Residential Development Standards Development of The Woodlands is guided by legally binding Covenants and Development Standards that protect the aesthetic integrity of this Master Planned Community. Additions, modifications and all improvements on properties must be in compliance with the Covenants and Standards to assure continuation of architectural design while also maintaining property values. Recently the Committees reviewed and approved revisions to the Residential Development Standards, in order to adapt to changes in building materials, building trends and other amendments as needed and are effective as of May 24, 2022.

Initial Land Use Designation and Criteria The Initial Land Use Designation (ILUD) limits permissible land uses and sets minimum and maximum building sizes and/or other constraints which is binding on all property owners. All improvements must comply with the established minimum and maximum square feet of living area allowable for all lots established by the ILUD and the Criteria. • Criteria - Establishes more specific regulations for setback lines, hard surface area, living area, colors, materials or other requirements for a home, group of homes or neighborhood based upon characteristics unique to that lot, group of lots or neighborhood. The Criteria varies from one neighborhood to another and frequently within a neighborhood. In case of a conflict between the requirements of the Criteria and the Standards, the Criteria will prevail for all instances other than fence height restrictions. Please contact the Township Covenant Administration Department for the applicable criteria.

Setbacks, Use of Easements and Rights-of-Way Easements provide a buffer zone between properties to minimize the impact of one lot upon another. They are also set aside for providing utility service and drainage to each lot, and to provide natural vegetative screening and privacy separations between lots. Being certain that your project respects all easements, setbacks and Criteria are probably the most compelling reason to contact The Woodlands Township before you commence with any project or complete your project.

Fences All lots are restricted to specific fence designs. Please see the Standards or call The Woodlands Township regarding fence criteria and prohibited fencing materials.

Colors and Materials Colors that harmonize with the natural landscape are strongly encouraged. Muted shades are considered to be most appropriate. Muted shades of white are acceptable in many

neighborhoods. Gloss paint is prohibited. Painting of brick, other masonry material or other types of finishes require an application for review and approval prior to commencement.

Decks and Other Patio Structures Decks, patios, arbors, trellises, sunshades, storage sheds, gazebos, patio covers and similar structures may be permitted, as long as they do not extend into any easements or setback lines established by Criteria and/or by a Plat. The Standards define allowed materials and height requirements.

Room Additions, Garages and Detached Buildings In addition to many other requirements set forth in the Covenants, Standards and Criteria, all improvements must be architecturally compatible. Architectural compatibility is a continuity or agreeable relationship of architectural style, mass, proportion, scale, materials, color and design detail with existing and planned improvements continued on next page

• Plat - Further limitations on the construction of improvements may be found on the plat. A plat is a map of land divisions within an area or subdivision showing individual lots, property lines, setback lines, street rights-of-way and some easements. • Building Code - Where used in the Standards, refers to the code currently adopted by the Residential Design Review Committee. • Improvements - All property owners are responsible for all improvements made on their property, even if they are made by a previous owner. JANUARY 2023 THE WOODLANDS COMMUNITY MAGAZINE 7

Revised Deed Restrictions In The Woodlands - continued on adjacent properties and in the neighborhood. Special restrictions as to the percentage of a lot that may be covered by hard surface material as well as the restrictions related to the amount of square feet of living area in a given home are attached to each lot as defined in the Covenants, Standards criteria and ILUD. Detailed construction drawings, exterior elevation drawings and specifications for color and materials must accompany the completed application. The drawings must indicate how the proposed improvement will relate architecturally to the existing residence, and the plans must be sealed by a licensed A.I.B.D./T.I.B.D. or N.C.B.D.C. designer, architect or structural engineer. Inspections and a refundable compliance deposit are also required.

