GOVERNMENT agents on Thursday intercepted a Canadian drug mule who was caught with a baggage containing shabu worth more than P48 million at the Ninoy Aquino International Airport.
A composite team from the Bureau of Customs, Philippine Drug Enforcement Agency and NAIA Inter-Agency Drug Interdiction Task Group arrested the suspect Mary Jane Marais who tried to smuggle the seven kilos of shabu “concealed as Truffle Chocolate Balls inside her checkin baggage.”
Port of NAIA officials said the illegal drugs came from Mexico, and arrived at NAIA Terminal 1 from Narita via Japan Airline Flight No. JAL741.
The passenger's check-in baggage underwent rigorous screening, including Xray scanning, K9 inspection, and physical examination resulting in the discovery of 7,150 grams of shabu with an estimated value of P48.6 million.

THE Philippine government will likely downgrade its alert level status on Myanmar, in the process allowing overseas Filipino workers (OFWs) to go back to the strife-torn country, the Department of Foreign Affairs (DFA) said Thursday.
DFA Undersecretary for Migrant Workers Affairs Eduardo de Vega said he was set to meet on Saturday with OFWs in Yangon who have sought a downgrading of the alert level status there.

“There is the likelihood that the alert level will be lowered? There’s a good chance, but I won’t make any guarantees. But I think that if we see that the condition, the situation there is good, there is a possibility that we can lower the alert level, De Vega said. He noted that the OFWs who have valid working visas for Myanmar may be allowed to return once the alert level is downgraded.
“Pag...ma-lower, ibig sabihin, balik manggagawa maaari. Yung mga nandoon na, na may working visa na sa Myanmar, papayagan na ng ating pamahalaan na makabalik, hindi na sila banned na pumunta doon,” he explained.

A SOUTH Korean national wanted in his home country has been ordered to leave by the Bureau of Immigration (BI).
The South Korean was identified as Choi Sunghee, 38, who departed the country last June 20 on board a Jeju Air flight bound for Incheon.
Commissioner Norman Tansingco said the Korean authorities informed the BI about Choi who was said to have set up illegal gambling websites that enticed users to bet on domestic and foreign sports.
He reportedly mustered more than KRW (won) 16 billion from the website’s members. South Korean law states that no person, other than the Seoul Olympic Sports Promotion Foundation or an authorized entity, may issue sports betting tickets or similar things to win at betting.
Violators are punishable by imprisonment with labor for not more than seven years or face a fine not exceeding 70 million won.

THE Philippine Institute of Volcanology and Seismology (Phivolcs) on Thursday said the lava flow in Mayon Volcano, Albay lava had cascaded down the slopes by about two kilometers from crater.

The moderate emission of plumes from the volcano reached as high as 1,000 meters, drifting to west-northwest, northnorthwest, and northeast directions, the Phivolcs said.
“Alert Level 3 is maintained over Mayon Volcano, which means that it is currently in a relatively high level of unrest as magma is at the crater and hazardous eruption within weeks or even days is possible,” the Phivolcs bulletin stated.
THE Philippine coast guard said Thursday it would end a week-long search for six missing crew members of a fishing boat that sank in bad weather in the country’s eastern waters.
The Genesis 2 sank 337 kilometers (209 miles) east of the southern island of Mindanao on June 22. Fourteen crew members were rescued and the bodies of three others were recovered, said local coast guard official Lieutenant Junior Grade Elmar Mesina.
“There’s only a low possibility of locating more survivors,” said Mesina, the coast guard station chief in Davao Oriental province, when asked by AFP if the six were presumed dead.
The coast guard’s head office in Manila announced Thursday that it had recommended to its commander to “terminate” the search.
It quoted the rescued crew members
as saying the six men, including the captain, might have been trapped inside the vessel, which sank amid big waves in an area where the seafloor was about 1,500 meters (5,000 feet) deep.
The PCG deployed the BRP Tubbataha (MRRV-4401) to respond to a maritime incident involving a F/B Genesis 2 that sank last June 22.
The survivors recalled that they encountered a sudden change in sea conditions at around 12 midnight, causing their fishing boat to sink an hour later.
Based on the crew manifest, F/B Genesis 2 had 23 crewmembers at the time of the accident.
A coast guard patrol vessel left the area on Wednesday after conducting the search, Mesina said.

“It is therefore recommended that the 6-km radius permanent danger zone (PDZ) be evacuated due to the danger of PDCs, lava flows, rockfalls, and other volcanic hazards,” it said.
Phivolcs said there was a total of 296 rockfall events, seven dome-collapse pyroclastic density current (PDCs) events, and two lava front collapse pyroclastic density current events over Mayon Volcano.
Salceda feared that heavier rainfall “could exacerbate risks in Mayon, and will force us to evacuate communities in near lahar channels, in addition to the ones already in danger zones.”
Salceda, chair of the House committee on ways and means, was reacting to projections by the Philippine Atmospheric, Geophysical, and Astronomical Services Administration (PAGASA) that three to four cyclones were likely to hit the country in July.
Thus, Salceda said, “we respectfully request President Marcos’s continued support for Albay, and we thank him for the unwavering help he has already provided us.”
“In July, the average rainfall in Albay was expected to be 155.2mm, and 112.53mm for the rest of the year with about 38 percent more rains. And, if the PAGASA projection takes place, we could see more. That compounds the risks Mayon poses,” Salceda said.
He added that “although, we might not need to evacuate those near lahar channels but are outside the designated 6-, 7-, or 8-kilometer danger zones for long periods, we might need to bring them to safety when a storm is impending, or there is heavy rain.”
“So, really what we are looking at is extended evacuation for those in danger zones, and intermittent evacuations for those in lahar channels during heavy rain. We will really need help,” he added.

