public hearing is postponed. A key policy is outdated. Questions are left unanswered. Economic development projects are delayed. That pretty much sums up the headaches that an ambitious new mayor is facing as he tries to change the culture of a troubled government agency. The agency in question is the Mount Vernon Industrial Development Agency. The mayor is Richard Thomas, who has sometimes taken a confrontational approach in what he has described as a “hostile takeover” of government.
He has even sued city council members and Comptroller Maureen Walker — an IDA board member — claiming they were bypassing his authority to review and sign vendor checks. The agency’s executive director, secretary and sole employee, Margaret Finlayson, was appointed by Thomas’ rival, the previous mayor and IDA chair, Ernest Davis. IDAs use tax incentives, property leases and financing to create jobs and promote economic development. Thomas has a low opinion of how the agency operated under his predecessor. PLANS FOR A 272-UNIT RESIDENTIAL complex on a brownfield cleanup site in Ardsley have been scrapped, according to Greenburgh Town Supervisor Paul Feiner, citing an email from a representative of Akzo Nobel, the Dutch company
that owns the 11-acre property off the Saw Mill River Parkway. “This email is to inform you that Akzo Nobel has terminated contractual relations with a prior potential purchaser of its site at 1 Lawrence St. in Ardsley, NY and has commenced marketing the property for Commercial or Industrial development,” wrote Richard
Rucoba, public affairs manager for Akzo Nobel, in an email to Feiner. Formerly the location of an Akzo Nobel chemical plant, Texasbased developer JPI Multifamily Communities had planned to construct on the vacant lot an apartment complex named the Jefferson at Saw Mill, a four-story 239,000-square-foot building with
438 combined parking spaces in both a garage and an uncovered lot. But the development, which was the subject of multiple public hearings before the Greenburgh Town Board and a petition signed by more than 1,300 people, faced an onslaught of opposition from the community. Residents’ griev-

What’s in a name? Just ask the gutter brothers

en and Ryan Parsons have learned the value of a catchy name in business. They are brothers, three years apart in age, and partners in a contracting business in Dutchess County. They are The Brothers That Just Do Gutters, as it says on their business cards. It hasn’t been an easy haul, but they’ve found their niche in the up-and-down construction industry. Theirs is a kind of business with the kind of name you can franchise — and the brothers, whose systematically well-trained crews just do gutters, have begun doing just that. Perhaps you’ve seen their eye-catching service trucks plying the roads of Dutchess, Putnam, Westchester and Orange counties in the Hudson Valley and western Connecticut. Those are the smooth-shaven, smiling Parsons brothers painted in caricature on the sides of the six to eight trucks they send out within a roughly 50-mile radius from Billings Plaza, a small retail and office strip in the town of LaGrange. Ken, the elder brother and founder of the business, is the darker-haired cartoon character with folded arms; Ryan, the one wearing glasses, sports a beard these days. “That’s been real helpful,” Ryan said of their trademarked company name, which began as a tagline in their company’s radio ads. Hearing the ads, prospective customers called their office asking for “the Gutter Brothers” or “the Brother Gutters,” he said. In any case, the tagline proved memorable, however imperfectly, to those who heard it. “That’s been marketing gold,” he said. The partners several years ago had changed their business name to Waterflow Gutter Solutions when a gutter manufacturer asked them to stop using Waterfall Seamless Gutters, the name by which Ken Parsons launched the business in 1998. With that prior name change, “That’s when we came up with the titles — ‘solutionists’,” Ryan said. The company’s three salespersons have that title. “Ken is the Senior Solutionist,” said Ryan, “and I’m the Chief Solutionist.” “We still haven’t figured out which one’s more important,” said Ken. A middle-school history teacher for three years, “I just couldn’t see myself doing

that for the next 25 years,” said Ken, who with his younger brother grew up working in their father’s construction business. Offered a summer job from a gutter installer in the area, “I started to see, wow, there’s something to this business,” said the dissatisfied teacher. “It’s like a factory on wheels. It was enjoyable work. It was different.” He did not return to the classroom that fall. Instead he invested $500 in a 16-foot box truck as his factory on wheels and picked up a free gutter machine for the one-man business he opened in his mother’s garage. A shoebox in which bills were separated into “Paid” and “Unpaid” stacks was his accounting system. “It broke down probably, like, 15 to 20 times that first year,” Ken said of the company vehicle. “I did a lot of advertising from the back of a tow truck.” “I had no business education,” said Ken, whose company has evolved from a simple DBA at its formation to an S corporation with about 30 employees in Dutchess County. “I just knew how to work my ass off.” An art and graphic design major at SUNY New Paltz, Ryan Parsons after graduation went to work at a Kingston company in 2000. “They were a dot-com dot-bomb,” he said. “Real exciting stuff. We were going to take over the world. Before you know it, I’m literally working for free” and living in his parents’ attic. In the economic wake of 9/11, “We were done.” Ryan did not want to do gutters but
he went to work, starting with “glorified chores,” for his overworked older brother. He began designing a company website — the Gutter Brothers were “light years ahead of everyone in our industry on the web,” he said — and used a software program “to get an accounting system going. I did it all wrong because I didn’t know what I was doing.” The business had one cell phone in Ken’s keeping. In the field, Ryan would call Ken from a phone booth for advice and then return to the job. The brothers found their skills complemented one another’s in business. “Ryan’s good at putting a lot of the details to the ideas that I have,” said Ken. “I’m a visionary, big ideas — let’s conquer the world. And he reins that in a bit, says, ‘OK, we’re going to do that but let’s do this first.’” Ken offered Ryan a 30 percent ownership stake in the business if he bought the company’s first new truck. Ryan agreed to the terms. In 2004, the company expanded to two trucks with crews. “Growing from one to three trucks is the hardest thing we have found in our industry,” said Ken, “and it’s typically the hardest thing that contractors face.” Working with an uncle, the brothers about 12 years ago ventured into general construction while continuing to operate their gutter business. ottoms up! Changes to the state’s alcohol law passed earlier this month will allow restaurants to serve alcohol earlier on Sundays. The so-called “Brunch Bill” will allow restaurants that offer Sunday brunch to serve alcohol starting at 10 a.m. The previous state Alcohol Beverage Control Law outlawed the sale of beers, wine and spirits before noon. “Fans of brunch, soccer, football, holidays and all things Sunday-funday can now raise a glass to thank the governor, Senate and Assembly for their agreement to allow alcohol service starting at 10 a.m. on Sunday mornings,” Melissa Fleischut, president of the New York State Restaurant Association, said in a statement. But while the alliterative title “brunch bill” stuck to the changes in the state’s ABC laws, the changes go beyond dictating how early people can legally use beer to wash down their eggs Benedict. The law also streamlines the licensing process for craft beverage producers. If a person is looking to launch a winery,
but also plans to distill whiskey, he or she will now only have to apply for one license. Previously, separate applications had to be filled for breweries, wineries and distilleries. The old requirements could make things complicated for a place like Warwick Valley Winery & Distillery. The Orange