Pools and Spas The pool and/or spa, as well as its associated decking, berms and waterfalls must not encroach upon any easements. Concrete, paving, and interlocking pavers are also limited by standards regulating lot coverage. Additionally, the water surface and hard surface areas are restricted by the Criteria for all lots. A comprehensive drainage plan is also required at time of submittal. Pools and spas must be enclosed by an approved fence with self-closing and self-latching gates. Pool barrier fencing must comply with the most currently adopted code.

similar systems are allowed, provided they are installed under the eaves and comply with the newly adopted additional regulations.

Play Structures Criteria for the color, materials and placement of play equipment and structures are designed to minimize visual impact of the equipment. Permanent basketball goals must be mounted to the residence or on a pole

Exterior Lighting No lighting fixture may create glare or a level of illumination that is offensive or inappropriate when viewed from adjacent properties. Lights mounted on buildings, poles or trees to provide general lot illumination must be mounted in fixtures that shield visibility of the lamp from the street or adjacent properties and direct the illumination upward or downward. Visibility of lights and fixtures does not necessarily constitute an impact. Permanent programmable channel type lighting or 8 THE WOODLANDS COMMUNITY MAGAZINE

at least 20 feet from a street edge. Freestanding basketball goals, including portable goals, must be located at least 20 feet from the street pavement edge or no less than half way up the drive or adjacent to the dwelling or garage. All basketball goals may not be placed on any easements. Forts, swing sets, etc., are restricted in height, tarp color and size and must be located in the rear or side yard and not in any easement. Wood construction is preferred.

The Covenants The Covenants, Restrictions, Easements, Charges and Liens of The Woodlands (the “Covenants”) are recorded in the real property records and are legally bindng upon most of the land, landowners and residents in The Woodlands. The Covenants require that changes and improvements to a property be reviewed and approved in advance. In addition to The Residential Development Standards, many other important governing documents need to be abided by when considerations for changes and improvements are made. Most home Improvements or modifications require an application for review and approval. For further information about Deed Restrictions and the application process, please contact The Woodlands Township at 281-210-3800 or visit www.thewoodlandstownship-tx.gov/covenants.

Disposition of Trash and Other Debris All trash, refuse or recycling containers may be placed near the street edge no earlier than one day prior to waste collection. Emptied containers must be removed from the street, front yard or driveway by the end of the collection day. Containers must be stored on the owner’s property at all times. All trash and refuse containers must be stored out of public view at ground level from the street or alley or adjacent and surrounding properties at all times except during waste collection. For properties with porte-cochere, carports, or similar covered areas in front of the garage, the trash and recycle cart enclosure may be located within the covered area and extend beyond the front façade of the garage, if it is in compliance with this Standard. No lumber, metals, bulk materials, refuse or trash may be kept, stored or allowed to accumulate on any lot or adjacent areas.

Residential Lot Use Restrictions Without prior approval by the Residential Design Review Committee or its designee, no structure may be used for any purpose other than that for which it was originally approved. The Development Standards Committee reviews considerations for variances.

Boat, Trailer and Automobile Parking and Storage Trailers, trailer homes, recreational vehicles, mobile homes, boats, or other similar vehicles or equipment may not be parked 48 consecutive hours or more on any street or on any lot where visible at ground level from a street or adjacent property. Parking on lawns, ditches, open space areas or other dirt, gravel or grassy areas is expressly prohibited. Motor vehicles that are disabled or mechanically inoperable on a public street may not be parked on any street or at a location where visible at ground level from any street or adjacent property.

Standards regulate allowances for tree removals and require replanting with a focus on native evergreen trees and shrubs.

Pets Residents of The Woodlands are limited in the number of animals to be kept outside the home. No more than three, either cats and/or dogs, may be kept outside. Puppies and kittens are not counted in this total until they are weaned from their mother. Animals must not be allowed to run at large but must be confined to the owner’s lot or controlled by a restraint device.

