Unofficial results from the Suffolk County Board of Elections show that Republican/Conservative, James Mazzarella crushed his opponent to win the Suffolk County 3rd Legislative District Special Election that was held on May 25, 2021. Board of Elections results show Mazzarella receiving 3,207 votes or (60.3%) to Kate Browning’s 2,106 votes or (39.6 %). This was an extremely important special election for both parties.

Mazzarella, who was endorsed by The South Shore Press for election ran on a families first platform and pledge to work with all levels of government to deliver for the residents of the 3rd LD.

Rail Transfer Station for Yaphank Stalled, State Electeds Respond to Community Concerns, Pull Bill that Would Move Project Forward

An application by Brookhaven Rail LLC that, if approved, would permit construction of a rail solid waste facility and transfer station in Yaphank, is before the United States Surface Transportation Board, (TSB). The project by the West Babylon-based Winters Brothers is facing mounting community opposition, and state elected officials are responding to constituents’ concerns.

Meanwhile, New York State NAACP President Hazel Dukes announced she is joining forces with Town of Brookhaven NAACP President Dr. Georgette GrierKey, NAACP Long Island Regional Director Tracey Edwards and other local organizations to oppose the plan without local approvals or local controls.

In a prepared statement, Dukes said “The company (Winters Brothers carting), is attempting to use the obscure United States Surface Transportation Board to pervert federal laws designed to bolster railroads to silence the people of Brookhaven and avoid local zoning and control,” and is calling on federal, state, county and town officials to “join the fight” to oppose the project.

Legislation that was before the New York State Legislature was withdrawn last week, according to Senator Anthony Palumbo and Assemblyman Joe DeStefano. The bill called for the authorization for the Town of Brookhaven to alienate wooded parkland in Yaphank to facilitate development of a privately owned rail station for the transport of thousands of tons of construction and demolition, (C&D) debris and other materials daily.

The project proposes the construction of a rail station that would transport 6,000 tons of off-island C & D to a solid waste management facility that would be sited in Yaphank. The rail tracks would run through a 60 acre conservation easement in a parcel of property that contains the last wooded lands left in Yaphank.

Brookhaven Town Supervisor Edward Romaine reported in a telephone interview last week that the town has “absolutely no application for a transfer station in the Yaphank area” that he is aware of. Romaine did say, however, that the United States STB, which reviews all rail projects, can override town zoning codes if they so choose. “Not quite,” asserts Citizens for the Campaign Environment (CCE) Executive Director, Adrienne Esposito. According to Esposito, CCE has “asked the Town of Brookhaven to

object to any exemption of local zoning,” emphasizing that “the community should have a voice to express concerns.” The property on which the rail project is being proposed is presently zoned L-1 industrial.

Romaine said transfer stations are zoned L-2. Asked whether he would support the rail project and solid waste management facility being proposed by Winters Brothers, Romaine said he “doesn’t know enough details about the project.”

But Esposito expressed adamant opposition to the project. underscoring that Winters Brothers’ pursuit of a federal permit from the STB should not be issued until the project has been fully vetted by the community. “The Surface Transportation Board is a little known entity, and we want our local laws and regulations to be adhered to,” Esposito told South Shore Press last week. “There are two other rail terminal projects on Long

Shirley Man Pleads Guilty to Killing Woman in DWI Motor Vehicle Crash

Suffolk County District Attorney Timothy D. Sini today announced the guilty plea of a Shirley man for driving while intoxicated and killing a woman in a motor vehicle crash.

Route 83 in Farmingville at a high rate of speed and rapidly changing lanes when he struck the rear of a 2015 Honda Civic, which had become disabled in the right lane and had its hazard lights engaged.

Chris D. Montpetit, 36, pleaded guilty today to Aggravated Vehicular Homicide, a class B felony; Aggravated Driving While Intoxicated, an unclassified misdemeanor; and Reckless Driving, an unclassified misdemeanor. Pursuant to the plea agreement, he is expected to be sentenced to five and two-thirds to 17 years in prison.

She has also earned numerous accolades for her work including NYSASN’s Judith Harrigan Founder’s Award for “exemplary service to NYSASN and the children of New York State,” the Suffolk County Association of School Nurses “Excellence in School Nursing Award” and the SCOPE Education Services “Support Staff Service Award.”

Their own nickname, the Bronx Bombers, represents hard hitting offense. Before the season began almost all of baseball looked at New York’s lineup as the driving force and questioned the arms.

The Yankees opened the season as one of the favorites to win the World Series. They were squarely inside the top 5 teams and were bringing back about a 6 to 1 return. There were high hopes everywhere, but under it all was the question “did they do enough to their pitching staff”.