While co-owner Jeremy Kidde said the change won’t affect his already-licensed business, he thinks it will be great for helping new businesses get through what he said was a difficult licensing process. Other changes that will come from
the law: Customers can fill growlers at wineries, allowing wineries to offer their product on tap. Didn’t finish the bottle you purchased at the winery? That’s OK. Changes to the law now allow customers to leave wineries with open bottles. A craft beverage sales staff should be cheaper to grow. State law currently requires a salesperson employed by a manufacturer obtain a solicitor’s permit, which Gov. Andrew Cuomo acknowledged can impose financial hardship. The agreement eliminates the fee for a solicitor’s permit for craft manufacturers. Finally, consumers no longer need to stop somewhere else to have their gift bottle of wine wrapped. The ABC laws will be amended to allow liquor stores to sell gift wrapping and gift bags directly to customers. The changes were brought after Cuomo convened a panel to review the laws and consider changes. Development Corp., the changes represent recognition of a growing craft beverage industry in the state. The HVEDC runs the Hudson Valley Food & Beverage Alliance, an industry group dedicated to promoting food and drink production in the region. While Gottlieb said the bill may not have huge changes, they do address needs of the producers to keep growing. “We’ve seen explosive growth of craft breweries, cideries, distilleries and wineries,” Gottlieb said. “And when you see explosive growth, you just want to add accelerant to it.”

After 18 years in the works, Harbor Square opens in Ossining BY ALEESIA FORNI

eveloper Martin Ginsburg and Ginsburg Development Cos. on June 23 unveiled a $65 million mixed-use luxury rental apartment complex on the Ossining waterfront, a development nearly two decades in the making. Harbor Square, the Valhalla company’s 188-unit building, features one- and twobedroom apartments along with a top-floor club lounge, fitness center, spa, rooftop pool and sundeck. Eight residents already have moved in, said Ginsburg, and an additional 42 units are leased. The developer said he aims to have the complex fully occupied within 12 months. Also under construction on the property’s 4½-acre lot is a 7,000-square-foot restaurant that will offer American cuisine and serve up to 100 guests. Ginsburg, at the ribbon-cutting ceremony, said a tenant is set to open the dining space this fall but declined to disclose the restaurant operator. “This has been a very long journey to get us to this point,” the developer said. The opening comes about 18 years after Westchester developer Louis Cappelli and

Cappelli Enterprises Inc. placed a winning bid for the waterfront property near the Ossining Metro-North Railroad station, with plans to build a luxury condominium development. Ginsburg joined the venture in 2006 but the project came to a standstill in the credit market crisis of 2007 and 2008 and Great Recession. “The market tanked so we went back
to square one,” Ginsburg said, adding that about $5 million went into an environmental cleanup of the former industrial property. Cappelli later withdrew from the project, which Ginsburg revived in 2012 as a rental development. Harbor Square is “not a low-rent” complex, Ginsburg said at the ceremony,
with monthly rates ranging from $2,395 for a 683-square-foot one-bedroom unit to $6,000 for a penthouse apartment. “You could say maybe we overreached the market a little by doing that, but the market will appreciate it because it is unique,” he said. Ginsburg hopes to attract both millennials and empty nesters with the transitoriented development directly across from the train station. Elected officials at the ribbon-cutting ceremony joined Ginsburg in dedicating a $1 million public park, built by Harbor Square’s developer on surrounding waterfront property, in honor of Henry Gourdine, a fisherman who spent most of his 94 years working the Hudson. Half of the funding for the park, which includes a playground, waterfront promenade and dock that serves the Haverstraw-to-Ossining commuter ferry, came from a state grant to the village. Officials attending the ceremony included Westchester County Executive Robert P. Astorino, County Legislator Catherine Borgia, state Assemblywoman Sandy Galef and Ossining Mayor Victoria Gearity. “It’s an exciting turn for our community to be using our riverfront in a new way,” Gearity said.

bers denied membership. The IDA has a reputation. Two years ago, state Comptroller Thomas DiNapoli issued a critical audit of the agency. Tax-exempt policies were not being applied consistently. Critical paperwork was missing. Projects were inadequately monitored. A $217,366 payment in lieu of taxes had not been paid. Promises of new jobs had fallen short by 671 positions. “As a result,” DiNapoli said, “there is limited assurance that Mount Vernon Industrial Development Agency projects have met their performance goals and benefited taxpayers.” Thomas appointed new board members and chaired his first meeting in May. struction company was draining revenue from their gutter business. By mid-2007, the Parsons saw that the region’s construction boom was ending. They were not being paid by contractors. About 70 percent of their gutter business came from new construction projects by national clients such as Lennar, Toll Brothers and Home Depot and smaller contractors in the area. They closed their construction business and were forced to lay off some top employees. “We were in trouble,” said Ryan. “Any person that had business sense would have told us to bankrupt at that point,” said Ken. But the Parsons saw their choice as either scaling back to a two-man business as owners-installers or trying to make their gutter business “bigger than anything in the country,” he said. Instead of declaring bankruptcy, they secured a $150,000 line of credit. “We wanted to get back in front of homeowners where we started,” said Ryan. “We gave it one more year to really try to make it into a business.” In the grip of the Great Recession, “Everybody cut their marketing,” he said.

