COVID Budget Increases State Spending, Pierces Spending Cap

The state legislature wrapped up its 2021 session with spending increases in many areas, Assemblyman Joe DeStefano reported from Albany. In the face of the lingering affects of the COVID pandemic, the adopted budget provides a 12 percent boost in education spending and help for small businesses.

Overall, the state will spend $212 billion, a 9.7% increase amounting to $18.7 billion over last year, a plan that does not stay within the 2% spending cap imposed by the state over all other governmental entities, DeStefano noted.

The cost to run state government will go up 6.6%.

“Schools will get $29.05 billion in state aid, which is a $3.06 billion increase,” the Assemblyman said. Counting federal dollars, total school aid funding will be $41.1 billion. Foundation Aid came in at $19.8 billion, $1.4 billion more than last year, while $938.6 million has been budgeted for Universal Pre-K, which is a $142 million increase. Non-public school aid stays stable at $193.1 million.

The budget allocates $94.1 million for Library Aid, same as last year, and $105.9 million for schools serving the blind and deaf, which is $2 million more than last

year.

The Community College base rate remains at $2,947 per student with $1.07 billion authorized for the Tuition Assistance Program, which is $73.8 million more than last year. The TAP maximum raises by $500 to $5,665.

The budget creates a Small Business Pandemic Relief Program, DeStefano reported, with $800 million for COVID-19 Pandemic recovery grants; $25 million was allocated for New York Restaurant Resiliency Grants, while $600 million was approved for the Small Business Credit Initiative Program.

The legislature also provided $2.45 billion for a Emergency Rental Assistance Program for individuals in rental arrears as a result of the pandemic and $600 million for the Homeownership Relief and Protection Program, designed to prevent mortgage issues and loss of utility/home energy services.

Mobile Sports Wagering was approved, as well as a Request for Information to solicit interest in three new Downstate casino licenses.

An “Excluded Worker” Fund was created to provide $2.1 billion for undocumented immigrants with unemployment benefits up to $14,820.

“This was one of the more controversial items with taxpayers having to provide money to those in our country illegally,” DeStefano said.

In the area of Transportation and Infrastructure, $357.3 million in operating aid was provided to Downstate transit systems, $47.9 million more than last year. The Consolidated Local Street and Highway Improvement Program (CHIPS) will get $538.1 million, $100 million more than last year. The Extreme Winter Recovery Fund received $100 million, while the same amount went to BRIDGE-NY; $150 million went to PAVE-NY, according to DeStefano.

The $300 million level for environmental protection was maintained and a new $3 billion Environmental Bond Act, “Restore Mother Nature,” will be submitted for voter approval in November 2022.

Aid and Incentives for Municipalities (AIM) is funded for $656.1 million; Regional Economic Development Council awards held steady at $150 million; and $35.8 million in agriculture assistance was approved.

Other legislative actions include: • $2 million to reimburse local boards of elections for the costs of expanded early

voting.

• $200 million in Pandemic Emergency Assistance to provide additional public benefits to low-wage workers.

• Extension of the Hire-A-Vet tax credit for one year.

• Requirement for Internet Service Providers (ISPs) to offer high-speed broadband service to low-income customers for no more than $15 or $20 per month.

• Expansion of the Excelsior Jobs Program to provide incentives for employers to provide childcare services to employees.

• Funding of $5 million for the PFC Joseph P. Dwyer Veterans Peer Support

Program.

• $46 million for the Office of Cannabis Management to regulate the program created by the Marihuana Regulation and Taxation Act. • $7.3 million for the Public Campaign Finance Board.

• Creation of an “Ultra-Millionaire’s Tax” which taxes $1 million-$5 million in income at 9.65%, $5 million-$25 million at 10.30%, and more than $25 million at 10.90%.

“Overall, the budget dramatically increased state spending,” DeStefano said. “Many of us would have preferred a little more fiscal restraint.”

Flag Day Celebration

The American Legion Arthur H. Clune Post 1533 in Mastic Beach had its annual Flag Day celebration.

They were joined by the Girl Scouts, Boy Scouts, the Mastic Beach Fire Department and County Legislator Jim Mazzarella.

