ubilation, uncertainty and disappointment punctuated the latest chapter in the long-running saga of the defunct Ahwatukee Lakes Golf Course.

Homeowners and their allies who opposed a plan to build houses on the 101-acre site cheered Judge John Hannah’s rejection of The True Life Companies’ effort to dump deed restrictions requiring a course on land it has owned since 2015.

In a prepared joint statement, the plaintiffs in the lawsuit, Linda Swain and Eileen Breslin, and Save the Lakes called the decision “a warning to developers who undercut homeowner protections – and a first step in restoring the golf course and its neighborhoods.”

n New Year’s Eve, Christian Nagel began his final post on Facebook, saying, “I wish I could go back in time.”

Time ran out for the 20-year-old Ahwatukee man on Tuesday, Jan. 2, when he lost his life in a motor vehicle accident during rush hour only a block from Purcell Tire and Service Center, 38th Street and Ray Road, where he had been working as a service technician for about 18 months.

Phoenix Police spokesman Sgt. Alan Pfohl said Nagel was on his motorcycle when an automobile made a left turn into a private driveway without yielding to the victim, causing him to run into her car. The unidentified 42-year-old woman driving the car was not hurt.

“The motorcyclist was wearing a helmet,” Pfohl said.

“Investigators also determined the driver of the vehicle was not impaired. Speed does not appear to be a factor.”

Ironically, at the time of the crash, police officers were across the street investigating a $6,000 armed robbery at a Chase Bank site inside a Fry’s Supermarket, Pfohl said.

“An adult male approached a teller and threatened to use a weapon if she didn’t give him cash,” he said. “No weapon was actually seen.”

City Councilman Sal DiCiccio said an unexplained delay at the bank in notifying police might have enabled the bandit to get away.

Through a friend, Christian’s family declined comment.

First freeway bridge to open in March in Laveen AFN News Staff

T

he Arizona Department of Transportation is preparing to mark another milestone in the construction of the South Mountain Freeway.

The first interchange under construction in Laveen is scheduled to open in March.

Elliot Road at 59th Avenue has been closed to allow crews “to make significant progress in a short time,” ADOT said in a release.

The 22-mile, eight-lane freeway, which at a cost of $1.7 billion is Arizona’s most expensive highway project in history, will connect the I-10 interchanges at West 59th Avenue in West Phoenix and Chandler.

In Laveen, ADOT said, crews completed “extensive earthwork” and then planted six large concrete piers in the future freeway’s median. More than 300,000 cubic yards of dirt have been moved to create bridge approaches and ramps.

The piers will support a 272-foot, twospan bridge that will carry Elliot Road traffic over the South Mountain Free-

Freeway bridge to be used by motorists.

Some 40 bridges wlll be built along the freeway by the time the project is completed in late 2019.

Crews also have installed underground utilities and drainage structures, including a four-footwide storm drain crossing, and built retaining or “mechanically stabilized” earth walls.

The walls will feature the “River Bank” aesthetic treatment reflecting Laveen’s agricultural heritage.

This is one of five aesthetic patterns that will be used along various stretches of the hioghway.

But social media sites were awash in an outpouring of grief for the Desert Vista High School graduate and Mississippi native.

Last Saturday, his previous employer, Pure Luxury Tint and Detailing Services in Chandler, held a car wash to raise money for funeral expenses.

“The outpouring of love and generosity from our community was just amazing,” said owner Tim Berry, praising volunteers who helped his employees wash cars as well as people who turned out to donate.

Nagel had just left Purcell after visiting with coworkers for about an hour, said a service manager who identified himself only as Travis.

“All the guys here were extremely upset to the point where they were in tears that evening,” he said.

Travis said that because he is relatively new at the Ahwatukee Purcell branch, he did not know Nagel as well as longtime employees did.

“Every time I talked to him, though, he seemed like a happy guy,” he said, adding that before he left Tuesday afternoon, “he was in a great mood.”

“He wasn’t scheduled to work that day

and had just dropped in to talk with the guys,” Travis added.

High school acquaintances and former coworkers alike remembered Nagel as a low-key, laid-back young man with a sense of humor and a passion for cars.

His Facebook page includes several dozen pictures of classic and sports cars and Travis said he was known around Purcell as a technician who loved automobiles.

Several other efforts are underway to help Nagel’s family with funeral expenses.

On Saturday, Jan. 13, Zzeeks Pizza, 4825 E. Warner Road, Ahwatukee, will hold a bake sale and silent auction between 4 and 8 p.m. From 11 a.m. till 11 p.m., owners Jody and Mark Pectol also will donate 20 percent of proceeds from all sales to help the family.

A family friend said funeral arrangements were incomplete.

ant to keep tabs on your lawmakers and not even have to get out of your pajamas?

You can – if you have a computer.

A website maintained by the Arizona Legislature has a full rundown of proposed new laws, amendments to proposals and even the roll-call votes in committees and on the floor.

But it’s even more interactive than that.

One function of the web site allows people not only to watch hearings but even sign in to “testify’’ for or against measures, all without making the trek to the Capitol.

It starts at the main legislative webpage: www.azleg.gov.

On the main page is a calendar of events.

But the real detail starts under the “bills’’ menu. Here, the new bills are listed by number, in batches of 50, divided between House and Senate bills.

Want more information on any of them? Clicking on the specific bill presents several options, including an overview, the status of where it is in the process, and a documents button where you can see the introduced version

and, as the session goes on, added amendments and changes.

There’s also a section called “RTS Current Bill Positions.’’ That’s a list of who has signed in for or against the measure, a feature that does not usually get filled until a bill is scheduled for a hearing. More about that in a minute.

Not sure of the bill number? Enter a keyword in the search.

So, for example, if you were to put in the word “marriage,’’ three bills already filed for the session would pop up: HB 2006, setting a minimum age to wed; HB 2031, which deals with what factors a judge considers in determining spousal maintenance in divorce, and HB 2075, dealing with orders of protection.

More bills can be filed in the next few weeks.

You can view the measure in PDF or HTML format. And when a bill gets set for a hearing, there’s a link to a staff explanation of what it would do.

Also on that main page are links to the agendas of upcoming standing committees. That enables you to poke through what hearings are coming up and what bills are on that day’s agenda.

One option is to drive to the Capitol, sign in to speak and have your say. How long you might get depends on the whims of who is chairing the committee.

But there’s a less direct – and less cumbersome – method of putting in your two cents. And it goes to that RTS system, short for “request to speak.’’

On the main legislative page is a pulldown menu for legislative information, with the first option being that request to speak.

Clicking on that will result in a page asking you to sign in.

Don’t worry if you don’t have a username or password. They’re easy to create. But you might consider doing that now, before you suddenly need it.

That leads to a whole different page where there’s a menu on the left side to create a new request to speak, see what you’re already sign in for and against, and search for upcoming agendas on that issue.

You will need to know the bill number or, at the very least, the name of the committee where it is scheduled to be heard.

But here’s the thing: You can register in support or opposed to a specific bill.

And you can even explain why.

There is, however, no requirement that you actually come to the Capitol to testify. And whether you do or not, there is an option to simply sign in with a position but not request to speak.

In any case, your name and position is shared with the legislators on the

committee and becomes part of the record.

Sometimes having a bunch of people signed in remotely supporting or opposing a bill can have some influence.

But those with strong feelings might consider that personal testimony, where lawmakers can ask you questions, is generally much more effective.

And, to be totally honest about it, understand what lobbyists already know: It’s helpful to contact lawmakers ahead of any vote, whether in person, by mail or phone. Very often by the time the committee actually meets most legislators already have made up their minds.

You also can actually watch committee meetings and floor actions as they unfold.

The link is under the House button on the main page, then click on “live proceedings.’’ You will, however, need to know in which room the hearing is taking place, information that can come from the agenda.

Oh, on that prospect of contacting lawmakers directly, the main legislative page has office phone numbers and links to direct email under both the House and Senate member lists.

One more thing: Legislators are likely to be far more responsive to inquiries and messages that come from their own constituents.

The Legislature maintains a toll-free number of 800-352-8404. You can not only dial a lawmaker by name or number, but can reach the House or Senate operator who can help figure out who represents you.

Lawmaker seeks crackdown on fake service animals

S

aying owners are abusing the law, a Republican state senator wants to make it illegal to misrepresent a dog as a “service animal’’ to bring it into places where pets are not allowed.

The proposal by John Kavanagh of Fountain Hills would allow judges to impose fines of up to $250 on someone who fraudulently misrepresents an animal as a service animal or service animal in training to anyone who operate any business or recreation site open to the public. That also includes buses, taxis and ambulances.

The bill would require an individual to produce proof that the animal had actually been trained for a specific chore covered by the Americans with Disabilities Act. The senator said nothing in SB 1040 would allow a business owner to refuse to let someone enter the premises solely because of the failure to provide such written proof. In fact, existing Arizona law prohibits requiring identification for the service animal.

Instead, Kavanagh said, it would be up to a business owner to file a complaint and have the issue heard by a court.

But Sarah Kader, attorney for the Arizona Center for Disability Law, said that presents problems of its own.

Kader said she could foresee a business owner calling the police on someone.

Then the officer would issue a citation, forcing the person with the disability to find his or her way to court to answer the charges.

And if that person lacked transportation, she said, a warrant for arrest would be issued.

She also questioned whether there really is a problem.

