Depository.

As provided in Section 9 hereof, the City and the Bond Registrar shall treat the Depository or its nominee in whose name the Bonds are registered in the Bond Registrar as the owner of the Bonds for all purposes. Accordingly, principal and interest payments will be paid to the Depository as the registered owner of the Bonds.

All notices required by this Ordinance to be given to the registered owners of Bonds shall be given to the Depository as the registered owner of the Bonds. The transfer of principal and interest and of notices to the Beneficial Owners will be the responsibility of the Depository and its Participants or other nominees of the Beneficial Owners. The City will not be responsible or liable for such transfers or the failure thereof or for maintaining, supervising or reviewing records of the Depository.

For the purposes of this Ordinance, “Depository” means any securities depository that is a clearing agency under federal law operating and maintaining, with its participants or otherwise, a book entry system to record ownership of beneficial interests in Bonds, and to effect transfers of such beneficial interests in the Bonds, in book entry form, and includes and means initially The Depository Trust Company (a limited purpose trust company), New York, New York. (b) Any series of Bonds sold to a Bank Lender pursuant to a bank lending proposal shall be evidenced by one certificate for each Bond maturity in typewritten form and registered in the name of and delivered to the applicable Bank Lender or its nominee.

Section 5.

Execution. The Bonds shall be signed by the Mayor and attested by the City Clerk (references in this Ordinance to such officers shall include persons acting in the capacity of such officers) in their official capacities. The signature of any or all of such officers may be facsimiles. No Bond shall be valid or obligatory for any purpose or shall be entitled to any security or benefit under this Ordinance unless and until the certificate of authentication printed on the Bond is signed by the Bond Registrar as authenticating agent. Authentication by the Bond Registrar shall be conclusive evidence that the Bond so authenticated has been duly issued, signed and delivered under this Ordinance and is entitled to the security and benefit of this Ordinance.

Section 6.

Registrar and Paying Agent. An Authorized Officer is authorized to appoint a qualified financial institution to serve as the authenticating agent, bond registrar, transfer agent and paying agent (collectively, the “Bond Registrar”) for the Bonds. The Mayor or an Authorized Officer shall sign and deliver, and the City Clerk shall attest, on behalf of the City, the Bond Registrar Agreement, in substantially the form on file with the City Clerk with such additions, deletions and modifications not inconsistent with this Ordinance as the officer executing such agreement shall approve.

Each Authorized Officer is authorized and directed on behalf of the City to provide for payment of the services rendered and for reimbursement of expenses incurred by the Bond Registrar from the proceeds of the Bonds to the extent available or from other funds lawfully available therefor.

Section 7.

Payment of Bonds. The principal of, premium, if any, and interest on the Bonds shall be payable in lawful money of the United States of America without deduction for the services of the Bond Registrar as paying agent. Subject to Section 9 hereof, (a) principal and premium, if any, shall be payable when due upon presentation and surrender of the Bonds at the principal corporate trust office of the Bond Registrar and (b) interest on a Bond shall be paid on each Interest Payment Date by check or draft mailed to the person in whose name the Bond was registered in the Bond Register, at the close of business on the 15th day of the calendar month next preceding that Interest Payment Date (the “regular record date”) at that person’s address appearing on the Bond Register (as defined in Section 8 below), or at such other address

as is furnished to the Bond Registrar, in writing, by the registered owner before the regular record date. Any interest which is not timely paid or duly provided for shall cease to be payable to the person who is shown as the registered owner thereof (or of one or more predecessor bonds) as of the regular record date, and shall be payable to the registered owner hereof (or of one or more predecessor bonds) at the close of business on a special record date for the payment of that overdue interest. The special record date shall be fixed by the Bond Registrar whenever monies become available for payment of the overdue interest, and notice of the special record date shall be given to registered owners not less than ten days prior thereto.

Section 8.

