Garbage, climate change blamed for floods

PRESIDENT Marcos on Thursday said irresponsible garbage disposal and climate change were factors in the massive floods in Metro Manila and other regions during the onslaught of Super Typhoon “Carina” and the enhanced southwest monsoon or “habagat.”

He said flood control infrastructures, like the pumping stations in Valenzuela and Navotas, did not work properly as they were clogged with garbage.

“We have a lot of pumping stations but we just encountered a problem. I hope the people will learn. Let’s not throw away our trash carelessly because they are blocking our pumps that’s why they weren’t effective,” Mr. Marcos

A CHINESE Coast Guard (CCG) vessel was spotted “cruising” along the western shoreline of Luzon, first detected near Manila Bay on Thursday morning, and, later the same day,

seen again navigating waters off the coast of Zambales province.

The ship that was able to travel some 92 kilometers within close proximity to the Philippine mainland was identified as CCG vessel 3301, a 3,980-ton Shucha II-class vessel.

One crew member of the MT Terra Nova died when it capsized in Manila Bay, nearly 3.5 nautical miles off Limay in Bataan province as it sailed to the central city of Iloilo.

The vessel went down as heavy rains fuelled by Super Typhoon Carina and the seasonal monsoon or “habagat” lashed Manila and surrounding regions in recent days.

Transportation Secretary Jaime Bautista said the DOTr already contacted ship salvage firm Harbor Star to help assess the situation.

He said 16 of the 17 crew had been rescued from the stricken vessel.

The body of a missing crew member was found in the afternoon after rescuers spent hours searching the rough seas, the coast guard said.

An investigation into the cause of the incident was underway, but Balilo said the vessel had not broken rules on heavy weather sailing.

“The livelihood of our fishermen is dependent on the waters. They don’t have any alternative,” Pando Hicap, chairman of Pamalakaya, told AFP.

Aside from the Guimaras oil spill, one of the worst oil spills in the country happened in February 2023 when a tanker carrying 800,000 litres of industrial fuel oil sank off the central island of Mindoro.

Diesel fuel and thick oil from that vessel contaminated the waters and beaches along the coast of Oriental Mindoro province, devastating the fishing and tourism industries. The oil dispersed over hundreds of kilometers of waters famed for having some of the most diverse marine life in the world.

Padilla asks Tolentino to resign from PDP

JUST days after stepping into his role as the new president of the Partido Demokratikong Pilipino (PDP), Senator Robinhood Padilla asked Senate Majority Leader Francis Tolentino to resign from his position not only as the party’s Vice President for Luzon but also as a member. Tolentino received the resignation call from Padilla after the latter accepted the position of Senate majority leader.

“Because of your new mandate in the Senate, I humbly propose that it would be good if you resign from PDP,” Padilla wrote in his letter to Tolentino.

Padilla said such a move would help avoid questions about their impartiality in political matters.

Tolentino’s departure from the party, Padilla suggested, would enhance PDP’s image of independence. “This would help the party show it is unbiased and independent,” said Padilla, a former actor turned politician.

“Again, I stress I wish for nothing else, but to support your good work and mission,” Padilla told Tolentino. Earlier this week, Padilla took his oath as the party’s president. Tolentino, who is seeking a second term, ran for senator under the PDP-Laban banner. Tolentino previously served as the chairperson of the Metro Manila Development Authority (MMDA) and as the mayor of Tagaytay City before joining the Senate in 2019.

CCG 3301 has been in the West Philippine Sea since July 22, and was last spotted near El Nido, Palawan, the PCG confirmed.

Meanwhile, Senate Majority Leader Francis Tolentino called for transparency in the Philippines-China Ayungin Shoal resupply deal.

He urged the Department of Foreign Affairs to reveal to the public the contents of the provisional agreement recently announced between the Philippines and China for resupply missions to BRP Sierra Madre on Ayungin Shoal.

“I take this opportunity to appeal to DFA Secretary Manalo to publicly disclose the contents of the provisional agreement signed between the Philippines and China,” he said. Tolentino, who also chairs the Special Committee on Philippine Maritime and Admiralty Zones, said while the deal can potentially help de-escalate tensions, the government must also ensure the country’s sovereignty is not compromised.

MMDA chairman Romando Artes lamented that irresponsible garbage disposal clogs canals, drainage systems, and waterways, which, in turn, causes floods.

The MMDA chief urged the public to exercise discipline in managing their trash properly to prevent “a never-ending cycle.”

“The amount of water was not as bad as Ondoy, but the effect was greater than Ondoy. The flood is worse. More areas are submerged with floodwaters compared to the time of Ondoy. But we have more flood control projects now than before,” he said.

At the Upper Chamber, Senate President Francis Escudero expressed disappointment over the Department of Public Works and Highways’ failure to stop waters from rising in Metro Manila despite having a P255 billion budget for flood control projects.

Earlier, the lawmaker criticized the flood control budget as disproportionately large compared to other critical sectors.

“What happened to the hundreds of billions spent on flood control projects by the DPWH, MMDA, and local government units?” Escudero asked.

He said the Senate Committee

on Public Works, chaired by Senator Ramon Revilla Jr., is poised to conduct an inquiry to uncover the reasons behind the inefficacy of the flood control projects despite substantial funding.

“We cannot control the severity and frequency of typhoons and heavy rains, but we must anticipate, adjust, and adapt so that extreme weather phenomena do not unnecessarily disrupt the lives of our [countrymen],” Escudero said.

For his part, Senator JV Ejercito said a comprehensive master plan for infrastructure development must be put in place to prevent massive flooding.

This plan would include high-impact flood mitigation and control projects alongside transportation modernization efforts, he noted. In the aftermath of simultaneous weather disturbances and the accompanying floods, House Deputy Minority Leader and Bagong Henerasyon Rep. Bernadette Herrera called for immediate and comprehensive action to aid

affected communities and ensure swift recovery and rebuilding efforts.