Kader pointed out that existing Arizona law already gives businesses the right to eject any animal – including a service animal – if it misbehaves, is not housebroken, poses an “undue burden’’ or “poses a direct threat to the health and safety of others.’’

Underlying all this is an Arizona law that makes it illegal for anyone who operates a public place to discriminate against people with disabilities who use service animals if what the animals do is “directly

related to the individual’s disability.’’

That includes everything from people with vision and hearing loss to balance stability, pulling a wheelchair and sensing when someone is about to have a seizure.

It also covers helping those with psychiatric and neurological disabilities “by preventing or interrupting impulsive or destructive behaviors,’’ but does not include animals purely for emotional support, comfort or companionship.

Generally speaking, service animals are dogs. But Arizona law also allows for the use of miniature horses.

Kavanagh said he has no problem with those who have a legitimate need. But he’s convinced there are a lot more animals being brought into businesses than what the law allows.

“People complain all the time: ‘There was a dog in the coffee shop.’ ‘A woman took a dog on a plane,’” he said. “I see it everywhere. Everyone sees it. And it’s getting out of control.’’

The tricky part for business owners is that they legally cannot ask someone with an animal about his or her disability. Instead, they can ask only if the animal is a

service animal and what tasks the animal has been trained to perform.

But they cannot demand to see any sort of special ID card.

Kavanagh said that people abuse the system. And he sees nothing wrong with requiring people to prove to a judge that their animals have been properly trained for a specific disability covered by the ADA. “It’s amazing that you can’t get a placard to park your car in a disabled spot unless a doctor certifies that you’re disabled,’’ he said. “But, pretty much, today everybody can walk around and buy vests (for their animals) on the internet and claim nontrained animals are service animals.’’

Kader said one big flaw in what Kavanagh proposes is that nothing in the law actually requires that a service animal be formally trained. She said that would subject people to who have trained their own animals for legitimate ADA-covered needs to fines.

Education funding, state tax reform among area lawmakers’ priorities

A

s the State Legislature returns to work, education funding and a major reform of Arizona’s tax structure appear to be the top priorities of its members from Ahwatukee and the East Valley.

Those were the most repeated top priorities as legislators briefly introduced themselves during a special Chandler Chamber of Commerce breakfast Jan. 4 aimed at helping business leaders and elected officials from all government levels get reacquainted.

The 50 or so elected officials, particularly legislators, also stressed that bipartisanship is alive and well in Arizona despite a guest presentation by a U.S. Chamber of Commerce executive that painted a bleak picture of how partisan politics was crippling the nation’s business in Washington.

Jennings Imel, western region manager for the U.S. Chamber, provided a sobering view of how “deep partisanship” had virtually paralyzed Washington despite passage of federal tax reform legislation last month.

That partisanship runs so deep, Imel said, that most Republicans claim to have few friends among Democrats and vice versa, he said.

“We rely on that middle ground to get things done,” Imel said. “The dynamic has definitely changed…Republicans and Democrats don’t have a lot of friends – or even go out to dinner or for a beer with – people in the other party.”

“How are you going to work with the other side if you don’t have friends on the other side?” Imel wondered. “It’s not just an ideological divide but a lifestyle divide as well.”

That lack of bipartisanship threatens action of a long list of important issues affecting Americans, he added.

Those issues include a new 2018-19 spending plan, stabilization of the health insurance market, an infrastructure improvement plan and others.

And even though he called business groups like the Chamber “the voice of reason” amid the political turmoil, Imel conceded, “It’s tough to break through.”

Former Chandler City Councilman Rick Heumann, co-chair of the Chandler Chamber’s public policy committee, said “it’s ridiculous” that members of one party don’t socialize with those of the oppo-

sition.

East Mesa Congressman Andy Biggs also maintained, “We work across the aisle” and cited bipartisan efforts to pass legislation like an Amber Alert for Native American lands.

Turning to priorities for the new legislative session, Republican House Speaker JD Mesnard said finding a permanent solution to Arizona’s funding of education was a top priority, followed closely by tax reform.

Mesnard said congressional passage of federal tax reform created momentum to re-examine and reform Arizona’s tax structure, although he did not give any specifics.

State Rep. Jeff Weninger of Chandler said he is working to make with the state attorney general to create a favorable tax climate for companies engaged in so-called “financial technology” like Bitcoins. He said Arizona could become a center for companies working on such alternative currency.

While Ahwatukee Democratic state Rep. Sean Bowie said “adequate funding of pubic education has been and will be my top priority,” he said he also is working on lowering tuition costs at Arizona’s three state universities.

Other officials expressed their top priority for the new year.

Corporation Commission member Bob Burns said he is working public utilities “safe, reliable and affordable.”

Numerous school board and city council members also voiced their goals for this year, with many of the former agreeing with State Education Superintendent Diane Douglas, who voiced concern that teachers are inadequately paid.

Mesnard and several other East Valley legislators suggested the state might be able to increase education by finding economies in other government spending – a position that Gov. Doug Ducey advocates.

In an interview with Capitol Media Services, the governor said the state has made a “significant investment’’ in K-12 education, saying aid to schools is $700 million higher now than it was three years ago.

“More is needed,’’ he acknowledged, saying the details of his budget will have to wait.

ASU honey bee lab works to save the vital insects

T

ucked away in a dirt lot at the southern edge of Arizona State University’s Polytechnic Campus in Mesa, the Honey Bee Research Lab is home to wide-ranging studies into the winged insects that play a vital role in pollinating the country’s food supply.

The facility – which can house around 1 million bees in peak season in the spring – gives ASU faculty and graduate students space to conduct research on many bee-related topics, including genetics, breeding, behavior and physiology.

One recent study at the facility tracked the effects of different sugars, including high-fructose corn syrup, on honey bee health, said Osman Kaftanoglu, Honey Bee Research Lab project manager.

Kaftanoglu, postdoctoral researcher Chelsea Cook and research technologist Cahit Ozturk presented the findings at Apimondia World Beekeeping Congress in Turkey in September with the talk “Effects of Glucose, Fructose and High Fructose Corn Syrup on the Development, Memory and Learning Behavior of Honey Bees.”

They plan on publishing the findings in the future.

Other topics of research include bee vaccines. Gro Amdam, a professor in ASU’s School of Life Sciences, is developing the world’s first vaccines to protect honey bees from deadly diseases.

Much of the research in the facility revolves around searching for ways to sustain and grow honey bee populations, which have waned in developed countries in recent years due, in part, to heavy pes-

ticide use and the effects of global climate change, Kaftanoglu said.

He added that there were 5.5 million to 6 million honey bee colonies in the U.S. in the 1950s, but now the number of colonies is less than 2.6 million, a decline of roughly 50 percent.

Honey bees, often viewed as pests in Arizona, are actually vitally important to the state’s ecosystem and agriculture, because of their role as a major pollinator for

many fruits, vegetables and other plants.

Honey bee pollination supports the production of $7 billion worth of agriculture in Arizona.

The industry supported by the bees’ honey is also worth $1.7 million per year in Arizona, according to the National Association of State Departments of Agriculture.

Lab encourages residents to take up beekeeping

W

hile Researchers at the Honey Bee Research Lab at Arizona State University’s Polytechnic Campus are always looking for new and innovative ways to save declining honey bee populations, they are also focused on much simpler local solutions to the problem.

“There should be some programs to support local beekeeping to make sure they have pollinators in the area,” lab project manager Osman Kaftanoglu said.

plays an important role in preserving honey bee populations into the future. He encourages beekeepers and local schools to provide programs to teach children the importance of pollinators and the value of beekeeping.

Beyond those educational programs, Kaftanoglu also said that local residents can help maintain bee populations by raising colonies in their backyards.

He stressed that proper preparation and education is important for any would-be apiarist who plans to start beekeeping at home. Local residents interested in beekeeping should also be aware of local laws regulating the practice.

“Right now, keeping bees in many states in backyards is not allowed because of Africanized bees,” Kaftanoglu said.

There are no state statutes in Arizona that prevent residents from keeping bees, though local ordinances can vary across the state, Arizona Department of Agriculture Director Mark W. Killian said via email.

Killian added that his department is working with a number of groups and individuals to find solutions to the death and loss of bees.

In the East Valley, Mesa, Chandler and Tempe all have regulations within their respective municipal codes aimed

at preventing insect infestations.

However, those codes also include other language that permits beekeeping under appropriate conditions.

Mesa’s Zoning Ordinance specifically allows for raising bee hives – also called apiaries – in the Agriculture District and states that “buildings or hives for apiaries may not be closer than 75 feet to any neighboring residence.”

“I’m not raising taxes,’’ he said.

Instead, Ducey insists that he can find the money elsewhere in the budget.

“Our economy is growing,’’ he said.

“Our state government is being operated more effectively and efficiently.’’

But the kind of money Ducey can find through such savings is unlikely to satisfy those who cite not only Arizona’s reputation of being at or near the bottom of per-student funding but the problems in both attracting and retaining teachers.

It’s not just Democrats and educators who are critical of Ducey’s position that the state can fund education without additional revenues. He also is increasingly at odds with those who otherwise might be considered allies.

It starts with the debate of the future of the 0.6-cent sales tax approved by voters in 2000 specifically to fund education. Without action, it will self-destruct in 2021, along with the approximately $600 million it raises.

The governor said he supports simply asking voters to extend it, insisting it could be reformed in a way to generate more dollars. He also doesn’t want any action this year, a move that House Minority Leader Rebecca Rios called “incredibly irresponsible.’’