Prior Redemption. (a) Each series of Bonds shall be subject to redemption prior to maturity as set forth in the certificate and receipt of the Bank Lender or Bond Purchase Agreement and the form of Bond. (b) (1) Notice of redemption of any Bond shall be mailed by first class mail, postage prepaid, not more than sixty (60) nor less than thirty (30) days prior to the date set for redemption to the registered owner of the Bond or Bonds being redeemed at the address shown on the registration books for the Bonds maintained by the Bond Registrar and Paying Agent. Failure to give properly such notice of redemption shall not affect the redemption of any Bond for which notice was properly given. A notice of optional redemption may contain a statement that the redemption is conditional upon receipt by the Bond Registrar as paying agent of funds on or before the date fixed for redemption sufficient to pay the redemption price of the Bonds so called for redemption, and that if such funds are not available, such redemption shall be cancelled by written notice to owners of the Bonds called for redemption in the same manner as the original redemption notice was mailed.

(2) On the date designated for redemption by notice given as herein provided, the Bonds or portions thereof to be redeemed shall become and be due and payable at the redemption price for such Bonds or such portions thereof on such date, and, if moneys for payment of the redemption price are held in separate accounts by the Bond Registrar and Paying Agent, interest on such Bonds or such portions thereof shall cease to accrue, such Bonds or such portions thereof shall cease to be entitled to any benefit or security hereunder, the registered owners of such Bonds or such portions thereof shall have no rights in respect thereof except to receive payment of the redemption price thereof and accrued interest thereon and such Bonds or such portions thereof shall be deemed paid and no longer outstanding.

(3) Except as otherwise provided in a certificate and receipt of the Bank Lender, the City may redeem, and the Bond Registrar and Paying Agent shall select, by lot in such manner as the Bond Registrar and Paying Agent may determine, any amount which is included in a Bond in the denomination in excess of, but divisible by, $5,000. In that event, the registered owner shall submit the Bond for partial redemption and the Bond Registrar and Paying Agent shall make such partial payment and shall cause to be issued a new Bond in a principal amount which reflects the redemption so made, to be authenticated and delivered to the registered owner thereof. (c) Any Bond or portion thereof in authorized denominations shall be deemed paid and defeased and thereafter shall have no claim on ad valorem taxes levied on taxable property in the City (i) if there is deposited with a bank or comparable financial institution, in trust, moneys or obligations issued by or guaranteed by the United States government (“Defeasance Obligations”) or both which, with the maturing principal of and interest on such Defeasance Obligations, if any, will be sufficient, as evidenced by a certificate or report of an accountant, to pay the principal of and interest and any premium on such Bond or portion thereof as the same matures, comes due or becomes payable upon prior redemption and (ii) if such defeased Bond or portion thereof is to be redeemed, notice of such redemption has been given in accordance with provisions hereof or the City has submitted to the Bond Registrar and Paying Agent instructions expressed to be irrevocable as to the date upon which such Bond or portion thereof is to be redeemed and as to the giving of notice of such redemption. Bonds the payment of which has been provided for in accordance with this Section shall no longer be deemed payable or outstanding hereunder and thereafter such Bonds shall be entitled to payment only from the moneys or Defeasance Obligations deposited to provide for the payment of such Bonds.

Section 9.

Registration and Exchange. So long as any of the Bonds remain outstanding, the City will cause the Bond Registrar to maintain and keep at its principal corporate trust office all books and records necessary for the registration, exchange and transfer of Bonds as provided in this Section (the “Bond Register”).

Subject to the provisions of Section 7 above, (a) the person in whose name a Bond is registered on the Bond Register shall be regarded as the absolute owner of that Bond for all purposes of this Ordinance, (b) payment of or on account of the principal of, premium, if any, and interest on any Bond shall be made only to or upon the order of that person, and (c) neither the City nor the Bond Registrar shall be affected by any notice to the contrary, but the registration may be changed as provided in this Section. All such payments shall be valid and effectual to satisfy and discharge the City’s liability upon the Bond, including interest, to the extent of the amount or amounts so paid.

