THE Commission on Human Rights on Thursday lauded government’s efforts to rehabilitate the San Juan River through the Metropolitan Manila Development Authority’s (MMDA) neighborhood upgrading program.
“The Commission recognizes various national and local government agencies, particularly the MMDA, for taking the initiative to develop this San Juan River rehabilitation program,” the CHR said in a statement.

WE’VE been tracking the progress in upgrading our rail system as a key component of reliable mass transport in Metro Manila.
In a previous column, we lamented report that some barangay officials in the city seemed to be deliberately defying President Marcos Jr.’s order for local governments to support the right-of-way requirements of the country’s flagship rail transportation project.
But here’s the good news: It looks like the mayor of a city in Metro Manila did not take things sitting down and decided to show barangay captains who is the real boss in that local government unit.
It appears that there’s ongoing dialogue between government functionaries and informal settler families from this Metro Manila city who will be affected by the construction of the North South Commuter Railways (NSCR).
The said mega-project is the 147-kilometer railway system which will connect Calamba City in the South and the New Clark City in the north.
Using modern, high-speed trains, the NSCR will pass through several key areas in Metro Manila which used to be traversed by the antiquated trains of the PNR.
The PNR has already suspended the service of the section passing through Metro Manila so that construction of the NSCR in the NCR can now shift to high gear.
That was when reports came out that the project may be stalled because some barangay officials allegedly refused to allow inter-agency teams of the government to enter areas under their jurisdiction.
The teams were supposed to conduct surveys to determine the location and number of illegal structures that may have to give way to the project, and to determine who will qualify for the resettlement program prepared by the government.
These teams were supposed to conduct public information campaigns on the NSCR and to listen to the side of the affected informal settlers.
Hence, since the government teams were allegedly refused access to the area by some barangay officials, the preparatory work for the clearing of the right-of-way could not be done.
There were also reports that the construction crews of the private contractors were also barred by some barangay officials from doing work in their area despite possessing the necessary permits.
Worse, some barangay officials reportedly told the inter-agency teams their refusal to allow entry into their areas was based on instructions by a congressman.
Given that situation, it looked like chances were bleak that the NSCR project would take off and be completed on time.
But we were pleasantly surprised when representatives of barangays whose chairmen figured prominently in the reported blocking of the government inter-agency teams and construction crews attended a recent meeting to thresh out contentious issues.
Our sources say the change of heart on the part of the barangay execs came about after they were summoned to the office of the LGU head and were told to stop blocking the activities of the NSCR project teams.
We salute this particular mayor and all the other LGU heads backing the NSCR project. No, we are not happy that the barangay execs involved had to go through the embarrassing experience.
The NSCR should not suffer any more delays if we are to free ourselves from the scourge of horrible traffic jams in Metro Manila
What we are happy about is that the project—which has entered a critical phase—can now proceed at full throttle.
We are also happy for the informal settlers who now have the chance to make a new start in life in the resettlement areas that national government agencies have prepared for them.
We are also happy that the lead agency, the Department of Transportation, did its best to mobilize support from various sectors, particularly local government units.
The NSCR project has shown to all that if our country is to succeed in its bid to provide us with modern infrastructure, all sectors—including LGUs—have to come in and help.
National government-LGU collaboration especially in the NCR becomes more urgent in view of reports that some 13,000 illegal structures along the NSCR right-of-way may have to be demolished.
It will take time to dismantle these obstacles.
There will be further delays if the owners of the illegal structures put up stiff resistance and are aided by barangay officials in their areas.
The inter-agency team for the NSCR said the government is strictly following the procedures for the dismantling of these illegal structures.
This is good news for the affected informal settlers.
We hope they cooperate with these procedures.

The grace period given to owners and drivers of small e-vehicles is a step in the right direction as it would give them enough time to review their daily operations and find new routes that would allow them to earn their keep without violating the new rules.
At the same time, the MMDA should assist them in adjusting to the new regulations.

While critics may see this as another policy that discriminates against the poor who have no other means to provide for their families, it is a temporary measure that serves to alleviate traffic build-up.