“The destruction caused by Typhoon Carina and the intensified southwest monsoon has left many of our fellow Filipinos in dire situations. Homes have been destroyed, livelihoods disrupted, and lives tragically lost. Now, more than ever, we need to come together as a nation to provide the necessary support and resources to those in need,” she told reporters. Meanwhile, the National Electrification Administration said Thursday 22 electric cooperatives (ECs) from 15 provinces and six regions were affected by “Carina” and the enhanced “habagat.”

Based on the NEA Situational Report, 13 ECs have restored power supply to their consumers while nine are still experiencing partial power interruptions.

It placed the number of consumer connections affected at 114,565, with an initial reported damage cost of P3.142 million.

Authorities uncover scam centers

It started with a raid on a Chinese-run online gambling center north of Manila where hundreds of foreigners and Filipinos were forced to run scams or risk torture.

Then came explosive allegations that the local mayor was involved in the illicit operation -- and that she was a Chinese national masquerading as a Filipina.

The scandal stunned the nation and fuelled calls for the government to ban the online gambling industry over its links to financial scams, kidnapping, prostitution, human trafficking, torture, and murder.

President Ferdinand Marcos Jr. outlawed the sector this week, saying “the grave abuse and disrespect to our system of laws must stop”, and foreign workers involved have been given two months to leave the Philippines.

Authorities believe there could be several hundred illegal online gambling entities -- as well as a good number of the more than 40 licensed operators -- that are running scam centers under the noses of public officials.

Alice Leal Guo, the mayor of Bamban, where the raided scam center was meters from the municipal hall, has been accused of human trafficking and money laundering in relation to the operation.

Guo has been suspended from her job and is in hiding after a warrant was issued for her arrest. She has denied the allegations against her.

“It seems Alice Guo is only the tip of an iceberg,” Senator Risa Hontiveros told a Senate committee investigating the online gambling industry.

“This committee hearing is in the process of uncovering a deep and deadly web of bad actors involving international criminal syndicates, local and national politicians, and perhaps malevolent elements of a foreign state.”

The sprawling Bamban complex, which was operated by Chinese nationals and included office buildings, luxury villas and a large swimming pool, was raided in March after a Vietnamese worker escaped and called police.

More than 700 Filipinos, Chinese, Vietnamese, Malaysians, Taiwanese, Indonesians, and Rwandans were found on site, along with documents allegedly showing that Guo was president of a company that owned the compound.

“She really needs to answer for this in jail,” said Winston Casio, spokesman for the Presidential Anti-Organized Crime Commission (PAOCC).

Scam centers have mushroomed across Southeast Asia, with crime syndicates luring, kidnapping or coercing workers into predatory online activity, and raking in billions of dollars.

Victims have reported travelling across the region, often on the pre-

tence of romance or high-paying jobs but finding themselves forced instead to cajole people into ploughing money into fake investment platforms and other ruses.

In the Philippines, scam centres are often disguised as online gambling operations, which are mostly run by Chinese nationals and target people overseas.

Official figures show more than 60,000 foreigners and Filipinos are working for licenced online gambling companies. Casio estimates as many as 100,000 could be employed by the illegal ones.

They flourished under former president Rodrigo Duterte after the government regulator was given the right to issue operating licences nationwide.

Many lost their licences in 2023 and went underground. Authorities are now racing to shut them all down.

Five have been raided since last year, with several thousand foreigners

repatriated, expelled or charged, Casio told AFP at his office inside one of the scam centres targeted.

Casio said “heads need to roll” among public officials, including mayors and police chiefs, who have allowed the scam centres to operate in plain sight.

“If we don’t start bringing people to court, if we don’t start asking these people to spend time in jail, then we won’t put an end to this problem,” Casio said.

Inside the Bamban compound, victims engaged in online scams under threat of physical harm or other punishment.

Dylan, a Malaysian national in his 20s, worked there for a month after a friend tricked him into visiting the complex. Once inside, Dylan said he wasn’t allowed to leave. He suspects that his friend sold him to the Chinese bosses in exchange for his own freedom. AFP

Solicitor General says EO enough to implement total ban on POGOs

SOLICITOR General Menardo Guevarra maintained that an executive order (EO) is enough to implement the total ban on all Philippine Offshore Gaming Operators (POGOs).

“Under the law, all gaming operations fall under the jurisdiction of PAGCOR (Philippine Amusement and Gaming Corporation), which in turn reports directly to the Office of the President, an executive order or other administrative issuance is sufficient to implement the policy,” Guevarra, quoted by GMA News, said.

The Department of Justice (DOJ) was sought for comment but has yet to give a response.

Guevara said that the ban “is a matter of government policy.”

“It is the president’s determination of what is good for the country after carefully weighing all competing interests,” Guevarra said.

During his third State of the Nation Address, President Ferdinand Marcos Jr. said he is banning all POGOs in the country by the end of the year. The ban came following consecutive raids against illegal POGO hubs leading to the discovery of equipment used for torture, love scams, and other crimes.

The Bureau of Immigration (BI) said foreign workers employed in POGOs will be given two months to exit the country following the ban on these establishments.

BI Commissioner Norman Tansingco also bared that at least 20,000 foreign POGO and IGL employees are expected to leave the country in the next 60 days.

Senator Joel Villanueva said: “The sooner they can leave, the better.”

AboitizPower gives a helping hand to students and teachers returning to the classroom

MOVED by the belief that Filipino students and their teachers should be in a safe and modern learning environment, Aboitiz Power Corporation (AboitizPower) is helping meet the needs of some local public schools across the country.

Since 2010, Visayan Electric Company, Inc. (Visayan Electric), an AboitizPower distribution utility, has embarked on a school rewiring project together with Aboitiz Foundation Inc. to replace outdated electrical wiring systems in public schools within its franchise area. Visayan Electric serves the cities of Cebu, Mandaue, Talisay, and Naga, and the municipalities of Liloan, Consolacion, Minglanilla, and San Fernando.

For over a decade, Visayan Electric’s own engineers have allocated at least two weekends every year to do the rewiring themselves, conforming with industry standards and significantly reducing the risk of fire hazards and electrocution accidents.

To date, a total of 5,311 classrooms and school facilities—equivalent to 146 public elementary and high schools—have been fully rewired to modern standards. The program continues in 2024, with seven schools chosen as beneficiaries.