Any Bond may be exchanged for Bonds of any authorized denomination upon presentation and surrender at the principal corporate trust office of the Bond Registrar, together with a request for exchange signed by the registered owner or by a person legally empowered to do so in a form satisfactory to the Bond Registrar. A Bond may be transferred only on the Bond Register upon presentation and surrender of the Bond at the principal corporate trust office of the Bond Registrar, together with an assignment executed by the registered owner or by a person legally empowered to do so in a form satisfactory to the Bond Registrar. Upon exchange or transfer the Bond Registrar shall complete, authenticate and deliver a new Bond or Bonds of any authorized denomination or denominations requested by the registered owner equal in the aggregate to the unmatured principal amount of the Bond surrendered and bearing interest at the same rate and maturing on the same date. Notwithstanding the foregoing, Bonds purchased by a Bank Lender shall be subject to such transfer restrictions as may be determined by the Assistant City Manager or Budget and Finance Director.

If manual signatures on behalf of the City are required, the Bond Registrar shall undertake the exchange or transfer of Bonds only after the new Bonds are signed by the authorized officers of the City. In all cases of exchanged or transferred Bonds, the City shall sign and the Bond Registrar shall authenticate and deliver Bonds in accordance with the provisions of this Ordinance. All fees and costs associated with the exchange

or transfer, including any tax or other governmental charges required to be paid with respect to the exchange or transfer, shall be paid by the registered owner requesting the exchange or the transferor, as appropriate. The City or the Bond Registrar may require that those fees and costs, if any, be paid before the procedure is begun for the exchange or transfer. All Bonds issued upon any exchange or transfer shall be valid obligations of the City, evidencing the same debt, and entitled to the same security and benefit under this Ordinance as the Bonds surrendered upon that exchange or transfer.

Any Bond surrendered to the Bond Registrar for payment, retirement, exchange, replacement or transfer shall be canceled by the Bond Registrar. The City may at any time deliver to the Bond Registrar for cancellation any previously authenticated and delivered Bonds that the City may have acquired in any manner whatsoever, and those Bonds shall be promptly canceled by the Bond Registrar. The canceled Bonds shall be retained for a period of time and then returned to the City or destroyed by the Bond Registrar as directed by an Authorized Officer.

The City and the Bond Registrar will not be required (a) to issue or transfer any Bonds during a period beginning with the opening of business on the 15th day next preceding any date of selection of Bonds to be redeemed and ending with the close of business on the day on which the applicable notice of redemption is given or (b) to transfer any Bonds which have been selected or called for redemption in whole or in part.

In case any Bond becomes mutilated or destroyed or lost, the City shall cause to be executed and delivered a new Bond of like date and tenor in exchange and substitution for and upon the cancellation of such mutilated Bond or in lieu of and in substitution for such Bond destroyed or lost, upon the registered owner’s paying the reasonable expenses and charges of the City in connection therewith and, in the case of the Bond destroyed or lost, filing with the City Clerk by the registered owner evidence satisfactory to the City that such Bond was destroyed or lost, and furnishing the City with a sufficient indemnity bond pursuant to Section 47-8405, Arizona Revised Statutes.

Section 10. Book-Entry Depository. Notwithstanding any provision of this Ordinance or of any Bond to the contrary, the City may enter into an agreement with the registered owner of a Bond in the custody of a Depository or a Bank Lender providing for making all payments to that registered owner of payments of principal and interest on that Bond or any part thereof (other than any payment of the entire unpaid principal amount thereof) at a place and in a manner (including wire transfer of funds) other than as provided in this Ordinance and in the Bond, without prior presentation or surrender of the Bond, upon any conditions which shall be satisfactory to the City; provided, that payment in any event shall be made to the person who is the registered owner of that Bond, on the date or other date duly agreed upon that principal and premium is due, and, with respect to the payment of interest, as of the applicable regular record date or special record date or other date as duly agreed upon as the case may be.