Each and every season there are rookies who emerge and catch the entire fantasy baseball world by surprise. During this 2021 baseball season, injured players are everywhere. In my mixed ESPN league we expanded our IL player lists from 4 to 5 after the COVID experience of 2020. It doesn’t look like we adequately addressed the issue. 5 of the 12 teams in our league have greater than 5 players on their respective teams’ Injured List. A good rookie can bridge these gaps in your lineup. Even better when their promotion occurred due to an organizational need or their superb play has advanced their timetable.

William Contreras: The younger brother of Cubs catcher Wilson Contreras came into the season as the 6th ranked prospect for the Atlanta Braves and seemed to be ranked below former 1st round draft pick Shea Langeliers. However, when starting catcher Travis d’Arnaud hurt his thumb in a collision at home plate, the organization turned to young

William Contreras. It has been a revelation to watch this young man take to this opportunity so well. In 47 at bats he has slugged 4 home runs already. He has shown patience at the plate walking 6 times and putting up an on base percentage north of .360.

As of this morning he has a .938 OPS. A player’s OPS is the sum of his on base percentage added to his slugging percentage. It is the first line I look at when I am reviewing an offensive player. I really don’t like having players on my fantasy team with OPS numbers below .800. Imagine my delight at having a 23 year old catcher with an OPS above 900 and an opportunity to play in Atlanta due to organizational need and injury. And he remains a free agent in most formats. Contreras is only rostered in 17.6% of ESPN leagues. What are you waiting for?

You might be ready to ask me, Contreras was already taken in my fantasy league, who is on the way that can help me? Let’s look at a few candidates…….

177 strikeouts in 152 innings this year. Garcia and Montgomery are young but promising and haven’t even contrubuted much this season. Then onto the bullpen. The Yanks pen has been anchored by Aroldis Chapman for years and he is looking as good as ever. Chapman has a 0.00 ERA on the season, yes you read that right. He also has allowed just 5 hits in 17 innings and as always has high K numbers with 36 in just 17 innings.

The Yankees lineup has been banged up and hurting, and it’s their pitching that has shined all year. If they can continue this the Bronx Bombers might just turn into the New York Strikeout Exchange.

Rookies Earning Their Keep • Julio Rodriguez – OF – Seattle Mariners – While the rage up in Seattle has been on their other top prospect, Jarred Kelenic, Rodriguez is one of the most feared hitters in the minor leaguers. Kelenic has been a top name for a number of years now, gaining notoriety in the New

York press as he was traded to Seattle.

New Yorkers immediately lamented the trade and missed Kelenic almost immediately. While Kelenic shows tremendous potential as a 5-tool player, Rodriguez is a fearsome slugger. As of this morning, Rodriguez is hitting

.322, he is controlling the strike zone with a .403 on base percentage.

Having hit 5 home runs in 6 of his last games, he is slugging at a huge .695 and his OPS is above 1.00. With a crowded outfield in Seattle, playing time and an opportunity look scarce for Rodriguez. Stash him in your Dynasty league and use that to your advantage.

This is probably the 2022 Rookie of the Year in the American League.

• Jackson Kowar – Starting Pitcher – Kansas City Royals – If you asked me which team in the American League is going to be competing in league championships with the New York Yankees, my immediate response would be the Kansas City Royals. And for one reason, they have tremendous starting pitcher coming up through the ranks. The Royals have tremendous young arms in Brady Singer, Asa Lacy, Daniel Lynch and my favorite of the bunch, Jackson Kowar.

Jackson pitched alongside Brady Singer in the 2017 College World Series in leading Florida to the title,

and they were both drafted in the 1st round of the 2018 draft by Kansas City.

What a changeup this guy throws.

It is described by scouts as a nasty, plus-plus pitch. When the bottom of the pitch drops out at 84-85 mph, both left-handed and right-handed hitters have swung through it. Paired with a 93-96 mph fastball and a mid70 mph curveball, Kowar is simply overpowering the hitters at TripleAAA right now. Little surprise he is 3-0 with 22 strikeouts in 15 innings pitched. The ERA is a scant 1.15 as Kowar will get the call up sometime in 2021. Don’t wait for it to happen. Go grab him now!

Jarred Kelenic is owned in 86.1% of ESPN fantasy baseball leagues. Julio Rodriguez is popular also amongst owners. William Contreras is active and producing at the major league level and is barely owned at 17.6%. Less than 1% of ESPN owners even know who Jackson Kowar is. These players are worthy of adding to your rosters right now.

Unfortunately, no one trained us how to return to civilian life, nor was there anyone there to train our family how to help us return.