Supplementing the effort, Visayan Electric also supports the Department of Education’s Brigada Eskwela program, a nationwide initiative to prepare public schools for a new school year, by annually mobilizing its team member volunteers and resources to help repair damaged school facilities, as well as clean and repaint classrooms and common areas.

Like Visayan Electric, Subic EnerZone is also set to elevate its contributions through a Brigada Eskwela Plus! Beyond the usual painting and cleaning initiatives, Subic EnerZone will also check the electrical system and repair the computer laboratory of their adopted school. The Company will also do a workshop on basic electrical information, electrical safety, and energy saving tips.

AboitizPower’s Subic EnerZone operates the distribution systems of the Subic Bay Freeport Zone, covering Zambales and Bataan.

Meanwhile, Hedcor, a renewable energy subsidiary of AboitizPower, also lent its support to the Brigada Eskwela program by financing the repainting and cleaning of classrooms, the repair of desks and chairs, the restoration of facilities, and the enhancement of safety in selected schools within its host communities in the Cordilleras. No rice price increase despite ‘Carina,’ monsoon rains—DA

THE Department of Agriculture (DA)

has said there is no reason for rice retail prices to go up despite the enhanced southwest monsoon and super typhoon Carina.

“There’s no reason to worry that the prices of rice will increase because our harvest is good during the last dry season. We have enough harvest. our importations (of rice) are also on a high level),” DA Assistant Secretary Arnel de Mesa said in an interview.

The price range of local regular-milled rice in Metro Manila remained at P45 to P55 per kilo for well-milled rice as of this week. according to the DA-Bantay Presyo (price watch).

Imported regular-milled rice, meanwhile, ranges from P46 to P52 a kilo, ., and P51 to P53 for imported well-milled rice. De Mesa said the latest import volume of rice hit 2.4 million metric tons (MMT).

As of June 1, the country has an estimated volume of 2.16 million metric tons (MMT) of rice stock inventory, according to the Philippines Statistics Authority (PSA).

The PSA reported earlier that the country had 4.68 MMT of palay (unhusked rice) production for the first quarter of 2024, which was slightly lower than the

THE Civil Service Commission (CSC) reminds heads of government agencies to implement the grant of a five-day special emergency leave to government employees affected by Super Typhoon Carina and the enhanced southwest monsoon or “habagat”.

CSC Commissioner Aileen Lizada said government employees affected by natural calamities or disasters are entitled to a five-day leave under CSC Memorandum Circular numbers 2 and 16, both series of 2012. “MC 16, s. 2012 clarified that special emergency leave under MC Nr. 2, S. 2012 shall be granted to employees affected by natural calamities after Ondoy,” Lizada said. She clarified that the five-day SEL should also be granted based on the declaration of a state of calamity by the President of the Philippines or by the Local Sanggunian as provided by Section 16 of Republic Act No. 10121 or Philippine Disaster Risk Reduction and Management Act of 2010.

NAVOTAS Rep. Toby Tiangco has demanded legal action against a company responsible for damaging the Tangos-Tanza Navigational Gate, emphasizing the urgent need for accountability.

Tiangco said if the flood gate were operational, the city government’s 81 pumping stations would have been able to control flooding.

“In fact, during Ondoy, flooding was controlled even if we only had 24 bombastik stations at that time,” he pointed out.

Tiangco said he is closely coordinating with the Metropolitan Manila Development Authority (MMDA), the agency with jurisdiction over filing a case against the responsible company. He is determined to ensure that the owners of the boat and tugboats

at fault are held accountable.

“We’re studying the legal options available to make those responsible for the damage of the navigational gate accountable,” Tiangco said. The floodgate was damaged following a collision with a vessel, towed by tugboats. This resulted in subsequent flooding in Navotas. Tiangco emphasized that flooding in Navotas has already been managed since the city government built bombastik pumping stations that siphoned water during heavy rains and high tide.

Tiangco also said the local government of Navotas continues to assist in evacuating residents from critical areas to the designated evacuation centers in each barangay. Trucks have been deployed under the city’s Libreng Sakay program, which are plying the C4-Tangos and C4-SRV routes to provide assistance to residents. PNP anti-cybercrime warns vs.

THE Philippine National Police (PNP) Anti-Cybercrime Group has reiterated its warning against scams through dubious phone calls purporting to come from bank employees.

The ACG issued the warning after nine suspects allegedly engaged in ‘vishing’ (voice phishing) scams preying on bank depositors were arrested in Cavite province on Wednesday night.

ACG chief Brig. Gen. Ronnie Cariaga said one of the arrests was made by virtue of search warrants April Joy Espino,34, for violation of Section 4 (b) (2) or Computer-related Fraud under Republic Act No. 10175 or the Cybercrime Prevention Act of 2012.

“In telephone calls, these individuals pretended to be bank employees, deceitfully obtaining money from the victims’ bank accounts,” Cariaga said in a statement.

He said the arrest was implemented after an eight-month investigation, case build-up, and surveillance on the suspects which stemmed from complaints from dozens of victims.

Post Office trucks help in relief, rescue missions

THE Philippine Postal Corp. (Post Office) has deployed its mail delivery trucks to assist in the relief and rescue missions of the Office of Civil Defense (OCD) amid the devastations brought about by Super Typhoon Carina and the enhanced southwest monsoon or habagat.

“As per coordination with the Office of Civil Defense Operations Center, the Post Office has prepositioned mail vehicles at Central Mail Exchange Center (CMEC) to OCD compound, General Headquarter to help in the rescue and relief efforts”, chairman and Postmaster General Mike Planas said in a news release on Thursday.

“Post Office 6-wheeler trucks are already at OCD Response Unit awaiting the release of relief goods from OCD storage site. There is also a standby 10-wheeler truck for possible dispatch in case the OCD needs it,” he said.

Planas directed all area directors nationwide to provide a list of their respective mobility assets which can be made available upon request by OCD.

Pasig bridge hit by barges closed

A BRIDGE in Pasig City was temporarily closed after it was hit on Wednesday by barges being swept by the strong current of the Marikina River brought about by Typhoon Carina and the enhanced southwest monsoon.