If any Depository determines not to continue to act as a Depository for the Bonds for use in a Book Entry System, the City may attempt to have established a securities depository/book entry relationship with another qualified Depository. If the City does not or is unable to do so, the City and the Bond Registrar, after the Bond Registrar has made provision with the Depository for notification of the Beneficial Owners by the then Depository, shall permit withdrawal of the Bonds from the Depository, and authenticate and deliver replacement Bonds in fully registered form in the denominations of $5,000 or any integral multiple thereof to the assignees of the Depository or its nominee. If the event is not the result of City action or inaction, such withdrawal, authentication and delivery shall be at the cost and expense (including costs of printing definitive Bonds) of those persons requesting such authentication and delivery.

This Bond is exchangeable and transferable for Bonds of other authorized denominations at the principal corporate trust office of the Bond Registrar, by the registered owner or by a person legally empowered to do so, upon presentation and surrender hereof to the Bond Registrar, together with a request for exchange or an assignment, signed by the registered owner or by a person legally empowered to do so, in a form satisfactory to the Bond Registrar, all subject to the terms, limitations and conditions provided in the Bond Ordinance. All fees and costs associated with the exchange or transfer, including any tax or governmental charges payable in connection therewith, shall be paid by the owner requesting the exchange or the transferor, as appropriate. The City or the Bond Registrar may also require that such fees and charges be paid prior to the procedure for exchange or transfer. Whenever there shall be insufficient money in the Interest Fund and Redemption Fund to pay Bonds and interest thereon payable therefrom when due, the City may pay such principal and interest from any other legally available fund and shall reimburse such other fund when money becomes available from the proceeds of the taxes hereinabove

required.

Section 16. Official Statement. If and to the extent applicable, all actions of the City related to preparing and distributing a form of Preliminary Official Statement, to be used if any of the Bonds are sold by negotiated sale to the Underwriters, in substantially the same form as that used in connection with the offer and sale of the City’s General Obligation Bonds, Series 2019, which may be distributed in connection with the offer and sale of the Bonds (as prepared in accordance with the terms of this Ordinance, the “Preliminary Official Statement”), are hereby approved and ratified. The portions of the Official Statement regarding the Bonds which concern and describe the City are hereby approved and, if so necessary, the Assistant City Manager or the Budget and Finance Director are hereby authorized and directed to execute the same and any required certificates as to the accuracy and completeness of said Official Statement descriptions of the City.

If so necessary, the Preliminary Official Statement is approved and the distribution of the same is hereby approved. If and to the extent applicable, the Preliminary Official Statement is “deemed final” (except for permitted omissions), by the City as of its date for purposes of SEC Rule 15c2-12(b)(1) and, if so necessary, a final official statement (the “Official Statement”) will be prepared and distributed to the Underwriters for purposes of SEC Rule 15c2-12(b)(3) and (4). If so necessary, the Assistant City Manager or the Budget and Finance Director are authorized and directed to complete and sign on behalf of the City and in his or her official capacity, the Official Statement, with such modifications, changes and supplements as being necessary to carry out and comply with the terms, provisions, and intent of this Ordinance. If so necessary, the Assistant City Manager or the Budget and Finance Director are authorized to use and distribute, or authorize the use and distribution of, the Official Statement and any supplements thereto as so signed in connection with the original issuance of the Bonds as may in his or her judgment be necessary or appropriate. If and to the extent applicable, the references to the City contained in the Preliminary Official Statement and the Official Statement relating to the Bonds are hereby authorized and approved.