Beyond that, others say education needs more than that 0.6-cent tax raises.

Douglas favors boosting the levy to a full penny, figuring to use three-fourths of that to boost teacher salaries by about 10 percent.

the defunct 18-hole course.

True Life had argued that a decline in the golf industry represented a “material change’’ that should allow relief from deed restrictions requiring the 101-acre site to remain a golf course.

True Life and previous owner Wilson Gee chose to ignore those restrictions – and Hannah criticized them in his lengthy opinion.

Hannah ruled that Gee and True Life violated the restrictions – which he said had amounted to contract with Ahwatukee homeowners – by purposely allowing the property to deteriorate and failing to maintain it as a high-quality course.

Barnes said he is prepared to have the judge take the final step and order True Life or Gee to undo the damage.

“I am going to draft an injunction to restore the property,” Barnes said, repeating an argument from the trial that a well-maintained executive course could succeed with the right amount of promotion and support from the community.

He said more courses have opened than closed in Arizona in recent years, despite the Great Recession and the decline in popularity of Tiger Woods, who once inspired swarms of golfers.

“Golf is not dead,’’ Barnes said. “That’s an easy thing to say and it’s not entirely true.’’

True Life and Gee had argued a change in the restrictions was justified because a stand-alone golf course is no longer financially feasible, that Ahwatukee Lakes was beyond repair and that it would be impossible to obtain funding to rebuild it.

True Life had opted for that effort to overturn the conditions, covenants and restrictions governing the site’s use after failing to get more than half the approximate 5,400 Ahwatukee Lakes homeowners to agree to a change in the CC&Rs. The company had spent more than a year in its campaign to win approval for a plan called Ahwatukee Farms, which would have made a five-acre farm the center of a development that would include the homes, a private school, a cafe and other amenities.

Barnes categorized Hannah’s ruling as a “repudiation’’ of True Life’s new position, saying that the judge ruled the property must be restored as a golf course – no matter the cost – to comply with the deed restrictions.

“The key to all of that is the CC&Rs are a contract between the property owner’’ and neighbors who benefit from the restrictions, Barnes said.

Gee started the course’s downfall by cutting off the water supply and closing the course in May 2013, Hannah ruled.

The judge noted Gee’s testimony during the trial.

Gee had testified that he spoke with the Ahwatukee Board of Management in 2008 and with City Councilman Sal DiCiccio in 2009 about redeveloping the property.

Gee testified those early conversations led nowhere and he subsequently focused on selling the course after he started losing money during the recession.

But Hannah concluded, “There was no evidence that the golf course could not have been operated profitably in 2008.”

He said Gee was mainly concerned with one of his other courses, Ahwatukee Lakes Country Club.

At the time, Gee owned all four golf courses in Ahwatukee. Last year, he sold the Club West Golf Course for around $1 million. True Life bought Ahwatukee Lakes for about $9 million.

True Life bought the property in 2015 with no intention of operating a golf course, intending to turn it into a lucrative residential development, the judge ruled.

Hannah reiterated his previous ruling from 2016, that the deed restrictions still require the operation of a golf course. His ruling cited the deed restrictions, which

say, in part, that the site “shall be used for no other purposes than a golf course’’ and associated improvements.

He noted that Gee’s own lease between the investors who bought the property, Bixby Village Golf Course Inc., and Gee’s operating company, Ahwatukee Golf Properties, amplified the deed restrictions.

The lease required maintenance of Ahwatukee Lakes “in accordance with the standards of a high-quality privately owned public and semi-private golf course,” the ruling said.

“By closing the Ahwatukee Lakes Golf Course in May 2013, shutting off the water and electricity, removing the irrigation heads from the irrigation system, draining the lakes and failing to maintain the property so that it could be used for golfing or golfing practice, Bixby breached its contractual obligations under the 1992 CC&Rs,’’ Hannah ruled.

True Life was bound by the same deed restrictions, even though the company chose to ignore them and attempted to get them modified to allow residential development instead, Hannah concluded.

“The inequitable conduct of Bixby Properties, which created the alleged hardship to the property owner, also cuts against equitable relief for” True Life, Hannah ruled, declaring: “At the very least, (True Life) had reason to know that Bixby’s actions substantially contributed to the conditions that

made restoration of the golf course economically unfeasible. Bixby, not TTLC (Ahwatukee Lakes Investors), will bear most of the economic burden if the transaction fails. That result, frankly, will not be unfair.”

Hannah also alluded to True Life’s efforts to protect itself financially from an unfavorable court ruling, or a political failure to get the property rezoned, through the terms of an out clause in its promissory note with Gee. While True Life plunked down a $750,000 down payment in 2015, it still owes $8.3 million to Gee to complete the sale.

Barnes said that sets the stage for the next step if and when Hannah issues an injunction.

Lawyers will submit briefs arguing about the terms later this month and early next.

“I think (True Life) will probably default. They put a lot of money into that property,” Barnes said, predicting that Gee will put the property into foreclosure and probably end up keeping it when he gets no takers.

Gee told AFN he does not know what he will do, adding that True Life officials told him they will contact him once they decide what they want to do.

Barnes said he is hoping that Gee, who testified during the trial that the property was worth $1 million if used as a golf course, will finally sell to someone interested in rebuilding the course.

might find the course back in his hands, Wilson Gee, said he was uncertain what will happen now as the case continues chugging through the court system “It’s up to True Life where we go from here,” Gee told AFN. “They said they will discuss it before they meet with me.

“I’m not really going to do anything,” Gee added, noting True Life “has threatened to tie it up in bankruptcy court.

“That could be, what, two years?” he said. “I don’t want to speculate because I really don’t know what’s going to happen. I have no control over this.”

Barry said True Life is “currently evaluating all of our move-forward options.”

Citing the deadlines that Hannah has set over the next eight weeks for various post-verdict actions in the case, Barry said, “We will work consistent with the direction from the judge on the time frame, but we’re evaluating our options as we speak.

“We’re still evaluating from a legal perspective the findings of fact and the conclusions of law and have yet to kind of understand …how the judge got to his decision, but we’re in the process of evaluating that and evaluating what our next steps are.”

Unbowed by Hannah’s occasionally harsh words for True Life, Barry also said, “We’re very proud of our vision for the redevelopment of the Ahwatukee Lakes property.”

He also said the company is “very excited” about its outreach to Ahwatukee Lakes homeowners and “very, very appreciative of the support that we received from a large segment of the community.”

True Life for more than a year had campaign aggressively to get just over half the approximate 5,400 Lakes homeowners to change the covenants, conditions and restrictions requiring a golf course. It ended up getting the support of about 2,000.

Swain praised Hannah’s decision that “as a matter of law, we are entitled to an injunction to undo the damage to our community caused by developers over 10 years’ time.

“In order to make millions for themselves, they destroyed the landscape, blighted our neighborhoods, divided our community, undercut the value of our homes – and then blamed the victims,” Swain said.

Breslin said, “The victims include elderly women alone, some getting around with walkers or canes, who invested their life savings in homes along the Ahwatu-

kee Lakes Golf Course to ensure a quiet, secure retirement.

“Instead, they’ve been rolled by developers and shut out by the Ahwatukee Board of Management, which nevertheless took their annual fees. Who was to speak for these women, if we did not?

Who will speak for us, if the time comes again?”

Ben Holt, a member of the Ahwatukee Foothills Village Planning Committee and president of Save the Lakes/ Save Open Space, ridiculed True Life’s contention a golf course would not be profitable.

“Developer True Life told us that golf is dead, yet they continue to invest millions in golf properties,” he said, citing testimony by a witness for Swain and Breslin that three or four buyers were interested in restoring a golf course.

He thanked the judge and the plaintiffs’ attorney, Tim Barnes, as well as “the majority of the Ahwatukee community who generously supported our effort – and refused to permit not one but three different developers to roll us over.

“This was a community-wide effort,” Holt said. “The victory belongs to the thousands of people who supported us.

We anticipate seeking damages to properly restore the golf course and its neighborhoods.”

He also praised Swain and Breslin, who, he said, “endured insults, abuse, threats and recrimination for standing up to big-money developers and those who supported them. By their example, Linda and Eileen embody the definition of hero. We and the entire Village of Ahwatukee owe them a tremendous debt.”

City Councilman Sal DiCiccio, a vocal opponent of True Life’s plan to build about 270 homes, a five-acre farm and other amenities on the site, also praised the verdict and lashed out at the company.

“True Life came in here and trashed our community, they created an eyesore,” he said.

“Now, the courts are clear: Our neighbors have a right to be involved in every step of the process,” DiCiccio added.

“The future of the Lakes cannot be decided without them at the table. This should send a message to anyone else looking to develop this site – they cannot come into our community, dictate terms, create a disaster, and expect to be rewarded for it.

“Whatever shape this area takes in the future must have buy-in from our community, or it will not happen,” DiCiccio said.

Village Planning Committee Chairman Chad Blostone echoed those remarks, stating “a collaborative approach to redevelopment is necessary” and noted that “previous owners and developers have told the community what they want and how things are to be. All failed.

“Zoning should be modified first, not the CC&Rs,” Blostone said. “That way, the community knows exactly what it’s getting before agreeing to a broad change to the CC&Rs.” Blostone also said True Life had sought

“zoning that provides the land the highest sales price.”

Instead, he said, the site should have been valued at a “more reasonable” price “that would result in more open space, less housing density and a more equitable end result – one that more fairly balances the reasonable expectations and rights of the community and those of the land owner.”