The purpose of the celebration is to honor our Flags and properly dispose of those flags that need to be retired by a cremation ceremony used by the National American Legion. The Post Commander Kenneth Brown led the procedures. Over 100 flags were retired, one at a time by the scouts and guests.

Lawmakers Seek Immediate End to Sand Land Mining Operations Senator Anthony Palumbo (R,CNew Suffolk) and Assemblyman Fred Thiele (Sag Harbor) today sent a letter to Basil Seggos, Commissioner of the New York State Department of Environmental Conservation (DEC), imploring him to stop sand mining operations at Sand Land Corporation in the Town of Southampton, after a recent New York State Appellate Court ruling voided mining permits issued to Sand Land by the DEC. The lawmakers argue that the Court’s ruling solidifies the primacy of local zoning under the State’s Environmental Conservation Law.

Palumbo, Thiele Urge DEC to Follow Court Ruling on Sand Mining The DEC processed the Sand Land application, despite the fact that mining was prohibited by the Town of Southampton Zoning Code and approved the massive expansion of the mine. The DEC also ignored the fact that the Suffolk County Department of Health Services had found that the water at Sand Land mine was polluted and exceeded state and federal drinking water standards. Additionally, the Sand Land mining operation is located in a residential area which is also designated by State of New York as a Special Groundwater Protection Area.

“Time and again, the DEC has failed miserably to protect our groundwater from pollution at the Sand Land mining facility. I am grateful that the Appellate Division of the State Supreme Court recognized both the intent of the Legislature to preserve Long Island’s valuable groundwater resources and the home rule authority of local government. The DEC must right their wrong and enforce the decision of the court by

immediately closing down the mine.”

“The Appellate Court’s ruling is an important victory for the Southampton Community, the environment and for local control,” said Senator Anthony Palumbo.

“Clearly, the Town of Southampton opposed the Sand Land mining facility out of quality of life concerns and in order to protect the region’s drinking water and local environment. The DEC should never

have circumvented the will of the community by issuing these mining permits.”

“Assemblyman Thiele and I have once again called on the DEC to acknowledge the rule of law and enforce the Court’s decision.

Additional litigation is not in the public interest. Close the mine as you originally proposed to do in the fall of 2018, and do so immediately,” concluded Senator Palumbo.

Kelp Bill Passes in the State Senate Senator Anthony Palumbo (R,C-New Suffolk) today announced the passage of legislation that he sponsors to allow kelp cultivation in underwater lands at Gardiner’s and Peconic Bays.

“I have long championed the promotion of kelp farming during my time in the State Legislature and I am pleased to see this important bill pass the State Senate,” said Senator Anthony Palumbo.

“This legislation is a win, win for our region’s aquaculture industries and the environment.”

Senator Palumbo noted that kelp farming would protect our waterways while also providing a natural habitat for fish and shellfish. Kelp is also a growing and popular food, which can be used in cosmetic and personal care products and for fertilizer and animal feed.

“High nitrogen levels in our bays and waterways have created algae blooms and resulted in fish die offs. Kelp farming will help to reduce nitrogen levels in our bays and put more oxygen into our waterways, strengthening this important ecosystem,” said Senator Palumbo. “In addition to the strong environmental benefits, kelp farming will create an economic boom for

our region’s aquaculture industries while having a positive effect on the health of New Yorkers.”

The legislation has the strong support of the Long Island Shellfish and Aquaculture community, Stony Brook’s School of Marine and Atmospheric Science, New York State’s Marine Resource Advisory Council and the Long Island Farm Bureau.

When signed into law, New York will join states such as Connecticut, Massachusetts, Maine and Rhode Island that promote kelp and commercial seaweed aquaculture programs.

The legislation has passed both houses of the State Legislature, and awaits the signature of the Governor.

Liberal State Lawmakers are Making the Same Mistake as They Did with Bail Reform as Crime Rates Spike throughout New York State and Suffolk County When the Democratic Party assumed control of both houses of the New York State Legislature in 2020, their first act was bail reform. By allowing those accused of all but the most violent crimes to go free without posting bail, crime has risen throughout New York State and Suffolk County.

In Suffolk County, from 2019 to 2020, homicides were up 25% and motor vehicle thefts were up 50%.