Landscaping and Tree Removal Residential lots in The Woodlands have been developed to preserve as much of the natural forest as possible. Native vegetation is the single most important landscape element in The Woodlands. It provides the unity and constant “sense of green” that is of immeasurable value to the visual pleasure and enjoyment of the outdoor experience. In an effort to preserve the forested environment and ecological balance of The Woodlands, the

Fireworks, Firearms and Hunting The sale and use of fireworks and the use or discharge of firearms of any kind whatsoever is strictly prohibited on any property within The Woodlands. Hunting of any kind and by any method is also prohibited.

Arbor Day Tree Giveaway and Annual Community Tree Planting

top by the 47th Annual Arbor Day Tree Giveaway on Saturday, January 28, 2023, from 9 a.m. to noon at Rob Fleming Park, 6055 Creekside Forest Drive, The Woodlands, TX 77389. Join us as we celebrate one of the longest running events in The

Woodlands! Arbor Day Tree Giveaway encourages residents to plant free seedlings in their yards, community open spaces and forest preserves. This year, 12 varieties of native seedlings will be available, including both canopy and understory trees. Known

as the upper layer of the forest, canopy trees typically reach a height of 40 to 90 feet at full maturity, providing shade, structure and vital habitat to the forest. The following canopy seedlings will be offered this year: American Sycamore, Chinkapin Oak, Loblolly Pine, Overcup Oak and Green Ash. At maturity, understory trees range in height from 8 to 30 feet and are generally more shade tolerant. These smaller varieties can be added to any yard and include Texas Redbud, Possumhaw Holly, Roughleaf Dogwood, Texas Persimmon, Spicebush, Chickasaw Plum and Witch Hazel. All native tree varieties benefit local wildlife. Flowering trees and shrubs provide nectar for bees, butterflies and other pollinators. Berry- and nutproducing varieties offer small mammals and birds a source of food. Each one is a critical host for beneficial insects. This is a FREE event for The Woodlands residents. For more information, please visit www. thewoodlandstownship-tx.gov/arborday.

Help add even more trees!

Lend a hand on Saturday, February 11, 2023, for the Ninth Annual Community Tree Planting event. Volunteers are invited to join the fun as we plant thousands of native trees and shrubs as part of our ongoing reforestation efforts. The year’s event will be held at the Rob Fleming Aquatic Center, 6535 Creekside Forest Drive, The Woodlands, TX 77389, and adjacent dog park from 8 a.m. to noon. Previous Community Tree Planting events have been held at Meadowlake Park (Panther Creek), Spindle Tree Ponds Park (Sterling Ridge), Tamarac Park (Grogan’s Mill), West Trailhead of the George Mitchell Preserve (Creekside Park) and Footbridge Way Pond Park (Creekside Park). Panther Creek

The new year presents the residents of Panther Creek with many opportunities to participate in keeping The Woodlands the “real hometown” that George P. Mitchell envisioned years ago. Your Panther Creek Village Association exists to help residents enjoy and benefit from the many resources in our community. This will be a busy year in Panther Creek with elections, flea markets, picnics, parades, holiday lighting contests, scholarship awards, guest speakers, bazaars and much more. Come join us. Our monthly meetings are held at 7 p.m. on the second Thursday of each month at The Woodlands Township, located at 2801 Technology Forest Blvd. All residents are invited to attend. Community leaders and civic groups present useful information and make

themselves available for your questions and suggestions. Sheriff Department Deputies present detailed reports of crime prevention and criminal activities in our neighborhood. The Woodlands Program Specialist from the Township’s award-winning Neighborhood Services Department keeps us informed of the wide range of events taking place in our village and actions and issues before the Township Board. Our board members also report on their work at communitywide committees on Residential Design Review, local policing and Parks and Recreation. Because so many of you turned out for the fall flea market, we are planning another this spring! Details and the date will be posted on our village website. Don’t forget to sign up at www. panthercreekvillageassociation.org for our newsletter. Residents recently selected four new members of The Woodlands Township Board of Directors: Brad Bailey, Linda Nelson, Richard Franks and Kyle Watson. The Township Board regularly meets on the fourth Wednesday of each month and the Thursday prior to the fourth Wednesday. Both meetings are typically held at 6 p.m. at The Woodlands Township, 2801 Technology Forest Boulevard, and are open to the public in person or online. Also keep informed by visiting our Panther Creek website, www.panthercreekvillageassociation. org or visit us at www.facebook.com/ PantherCreekVillage, or www.twitter. com/PantherCreekTX. Mexican Plum