“This bridge is scheduled to be rehabilitated or reconstructed because its freeboard is too low. It’s not really designed for the barges to pass through,” Department of Public Works and Highways (DPWH) Secretary Manuel Bonoan told President Ferdinand Marcos Jr. during a situation briefing at the Presidential Security Command on the effects of the typhoon and the monsoon rains. Bonoan said the DPWH has enough funds to reconstruct the damaged Manalo bridge.

“It’s just the matter of going through the design,” he said. In the same briefing, Metropoli -

tan Manila Development Authority (MMDA) acting chairman Romando Artes reported that 13 barges and tugboats were swept by the strong currents on Wednesday.

They are owned by a construction company contracted for a Japan International Cooperation Agency-funded project at the Marikina River.

“We closed it temporarily, in coordination with the Pasig government, because it might not be safe. The current is still strong. We are coordinating with the office of [Transportation] Secretary Jimmy [Bautista] and the Philippine Coast Guard. The barges are still there and cannot be immediately removed because the current is still strong. However, the Coast Guard has already coordinated with some salvage companies to assess how they can be removed,” Bonoan said in Filipino.

Davao region police chief says search for Quiboloy top priority

THE new police chief of the Davao region has declared that he would press the search for televangelist Apollo Quiboloy, saying the manhunt for the pastor was a priority mission assigned to him.

Police Brig. Gen. Nicolas Torre III, in an interview, “there is a national task force involved overseeing the operation, and the situation is still considered complex.”

“It’s just a simple implementation of a warrant of arrest. The court has spoken, and we need to follow it,” Torre said.

He added that they were actively pursuing leads and were still in the process of apprehending the remaining henchmen of Quiboloy.

“It won’t be long now,”

Torre stressed. In an earlier press briefing at Camp Crame following the arrest of Quiboloy’s co-accused identified as Paulene Canada, Torre said there is a commitment order for the detention of the suspect.

“The warrant of arrest was executed by a task force, a collaboration of multiple units. Because the arrest occurred in Region 11 and involved other parts of the task force, we handed her over to the CIDG (Criminal Investigation and Detection Group), who were then responsible for returning her warrant and presenting her to the court,” he added.

Quiboloy and his co-accused are charged with multiple crimes including human trafficking, among other human and labor rights violations.

‘Inaccurate’ interpretation of agreement

EARLY last week, news reports indicated the simmering tension in the West Philippine Sea between the Philippines and China had begun to cool down, in a way, and could eventually lead to a mutual understanding. That was my initial impression after the Department of Foreign Affairs reported the Philippines and China had reached an “understanding” on a “temporary arrangement” for the rotation and resupply (RoRe) missions of daily necessities to the BRP Sierra Madre in Ayungin (Second Thomas) Shoal. Here’s what the DFA actually said: “Both sides continue to recognize the need to deescalate the situation in the South China Sea and manage differences through dialogue and consultation and agree that the agreement will not prejudice each other’s positions in the South China Sea.” Beyond this, however, the DFA was tightlipped on the specifics of the supposed deal. That must have been the diplomatic, or tactful, thing to do so as not to pre-empt what the other side had up their sleeve.

The supposed agreement was reached after a series of consultations following what the two countries described as “frank and constructive discussions” during the 9th Bilateral Consultation Mechanism (BCM) held in Manila on July 2.

The DFA side was led by DFA Undersecretary Ma. Theresa Lazaro while the Chinese were represented by Chinese Vice Foreign Minister Chen Xiaodong.

I have followed the progress of the BCMs since they started in 2017 with no less than then Ambassador Chito Sta. Romana representing the Philippine side. My conclusion is the two sides have never really agreed on anything substantial that would lead to the resolution of issues, if what’s been happening in the West Philippine Sea is any indication.

In practice, the two sides never really publicly discuss the specifics of their supposed agreements.

The communiqués they have issued after each meeting were always couched in diplomatese—“frank and cordial” discussions—they said, with no reference at all to, for instance, any banging on the table amid heated discussions or serious disagreements.

The latest communiqué said in part: “In her comments, Undersecretary Lazaro underscored to her counterpart that the Philippines will be relentless in protecting its interests and upholding its sovereignty, sovereign rights, and jurisdiction in the West Philippine Sea.”

On July 22, however, it appears the Chinese side had issued a statement that did not adhere to what they had agreed upon.

The spokesperson of China’s Ministry of Foreign Affairs claimed the two sides had agreed on the need for prior notification and on-site confirmation before conducting resupply missions in Ayungin (Second Thomas) Shoal.

Our DFA reacted sharply to this: “The spokesperson’s statement … regarding prior

notification and on-site confirmation is inaccurate.”

It was not clear, however, if the provisions cited by the Chinese MFA were part of the conditions under the agreement as both parties have yet to release specifics of the deal.

Responding to inquiries about the agreement, the Chinese MFA, through the Chinese Embassy in Manila, reiterated its “principled” position with three main points, primarily its demand for the Philippines to tow away the rusting warship, which serves as a military outpost in the West Philippine Sea.

“Between now and when the warship is towed away, should the Philippines need to send living necessities to the personnel living on the warship, China is willing to allow it in a humanitarian spirit if the Philippines informs China in advance and after on-site verification is conducted. China will monitor the entire resupply process,” it said.

The Chinese MFA added Beijing would “absolutely” reject and “resolutely stop” any attempt by Manila to send large amounts of construction materials to the warship and build fixed facilities or permanent outposts.

Both sides should strive to de-escalate the situation in the vital sealane and to manage differences in a peaceful manner and to the extent possible

Responding to the “inaccuracy” of the prior notification and on-site confirmation conditions laid down by China, our DFA said: “The principles and approaches laid out in the agreement were reached through a series of careful and meticulous consultations between both sides that paved the way for a convergence of ideas without compromising national positions.”

The DFA also emphasized the agreement was concluded with the clear understanding on both sides it would not prejudice both countries’ respective national positions.

I’m afraid it is the same murky situation in the West Philippine Sea at present from where we sit, despite face-to-face negotiations through 9 BCMs.