Residential and commercial burglaries went up as well, from 900 in 2019 to 973 last year. These increases occurred, despite stay-athome orders. Meanwhile, identity theft shot up 85%

Republican Suffolk DA Candidate Ray Tierney Says Parole Reform Will Further Endanger Residents across the state last year.

Ray Tierney, Republican candidate for Suffolk County District Attorney, says the Democratcontrolled state Senate and Assembly are now looking to reform the state’s parole system, which will only release more criminals.

Proposals include releasing longtime prisoners 55 years old and over and those already eligible for parole and lessening sentences for those who violate the conditions of their parole.

“Thanks to the soft-oncrime liberal Democrats, there will be more of New York’s most dangerous, recidivist criminals back on our streets,” he said. “Crime is already spiraling out of control and our neighborhoods are becoming less safe.”

Romaine Honors Eagle Scout Candidate Aidan McKeon from Troop 29 of East Moriches On May 23, Aidan McKeon, an Eagle Scout Candidate from Troop 29 in East Moriches, held a Healing Fair at St. John the Evangelist Roman Catholic Church in Center Moriches.

Aidan’s motivation for holding the fair was the COVID-19 pandemic, and the theme focused on mental health and overall wellness. He felt it was important for members of the Brookhaven Town community to know what resources are available to them if they need assistance.

to deliver their donations to the Long Island Veterans Home in Stony Brook and the Northport Veterans home on their behalf. The commander delivered the material for them last week. Bellport High School’s Laura Slovensky Pursues U.S. Coast Guard Career Bellport High School senior Laura Slovensky has been appointed to the United States Coast Guard Academy in New London, Connecticut and will report for summer training to the Academy’s Corps of Cadets on June 28, just two days after high school graduation. Laura’s appointment was only one of the 400 offered annually from a pool of 2,000 applicants.

“I’m extremely proud and excited for this opportunity to attend my dream school and am really looking forward to it,” Laura said.

The smallest of the nation’s five military academies, the U.S. Coast Guard Corps of Cadets is a credited college which educates future Coast Guard officers. Cadets receive a full tuition scholarship and monthly stipend for a five-year service commitment to the U.S. Coast Guard upon graduation. All graduates receive a Bachelor of Science degree and are guaranteed a position of leadership as a commissioned officer in the U.S. Coast Guard.

Laura’s road to this appointment parallels her love of being on the water. She was recruited to the academy for competitive sailing. For the past two years, Laura spent her sophomore and junior years of high school at the U.S. Performance Academy, an online high school, so she could train and travel around the world full time and compete in sailing on the Olympic level. She will continue her sailing career on the U.S. Coast Guard Academy’s dinghy sailing team against other top colleges.

Laura has chosen a government major with a security studies track. She hopes to pursue law enforcement within the U.S. Coast Guard upon graduation.

BY KARL GROSSMAN With the big push by the Biden administration for infrastructure work, there’s a call for creation of a “a highspeed rail spine” with trains moving at “150-200 mph” between New York City, across much of Long Island, and then from Port Jefferson through a tunnel to be dug under the Long Island Sound.

The trains would emerge at New Haven, Connecticut and connect to Hartford, Providence and Boston.

Representative Tom Suozzi whose district includes part of Suffolk is leading the effort.

Does the plan have a chance?

What’s being called the “North Atlantic Rail Network,” acronymed NAR, would be “the nation’s first integrated high-speed, performance and regional rail network serving the seven-state New York/New England region,” said the letter. “It can serve as a prototype for new 21st century rail networks in the nation’s other megaregions. This proposed

For starters, it would be expensive. At a now estimated $105 billion, “the project would be among the most costly public works projects in American history,” relates Newsday. The possible availability of loads of federal infrastructure dollars softens this—although Republicans in Congress are not in tune with all the funding the Biden administration seeks.

Then there is the projected time for construction: 20 years.

A model for high-speed (150 mph) trains exists in Europe. Once off such a train in Europe, you can easily get around on connecting trains, trolleys, buses, and not need a car. China now has the fastest high-speed trains in the world, moving at nearly 220 mph.