A FREAK explosion at a shopping mall in Calapan City Thursday morning left 15 people seriously injured, police said.
In a statement released, Region IV-B (MIMAROPA) police chief Brig. Gen. Joel Doria said four restaurant employees, one delivery boy, and 10 other unidentified victims were hurt in the blast which happened at around 10:20 a.m.
The explosion at the restaurant, which was located on the first floor of the Xentro Mall also damaged 12 vehicles parked nearby.
Calapan City administrator Raymund Ussam said in an interview with CNN Philippines they were monitor-
ing the conditions of the victims who were sent to three different hospitals. No deaths have been reported so far.
Authorities were still investigating, but Ussam said initial findings indicate gas leak as the possible cause of the explosion.
“Initial findings showed an alleged gas leak in the area of the Korean restaurant.” Ussam said.
“An LPG pipe was seen in the area, it might be the cause.” he added
“The ceiling collapsed but the structure was not totally damaged.” Ussam said.
At least 15 people were injured in an explosion due to a suspected gas leak

Twelve vehicles sustained varying degrees of damage from the blast.
In response, Doria said immediate action was taken by activating the Incident Command Post (ICP) in coor-
dination with the Bureau of Fire and Protection (BFP) and the Calapan City Disaster Risk Reduction and Management Office.
Doria assured the public that they are working closely with the BFP to facilitate a thorough investigation of the incident.

PRESIDENT Ferdinand Marcos Jr. on Thursday called on the Philippine Coconut Authority (PCA) to step up its modernization efforts and invest in new technologies to ensure the resilience of the coconut sector.
Speaking during the PCA’s 50th anniversary celebration at the Coconut Palace in Pasay City, Mr. Marcos said the Philippines, as a major exporter of coconut products, is now in a prime position to harness the advantage of developing the industry for the benefit of the economy and the Filipino people.

PCA to continue to uplift the lives of the coconut farmers, empower them to improve their conditions, and free them from poverty.

PRESIDENT Ferdinand R. Marcos Jr. vowed to address the perennial problems of illegal recruitment and human trafficking that plague the Filipino workforce, Malacañang said Thursday.
Mr. Marcos made the commitment when the International Labor Organization (ILO) officials led by ILO Director General Gilbert Houngbo paid him a courtesy visit at Malacañan Palace in Manila on Tuesday, the Presidential Communications Office (PCO) said.
“That’s a big problem for us here in the Philippines. Illegal recruitment and really, you take it a little further, it becomes human trafficking. And we seem to have become a
target for many of these unscrupulous activities,” the President, as quoted by the PCO, told the ILO executives.
Mr. Marcos lamented that human trafficking is plaguing Southeast Asian countries such as the Philippines, Indonesia and Vietnam.
He said he is working with Department of Migrant Workers Secretary Susan Ople to maintain the Philippines’ “Tier 1” status against human trafficking.
The Philippines has maintained its “Tier 1” ranking for the eighth straight year, according to the 2023 Trafficking in Persons Report released by the United States State Department earlier this month.
A BILL was filed at the House of Representatives which proposes that liquefied petroleum gas (LPG), instant noodles, potable water in containers, and kerosene be included in the list of basic necessities as defined under the law to protect consumers from unwarranted price increases of these goods, especially during times of calamities.
House Bill (HB) 7977, authored by Reps. Brian Yamsuan of Bicol Saro partylist group and Luis Raymund Villafuerte of Camarines Sur amends Republic Act 7581 or the Price Act to include these four items in the list of basic necessities covered by the regular monitoring of the Price Coordinating Council (PCC).
“The Price Act is due for an update. The Act has not included ‘new’ goods that by virtue of their mass and necessary usage, qualify as basic necessities,” Yamsuan and Villa-
fuerte said in their bill’s explanatory note.
HB 7977 also provides a mechanism for greater flexibility in including or excluding types and brands of goods in the list of basic necessities or prime commodities.
Enacted into law in 1992, the Price Act ensures fair pricing and availability of basic necessities and prime commodities, especially during times of calamities and emergencies. This law also outlines the responsibilities of government agencies in monitoring prices and ensures a just return on investment for legitimate businesses.
Under the Price Act, the inclusion or exclusion of goods in the list of basic necessities and prime commodities can be done upon the petition of concerned parties. HB 7977 amends this provision by also allowing the inclusion or exclusion of goods through motu proprio action of the concerned agencies of the PCC.
Tier 1 means a country is fully compliant with the minimum standards for the elimination of severe forms of trafficking in persons, while Tier 2 classifies a country that is not fully compliant but making “significant efforts” to adhere to the minimum standards.
Tier 3 means a country fails to comply and to make “significant efforts” to meet the minimum standards.
Houngbo said the Philippines could serve as a “model” as it has taken steps to address several issues hounding the labor sector, including human trafficking.
The President also briefed the ILO officials about his administration’s consul-
tations with labor stakeholders to “strike a balance and alleviate the ‘inflationary pressures’ on workers.”
He noted that minimum wage earners may enjoy an increase in their salaries to protect them from rapid industrialization and expansion of the economy.
“When there is rapid industrialization and rapid expansion of the economy, there is a tendency to leave the labor sector behind and just exploit the labor sector,” Marcos said. “But I think our negotiations with workers, with the unions, with the different negotiations, we will be able to come to a good working number, a good compromise.”
SENATE President Migz Zubiri said he is a pro-gun legislator “as long as documentations are OK.”
Zubiri also said he makes “it a point that I don’t show my firearms in public.”
He issued the statement when sought for his comment about Sen. Robin Padilla showing off his collection of guns on his Facebook page which went viral. But Zubiri said he respects Padilla whom he tagged as “a shooter.”