posed to be held to discuss one of the mayor’s pet ideas, a ground-floor tax break to stimulate storefront rentals downtown. Finlayson had not prepared materials for discussion, and the hearing was postponed. The materials still were not ready for the June 23 meeting. The board then turned its attention to a request for tax incentives for an industrial laundry. Board member Thomas Rajala had submitted 13 cost-benefit questions to Finlayson. “I had no time to answer these questions,” she said. “I expected you to sit with me and go through these questions.” She described the project information as preliminary. “It ought to be a whole lot more than preliminary, if we already have a resolution in front of us to approve a PILOT (payment in lieu of taxes),” Rajala said.
“There is a performance issue with respect to the IDA that we are looking to address at some point very soon,” Thomas said, citing failures to answer the cost-benefit questions and provide materials on the ground-floor tax proposal. Finlayson insisted that she had not been asked to provide information on the groundfloor tax break and that she had merely been told to put the issue on the agenda for discussion. Thomas disagreed. “That’s a problem,” Rajala said. “Two years ago, the office of the state comptroller came in here and he indicated that a costbenefit analysis needed to be done for every single project.” “It’s the applicant’s responsibility,” Finlayson said. No, Rajala said, it is the IDA’s responsibility. The board moved on to another applica-
tion for tax incentives. Rajala noted that the agency’s financial incentive policy seemed to have expired in April. “Yes,” said Ronald Grosser, the IDA’s bond counsel. “Your policy was good through the end of last year and kind of rolled over a few projects through the first quarter of this year. But it is expired, and by statute you need to have a policy.” “It’s good projects like this that get delayed because of work not getting done,” Thomas said. He adjourned the meeting. Afterward, Thomas said he was frustrated and embarrassed. “We have some real good ideas coming forward,” he said, “but we need our staff to do the work so we can present the ideas.” He said the board will probably start looking for new leadership very soon.
residential building. “People were totally livid,” Feiner said of the public’s reaction to the proposed development. Ardsley Mayor Peter R. Porcino said he was pleased the Jefferson project would not be moving forward as proposed. “It was ill-conceived and did not comport with any definition of good regional planning,” Porcino said.
Rucoba, when reached by phone, had no comment, and calls and emails to both Akzo Nobel and JPI were unreturned at press time. Feiner said he would continue working with Akzo Nobel to find “an acceptable use” for the site, one that would have the smallest negative impact on the quality of life for the residents of Ardsley. Porcino said he believes the location is best suited for a light industrial use.
“Ideally, whatever would generate the least amount of traffic,” Feiner said, adding that he has also reached out to the Department of Environmental Conservation to discuss both the extent and the multimillion-dollar clean up of the brownfield site that JPI had intended to fund. “The village would like to see the property cleaned up, as Akzo Nobel has shirked its responsibilities to do so,” Porcino said.
“We said, we can’t. We’ve got to increase our marketing if we want to survive.” They also raised their quoted price to clients to $5 a foot after their bookkeeper said they would have to charge a minimum of $4 a foot to stay in business — at a time when competitors were charging $3 to $3.25 a foot, Ken said. Clients did not blink. “That was a big turning point in my head,” he said. “We started learning that it’s not so much about the product, but it’s about the value and experience you’re providing your client. We want to reinvent the contractor experience for clients.” In 2011, the Parsons hired a business coach recommended by another contractor. “That’s when we really started to get it together,” Ryan said. From its Dutchess County base, the company does about 2,000 jobs and about $3 million in revenue a year. The brothers in 2011 opened two locations in New Jersey and Virginia — respectively run by Ryan’s brother-in-law and their sister’s husband — which have since become franchises of The Brothers That Just Do Gutters. The company launched two more franchises last year and aims to sell two this year. Franchise owners typically pay from $25,000 to $35,000 to acquire a territory, Ryan said. “They’ve got to come to the
table with about $100,000,” which typically includes $35,000 to $40,000 in working capital, he said. Drawing on their extensive business reading and with the aid of their business coach, the brothers have systematized their sales process and employee training. A fourdesk call center in their Billings Plaza office handles phone calls from clients and does job scheduling for franchise owners. The call center and technology developed by the company frees franchise owners to train their employees and concentrate on developing their local business, Ryan said. He said the company would like to extend its franchise reach to Albany, Connecticut, New Jersey’s Bergen County and Pennsylvania, where a former employee from Kenya opened a franchise in Allentown last year. “But with the technology, we can go anywhere,” Ken said. Five years ago, the brothers started a “skills ladder” system for training and promoting crew workers, from apprentice on the lowest rung to field supervisor at the top. Employees are given skills manuals that list in detail the requirements of their jobs, including topics such as “dumpster optimization” and “jobsite setup.” The training includes required reading and employees present oral book reports in front of their
colleagues. Workers receive pay raises when completing all requirements for their positions. Employees on higher rungs of the skills ladder must train new employees in order to get their next promotion. The brothers plan to add video and online classroom learning to the skills ladder program and will monitor employees’ progress online. Their proprietary training system works well, they said. “It changed our culture,” said Ryan, and has allowed the partners to “get out of the hourglass” and off their company trucks as installers. “We’ve got awesome guys as a result of it,” said Ken. “I can safely say that 90 percent of guys who work for us wouldn’t have been able to cut it in the traditional construction environment.” Of the factors that have kept their company out of the gutter of small-business failures, the name — The Brothers That Just Do Gutters — “is the most important,” Ken Parsons said. It has attracted interest from investors as well as customers. “We’ve had guys reaching out to us from across the country,” said Ryan. “They just want to do something with us — they love the name.” “The name is gigantic,” he said. “What a home run on that.”