As stated in previous articles when we came home not only had we changed but so did our family.

So let’s try to help both the veteran and the family get together again.

In a way the family has the greater problem, so we will start by trying to help the family welcome home the veteran.

When a warrior comes home you see there is something wrong, but he says everything is okay. He knows there is something wrong but he will not tell you. When he was in combat he saw or did something horrible and believes he is protecting you by not telling you. He is also afraid that if he seeks mental health assistance it

will handicap him when seeking employment. Unfortunately you have no idea how to help him or who can, so you may give up.

However help is available. Let’s see how.

Most important, is understanding that you cannot help him alone, but you need help from others. The Suffolk County American Legion has trained over fifty members of its Auxiliary to serve as peers to the families of veterans seeking help. They can work with you as a team. In addition they have trained over a hundred members to work as peer support with your veteran. While the veteran will not expose you to the horror he went trough, he should be willing to talk to another veteran.

So don’t make his talking to you about the issue. Instead, focus on getting him to share with another veteran or someone and getting the help they need.

Giving Your Estate Plan a Spring Cleanup

Spring cleaning has me thinking I may need to update more than my window treatments.

What changes should I be making to my estate plan?

Not unlike our homes and yards, our estate plans may be in need of a spring cleanup too! If it has been a few years since you have visited with your estate planning attorney, now is the perfect time to review your plan to ensure that your documents are up to date.

1.) Have you funded your trust? While trusts have been a popular estate planning technique for many years to protect assets and/or avoid probate, it is important to recognize that trusts are only as good as the assets they own. In other words, unless you have taken steps to actually re-title the asset in the name of your trust, the trust is not protecting the asset. All too often clients leave their attorney’s office thinking that their annuities or investments have been put in their trust, but unless documentation is completed changing the ownership, the asset has not been transferred. A good tip to see whether or not the asset has been transferred is to review your monthly statements to see who owns the account. If your statement is coming in your individual name, instead of in the name of the trust, it is likely that the account is not in the trust.

2.) Are you protecting your beneficiary’s inheritance? A relatively new technique

in trust planning is leaving assets to your beneficiaries in trust rather than outright.

The benefits of descendants’ trusts or inheritors’ trusts are that they give the beneficiary protection against creditors, divorce, and ensure that the assets pass tax free to the next generation. All this and the beneficiary can be their own Trustee. If you have not already incorporated inheritors’ trusts into your estate plan, you may want to consider adding them.

3.) Do your beneficiary designations coincide with your estate planning documents? Another common oversight is not coordinating your beneficiary designations with your estate planning documents. Not all assets pass through a Last Will and Testament or a trust. Assets will only pass through a trust if the asset was retitled in the name of the trust. The only assets that will pass through a Will are those that are in the decedent’s estate; that is, in the decedent’s sole name when they pass away with no beneficiary designation.

Assets which are jointly owned with another person or which designate a beneficiary will not pass through a Will, but automatically.

However, if you have invested the time and money to put together an estate plan you will want to ensure that you are utilizing your documents to their fullest potential.

For instance, if you have incorporated inheritors’ trusts or trusts for the benefit of disabled or minor beneficiaries, you will want to designate those trusts as the beneficiaries of your assets, rather than the beneficiary outright. A word of caution with retirement accounts; not all trusts may be able to accept retirement accounts without negative tax consequences. Your estate planning attorney should discuss your beneficiary designations as part of a comprehensive review of your estate plan.

4.) Are you over-planning or underplanning for estate taxes? The current estate tax exemptions are $11.7 million for Federal Estate Tax and $5.93 million for New York Estate Tax. Your estate planning documents may have tax planning which is no longer applicable to your estate.

Moreover, some estate tax planning may actually hurt your beneficiaries. For instance, some trusts that remove assets from your estate for estate tax purposes will force your beneficiaries to lose a “step-up” in cost basis which would save capital gains tax.

That being said, with the new administration comes the possibility of new estate tax exemptions. There have been proposals of lowering the Federal Estate Tax exemption to $3.5 million and eliminating

the step up in basis. Accordingly, if you previously were not going to be subject to estate tax but now may, you should visit your estate planning attorney for some planning which may include using some of your exemption now while the exemption is still high.

5.) Have you updated your Power of Attorney? Everyone focuses on Wills and Trusts, but a Power of Attorney and other advance directives are just as significant.

It is important to remember that not all Powers of Attorney are created equal.

designate someone to make financial decisions for you are only as good as the powers enumerated within the document.

