A GROUP SEEKING A SPECIAL-USE permit to build a 113-bed assisted living facility has presented a preliminary plan to the Greenburgh Town Board. RAKS Corp. is seeking to build on a 5.3-acre wooded site it owns at the ends of North High Street and North Lawrence Avenue adjacent to the Sprain Brook Parkway. FIVE YEARS AFTER OPTING TO keep its bottling division in the town of Somers, PepsiCo Inc. by early next year will relocate its operations and employees there to its offices in White Plains and Purchase, the company said recently. The Feb. 17 announcement from PepsiCo followed a recent announcement from Somers officials that the food and beverage industry giant, a major source of tax revenue in the town, will exit its 540,000-square-foot facility at One Pepsi Way by the first quarter of 2016. PepsiCo and its former spinoff company, Pepsi Bottling Group, which Purchasebased PepsiCo reacquired in 2010, have operated in Somers since 1989.

At Regeneron, genetics research shapes the future of medical care BY JOHN GOLDEN jgolden@westfairinc.com

rom the headquarters of Regeneron Pharmaceuticals Inc. in Westchester, Dr. George D. Yancopoulos visited the White House late last month for a presidential announcement heralding a new venture in gene-focused medical discovery, research and drug development that enlists government agencies, physicians and health care organizations, individual citizens and pharmaceutical companies like Regeneron as partners. At Regeneron laboratories on the Landmark at Eastview life sciences campus, where Yancopoulos is president and chief scientific officer, scientists have pioneered the kind of work and collaborations described that day by President Obama and first unveiled in his State of the Union Address last month. And Regeneron has expanded and evolved its biomedical research and drug development business to incorporate advances in genetic sequencing and genomics that will drive the new federal initiative. Though its fate in the Republicandominated Congress is uncertain, the president’s 2016 budget includes a $215 million investment in a Precision Medicine Initiative that will seek to recruit at least 1 million American volunteers to contribute their health data and DNA samples for analysis and genetic sequencing. The funds will be allocated to the National Institutes of Health, which will develop the million-volunteer national research group for data sharing; the National Cancer Institute, where expanding cancer genomics is an immediate goal of the initiative; the Food and Drug Administration, to develop the regulatory structure and databases needed to safely speed targeted drug therapies into the marketplace; and the Office of the National Coordinator for Health Information Technology, to develop standards that address the highly charged issue of health data sharing and patient privacy. The Precision Medicine Initiative, according to a White House spokesperson, “will pioneer a new model of patient-powered research that promises to accelerate biomedical discoveries and provide clinicians with new tools, knowledge, and therapies to select which treatments will work best for which patients.” At the year-old Regeneron Genetics Center, that patient-powered research

already is well underway. A wholly owned subsidiary of Regeneron Pharmaceuticals whose formation was announced at the start of 2014, the genetics center is collaborating with Geisinger Health System in Pennsylvania to collect and sequence patients’ DNA samples to precisely identify the genetic determinants of human disease. Launched with about 40 employees, the Regeneron subsidiary expects to employ from 50 to 60 scientists “to accomplish the research that we want to do,” said Dr. Aris Baras, executive director of Regeneron Genetics Center. An integrated health system serving some 2.5 million patients in a largely rural area of Pennsylvania that extends from Pittsburgh to Philadelphia, Geisinger has been “a fantastic partner” for Regeneron, Baras said. That non-academic institutional partner, only the second health system in the nation to adopt the now-mandated Electronic Health Record for safer, more efficient and coordinated patient care, Geisinger has treated multiple generations of family members, providing a rich health care database for analysts and researchers to mine at Regeneron, Baras said. For Geisinger, the collaboration with the New York biotech company “is about the potential to improve individualized patient care,” said David H. Ledbetter, Geisinger Health System executive vice president and chief scientific officer, when the pioneering partnership was announced last year. “This collaboration has the potential to provide Geisinger with tools to transform our ability to foresee disease before the onset of symptoms, diagnose chronic and potentially fatal conditions before it’s too late to intervene, and determine how best to optimize the health and well-being for each of our patients.” As Yancopoulos noted at the start of the Geisinger collaboration, genetics has been central to Regeneron’s research efforts since the company’s early years. Arcalyst, the company’s first FDA-approved drug that went on the market in 2008, “treats a rare genetic disorder,” said Yancopoulos, “and the target of one our product candidates in late-stage development that acts to lower LDL cholesterol was identified using human genetics.” “With the tremendous recent advances in DNA sequencing, we believe that now is the time to increase our commitment to, and investment in, human genetics research,” Yancopoulos said.

That commitment in the last year has accelerated at a pace exceeding the partners’ initial plan. Geisinger agreed to collect genetic samples from 100,000 patients who consented to be tested over five years. Baras said Regeneron already has received 50,000 samples, and 25,000 samples have already been sequenced. The partners have raised their sampling goal to 250,000 patients over five years — or one-fourth of the national goal for patient volunteers in Obama’s Precision Medicine Initiative. At Geisinger, Ledbetter has an additional 80,000 patients who have consented to be tested, Baras said. Since its start with the Pennsylvania partner, the genetics center has forged more research collaborations with Columbia University Medical Center to study the genetic basis of cardiometabolic and other familial diseases; the Clinic for Special Children in Strasburg, Pa., to study the genetic basis of early-onset and familial forms of pediatric disorders in Amish and Mennonite families; and Baylor College of Medicine, studying disease genes discovered by the Baylor Center for Mendelian Genomics. Baras said it’s not known what role Regeneron might play in the government’s Precision Medicine Initiative. “It’s too early to say. We’re thrilled that Dr. Yancopoulos was chosen to be part of this discussion.” “We think it’s great any time there’s a big commitment to biomedical research like that…For them to be so focused on precision medicine and genomics, something we’re so passionate about, it has a big impact here.”

