The officer observed a strong odor of intoxicants coming from the vehicle and an open case of beer in the back seat. The deputy woke the driver and had Buck step out of the vehicle and began field sobriety tests. Buck proved uncooperative during the tests and began walking away. He was then placed under arrest. About the crime stories The crime stories on this page are based on the Probable Cause reports from different law enforcement agencies. session of marijuana, and not wearing a seatbelt. According to the probable cause report filed by the St. Croix Falls Police, Ferngren lit a cigarette as the officer approached the vehicle in an attempt to hide the odor of alcohol. He admitted to coming from a tavern and having “a couple beers, maybe three.” A records check indicated that Ferngren had two prior OWI convictions in Minnesota and was required to have an ignition interlock device in his vehicle. There was no device in the vehicle. During field sobriety tests, Ferngren stumbled to the sidewalk when trying to walk a straight line. During instructions for the second test, he stated that he wanted to “just blow into the PBT (portable breath test),” but kept listening to instructions. After failing to follow the officer’s finger, Ferngren asked if he could “do that test in a bit.” Before the next test, Ferngren stated that he did not want to do the tests anymore. He was asked if he was refusing to do sobriety tests and answered yes. After blowing .14 in the PBT, Ferngren was placed under arrest. While he was being handcuffed, he stated that he had “some weed in the car.” A small plastic box and plastic bag containing marijuana were found in the car. Ferngren consented to a blood draw at St. Croix Regional Medical Center and was transported to the jail afterwards.