“INTERVENTION is a proceeding in a suit or action by which a third person is permitted by the court to make himself a party, either joining plaintiff in claiming what is sought by the complaint, or uniting with defendant in resisting the claims of plaintiff, or demanding something adversely to both of them” (Garcia, et al., v. David, et al, G.R. 45454, April 12, 1939).
“[It] is the act or proceeding by which a third person becomes a party in a suit pending between others;… [a] person becomes a party [with leave of court] for the protection of some right or interest alleged…” (Garcia, et al., v. David, et al, G.R. 45454, April 12, 1939 citing 33 C. J. 477).
The leave can be availed of by filing a motion attaching the complaint-in-intervention or answer-in-intervention.
“Fundamentally, therefore, intervention is never an independent action, but is ancillary and supplemental to the existing litigation. Its purpose is not to obstruct nor unnecessarily delay the… machinery of trial, but merely to afford one not an original party… the opportunity to appear and be joined so he could assert or protect such right or interest” (Garcia, et al., v. David, et al, G.R. 45454, April 12, 1939).
The Philippine Rules on Intervention finds its roots in the Code of Civil Procedure of the State of California. The three important elements, as paraphrased, are: that only a person having a legal interest in the subject matter of the litigation or in the success of either of the parties or an interest against both, may intervene;
(2)that a mere intruder or stranger may not be allowed to intervene; and
(3)that a judge is given the full measure of discretion in permitting or disallowing the motion for intervention (Garcia, et al., v. David, et al, G.R. 45454, April 12, 1939).
The court when faced with a motion for intervention ‘shall consider whether or not the intervention will unduly delay or prejudice the adjudication of the rights of the original parties, and whether or not the intervenor’s rights may be [more] fully protected in a separate proceeding’
“What qualifies a person to intervene is his or her possession of a legal interest in the matter in litigation or in the success of either of the parties, or an interest against both; or when he or she is so situated as to be adversely affected by a distribution or other disposition of property in the custody of the court or an officer thereof” (Republic v. Rubin, G.R. 213960, October 07, 2020).
“[T]he Court has ruled that such interest must be of a direct and immediate character so that the intervenor will either gain or lose by the direct legal operation of the judgment. The interest must be actual and material… more than mere curiosity, or academic or sentimental desire; it must not be indirect and contingent, indirect and remote, conjectural, consequential or collateral” (G.R. 213960, October 07, 2020).
The court when faced with a motion for intervention “shall consider whether or not the intervention will unduly delay or prejudice the adjudication of the rights of the original parties, and whether or not the intervenor’s rights may be [more] fully protected in a separate proceeding” (Section 1, Rule 19, 2019 Rules of Civil Procedure).
The motion to intervene may be filed at any time before the rendition of judgment by the trial court (Section 2, Rule 19).
“After the lapse of this period, it will not be warranted anymore… [since] intervention is not an independent action but is ancillary and supplemental to an existing litigation” (Ongco v. Dalisay, G.R. 190810, July 18, 2012).
“It can be readily seen that intervention is not a matter of right, but is left to the trial court’s sound discretion. The trial court must not only determine if the requisite legal interest is present, but also take into consideration the delay and the consequent prejudice to the original parties that
the intervention will cause” (G.R. 190810, July 18, 2012).
“Both requirements must concur, as the first requirement on legal interest is not more important than the second requirement that no delay and prejudice should result. To help ensure that delay does not result from the granting of a motion to intervene, the Rules also explicitly say that intervention may be allowed only before rendition of judgment by the trial court” (G.R. 190810, July 18, 2012).
“There is wisdom in strictly enforcing the period set by Rule 19 of the Rules of Court for the filing of a motion for intervention. Otherwise, undue delay would result from many belated filings of motions for intervention after judgment has already been rendered, because a reassessment of claims would have to be done” (G.R. 190810, July 18, 2012).
In the case of Ongco v. Dalisay, Valeriana Ungco Dalisay (Dalisay) applied for the registration of a parcel of land by filing an Application for Land Registration before the Municipal Trial Court (MTC) of Binangonan. At the hearings, no oppositor aside from the Republic of the Philippines (the Republic) came (G.R. 190810, July 18, 2012).
There being no oppositor, an Order of General Default was issued against the whole world except the Republic.
Consequently, the court found Dalisay to have clearly shown a registrable right over the subject property and ordered that a decree of registration be issued by the Land Registration Authority once the Decision had become final.
The Republic filed an appeal with the Court of Appeals. While the case was pending appeal, Lorenza C. Ongco (Ongco) filed a Motion for Leave to Intervene with an attached Answer-in-Intervention which sought the dismissal of Dalisay’s Application for Land Registration on the grounds that the subject property was not free from any adverse claim.
The Court of Appeals denied the intervention since it was filed after the judgment was rendered in the trial court and when the appeal was pending with it.
Moreover, Ongco is not an indispensable party since her interests are inchoate and merely collateral, as she is only in the process of applying for a free patent (G.R. 190810, July 18, 2012).
“Also, the action for land registration may proceed… without joining her. This is because the issues to be threshed out in a land registration proceeding — such as whether the subject land is alienable and disposable land of the public domain; and whether the applicant… [has] been in open, continuous, exclusive and notorious possession of the said land… — can be threshed out without joining petitioner” (G.R. 190810, July 18, 2012).
“In any case, we note that petitioner (Ongco) is not left without any remedy in case respondent (Dalisay) succeeds in getting a decree of registration. The person may file, in the proper court, a petition for reopening and reviewing the decree of registration (obtained by actual fraud) within one year from the date of entry thereof (G.R. 190810, July 18, 2012 citing Section 32 of Presidential Decree 1529).
In the case of Looyuko, et al. v. Court of Appeals, et al., the Manila Regional Trial Court issued a writ of execution in an action for judicial foreclosure.
Subsequently, the deputy sheriff sold in a public bidding the parcel of land covered by TCT 1702 to FGU with a certificate of sale which was later confirmed by the RTC (G.R. 102696, July 12, 2001).
The RTC issued an order for the cancellation of TCT 242 and for the issuance of a new TCT in FGU’s name.
Before the new TCT could be issued, the Spouses Gutang filed a motion for intervention and to set aside the judgment of the RTC, alleging that they are the new registered owners of the property (G.R. 102696, July 12, 2001).
In an Order, the RTC allowed the motion for intervention, holding the failure of FGU to implead the Spouses in the action for foreclosure deprived the latter of due process. Later, Looyuko et al. filed a motion for intervention, which the RTC granted (G.R. 102696, July 12, 2001).
The Supreme Court ruled that a motion for intervention should be made “before or during a trial” or can be filed any time before the rendition of judgment.
“[T]he motions for intervention were filed after judgment had already been rendered… [and] when the case was already final and executory… [this] can no longer be allowed in a case already terminated by final judgment” (G.R. 102696, July 12, 2001).
That was the main point of National Treasurer Rosalia de Leon when she appeared before a media forum recently. She gave assurances that the MIF, which is our version of what’s called a Sovereign Wealth Fund in other countries, has ample safeguards or safety nets to ensure proper and transparent utilization and prevent mismanagement.
First of all, she pointed out, Congress will have oversight functions over the MIF, which will eventually become the Maharlika Investment Corporation or MIC.
The MIF will have both internal and external auditors who will submit regular reports its financial performance.