Section 17. Continuing Disclosure Undertaking. If any of the Bonds are sold by negotiated sale to the Underwriters, the Mayor and each Authorized Officer is hereby authorized, empowered and directed to execute and deliver the Continuing Disclosure Undertaking in substantially the same form as now before the City, or with such changes therein as the individual executing the Continuing Disclosure Undertaking on behalf of the City shall approve, his or her execution thereof to constitute conclusive evidence of his or her approval of such changes. If a Continuing Disclosure Undertaking is executed and delivered on behalf of the City as herein provided, such Continuing Disclosure Undertaking will be binding on the City and the officers, employees and agents of the City, and the officers, employees and agents of the City are hereby authorized, empowered and directed to do all such acts and things and to execute all such documents as may be necessary to carry out and comply with the provisions of the Continuing Disclosure Undertaking as executed. Notwithstanding any other provision of this Ordinance, the sole remedies for failure to comply with the Continuing Disclosure Undertaking shall be the ability of the beneficial owner of any Bond to seek mandamus or specific performance by court order, to cause the City to comply with its obligations under the Continuing Disclosure Undertaking.

Section 18. Tax Covenants. The City covenants that it will use, and will restrict the use and investment of, the proceeds of the Bonds in such manner and to such extent as may be necessary so that (a) the Bonds will not (i) constitute private activity bonds, arbitrage bonds or hedge bonds under Sections 141, 148 or 149 of the Internal Revenue Code of 1986, as amended (the “Code”), or (ii) be treated other than as bonds to which Section 103(a) of the Code applies, and (b) the interest thereon will not be treated as a preference item under Section 57 of the Code.

The City further covenants (a) that it will take or cause to be taken such actions that may be required of it for the interest on the Bonds to be and remain excluded from gross income for federal income tax purposes, (b) that it will not take or authorize to be taken any actions that would adversely affect that exclusion, and (c) that it, or persons acting for it, will, among other acts of compliance, (i) apply the proceeds of the Bonds to the governmental purposes of the borrowing, (ii) restrict the yield on investment property, (iii) make timely and adequate payments to the federal government, (iv) maintain books and records and make calculations and reports, and (v) refrain from certain uses of those proceeds and, as applicable, of property financed with such proceeds, all in such manner and to the extent necessary to assure such exclusion of that interest under the Code.

Each Authorized Officer is hereby authorized (a) to make or effect any election, selection, designation, choice, consent, approval, or waiver on behalf of the City with respect to the Bonds as the City is permitted or required to make or give under the federal income tax laws, including, without limitation thereto, any of the elections provided for or available under Section 148 of the Code, for the purpose of assuring, enhancing or protecting favorable tax treatment or status of the Bonds or interest thereon or assisting compliance with requirements for that purpose, reducing the burden or expense of such compliance, reducing the rebate amount or payments of penalties, or making payments of special amounts in lieu of making computations to determine, or paying, excess earnings as rebate, or obviating those amounts or payments, as determined by that officer, which action shall be in writing and signed by the officer, (b) to take any and all other actions, make or obtain calculations, make payments, and make or give reports, covenants and certifications of and on behalf of the City, as may be appropriate to assure the exclusion of interest from gross income and the intended tax status of the Bonds, and (c) to give one or more appropriate certificates of the City for inclusion in the transcript of the proceedings for the Bonds, setting forth the reasonable expectations of the City regarding the amount and use of all the proceeds of the Bonds, the facts, circumstances and estimates on which they are based, and other facts and circumstances relevant to the tax treatment of the interest on and the tax status of the Bonds.

Section 19. Further Actions. All actions of the officers and agents of the City which are in conformity with the purposes and intent of this Ordinance and in furtherance of the issuance and sale of the Bonds as contemplated by this Ordinance whether heretofore or hereafter taken shall be and are hereby ratified, confirmed and approved. The Mayor, each Authorized Officer and the City Clerk and other appropriate officers and agents of the City are hereby authorized and directed to do all such acts and things and to execute and deliver all such documents on behalf of the City as may be necessary to carry out the terms and intent of this Ordinance.

Section 20. All Conditions Met. This Council determines that all acts and conditions necessary under the Act and other applicable laws to be performed by the City or to have been met precedent to and in the issuing of the Bonds in order to make them legal, valid and binding special obligations of the City, have been performed and met,

PUBLIC NOTICE or will at the time of delivery of the Bonds have been performed and met, in regular and due form as required by law; and that no statutory, charter or constitutional limitation of indebtedness or taxation will have been exceeded in the issuance of the Bonds.