WARBY PARKER EYES ROCKLAND FOR OPTICAL LAB EYEWEAR RETAILER AND MANUFACTURER WARBY PARKER plans to launch an optical lab in Rockland County that would create 128 jobs, the company and Gov. Andrew Cuomo announced June 22. The 34,000-square-foot lab will be in Sloatsburg, a village of about 3,000 off Interstate 87 near Harriman State Park. Warby Parker will invest more than $15 million to construct the factory, which will start out with about 15 employees, according to the press release. “As a vertically integrated brand, opening our own lab is the next step in continuing to provide remarkable customer experiences,” said Neil Blumenthal, Warby Parker cofounder and co-CEO. The project will receive $1.32 million in Excelsior Jobs Program tax credits through the Empire State Development Corp. The state also offered the company tax incentives to maintain employment at its New York City headquarters. “Warby Parker is a fast-growing company and their new facility will bring jobs, private
investment and a new economic energy to the entire region,” Cuomo said. Warby Parker employs more than 250 people at its Manhattan headquarters. It sells fashionable prescription eyewear and sunglasses online and in 31 retail locations nationwide, including five in New York City. The company says the optical lab allows it to further manage the manufacturing process and gain control over order time and quality assurance.

Bedford Road in Mount Kisco, where the company has leased 14,896 square feet of space. The deal was announced by CBRE Group Inc. David Block of CBRE’s Westchester/ Connecticut office and Peter Danna of the firm’s Dallas operations represented Regus, which they said operates more than 140,000 square feet of office space throughout Westchester. Block said the South Bedford Road building “met all of Regus’ very specific requirements” for an office location in the northern Westchester market. The 91,000-square-foot, Class A office property is owned by Diamond Properties, the commercial real estate investment and management company in Mount Kisco.
Michael Berretta, Regus vice president for development, said in the announcement the company’s expansion into northern Westchester “enables Regus to meet the ongoing demand for flexible office space in the market.” Headquartered in Luxembourg and calling itself the world’s largest provider of workspace, Regus operates a network of 2,800 offices in 106 countries that serve 2.3 million Regus members and encompasses 43 million square feet of office space.
MOUNT VERNON IDA BACKS LAUNDRY THE MOUNT VERNON INDUSTRIAL DEVELOPMENT AGENCY APPROVED its first project of the year June 23 when it endorsed an industrial laundry. Regent Hospitality Linen Services of Richmond Hill, Queens plans to build a $6.1 million laundry for hotels in a little-used warehouse at 130 S Columbus Ave. “Hotels can’t operate without bedsheets,” said Mandy Lema, managing partner of the firm said at a June 17 public hearing. “It’s a necessity.” New York City hotels devote as much space as possible to rooms and other revenue sources, she explained, so their linens must be cleaned off-site. The company has already lined up enough customers, she said, to make the business profitable. Some of the work will come from hotels owned by the partners: Lema, Xiao Dong Zhao, Joseph Huang and
Ingrid Almanzar. Regent Hospitality asked the IDA for tax incentives that will total an estimated $958,000 over 10 years, including exemption from property and mortgage taxes and relief from sales tax on materials and equipment. The company will make payments in lieu of taxes beginning in 2018. At $1.85 per square foot on 15,000 square feet, the payments will begin at about $27,750. Payments will increase by 3 percent a year. Lema said the business would create 25 to 35 jobs in the first year and another 10 to 15 jobs in the second year. She held out the possibility of opening a second laundry in Mount Vernon if business grows. Lema depicted the linen service as a safe investment for the city. The industrial washing machine will be as big as a locomotive, capable of handling 30,000 pounds of sheets, pillow cases, towels and bathmats while operating eight hours a day. That’s 15 pounds of laundry per room for 2,000 rooms. The company has budgeted annual expenses at nearly $5.9 million. Revenue per hotel room is estimated at $10.49. That works out to annual revenue of almost $7.7 million, a net profit of more than $1.7 million and a profit margin of 23.1 percent. “New York had 56 million visitors last year,” she said after the public hearing. “There are 100,000 hotel rooms. He estimated that the project would create 3,400 construction jobs during the height of the construction, and 34,000 jobs ultimately. Digging yourself out of a financial hole I have no more money to put into the business. Over the years the business has been good to me. It has supported lots of families — mine, as well as my employees. Right now I need more cash to pay the bills, I can’t get a line of credit like I used to and I’m tapped out. I’m planning to sell the business in the next few years, but it’s going to take some work to get it ready for a good buyer. Have I dug a hole too deep or is there a way out? THOUGHTS OF THE DAY: It’s a different financial landscape for many businesses today versus 10 years ago. Figure out what got you into trouble in the first place. Be a conservative borrower. Prove your business has high value by turning it into a money machine. Business owners who have been around
for years often complain that financing the business is a lot harder today than it used to be. They’re right. The credit ratios are tighter, the demand for good credit scores is higher and the documentation needed to get approved is stricter. All of that means it takes longer to get approved for a smaller pot of funds.
The good news is that tougher lending means it’s harder to get the business in over its head with debt. Pay attention when a banker says your business might not get approved. Don’t get mad, get smart. Find out what needs to get fixed and then do it. Ask your banker to give you an education on what they’re looking for. Want to sell the business for maximum profit? Limit spending to things that will grow the business. Prove you’re profitable on your tax returns. Accurately record your re-investments in the business. Learn how to read your balance sheet. Take a good hard look at your client mix. Focus on customers who can make you a profit. Eliminate predatory clients willing to hurt your business in order to help them-