“High-Speed Rail Spine” There are already critics of the NAR project. Priority for spending infrastructure dollars should be on “things that we need, not things that are fantasies,” says Mitchell Moss, director of the Rudin Center for Transportation Policy and Management at NYU. “HighSpeed Rail on Long Island? Not So Fast,” was the headline of Stony Brook University professor of public policy, Richard Murdocco’s column “The Foggiest Idea.” He said the plan fails to “meet…more immediate infrastructural needs” and “policymakers should focus on encouraging transit ridership postpandemic.”

There have been numerous proposals through the years for bridges and tunnels from Long Island to Westchester County or New England. They started in 1938 with the proposal by Royal Copeland, a three-term U.S. senator from New York State, for an island-hopping 18-mile bridge from Orient Point and then across Plum, Great Gull and Fishers islands landing in Groton, Connecticut or Watch Hill, Rhode Island.

In the 1960s, Robert Moses pushed unsuccessfully for bridge from Oyster Bay to Rye. In 1979, New York Governor Hugh Carey set up a tristate advisory committee

to consider cross-Sound bridges from sites at Riverhead, Wading River, East Marion, Port Jefferson and Orient Point.

But the panel found that expanding cross-Sound ferry service was preferable.

In 2003, there was a drive by the Long Island Association and the Construction Trades Council of Nassau and Suffolk Counties for a tunnel starting at Exit 68 on the LIE going under a 100,000-acre pine barrens state preserve and then the Sound to New Haven. Bob Yaro, president of the Regional Planning Association, warned: “That far east on Long Island

there are apt to be very serious growth impacts.” Richard Amper, executive director of the Long Island Pine Barrens Society, protested: “Some Long Island leaders are still in denial that this is an island, not a highway to New England.”

Meanwhile, there’s that relatively slow but pleasant way to leave eastern or central Long Island, if you have the time—ferries from Orient Point to New London or Port Jefferson to Bridgeport.

The latter line was founded in 1883 by backers including P.T. Barnum and has outlived his circus.

Nobody Likes the Nets

BY TOM BARTON The best team in New York is the team that no one seems to care about or like, and that is the Brooklyn Nets. With all due respect to what the Islanders have accomplished this season, the Nets are the closest to a championship team in the big apple at the moment. The Nets began the season, even with the injuries to Kevin Durant and Kyrie Irving as a solid bet to win it all at 8:1 odds. That quickly shrunk down to 6:1 right after the lines were released and the public ran to the windows on Brooklyn. After the blockbuster deal for James Harden the Nets were the co-favorites with the Lakers to win it all at +250 and the favorite in the East overall at +200. The public loved

the Nets ... New York fans still did not.

You can point to a number of factors for the fans not showing out for the Nets. First of all this is a Knicks town and always has been. The Nets are a new product to the city, even if they only played in New Jersey, it seemed like worlds away. Second, this team doesn’t have a rich or storied past. Perennial losers, outside a few bright spots like Derek Coleman and Drazen Petrovic, this team was a basement dweller for decades. The Nets also have no one to cling to, no one that is “a true Net” or a “New York guy”.

Those guys are important to a fan base. This is a collection of athletes that were thrown together and

Sabermetrics dot the landscape everywhere in fantasy baseball analysis these days, and it is creeping into baseball broadcasts of late. One of my favorite things about the Baseball Package is watching the different broadcasts from different baseball markets and seeing the sabermetric analysis becoming more and more mainstream. For a kid who first got into baseball during the 1973 season watching the NY Mets win the National League East that year with a .509 winning percentage, the transformation is incredible.

When a batter came to the plate when I first watched baseball, the hitter’s batting average, HR’s and RBI’s were displayed on my TV screen. Most of today’s broadcasts will show you the batter’s on base percentage and OPS prominently. Many of us read the seminal book “Moneyball” about the then radical methodologies of Billy Beane in building a winner out of the Oakland A’s with a tiny budget and loads of statistical analysis coming at the expense of traditional scouting. It didn’t hurt casting Brad Pitt to play Billy Beane in the movie “Moneyball” either.

The timeless quality of the concept that there is no clock in baseball amongst the major sports makes it unique. 27 outs determines the winner of a baseball game,

and if the score is tied at that point, they go to extra innings and outs to determine the winner. But populating your team with players who get on base, delays that 27th out for your baseball team. And so, the baseball broadcasts of today shows you the percentage of the time that a hitter gets on base. It tells you much more about a team’s chances to score runs than a batting average can ever tell you.

the fanbase has no emotional connection. Finally, let’s be honest here, this team couldn’t care less about the regular season. So the fans didn’t either.

