Overstepping Boundaries

Drainage Superintendent Alleges Assault, Later Recants

In a police report obtained by The Voice, a Town employee has recanted allegations of assault after a confrontation with Fenwick residents who claim he threw himself to the ground.

On September 9 2015, Mike Zimmer, Chief Building Official and Drainage Superintendent for the Town of Pelham, attended a meeting with Fenwick residents informing them that he and several water management engineers would be evaluating drainage on private properties in the area.

Knights of Columbus Bringing Flag Relay to Pelham The Knights of Columbus Flag Relay is used by the Knights to raise public awareness for the Special Olympics Movement. It also offers a way for the Knights, their Squires, and their families and friends to become involved with the program at the local level.

This year, for the first time, the Flag Relay will be coming to Pelham. On April 18th, at 8:30am, the flag will be picked up at St. Alexander’s Church, and taken by motorcycle motorcade to various stops throughout the Region.

EDITORIAL Pro-Community Centre, Anti-Community Centre Process

There are a number of strong arguments to be made for a new community centre in Pelham. As someone who has grown up playing in the small, aging ice rink on Haist Street, I know as well as anyone that this town needs a new facility. I also recognize that our community is growing, and that having adequate recreation facilities is an important part of attracting new residents and providing for those that are already here.

So I agree that Pelham needs a community centre. But I cannot agree with the undemocratic process by which we have arrived at this community centre. And process, especially in the public sector,

is incredibly important.

It is through a clear and transparent process that residents are assured they will be listened to, that their needs will be met, and that their money is being spent wisely.

Meaningful public consultation is one important area where the Town’s community centre process has failed. While other municipalities held

open houses where every resident could offer input on potential functions and design- before the designs were complete- Pelham conducted a random survey from a relatively small sample size. If you weren’t one of those surveyed, or selected to be a member of the Architectural Design Advisory Committee, you ultimately had no say in the largest project this town has ever undertaken. That’s wrong.

The minimization of resident input on the centre has been a disturbing theme over the last year or so. The Town’s refus-

A community centre in itself is not a bad idea. But I have some serious concerns about the Town’s process- concerns that are shared by many, many other residents. Concerns that SHOULD be shared by our Councillors. Elected officials are supposed to tell town Staff what WE want. In Pelham we have it backwards, and Councillors tell residents what Staff want. And they do it on a tight schedule. This is not a healthy process.

And in government, an unhealthy process often leads to an unhealthy result.

Creating a false sense of urgency in order to force Council to rush to a definitive vote by April 25 is equally disturbing.

Residents, media, and Councillors, should have more than a month to review designs, costs, and construction schedules. Heck, the first open house opportunity will be held on the 16th and then Council will vote on the project nine days later! Is that enough time to listen to, and follow up on, residents’ concerns?

I love the neat and tidy pie graph that won't cost us a penny ....... this year but what about next year? And the years after?

A $9.1 million debenture will cost over $310,000 in interest each year; the sale of surplus land could take years so we are carrying all that debt plus utilities and usual upkeep costs with no tax increase? Really, Mayor Augustyn and Councillors - how big do you think that cabbage patch is?! Have you asked your electorate if they are ready to embrace this overwhelming "money pit"??

I believe we, the taxpayers, have a lot of unanswered questions and now we are getting the rush job; a decision of this magnitude should not pushed through without considerable dialog and thought. Yes, we are having an open meeting on April 25 followed immediately by a decision vote! No time for council to digest or, perhaps, even rethink what may have come up - the decision has already been made!

NOT FAIR! Seems the only thinking member, Marv Junkin, is alone in his call for public input - a referendum would provide each of us with a say in how we propose to spend $36.2 million of our money!

Arena Funding Must be Secured Before We Build Council recently received the community centre design, which will be financed for a projected cost of $36.2 million. Though previous reports stated we only needed one rink, those reports were ignored until a design with two ice pads was ultimately approved. Many residents wonder how we will pay for one hockey rink, let alone two. Seniors, who make up the largest portion of the population of Pelham, do not need 2 arenas.