selves. The same goes for clients that can’t or won’t pay their bills on time. Go through income and expenses thoroughly. Are you paying too much for materials and labor and not charging enough for the product or service being delivered? How much waste can you eliminate? Cut out expenses that aren’t necessary, especially personal spending. Make sure that the business has enough margin to show a good profit. When you’ve been turned down by traditional sources for standard loan terms, the offers may start flooding in from the less traditional, higher interest, more onerous loan sources. Owners can get themselves into real trouble thinking they can beat the odds. Lending doesn’t solve the underlying problems that got you here in the first place. Wondering what to avoid when it comes to lenders? Steer clear of offers with lots of fees, credit insurance provided by the lender, prepayment penalties, balloons on the back end, mandatory arbitration, high reset percentages on variable loans and tying up most or all of your assets. Avoid double-digit interest rates that can make it hard to ever pay off the loan. Subprime lending and overdraft loans are only two of the types that cause problems for many business owners. Financing accounts receivable or inventory with highinterest terms can be especially hard to get out from under. Whatever you do, don’t panic. It’s time to buckle down and get things on track. Get costs in line by negotiating with your vendors for reasonable material prices and payment terms. Review employee cost and productivity to be sure everyone is delivering the value they need to — and correct any situations that are out of balance by being honest about what you expect and what you can afford. harmaCann LLC, one of five companies approved by the state to grow and sell medical marijuana, will soon launch its Orange County facility that will harvest “tens of thousands” of medical cannabis plants — just don’t call it pot. Professional language, such as “medical cannabis” or “medical marijuana,” is preferred to the slang of “pot” or “weed,” according to patient guides the company handed out during a tour of its new Hamptonburgh facility on June 27. That advice went with the theme of the facility tour, which was organized by the Orange County Partnership and featured appearances from elected officials and business leaders. Jeremy Unruh, general counsel and chief compliance officer for PharmaCann, stressed the professional, secure nature of the operation to the group. He said he hoped it would soothe any concern about having medical marijuana growing in the area. “Are we letting some terrible scourge in our country be present in my backyard?” Unruh asked. “My job today is to dispel any of those notions.” The tour included state Sen. John Bonacic, Assemblyman James Skoufis, Orange County Executive Steve Neuhaus, Orange County Legislature Chair L. Stephen Brescia and Hamptonburgh Town Supervisor Robert Jankowski. “We want to be viewed as a normal business,” Unruh said. “We want to pay taxes, we want to have the banking relationships that any other business has.” Unruh and a group of employees at the lab led the group through the 135,000-squarefoot facility in the Hudson Valley Crossing corporate park on Neelytown Road. PharmaCann spent about $25 million building the lab, Unruh said. As part of the state’s licensing requirement, PharmaCann had to produce medical marijuana within six months. Construction went beyond that timeframe, however, so the company began growing a small amount of medical marijuana in trailers on the property to meet the state requirements.

But now the facility is ready to start producing and needs only final approvals from the state Department of Health and the town’s building inspector to launch its production. The PharmaCann lab features 16 grow rooms, each with heating lamps and plants lined up about a dozen across. PharmaCann representatives said the facility will be able to harvest product year round. From the grow area, the cannabis will be harvested and dehydrated on site, then made into an oil for sale. State law doesn’t allow for the smoking of medicinal marijuana, instead it can be taken via liquid or oil capsules or vaporized. Unruh showed off the security measures of the facility throughout the tour. Those measures include specialized security cameras and motion sensors throughout the facility and a production and storage area with reinforced concrete walls, plus a room for the final product that Unruh said even the CEO of the company can’t access. Security is overseen by a former New York City Police Department supervisor. Unruh himself has a history in law enforcement. He served as an assistant state attorney in Illinois for six years. “We are not black marketeers, I don’t have a black market background,” Unruh said, adding that you won’t see “pot leaves emblazoned on the wall” at any of PharmaCann’s
four New York dispensaries. PharmaCann is based in Illinois, where it runs two medical marijuana plants and four dispensaries. Started in 2014 by partners in a Chicago law firm, PharmaCann was one of five companies the New York State Department of Health awarded medical marijuana licenses to in July 2015 under the Compassionate Care Act, signed into law by Gov. Andrew Cuomo. The law allows patients suffering from conditions such as epilepsy, HIV or AIDS, Parkinson’s, multiple sclerosis and Huntington’s disease, to be certified by a doctor to receive medical marijuana from a dispensary. But many would argue the implementation of this law hasn’t exactly been smooth. From the start, advocates for medical marijuana questioned whether New York’s program was big enough to meet the demand. “There are huge areas of the state where patients will have to travel enormous distances to get medicine,” Julie Netherland, a deputy state director at the Drug Policy Alliance, a drug reform group, told The New York Times following the state’s announcement that granted companies licenses. The Times article noted that California, the first state to adopt medical marijuana in 1996, had hundreds of dispensaries. The five companies licensed in New York can build four dispensaries each.
There have also been concerns from the medical community about the legality of the program, causing doctors to be slow to complete the four-hour training course to become certified to recommend medical marijuana to patients, a report from The Journal News found. Cuomo has publicly supported the rollout, saying he hasn’t heard any concerns about availability of doctors. “I haven’t heard issues that people can’t find access,” Cuomo said last week. “You don’t have one on every corner because you don’t have that kind of demand. But if you need the drug, you can get the drug.” More than 600 doctors have registered and have certified about 5,000 patients, according to the state Department of Health. Asked about patient access during the walkthrough, Unruh acknowledged there have been difficulties. He called it a “sticking point” in the new law. “Patients don’t know where to go to find a physician, those lists are not publicly available,” he said, adding people often turn to social media to find doctors who can certify patients. The company has also started outreach efforts to educate doctors on what it means to register in the program, Unruh said. PharmaCann’s lab can only provide medical marijuana to its four dispensaries, which are licensed as PharmaCannis. The dispensaries are in Buffalo, Syracuse, Albany and the Bronx. A separate company, Vireo Health of New York, opened a dispensary in White Plains in January. Another company licensed under the program, Etain LLC, opened a dispensary in Yonkers in April. Etain also runs a dispensary in Kingston. Unruh said it’s unclear exactly how much medical marijuana PharmaCann will produce yearly from the Hamptonburgh facility, but he expects to harvest tens of thousands of plants per year. PharmaCann has about 15 employees in Hamptonburgh now, but will employ 70 people once the facility is fully up and running, Unruh said. The company is looking for a wide range of employees, including technician jobs, chemists, security and warehouse jobs. WCBJ | HV Biz