But Blostone also warned that a possible bankruptcy and other issues surrounding the next steps in the case “will complicate an already very complicated site.”

Insurance denial threatens local student’s treatment

I

n the past decade, Heidi Berger Manoguerra has become quite adept at conversing in medical terms.

The Ahwatukee resident of 12 years isn’t a physician or a med student, but the mother of 18-year-old Kathleen Kayley Maro has learned about a plethora of illnesses and diseases since her daughter was diagnosed with pancreatitis at age 10.

“Over the years, I’ve been told time and again that the pancreatitis was idiopathic, the worried mother wrote on her GoFundMe account last month.

“Nonetheless, every year since, I have requested imaging studies and lab work.

Idiopathic didn’t sit well with me.”

Idiopathic refers to any disease or condition arising spontaneously, or one for which the cause is unknown.

What prompted the establishment of the GoFundMe account – which has reached more than half of its modest $5,000 goal – was the latest diagnosis in mid-December at Boston’s Massachusetts General Hospital, often referred to as Harvard/Mass because it is the largest teaching hospital of Harvard Medical School.

The account’s donations were initially earmarked for travel costs – but now a denial of coverage by the family’s healthcare insurance provider has worsened Maro’s plight. The family estimates treatment alone could run $22,000 a month.

Mom, stepfather Mark and their daughter met with Dr. John H. Stone, director of clinical rheumatology at the hospital and professor of medicine at Harvard Medical School.

That physician’s research group also has broadened knowledge of IgG4-RD, “a condition unknown in the U.S. before Dr. Stone’s work,” a Harvard website states, adding that he is recognized as the world’s leading investigator in this disease.

Manoguerra, currently a fifth-grade social studies teacher at Chandler’s Dr. Howard K. Conley Elementary and a former charter school principal, did meticulous research before deciding Stone was the best physician to determine what treatment they should pursue for

their daughter.

“We flew her out to see him on Dec. 14, and he confirmed the diagnoses.

There is a treatment available, but we will need to fly to Boston at least two more times for it. From there, they’ll check her labs and determine when we need to go again,” said Manoguerra, adding: “This is really a life or death issue. If she doesn’t receive the treatment, Dr. Stone told us, she’ll be facing multiple organ failure, cancers and more within 10 years.”

A recent decision by the family’s insurance company added yet another layer of financial concern.

“I was hoping to raise $5,000 for travel-related expenses. We do have amazing Nationwide insurance, but yesterday (Wednesday, Jan. 3) we received a denial for the treatment because it is currently labeled for oncology only,” she said. “We’re appealing the decision. Dr. Stone and his assistant are working on the appeal. We may need significantly more money.

The approval request was for four treatments. My initial GoFundMe was for the first two trips to Boston.”

With that uncertainty, the February trips may be postponed and the ante upped.

“If the appeal is not successful, we will be needing in excess of $45,000,” she said.

In the interim, the Ahwatukee family home hums with three teens, ages 15 through 18.

Adding to the blended family mix are five dogs – some the result of Manoguerro’s fostering ventures. The dogs range from a Shepherd mix weighing 25 pounds to the grand dame – a Goldendoodle tipping the scales at 80 pounds.

“They bring a lot of joy to our home,” said Manoguerra, whose ailing daughter grew up with dogs and is a canine enthusiast.

The Desert Vista High School senior aspires to study international relations at Harvard, Yale, Duke or Brown and spent much of her holiday break fine-tuning her college application essays. She is enrolled in AP classes at Desert Vista and is a member of its renowned speech and See

“She’s definitely an overachiever,” laughed her mother.

She said that to look at her good-natured 18-year-old as she lay on her bed studying while surrounded by three dogs, a casual viewer wouldn’t think of her as suffering from any illness.

“If you met her right now, you wouldn’t know she was sick; but I see it,” Manoguerra said. “We just have to find a way to get these treatments.

“When she had all these odd medical events over the years, we never stopped asking questions. Even right now, this is impacting her lacrimal glands, salivary glands, pancreas, liver, bile ducts, and lymph nodes. If she doesn’t receive these treatments, by her mid-to-late 20s, she’ll be facing multiple organ failure, possible malignancies and the lack of production of some enzymes,” she said, her eyes tearing. “So, this treatment is critical.”

With the blizzard paralyzing Boston late last week, progress in dealing with the insurance company – like Boston’s traffic – halted or proceeded at a snail’s pace.

Senior Olympians prepare for challenges in 2018 games

ention the word “Olympics” and many people conjure an image of well-toned young bodies ready to test their prowess and endurance.

But a group of Ahwatukee Olympians beg to differ as they prepare for one of Arizona’s biggest sporting events – the 2018 State Senior Olympics.

Olympic games are not just for the young, but the young at heart as well, they say.

Residents ages 50-100 years of age can now register for one or more of the competitive sports to be held in venues across the Valley starting on Feb. 17 and running through March 11.

Don’t think these competitors are any less aggressive in their pursuit of athletic excellence.

Take Gloria Tolaro of Ahwatukee, for example.

She does 50-yard freestyle, breaststroke and backstroke swim sprints, as well as 100, 200 and 500-meter freestyle and relays.

She’s 86 years old.

“Whether you medal or not, the fun and camaraderie of the event are equal rewards,” she said.

The Arizona Senior Olympics began in 1982 as the City of Phoenix Olympic Games but was cut from the city budget in 2008 due to the recession.

In order to continue this popular senior event, the nonprofit Arizona Lifelong Fitness Foundation was born.

“The all-volunteer program group provides an opportunity for senior athletes to not only exercise, train, participate in their favorite sport and stay fit and strong, but to socialize and be rewarded for their efforts,” Tolaro said.

The Senior Olympics features 31 sports, including track and field, tennis, golf, swimming, powerlifting and cycling. It is an “open” meet, so Arizona residency is not required.

Participants compete in five-year age groups, and medals go the top three finishers in each event.

Burns said.

“When I retired eight years ago, I decided to re-engage myself in tennis for two reasons: First, it’s an easy way to stay in shape if you play three to five times a week, and second, after I sold my company and became fully retired, I soon realized something was missing.

“It’s a crazy thing, but 38 years in the clothing business made me a very competitive person, and tennis, especially senior tennis, gives me as much competition as I can handle.”

He calls the senior games – which include both team and individual sports – “a great way to meet so many other like-minded sport people and take your sport to another level by leveling the playing field via your age. That is to say you compete with a team or another person who is in your age bracket.”

Besides, he added, the Senior Olympics offer him “another way to test my skills and physical ability against other players in my age bracket.”

When training for a senior game or tournament, Burns works aggressively, spending an estimated 20-30 hours a week for as long as two months before he competes.

Merilee Reynolds, 68, also of Ahwatukee, has been powerlifting for the last six years or so.

Her hard work paid off last year when she won a gold medal in her first entry into the Senior Olympics.

“It keeps me young,” she said of her gym work. “The senior games are fun.”

At age 78, swimmer Ken McKinney can boast a passel of medals for his participation in senior games.

He has logged eight All-American awards, two national records and ranks among the top 10 seniors for five different swimming categories.

Indeed, he has so many medals that he donated more than 60 to a Tucson organization that gives them to special-needs children when they accomplish a task.

Comic book legend Todd McFarlane geeks out

The industry has changed since McFarlane’s childhood days in Calgary and California, where comic shops were rare. He was often called “odd” or “mentally arrested” because he collected comic books. He considered that weird because the name callers themselves were going to see “Indiana Jones” and “Star Wars” movies.

“The people were looking down at me when they were going to their fantasy,” he said. “I just couldn’t have mine.”

His life changed when a comic shop opened in his hometown.

“Other people like me said, ‘This is cool,’” he said. “Then, there were conventions and I said, ‘What? There are thousands like me. Now there are hundreds and millions like us.”

Joining the Marvel team in March 1984, McFarlane became known for his attention to detail and for drawing the first incarnation of the villain Venom.

Hollywood, he said, understands the attraction and the passion behind the comic phenomenon. But Fortune 500 companies are slow to grasp the magnitude of events like the comic cons in San Diego or New York.

“I see a literal tidal wave of people,” said McFarlane, 56. “I’ve been to Super Bowls.

This is the Super Bowl for four days in a row.”

He offers a bit of advice.

“Investment firms are pretty dry, I think, to the average person,” he said. “If they did a commercial about investing, one in which people were talking about investing while putting on superhero costumes to get ready to go to a convention, people would pay attention. A private moms group called Ahwatukee Mamas is hoping interested mothers will join an annual membership drive slated for 9:30-11:30 a.m. Jan. 15 at Desert Foothills Park in Ahwatukee.

Spokeswoman Cindy Smith said this “diverse group of women who support each other in all stages of motherhood” is for both stay-at-home and working moms.

Members have access to a private Facebook page and calendar of events that include play dates, park meetups, field trips, Moms Night Out, book club as well as community service projects and donations to local nonprofit organizations.

Members are encouraged to attend one event a month.

A $30 annual membership fee, prorated throughout the year so members can join anytime, helps support larger activities that include a trunk or treat and spring fling.

t was what one expert called “the mother of all booms.”

Just over a decade ago, Arizona’s construction industry was leading the country in residential and commercial building. People were waiting up to a year for a house, even as builders were throwing new homes up on spec for the residents who were flocking to the state.

And then it was over.