Section 21. Open Meeting. This Council finds and determines that all formal actions of this Council concerning and relating to the passage of this Ordinance were taken in an open meeting of this Council and that all deliberations of this Council and of any committees that resulted in those formal actions were in meetings open to the public, in compliance with all legal requirements.

Section 22. Severability. If any section, paragraph, clause or provision of this Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Ordinance.

Section 23. Ordinance a Contract. This Ordinance shall constitute a contract between the City and the registered owners of the Bonds and shall not be repealed or amended in any manner which would impair, impede or lessen the rights of the registered owners of the Bonds then outstanding.

Section 24. Emergency Clause. The immediate operation of the provisions of this ordinance is necessary for the public peace, health, and safety of the residents and citizens of the City for the reason that the bonds herein authorized must be sold at the earliest possible time in order to obtain the most advantageous interest rate; an emergency is , therefore, declared to exist, and this Ordinance shall be in full force and effect immediately upon its passage and adoption by the Mayor and Council of the City of Glendale, and it is hereby exempt from the referendum provisions of the Constitution and laws of the State.

SECTION 2. The sale and purchase of the 2021 Project pursuant to the Purchase Agreement are hereby approved; and the installment purchase payments (the “Purchase Payments”) specified in the Purchase Agreement are hereby approved (but subject to the limitations on the source of City payments as set forth in Section 3). The City Manager, Assistant City Manager or Budget and Finance Director, whether actual, acting or interim (each an “Authorized Officer”) is hereby authorized and directed to execute the Basic Documents on behalf of the City in substantially the form on file with the City Clerk with such modifications, insertions and changes as may be approved by the executing officials, which approval shall be conclusively evidenced by their execution of the Basic Documents. If more than one series of obligations are issued, Basic Documents shall include additional agreements necessary to provide for such series. If an Authorized Officer determines that refunding obligations authorized pursuant to Ordinance No. O20-23 shall be issued concurrently, the Basic Documents shall reflect such concurrent refunding obligations.

SECTION 3. For the payment of the Purchase Payments due and payable under the Purchase Agreement authorized in Section 2 hereof, there are hereby pledged the City’s Net Revenues on a priority of lien basis to be determined as set forth in Section 5 hereof. It is intended that this pledge of Net Revenues will be sufficient to make the Purchase Payments pursuant to the Purchase Agreement and the City agrees and covenants to make said Purchase Payments from such Net Revenues, except to the extent that it chooses to make such payments from other funds, as permitted by law. Neither the Purchase Agreement nor the promise to pay pursuant thereto nor the Obligations constitute a general obligation of the City nor shall the City be liable for the payments under the Purchase Agreement from ad valorem taxes.

SECTION 4. The City Council of the City hereby finds and determines that the financing of the 2021 Project pursuant to the terms of the Purchase Agreement and the Trust Agreement, through the issuance and the sale of the Obligations in an aggregate principal amount not to exceed $30,500,000 with a final maturity no later than twentysix (26) years after the date of issuance at an interest rate not to exceed 5.00%, are in furtherance of the purposes of the City and in the public interest and will enhance the standard of living within the City and within the State.

SECTION 5. The Obligations shall be in the denomination of $5,000 or any integral multiple thereof, shall be dated as determined by an Authorized Officer, shall bear interest from such date payable on January 1 and July 1 of each year, commencing as determined by an Authorized Officer, and shall be fully registered bonds without coupons. The Obligations shall mature on July 1 in the years determined by an Authorized Officer.

The forms, terms and provisions of the Obligations and the provisions for the signatures, authentication, payment, registration, transfer, exchange and number shall be as set forth in the Trust Agreement and are hereby approved.