The US Supreme Court will hear arguments Thursday on whether Donald Trump, as a former president, should be immune from criminal prosecution for acts he committed while in office.
The ruling could have far-reaching implications for the extent of US executive power -- and Trump’s multiple legal issues as he seeks the White House again.
And while most constitutional law experts expect Trump to suffer a legal defeat, he may already have scored a political victory.
By taking the case, the court’s nine justices delayed -- perhaps indefinitely -- the start of Trump’s trial on charges of conspiring to overturn the results of the 2020 election won by Joe Biden.
The question of whether an ex-president is immune from prosecution is an untested one in American jurisprudence because, until Trump, no former White House occupant had been charged with a crime.
“Famously, Richard Nixon engaged in
criminal law-breaking,” said James Sample, a constitutional law professor at Hofstra University.
“But because he resigned, and (successor) Gerald Ford then pardoned him, we have never had to squarely address the notion of a criminal prosecution against a former president.”
Special Counsel Jack Smith filed the election conspiracy case against 77-yearold Trump in August and had pushed for a March trial start date.
But the Republican presidential candidate’s lawyers filed a blizzard of motions seeking to postpone the case against him, including the claim that an ex-president enjoys “absolute immunity.”
Two lower courts flatly rejected that argument but the Supreme Court agreed in February to hear the case.
One lower court ruled Trump’s immunity claim is “unsupported by precedent” or the US Constitution.
“We cannot accept that the office of the Presidency places its former occupants above the law for all time thereafter,” the judges said.

PARIS – The new US package of $61 billion in aid for Ukraine will not bring the warbattered country out of the woods, according to the Kiel Institute, which has been tracking the help provided by Kyiv’s allies.
“This is sorely needed support, but in the grand scheme of things it is not a game changer and will only provide temporary relief,” said Christoph Trebesch, head of the Ukraine Support Tracker at the German think tank, which published its latest update Thursday.
“Should the US pass no further support packages in late 2024 or 2025, Ukraine is very likely to face the same gap in support in 2025,” he said.
During months of blockage of the package in the US Congress, Ukrainian forces have run short of ammunition and have suffered battlefield setbacks. By Feb. 29, the European Union, other members of the NATO alliance and countries such as Australia and Japan had come up with 112 billion euros ($120 billion) in military aid to Ukraine since the
Russian invasion of February 24, 2022, according to the Kiel Institute’s update -- compiled before the latest US aid was unblocked.
The European Union and its member states have pledged 52.4 billion euros, but over a period of several years.

THE National Economic and Development Authority (NEDA) said Thursday that rice imports are still necessary to ensure the country’s food security.

Balisacan said in a statement that the landed cost of imported rice (5% broken) in 2024 remained stable at about P39 per kilogram but is still 27% to 29% higher than last year. “As landed cost includes tariffs and other fees, carefully adjusting tariff rates temporarily, while world prices are increasing, could help stabilize rice prices in the country,” Balisacan said.
“Despite an expected 0.7-percent increase in local rice production this year, domestic output will still fall 15 percent short of demand,” he said.
The Philippines has been facing agricultural supply challenges, which have worsened due to global disruptions and domestic policy coordination issues, resulting in higher inflation, particularly for food.
Balisacan said the Inter-Agency Committee on Inflation and Market Outlook (IAC-IMO) recommended to President Ferdinand Marcos Jr. the issuance of Administrative Order (AO) No. 20, series of 2024, to enhance the country’s agricultural importation policy regime by streamlining administrative processes and removing non-tariff barriers.
“Failing to augment local production during shortages exacerbates food insecurity and perpetuates poverty,” he said. “High food prices disproportionately affect the poor and contribute to hunger, malnutrition, and stunting, hindering development goals,” he said.
TOURISM revenues in the Philippines jumped 38.28 percent in the first quarter of 2024 to P157.82 billion from P113.98 billion in the same period last year, the Department of Tourism said Thursday.
The DOT also estimated that the sector already achieved a recovery rate of 120.70 percent from the prepandemic receipts of P130.59 billion in the same period in 2019.
DOT Secretary Christina Garcia Frasco said international visitor arrivals hit 2,010,522 as of April 24, 2024, representing a 15.1 percent increase from 1,746,630 arrivals recorded in the same period in 2023.
“The DOT sees a positive trajectory for the country’s international tourist arrivals this year. We are hopeful that with more investments in tourism infrastructure, as well as muchneeded increase in connectivity and improvements in air, land, and sea infrastructure and accessibility, the numbers can further increase,” Frasco said. International visitors accounted for 94.21 percent, or 1,894,076 of the