The Brooklyn Nets have a lot going for them. They are talented, a draw around the country, and have a great shot at winning the title this year. But there is a stark difference when you hear the passion from--the Barn and those Islander fans than in Brooklyn.

What a fall from grace we have come from the Dodgers who played in Brooklyn and Dem Bums who captured the cities hearts, despite always losing to a team who might win it all but haven’t been able to capture a fan base.

The Old Stats vs. The New Stats by adding his 0.435 on base percentage to his 0.643 slugging percentage to arrive at an OPS of 1.078. It is a recognized mark of excellence in baseball to have an OPS of 1.00 or higher.

Guerrero is 22 and his father was a Hall of Fame slugger. Winker may surprise some casual fans to see him figure so prominently but his career OPS is 0.897. He has been underrated for a while. The OPS could have

It’s counting the wrong stats. The batting average has little to do with the baseball teams that score the most runs in a given season. It never has had a direct correlation.

But the on base percentage tells me what I need to know about a team’s chances. As important as the on base percentage is though, it is dwarfed in importance by OPS. OPS stands for On Base plus Slugging and it is the most important stat to track.

There is a beautiful and near perfect correlation between the runs scored and runs driven in that an offensive player produces and his given OPS. The OPS is the simple adding of a player’s on base percentage and his slugging percentage.

Vlad Guerrero Jr. is the current major league leader in OPS at 1.078. His figure is derived

in most leagues, runs and RBI’s almost certainly are. The OPS stat will tell you who has the most runs and RBI’s in your fantasy baseball league. Let the other owners in your league ignore OPS at their own peril.

Be sure to review the OPS stats in your league, ESPN posts it in their stats and lets you sort the list from highest to lowest.

Perform a cutoff at the 0.800 level. If you see a player who makes the grade at .800+ and he is isn’t on a team in your league and is available in your league as a free agent waiver, snap him up.

Obviously doing this before May 1st can leave you susceptible to catching a small sample that is not accurate. But a review as of this morning shows a number of guys who weren’t prominently drafted in your drafts this winter/spring. Yermin Mercedes at .802/Mark Canha at .847/Adolis Garcia at .853/Austin Meadows at .857/Austin Riley at .896/Brandon Crawford at .912/Cedric Mullins at .928/Yuli Gurriel at .953.

The only three (3) players in baseball thus far who have an OPS higher than 1.00 in 2021 are Vlad Guerrero Jr., Jesse Winker and Nick Castellanos. All three are also doing it for the first time in their careers. Castellanos is 29, Winker is 27 and

Check the standings in your league, I guarantee that these 3 players are on the rosters of the teams in contention in your league. Even though OPS is not a category

How are Promissory Notes Used in Medicaid Planning?

Q: How are promissory notes used in Medicaid planning?

A:

Have you ever heard of the “5-year lookback” and wondered what people are talking about? If you have, you are not alone.

The lookback concept is one that governs the conversation surrounding Chronic Medicaid, the New York State program that covers long term care services in a nursing facility. To financially qualify for Chronic Medicaid, an individual must show they have countable resources of less than $15,900 (2021 figure that changes annually).

When applying for Chronic Medicaid, the applicant and spouse must show that they did not gift or transfer assets within the 5 years prior to needing Medicaid to cover the cost of the facility. Any such transfers result in a “penalty period.”

If you or a loved one find yourself in a position where you have resources in excess of that amount, planning will be necessary in order to protect any of your assets. There are certain assets that are not considered

a resource for the purposes of eligibility.

Additionally, certain transfers are exempt and do not result in the imposition of the penalty. But, for those that have assets that do not fall within these exempt categories, promissory note planning can come into play. First of all, do not try this at home.

Promissory note planning for Medicaid eligibility should only be done in consultation with an attorney with experience in this type of Medicaid planning. A mistake in the terms of the note or the process of transferring the assets can create unintended Medicaid penalties or periods of ineligibility.

Take an individual with assets that are $300,000 above the $15,900 limit. One option would be to spend all of the assets on the cost of the facility and when they were spent down to $15,900, an application could be made to Medicaid to cover the cost of care.