try’s social protection institutions such as GSIS, SSS, Pag-IBIG and PhilHealth will be prohibited from investing in the fund, a provision clearly stipulated in the version recently passed by the Senate.
The National Treasurer also pointed out that government financial institutions (GFIs) in the country have ample resources to support the MIF. She said Landbank and the Development Bank of the Philippines each have investible funds.
Landbank, owned by the government, has P1.3 trillion in investible funds, but will infuse only P50 billion into the MIF, or roughly three percent.
The DBP, on the other hand, has P850 billion in investible funds, but will put in just P25 billion into the MIF.
To the argument raised by critics that the MIF should consist solely of surplus funds, de Leon noted that even countries with no current account surplus such as Indonesia, India and Vietnam, have established their own sovereign wealth funds to support their priority development projects.
She cited the case of Indonesia which also has its sovereign wealth fund, the Indonesia Investment Authority (INA).
Indonesia, like the Philippines, she said, is also operating on a fiscal deficit.
But the government contributed $2 billion to set up the INA and also transferred assets worth $3 billion.
So, even while they have a fiscal deficit, they still went ahead and provided capital for the INA.
The MIF will be used to invest in a wide range of assets, including foreign currencies, fixed-income instruments, domestic and foreign corporate bonds, commercial real estate and infrastructure projects.
And just as important, it is fully aligned with the Medium-Term Fiscal Framework and 8-point Socio-Economic Agenda of the Marcos administration that envisions sustained economic growth in the years ahead.
IS THE plan of the Metro Manila Development Authority to appeal the Supreme Court decision suspending the No-Contact Apprehension Policy (NCAP) valid?
The MMDA claims that from an average of 9,514 traffic violations, the figure rose to 22,736 in September last year and skyrocketed to 32,739 as of May this year.
Disregarding traffic signs made up a huge chunk of traffic infractions with over 24,000, followed by 5,500 violations of the number coding scheme, 2,088 for improper loading and unloading, 682 for road obstructions, 56 violations of the dress code for public utility vehicle drivers, and illegal parking.
At first glance, the MMDA plan to appeal the NCAP suspension is fundamentally sound.
After all, the NCAP was implemented precisely to instill discipline among motorists and reduce traffic violations to a minimum.
But the traffic management system using CCTV cameras and advanced technology to record and process road violations without human intervention has been heavily criticized for being too oppressive. The cities that implemented the NCAP before the SC suspension were Manila, Quezon City, Parañaque, Valenzuela, Muntinlupa City, and Marikina.
We must raise questions on the MMDA methodology in data gathering.
How did they gather the data?
Is the three-fold increase in traffic violations monitored only from those covered by NCAP areas, or the entire Metro Manila area?
If the violations took place only in NCAP-covered areas, did the agency deploy traffic enforcers there or not?
They should have done so, to make motorists aware that they are being monitored.
What are the MMDA traffic enforcers doing in the meantime that the NCAP is suspended?
Have they been laid idle and not deployed in NCAP areas as they should?
Shouldn’t the MMDA have hired more traffic enforcers to keep traffic violations to a minimum?
The MMDA and LGUs claim the NCAP is beneficial as it compels motorists to strictly observe traffic rules.
Besides, since it eliminates direct contact between traffic enforcers and motorists, it can also prevent bribery. While the NCAP has a grievance mechanism that allows motorists to contest the mailed notice of traffic violation via an adjudication system, this involves the inconvenience of personally going to the Traffic Management Office of LGUs or the MMDA and waiting in line to be able to talk to them or to file a counter-affidavit.
But we’ve heard more than enough horror stories regarding NCAP implementation.
A taxi operator complained on TV news that she had been slapped with fines reaching P1 million for supposed traffic violations of her taxi drivers.
Another complained that he was slapped with a P2,000 fine after his car’s front wheels managed to touch the white painted lines of a pedestrian crossing in an intersection, after he stopped to give way to an emergency vehicle.

Masda, Alliance of Concerted Transport Organizations, and Altodap, have filed a 47-page petition before the Supreme Court asking it to declare the NCAP as unconstitutional.
The transport groups argued that motorists were “under constant threat of being arbitrarily apprehended remotely and issued notices of violation for alleged traffic offenses committed without any contact whatsoever.”
The NCAP, insists a lawyer who had been told to pay thousands of pesos in fines and penalties because traffic authorities sent the notice of violation to a wrong address, violates a person’s right to due process.
Albay Rep. Joey Salceda has also weighed in on this issue and described the scheme as “oppressive.”
Even the Department of Transportation (DOTr) and the Land Transportation Franchising and Regulatory Board (LTFRB) asked the MMDA to suspend the NCAP for public utility vehicles (PUVs).
The two agencies said this would ensure that PUVs will be able to accommodate passengers amid the surge both in traffic volume and passengers in Metro Manila because of the resumption of face-to-face classes.
Many netizens are also up in arms against the traffic scheme and urging LGUs to install 21st century digital traffic lights with the minutes remaining for green lights to turn to amber and red instead of the old ones with no such numbers.

Outside of natural disasters, power outages are scheduled only for the periodic maintenance of the distribution system.

Treñas has repeatedly commended MORE Power for its role in the city’s progress.
How was Castro able to achieve all that for MORE Power?
Under Castro’s management, MORE Power embarked on a five-year modernization program costing about P1.9-billion. The modernization program consisted of the rehabilitation and addition of substations, and the replacement of aging poles, transformers and electric meters, among others, throughout Iloilo City. Included in the program was the installation of automatic circuit reclosers at strategic points in the power distribution system in order to stabilize the supply of electricity in the city.
In addition, MORE Power built a switching station in La Paz, Iloilo City to connect the city’s power distribution grid directly to the National Grid Corporation of the Philippines. This reduces, if not prevents, unscheduled power outages in the city.
The old traffic lights, they said, stack the cards against motorists and allow the government to demand hefty fines from them without due process. You can contest the violation but you have to go through a lot of inconvenience going to City Hall, lining up for hours so that you can explain yourself before traffic authorities.
Many, I think, simply cough up the fines imposed so they can avoid all the hassle.
It’s not surprising therefore that there is now a growing clamor from various quarters for NCAP’s suspension.
I’ve said this before and it bears repeating: The NCAP is a trap that amounts to institutional extortion.
It should be declared unconstitutional by the High Tribunal.