There was a significant change in the Power of Attorney law in 2010 which changed the statutory form in New York State. As of June 13, 2021, another change to the Power of Attorney will be effective, streamlining the form to make it less complicated and more easily accepted by financial institutions. Be sure not to overlook your Power of Attorney and update if necessary.

Esport games like Animal Crossing, Fortnite and Super Mario Brothers were some of the favorites played. Divorcing couples are confronted with an extraordinarily challenging task – communicating and resolving conflicts over the most important things in their lives – their children – with someone they may distrust, fear or even despise. Nevertheless, parents need to cooperate and communicate with each other to provide a sense of stability and security in their children’s lives.

The following list presents basic guidelines for effective communication.

5. Agree on mutually satisfactory times to talk. Do not negotiate under the influence of drugs or alcohol.

6. Focus on only the problems that need to be resolved. Do not try to physically intimidate your former spouse or play on his/her insecurities.

Listen attentively to the other person’s point of view. Do not pretend to listen while actually shutting them out and formulating your own rebuttal.

8. Accept responsibility for your share of what went wrong. Do not assign blame, rigidly resist your former

spouse’s viewpoint, or insist that your perception of events is the only version of the truth.

By following these rules, divorcing couples will avoid most common pitfalls of conflict negotiations. Of

course, the success of these guidelines depends on both parties agreeing to abide by them as much as possible.

Last week, we wrote about the increasingly more dangerous season ahead. In addition to the forecast update, it was largely about what you and your family should do (like never stay on the boat nor drive through running water.) What about the boat? Tis the season of heavy weather. This column is about that.

Let Me Say It Again…

Never stay on the boat. I know. There are old timers that swear by it. “I’ve saved my boat every time when others were lost.”

With absolute certainty, it is simply because the winds – and seas – never exceeded the operational capacity of the engines. But when they do, you will be lost with the boat.

The boat is just money. You are someone. If you care about the people who care about you, read on – and leave the boat behind while you take your loved ones to high ground.

The Spider Web of Lines

If you can’t get the boat out of the water and on to “the hard”, then you are compelled to protect her in her natural element – the water. But the sea presents forces magnified beyond the speed of the wind – it is the momentum of the wind-driven seas and the tidal surge. The storm tide is added to the astronomical tides. And when those waves hit something solid, they generate force dozens of times more powerful than wind of the same speed. Sandy generated a storm surge of 14 feet. Andrew generated a storm tide of 17 feet. Camille in 1969? 24 feet. Dorian made the Bahamas look like

Hiroshima…

While nothing will save the boat from that, the vast majority of storm-driven tidal surges are significant but really fractions of that. So, with a “spider web of lines”, you can create a fighting chance that your beauty will ride out the storm.

What to use? The universal winner-takeall is old garden hose. OBITUARY

A Love of Nature

What can fill the heart with love and hope better than a stroll in the park?

What can bring joy and peace to the soul better than time spent in the outdoors surrounded by the ones you love? Some of us never find the time or desire to do these things while others relish every hour spent in nature.

William Wayne Meier understood the healing that comes from being in the resplendent beauty of nature. He understood the importance of family as attested to his long and happy marriage to Ginnie and his love for his eight children, eighteen grandchildren and seven great grandchildren.

The simple pleasures of finding solace in going to the beach, fishing, and

boating. He loved taking long drives, and time around a roaring campfire, these are the priceless moments in life. A time for reflection, a time to reconnect with family and friends, a time away from the daily grind of life. Going on vacation and quality time, listening to the music of the 50’s, Elvis, and Blondie. His favorite song was “I’ve finally found someone” which was chosen as Ginnie and William’s wedding song.

He was an animal lover and his very special canine companion was Petie.

William’s most endearing quality was his unconditional love for his family. He loved being with them and sharing in their lives. He was a devoted husband, father, grandfather, and brother.

Please join the family in celebrating William’s life by making donations in his memory to St. Jude’s Children’s Hospital.

WILLIAM WAYNE MEIER, 71, of Mastic Beach, died at Long Island Community Hospital on May 12, 2021. William was born in Baldwin, New York and was a United States Postal Carrier. He loved the outdoors, camping, fishing, vacationing, and nature. He is survived by his wife Ginnie of twenty-three years, his beloved children Kerry, Tracy, predeceased by his son William, Steven (Dayna), Keith (Jenn), Thomas (Teri), Michelle and Donna.

He was the cherished grandfather of eighteen and great grandfather of seven. He was the devoted brother of Willanne Murphy. Family and friends were received at Roma Funeral Home in Shirley on Monday with a private cremation on Tuesday at Mt. Pleasant Cemetery, Center Moriches.

Donations in his memory can be made to St. Jude’s Children’s Hospital.