DEALS &DEEDS FRIEDLAND REALTY TO MOVE HQ TO HARRISON Friedland Realty Advisors will end its 40-year presence in Yonkers this spring when it moves its headquarters to 440 Mamaroneck Ave. in Harrison. Ayall Schanzer, the CEO who has led the commercial brokerage in its rebranding, technology upgrade and business services expansion since joining the Friedland company a year ago, said the move to the RPW Group building will double the company’s office space to about 8,000 square feet. The brokerage expects to move from its office at 656 Central Park Ave. in late March or early April, he said. Repositioning for growth, the company, said Schanzer, anticipates hiring more brokers — it currently numbers about 25 — as it develops new business lines, including property management and capital mar-

kets, and extends its geographical reach in Westchester County. “We’ve outgrown the space we’re in now,” he said. The Harrison office building, a 223,000-square-foot property, offered a more central location in the county and an amenities-rich environment for Friedland staff, he said. “Where are we going to put our headquarters? That was the big decision,” Schanzer said. The company also considered Stamford and Greenwich in Fairfield County, Conn., Manhattan, where Friedland maintains a small office, and the Bronx, which has been the predominant market for sales and lease deals by its industrial, retail and office divisions. Schanzer said the brokerage might eventually open satellite offices in the metropolitan area. “Westchester positions us to be a dominant regional player with close proximity to our target customers and desirable inventory,” he said in a press release from the office of Westchester County Executive Robert P. Astorino. The company in its application for financial assistance from the Westchester County Industrial Development Agency said

it expects in the next year to add four executive positions to its current full-time staff of seven employees. County IDA directors at their February meeting approved $102,000 in sales and use tax exemptions for renovations and equipment purchases at the new Harrison headquarters.

DEC’s plan for summer shutdown of Indian Point ‘preposterous’ BY ARTHUR KREMER

he New York State Department of Environmental Conservation’s recent push and legal victory to keep alive a proposal to close Indian Point for up to 92 days in the summer is a preposterous idea, even by government standards. While the proposal aims to reduce the impact of the plant on fish eggs and larvae, it would wreak economic havoc, while also creating far more environmen-

tal problems than it would solve. Businesses, especially those in energyintensive industries like information technology, manufacturing, hospitality, cleaning and grocery would face much higher prices, and indeed the prospect of periodic blackouts and the economic disruption they cause. The net result is lower profits, fewer jobs and a degraded economic climate. The DEC proposal to close Indian Point in the summer would take offline 2,000 megawatts of power, enough to power 2 mil-

lion homes. Up to 30 percent of the region’s electricity comes from Indian Point and the summer is when that power is needed most. In 2011, the New York City Department of Environmental Protection conducted its own study evaluating Indian Point and found that closing the plant permanently would mean $10 billion to $12 billion in higher costs for consumers through 2030. This study also found the permanent shutdown of Indian Point would raise electric costs for New Yorkers by $300 million annually. The

last thing New Yorkers need is an increase in their electric bills. Unemployment rates will also rise right along with energy bills, as Indian Point is a job creator throughout Westchester County and the surrounding region. In Westchester alone, 3,300 jobs are dependent upon the continued operation of the plant, according to a 2012 study by The Business Council of Westchester. If the plant is operating at a capacity of only 75 percent, as the DEC proposes, many of those jobs are endangered. Forced outages will also have a negative impact on the state’s economy, as out-of-state investments will be discouraged. Industries are unlikely to relocate or expand into a state where the grid is unreliable and the power is arbitrarily turned on and off. Closing Indian Point also means New Yorkers will have to power their air conditioners and homes through other sources. Only fossil fuel plants will be able to step into replacing the vast majority of the power, leading to an increase in dirty air and smog. In place of the virtually zero carbon emissions that Indian Point provides, New Yorkers will have to contend with an increase in carbon dioxide, particulates, nitrous oxides and sulfur dioxide. When it comes to water protection, Indian Point’s owner Entergy has put forward a better proposal to protect fish, fish eggs and larvae than has the DEC. Many major industrial facilities use wedgewire screens to mitigate their environmental impact and these wedgewire screens have a proven track record. Entergy has proposed implementing a sophisticated system of wedgewire screens by Indian Point. This year-round technology would improve and protect the water around the plant 12 months of the year, 24/7, protecting more fish, fish eggs and larvae. It would also bring jobs and economic activity to the region. For the benefit of New York’s economy and environment, the DEC should abandon its ill-advised shutdown proposal and turn to solutions which will have more immediate and tangible benefits for the environment, while also safeguarding the economy. If an owner desires to fly out of, say, Teterboro or East Hampton, our enhanced capacity in White Plains will allow us to serve them better.” According to Flexjet’s application for funding, 20 temporary construction jobs will be created during a four-month renovation of the hangar facility, which will include enlarging the hangar doors to a height of 27 feet to accommodate larger aircraft and renovating and remodeling half of the office space into a customer lounge. Mashburn said that Hangar F will become the East Coast maintenance facility for the Flexjet fleet, which includes Bombardier, Learjet, Embraer and Gulfstream business jets. “A meaningful portion of Flexjet’s customer base resides within 30 to 45 minutes of Westchester County Airport,” Flexjet’s appli-