Alternatively, that same person could

protect assets by gifting a portion, thereby creating a penalty period, and giving a separate portion as a loan to a trusted friend or family member pursuant to a promissory note to be paid back on a monthly basis.

The promissory note payments would be income to the individual which would be added to the Social Security, pension, and other pieces of income to be used to pay the cost of the facility during the penalty period. While this technique is an offshoot of “half loaf” planning, the amount of assets saved as the gift is not actually half. The exact amount of the $300,000 that would be protected would depend on the exact amount of the other sources of income and the private pay rate at the facility in which the individual is receiving care. The promissory note must be actuarially sound and follow certain criteria for this plan to work.

The important take away is that it is (almost) never too late to do Medicaid planning. The 5-year lookback is a rule

that impacts how your plan can unfold but speaking with an Elder Law attorney about your particular situation could result in the

The Children's Department will be giving out Summer With Us journals to children entering K-7th grade. These journals can be used to keep track of all of the fun they have this summer. Children can scribble, start a diary, list the books they read, draw a picture inspired by something they read or just collect stickers or keep track of the library programs they attend.

We have a journal making station in the Children's Department with all kinds of fun art supplies, stickers and craft material, where kids can decorate and add to their journals.

Every time a child shows us something from their journal throughout the summer, they can enter our Summer With Us raffle for a chance to win exciting prizes.

For children birth-entering Kindergarten, we offer a reading program called 1KB4K (1,000 Books Before Kindergarten). Reading aloud to children starting at birth helps them develop the literacy skills needed to learn to read, and this program gets families started with fun prizes along the way. We will have lots of in-person programs in the library and out in the community as well as continuing to offer our grab and go kits and crafts to go.

& Atmospheric Administration.

And that is where safety must be.

During this period, the following order shall be in effect: A. The Town Board hereby creates, authorizes and permits COVID-19 Social D i s t a n c i n g Accommodations. There shall be four types of said Accommodations permitted: 1. Areas: Changes to outdoor spaces on existing improved sites, with a Certificate of Occupancy for the principal use, to be used where said principal use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area to accommodate COVID-19 social distancing requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of outdoor seating tables and/or chairs, display racks, public assembly areas, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. 2.

Signs - Changes to parking lot signage for designation and installation of curbside pickup signs or pick-up parking stalls signs. 3.

Pick-Up Windows: Changes to existing facades

for the installation of pickup windows or movable exterior walls or similar. 4.

Alternate Indoor Dining Spaces: Changes in use to vacant indoor spaces to add dining areas for take-out restaurants, restaurants or major restaurants in existing improved sites, whether the vacant space is adjacent or not, where the existing take-out restaurant, restaurant or restaurant has a valid Certificate of Occupancy , and where said take-out restaurant, restaurant or major restaurant use has been authorized by the Governor of the State of New York to re-open, but the occupant does not have the indoor area in its existing indoor space to accommodate COVID-19 social distancing requirements or occupancy restrictions imposed by the Governor of the State of New York. The placement of dining tables and/or chairs, equipment or other similar items shall be permitted in the COVID-19 Social D i s t a n c i n g Accommodation Areas. B. Only the following uses, hereinafter “permitted use(s,)” shall be permitted to utilize COVID-19 Social D i s t a n c i n g Accommodations: 1.

Assembly and social recreation halls; delicatessens; health clubs; large commercial retailer, except those deemed essential business; lodges; major restaurants; nondegree-granting instruction/program except those associated with manufacturing or driver training; offices; personal service shops; places of worship; restaurants; retail sales establishments; shops and stores for the sale at retail of consumer merchandise and services; take-out restaurants; community or regional movie theatres; and tasting rooms as an accessory to a permitted principal farm brewery, cidery, distillery, or winery

use. Motor vehicle wash facilities shall be permitted to maintain an Outdoor Accommodation Area limited to a customer waiting area only.

C. COVID-19 Social D i s t a n c i n g Accommodations may be granted via administrative review and shall be subject to any conditions the Commissioner of Planning, Environment and Land Management, or his/her designee, deems appropriate. Submission of applications shall be on a form provided by the Commissioner of Planning, Environment and Land Management.