The housing bubble burst and the socalled Great Recession hit in 2007, leaving builders with unfinished properties and no buyers. Arizona saw the “steepest decline” in construction jobs in the nation, as the state

shed more than half its 240,000 jobs before bottoming out in 2011.

“Arizona is a state that tends to operate at extremes,” said Ken Simonson, chief economist for the Associated General Contractors of America.

While the recession lasted longer and was worse on the state’s construction industry than any downturn since World War II, builders have slowly clawed their way back.

Permits for new homes are up, commercial vacancy rates are down and contractors face a new challenge – not enough workers to fill the jobs needed.

After reviewing the new 2018 tax bill, the National Association of Realtors (NAR) has come up with some conclusions on how this will affect homeowners. NAR has concerns that the overall structure of the final bill diminishes the tax benefits of homeownership and could cause adverse impacts in certain markets.

The overall consensus of their members, as well as consumers, helped NAR to gain some important improvements throughout the legislative process. Due to the efforts of the National Association of Realtors, the final bill will continue to benefit many homeowners, homebuyers and real estate investors.

As a result of the changes made during the legislative process, NAR is now predicting slower growth in home prices of 1 to 3 percent in 2018 as low inventories continue to drive price gains. Yet, some areas, mainly high home pricing and high-tax areas, will probably have prices decrease.

This is a result of the new restrictions on state and local taxes and mortgage interest.

Here are some of the major provisions that are affecting current and prospective homeowners: • The tax rate reductions: The new bill generally lowers tax rates for all individual tax filers. Projections are that in the next ten years we can expect to see the tax cut from the rate reductions equaling more than $1.2 trillion. The bill retains the current maximum rates on net capital gains.

Generally, it is 15 percent maximum rate and 20 percent for those in the highest tax bracket with a 25 percent rate on recapture of depreciation from real property. These tax rate reductions should spur activity from new home buyers and real estate investors.

• The exclusion of gain on sale of a principle residence stays the same as the current law. This is a significant victory in the final bill. Prior drafts would have eliminated or reduced significantly this benefit to home owners. Individual filers are still allowed an exemption of up to $250,000

and married filers up to $500,000 if the property was their primary residence for two of the past five years.

• Mortgage interest deduction: The new bill reduces the limit on deductible mortgage debt from $1 million to $750,000 for any loans taken after Dec. 31, 2017.

Loans prior up to $1,000,000 are grandfathered in and not subject to the new cap.

Homeowners may refinance mortgage debt existing on or before Dec. 31 up to $1 million and still deduct interest, so long as the new loan does not exceed the amount of the mortgage being refinanced. Interest remains deductible on second homes, but subject to the $1 million/$750,000 limits.

• Deduction for state and local taxes: The final bill allows an itemized deduction of up to $10,000 for the total of state and local property taxes and income or sales tax. This $10,000 limit applies for both single and married filers.

• Major provisions to commercial real estate: The final bill retains the current Section 1031 Like Kind Exchange rules for real property. It repeals the use of Section 1031 for personal property. Also, the final bill retains the current recovery periods for nonresidential real property (39 years), residential rental property (27.5 years) and qualified improvements (15 years).

Who stands to benefit and who stands to lose?

Those who reside in the country’s most expensive, coastal cities with the highest housing costs and local state taxes could take the biggest hit negatively. The most expensive homes could become more expensive due to the reduced interest deduction and cap on property taxes.

Since the 2018 tax bill retains many of the prior benefits to homeowners and investors hopefully the impact on the overall housing market will be minimal.

The new law provides generally lowers tax rates for individual tax filers.

While this doesn’t mean that every American will pay lower taxes, under these changes many will.

Consulting with a tax attorney or tax account is highly recommended to make sure you have the most current information on the 2018 tax bill. Best wishes for a happy and prosperous 2018.

ome prices are sizzling and sellers are in the hot seat. Sales prices jumped 7 percent annually in November, according to a new report from CoreLogic.

That is the third straight month at that pace, far higher than the price gains in the first half of 2017. Low supply and high demand are fueling the spurt and neither of those is expected to ease up anytime soon.

Supply is actually falling even more now, and a strengthening economy is pushing demand. This will have potential buyers out early this year, trying to get a jump on the spring market.

“Rising home prices are good news for home sellers, but add to the challenges that home buyers face,” said Frank Nothaft, chief economist at CoreLogic, in the report.

Nothaft said the limited supply is the worst at the lower end, and will hit the

growing number of first-time buyers hardest.

Half the homes are overvalued, according to CoreLogic.

The largest metropolitan areas are seeing the biggest gains. Phoenix was the

fastest growing real estate market in the country in 2017.

In the nation’s top 50 markets, half of the housing stock is now considered overvalued, based on market fundamentals, like income and

employment.

CoreLogic defines an overvalued housing market as one in which home prices are at least 10 percent higher than the long-term, sustainable level. This does not seem to be the case in Phoenix, however, because we are reaching equilibrium with supply and demand.

of new homes, which in turn helps drive up prices while lowering the availability of existing homes.

The industry is not yet back to where it was, but it’s better off. Now experts wonder where the ceiling will be this time.

“The new normal is the big question,” said Greg Burger, president of RL Brown Housing Reports, which specializes in residential market research.

The Great Recession officially began in December 2007 when the economy peaked after a 73-month period of expansion, according to the National Bureau of Economic Research.

Arizona’s construction industry saw its highest peaks in April 2006, according to Simonson, citing the Bureau of Labor Statistics. The market quickly declined until it hit rock bottom in 2011, by all measures – two years after the government said the rest of the economy had started its slow turnaround.

The depths of the recession for construction in Arizona saw new permits at historic lows, vacancies in existing buildings at their highest and a shrunken labor force.

“We saw a lot of people cutting expenses very quickly, getting rid of overhead and staff as fast as they could in order to survive,” said Mark Minter, president of the Arizona Builders Alliance.

Elliott Pollack, an economist and real estate consultant, said the decisions builders were making before the recession hit made sense at the time.

“If you just looked at the numbers and you didn’t anticipate the type of recession that occurred – and very few people did – you were able to justify the new construction,” Pollack said. “People were building in anticipation of rooftops that never got built.

“The problem was that nobody anticipated the depth of the recession,” Pollack said. “Therefore, you had all this stuff that was in the building stages when the recession hit, and it took a while to turn that off. And then, of course, you can’t close down a half-done building. You have to finish it.”

It wasn’t until 2012 that the industry began to improve, as indicated by measures including increases in the numbers of approved residential permits from across the state. These increases, while slight, were “an indication of the builders coming back off life support,” Burger said.

Since 2012, the state’s “recovery has been somewhat uneven,” Simonson said.

Pollack said that “population and employment growth were both weaker than anything Arizona, and greater Phoenix for

example, had ever experienced.”

Arizona continued to see population growth, even during the recession, and in 2016, Maricopa County was the fastestgrowing county in the United States, the Census Bureau said.

While some forecasters thought that the Arizona market would skyrocket back up, Burger said he tries to provide a more realistic forecast for residential housing.

Burger does not think the number of construction jobs will get as high as it was right before the recession. But he does think residential home growth will be healthy and steady, thanks to this population growth and to homebuilders adjusting to a changing market that includes new buyers – like millennials.

And Pollack said that the three main categories of the commercial market – industrial, office and retail – are all doing better than they were during the recession.

Retail is the weakest of the three, but Pollack said that’s because retailers face intense internet competition – and because some retailers are just “crappy.”

Simonson said he expects growth to be “more of the same.”

“We will have growth, but it will be spotty,” he said. “Not nearly as strong as the … decade before the recession hit.”

Minter said he’s now more worried about workers than work.

“There’s plenty of work,” he said. “Now our concern is, can we find people to do it?”

Burger agreed, saying that the labor void created when the recession drove workers away is catching up to builders now.

Simonson said that Arizona added 3,000 workers from last October this one, but he said it’s just a minor bump in the overall workforce.

The shortage of construction workers is a national problem that started around 20 years ago, Simonson said. But while the national construction workforce is about 10 percent below peak, he said, Arizona is 40 percent below.

Minter said Arizona builders are looking at recruiting from everywhere.

“We’re looking at everything from returning veterans to people who are just getting out of jail, who might be interested in something in our industry,” Minter said.

“We’re certainly an industry that likes to give people chances.”

Despite the challenges, and some uncertainties, experts agree that Arizona’s construction industry is, in Pollack’s words, “far better off than we were when we were on the precipice of this huge decline.”

“Now, if you didn’t have the benefit of 20/20 hindsight, 10 years ago you probably wouldn’t have said that,” he said. “But given what ultimately happened, yes, you’re far better off.”

AFN Opinion pages are yours – why not use them?

T

he latest installment in the long-running saga of the Ahwatukee Lakes Golf Course’s future gave birth to a crazy thought on my part – crazy because it’s a thought that only an editor might have.

Throughout the latter half of 2016 and the first quarter of last year, these Opinion pages were popping with letters and guest columns on both sides of the issue. To a somewhat lesser degree, the same thing happened as the South Mountain Freeway fight chugged along in the court system.

I miss those days because it showed that Ahwatukee had a pulse when it came to issues that affected the community.

These days, residents post pithy one- or two-liners on Facebook. And while some are thoughtful and provocative and others are amusing, it seems people don’t want to bother with a longer, more cohesive letter

or guest column that will stir the pot and trigger some meaningful dialogue.