KRAMATORSK, Ukraine—The toll from a Russian missile strike on a restaurant in eastern Ukraine rose to 12 dead and at least 60 wounded on Thursday morning, including children, as the Kremlin insisted Russian forces only hit military-linked targets.
The latest tragedy came as US President Joe Biden denounced Vladimir Putin as a “pariah” while German Chancellor Olaf Scholz said the Russian president had been weakened by mercenary group Wagner’s aborted rebellion.
Ukrainian President Volodymyr Zelensky meanwhile called the Kramatorsk strike a “terrorist attack” and in his Wednesday evening address announced the arrest of an individual who had coordinated Russian fire.
In the Ukrainian-controlled town, where Russian strikes also hit homes, shops, a post office and other buildings, “rescue workers removed another body” on Thursday morning, bringing the death toll to 12, according to Kyiv’s Interior Minister Igor Klymenko.
Three children were among the dead but the count of the wounded differed, with Klymenko putting the figure at 65 and emergency services counting 60.
The latter also said 11 people had been rescued from the Ria Pizza restaurant, an eatery popular with soldiers, aid workers and journalists.

Galyna, a military doctor, said she was near the restaurant when it was struck.
“We were in an apartment and we heard an explosion,” she said, adding there were numerous wounded inside.
“It’s horrible and very sad, but I am
not surprised that a missile arrived here.
It was a place where you could come and have a delicious lunch and coffee.
“I myself have sat there more than once.”
Colombian President Gustavo Petro said that three Colombians were injured in the strike: decorated writer Hector Abad Faciolince, former Colombian peace negotiator Sergio Jaramillo and journalist Catalina Gomez.

PARIS—Violent protests broke out in France in the early hours of Thursday as anger grows over the police killing of a teenager, with security forces arresting 150 people in the chaos that saw balaclava-clad protesters burning cars and setting off fireworks.
Nahel M., 17, was shot in the chest at point-blank range on Tuesday morning in an incident that has reignited debate in France about police tactics long criticised by rights groups over the treatment of people in low-income suburbs, particularly ethnic minorities.
The teenager’s mother called for a march on Thursday afternoon in the Paris suburb of Nanterre where he was killed, in tribute to her only child.
In a sign of the seriousness of the situation, President Emmanuel Macron called an early morning crisis meeting of his ministers, the Elysee announced.
There had already been clashes the pre-
vious evening and while Wednesday night began calmly, unrest erupted in other French cities, including Toulouse, Dijon and Lyon before violence after midnight hit the Paris region, where around 2,000 riot police had been deployed.

BRUSSELS—Belarusian leader Alexander Lukashenko could betray Russian mercenary boss Yevgeny Prigozhin, despite offering him refuge after his aborted mutiny, exiled Belarus opposition leader Svetlana Tikhanovskaya said.
“They’re not allies. They cannot trust each other,” Tikhanovskaya told AFP in an interview in Brussels on Wednesday.
“At any moment Lukashenko can betray Prigozhin, Prigozhin can betray Lukashenko.”

WASHINGTON—Experts have recovered presumed human remains from what is left of the Titan sub that imploded during a dive to the Titanic wreck, with the death of five people, the US Coast Guard said Wednesday.
“United States medical professionals will conduct a formal analysis of presumed human remains that have been carefully recovered,” the agency said.
On board were British explorer Hamish Harding, French submarine expert PaulHenri Nargeolet, Pakistani-British tycoon Shahzada Dawood and his son Suleman, and Stockton Rush, CEO of the sub’s operator OceanGate Expeditions.
They presumably died instantly when the Titan sub, about the size of an SUV car, imploded under the crushing pressure of the North Atlantic at a depth of more than two miles.
JEDDAH—Saudi authorities were investigating Thursday after an assailant and a security guard were killed in an exchange of gunfire outside the US consulate in Jeddah, the gateway city for the massive hajj pilgrimage taking place in Mecca.
The gunman and a Nepalese security guard both died after the exchange of fire outside the consulate on Wednesday evening, officials said, giving no possible motive for the incident.
“At 6:45 pm (1545 GMT), a man stopped in a car in front of the consulate building and got out with a
weapon in his hand,” the official Saudi Press Agency quoted a police spokesman as saying.
“Security forces reacted... resulting in an exchange of fire that killed the assailant,” it said, adding that the Nepalese guard later died of his wounds.
The shooting coincided with the final day of the hajj at nearby Mecca. More than 1.6 million foreign pilgrims arriving on planes and boats have streamed through coastal Jeddah en route to the rituals.
“Security investigations are still underway to ascertain the circumstances” of the incident, the police spokesman
said.
The gunman’s nationality has not been revealed. US officials said no Americans were hurt and that the consulate had been secured.
“We offer our sincere condolences to the family and loved ones of the deceased local guards member,” the State Department said in a statement in Washington.
“The consulate was appropriately locked down and no Americans were harmed in the attack,” it said.

BAGHDAD—Iraq has condemned as “racist” and “irresponsible” the burning of a copy of the Koran by an Iraqi living in Sweden during a protest authorized by the police.
Under a heavy police presence, Salwan Momika, a 37-year-old who fled to Sweden several years ago, on Wednesday stomped on the Koran before setting several pages alight in front of Stockholm’s largest mosque.
Police had granted him a permit for the protest in line with free-speech protections, but said later it had opened an investigation into the Koran burning which sparked anger across the Muslim world.
The incident occurred as Muslims around the world marked the Eid al-Adha holiday.
The Iraqi government in a statement issued late Wednesday strongly condemned “the repeated acts of burning copies of the holy Koran by individuals with extremist and disturbed minds”.