New York’s Medical Aid in Dying Act: what you should know
E
very year thousands of Americans grapple with excruciatingly painful terminal illnesses. For many of these individuals, the thought of their lives being unnecessarily prolonged is abhorrent. On May 23, New York came one step closer to allowing terminally ill patients to end their lives with the State Assembly Health Committee’s passage of the Medical Aid in Dying Act. While the issue of euthanasia or physician-assisted suicide has been front and center in the American psyche since the days of Dr. Kevorkian and Karen Ann Quinlan, the controversial nature of this issue is still as strong today as it was 40 to 50 years ago. Euthanasia is illegal in most states and has been found morally
unethical by many organized religions. If the Medical Aid in Dying Act becomes law, New York will join just five other states — California, Montana, Oregon, Vermont and Washington — and one county — Bernalillo County, New Mexico — where physicianassisted dying, or PAD, is permitted. State Assemblywoman Amy Paulin, D-Scarsdale, sponsored the bill in the Assembly, while Sen. Diane Savino, D-Staten Island, was its Senate sponsor. The 2016 legislative session ended last month without the bill being put to a vote in either chamber. Its sponsors expect it will advance to a floor vote during the next session. The major distinction between euthanasia and physician-assisted dying is who administers the lethal dose. With euthanasia, the
physician or other third party administers the lethal dose, whereas with PAD, the lethal dose is self-administered by the patient and the patient determines whether and when to administer it. Under the Medical Aid in Dying Act, the Public Health Law of New York would be amended to include a new Article 28-F “Aid in Dying” provision. The legislation would permit a terminally ill adult — age 21 or older and expected to live six months or less because of terminal illness or condition — who has the capacity to understand and appreciate the nature and consequences of health care decisions, including risks and benefits, and who is able to reach and communicate an informed decision to a physician licensed to practice in New York state, to

decide to end his or her life. The legislation allows the attending physician — one who has primary responsibility for the care and treatment of a patient’s terminal illness — to prescribe a lethal dose of medication to the terminally ill patient that he or she can self-administer. The medication has to be capable of ending life and can include any other ancillary medications intended to minimize the discomfort to the patient. The request for this medication must be made in writing, signed and dated by the patient and witnessed by at least two individuals who, in the presence of the patient, attest that to the best of their knowledge and belief, the patient has capacity, is acting voluntarily and is not being coerced to sign the request. One of the witnesses cannot be a relative of the patient by blood or by marriage. Additionally, the witnesses can neither be individuals who would be entitled to inherit upon the death of the patient, the attending physician, nor the owner or operator of a health care facility where the patient is residing or receiving treatment. One of the issues that will surely arise when a decision is made by a terminally ill patient to end his or her life is whether the patient has the requisite capacity to make the decision. The legislation provides that if in the opinion of the attending physician, the patient is suffering from a psychiatric or psychological disorder or depression causing impaired judgment, the attending physician shall refer the patient for counseling. The legislation further provides that no medication to end a patient’s life shall be prescribed, dispensed or ordered until the person performing the counseling determines that the patient is not suffering from a psychiatric or psychological disorder or depression causing impaired judgment, and that the patient has the requisite capacity. Although the legislation has bipartisan support, it is not without controversy and opposition in the state Assembly and Senate. The Assembly health committee’s approval was by a narrow margin of votes, 14 to 11. However, irrespective of where one’s opinion falls on this issue, it is safe to say that whenever any legislation is proposed that allows one to end his or her own life, it should be approached carefully and with a great deal of caution and deliberation. ontefiore in the Bronx and Burke Rehabilitation Hospital in White Plains announced June 28 that they will form a new clinical partnership to open a Center of Excellence for Alzheimer’s Disease serving people with Alzheimer’s and other forms of dementia in the seven-county mid-Hudson valley region. The state Health Department has awarded a five-year, $2.1-million grant to the health care institutions to combine the services of the Montefiore Einstein Center for the Aging Brain and Burke Rehabilitation’s Memory Evaluation and Treatment Services as the exclusive center of excellence for Alzheimer’s disease in the region. The grant will be used to expand cognitive screening, diagnosis and care planning and to train primary-care providers throughout the region who can help screen for and diagnose cognitive impairment and make referrals to specialists and community-based organizations. The new center also will make more clinical trials available for patients with Alzheimer’s disease and related dementias and provide telephone and video consultation to area health care providers. Spokespersons for Montefiore and Burke said the center for excellence will capitalize on the research and training capabilities of Albert Einstein College of Medicine in the Bronx, for which Montefiore Medical Center is the university hospital, as well as Montefiore’s expanding network of hospitals and physician groups in the Hudson Valley. “The Center for Alzheimer’s Excellence will allow us to further break down the walls between our outpatient practice and community-based organizations,” said Dr. Jessica Zwerling, a program director for the newly awarded center of excellence and associate director of Montefiore Einstein Center for the Aging Brain, which launched two years ago. Opened in 1979, Burke’s Memory Evaluation and Treatment Services program provides comprehensive outpatient assessment and treatment of memory disorders. Dr. Barry Jordan, who directs the METS program at Burke, will serve as co-director of the new Center of Excellence for Alzheimer’s Disease. “The new grant will allow Burke to continue its longstanding commitment to providing services to patients with dementia and Alzheimer’s disease,” Jordan said in the announcement. “We will be working collaboratively with Montefiore to build upon the solid foundation both organizations have established in this area over the years.” Founded in 1915, Burke Rehabilitation Hospital this year became one of 10 hospitals in Montefiore Health System Inc.