But it is entirely correct for the Philippines to continue asserting its rights and jurisdiction in our Exclusive Economic Zone that includes Ayungin Shoal where the BRP Sierra Madre is grounded.

At the same time, however, both sides should also strive to de-escalate the situation in the vital sealane and to manage differences in a peaceful manner and to the extent possible. (Email: ernhil@yahoo.com)

Application for a search warrant

“A SEARCH warrant is an order in writing issued in the name of the People of the Philippines, signed by a judge and directed to a peace officer, commanding him to search for personal property described therein and bring it before the court” (Section 1, Rule 126, Rules of Criminal Procedure). Generally, “[a] search warrant application… [is] filed in the court where criminal proceedings have been instituted. If not yet instituted, the application should be filed in a court with territorial jurisdiction over the place of the crime’s commission or of the warrant’s implementation” (People v. Alagaban, G.R. 244842, January 16, 2023). This requirement pertains to venue and not jurisdiction, “but [is] crucial in the proper issuance of a search warrant.” However, “for compelling reasons… [as an exception, the application shall be filed in] any court within the judicial region where the crime was committed…, or any court within the judicial region where the warrant shall be enforced” (Section 1, Rule 126). “The exception to these venue rules… has been repeated[ly] misuse[d] due to a misinterpretation of the exception’s nature and parameters. While compelling reasons may justify a recourse to the exception, these reasons must be adequately substantiated to prove the application’s sufficiency” (G.R. 244842, Jan. 16, 2023).

In the case of People v. Alagaban, the latter was charged “with illegal possession of seven packets of methamphetamine hydrochloride (locally known as shabu), totaling 11.989 grams in weight” in Legaspi City. His previous arrest was due to the enforcement of a search warrant issued by the

Regional Trial Court of Ligao City. After trial, Alagaban was found guilty of violating Section 11, Article II of Republic Act 9165, or the illegal possession of methamphetamine hydrochloride or shabu.

Since the quantity of the shabu is more than 10 grams, he was sentenced to life imprisonment and fined P500,000.

In an appeal to the Court of Appeals, “he (Alagaban) assailed the search warrant’s validity and the integrity of the prosecution’s evidence.

In granting the appeal, the Supreme Court… acquitted [the accused] because the evidence used to convict him was procured through an invalidly issued search warrant

According to Alagaban, “the warrant was invalidly issued by the Regional Trial Court of Ligao City, while it was implemented in Legazpi City.”

The Court of Appeals affirmed the Regional Trial Court’s Decision and upheld Alagaban’s guilt.

The relief drive designated for the Camanava area, which was delayed because of some “impassable” roads, was set in motion shortly after Malacañang ordered the suspension of work in government offices.

“We were literally stopped in our tracks by the heavy rains and massive flooding from bringing relief goods and other assistance to the victims, especially those in the Camanava area,” PCSO general manager Mel Robles said in an interview.

He added that the PCSO team had already prepared as early as yesterday afternoon with relief goods placed in plastic water pails called “Charitimba” for distribution. According to PCSO, their team will proceed with the distribution of relief goods to-

Secretary Ted Herbosa on Thursday said four regions have been placed under “Code Blue” alert with the onslaught of typhoon Carina and the enhanced Southwest Monsoon or habagat Under Code Blue alert are the National Capital Region (NCR), Central Luzon, Ilocos Region, and Calabarzon.

“We have three regions that have raised code blue alert — Metro Manila regional office, even the hospitals of DOH are considered under blue alert. It also includes Ilocos and Calabarzon,” said Herbosa.

“And Central Luzon is also under Code Blue,” he added.

In a press briefing, Herbosa explained that under this alert level--which is the second highest alert--there is a 50% agency resource mobilization.

He said this means that teams are mobilized to augment existing regular dayto-day resources, and to tend to the affected areas or to treat patients.

He also said the DOH Incident Command System is also activated and a coordinative meeting with health clusters is conducted.

The alert further provides coordination with the National Disaster Risk Reduction and Management Council (NDRRMC).

DOH data showed that as of 12 p.m., Cagayan Valley and Cordillera Administrative Region (CAR) are under Code White alert due to heavy rain, massive flooding and threat of leptospirosis.

The alert refers to the readiness of medical personnel in hospitals and health offices to provide or respond to necessary health services.

In a statement, the DOH said “with the inclement weather and flooding in various areas brought about by the Southwest Monsoon strengthened by Typhoon Carina, the [DOH] has declared a Code White Alert in all its Centers for Health Development (regional offices) nationwide, as well as for the Ministry of Health in the Bangsamoro Autonomous Region in Muslim Mindanao (MOH-BARMM).

THE spotlight returns to the nation’s top junior and emerging tennis talents as they compete for top honors and ranking points in the Rep. Edwin Olivarez National Tennis Championships, kicking off today (Friday, July 26) at the Olivarez Sports Center courts in Sucat, Parañaque.

Over 200 participants are set to compete across nine age categories over the next two weekends. Notable among them is Sandra Bautista, who aims to secure titles in both the girls’ 16-andunder and 18-and-under categories.

IN a crucial game against Cambodia in the 2024 ASEAN U-19 Boys Championship, the Philippines opted to field in a different lineup despite riding on the momentum of a breakthrough 1-0 win against Timor Leste in the previous game.

What could have been a winnable game turned out to be a disaster as the boys yielded an early goal, although a questionable one, in the against the Cambodians. The 11th minute strike eventually proved to be the winning score in Surabaya, Indonesia.

The Philippine side had more than enough time to turn the game around but failed to do so in spite of several narrow misses. Maybe because the

DAVAO—After a challenging Wednesday, where they were shut out of the title race in two age categories, the Davao golfers bounced back with a stellar performance on Thursday, claiming the 13-15 division titles in impressive wire-to-wire fashion at the ICTSI JPGT Mindanao Series I at the Apo Golf and Country Club here.

Johanna Uyking showcased her skill with another three-birdie round, carding a three-over 75 and finishing with a 54-hole total of 227 (79-74-75). She won the girls’ title by a commanding 24 strokes over fellow Davaoeña Merry Rose Wacan, who ended with a total of 251 after an 83.