SEVERAL cryptocurrency traders have transferred their funds from Binance to other apps following the Securities on Exchange Commission’s crackdown on unregistered exchanges, according to an industry expert.
Arlone Abello, the founding chairman of the Innovative Movement of the Philippine Association of Crypto Traders (IMPACT) and the chief executive of Global Miranda Miner Group, said the SEC’s decision to block Filipino investors’ access to Binance had a chilling effect on unregistered exchanges in the country and their users. The SEC said Binance, being an
unregistered company with the agency, violates Republic Act No. 8799 or The Securities Regulation Code (SRC) for the sale or offer of unregistered securities to Filipinos.
“We have noticed that cryptocurrency traders are becoming more aware of the need to comply with regulations to preserve access to their funds. There is a growing acceptance that crypto exchanges will need to register with the government going forward. Thailand’s recent decision to ban unregistered crypto exchanges is creating a trend in Southeast Asia of regulators taking action against unauthorized exchanges,”
Abello said. “In response to the Philippine SEC’s move, some traders are transferring funds to other regulated Philippine crypto exchanges like PDAX and Coins.ph that allows converting fiat to crypto,” he said.
Abello confirmed that others were continuing to use unregistered exchanges that have not been explicitly called out by the SEC. “This suggests the Philippine SEC’s action is more about requiring registration like the US SEC has done with Binance and other exchanges, rather than an outright crypto exchange clampdown,” he said.

SAN Miguel Corporation (SMC) said Thursday it expects to complete the expansion of the South Luzon Expressway by December 2024, just in time for the holiday season. The project, which is about 70-percent complete, would boost the economic prospects of the CALABARZON region and provide significant benefits for motorists, it said.
It said the ongoing SLEX expansion project, led by SMC SLEX Inc., involves widening the expressway from three to four lanes to six lanes on each side. This is expected to dramatically improve traffic flow and enhance connectivity between southern and northern Luzon.

GLOBAL commodity prices are leveling off after a steep descent that played a decisive role in whittling down overall inflation last year, which could make it harder for central banks to cut interest rates quickly, according to the World Bank’s latest Commodity Markets Outlook. The report also finds that a major outbreak of conflict in the Middle East could halt the inflationary decline that has occurred over the past two years.
It said that between mid-2022 and mid-2023, global commodity prices plummeted by nearly 40 percent, helping drive most of the roughly 2-percentage-point reduction in global inflation between 2022 and 2023.
It said that since mid-2023, however, the World Bank’s index of commodity prices has remained essentially unchanged.
“Global inflation remains undefeated,” said Indermit Gill, the World Bank Group’s chief economist and senior vice president. “A key force for disinflation—falling commodity prices—has essentially hit a wall. That means interest rates could remain higher than currently expected this year and next. The world is at a vulnerable moment: a major energy shock could undermine much of the progress in reducing inflation over the past two years,” Gill said.
THE Department of Energy (DOE) said Thursday said at least 4,164.92 megawatts (MW) of power projects will come online this year to augment the country’s energy infrastructure and bolster the power supply and stability of the grid. It said about 161.20 MW of these committed projects are now in full commercial operation, while 835.888 MW are under the testing and commissioning stage. These power projects represent a mix of both renewable and conventional sources. Baseload plants will comprise around 678.06 MW, while mid-merit plants
will total 1,320 MW. Peaking plants will comprise 2,164.92 MW.
The DOE said of the expected capacity, 4,030 MW are in Luzon, 80.25 MW in the Visayas and 52.50 MW in Mindanao.
Around 1,224.655 MW will operate in the second quarter, 1,352.167 MW in the third quarter and 1,571.154 MW in the fourth quarter.
Among the committed capacities are the 4x150-MW Mariveles Coal-Fired Power Plant (600 MW) with Unit 1 already under commercial operation, while the remaining three units are under testing and commissioning and are expected to be on full commercial operations by the third quarter.