It’s not as though all is well when it comes to issues affecting Ahwatukee, its school districts, its legislative and congressional districts or Phoenix City Hall. Or at least it can’t be everyone feels that way.

Yet, the falloff in thoughtful commentaries from our readers disappoints me.

Okay, it’s true I enjoy a robust debate.

I like reading the viewpoints of people, especially if those viewpoints clash – in a respectful way that doesn’t degenerate into mere name-calling.

When you think of it, this is the perfect time to renew an invitation I extended during my first few months in my position – a reminder that these Opinion pages belong to readers first and foremost.

For starters, the State Legislature is back to work – and in an election year no less when we will be deciding not only on its members’ political future but that of the governor and a U.S. Senate seat as well.

Thanks to Capitol Media Services’ early

reporting appearing in the news section of this paper, we already know that at least some legislators want to change municipal elections into partisan rather than nonpartisan affairs in order to “keep liberals from sneaking into office,” as the sponsor of that bill explained.

Another lawmaker wants to ban billboard advertising by medical marijuana dispensaries while another wants to exempt Arizona gun owners from any legislation Congress might pass to regulate their access.

Then, of course, there’s the big gorilla confronting legislators: funding public education.

In short, with the Legislature alone, there’s enough grist for the mill where letters and op-ed columns are concerned.

Closer to home, the mayoral special election promises to be a brawl – and Ahwatukee residents surely have their own opinions on what City Hall should or shouldn’t be doing to and for their community.

The bottom line is this: Social media is fine for tiny bites of commentary, but as the passionate letters about Ahwatukee Lakes Golf Course and True Life’s now-aborted plan demonstrated a year ago, there are readers who have given various issues a lot more thought than a driveby comment.

And if you are one of them, you should know this newspaper welcomes those more developed arguments pro and con – even neutral.

Will they be subjected to editing? Yes, insofar as grammar, understandability and decency are concerned.

Other than that, it doesn’t matter whether I agree or disagree with what a letter or column author has to say.

I just want these Opinion pages to give people a chance to speak their mind – and start a dialogue that can ultimately only benefit Ahwatukee.

Expanding intellectual, cultural and political horizons on MLK Day

nce again, the MLK holiday is upon us, and once again we rehearse the words of “I Have a Dream” and reflect on whether we are ever going to realize Dr. King’s dream of social justice and equity.

To commemorate this day and Dr. King’s bold commitment to servant leadership, many coordinate single-day service projects that “give back to the community.” We see vintage footage of King and his civil rights activism and attend myriad festivities in local parks with vendors marketing their wares.

The holiday comes and goes and we go on about our lives with no real commitment to doing anything more than talking about King’s dream of equality, equity, diversity and inclusion.

Too many wait until this annual holiday

to think about and do anything related to King’s legacy.

Perhaps this holiday can afford a different kind of service and work, perhaps a different kind of personal inventory and personal accountability that demonstrate our deep individual and collective commitment to social justice.

This year, I am doing something different.

While I have over the years attended street festivals and given keynotes and the-importance-of-service talks on this day, this year I am participating in a new community partnership program on black and Jewish relations using the PBS documentary “Strange Fruit” (2007), about America’s ugly history of lynching, to center that event.

The profoundly haunting song “Strange Fruit,” while popularized by Billie Holiday, was actually written as social protest

by Jewish high school teacher Abel Meeropol in the 1930s.

That we are doing this event on MLK

Day provides a bridge between past and present, between blacks and Jewish peoples, and reminds us of the human capacity for empathy in the face of horrific inhumanity.

As I take personal inventory and reflect on Dr. King’s words and actions in the context of this community conversation about the past and present community alliances and tensions between blacks and Jewish peoples, I am better understanding the history of both groups in their interactions with each other.

I am better understanding that each group can own its individual and communal histories without lessening the tragedies of the other. Our two groups cannot coalesce maximally without acknowledging our intersecting and diverging histories of American oppression and suppression.

Clearly, the peculiarities and disenfranchisement of Jim Crow – No Negros, No Jews, No Dogs – and the fiasco of Charlottesville last year underscore these historical ties that bind.

This American history for both groups is written in blood, violence, intimidation and human cruelty, in the case of American lynchings made popular through mainstream photographs, body parts souvenirs, post cards and recordings.

Our event and the documentary will also demonstrate the power of empathy to disrupt “tribal mentalities” that weaken the fight for collective social change.

I am taking this MLK holiday to expand my intellectual, cultural and political horizons. Between this Jan. 15 and next year’s holiday, I want to know more and do more.

I am challenging myself to move beyond my current cultural awareness and knowledge base to understand more, to do more self-education, and to be more empathetic. This commitment feels very MLK-ish.

I am challenging others to do the same: acknowledge what we don’t know and open our ears, eyes and minds to learn.

PARC president assails quality of freeway opinion

I

cannot resist writing one more time about the Loop 202 South Mountain Freeway fiasco.

Protecting Arizona’s Resources and Children, the Gila River Indian Community and others lost our appeal to the Ninth Circuit Court of Appeals.

I could accept a well-considered court decision without comment. This decision, however, was anything but well considered, so I believe those who supported our lawsuit deserve an explanation.

This was a complicated suit involving nine plaintiffs, two government agencies, and many counts of violations of two federal laws. Such a case should have taken a panel of three appeals court judges around four to six months to produce a result that properly and fairly considered all aspects of the case in 50 or 60 pages.

Instead, we had a panel of two appeals court judges and one district court judge (from Texas), and the decision was published in about six weeks in a 12-page doc-

ument.

The decision document has “Not For Publication” stamped at the very top of the first page. At the bottom, it also says that it is not appropriate for use as a precedent in other cases.

In other words, the judges knew very well that their decision was not well considered. In fact, it was downright awful. As with the ruling from the Arizona district court, this ruling ignored the law and said the government can do whatever it wants.

Unfortunately, this ruling is at best a prime example of what corruption does to our government at all levels. Big money was involved in the decisions that have been made.

Money drove the supposed “need” for the freeway in the first place. It drove the backing of all the government agencies along the way. Money has also driven the court decisions we have received.

My hope all along had been that the corruption was limited to Arizona and that we would get away from it in the Ninth Circuit. I was wrong.

I am not sorry that I spent about 10 years and a lot of energy on this case. It

was worth the fight, and in a perfect world we would have stopped this freeway and saved South Mountain.

The world is far from perfect, so we must accept what has happened and move on.

For those of you who supported PARC all along the way, thank you. You should be proud of the fight, regardless of the result.

The bottom line is that the Arizona Department of Transportation has wasted millions of our tax dollars on this freeway fiasco, and it continues to do so.

The freeway will not ease traffic on the I-10. It will just create more traffic in more places. It will also destroy a major part of South Mountain Park and Preserve (the effects will be felt far beyond the actual cut through the mountain), create more bad air in the Valley of the Sun, and subject Ahwatukee residents to new dangers.

PARC’s concerns will be realized – just too late to do anything about it.

This fight is over, but the fight against corruption must continue.

Federal regulators need regulation before they strangle businesses

F

or the Indian Ladder Farms, autumn is the busy season. It’s harvest time, including sales, promotions, school visits, special events and apple picking itself. So naturally it was in October that federal inspectors showed up to ensure that the family-owned farm was in compliance with... everything.

As recounted in the New York Times, the orchard had to spend 40 hours compiling 22 different kinds of records demonstrating compliance with immigration rules, OSHA and Fair Labor standards among others. The ladder safety requirements alone ran thousands of words (who knew ladders could be dangerous?).

Indian Ladder Farms eventually got through it, but others have not been so fortunate. Farm economists note that ever stricter and more complicated regulations have put many small farmers out of business, costing them their homes and livelihoods.

America’s regulatory state is relentlessly expanding. In 1975, there were 71,000

pages of regulations in the Federal Register. Few complained about being underregulated, yet the volume had more than doubled to 135,000 by 2000 and today fills 185,000 pages.

This overregulation comes at a horrific cost. The National Association of Manufacturers in 2014 calculated the total cost of compliance with federal regulations at $2.028 trillion, more than the entire GDP of all but 15 countries.

That works out to $9,991 per worker overall. It’s worse in the manufacturing sector, where the average cost of compliance is $19,564 per employee and a whopping $34,671 in manufacturing companies with less than 50 employees.

Regulation is a silent killer. Unlike taxes and most other things we pay for, we’re scarcely aware of how much we are losing.

Regulations increase the cost of everything we buy, force employers to spend less on salaries and stunt economic growth.

But aren’t some regulations necessary?

Of course. Free markets are great at producing wealth and rewarding merit, but left unchecked they can produce excesses that sting the conscience.

Clean air, water and food must be assured. The truly helpless and vulnerable

deserve protection.

But we don’t have a process that develops thoughtful curbs on the excesses of capitalism. Instead, we have a massive unelected bureaucracy churning out mounds of regulations because that’s what they do. Cost/benefit analyses are seldom used. Impacts to businesses are left undetermined.

Even regulations that begin as reasonable curbs on behavior often morph into grotesque excesses. Take the Migratory Bird Treaty Act of 1918, intended originally to protect birds that migrate internationally from hunting and poaching.

Over the last century, the list of protected birds has grown to over 1,000 species but things really got crazy when the Obama administration, with no change in the law, began to go after the incidentally harmful activity of energy companies.

In 2011, federal prosecutors charged seven oil companies in North Dakota with the crime of having two dozen birds fly into their tar pits. Once the thrust of the regulation had been shifted away from intentional harm, several wind farms were rung up for maiming birds. Individuals could be sued for birds hitting their windows. It was purely prosecutorial discre-

tion.