During the presentation by Simone, Feiner asked about the possibility of frequent ambulance calls to the facility being a disruption, which were among the concerns relayed to him by nearby residents. “Typically… you have the potential for an ambulance call, but not on a daily basis,” Simone told the board. He said a similar facility he had worked on averaged one ambulance call per week. “Generally, these are healthy individuals in assisted living, and when they get to a more ambulatory situation, they’re transferred to a nursing (home.)”

Simone told the board that the facility would get one or two deliveries trucked in each week, and that the majority of the 60 or so projected employees would likely drive to the facility. RAKS Corp.’s plan, according to Simone, is to bring in a separate operator for the facility. “Most of the operators are waiting to see how the application is received before they make a commitment,” he said. Despite the plan being presented to the Town Board as part of the application for a special permit, the plan for the facility is still in the preliminary stages.

“We intend to do community outreach and garner information and questions that may be out there,” Simone said. Before construction could begin, a full proposal for a special permit would have to be approved by the zoning board of appeals, which has previously passed certain conditions, such as access to a major roadway, for assisted living facilities. “Since this is on a dead end … my personal gut feeling is that it would be tough,” Feiner said during the Town Board work session. “You’re talking about not a small facility, you’re talking about a large facility with 113 beds at the end of the street.”

wage permanent jobs from Teterboro to Westchester County Airport, with Flexjet’s employment levels at the airport growing by 10 percent each year for the next two to three years and creating an additional 55 permanent jobs over the next five years. Flexjet will add 10 new jobs in the “large cabin program,” a number it expects to double in the first three years the company operates at the airfield. “Overall, these will be highly technical jobs that involve maintaining, servicing and flying aircraft,” Mashburn said. “This includes everyone from aircraft mechanics to pilots to the owner services personnel who will staff our passenger lounge.” Flexjet’s fractional jet ownership is a business concept where individuals pay for a certain amount of annual flight time on a private jet in 50-hour increments on aircraft owned, operated and maintained by the corporation. In addition to fractional jet ownership and management, Flexjet also operates

traditional charter service. The move from Teterboro to Westchester by Flexjet will add to the private jet presence at the airport. NetJets, the fractional jet company owned by Warren Buffett’s Berkshire Hathaway Inc., also operates at Westchester County Airport. At the launch of a new line of aircraft last summer, CEO Jordan Hansell told the Business Journal that NetJets had carried more than 300,000 passengers on more than 87,000 flights to and from the airport. It has 65 employees at the airport. According to an email from Britta Vander Linden, a communications specialist and economic development liaison in the county executive’s office, there were 57,566 corporate jet takeoffs and landings out of Westchester County Airport in 2014. “Westchester County Airport is already one of Flexjet’s top five airports for takeoffs and landings each year,” Mashburn said. “Flight activity will certainly rise as our new facilities come online.”

The expansion was aided by a $4 million grant from Empire State Development Corp. Town of Somers Supervisor Rick Morrissey said PepsiCo currently employs 1,200 to 1,400 workers there. PepsiCo’s lease signing in 2011 ended a roughly three-year effort by state and county officials and U.S. Sen. Charles E. Schumer to keep the Pepsi bottling group in Somers and counter an effort by Connecticut officials, reportedly sweetened by up to $30 million in financial incentives, to bring the company to Danbury. PepsiCo’s lease agreement included a five-year renewal option. “For the town, it was a surprise,” Morrissey said of the company’s decision to relocate. Yet he had indications last June that a move could be planned when

PepsiCo’s Somers landlord, Norman A. Sturner, founder and head of MHP Real Estate Services in Manhattan, expressed concern that PepsiCo had not signed a lease renewal. Morrissey said the loss of PepsiCo will have no immediate impact on the town’s tax base, which has long been buttressed by the presence of IBM Corp. and the Pepsi bottling division. officials in a coordinated effort to replace PepsiCo in Somers. ided by a state grant, Purchase College will retrofit campus surfaces to reduce stormwater runoff and improve water quality in a nearby stream that empties into the Long Island Sound. The SUNY school received $765,000 in the state’s annual round of regional funding awards announced in December. The money will come from the state Environmental Facilities Corp.’s green infrastructure grant program. The money supports the college’s environmental efforts and offers a learning experience for students, according to SUNY Purchase President Thomas J. Schwarz. “This opportunity embodies the college’s ‘Think Wide Open’ motto, encompassing environmental and educational benefits for

the betterment of our students and community,” he said. The college plans to retrofit parking lots and pedestrian paths, impervious surfaces that cause runoff water to form puddles, flood or flow into storm drains. Tom Kelly, senior energy manager at Purchase College, said one of the projects includes installing porous pavement, which will help runoff spread to lawns instead of storm drains. This will also alleviate “ponding” on sidewalks, he said. Another component of the project is installing bioretention swales, which divert water away from pavement to the earth, Kelly said. Bioswales use engineered soils and vegetation to capture, treat and slowly absorb and filter surface water runoff. The system is designed to decrease the volume of water and reduce pollutants from reach-