Town staff have presented a variety of financial tools, claiming a modest taxpayer contribution. $12 million will be generated by the sale of surplus land. If the price is $800,000/acre (maximum suggested price), you need to sell 15 acres to generate $12 million, leaving 4.75 acres to build the facility. Can 15 acres be sold at such a high price, and timely enough to generate the necessary funds?

Another large portion of the funding will come from development charges. This will not be instantaneous, as they are collected with the sale of building permits.

How many years will it take to generate this portion of the financing? Remember, development funds are used for roads and services not just recreational facilities.

$3 million is to come from fundraising. Are there people in place to co-ordinate the fundraising? Again, how long will this take?

And finally they plan to put $9 million directly on the backs of the taxpayer. This means that a large portion of the population will be making payments through their taxes for a facility that they do not need or want.

These calculations are for a facility proposed at $36.2 million. We will be committed to this project, only to discover that it is going to cost $6 or $7 million more than planned. Where will this funding come from? Initially council felt we could not do it alone. It was understood that we had to have funding from higher levels of government. Council has now decided that it is important to proceed with this project in spite of the fact that funding is not in place, only projected. It is utterly ridiculous to think that we as a community can do this alone. This project must be postponed until funds are in place- the surplus land sold, the development charges collected, and fundraising completed. It is irresponsible to commit to a project where 75% of the funding is not in place, with no firm timeline to secure it.

Students Raise Pelham High Reunion Big Money for Mental Health

On January 22, comedian Shelley Marshall brought her award winning onewoman show Hold Mommy’s Cigarette to Centennial Secondary School in Welland, in support of mental wellness.

The event was organized in part by members of E.L Crossley’s Mental Wellness group, who helped promote the event through marketing and ticket sales. The goal was to raise $12,000 to help fund mental health and wellness initiatives through organizations within the Niagara community.

Two weeks ago, the group of dedicated students announced that they had exceeded their original goal, raising $12, 375 for three different organizations within the Region The funds were distributed evenly between the Niagara Suicide Prevention Coalition, the Powerhouse Project, and Youth Resources Niagara. Representatives from each organization were on hand to accept the donations, and to give high praise to the students for achieving such an incredible outcome.

“This has a huge impact on your community, and the leadership that you showed in putting something like this together is incredible,” said Mike Taylor of Youth Resources Niagara to the Mental Wellness group. “I’m

awestruck by what you’ve accomplished, and this is certainly beyond our expectations. We were happy to be part of something that was so meaningful to the community, but the success of it was all yours.

Well done.”

“This is a lot of money when it comes to the work that we do and it does go a long way,” added Joanne Bovine of the NSPC. “I hope you guys understand what you accomplished.”

The students were excited to be able to provide such a large donation to organizations focused on Niagara. They explained that they had carefully selected charities where their funds were most needed and would have the greatest impact on the Region.

“We wanted to pick organizations that needed the money and where we knew it would go a long way,” said twelfth grade student Brooke Casey.

“And it’s all in our back yard,” added classmate Amy Nyman. “We gave to the Niagara region.

That was an important part of it for us, because we know that we have the issue here. So we wanted to help people around us, people that we see every day.”

Not only were the students able to raise a great deal of money for local charities, but they also felt

like they learned lessons about cooperation and teamwork.

“Individually we didn’t do a lot, but as a group we accomplished so much,” explained Nyman. It was the little things that every person did that had an impact and became thissomething so much bigger than we ever thought it would be.”

“It didn’t take much to accomplish something so big,” added group member Megan Hall. “With this project we were able to help destigmatize mental illness and make communities more aware of those issues.”

Casey also noted that many of the students found the project to be cathartic: “I think that a lot of us, with ourselves going through mental health problems, and losing fellow students and friends at our school to mental health issues, I think this was something that really helped us grieve and talk about it more. This was very therapeutic for us.”