Companies forked over millions of dollars rather than risk prosecution. Finally, Citgo Petroleum in 2014 challenged – and won – the government’s theory after some birds flew into its oil tanks. The Fifth Circuit sensibly ruled that the law applied to “deliberate acts done directly and intentionally” to migratory birds.

Still, the Obama administration defiantly doubled down on their way out, authoring a legal opinion insisting that incidental takings were included in the act.

Here’s the happy ending: The Trump Interior Department issued a directive upholding the law and preventing further prosecutorial abuse.

The Trump folks are on the right track, but we need more than happy endings.

We need comprehensive reform of our process of generating regulations. Significant regulatory cutbacks would complete the job begun by tax reform in permanently strengthening America’s economy.

All new regulations should be subjected to a cost/benefit analysis. Existing regulations should be combed for duplication and appropriateness. At least one regulation should be deleted for each new one produced.

Local store a fountain of youth for 29 years

anity thy name is business in Connie Desrochers’ world.

For 29 years, she has run her Merle Norman Cosmetics store in the Ahwatukee Palms plaza, on the southeast corner of 48th Street and Warner, where she is the last of the original tenants.

“Mountain Park Ranch was just developing, so we came over here to look at those homes. This center was just going up and I said I want to put a Merle Norman store here,” recalled Desrochers, who was raised in Mesa.

She had been using the products of the Los Angeles-based cosmetics company for a while, so it seemed natural to her to start selling it.

Merle Nethercutt Norman was one of the first women in cosmetics and a true entrepreneur. In the late 1920s, she had begun addressing her own skin needs by testing formulas she made in her kitchen.

She began sharing them with family and friends, believing that it was important for customers to “get it on their faces.” As the company grew 85 years ago, its famous slogan became “Try Before You Buy.” Desrochers said the try-before-buy approach has helped her build and retain a loyal customer base, which includes daughters of some of her first customers.

“Normally, everybody is different,” she said. “Some ladies do a foundation test and some want to do the whole nine yards because they’re looking for a new look.”

All the product samples are in tiny containers so that after a customer has tried one, it can be tossed in the trash.

Lipstick samples are the size of M&Ms, for example.

Besides selling products, Desrochers will provide full or partial makeovers.

That’s especially important when customers decide to change their look with the season.

believer, you will do seasonal. Maybe not all four but at least spring and fall.

Of course, here we really only have two seasons.”

Given the length of time she’s been in business, Desrochers has weathered many changes in her industry.

Besides online shopping, the very advent of department store cosmetic areas became challenging. At the same time, however, she noted, “Many women don’t like taking their makeup in a department store, where everyone is walking past them.

“Besides, they have the same testers for everyone and they get dirty. Here, everything is sealed.”

While “we’re medium range pricewise,” she said, one of the big challenges is the sheer number of product lines.

“There weren’t that many lines when I started the business,” she said. “Now, every star and every model and every celebrity has their own line.

“Then there’s the infomercials,” she said. “Women are terrible that way.

These infomercials say the same thing over and over and the women always think they need to try something new.”

“Fortunately, though,” she added, “many come back to Merle Norman.”

One of the changes for the better has been that products have improved to the point where “you don’t have to go to a

dermatologist to get a good moisturizer.

“The way they regulate stuff, Merle always told us, if you try to combine a lot of stuff into one little product, every ingredient will be diluted. You won’t get the same benefit.”

One other positive change she has seen over time is the increase in male customers.

Merle Norman’s male product line consists only of a moisturizer, toner and a cleanser. So, men who are concerned with their looks will easily buy wrinkle smoothers, neck lotions and other “women’s products” in a bid to keep See

Kiosk at clinic helps patients get medications quickly

ew self-serve technology at one East Valley medical clinic is allowing patients to quickly receive prescriptions and over-the-counter medications from a kiosk immediately following an appointment.

The APM Pharmacy kiosk – currently available at Bayless Integrated Healthcare’s Dobson Ranch location at 2204 S. Dobson Road in Mesa – allows patients to fill prescriptions within minutes at the clinic.

Practitioners at the location can send prescriptions electronically to the kiosk, which verifies patients using their ID. Patients then use the kiosk to interact with a pharmacist via telemedicine and receive their prescriptions.

“There is a pharmacist with every interaction,” said Katie Brite, Bayless Integrated Healthcare medical director.

All conversations with pharmacists are conducted using a private phone to preserve patient confidentiality and avoid HIPAA violations.

The new technology provides increased convenience for patients who are sick or need to fill multiple prescriptions. “(Patients) love it, especially if they are sick or if they have strep throat and need antibiotics, because they can just get it and don’t need to go to a pharmacy,” Brite said.

In addition to providing convenience, the kiosks give doctors peace of mind by ensuring that patients receive prescribed medications.

“It’s great on the provider side because underserved patients don’t always make it to the pharmacy, and (with the kiosks) I know they are leaving with their medications,” Brite said.

She added, “The relevance for our population in general is that we are trying really hard to eliminate barriers … and this is one more barrier we can eliminate.”

The one setback is that the APM Pharmacy kiosks do not currently accept all insurance plans, though that could change in the future.

That shift is largely societal, Desrochers believes, as a youth-dominated culture takes over America.

“Our parents didn’t mind aging,” she observed. “They wanted to grow old gracefully. Most women I know fight aging morning to night, seven days a week. It’s just the way our society is.”

Nevertheless, Desrochers avoids a hard sell.

Asked if she ever calls a client’s attention to newly appeared wrinkles, Desrochers replied, “I would never do that.”

Besides, she doesn’t have to.

“They’ll usually say, ‘I noticed this’ or ‘I noticed that,’” she said.

Desrochers works Monday through Thursday and has one employee, who takes Friday and Saturday. Her shop is closed Sundays.

Make Jesus, prayer part of your New Year’s resolutions

A

brand-new year is here and I am excited to see what the Lord has for us. Keeping Christ at the center of our thoughts takes a great deal of discipline and determination, but so does everything else we really care about.

As a Christian, the best way we can demonstrate our love and devotion is by trying to live for Him. Whatever we become involved with, He simply wants to be our highest priority.

This time of year is a perfect time to start developing spiritual lifestyle changes. You notice I used the word “developing” because drawing closer to God is a process much like losing weight, exercising or any other type

goal in which we are striving toward a goal.

For example, eating a salad today is not going to automatically fix our weight problem, but it’s a positive first step. The same is true with learning how to live the Christian life.

There have been many adaptations from the original Al-anon credo, which encourages everyone to be realistic about trying to change everything all at once. We just need to remember that personal transformation is a lifestyle that will require concentration and perseverance.

Philippians 3:14 says, “I press toward the mark for the prize of the high calling in Christ Jesus” and reveals that no one else can do this for us – it’s between us and God. It’s great to have long-term goals, and we should release our faith into becoming all that He has called us to be, but an import-

ant key is to focus on our mission one day at a time. It would be much better to go slow with permanent results than to rush and become overwhelmed with frustration and disappointment.

Another meaningful resolution would be to dedicate a few minutes each day to prayer.

Daily Bible reading is another excellent place to focus our attention because the words of God are spiritual nourishment to our soul and will help fill our mind and heart with strength and confidence.

Again, I must include this journey will require a fierce tenacity that we commonly avoid because we hate to be uncomfortable.

As many of you already know, drawing near to Christ is a serious challenge because of the added resistance from the dark side.

Long story short: It’s possible but not easy. I recently recorded an 80-minute CD

where I narrate over 100 encouraging Bible passages. It also includes several original songs filled with hope, joy and faith.

Festival aimed at making Chandler ‘a film place’

ilm is a universal language, and Mitesh Patel said that’s the most important part of his Chandler International Film Festival, which runs Friday, Jan. 12, to Monday, Jan. 15.

“People should attend the film festival because they will be watching stories from around the world,” said Patel, festival founder and CEO. “If people attend the festival, they will be engaging with and learning different cultures.

“Along with that, over 200 filmmakers, local and international, come to Chandler so people attending the festival can talk with the filmmakers of films they have just watched.

They can ask questions about the film, where the idea came from, how it was filmed, and it is a great opportunity for people to network.”

The film festival is held throughout Chandler and kicks off with “The Competition,” directed by Harvey Lowry and starring Thora Birch, Chris Klein, Claire Coffee and David Blue, at Harkins Crossroads Theater.

The film is a romantic comedy that follows Lauren Mauldin, a successful blogger who develops her own theory on romance. She encourages women to break up with the men they date after six months to avoid heartbreak.

Besides screening more than 150 films, festival highlights include educational workshops, a film auction, film market, after parties each day and an awards ceremony.

Daily passes, which range from $35 to $115 per day, include general admission and VIP options. All-access VIP passes are $330. For more information, visit chandlerfilmfestival. com.

Patel acknowledged that the Chandler International Film Festival comes with its set of challenges, especially because this is only its second year.

“Chandler is not a film place,” Patel said. “It’s a new thing to the people of Chandler, and filmmakers outside of Chandler have to get

“We want to make the festival bigger, more well-known, and have the ability to spend more money so we can offer more, but we are limited. We are limited in budget since it’s only our second year and our team is limited.

Since our team is limited, our creative side is limited, which requires me and everyone else on the team to wear multiple hats in order to get this festival up and running,” Patel added.