After receiving state approval, college officials have two years to complete the project, which is epxected to begin this fall. “We look forward to the environmental benefits that the grant accrues,” Kelly said. “Everyone here is happy to have the ability to give back to the college and to the environment.” College officials said the project will also serve as a hands-on opportunity for students and faculty to learn more about the impact of stormwater solutions. Faculty from the college’s environmental studies program will design comparative studies on water quality within and outside the project area

and collect data over a three-year period. Undergraduate interns will collect the field samples and conduct laboratory analysis. The college will report preliminary results of the studies to the state Department of Environmental Conservation. “This project has the potential to inspire the next generation of green infrastructure stewards, who will advocate for new environmentally resilient systems in many settings,” Kelly said.

ESD names Taylor to lead regional office

eghan Taylor has been appointed mid-Hudson regional director for Empire State Development Corp., replacing Aimee Vargas, who will take a role elsewhere in state government. Taylor will work under Empire State Development’s incoming president, CEO and commissioner, Howard Zemsky, managing daily operations of the mid-Hudson office and promoting economic development practices to retain and attract businesses in the Hudson Valley region. Taylor also will serve as executive director of the Mid-Hudson Regional Economic Development Council. “I look forward to this new opportunity and will work hard to further the midHudson region’s economic development agenda and stimulate job growth throughout our area,” Taylor said in a press release announcing her appointment. “I am eager to contribute to the exceptional work of the staff already in place and am delighted to be working alongside the co-chairs and members of the Mid-Hudson Regional Economic Development Council.” An Empire State Development spokesman told the Business Journal that Vargas will remain with the administration of Gov. Andrew M. Cuomo in a new role to be announced in the near future. Taylor holds a bachelor’s degree in finance from Binghamton University and an MBA from Mount St. Mary College in Newburgh. How we all pay for affordable housing

hat do a pig farmer in Iowa, a sanitation man in Mount Vernon and a bond trader in New York City have in common? They all are paying for affordable housing in the richest areas of Westchester County. The county’s refusal to transfer the obligation to create affordable housing to municipalities — the direction of New York state law and county policy for more than 20 years - has meant that federal, state and local taxpayers are paying well more than $200,000 for each two-bedroom apartment created under the federal consent decree. That federal order requires Westchester County to ensure the creation of 750 units of affordable housing in overwhelmingly white areas to overcome the effects of de facto segregation. Take Roundtop, an affordable housing development of 92 one- and two-bedroom apartments in Montrose. The total development cost for that project was $31 million, or $337,000 for each apartment. Because affordable rents can only support about $100,000 in mortgage debt, that meant that

federal, state and Westchester County taxpayers had to subsidize $237,000 for each unit. The approval last month of a project in Chappaqua, Chappaqua Station, carries a projected cost of more than $500,000 per one- or two-bedroom apartment, and that doesn’t take into account the cost of addressing safety concerns in return for variances recently granted by New York state.

Problem solved 25 years ago A Republican county executive working with a Democratic legislature proposed a solution to this problem 25 years ago. County Executive Andrew O’Rourke predicted stagnant growth and a decline of Westchester County without affordable housing for firefighters, teachers and other members of the workforce. And so, he and the county Board of Legislators set up a Housing Opportunity Commission (originally called the Housing Implementation Commission) that authorized an independent study to determine the “regional need” for affordable housing, pursuant to a New

York State Court of Appeals decision in Berenson v. New Castle. That decision and line of cases required each municipality, no matter how rich and exclusive, to satisfy its fair share of the “regional need” for multifamily and affordable housing to promote growth and equal opportunity. A 1992 study by the Rutgers University Center for Urban Policy Research, and a subsequent study that projected housing needs through 2015, became the cornerstone of the county’s Affordable Housing Allocation Plan. It assigned a goal for each municipality to produce units affordable to families at or below 80 percent of the area median income (about $83,000 for a household of four). The plan placed the obligation for affordable housing on each local community rather than the county government. The Affordable Housing Allocation Plan, which was voluntary, provided a tool for developers to sue municipalities that refused to follow it, and subsequent court decisions accepted its validity in overturning zoning that eliminated multifamily housing. But few developers had the stom-

ach to go through the expensive and onerous process of years of litigation, and the politicians who publicly supported the plan often ended up run out of town. In 2010, then-state Sen. Suzi Oppenheimer managed to get a bill through the state Legislature requiring that all multifamily development in Westchester include at least 10 percent affordable units. But the reaction by Westchester municipal officials was so severe, she actually asked then-Gov. David Patterson to veto her own bill, which he did. So, without the Affordable Housing Allocation Plan (it expired at the end of last year) or the will to enforce it, the Iowa pig farmer and all of us must pay a lot more than necessary to persuade places like Chappaqua, Scarsdale, Mount Pleasant and Harrison to do what the law requires. Partnerships advance affordable housing in region