PHELPS HOSPITAL OFFICIALS, STAFF AND GUESTS celebrated the official opening of the community hospital’s new main entrance and renovated lobby in Sleepy Hollow at a June 27 ceremony attended by a member of the 60-year-old institution’s founding family. Visitors entered the new $4.5 million lobby beneath signage displaying the hospital’s change of name from Phelps Memorial Hospital Center and the logo of Northwell Health, formerly North Shore-LIJ Health System, which Phelps joined 18 months ago. Philanthropist David Rockefeller was the hospital’s special guest at the ceremony. His great-uncle William Rockefeller 125 years ago funded the opening of a predecessor of Phelps, a single-room, three-bed facility known as Tarrytown Hospital. His Rockefeller grandparents in 1906 were the first major financial supporters of local health care and his father, John D. Rockefeller Jr., was active in the operations of Tarrytown Hospital and another small hospital that opened in Ossining around 1907. Responding to an increased demand for hospital services in Westchester, David Rockefeller’s brother, John D. Rockefeller III, in 1949 led an initiative to build a larger and more centrally located community hospital in what is now Sleepy Hollow. His family donated $1,225,000 as a grant to be matched by the community, and Phelps Memorial Hospital opened in 1956. “The Rockefellers have been very important partners of Phelps,” Richard Sinni, chairman of the Phelps board of directors, said at the ceremony. “Without their contributions, this hospital would not exist.” The 238-bed community hospital has 1,700 employees and 500 medical staff members representing 60 medical specialties, according to a Phelps spokesperson.
CRYOTHERAPY CENTER TO OPEN IN EASTCHESTER NORDIC CRYOTHERAPY, A CENTER THAT will offer both whole body cryotherapy and localized treatments, recently opened at 31 Mill Road in Eastchester. Whole body cryotherapy is a procedure that uses liquid nitrogen vapors to lower the skin’s surface temperature. According to the center’s founder, Yonkers resident Marie O’Connor, some of the ailments cryotherapy is used to treat include autoimmune and neurological dis-

A
simple observation by Marci LobelEsrig led to a profound insight and a new way of handling a daunting problem for older adults. She was visiting an elderly aunt who excused herself to drive to a car dealership and drop off a check. Lobel-Esrig realized that paying bills can be a hassle for older adults. Many of them are not adept at using computers or they have infirmities that make them vulnerable to mistakes and fraud. “The elderly should be able to age in their homes with dignity and security,” LobelEsrig said, “without having to deal with the burdens of paying bills.” Her insight ultimately led her to create SilverBills LLC, a new kind of bill-paying service. Having practiced corporate law for 20 years, Lobel-Esrig thinks about liability and she is practiced in problem solving. She immersed herself in research. She took a business-planning class at the Women’s Enterprise Development Center in White Plains. She networked with elder service providers, such as the Central Westchester Geriatric Committee.
“The reactions I was getting were so positive and exciting,” she said, “that it just propelled me into thinking, I can do this.” She concluded that older people need a trusted partner. As eyesight declines or dexterity weakens, for example, they find it difficult to write checks correctly. Many of them have no children, or they live far away from family. Some are managing bills for the first time after a spouse has died. Many are proud; they won’t tell their children that they need help. Older adults with physical and cognitive limitations are particularly vulnerable to fraud. The state Office of Children and Family Services recently documented $25 million in losses by elderly victims. That was from just a small sample of 928 adult protection services cases. Many frauds against the elderly are never reported, the agency noted in a June report on financial exploitation of vulnerable adults. Annual losses could be more than $1 billion. Financial stress can quickly spiral out of control. Checks are not deposited and bills are not paid. Utilities cut off water and electricity services. Banks foreclose on houses and landlords evict tenants. The victims are unable to buy food and medicine and they

become fearful or depressed. The daily money-manager industry already offers bill-paying services, but LobelEsrig sees risks. The industry is not licensed or regulated. The managers typically get direct access to client bank accounts to write checks. Paper checks are mailed, leaving clients vulnerable to mail theft. Last year she quit her position as associate general counsel at Sterling Equities, the real estate firm that also owns the New York

ed online portal. Before paying a bill, it is checked for “reasonable and customary charges,” in other words, errors and fraud. One time, for example, a phone bill had doubled in one month. SilverBills set up a conference call with the client and vendor and got the bill corrected. The firm does not have direct access to the client’s bank account. Payments are deducted electronically from either the client’s bank account or as escrow account. The client, or her family, can monitor payments on a secure portal. The company is insured, and if a late fee or penalty is incurred SilverBills will cover the cost. Clients get a monthly statement showing that the bills have been paid. They are charged a flat rate — instead of the hourly rate that daily money managers typically charge — $100 a month or $75 if they are Medicaid eligible. “We charge a sliding scale,” she said, because I believe that regardless of one’s income they should be able to have a solution to this problem.” No more keeping track of due dates. No more writing and mailing paper checks. No more late fees and penalties. No more anxiety, by the client or her children, over financial disruptions. Clients get the benefit of secure bill paying technology without having to use a computer. SilverBills has no office yet. Lobel-Esrig works from home in New Rochelle and has two consultants and a tech adviser with whom she collaborates “virtually.” She recently won a “Pitch for People” competition sponsored by Inspiring Capital, a consulting firm that places business school fellows with social enterprise ventures. Her summer intern is working on the firm’s financial model. The company financing has been bootstrapped through friends and family and Lobel-Esrig has taken no salary yet. She would not disclose how many clients she has but said the number is in the double digits and growing every day. She sees tremendous potential. The population is aging and the problems her company addresses are universal. “The goal for this company,” she said, “is to create a large-scale solution to this problem.” She’s refining her financial model and will seek formal funding. Her advice to would-be entrepreneurs: Make sure you are solving an actual problem. Do your research. Surround yourself with positive people who can help you achieve your goals. The work is exciting, she said, because she can see the impact on her clients’ lives. “If you are doing something that has a social purpose to it, it makes your day-to-day life very much more meaningful.” WCBJ | HV Biz