S

pring is not the only season in which this beautiful native tree sparkles. Fragrant flowers pollinated by bees give way to its namesake plums. The fruit matures purply red in September, followed by a profusion of yellow and orange leaves. Even in winter, this versatile tree provides interest, with young stems bearing metallic gray, smooth bark. As the tree matures, it develops rough furrowed bark that sometimes exhibits a spiraling pattern on the tree. Mexican plum is a very flexible tree in the home landscape. Growing in sun or shade, undeterred by clay soil

and requiring very little water, it is an understory tree that adds beauty under the shade of larger canopy trees. Mexican plum is preferred to the invasive Bradford pear, which has branches that split easily and is relatively short-lived. The perfect spring-blooming companion to Texas redbuds, Mexican plum is an important source of food for wildlife large and small. This one tree provides nectar for bees and butterflies, leaves that feed the caterpillars of the Tiger Swallowtail butterfly and Cecropia moths, and fruit for birds and small mammals. The plums are also enjoyed by people and make delicious jams and jellies.

Township Launches Project 365 for 2023 T

he Woodlands Township Neighborhood Services Department invites residents to participate in Project 365, a unique component of the National Night Out Campaign. Working together with the Montgomery County Sheriff’s Office Crime Prevention Unit and the Harris County Constable’s Office Precinct 4, the goal is to designate a particular crime or safety-related problem in the community that, when removed, will help to make The Woodlands one of the safest places to live. The Project 365 initiative for 2023 is Identity Theft/Scams Prevention. Identity theft occurs when someone uses your personal information, like your name, Social Security number or credit card number without your permission to commit fraud or other crimes. A scam is a deceptive scheme or trick used to cheat someone out of something, especially money.

How to Participate • Join The Woodlands Township at events throughout the year to learn how to avoid becoming a victim of identity theft attempts and scams. • Host a Safety Awareness Day in your neighborhood to receive information on protecting yourself from identity theft and more. For more information, please contact The Woodlands Township Neighborhood Services Department at 281-210-3800 or neighbor@thewoodlandstownship-tx.gov.

Winter Averaging: Published by Champions Printing & Publishing, Inc.

The Key to Lower Water Bills

By John Geiger, Woodlands Water

W

oodlands Water rates are among the lowest in the region, but that doesn’t mean we enjoy paying the bill. Fortunately, there’s a simple way to lower your water bill now and throughout the coming year. It’s called “Winter Averaging.” The average amount of water used in December, January and February determines the maximum monthly sewer charge for the entire year. The less water you use, the lower your monthly charge. Consider that the average Woodlands home uses 6,000 gallons of water a month between December and February; this generates a maximum monthly sewer charge of $35.18 for the following year. If a neighbor “winter averages” 10,000 gallons a month (perhaps by continuing to irrigate their lawn), they’ll generate a maximum $57.30 monthly sewer charge and pay $265 more over the course of the year.

Woodlands Water Monthly Sewer Rates Residential Base Charge ............................................. $2.00 Charge per 1,000 gallons of water used ................... $5.53 The good news for homeowners is that most water use occurs outdoors, and outdoor water use drops dramatically in fall and winter since rain normally supplies all the water our lawns need this time of year. In fact, irrigating during cooler months, when grass is dormant, can weaken the roots and invite disease and pests in the spring. Not sure how much water you’re consuming each month? Join the over 10,000 Woodlands Water customers who use WaterSmart, an online tool that helps to better understand personal water use, detect and resolve leaks and prevent high bill surprises. This easy and effective way to lower your bill is just one of many water and cost-saving opportunities through Woodlands Water.