An Authorized Officer is hereby authorized and directed to determine on behalf of the City: (i) the components of the 2021 Project to be financed; (ii) the principal amount of the Obligations; (iii) the final maturity schedule of the Obligations; (iv) the provisions for redemption in advance of maturity or payment of the Obligations; (v) the interest rates on the Obligations; (vi) the sales price and terms of the purchase of the Obligations (including the underwriter’s discount and the original issue discount or premium), (vii) the determination as to whether the Obligations shall be Senior Obligations and which shall be Subordinate Obligations (as defined in the Trust Agreement), (viii) the provisions for credit enhancement, if any, for the Obligations including a debt service reserve fund or surety bond; (ix) the provisions for a capitalized interest or contingency amount, if any, if deemed to be in the best interests of the City and (x) the identity of the financial institution to serve as trustee under the Trust Agreement (the “Trustee”).

The provisions for redemption of the Obligations shall be as set forth in the Trust Agreement.

The forms and other terms and provisions of the Obligations and the provisions for the signatures, authentication, payment, registration, transfer, exchange, and number shall be as set forth in the Trust Agreement and are hereby approved.

SECTION 6. An Authorized Officer is authorized to (i) determine whether the Obligations are to be sold pursuant to negotiated sale or competitive bid basis either to one or more underwriters as described in the Official Statement or to one or more financial institutions on a private placement basis or pursuant to a bank lending proposal and (ii) confirm such sale through the execution and delivery of an obligation purchase contract in a form similar to that executed and delivered in connection with the 2020 Obligations in the event of a negotiated sale or, in the event of a competitive bid or bank lending proposal, through execution and delivery of a certificate and receipt. An Authorized Officer is hereby authorized to execute and deliver such agreements in such form with such insertions, omissions and changes as are necessary and consistent with this Ordinance, the execution of such agreements being conclusive evidence of such approval.

SECTION 7. The forms, terms and provisions of the Basic Documents, in substantially the forms of such documents (including the exhibits thereto) on file with the City Clerk, are hereby approved. An Authorized Officer is hereby authorized and directed to execute and deliver, and the City Clerk of the City to attest, if necessary, the Basic Documents, with such insertions, omissions and changes as are necessary and consistent with this Ordinance, the execution of such documents being conclusive evidence of such approval and particularly of approval and acceptance of the covenants contained therein by the City Council of the City on behalf of the City.

SECTION 8. An Authorized Officer is authorized to enter into such agreements as he determines necessary in conjunction with obtaining bond insurance or a reserve fund surety bond, if any and which are necessary to carry out and comply with the terms, provisions, and intent of this Ordinance.

All actions of the City related to preparing and distributing the Preliminary Official Statement are hereby approved and ratified. The portions of the Official Statement regarding the Obligations which concern and describe the City are hereby approved and the City Manager is hereby authorized and directed to execute the same and any required certificates as to the accuracy and completeness of said Official Statement descriptions of the City.

SECTION 9. The Preliminary Official Statement in substantially the form utilized by the City in connection with the sale of the 2020 Obligations is approved and the distribution of the same, if necessary, is hereby approved (the “Preliminary Official Statement”). The Preliminary Official Statement is “deemed final” (except for permitted omissions), by the City as of its date for purposes of SEC Rule 15c2-12(b)(1) and a final official statement will be prepared and distributed to the Original Purchaser, if necessary, for purposes of SEC Rule 15c2-12(b)(3) and (4). The City Manager is authorized and directed to complete and sign on behalf of the City and in his or her official capacity, the Official Statement, with such modifications, changes and supplements as being necessary to carry out and comply with the terms, provisions, and intent of this Ordinance. The City Manager is authorized to use and distribute, or authorize the use and distribution of, the Official Statement and any supplements thereto as so signed in connection with the original issuance of the Obligations as may in his or her judgment be necessary or appropriate. The references to the City contained in the Preliminary Official Statement and such final Official Statement relating to the Obligations are hereby authorized and approved.