Ayala expects to keep growth despite high interest rates
PROPERTY developer Ayala Land Inc. is optimistic on sustaining its growth momentum this year despite the high-interest-rate environment as it shifts its focus on developing more upscale residential and mall projects.
ALI president Anna Ma. Margarita Dy said during the company’s annual stockholders meeting Thursday the current environment is affecting demand for housing projects catering to the middle-income group, the group’s core residential market.
Dy said ALI is now planning to launch more premium residential projects, given the market situation.
She said 80 percent of launches for 2024 would be upscale projects as this segment remained resilient despite high interest rates.
ALI reported plans to launch P100 billion worth of projects and spend P100 billion for 2024 capital expenditures.
Dy said ALI’s projects for the middle-market are on push-button mode, are ready for launching once interest rates start to ease.
“Current higher interest rate is affecting demand in the mid-market, our core residential market Avida and Amaya brands. The sentiment there is improving, and we expect a boost when interest rates improve,” Dy said.
Dy said the group was expected to sustain its growth momentum this year despite market situation.
“In 2023, our performance was good with 18 percent growth in revenues and 32 percent in net income after tax. We expect this growth to continue, and our planning parameters do not include boost from lower interest rates,” Dy said.

The Philippine peso tumbled to 57.78 a dollar from 57.55 on Wednesday, with analysts pointing to the general strength of the greenback on expectation the Fed would delay its interest rate cuts.
The Bangko Sentral ng Pilipinas earlier also said that the peso’s recent decline was due to the strength of the dollar amid expectations that the US Federal Reserve will not be cutting interest rates anytime soon.
Last week, Fed Chairman Jerome Powell said persistently elevated inflation will probably delay any Fed interest rate cuts until later this year.
“If higher inflation does persist,” he said, “we can maintain the current level of [interest rates] for as long as needed.”

P25-m worth of banned Flava vape products
AUTHORITIES confiscated P25 million worth of banned vape products under the Flava brand for being distributed near a school and for containing flavor descriptors that could appeal to minors.
The Department of Trade and Industry’s Fair Trade Enforcement Bureau (DTI-FTEB) and the Philippine National Police shut down a store selling the banned Flava vape products near Baclaran Elementary School in Paranaque City on April 23, 2024.
DTI-FTEB Director Fhillip Sawali said the joint operation netted 452 boxes or 45,200 units of illegal vape products with an estimated value of P25 million. The store, located just 20 meters from the school, violated Republic Act No. 11900, or the Vaporized Nicotine and NonNicotine Products Regulation Act of 2022.
The law prohibits the sale of vapes or e-cigarettes “within 100 meters of any point of the perimeter of a school, playground or other facility frequented particularly by minors.”
Before the raid, the DTI-FTEB had already ordered the suspension of the sale, manufacturing, import, and distribution of Flava Corporation’s vape products on March 15, citing violations of RA 11900.