The 9th Pelham High Reunion will take place on Saturday September 24th, 2016 from 1-5 p.m. at Lipa Park, Oille Road, North Pelham. Registration is $15.00. The three organizations that received funds offer a broad spectrum of direct and indirect programming that looks to address mental health issues within the Region.

The students hope that their actions will inspire others to help raise money and awareness for mental health causes in the future.

NRP HOST FRAUD TALK “Fraud is absolutely 100% on the rise,” said Day. “Technologies like chip cards are helping to decrease certain types of frauds, but overall these crimes are increasing.”

According to Day, this is a result of several factors, including the prevalence of the internet which allows scammers to access greater amounts of data in a multitude of ways.

The internet also eliminates borders, allowing scammers from other countries to defraud Canadians, while simultaneously making it difficult to track those criminals down.

“Anyone can get online to commit crimes and often times it is hard to be detected,” she said.

Day spoke about a number of different types of fraud that occur in Niagara, including identity theft, phone and email scams that claim the victim has won a lottery or inherited some money, and door-to-door scams where criminals try to convince homeowners that they need to replace their roofs/ furnace/ water heater etc. She also spoke of more involved scams, like the ‘emergency’ scam, where victims receive a phone call saying that a loved one is in trouble and that they need money wired to them immediately for doctors, lawyers etc.

Residents need to remain vigilant in order to avoid falling for such scams, said Day, but people can stay safe by following some basic rules. For one, never, ever give out personal information over the phone or through email.

“The government doesn’t need you to give them your information,” she said in reference to a common scam where criminals pretend to be Revenue Canada. “They have it. They know everything about you, and will never ask for that info over the phone.”

Finally, it is always a good idea for a person to slow things down if they are unsure about anything; to take the time to carefully think things over, and ask a relative or trusted friend for advice.

“You do not have to talk to that person right then and there,” she said. “Tell them you’ll call them back, and then consult with a neighbor, or a friend, etc.”

Frazer won by 99 votes, but not before he found himself attacked by his opponent, a cranky Mr. Street, with fervor equalling anything found in the bitterest partisan journals (or on Twitter) today.

A sampling:

So begins an article on the history of Fonthill newspapers published in the Pelham Herald nearly 50 years ago.

It’s almost impossible to imagine a world free from the constant bombardment of media of all types. Even the oldest of us grew up with record players, radio, and at least one television station (if not a television to watch it on).

Newspapers marked the earliest beginnings of the Information Age. By the mid-1800s, their creators were seen as daring risk-takers, akin to the Internet entrepreneurs of the late 20th century.

They were also often partisan activists.

Objectivity in journalism is a recent invention.

For centuries, newspapers mirrored the political, moral, and religious views of their owners.

This is still often the case in Europe.

In the early part of 1854, the demands of an approaching general election prompted the founding of a newspaper in Fonthill to lobby for the Reform movement. The enterprise was conducted by a joint stock company, of which one Dr. Frazer, the Reform candidate, was president. He named the paper the Welland Herald.

Extract the venom from the vilest snake that ever on its belly crawled along the dust; take the quintessence from the juice of all the poisonous herbs …. then mix, and with a quill plucked from the raven’s wing, write against truth and honesty, principle and justice, morality and religion, and if you are equal in virulence and intention [to] the article alluded to, then mustered your heart also, and venom dictate the words, with venom written.

No, we don’t entirely understand it either, but it sounds pretty snarky.

Having won his seat, Frazer sold his newspaper. It changed hands a few more times before being renamed the People’s Press and moved to Welland ―although the

printing plant stayed in Fonthill.

deprivations of this nightmarish time are best left undescribed.

Its new owner was a better journalist than financial manager (not uncommon in this business) and he was soon forced to sell his enterprise to an American named Titus, whose wife did most of the editing, much of which skewed toward the poetic.

After a brief time at the helm, Titus sold out to A.G. Hill, who changed the name of the paper to the Welland Tribune, the title it still bears. Its Fonthill press was shut down in 1865 by yet another owner, one Hosmer L. Stone, who was making his second stab at the news game.