“But everyone does a great job taking on multiple roles and, as the CEO, I have to wear the most hats, which is exciting for me so I can have a decision in the entire festival process.”

He said his passion for “anything and everything that has to do with film” keeps him going.

“As a child, my love of film triumphed over everything else and that love stuck with me as I got older,” Patel said. “I am a film producer and distributor myself, have been so for the last 10 years, so I deal in a lot of different aspects of film.

“One of my biggest passions with film is helping other filmmakers. Helping other filmmakers get their films done and released properly is one of my favorite things because films tell stories and people love stories.

“It’s very important to me that the filmmakers themselves come to the festival to talk about their film. I love bringing filmmakers from different backgrounds together in one place to talk about the one thing we all have

in common, our common language, which is film.”

Some of the films that attendees can expect to see are “The Competition,” “Detroit Under S.T.R.E.S.S.” and “Dad, Where Are You? I Am Lost.” The films are from a wide variety of genres, and patrons will have the opportunity to explore each.

“My hope is that as we grow, it will allow us to officially select more films to show at the festival, being able to bring more and more filmmakers together,” said Patel, who decides which films to screen.

“Our main goal is to make Chandler a film place so more filmmakers from around the world will come here. Whether you’re a local who just loves film, or you’re a filmmaker looking to network, this festival is the place to be.”

Wild Horse hosts Indian ‘Storytelling & Song’

people’s heartbeat is its stories and songs.

For two Valley Native peoples, the Akimel O’otham, or Pima, and the Pee-Posh, the Maricopa, that spirit is eloquently voiced in the “Storytelling & Song” program, which has returned to the Sheraton Grand at Wild Horse Pass, 5594 W. Wild Horse Pass Blvd., Chandler.

Heritage stories and traditional and social songs are shared during the one-hour presentation, 6 to 7 p.m. Thursdays, Fridays and Saturdays at the resort’s outdoor fire pit. Complimentary for resort and restaurant guests, the 13th year for the program opened with a ceremonial blessing last month and continues until the closing blessing Feb. 17.

The goal of “Storytelling & Song” is to protect and share the ancient cultures, traditions and meaningful history of the Pima and Maricopa people with resort and restaurant guests of all ages, explained Rosie Rivera, who manages the resort’s cultural concierge.

“The songs and stories, like our tradition-

al legends, teach us about our roles and responsibilities.”

“We have different languages but share the same cultural values based on a sense of community – sharing resources, helping each other and our fellow man and the law of the common good,” she added. “We revere all forms of nature, including animals and birds, as a meaningful part of our lives, and we consider the surrounding Estrella and South Mountain ranges to be sacred.”

Comprising the Pima and Maricopa peoples, the Sacaton-based Gila River Indian Community owns the Sheraton Grand at Wild Horse Pass.

Historically, different bands of the Maricopa people had lived along the lower banks of the Colorado River for centuries and left these areas, joining the homelands of the Pima people during the late 1700s, said Rivera.

In 1859, Congress established the first reservation in Arizona, comprising 64,000 acres – the beginning of today’s Gila River Indian Community. Since then, Congress added to the designated land, totaling 372,000 acres today.

Fed by the sacred waters of the Gila River, the people constructed 500 miles of large canals linked to smaller ditches and grew cotton for clothing as well as rugs and corn, melons, beans, fruits, tobacco and other foods.

Enrolled tribal members tell and sing a combination of Pima and Maricopa legends based on desert wildlife, often with a moral lesson (but not always), as well as personal stories about their experiences growing up on the surrounding tribal lands.

Some of the storytellers and singers are Tim Terry, Jr., Amil Pedro, Yolanda Hart Stevens and Robert Stone, who recently was elected lieutenant governor of the Gila River Indian Community.

tradition are stipulated, but winter is the only season when storytelling is permitted among the Pima and Maricopa people. Rivera noted that this seasonal tradition has never before been shared with the public.

“Much of our history is passed down to us orally through our families, which means storytelling has been a part of every generation,” she said. “The storytellers share different stories from their upbringing on and around the reservation lands. They also share lessons they were taught by their families, and sometimes they tell stories related to their artwork/craft, such as painting, beadwork, primitive tools, gourds and shell jewelry.”

The Akimel O’otham and Tohono O’odham, a separate tribe in Pima County, were premier basket makers; the Tohono O’odham remain active.

For the Akimel O’otham, basket-weaving is being revived, and more and more members of the community are making a living, or supplementing their income, through arts and crafts, Rivera said.

On the other hand, the Maricopa are known for red clay pottery work. Made of natural materials, various jars and bowls were created for essential needs.

My momma’s famous meat sauce is a family fave

’m positive it was recipes like this that made my momma’s restaurant in Lake Tahoe a hotspot for celebrities.

One of the dishes she was most known for was her pasta with homemade Bolognese (meat sauce). So, I thought it might be nice to kick off

1 large sweet yellow onion, finely diced 3 or 4 cloves fresh garlic, minced 2 sticks of celery, finely diced 1 large carrot, finely diced 2 tablespoons olive oil 1 pound of fresh ground beef 1/2 pound Italian sausage (sweet or hot) 2 cans (16 oz.) organic tomato sauce 1 can (6 oz.) organic tomato paste 3 bay leaves 2 tablespoons fresh basil, finely chopped

Directions:

In a large pan (or Dutch oven) over medium heat, sauté onion, garlic, celery and carrot in olive oil until tender and translucent. Add beef and sausage and cook until browned. Add tomato sauce, tomato paste, wine, bay leaves and basil. Simmer for about 45 minutes. Sauce is done when dark oil begins to bubble to the surface. Add salt and pepper to taste.

is father holds a racquetball national championship in his age group and his two older brothers, Andrew and Reid, both played soccer collegiately and Reid played professionally for Phoenix FC in the United Soccer League. Now, after leading the Louisville men’s soccer team in both goals and points in his junior season, Ahwatukee native Tate Schmitt is creating his own legacy on the soccer field.

It started when Schmitt was young, in the backyard of their house in Ahwatukee, where Tate used to battle with his older brothers, always striving to be just as good, or better than what they were. This is where he picked up his competitive nature and his desire to give his best.

After his sophomore season at Desert Vista High School, a season in which they made a run to the state championship, his ability on the pitch was undeniable.

Schmitt decided to take the next step by joining the Real Salt Lake academy in Casa Grande.

“A couple other families had taken their kids down there the year before and they strongly recommended taking him down,” said Tate’s father, Gil. Soccer academies are made up of the top players around the country, and some are associated with MLS soccer teams. They play against the top competition, preparing players for the next step and even grooming them for the professional level.

Joining Real Salt Lake’s program was one major step in Schmitt’s development that allowed him to earn key opportunities.

“Being able to play under coaches that had played and coached at the professional level and just that MLS environment of the academies and all of them competing against each other, that helped grow me

into being able to play Division I soccer,” Schmitt said.

His time spent at academy, traveling around the country and playing against top competition, allowed Schmitt to develop his game enough to contribute at the Division I level, and it paid off almost immediately.

As a freshman, the 5-foot-11 forward led the Cardinals with a team-high seven goals and dished out three assists. He appeared in all 19 matches and started 13 of them. He also excelled in key moments, scoring four game-winning goals, including the final tally against Duke in the ACC Championship game.

To cap off his successful first year in Louisville, Schmitt was named to the ACC All-Freshman team and was also named to the TopDrawerSoccer.com Freshman Best XI second team. It didn’t come easy, and Schmitt said he didn’t expect to have such an impact so early in his career.

“I thought that I was going to be able

to work my way in and get some minutes my freshman year,” Schmitt said. “But after being at the level of my academy team, it was just as competitive as what it was at Louisville. And with the position I was in, some of the players weren’t the top players on the team at the time, so I was able to get some minutes and prove myself. From then on, I have been an integral part of the team.”

That’s exactly what Schmitt has been in his three years at Louisville. After his successful freshman year, Tate went on to score five goals and added two assists while starting all 22 games in his sophomore year. But his biggest contributions came at the end of the season.

In their NCAA championship tournament run, Schmitt delivered game-winning goals in back-to-back games against UCLA and No. 13 Notre Dame. His ability to perform in clutch situations carried over into his junior season as well.

This past season, Schmitt earned All-

ACC second team honors and was named to the United Soccer Coaches All-South Region Third team. He started all 20 matches, led the team in goals and points, and also dished out three assists as the No. 7 Cardinals earned a NCAA Championship berth. Once again, Tate showed his ability to perform in clutch situations, scoring clinching goals in wins over San Francisco and Colgate.

“I just feel like the big moments are where people need to show up, and I like to take advantage of those situations, when people are tired,” Schmitt said of his ability to perform in clutch situations.

“I always have the chip on my shoulder and go after it, and I just feel like I am very confident in my abilities, and I like to prove it in those situations.”

While Schmitt has been successful through his first three seasons at Louisville, he doesn’t plan on stopping anytime soon. With one season remaining, he hopes to prove himself even more and earn a spot on a professional soccer team, but he also plans on finishing his degree as well.

With the MLS draft taking place in December, Schmitt has been taking extra classes in the summer in order to speed up his degree so he can graduate in December. This will allow him to earn his degree while still being able to pursue his dream of playing professionally.

Schmitt plans to train with the Real Salt Lake MLS team over the summer and allow as many teams as possible to see him play before heading back to Louisville for his senior season. If anything is guaranteed, it’s the fact that Schmitt has already begun to establish his own legacy.