Jed Santinna Patosa, also from Davao, secured third place with a total of 333 following a round of 113.

“It feels great to win for the first time in JPGT. This victory is significant because all my hard work has paid off,” said Uyking, who will turn 13 this year.

“I expected to win because I had a substantial lead after 36 holes.”

Looking ahead to the Mindanao Series 2 at South Pacific Golf and Leisure Estates next week, Uyking plans to prepare diligently and aims to perform at her best while enjoying the game.

In the boys’ division, AJ Wacan demonstrated his class with a 23-shot victory, finishing with a three-day total of 229 after a remarkable closing round of 74.

Despite slipping with a couple of bogeys on the back nine, Wacan pulled away with a birdie on the 13th and finished strongly, putting him comfortably ahead of his competitors.

Joaquin Pasquil, who was eight strokes behind after 36 holes, ended in second place with a total of 252, while Dexter Eiki rallied with an 83 to claim third place with a total of 262. Santi Asuncion of Taguig, previously in third, fell to fourth with a 267 after a final round of 90.

“I’m thrilled to win for the first time in JPGT. Although there was pressure, I played with relaxation and focus,” said Wacan, 15, who highlighted his round with three birdies, including a 6-footer on No. 9, a 16-footer on No. 13, and another from pin-length distance on the 18th.

“I will work even harder for the upcoming tournaments,” he added, confirming his participation in South Pacific, Del Monte and Cagayan de Oro over the next three weeks.

The victories thus set in motion Uyking and AJ Wacan’s bids in the Match Play Championship, which will bring together the top finishers from the nationwide circuit sponsored by ICTSI aimed at developing young talent in the sport. In the boys’ 16-18 division, local ace Aldrien Gialon edged closer to victory, maintaining consistency with a third straight 78. He surged ahead of South Cotabato’s Rainier Tagwalan by four shots with a total of 234 going into the final round of the premier division of the series organized by Pilipinas Golf Tournaments, Inc.

From Canada to PH: Sanchez ‘is very Filipino’

FOR Kayla Sanchez, a two-time Olympic medalist who previously represented Canada’s national swimming team in the past, going to the Paris Olympics has a special meaning for her.

The 23-year-old Sanchez will now represent not only herself, but her family ties, roots and culture.

“I’m going to represent the flag. It’s going to be special for me,” said Sanchez in an interview with Sports Radio on Radyo Pilipinas 2.

“This is very special for me. Because I’ve grown up very Filipino, attending Filipino parties, having karaoke and eating Filipino ulams,” said Sanchez. Sanchez, who set foot on Paris on Wednesday with her coach Luka Gabrilo, was born in Singapore to Overseas Filipino Worker parents -- father Noel, who came from Mabalacat, Pampanga, and mother Susana, who is from Baguio. When she was two, Sanchez and her family moved to Ontario, Canada.

“They were so happy for me. They’re so proud of me. They’re the ones who encouraged to compete and be my best,” said Sanchez.

Sanchez, who switched nationalities from Canada two years ago, is entered in the women’s 100-meter freestyle and the 100-meter backstroke.

This was after the International Olympic Committee waived the threeyear residency on Sanchez’s nationality switch, paving the way for the former Canadian standout to focus on preparing for the Paris Olympics.

No boxing in ‘28 LA Olympics? That’s a crime, says Aussie icon

PARIS—Australian medallist Harry Garside said on Wednesday it would be “a crime” to drop boxing from the 2028 Olympics, calling it a poor man’s sport that saves lives.

Boxing has been part of every Games since 1920, but faces an uncertain longterm future after its place at the 2028 Los Angeles Olympics was put “on hold” by the International Olympic Committee.

Garside, who won lightweight bronze in Tokyo and is bidding for gold in Paris, said it was more than a sport, with young people’s dreams and aspirations at stake.

“All of our dreams started somewhere, and whether you’re a boxer, whether you’re in other sports, we all love the Olympic movement. That’s why we’re here,” he said.

“To take that away from some young people around the world, it would be a crime, truly.”

The International Boxing Associa-

tion was effectively expelled from the Olympic movement last year following a bitter dispute with its Russian president, Umar Kremlev.

It followed concerns over the credibility of IBA-sanctioned tournaments as well as the boxing governing body’s finances and governance. No other boxing governing body has been recognised by the IOC, which is organising the tournament in Paris but has said it will not be in a position to do so in Los Angeles. Garside, Australia’s first boxing medallist in 33 years, said “politics is politics”, but powerbrokers must think about the consequences.

“To say it may not be in the Olympic Games is obviously terrifying because I think boxing is historically a poor man’s sport,” he said.

“If you look around the world, it’s the Third World countries that do the best. It’s the countries that come from these really rough areas in the world. And they’re the ones that come and win gold medals.

“Boxing deserves to be in the Olympics,” he added. “It has saved many people’s lives, and I’ve seen it save many people’s lives. So I hope it stays.” AFP

Durant ‘feeling good’ as Team USA arrive in France

PARIS—Kevin Durant, who missed all five of

the USA’s warm-up games with a calf strain, practised on Wednesday upon the team’s arrival in France ahead of the defence of their Olympic basketball title.

The Phoenix Suns star, a former NBA MVP and three-time Olympic gold medallist, suffered the injury in June, but coach Steve Kerr has said there was no thought of replacing Durant on the roster.

“The plan is for him to get in the scrimmage and see how he handles that,” Kerr told reporters in Lille after the team held an hourlong practice session.

“He looked good today and he did everything, he got a lot of shots up and told me he’s feeling pretty good.”

Durant, 35, missed the win over Canada earlier this month as well as the two exhibition games in Abu Dhabi. He was deemed not quite ready to return for the two most re-

cent games in London either.

“It starts with the scrimmage tomorrow and we’ll see what the training staff says after that,” Kerr said of the plan for easing Durant back into action.

The Suns and Durant’s representatives will also be involved in any decision-making, Kerr insisted.

“This is not going to be like us going out and saying, ‘Hey, let’s just throw him out there.’”