Said application form shall replace current application forms used for land use applications, building permits and tent and membrane structures, as may be applicable. D. Nothing herein shall be deemed to supersede, alter or amend New York State Uniform Fire Prevention and Building Code requirements for inspections, permits and certificates. E. No fee shall be charged for said applications or any other permits required herein. F. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, is hereby authorized to review and approve COVID-19 Social D i s t a n c i n g Accommodation Areas subject to the following: 1.

The application must be for a legally existing permitted use with a valid Certificate of Occupancy.

2. Parking spaces may be used without penalty for loss of parking stalls, however, a physical barrier or separation to protect customers from vehicle traffic, such as bollards, substantial planter boxes or similar barrier, must be installed.

parking analysis to ensure that adequate parking for facility is always provided.

3.

COVID-19 Social D i s t a n c i n g Accommodations must meet Fire Code standards, including points of egress, access to fire extinguishers, and tent and awning ratings, if applicable.

Nothing shall block entrances, exits, fire lanes, hydrants, sprinkler connection points, drive aisles, back-up areas, pedestrian or handicapped access.

4. COVID-19 Social Distancing Accommodations, including generators used for said areas, shall not be located within 250 feet of a structure used for residential purposes, shall only be utilized between the hours of 8:00 AM and 9:00 PM and shall expire on September 6, 2021.

Any owner of any residential structure within 250 feet of a COVID-19 Social Distancing Accommodation must consent to the location of for seating to be located closer than 250 feet from their residence.

This consent may be revoked at any time. 5. All items located within the COVID-19 Social D i s t a n c i n g Accommodation Areas shall be removed no later than September 20, 2021.

COVID-19 Social D i s t a n c i n g Accommodation Areas must be maintained, free of trash and other debris, and trash receptacles provided.

7. Take-out restaurants, restaurants and major restaurants utilizing COVID-19 Social D i s t a n c i n g Accommodation Areas must comply with all New York State Liquor Authority licenses, permits, approvals, guidance, and/or applicable laws. Nothing herein shall permit outdoor bars, taverns or nightclubs.

Nothing herein shall be construed as to amend, repeal, supersede, override

or alter the Alcoholic Beverage Control Law. G. If a tent or canopy is to be used, New York State and Town Code requirements for tent and membrane structures must be complied with.

H. Handicapped/ADA parking stalls may not be used for Outdoor Social D i s t a n c i n g Accommodation Areas.

The blocking of handicapped/ADA routes (path from ADA parking stalls to sidewalk curb ramps to store entrances) is prohibited. Do not reduce sidewalk widths to less than 36”. I. Removal of existing natural areas or required buffers is prohibited.

J. Outside loudspeakers or exterior live entertainment COVID-19 Social D i s t a n c i n g Accommodation Areas shall be prohibited within 1,000 feet of any structure used for residential purposes.

Town Code Chapter 50 must always be complied with.

K. Installation of barriers, bollards, planters or other portable structures to prevent vehicles from entering the COVID-19 Outdoor Social Distancing Accommodation Areas if said area is located within a parking lot or grass area.

L. The submission of a plan meeting the following requirements: 1. Depict the location of proposed tents, other membrane structures, and canopies, inclusive of support ropes and guy wires, outdoor seating, display areas, public assembly areas, equipment or other items.

Plans can be hand drawn on existing survey, site plan or aerial map from Google Maps/Earth, Bing, etc. 2. Depict the location within the COVID-19 Social Distancing Accommodation Areas, and the dimensions of, outdoor or indoor seating tables and/or chairs, display racks and/or tables, equipment or other items, service/customer aisles,

and pathways from business to outdoor or indoor seating/area. Those occupying separate dining tables within COVID-19 Social Distancing Accommodation Areas must be spaced at least six (6) feet apart. All spacing within the outdoor or indoor areas must meet any other applicable current social distancing requirements. 3. Indicate the total number of seats for take-out restaurants, restaurants, or major restaurants thereon. The County of Suffolk Guidance Memorandum for Outdoor Seating in Food Establishments must be complied with.