Business process outsourcing (BPO) companies drove the growth in leased spaces and accounted for 68.9 percent in the first quarter of 2024, while corporate occupiers represented 31.1 percent.
Metro Manila registered 97,000 sq. m. of leased spaces in the first quarter, with BPOs accounting for the biggest share of the pie. The growth was tempered by an increase in released spaces.
ALL 17 regions in the Philippines expanded in 2023, with Central Visayas leading the pack at 7.2-percent growth, the Philippine Statistics Authority (PSA) said Thursday.
Western Visayas followed closely at 7.2 percent, while the Ilocos Region came in third at 7.0 percent. These top three regions outperformed the national growth rate of 5.5 percent last year.
Five other regions exceeded the national average: the Cordillera Administrative Region (CAR) at 6.9 percent, Davao Region at 6.7 percent, Eastern Visayas at 6.4 percent, Cagayan Valley at 6.2 percent and Central Luzon at 6.1 percent.
Data from the PSA showed the gross domestic product (GDP) grew 5.5 percent in 2023, a slowdown from the 7.6-percent expansion in 2022.
All 16 major industries recorded positive growth.
The strongest growth came from the accommodation and food service activities sector (23.2 percent), followed by other services (20.8 percent) and transportation and storage (13.0 percent).
The National Capital Region (NCR) held the biggest share of the services sector at 41.4 percent, followed by CALABARZON (10.8 percent) and Central Luzon (8.3 percent). The PSA said that in terms of contribution by region to total industry, CALABARZON led at 25.0 percent, followed by NCR (18.6 percent) and Central Luzon (16.0 percent).
Surveys shows Filipinos prefer cage-free eggs as customer values evolve
A NATIONWIDE survey conducted by GMO Research, a leading Asian consumer research agency, reported a significant shift in Filipino consumer preferences towards cage-free eggs.
The survey results showed that 83 percent of Filipino consumers believe restaurants, supermarkets and food companies should source their eggs from cage-free production farms. This indicates a strong desire for ethical treatment of egg-laying hens.
The survey disclosed that 80 percent of Filipinos are more likely to patronize brands that prioritize cagefree eggs. This highlights the growing importance of ethical sourcing practices in the food industry.
It also underscored the increasing concern for animal welfare among Filipino consumers.
The survey also found a high level of acceptance for a potential price increase associated with cage-free eggs. Nearly 90 percent of respondents acknowledged the potential benefits of cage-free eggs in terms of food safety, indicating a willingness to pay a slight premium for the perceived advantages.

THE Philippines’ participation in Asia Dive Expo (ADEX) Singapore, known as Asia’s largest and longestrunning dive expo, generated P197.2 million in combined negotiated sales leads and actual bookings during a three-day business-to-consumer session. This marked a more than 300-percent increase from last year’s negotiated sales leads.
The Philippines was also named the Sustainable Dive Destination of the Year in recognition of its commitment to environmental conservation and sustainable practices in dive tourism.
“This recognition, alongside our long list of accolades celebrating the beauty of our nation, underscores our steadfast commitment to sustainable tourism practices,” said Tourism Promotions Board (TPB) chief operating officer Maria Margarita Montemayor Nograles.
“Participation in trade fairs like ADEX provides us a platform to promote the Philippines’ diverse tourism products and experiences. Moving forward, we will continue to work hand in hand with local communities and dive operators to ensure sustainable practices are followed so that our country’s
treasures will still be enjoyed by future generations in the years to come,” Nograles said. The Philippine pavilion utilized a 90-square-meter booth space to feature some of the country’s finest dive sites such as the UNESCO World Heritage Site of Tubbataha Reefs Natural Park in Palawan, the famed sardine run of Moalboal in Cebu and the marine and natural park of Apo Reef in Mindoro. The Philippine delegation, led by the TPB, was composed of 16 exhibitors from the dive industry, accommodation and tour operators.

A cornerstone investor is an investor who agrees in advance to subscribe in an upcoming IPO. Such investor is usually brought into the IPO process before the formal bookbuilding process starts and is guaranteed allocation at the final offer price. The SEC said in a statement Thursday it issued Memorandum Circular No. 8, Series of 2024, requiring companies that plan to go public to include in their IPO registration statements the cornerstone investment agreements they have entered into. The agreement should include the allocation guaranteed to a cornerstone investor, which should be signed on or prior to the pricing event of the IPO. It requires the cornerstone investor to firmly commit to purchase the shares, provided that the final offer price falls within the preferred range as agreed upon. The issuer should also disclose in its final prospectus certain details about its cornerstone investors, including the number of participating cornerstone investors and their respective profile descriptions; the number and type of securities proposed to be issued or offered to such investors;
MPTC commits to barrier-free expressways as early as end-2025
METRO Pacific Tollways Corp. (MPTC) said it will implement barrier-less toll systems across all its expressways in Luzon, aligning with the government’s goal.
“MPTC is already in the implementation mode of our Barrier-Free program,” Roberto Bontia, MPTC chief transformation officer said.
“Since 2023, MPTC has organized several dedicated project teams to ensure that motorists are on RFID already, back office systems are robust and seamless, and the our support personnel are as customer-centric to deliver excellent service to the motoring public,” Bontia said.
He said a three-year timeline would be needed to implement the barrier-free program for all its concessions in Luzon.
Bontia said the implementation will be undertaken in “phases” where North Luzon Expressway, Subic Clark-Tarlac Expressway and NLEX Connector Road will be the first expressways to complete the rollout by end 2025.
“CALAX and CAVITEX are foreseen to go-live by end 2026,” he added.
Once barrier less is implemented, Bontia said the typical congestion being experienced by customers at the toll plazas in expressways would be eliminated.
“These seamless passages will likewise improve the overall safety of both customers and personnel operating the expressways,” he added.
Bonita said studies have likewise confirmed that “barrier-free” setups at tolling points in expressways reduce carbon emissions by as much as 30 percent, contributing to environmental sustainability.