Gov’t to file insurance claim for flooded schools

The Bureau of the Treasury (BTr) said Thursday it will file a claim under the National Indemnity Insurance Program (NIIP) to cover the damage sustained by 45 public schools across eight regions because of the heavy rainfall induced by Typhoon Carina.

It said the NIIP, which commenced on Jan. 1, 2024, provides comprehensive cover to government assets against fire, lightning, typhoons, floods, earthquakes and volcanic eruptions.

The BTr secured coverage for 132,862 school buildings nationwide, with a total insured value of P 843.11 billion for the pilot run.

The BTr said with costs of damages amounting to at least P308.5 million for public schools, the Department of Education (DepEd) and the Government Service Insurance System (GSIS) are actively coordinating the

filing of insurance claim under the NIIP.

Once a payout is confirmed, the DepEd will be able to utilize the funds for the repair and reconstruction of the schools.

“I commend the Bureau of the Treasury for its proactive steps in implementing the National Indemnity Insurance Program. Protecting our national assets is crucial for ensuring the economic security of our people.

THE Securities and Exchange Commission said Thursday it issued rules for real estate developers offering properties with rental pool agreements.

The agency said in a statement it issued Memorandum Circular No. 12, Series of 2024 on “Securing and Expanding Capital in Real Estate Investment Transactions” (SEC RENT). The move comes amid a rising trend of developers offering potential investment returns and additional income by renting out properties.

SEC RENT outlines guidelines for investment contracts, certificates of participation, profit-sharing agreements and other securities issued by real estate developers or managers in connection with rental pool agreements.

Such agreements are investment contracts where a developer sells or offers units in projects like condominiums, hotels, resorts or dormitories. Buyers contribute the units to a rental pool managed by the company or a third-party operator and receive a share of rental income. These investment contracts are considered securities under Republic Act No. 8799, the Securities Regulation Code, and should be registered with the SEC before public offering. DoubleDragon Corp. and DMC Homes are among the firms offering this type of investment.

FORMER Ilocos Sur Gov. Luis Singson said Thursday he plans to redevelop the 16-hectare Metrowalk Commercial Complex into a “new city within a city.”

Singson, chairman of the LCS Group, told the Manila Standard the company is negotiating with Korean investors to begin work on the project this year.

The plan calls for state-of-the-art office and commercial buildings, hotels and a Korean lifestyle hub, he said.

Singson said he was waiting for the government approval to start the project, which would include a station for the Metro Manila Subway. PSA explains role in birth registrations, limited oversight of local civil registry

THE Philippine Statistics Authority (PSA) on Thursday clarified its role in civil registration and its limited oversight of local civil registry offices (LCROs) amid reports of fraudulent birth registrations nationwide.

“In response to recent developments, the PSA has taken steps to protect and strengthen the civil registration system. We seek support from lawmakers and law enforcement to safeguard this process,” the agency said in a statement.

It said that under Republic Act No. 10625, the Philippine Statistical Act, the PSA is the central repository for all registered vital documents submitted by LCROs. This includes receiving documents related to births,

deaths, and marriages, storing them in a national database, and issuing certified copies. The PSA also provides technical supervision to LCROs as mandated by Act No. 3753, the Law on Registry of Civil Status. This role is limited to setting policies, guidelines, and standards for civil registration nationwide, it said. It said the general administration and supervision of LCROs falls under local government units, headed by their chief executives. These officials have the authority to hire, transfer, discipline or dismiss LCRO employees, including local civil registrars.

The amendments would expand IPOPHL’s enforcement powers, allowing the agency to issue blocking orders, takedown orders and cease-and-desist orders against online platforms and service providers violating IPR. It also seeks to expand the IPR Enforcement Office and IP Academy to strengthen enforcement and educational efforts.

Jollibee raising $111m to acquire Compose Coffee

FASTFOOD chain operator Jollibee Foods Corp. (JFC) said it plans to raise $111 million through bank borrowings to partially finance the acquisition of South Korean coffee chain Compose Coffee.

JFC chief finance officer Richard Shin in a virtual media briefing Thursday the company was in talks with several banks for the planned borrowing.

He said the remaining $128 million would be funded through internallygenerated funds.

Jollibee reported early this month it would acquire a 70-percent interest in Compose Coffee for $238 million as part of the global expansion of its coffee and tea businesses.

Jollibee Foods’ majority-owned Titan Fund and private-equity firm Elevation will assume the remaining 5 percent and 25 percent, respectively. Shin said the company would aggressively expand Compose Coffee in South Korea, given the huge growth potential in the East Asian country.

Compose Coffee has 8-percent market share in South Korea with 2,600 stores. Its Americano coffee is priced at 1,500 won.

“We are very focused on Korea for at least the next five years,” Shin said when asked if JFC planned to bring Compose Coffee to the Philippines and other Southeast Asian countries.

“We would like to take market share growth in Korea. That will be a better return on shareholders because it is quite lucrative and profitable,” Shin said.

Manila Water immediately implemented its emergency response programs during the onslaught of Super Typhoon Carina and the southwest monsoon, recognizing the vital role of water in disaster response and recovery.

Manila Water has positioned 30 water tankers in evacuation centers in Metro Manila and Rizal Province, serving over 40,000 displaced individuals since July 24.

These water tankers address the water supply needs of the evacuees for drinking, bathing, and other hygiene-related activities.

Santa Cruz Solar is a special purpose vehicle for the development of renewable energy projects in the Philippines.

THE Philippines recorded a surge in demand for fresh Norwegian salmon, according to May 2024 data from the Norwegian Seafood Council in Bangkok.

The country’s market growth of over 169 percent was the second highest in the ASEAN region, with a robust annual average growth rate from 2020 to 2023.

“There is much potential for Norwegian salmon and other high quality Norwegian seafood in the Phil-

“This bill would protect farmers, fisherfolks, as well as livestock, and poultry raisers from the menace of agricultural smuggling, as well as its perpetrators such as cartels, saboteurs, and smugglers. We just want to know,” said Briones.

Senators approved Senate Bill No. (SBN) 2432 or the AntiAgricultural Economic Sabotage Bill in December 2023, which repeals Republic Act No. 10845, otherwise known as the AntiAgricultural Smuggling Act of 2016.