GIVING CIRCLE AWARDS GRANTS The Giving Circle of Lower Westchester awarded $68,000 to 20 not-for-profit organizations that serve the hungry in lower Westchester County. Award winners were selected based on their work in providing food and services to diverse communities in need. Each organization will receive grants of $1,000 to $6,000 through credits for food purchases from the Food Bank for Westchester. In addition, the Giving Circle provided $10,000 in funding to two preschools – New Rochelle Day Nursery and the Yonkers-based Queens Daughters Daycare under the
FB4W’s Green Thumb program. Each of the two preschools will receive a monthly distribution of “Green Thumb Bags” containing six to eight varieties of fresh fruits and vegetables. The program advances a key priority of improving the nutritional value of food made available to those at risk of hunger in Westchester County. This is the second year the Giving Circle is providing such funding. The $78,000 total funding by the Giving Circle in 2016 represents a 10 percent increase over its 2015 grants of $71,000.
HUDSON PEAK EMPLOYEESS JOIN EFFORT TO FEED HUNGRY Financial advisers Eric Nachman and Darrel Upson recently organized co-workers at Hudson Peak Wealth Advisors in Pleasantville to serve dinner to more than 40 men at Open Arms Men’s Shelter in White Plains. The effort was part of the semiannual national days of service arranged by Ameriprise Financial in partnership with Feeding America, the nation’s largest hunger-relief organization. “Serving our community is important to us at Hudson
Peak Wealth Advisors,” Upson said. “Each June and November we participate in the Ameriprise Day of Service, closing the office for an afternoon so the team can work at a local food bank or other charitable organization. We began our partnership with Lifting Up Westchester’s Open Arms in May with a month-long food drive. Serving dinner at Open Arms was a tremendous experience for all of us. We quickly connected with the guests and were struck by the commitment of the organization.”
FRIEDFEL JOINS JACKSON LEWIS Jackson Lewis PC has added principal Susan D. Friedfel to its White Plains office. Friedfel was formerly co-chair of Proskauer Rose LLP’s higher education practice group. ENEA RECEIVES DISTINGUISHED SERVICE AWARD Elder law attorney Anthony J. Enea, managing partner of Enea, Scanlan & Sirignano LLP of White Plains and Somers, was honored with the Hon. Richard J. Daronco Distinguished Service Award at the Columbian Lawyers Association of Westchester County’s 33rd annual dinnerdance. The event raised funds for the nonprofit’s scholarship program, which awards thousands annually to ItalianAmerican law students. The award is named for the former justice of the Supreme Court of Westchester County. At the time of his assassination in 1988, Daronco was a federal judge for the U.S. District Court for the Southern District of

More than 130 golfers hit the course on June 7 for Arc of Westchester’s 16th Annual Golfing for Kids outing at Hampshire Country Club in Mamaroneck. The event, which raised more than $180,000, benefits children with
autism, Down syndrome and other developmental disabilities served by Arc’s Children’s School for Early Development. The school provides educational, social and support services for chil-
dren, from birth to five years of age, as well as their families. The funds raised by Golfing for Kids will help the school to maintain its standard while continuing to offer services to families at no cost. Following the golf tournament, attendees enjoyed cocktails, dinner, live and silent auctions and the debut of the video, “New Beginnings,” which highlights two Westchester County families who have benefited from the school’s services. Gene Porcaro and Tony Rizzi have co-chaired the event since its inception 16 years ago. News anchor Mary Calvi and Arc of Westchester’s outgoing President Bernard A. Krooks, were both honored with awards.

“Night Light,” an exhibit of photography by Paula Kelly, are on display at the Delaware Arts Center’s Alliance Gallery in Narrowsburg. The exhibit features nocturnal images of landscapes, celestial time exposures, and still life studies. The exhibit will be on view through July 30. Kelly anticipates the movement of stars through the treetops and “draws with light” using the trails created by the Earth’s rotation. “A visual transformation occurs,” she said. “I find observing the constancy of the stars to be grounding and offers perspective to everyday life.” Alliance Gallery is at 37 Main St., Narrowsburg, and is open Tuesdays through Saturdays from 10 a.m. to 5 p.m.
PARKS FOUNDATION TO HOST FUNDRAISER AT PLAYLAND The Westchester Parks Foundation, formerly known as Friends of Westchester County Parks, will host a “Summer Party on the Pier” fundraising event July 15 at 7 p.m. at Playland in Rye. This event comes after the 40-year-old organization changed its name earlier last month to better reflect its mission and reach a wider audience. Joanne Fernandez, board chairperson for the foundation, said the summer gathering is a way for the organization to meet the community and enjoy the summer season. “We are thrilled to host this new summer celebration at one of Westchester’s County’s most iconic parks,”
Fernandez said. “We want to bring back amazing memories at Playland and invite everyone to come experience the park while supporting an organization that helps preserve the more than 18,000 acres of parkland throughout the county.” With admission, guests will receive wristbands to enjoy all of the rides at the park, as well as food and an open bar at Playland’s Tiki Bar with live music followed by fireworks. The event is from 7 to 9:30 p.m. Live music will begin at 8 p.m. and fireworks will start at 9 p.m. Tickets are $100 per person and all proceeds will go to the foundation.

NEW BOARD CHAIR AT AMALMAGATED LIFE Amalgamated Life Insurance Co. of West Harrison announced that Lynne Fox, international president of Workers’ United and the manager of the Philadelphia Joint Board for Workers’ United, has been elected chair of the board. She succeeds Noel Beasley, president of Workers United and the manager of its Chicago and Midwest Regional Joint Board, as well as the vice president of the Service Employees International Union who is retiring. Fox was a board member of Amalgamated Life and brings to her new role as chair “strong values, professional integrity, extensive labor experience and a longstanding commitment to fair and equal treatment of all working people,” according to a press release.