THE Philippines is gearing up for a smoother and faster driving experience with the planned implementation of barrier-less toll booths in all Luzon expressways by 2026, according to the Toll Regulatory Board (TRB).
Alvin Carullo, executive director of TRB, said the Barrier-less Tollway Project is the third of the technologydriven projects to be implemented by the agency.
“For this project, alongside the advancement of technology being utilized, a regulatory regime visà-vis updating of existing policies in road transportation shall by duly formulated. This is to shape up the toll road user’s behavior to become a responsible RFID/ETC subscriber,”
Carullo said.
“Once policies are in place, it can be assured that there will be no, or at least minimal, toll evasion scenarios,” he said.
Carullo said that for the Tollway Operators and Concessionaires’ readiness, this is not a one-shot deal.
He said the program is designed to be implemented in phases to provide smooth transition of policies and
technology and avoid motorists’ birth pains.
“Phase 1 is scheduled to be implemented in November 2024. In this Phase, only the Toll Barrier at the Entry will be removed, and all the exit lanes will still maintain barriers,” Carullo said.
“The succeeding phases wherein all the exit barriers will be removed is initially scheduled in 2025 to 2026,” he said.
No more stopping
According to Carullo, the benefit of having a barrier-less toll road is that there will be no more stopping at tollgates, thereby improving the flow of traffic, eliminating choke points and bottlenecks and increasing the throughput of tollways. With the electronic toll collection/ radio frequency identification at present, the system can transact one vehicle passage within five seconds.
That is equivalent to 900 vehicles per hour.
Once the barrier less is implemented, Carullo said these toll lanes will be almost free flowing, and the stop- and-go motion will be eliminated. Thus, it will significantly increase the throughput per toll lane.
The TRB chief said, however, the agency is carefully looking into the possible impact of the barrier-less project to the toll rates.
“It is worth noting that implementing a more advanced technology will mean putting additional capital expenditure and the Tollway Concessionaires/Operators may propose a recovery mechanism for the said undertaking,” Carullo said.
“In this case, the TRB, being the regulatory agency for toll roads, will have to review all these costs and shall ensure that whatever recovery mechanism will be proposed, the interests of all stakeholders should be protected, particularly the motoring public,” he said.
Challenges
Carullo said the potential challenge of transitioning into a barrier-less toll system is mostly focused on the driver’s behavior, particularly
on becoming a responsible account holder vis-à-vis the enforcement.
“Since there will be no more barriers, every toll lane will be free flowing, in this case, if there is an errant motorist who intends to use the toll road with insufficient load, with no load, or worst case, without RFID, they can do so,” he said.
“The DOTr [Department of Transportation], LTO [Land Transportation Office] and TRB have already seen these possible scenarios and shall devise measures to minimize such occurrence,” Carullo said.
He said the government in coordination with the tollway concessionaires/operators, would devise a mechanism to apprehend errant motorists through the use of Automatic License Plate Recognition (ALPR).
“The LTO will play a significant participation in this endeavor since they are the authority in plate issuance, vehicle registration, as well as the enforcement of R.A. No. 4136,” Carullo said. Republic Act No. 4136, or the Land Transportation and Traffic Code, serves as the manual for anything that to do with traffic management, road safety and land transport in general.