The President saw the need to immediately pass the measure by certifying it as urgent in his SONA 2022, citing the rising prices of agricultural products caused by hoarding, smuggling, and other illegal activities. Under the bill, the crime of agricultural smuggling as economic sabotage is committed when the value of each, or a combination of agricultural and fishery products smuggled by a person is at least P3 million using the daily price index computed at the time the crime was committed.

NFA bares P5-b investment for post-harvest tech, equipment

THE National Food Authority (NFA) announced a P5-billion investment strategy to improve postharvest technology and equipment in the Philippines.

“Future investments of the NFA will be geared towards postharvest. For this year, we have P5 billion to retrofit or construct warehouses. Next year, we’ll bring in the dryers and milling facilities. Hopefully, these can be completed within two years’ time,” said NFA administrator Larry Lacson.

Lacson assured farmers during a three-day visit to Davao by the NFA Council that the government will start prioritizing post-harvest programs to reduce crop losses and improve farmers’ income.

National Economic Development Authority undersecretary Rosemarie Edillon, who joined the council in Davao, said the visit provided NFA council members better appreciation of the impact of their decisions to farmers’ lives and better insights for future policy formulations.

“This was very useful because it gave us an idea of how it is happening on ground, what the concerns of the farmers are, and also to see the current state of NFA facilities,” she said.

THE National Telecommunications Commission (NTC) on Thursday asked telecom companies to immediately repair and restore services disrupted during the onslaught of Typhoon Carina and the southwest monsoon.

The NTC issued a memorandum directing all telcos to ensure that there are sufficient number of technical and support personnel, standby generators, tools and spare equipment in the areas affected by the monsoons rain and fast track the repair and restoration of telecommunications services in those areas.

It said telcos reported that there were mobile and broadband service disruptions in some areas affected by the typhoon primarily due to power outages.

Flooding in many areas made restoration activities more challenging as some roads were impassable.

“Nonetheless, round-the-clock restoration efforts are continuously being undertaken by the PTEs, including deployment of power generator sets until such time that commercial power is re-established, which will then hopefully restore regular telecommunications services within 24 to 48 hours,” the NTC said.

Globe Telecom said it started restoration work in a few areas in Metro Manila and Northern Luzon affected by service disruptions due to commercial power failure.

THE Philippines is poised for a railway renaissance with big ticket projects currently in progress that are expected to reduce traffic congestion in Metro Manila.

President Ferdinand Marcos Jr., in his third State of the Nation Address (SONA), declared the country in the midst of a “railway renaissance” aimed at easing the notorious traffic congestion in Metro Manila.

The Department of Transportation is spearheading this initiative, with 23 of its 69 infrastructure projects focused on railway improvements and expansions.

Five of these projects, including the North-South Commuter Railway, Metro Manila Subway, LRT Line 1 Cavite Extension, MRT Line 7 and MRT Line 3 rehabilitation are under construction.

Transportation Secretary Jaime Bautista said these railway projects are seen to solve the country’s traffic woes once all these rail lines are simultaneously operating.

He said the North-South Commuter Railway (NSCR) System can service at least a million passengers, while the MRT-3 line can carry 500,000 passengers daily.

The Metro Manila Subway can accommodate 519,000 passengers daily, with the MRT-7 and LRT-1 Cavite Extension Project expected to fetch 800,000 passengers and 300,000 passengers respectively.

NLEX Corporation has launched a new program called Barangay Responders and Advocates of Violence-free Environment (BRAVE) to equip young women with the skills to become disaster and emergency responders in their communities.

The program aims to harness the unique qualities of women – adaptability, sensitivity, and compassion – to effectively manage crisis situations.

NSCR is one of the key projects that would help decongest Metro Manila roads.

A flagship project under the “Build Better More” program, it is a mega railway network spanning 148 km., with 37 stations and 464 train cars and encompassing three segments―the PNR Clark Phase 1 (Tutuban-Malolos), PNR Clark Phase 2 (Malolos-Clark) and PNR Calamba (Solis-Calamba).

The mass transport project will run across 26 cities and municipalities in Central Luzon, National Capital Region and Calabarzon.

GRAB Philippines said it implemented safety measures across all its services in response to the severe weather conditions and widespread flooding affecting Metro Manila.

“At Grab Philippines, the safety and well-being of our community, including our consumers, rider-partners, driver-partners, delivery-partners, and financial service users, are our top priority,” the company said.

Amid challenges such as road closures, flooding, and heavy rainfall, Grab requested for the patience and understanding of its consumers as there may be some booking difficulties and delays – particularly in the areas severely affected by the weather.

WITH ‘90s fashion making a comeback, the trend of wide pants has recently been taking the world by storm. From light denim cowboy pants for casual wear to black chino pants for the office, the wide pants trend has been growing in popularity among fashion enthusiasts as well as those looking for a simple and functional yet stylish look.

Celebrity stylists Cath Sobrevega and John Lozano have been incorporating these pieces into the stylish outfits that they curate for their clients. During a recent style talk hosted by clothing brand Uniqlo, the pair gave tips about how one can boost their outfit for the day with their comfortable wide pants.

Sobrevega pointed out that the wide pants have been a staple in one’s closet since it first became a trend in the 1920s.

“Wide pants can be flattering for all body types. It elongates the legs and they create a balance well. They’re flattering and comfortable,” she said.

As versatile pieces, Sobrevaga said that wide pants can be used for work, travel, and even casual days. A pair of pleated wide pants can be matched with a blouse or a top with a blazer for a comfortable day at the office. Denim pleated jeans, wide chino pants, and

wide straight jeans can be mixed and matched with loose tops, sweaters, and jackets while traveling through any type of weather. For casual wear, wide straight jeans, wide straight cargo pants, and dry sweat wide pants can be paired with a sleeveless top or even a jacket.

Lozano also shared that there can be many creative ways in styling one’s wide pants but the main things to remember boil down to three: proportion, illusion, and silhouette.

The passion for music continues with the app’s growing number of listeners. “We are still excited to share the music that we genuinely love. Ron and I have been together for over 30 years, and it’s no longer a job for us, this is something we love,” Robert Crespo said.