hile there is little dispute about the shortage of affordable housing in the region, there is an ever-increasing controversy about how to fix the problem. The terms of a $51.6 million fair housing settlement between the U.S. Department of Housing and Urban Development and Westchester County require the development of 750 affordable housing units in the parts of the county that have the lowest Hispanic and black populations. However, while the battle over the settlement makes the headlines, a second and perhaps more important issue affecting the affordable housing landscape is to preserve existing affordable developments to prevent the problem from getting worse. As a longtime advocate and developer of affordable housing communities, Wilder Balter Partners Inc. believes that access to affordable housing is critical for the Hudson Valley, particularly in Westchester and its neighboring counties, where the cost of living and doing business is so high. According to a survey conducted recently by the Westchester County government, the top priority for a business wishing to relocate to Westchester is access to an educated and skilled workforce. According to that same survey, the cost of housing ranks

as the top priority of workers making a decision on where to live. It is clear that affordable housing will be a critical factor to this region’s economic growth. In addition, as the population continues to age, more affordable housing is needed to house our seniors who want to stay in their communities but whose home upkeep and taxes are no longer affordable. It is increasingly more challenging to build affordable housing in the Hudson Valley due to high land costs, regulatory issues and necessary, but limited, governmental funding. At the same time, existing affordable housing, especially senior affordable housing, is aging and in need of significant capital improvements. Nonprofit housing sponsors of thousands of existing affordable apartments in the Hudson Valley and the metro New York region are struggling with a common problem not anticipated by their original financial model — how do they continue to own and operate their properties when they require significant capital funding that is not available to nonprofit sponsors? Westhab of Yonkers recently tackled this problem head-on. Two years ago, Westhab merged its operations with the Washingtonville Housing Alliance, a small nonprofit housing organization with several small affordable mul-

tifamily buildings and one larger, 75-unit affordable senior community called Mamaroneck Towers. Shortly after Westhab took over the day-to-day management of the alliance, the nonprofit agency realized that renovations to the apartments and common areas at Mamaroneck Towers were required for the complex to remain viable for the long term as an affordable senior building. They sought to find a partner who would bring in the necessary capital and expertise while Westhab and WHA would continue to be involved in the development going forward. Westhab and WHA had a second goal for Mamaroneck Towers — to have the project serve as a funding source to carry on their mission of providing affordable housing and counseling resources for low-income residents in the area. Wilder Balter Partners Inc. partnered with the nonprofits to help fulfill these goals. As owner, developer, builder and manager of properties in the Hudson Valley, Wilder Balter specializes in working with municipalities and nonprofits wishing to bolster their existing affordable housing and/or build affordable housing. Over the course of the last year, Westhab, WHA and Wilder Balter developed a partnership that enabled the restructuring

of Mamaroneck Towers’ finances with taxexempt bonds and housing tax credits totaling $15.8 million through the Westchester County Industrial Development Agency. Renovations of the common areas and apartments will begin later this month and will be completed by year’s end. Long-term affordability of Mamaroneck Towers is now assured for the next 30 years. With the financial restructuring complete, Westhab and WHA created a fund of more than $3 million to invest back into the village of Mamaroneck to create additional housing opportunities and social services to those in need. Wilder Balter also is working on the financing and rehabilitation of other affordable housing communities in Westchester and Rockland counties. For Westchester County and the rest of the Hudson Valley, the effort to provide the area’s workforce with attractive and affordable housing options will require creativity. Even with the 750 units required under the fair housing settlement, much more affordable housing in the Hudson Valley is needed. William G. been looking for a new location following their decision to put the 16-acre campus, at 52 N. Broadway, up for sale. The order has been located there for 125 years. Geoff Thompson, a spokesman for the order, told the Business Journal in November the combination of the congregation’s nuns aging and fewer young women joining the order have put the congregation in economic peril. After examining potential solutions over the past 15 years, the sisters decided to sell the property, which includes an elementary school in addition to the high school, Thompson said. “All of the properties owned by the sisters were thoroughly evaluated,” Thompson said in November. “The property that is the most costly to operate and holds the most value is the Good Counsel campus, and that’s why it is on the market.” According to a letter from Cardinal Timothy Dolan, archbishop of New York, the archdiocese helped the Good Counsel trustees search for a vacant Catholic school building to relocate the high school but were unsuccessful. Dolan’s letter said

one school, in New Rochelle, was ruled out after it was determined costly renovations would be necessary. “As recently as December 2013, the archdiocese also attempted to negotiate a building lease for Our Lady of Good Counsel Academy in another part of Westchester County,” Dolan wrote. “At this point, the archdiocese has done all that has been asked to assist this private school in remaining open.” The Good Counsel elementary school, which offers pre-K through eighth grade, was able to find a new home. In September, it will open 2 miles north of the White Plains campus at the former Holy Name of Jesus elementary school in Valhalla. Commercial real estate firm CBRE Group Inc. has the exclusive listing of the Good Counsel campus, which is next to Pace Law School. Reached by phone, Bill Cuddy, an executive vice president at CBRE, declined to comment on any bids that have been made on the property, citing the need for confidentiality on both sides of the transaction.