Depict or provide a narrative of the steps to be taken to ensure overall site circulation is safe for vehicles, occupants and staff which may need to traverse drive aisles to access accommodation areas i.e.: pedestrian markings or signage. L. The Commissioner of Planning, Environment and Land Management, or his/her designee, shall take existing improvements into consideration and determine whether or not additional on-site improvements are necessary and/or appropriate, including but not limited to drainage, parking, curbs and walks, landscaping and fencing, and may require such improvements as part of his/her approval of said.

M. The applicant shall provide any additional information and documentation which the Commissioner of Planning, Environment and Land Management, or his/her designee, deems necessary and appropriate for his/her review of the application.

N. The Commissioner Planning, Environment and Land Management, or his/her designee may, at his/her discretion, refer any COVID-19 Social D i s t a n c i n g Accommodations to the Planning Board as s/he

deems appropriate. O. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, is hereby authorized to review and approve COVID-19 Social D i s t a n c i n g Accommodation Pick-up Windows subject to the following: 1. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, approval shall be for the façade changes only. Nothing herein shall be deemed to supersede, amend or otherwise affect the authority of the Chief Building Inspector as a Code Enforcement Official for compliance with all New York State Uniform Fire Prevention and Building Code requirements.

If located within an Historic District or Historic District Transition Zone, the application shall be referred to the Historic District Advisory Committee for comment only. WHEREAS, the Town of Brookhaven is desirous of assisting existing businesses in the Town of Brookhaven which have been authorized to re-open and seek to utilize existing outdoor areas for drive-in movie theaters, provided social distancing and cleansing/ disinfecting measures are in place. by Executive Law §24, I hereby declare a State of Emergency.

This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven.

From the date of this Executive Order until September 6, 2021, the Town Board of the Town of Brookhaven hereby authorizes and permits the use of outdoor areas on private parcels of existing businesses in the Town of Brookhaven as drive in movie theaters subject to the following: 1. The Host/Applicant submit an Amusement/Event Application for DriveIn Movie Theater to the Brookhaven Town Clerk at least fifteen (15) days prior to the commencement of utilizing a parcel as a drive-in movie theater. 2.

All areas designated for drive-in movie theater use must be situated at least one thousand (1000) feet from any residential property lines in the Town of Brookhaven. 3. The permissible event hours shall be daily, including weekends, commencing from sunset with the last movie commencing at 11:30 p.m. 4. At all times, all employees and guests shall strictly adhere to social distancing guidelines and occupancy restrictions imposed by the Governor of the State of New York, including but not limited to maintaining a distance of six (6) feet from other individuals and/or wearing a face mask or cloth face covering that covers

your nose and mouth when six (6) feet of social distancing cannot be maintained. 5. The Host/ Applicant is responsible for implementing all necessary cleansing/ disinfecting procedures for any on-site restroom facilities. 6. The Host/ Applicant is responsible for the designation of appropriate parking stalls which are at least six (6) feet apart in order to adhere to social distance guidelines imposed by the Governor of the State of New York. 7. Food trucks and mobile concessions in specifically designated and approved areas are permitted provided that all queue lines have floor markings at a distance of six (6) feet apart in order to ensure that individuals maintain a distance of six (6) foot distance. 8. The sale of alcohol Is strictly prohibited. 9. Attendees shall remain within their vehicles at all times except to utilize the restrooms or make purchases from food trucks/mobile concessions. No outdoor seating is permitted for viewing purposes.

Nothing herein shall be deemed to supersede, alter or amend the requirements for all preliminary approvals by Town of Brookhaven Division of Fire Prevention, Town of Brookhaven Division of Public Safety and Suffolk County Police Department.

11. No fee shall be charged for drive-in movie theater applications. 12. The Host/ Applicant is permitted one (1) advertisement sign per street frontage not to exceed thirty-two (32) square feet in area and shall not be placed in the Town’s right of way or in a location that will obstruct or impair vision or traffic in any manner or create a hazard or disturbance to the health and welfare of the public. 13. The Host/ Applicant is responsible for maintaining the events/parcels free of trash and other debris and

provide trash receptacles in accordance with Chapter 49, Property Maintenance, code of the Town of Brookhaven. 14.

All paved areas, including but not limited to parking spaces, must conform with Chapter 49, Property Maintenance, code of the Town of Brookhaven, in order to afford safe passage for pedestrian and motor vehicle traffic in order to prevent hazards to public health, safety and welfare.