THE HAGUE—Iran has taken Canada to the International Court of Justice for allowing victims of alleged terror attacks to claim damages from Tehran, the UN’s top tribunal said on Wednesday.
Tehran’s case claims that Ottawa, which listed the Islamic Republic as a sponsor of terrorism in 2012, had violated Iran’s state immunity.
Iran asked the Hague-based ICJ to make Canada overturn a law passed in the same year that allows victims to collect damages from state terror sponsors in Canadian civil courts.
“Canada has adopted and implemented a series of legislative, executive, and judicial measures against Iran and its property in breach of its international obligations,” Iran said in its filing to the court.
Tehran also demanded compensation from Canada.
Iran’s application cites a Canadian court judgment in 2022 that awarded more than $80 million in compensation to the families of six people who died when Iran shot down a Ukrainian airliner almost two years ago.

‘Wagner head cannot trust Lukashenko in Belarus’
PHILIPPINE shares edged higher on Wednesday as the index went up by 8.64 points to close at 6,511.49 despite strong selling pressures.
Philstocks Financial Inc. research and engagement officer Mikhail Plopenio said investors cheered the narrowed budget deficit of the national government.
Plopenio said the market opened strong as the index reached an intra-day high of 6,559.25.
However, selling pressures increased during the afternoon trading session which trimmed gains.
Value turnover reached P6.78 billion with 1.06 billion shares changing hands. Decliners outnumbered advancers, 94 versus 79, while 51 stocks were unchanged.
Meanwhile, equity markets were mixed Thursday as central bank warnings that interest rates would rise further to counter inflation played up against hopes the US economy could avoid a recession.
Worries over the outlook for China also continue to weigh on sentiment in Hong Kong and Shanghai after mainland officials failed to provide any details on plans to boost growth, despite pledges of help.
Investors were also keeping an eye on Tokyo as the yen weakened to a fresh seven-month low against the dollar as Japanese and US monetary policies diverge.
With the weekend crisis in Russia appearing to have ebbed, focus is now back on efforts by the Federal Reserve and other central banks aimed at fighting inflation.

THE Philippines’ growing urban population will remain mired in a Third World setting if the water infrastructure remains in the post World War II era.
For decades, Metro Manila and its adjacent provinces have solely relied on the water provided by the 50-year-old Angat Dam. The dependence on a single source of water is untenable—the Philippine population has increased exponentially since the establishment of the dam.
Every dry season season, concerned government agencies such as the Metropolitan Waterworks and Sewerage System and the National Water Resources Board have routinely raised alarms over the critical level of water in the reservoir, resulting in rotational cuts across Metro Manila.
Fortunately, the island of Luzon was blessed with a series of rainy days in the last two months but the considerable amount of rainfall does not always land over the watersheds.
So while some parts of Metro Manila get flooded because of strong rains, faucets still run the risk of going dry because Angat Dam water levels have not been going up. This begs the question: Why are Metro Manila water consumers still relying on Angat Dam alone? When the Angat Dam was built in the 1960s, the population in Metro Manila was just a little over 2 million people.
Now, the population in Metro Manila has increased to around 15 million. All these consumers still get their water supply mainly from Angat Dam. And the pie is getting smaller. Angat Dam also supplies water to Bulacan residents.
The dwindling water resource is compounded by climate change. Drought periods are longer, typhoons are more severe and El Niño and La Niña cycles are more frequent.
Simply put, we need another dam to meet the supply needs of Metro Manila and adjacent provinces. We needed it years ago. The MWSS is working to speed up the construction of Kaliwa Dam, but by the time it is up and running, they should have already completed a third one—the Kanan Dam, which is still under review by the National Economic and Development Authority. These dams are not being built fast enough to quench the thirst of the growing population.
As a stop-gap measure, the private water concessionaires have been trying to look for alternate sources. Maynilad Water Services Inc. began tapping Laguna Lake in 2010 and Manila Water Co. Inc. followed suit in 2019.
The alternative sources, however, do not produce a significant volume of water. We need another dam similar in scale to Angat Dam, which currently provides 90 percent of Metro Manila’s water supply.
The Angat Dam is just part of one system that conveys water to Metro Manila. The MWSS calls this the Angat-Ipo-La Mesa system. The water from Angat Dam flows down to the Ipo Dam (which is a mere diversionary dam), and then down to La Mesa Dam. Since all three dams belong to one system, all three should benefit the customers of both MWSS concessionaires, Maynilad (West Zone) and Manila Water (East Zone).
Yet, only Manila Water enjoys exclusive use of La Mesa Dam—a major infrastructure advantage over Maynilad. Even with lower allocations from Angat Dam, Manila Water still has around a month’s worth of water stored in La Mesa Dam, so it is unaffected even as Maynilad already has service interruptions. The rains thankfully have arrived
and La Mesa Dam is now back to healthy levels.While the water elevation in Angat Dam continues to go down, the water elevation in La Mesa Dam has been going up because it also gets refilled with water from its surrounding tributaries.
So even if allocations from Angat Dam are reduced, Manila Water is insulated from the impact. This is not the case for Maynilad, which does not have the luxury of having its own dam.
The MWSS perhaps should intervene in the situation. All water resources should be shared by all. By stretching available supplies, we are considering the welfare of all consumers and mitigating a water crisis while MWSS is still building Kaliwa Dam.
Another means being employed to generate more supply is the reduction of losses in the pipe network, or what is called the Non-Revenue Water or NRW. As far as NRW reduction is concerned, Manila Water is ahead in the game. The average NRW of Manila Water is already at 12.69 percent as of 2022, which is way below the 25 percent standard set by the World Bank. Maynilad has a lot of catching up to do, as the average NRW in the West Zone is still at 43 percent by 2022.
Maynilad inherited the older section of the pipe network when MWSS operations were privatized in 1997. The previous owners of Maynilad, moreover, could not invest in the water infrastructure for 10 whole years after its debts sky-rocketed following the Asian financial crisis in 1998.
The early sins of privatization dealt a severe blow to Maynilad and, consequently, its customers. The West Zone concession essentially lost 10 years that could have been spent on improving the pipe network to reduce losses.
Maynilad hopefully will step up efforts to upgrade the pipe network. MWSS, in the meantime, should complete Kaliwa Dam to improve the water services in both the East and West Zones.