Ten years earlier, in the summer of 1855, Stone and a partner had founded their own small newspaper in Fonthill, the Acorn.

when they entered high school at age 14.

In 1955, Bill Pitkin, Dave Hall, Brian Cupples, Harold Robins and Harold Brant started the Fonthill Minor Baseball League.

To support it they also started the Fonthill Weekly. The paper was composed by the players, run off on a duplicating machine, and enjoyed a circulation of about 300.

Pitkin and Robins partnered with Phil Barteaux four years later to start a new weekly, the Informer. Another original Weekly partner, Dave Hall, bought everyone out shortly later, and renamed the Informer the Pelham Herald.

Even at the tender age of 14, Jim Casson knew that the newspaper business wasn’t his destiny.

“There was no money in it, not really,” recalls the co-founder of the Fonthill Bugle, now 78. “It was too much work—selling ads, writing. Talk about multitasking.”

A visitor to the spacious Casson home in Welland, warmly greeted by Jim and his wife, Noreen, can’t dispute that young Jim made the right choice. Enormous arched windows to the top of a cathedral ceiling provide a panoramic outlook on the Welland Canal, literally in his back yard, mere meters away. The appearance of a butler would not surprise.

Casson’s Niagara roots go deep. He says he’s never lived more than 10 miles from the hospital in Welland where he was born. Only when he retired did the writing itch return, a development that Noreen encouraged as a way to keep Jim from getting underfoot.

In a special broadsheet edition commemorating Canada’s Centennial in 1967, the paper boasted of a “greatly enlarged circulation.”

bant’s other papers were all in the Hamilton area, which proved attractive to advertisers. But the Herald was all on its own in Niagara.

“Because of that, we all had it in the back our minds that this could happen some day,” Cepuch says.

“This” was closure. In December 1996, the Herald became the victim of one-too-many buy-outs as its new conglomerate-owner pulled the plug in favour of consolidating operations at the Welland Tribune, which it also owned.

The good times weren’t to last.

Television continued to erode newspaper circulation into the 1970s, triggering a series of media company mergers and acquisitions that’s still going on nearly five decades later. Brabant was sold and sold again (its current owner is Metroland Media Group, publisher of Niagara This Week).

Yet the thirst for community news, delivered by a truly local newspaper, could not be denied.

Within a matter of weeks, a group of 50 civic-minded citizens banded together, ponied-up $1,000 each, and founded the Voice. Former Herald editor, Carolyn Mullin,

None other than Dave Hall, founder of the Herald in the late 1950s.

Vice President Brian Sullivan wrote in our first issue, “The Voice of Pelham is not just a newspaper, it is the fruit of the community who came together for a common cause. It is the result of friends and neighbours who are persuaded that the Pelham area is unique, that it deserves a voice of its own, and that we as a people will not be influenced or coerced by a corporate decision that immediately and directly affects our community.”

And so it remains today.

“It’s nobody’s damned business what I’m doing at 4:00 in the morning,” he mildly growls, then offers his visitor another chocolate chip cookie.

Meanwhile, back in Fonthill, since the first issue of the Voice hit the streets nearly two decades ago, there’s never been a Mullin far from the scene.

Among memorable Mullins was its beloved founding editor, Carolyn.

She was barely in her 30s in 1997, but in journalism years that’s practically middle-aged--especially at a community paper.

Then there was mom Jeanette, the paper’s first administrative assistant, and its volunteer proofreader for many yars-sorry, years--until she regained her senses in 2010.

Longtime readers will no doubt remember some doozies that made it into print after Jeanette’s eagle eye flew the coop.

Finally there’s dad Allan.

“You want to know what’s really going on in town?” says Carolyn.

“That paper boy knows.”

Allan can still be seen every Wednesday, delivering these inky pages to homes and businesses in downtown Fonthill.

His daughter is a well-remembered dervish from her time editing the last few years of the Pelham Herald, and the first few years of the Voice. In a crowded Fonthill cafe, Carolyn is recognized and greeted every few minutes by yet another patron. At public events, she says, when she pulls out her camera she’s often asked whether the pictures will appear in the next issue.