INBRIEF ACORDA EARNINGS BEAT EXPECTATIONS Acorda Therapeutics Inc. announced fourthquarter earnings of $331,000 and beat Wall Street expectations on earnings per share and revenue. The company, based in Ardsley, posted adjusted earnings per share of 46 cents for the fourth quarter of 2014, beating the Zacks Investment Research consensus estimate of 15 cents per share. The drug maker announced revenues of $117.9 million in the fourth quarter, beating analysts’ expectation of $111.1 million, according to Zacks. “During 2014, we made major progress across our three core value drivers: Ampyra commercial performance, clinical pipeline

and business development. We grew Ampyra net revenue 21 percent over 2013; Ampyra is now considered a standard of care in (multiple sclerosis). The firm announced non-GAAP (generally accepted accounting principles) adjusted earnings of $2.79 per share for the fourth quarter and $10 per share for the whole year, reflecting an increase of 25 percent in the fourth quarter against the same period in 2013, and 22 percent for the full year against 2013. Regeneron’s revenue was $802 million in the fourth quarter and $2.82 billion for the full year, representing growth of 31 percent for the quarter and 34 percent for the year. Net product sales totaled $522 million in the fourth quarter and $1.75 billion for 2014, compared with $406 million in the fourth quarter and $1.43 billion for 2013.

SBA LAUNCHES ONLINE LENDING TOOL The U.S. Small Business Administration has launched a new online tool called LINC (Leveraging Information and Networks to access Capital) to connect borrowers looking for an SBA loan to lenders within 48 hours. Maria Contreras-Sweet, the SBA’s administrator, in a press release said the tool requires small-business owners to fill out a 20-question form and will connect them with lenders within a 48-hour window. “By directly connecting with prospective borrowers, the agency will be able to provide more guidance and ensure more capital is reaching our nation’s entrepreneurs,” she said. According to Kellie LeDet, an SBA regional administrator who oversees the agency’s programs and services for New Jersey, New York, Puerto Rico and the U.S. Virgin Islands, once a borrower completes the online form it will be sent to every lender in that borrower’s county, as well as to other lenders with a regional or national reach. Once lenders have reviewed the information, they will respond within two days, with no fees or commitment to the prospective borrower. “This option frees entrepreneurs from the limited choices they may have,” LeDet said in the press release. “Using this technology will enhance a borrower’s position with lenders and provide them with alternative sources of finance.” LeDet said the agency plans to roll out LINC in waves. It will begin by offering connections with nonprofit lenders that offer free financial advice and specialize in microlending, loans in the SBA’s Community Advantage program and real estate financing. The SBA will look to add more traditional banks in the future, LeDet said. The SBA reported 124 lenders nationwide are participating in LINC. — Leif Skodnick

Avoid the risk of not getting paid People owe us money and I want to get paid! We were busy last quarter and we didn’t stay on top of collections. Now even current clients are slowing down payments. I’m starting to worry about how I’m going to pay our bills. How much accounts receivable is enough or too much? THOUGHTS OF THE DAY: There are business cycles when things seem to dry up, and falling into one of those cycles can make it really difficult for any business. Carrying accounts receivable means you’re running the risk of not getting paid. Not carrying accounts receivable means leaving money on the table, sometimes. Don’t hesitate to rein in a really good customer. Make sure that collecting money is everyone’s job. Get tools in place to make the job easier. Many businesses have failed with too much of a good thing — lots of orders, followed by too much of a bad thing — unfulfilled promises to pay. If you’re going to go to the trouble of producing a product or delivering a service, make sure you will get paid for the effort. Think about your own business. There are probably times when your company is flush with cash and times when things get really tight. The same happens to other businesses as well. Here are a few common influencers: big bid awards in the spring, paying taxes before the October deadline and clearing out the bank account at year end. Make a list of the cycles you’ve seen in your industry. Lay it out in a calendar so you know when the peaks and valleys occur. Get ahead of the valleys by stepping up pressure to get paid a month or two before the valley hits. Ask for prepayments when companies are at the top of their cash flow cycle. Ever have to write off a bad debt? Why? Because the client decided not to pay. Whatever excuse is given, the client made a choice and your company came up short. Make sure that you minimize the reasons why your company might not get paid. Have a written scope of work signed by an authorized officer of the client company. Specify payment terms and what happens if payment terms are not met. Beware of the client who presses you to negotiate away all of your company’s leverage. Grabbing for a great deal that almost seems too good to be true — that’s a warning sign for you to exercise care and restraint in your credit authorization.

