By Rey E. Requejo, Maricel V. Cruz, Macon Ramos-Araneta and Rio N. Araja

HE Supreme Court has affirmed the constitutionality of the AntiTerrorism Act (ATA) of 2020, except for its two most assailed provisions, in what critics called a “devastating blow” to human rights and democracy.”

T

In an advisory released by the Court’s Public Information Office, the 15-member bench declared as unconstitutional two provisions in the Republic Act No. 11479, which has been the subject of 37 petitions before the Supreme Court. Voting 12-3 in an en banc session on Dec. 7, the Next page

Critics fear govt can order arrest without warrant terror suspects By Rey E. Requejo THE petitioners against the Anti-Terror Act said the striking down of a "killer caveat" in the law was an “important win for the protection of civil liberties” but said the Supreme Court upheld “the draconian powers of the Anti-Terrorism Council that arrests, harasses, and murders with zero regard of your legal standing." The Anti-Terrorism Council, comprised of members of Duterte's Cabinet, can order the warrantless arrest of anyone they deem a terrorist. Suspects can be detained for up to 24 days without charge. Cristina Palabay, secretary general of rights group Karapatan, said other sections of the law remained "largely vague and susceptible to subjective interpretations and therefore, abuse." Senatorial candidate and former Partylist Rep. Neri Colmenares, said the Court decision “corrects the erroneous and dangerous view of the law’s proponents that equate activism with terrorism.”

By Vito Barcelo and Joel E. Zurbano THE 23 cities that have fully vaccinated over 70 percent of their target populations may have achieved the desired vaccine coverage, but Health Secretary Francisco Duque III said Thursday “they have yet to achieve absolute protection from COVID-19." He said herd immunity should involve the whole country achieving the target vaccination coverage. “In terms of absolute protection, it’s not, because there are areas that can be visited by individuals from areas with low vaccine coverage, so they can still be infected,” Duque said. The Interior Department has identified the following cities as having achieved herd immunity in Metro Manila: San Juan City; Mandaluyong