SECTION 10. An Authorized Officer and the Clerk of the City are hereby authorized and directed to do all such acts and things to execute, acknowledge and deliver all such documents (including, without limitation, tax compliance certificates, security agreements and financing statements, any amendments to such documents and all closing documents) as may in their discretion be deemed necessary or desirable to carry out and comply with the terms, provisions and intent of this Ordinance, and the Basic Documents and all exhibits to any of the foregoing. All of the acts of the officers of the City which are in conformity with the intent and purposes of this Ordinance, whether heretofore or hereafter taken or done, shall be and the same are hereby ratified, confirmed, and approved in all respects.

SECTION 11. The City covenants that it will use, and will restrict the use and investment of, the proceeds of the Obligations in such manner and to such extent as may be necessary so that (a) the Obligations will not (i) constitute private activity bonds, arbitrage bonds or hedge bonds under Section 141, 148 or 149 of the Internal Revenue Code of 1986, as amended (the “Code”), or (ii) be treated other than as bonds to which

PUBLIC NOTICE Section 103(a) of the Code applies, and (b) the interest thereon will not be treated as a preference item under Section 57 of the Code. An Authorized Officer, or any other officer having responsibility for issuance of the Obligations shall, alone or with any other necessary officer or employee or consultant to the City, give an appropriate certificate of the City, for inclusion in the transcript of proceedings for the Obligations, setting forth (i) the reasonable expectations of the City regarding the amount and use of all the proceeds of the Obligations; (ii) the facts, circumstances and estimates on which the City’s expectations are based; and (iii) other facts and circumstances relevant to the tax treatment of interest on the Obligations.

The City covenants (a) that it will take or cause to be taken such actions which may be required of it for the interest on the Obligations to be and remain excluded from gross income for federal income tax purposes, (b) that it will not take or authorize to be taken any actions which would adversely affect that exclusion and (c) that it, or persons acting for it, will, among other acts of compliance; (i) apply the proceeds of the Obligations to the governmental purpose of the borrowing; (ii) restrict the yield on investment property; (iii) make timely and adequate payments to the federal government; (iv) maintain books and records and make calculations and reports; and (v) refrain from certain uses of those proceeds and, as applicable, of property financed with such proceeds, all in such manner and to the extent necessary to assure such exclusion of that interest under the Code. An Authorized Officer, and other appropriate city officers are hereby authorized and directed to take any and all such actions, make calculations and rebate payments, and make or give such reports and certifications, as may be appropriate to assure such exclusion of that interest.

SECTION 12. If any section, paragraph, clause or provision of this Ordinance shall for any reason be held to be invalid or unenforceable, the invalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Ordinance.

SECTION 13. All orders and Ordinances or parts thereof inconsistent herewith are hereby waived to the extent only of such inconsistency. This waiver shall not be construed as reviving any order or Ordinance or any part thereof.

EMERGENCY CLAUSE SECTION 14. The immediate operation of the provisions of this ordinance is necessary for the public peace, health, and safety of the residents and citizens of the City for the reason that the obligations herein authorized must be sold at the earliest possible time in order to obtain the most advantageous interest rate; an emergency is , therefore, declared to exist, and this Ordinance shall be in full force and effect immediately upon its passage and adoption by the Mayor and Council of the City of Glendale, and it is hereby exempt from the referendum provisions of the Constitution and laws of the State.

That it is deemed in the best interest of the City of Glendale and the citizens thereof to enter into the Intergovernmental Agreement with the Arizona Department of Transportation for the State to acquire federal funds for the purchase of 1 GB network switches and CCTVS to be used at 166 locations throughout the City of Glendale to monitor traffic on City roadways (20-0007892I), which agreement is now on file in the office of the City Clerk of the City of Glendale. SECTION 2. That the City Manager or designee and the City Clerk be authorized and directed to execute and deliver any and all documents necessary to effectuate said Agreement on behalf of the City of Glendale.