Keep a close watch on accounts receivable. Set limits for how to wait to get paid. When things get busy make it someone’s job to watch and report on the aging of every account, every week. Send off warning flags at 30 days past due, rather than 60. If a client gets to 60 days late, they’re probably juggling vendors who also delivered stuff two months earlier. Meanwhile that client’s focus is now on keeping things rolling with new orders, which may include moving on to new vendors if you shut them off. Once they don’t need you anymore, your leverage is down to legal maneuvering which can take time and money. On the other hand, walking away from business when you can afford to extend credit can also be a mistake. Don’t leave business on the table for some other competitor to pick up if you can afford to extend terms and if the customer is credit worthy. Check the credit worthiness of every customer before negotiating payment terms. The best credit check of all may be to talk to a number of your potential client’s vendors. They’ll know if their customer is paying or not. It’s easy to find out who companies work with. Just ask. Make it casual. Show some interest. Most potential clients will eagerly share details. They’re proud of the strengths of their business, which include who they work with. Pass your notes on to whoever is responsible for checking credit. Then that person has a casual conversation with the vendors, about how they’re doing with collecting from their clients. Pretty soon you have a good feel for the risks of getting that new client of yours to pay their bills on time. Periodically repeat the process of checking up on clients. Keep a book of vendor reference contacts to call. Back up informal conversations with standard credit reviews. Use information available from a credit reporting agency. Create a file on each client and drop each report into the file. That way you can look back for trends if there’s ever a question. Looking for a good book? changed dramatically during the three decades that Rakow has been in business. In the ’80s, the Fortune 500s dominated the office scene and accounted for the largest share of the county’s workforce. That gave way to the emergence of small and midsized firms and the transformation of those large Fortune office complexes into Class A office spaces for new tenants. Rakow cited commercial real estate developer Robert P. Weisz of RPW Group as a “genius who swam against the tide and took the risk to convert the former General Foods headquarters at 800 Westchester Ave. and other Fortune buildings along (Interstate) 287 into smaller and attractive spaces, offering value-added amenity packages for so many tenants.” The makeover of the market turned out to be a plus for the overall economy, especially during the Great Recession, which started in 2008. “When you look elsewhere in New York state that experienced a void when large companies moved out, our region was fortunate to have a threshold of companies and firms that kept the market going during the sharp downturn in the economy,” Rakow said. He said the trend of companies getting by with fewer employees and needing less office space has abated somewhat, creating more equilibrium in the market, which is encouraging. As much as he takes pride in having created a successful business and, in a sense, becoming a game changer who has leveled the commercial real estate playing field so tenants are equal with landlords, Rakow also is quick to cite the great satisfaction he derives from devoting his energies to causes that meet the urgent needs of others.

n the early 1980s, Rick Rakow had been a successful direct mail list marketer for an ad agency that handled the IBM Selectric account. But as that typewriter product line faded from the scene, he found himself at a career crossroads. “I wasn’t sure whether I should remain in the same sector or start something different,” Rakow said. Then came a defining moment that would shape his career, as he looked to rent a small office space in Westchester while he explored his options. Rakow’s experience in searching for that space and negotiating the terms of the lease was an eye opener. “At that time, I discovered that a small tenant like me was at the mercy of one of the largest real estate brokerage firms in the country that dominated the market and represented the interests of the landlords,” he said. Coming from a customer-service, entrepreneurial background, Rakow saw an opportunity to fill a gap in the Westchester commercial real estate market by representing the interest of tenants. “Having gone through a negative experience, I felt I could do very well, sensitive to the fact that every tenant rightly feels that their space is the most important regardless of the size,” he said. Rakow seized that opportunity in 1985 when he launched a business that would become one of the region’s largest commercial real estate companies. Marking its 30th anniversary this year, Rakow Commercial Realty Group has assisted more than 1,000 tenants, buyers and sellers in Westchester and Fairfield counties as well as clients across the country and as far away as Vancouver. Under the leadership of Rakow, who serves as president and CEO, the firm leases, buys or sells properties ranging in size from 1,000 square feet to more than 250,000 square feet of office, retail and industrial space. “I am very proud that we have built a profitable and sustainable business, one that today is helping hundreds of tenants every year,” Rakow said. Looking back at how the firm’s approach evolved, Rakow cited the epiphany he had as a young broker. “Basically, it occurred to me that unless special circumstances warranted it, a business owner would prefer remaining in the space instead of going through the trouble of moving to new quarters,” he said. So Rakow developed a model to help tenants remain where they were and to do so at better terms in a new lease that his firm would negotiate. The commercial real estate market has

than 7.5 million pounds of food annually to more than 200,000 people in need in Westchester. “Shockingly, that is nearly one-fifth of the county’s population, which tracks with the alarming numbers of hungry in our country,” Rakow said. “No one should go hungry at night and eradicating hunger needs to get done, which makes supporting the mission of the Food Bank so vitally important.

Ratan, a professor of neurology and neuroscience at the Burke Medical Research Institute and associate dean at the Weill Cornell Medical College, is widely regarded as a leader in cutting edge neurological and rehabilitation medicine. He followed his passion. In 2002, Ratan joined the team at Burke Medical Research Institute, where he has recruited and retained many top-notch scientists. Prior to joining Burke, he set up the Neuroprotection Laboratory in the Department of Neurology and Neuroscience at Harvard Medical School and served as an associate professor at Harvard Medical School. Westmed crosses border into Fairfield County

force in Westchester County medicine — Westmed Medical Group, with 287 physicians in 10 locations — is crossing the border in the company’s first leap into another state. Bronx-based Simone Development Cos. announced the medical group has signed a lease for approximately 13,000 square feet at the developer’s Greenwich development project at 644 W. Putnam Ave., a 36,000-square-foot retail/office/medical building. A second lease at the property — 5,600 square feet for a pediatric practice — was also announced by Simone, bringing the building to 100 percent occupancy. Other tenants at the property include a CVS pharmacy, Greenwich Hospital and Zaniac Prep, an after-school enrichment program. Westmed’s multispecialty group practice will occupy 9,347 square feet on the second floor of the two-story building for medical offices and 3,356 square feet on the ground level for a walk-in medical clinic. Occupancy is slated for this fall. “We are delighted to welcome Westmed Medical Group, the region’s premier medical practice, as our newest tenant at 644 W. Putnam Ave,” said Joseph Simone, president of Simone Development Cos., in a statement. “We are particularly pleased that they have selected this location for their first entry into the Connecticut market. Training offered to boost small businesses