Secretary Janet Yellen said in an interview that aired Wednesday she hopes to travel to China to “reestablish contact” with Beijing despite differences between the two countries.
Tensions between China and the United States have soared in recent years, with both President Joe Biden and his predecessor Donald Trump calling Beijing the most serious threat to long-term US global primacy.
But the Biden administration has recently sought to dial down the heat, with Yellen telling MSNBC that her hopes in “traveling to China is to reestablish contact.”
“There are a new group of leaders, we need to get to know one another,” she said, declining to give an exact date for an expected visit to Beijing, which Bloomberg has reported will take place early next month.
Deepening China-US discord are Washington’s bans of exports of high-end semiconductors and other trade curbs on the rising power.
Yellen acknowledged in the interview that the two countries have disagreements, stressing the United States would continue to defend its national security interests.
“The United States is taking actions and will continue to take actions intended to protect our national security interest and we’ll do that even if it imposes some economic cost on us,” Yellen said.
But Yellen added that economic competition would benefit both countries.
“Healthy competition that benefits both American businesses and workers and Chinese businesses and workers, this is something that is both possible and desirable,” she said.
Yellen’s reported trip to China comes on the heels of another visit by a top US official, Antony Blinken, to Beijing this month— the first by a US Secretary of State in nearly five years.That visit saw Blinken meet with President Xi Jinping, who said the two powers had “made progress and reached agreement” on unspecified issues. THE Asian Development Bank approved on Thursday a $1-billion or nearly P55.5-billion loan to help establish a city-wide public transport project in Davao City.
Called the Davao Public Transport Modernization Project, it would be the first in the country to deploy electric bus fleets at scale in support of efforts to reduce greenhouse gases and promote climate action.
ADB’s largest road-based public transport project in the Philippines is expected to serve as a pilot for overhauling the country’s public road transport system.
CEMENT manufacturer Holcim Philippines, Inc. said Thursday it plans to delist from the Philippine Stock Exchange after a major shareholder increased its stake in the company, causing its public ownership to fall below 10 percent.
HPI said in a disclosure to the stock exchange it received a notice from Holderfin B.V. that it acquired 594.9 million shares in the company owned by Sumitomo Osaka Cement Co. Ltd. This is equivalent to 9.22-percent stake in HPI.
The deal was conducted via a block sale worth P2.3 billion, which translates into acquisition price of P3.92 per share.
Post-Acquisition, total shareholdings of Holderfin, a Dutch company, in HPI increased to 27.33 percent from 18.11 percent of the company’s outstanding capital stock.
This reduced HPI’s public float to 5.05 percent from 14.27 percent as Sumitomo shares were attributed to shares held by the public.
HPI said Holderfin would be unable to issue additional shares to the public sufficient to raise its public float to the required level given the prevailing market conditions.
“Holderfin is prepared to make a tender offer for all outstanding common shares of the company held by the public with the aim of subsequently conducting a voluntary delisting of the company’s common shares from the main board of the PSE,” HPI said.
“Given Holderfin’s willingness to conduct the tender offer and voluntary delisting, the company is carefully evaluating the feasibility and potential benefits of pursuing the voluntary delisting,” it said.
The PSE immediately implemented a trading suspension on HPI shares. Prior to the trading suspension, the price of HPI closed at P3.87 on Wednesday.
HPI owns and operates four cement production facilities and one cement grinding mill with total production capacity of 10 million metric tons.
The cement firm saw its net income decline by 63 percent in 2022 to P941.77 million from P2.56 billion in 2021 on higher fuel and energy cost.

It will support the procurement of a modern fleet of about 1,100 buses with operations managed by the private sector under performance-based contracts. The new fleet is expected to reduce 60 percent of annual greenhouse gas emissions from public transport in Davao City, the country’s third-largest city by population, the ADB said. ADB senior transport specialist for Southeast Asia Shuji Kimura said in a
statement the project would transform the quality of Davao City’s public transport and support the city’s rapid economic growth with a low-carbon and climate-resilient bus system.
“Not only will this support the Philippines’ climate goals, but it will help to improve the lives of vulnerable populations especially women and the young who use public transport daily,” Kimura said.
The project will service about 800,000 passengers a day. It also involves the construction of around 1,000 bus stops with bright lighting and shelters, five bus depots and three bus terminals and providing bus driving training for the new system.

REDC said in a statement that under the terms of the agreement, TOKAI would take a 32.5-percent stake from the IPO.
“We are pleased on TOKAI’s commitment to participate in our IPO as this is a testament to the market’s growing interest in our company,” REDC president and chief executive Eric Peter Rox-

REDC will allocate a board seat to TOKAI on an observer status. TOKAI is a Japan-based listed conglomerate involved in various sectors such as gas, solar power and real estate.

REDC, a subsidiary of Pure Energy Holdings Corp., is looking to raise P1.15 billion by offering common shares at P5 apiece.
It will offer a total of 200 million common shares, with an overallotment option that would allow the sale of another 30 million common shares.
The company said it would start its offer period on June 30, with the settlement date set on July 14, 2023.
REGISTERED foreign portfolio investments or hot money in May 2023 posted net outflows of $124 million, lower by 64.6 percent and by 54.0 percent than the net outflows recorded in April 2023 of $352 million and in May 2022 of $270 million, respectively, the Bangko Sentral ng Pilipinas said Thursday.
BSP said the lower May net outflows resulted from gross outflows of $969 million and gross inflows of $845 million for the month.
The $845 million registered investments for the month are higher by 18.5 percent (or by $132 million) compared to the $713 million recorded in April 2023.
Majority of registered investments ($589 million or 69.7 percent) were in Philippine Stock Exchange-listed securities (investments mainly in banks, food, beverage and tobacco,
holding firms, property, and transportation services).
The remaining were in peso government securities ($256 million or 30.3 percent) and in other instruments (less than one percent).
The top five investor countries for the month were the United Kingdom, the United States, Singapore, Luxembourg and Hong Kong with combined share to total at 86.6 percent.
The $969 million gross outflows for the month are lower by 9 percent or by $95 million compared to those recorded in April 2023 at $1.1 billion.
The US received 66.2 percent of total outward remittances.
Transactions from January to May 31, 2023 yielded net outflows of $805 million, a reversal of the $1.1 billion net inflows noted for the same period last year.