The problem is, Mullin left the Voice 15 years ago.

Like community newspaper editors everywhere, she was out shooting those pictures and writing her stories seven days a week. It’s the dictionary definition of burn-out, no matter how motivated, young and idealistic an editor may be.

Even with the commute, her time at home increased exponentially.

Since then Mullin has received a Master’s Degree in English from Brock, and is currently a communications officer with Niagara College.

“I find the younger generation knows the headlines, they read Tweets, but they don’t read the substance of a story,” she says.

When asked whether “Citizen Journalism” will ever credibly replace the professional version, Mullin pauses for a moment.

The basic ideal of news reporting—aside from accuracy—is informing readers “about all sides,” Mullin says, adding that she was unfairly perceived by some in her time as too friendly with Town Hall.

Showtime Comedy and Entertainment in St. Catharines had its 100th show celebration this weekend.

Overstepping Boundaries This announcement raised concerns for property owners Ted Bowman and Doug Hargreaves, who have been involved in a decade-long legal battle with the Town over drainage issues. The police report states that the two contacted their lawyer, who instructed them that under the Drainage Act, government officials could inspect drains, but did not have the right to access unrelated portions of their property.

This information was relayed to Zimmer and the engineers when they arrived at a farm belonging to Bowman. “This did not sit well with Zimmer as he believes that the Drainage Act allows him to enter and walk an[sic] any part of any property to complete his duties,” reads the report.

The report further states that while the property owners spoke with the engineers, Zimmer chose to walk off on his own.

The engineers decided to leave and let the lawyers sort it out. The owners then noticed Zimmer was gone and assumed everyone had left the property.

Soon after, Bowman noticed Zimmer walking along the farm where he

had been asked not to go.

They approached Zimmer and confronted him.

Zimmer and the property owners give very different accounts of what happened next.

In his initial report to police dated September 10, 2015, Zimmer states that after explaining he was allowed onto any portion of their property, he was pushed to the ground twice, once by each person. The report states that he then returned to his office and contacted police.

In their interviews, the property owners maintain that they did not touch Zimmer. In their statement, they told Zimmer he was trespassing, at which point Zimmer showed his credentials and stated he could walk where he wanted to. The property owners claim that when Zimmer was again asked to leave, he held up his phone, said he was recording them, and then jumped back and threw himself on the ground: “He takes his camera out, points it at our faces and says ‘I want a picture of this.’ And then he screams ‘Don’t push me!’ and jumps backwards and goes to the ground.”

In the Supplementary Report dated December 10 2015, it is stated that Zimmer recanted when he was interviewed by police. Zimmer instead claimed that the property owners had put their arms up, which caused some contact, at which point he lost his footing and fell.

“Based on his own account of the events, it was clear that he was not assaulted,” reads the report.

It further states that “Although Zimmer believed he could enter and walk wherever he wanted, Bowman acting on advice of his lawyer believed Zimmer was trespassing.”

Zimmer declined to comment on the incident. In an email, Town CAO Darren Ottaway wrote, “Unfortunately we are not at liberty to discuss this with the media as it is a matter that is proceeding toward litigation. The Town does not feel it appropriate, in this or any other subject area that is in litigation, to have the matter tried in the local media or the court of public opinion.”

Local Scouts are challenging the community to look up from their screens, discover someone in need and perform a Good Turn during the 7th annual Scouts Canada Good Turn Week from April 22 - May 1, 2016.

Initiated in 2009 by Scouts Canada, Good Turn Week isn’t just for Scouts; it’s a national movement. Let’s bring it to our community. Simply perform a Good Turn and encourage the recipient to pay it forward to help spark a cycle of goodwill across our community.

Last year from coast-tocoast, a homeless youth shelter in Kelowna, BC got a much-needed facelift; a student in Markham, ON gave blood; kids in need in St. John’s, NF received healthy school lunches and snacks – these are just a few of the countless acts of kindness that took place.