he U.S. Small Business Administration’s New York district is seeking 15 business leaders for an initiative that will provide a three-year, tailored strategic growth plan to help bring the participants’ businesses to the next level. New York was selected this year to be part of the SBA’s Emerging Leaders Initiative, a federal training program that focuses on business executives poised for growth in historically challenged communities. The initiative will provide the participating executives with the organizational framework, resource network and motivation required to build sustainable businesses and promote economic development. The course is free for those accepted. The first class meets April 7, and classes will be held one night a week, every other week through October, from 6 to 9 p.m.

The initiative is targeted for owners or principals of small businesses with annual revenues of at least $400,000, who have been in business for at least three years and have at least one employee other than themselves. Executives must be able to attend 13 evening training sessions and complete required homework, approximately a 100hour commitment. Middletown chef brings his talents on the road “HAVE CHEF’S HAT. WILL TRAVEL.” Middletown’s Steve Schultz did not need to place an ad to become part of a traveling team opening new accounts, mentoring chefs and filling in for absent chefs on behalf of Flik International, a family-owned food service business founded 30 years ago. Schultz came to the position well known in the mid-Hudson Valley as a partner/chef in Inn Credible Caterers, operating the Bear Mountain Inn, Chalet on the Hudson, Inn at Central Valley and nine other locations. Since his affiliation with Flik four years ago, Schultz has traveled to Philadelphia, Texas, Tennessee and Utah on behalf of his employer, not to mention working nearer home in Westchester and New York City. The Flik team serves a variety of clients, ranging from private schools to corporations to conference centers. Schultz presided over the opening of a food service for 3,000 employees at the Tennessee BlueCross BlueShield headquarters. Recently, he was assigned to the world headquarters of one of Flik’s largest accounts, the pharmaceutical giant Merck, in Whitehouse Station, N.J., and now works in its large Rahway facility serving 900 to 1,100 people daily.

Today, Frank Jr. is the general manager and his sister Dina, an attorney, provides legal advice for the company.

Flik has several ground rules for chefs. “Everything is fresh,” Schultz says. “Nothing is frozen except peas, which are seasonal. Our vendor goes to farm markets, purchasing locally. If out of season, it is not served. Eggs are from free-range chickens. Meats are never frozen or from animals given hormones.” Use of leftovers is prohibited. “We do accurate estimates, but err on the side of running out of a food item,” Schultz says. For calorie counters, Schultz puts together a 600-calorie meal with appetizer, choice of soup or salad and hot meal, including two vegetables. “Our menu changes daily at all locations,” Schultz says. “Soups rotate, with three soups offered daily. There are 900 soups in our repertoire.” Schultz points to a school where 900 children are fed a diet inhibiting the obesity prevalent among today’s youths. “An advance menu goes home weekly,” he says. “We make macaroni and cheese with skim milk and low-fat cheese. Omelets are made with low-fat milk. With French toast, we use pure maple syrup — no additives. We even make a low-fat pizza. The goal is to wean students from fatty foods brought from home. Our service is healthier and also more convenient for parents.”

In his present post, Schultz offers specialties for every holiday celebrated by company employees. “We are not set up for kosher cooking, but we do offer favorite ethnic foods on Jewish holidays,” he says. “Merck employees’ heritages span the globe.” Being himself of German heritage, Schultz gloried in Oktoberfest, preparing sauerbraten, weiner schnitzel, sauerkraut and red cabbage. Also observed are such holidays as Easter, Thanksgiving and even Mardi Gras, as well as offbeat days like National Ice Cream Day. Like a sailor going rowing on his day off, Schultz caters private clients on holidays and weekends, contacted through Ssch712003@aol.com. He once worked for Mary Beth Catering, caterer for Caroline Kennedy. “When she became ambassador to Japan, she engaged Mary Beth as personal chef, so the catering business was dissolved” he says. Schultz entered food service at age 15 when his parents dispatched him to work in a restaurant. “The owner offered me a scholarship to the Culinary Institute in Hyde Park, from which I was graduated,” he says. There is one negative to a life of travel, Schultz says. Customers at the former

PPHP NAMES NEW BOARD MEMBERS Planned Parenthood Hudson Peconic (PPHP) of Hawthorne has elected a new chairman of its board of directors, Ann Pogue, and elected four board members: Susan Chatzky, Maria Fidalgo, Pearl Lim and Judith D. Widmann. Most recently, Pogue was the vice chairman of the PPHP board and previously was board secretary. She also served on the executive, fundraising and board development/nominating committees, and chaired PPHP’s Board Diversity Task Force. Pogue has served both nonprofit and for-profit organizations as a marketing consultant, including Nickelodeon, Prime Access Advertising, and American Express. While at J. Walter Thompson advertising