KUALA LUMPUR—Air Asia is acquiring 362 new A321neo aircraft in line with the airline’s sustainability program and upgrading of its fleet.
Capital A (Air Asia) chief sustainability officer Yap Mun Ching made the announcement during the Sustainability Day event here in Malaysia attended by foreign media, aviation experts and other stakeholders.
“All airlines are faced with four pathways to decarbonize, namely to upgrade their fleet, step up implementation of green operating procedures, switch to biofuels and offset remaining emissions. Air Asia’s top priorities are in upgrading its fleet to the A321neo, widely acknowledged as the most fuel-efficient aircraft on the market today, and in expanding and deepening its industry-leading fuelefficiency programme,” said Yap. THE Joint Foreign Chambers of the Philippines asked the government to reconsider its proposal to impose new taxes on junk food and increase the existing tax on sugar sweetened beverages.
The group said it is not the right time to introduce additional taxes on products primarily consumed by middle and lower middle-class households because the country is still recovering from the pandemic and a prolonged period of high inflation.
“While we recognize the need for government to boost revenues and support initiatives to improve the health and well-being of Filipinos, we recommend careful reassessment of any proposal to impose additional taxes that will be inflationary for Filipino consumers and
discriminatory to certain businesses,” the group said.
The proposal would also affect micro and small enterprises that retail these products as a source of income, they said.
JFC said additional tax impositions will only strain the capacity of businesses in affected sectors to continue operations and grow their businesses, especially when issues related to the supply of certain raw materials remain unresolved.
“This could potentially reduce competition in the market to the detriment of Filipino consumers and the growth of the economy driven by consumption. Instead, we recommend that the impact on consumption and health of the existing SSB tax imposed under Republic Act 10963, otherwise known as the TRAIN Law, be fully studied and presented before any ad-
ditional taxes are imposed,” it said.
“We also strongly recommend the prioritization of improvements to tax administration such as in the proposed Ease of Paying Taxes Act and non-tax interventions as alternative, non-inflationary measures to raise government revenues and improve health outcomes of Filipinos,” JFC said.

Our generation then was used to losing. But we had fun losing then.
The current Bedans, however, are not used to seeing their Red Lions lose. More importantly, they are not used to seeing the men’s team lose by embarrassing margins.
Like they say, it’s better to lose the games during the preseason rather than during games when they actually matter. But then again.
I just hope the current coaching staff led by Yuri Escueta can make the needed adjustments to make the Red Lions a better team soon. I also pray that the Red Lions will also rediscover their mighty roar and pride once the tournament that matters begins.

3. Applicant SNAP-MI is a corporation duly organized and existing under and by virtue of the laws ofthe Republic of the Philippines, with principal place of business at Magat Hydro Electric Power Plant, Magat River, Brgy. Aguinaldo, Ramon, Isabela.
3.1 SNAP-MI is the owner and operator of a power plant composed of the Magat Hydroelectric Power Plant, with a dependable capacity of 388MW continuous output at 60Hz, including required ancillaries and spare parts, located in Brgy. Aguinaldo, Ramon, Isabela (the “Generation Facility”), which was certified and accredited by the NGCP as capable of providing Contingency Reserve and Dispatchable Reserve.
4. NGCP and SNAP-MI may be served with orders, notices, pleadings and other legal processes through their respective counsels at the addresses indicated below.

Republic Act No. 9136, also known as the Electric Power Industry Reform Act (“EPlRA”), provides that it is the responsibility of NGCP to ensure and maintain the reliability, adequacy, security, stability and integrity of the nationwide electrical grid in accordance with the performance standards for its operations and maintenance, as set forth in the Philippine Grid Code (“PGC”), adopted and promulgated by the Honorable Commission, and to adequately serve generation companies, distribution utilities and suppliers requiring transmission service and/ or ancillary services (“AS” or “Ancillary Services”) through the transmission system.
6. Similarly, the PGC provides that NGCP is responsible for determining, acquiring, and dispatching the capacity needed to supply the required Grid AS and for developing and proposing Wheeling Charges and AS tariffs of the ERC.
7. Ancillary Services is defined in Section 4 (b) of the EPIRA as referring “to those services that are necessary to support the transmission of capacity and energy from resources to loads while maintaining reliable operation of the transmission system in accordance with good utility practice and the Grid Code to be adopted in accordance with this Act.” These services are essential in ensuring reliability in the operation of the transmission system and consequently, in the reliability of the electricity supply in the Luzon, Visayas and Mindanao grids.
8. In order to implement and regulate the procurement of AS, the Honorable Commission approved the Ancillary Services Procurement Plan (“ASPP”) through its Order dated 9 March 2006 in ERC Case No. 2002-253 and the AS-CRM through its Decision dated 3 October 2007 in ERC Case No. 2006-049RC.

In addition, Café Eight at Crimson Alabang will have a dinner buffet and drag show every Friday and Saturday of June. From the mouthwatering selection of international dishes to aweinspiring drag performances, the restaurant will transform into a colorful space where laughter, applause, and sheer joy fill the air.
Simultaneously, on June 2, Quest Plus Clark and Quest Cebu will also host their own exhibits in solidarity with the LGBTQ+ community. These
exhibits aim to foster understanding and acceptance of diverse identities and serve as a reminder of the ongoing need for social progress and equality.
To further celebrate and showcase the vibrant spirit of Pride, Quest Plus Clark will present drag shows at Charlies on June 2, featuring talented local drag artists. The event promises an evening filled with mesmerizing performances, glamour, and boundless creativity.
Continuing the festivities, Quest Cebu will host an unforgettable drag show on June 10, headlined by the renowned and sensational drag queen Minty Fresh. Known for her impeccable artistry and captivating stage presence, Minty Fresh will deliver an extraordinary performance that will leave the audience in awe.
Finally, on June 23, Crimson Boracay will be transformed into a haven of pride and acceptance as it presents a spectacular drag show. This mesmerizing performance will be an unforgettable highlight of Pride Month celebrations on the stunning island of Boracay.
