Bellport Village Suffers Loss of Deputy Mayor

The tight-knit, quaint hamlet of Bellport Village has lost a beloved public servant with the passing of Trustee Joseph Gagliano. Gagliano passed away peacefully at his home in Bellport on March 21, 2021.

Having served as the youngest school principal at age 24, then subsequently appointed Acting Superintendent of Schools for the Eastport School District, Gagliano was esteemed by his colleagues, peers and students.

Gagliano was regarded as the people’s person who dedicated his life to public service and education.

At the time of his passing, Gagliano was Deputy Mayor of the Village of Bellport. First elected to the Bellport Village Board of Trustees

in 2016, Gagliano was re-elected in 2018, and had just won election this past September to serve a third two-year term. Village elections are traditionally held in June, however, the pandemic prompted officials to conduct the elections in September.

Bellport Village Mayor Ray Fell reflected on Gagliano’s legacy and love for his community. “Joe really loved Bellport Village,” Fell said.

“He was a person of high integrity, he was honest, loyal, kind, and he was the type of guy where, if you said ‘no,’ he would find a way.”

Fell continued, “Joe was a tireless worker who was always dedicated to improving Bellport Village.”

Gagliano was appointed Deputy Mayor by the members of the Village Board of Trustees when he was first elected in 2016. He would

continue to serve in the capacity of Deputy Mayor until his passing.

Gagliano was instrumental in securing FEMA funding for an array of capital projects which the village fronted money for before being reimbursed by FEMA. He assisted with the successful efforts to rebuild the bulkhead at the dock, and he played a pivotal role in securing FEMA funding for the pavilion at Ho Hum-Beach. As the trustee in charge of the village’s highway department, Gagliano spearheaded an effort to expend $730,000 to rebuild the highway yard into a state of the art facility that resulted in the transformation from oil gas pumps to natural gas.

construction of the village’s new salt shed which was mandated by the New York State Department of Environmental Conservation to replace the tarp in the highway yard. “He (Gagliano), was such a positive guy who always looked at the glass as half full,” Fell said. “Joe will be very missed.”

Gagliano viewed former Bellport Village Mayor Frank Trotta as his long time mentor. In his testament to Gagliano, Trotta shared just a few of his thoughts and many fond memories: “Joe was the chairman of my Beach and Dock Commission during my tenure as mayor. He was always a man of great vision and great faith for whom I had great respect. Though small in stature, he was mighty - a fighter for what he believed in, but always with a respectful dialogue.” Citing Gagliano’s love for his family, Trotta said Gagliano was dedicated and passionate about Bellport Village and its waterfront. “Joe led a life of

public service and was dedicated to the people he served as a school superintendent and Deputy Mayor of our village. I will miss our talks, but I know that Bellport is a better village because of him.”

Joseph Gagliano is survived by his wife, Carole, of 49 years, their daughters Jaime (Steve Nolan), Cara (Neil Koenig), and three grandchildren, Jacob Nolan, and Avery and Addison Koenig.

There will be a line on the ballot for a candidate to fill a one year term for Gagliano’s seat in the upcoming June 15, 2021 Bellport Village Board elections. The person who is elected to fill that seat will be required to run for election again in 2022. Up for re-election this year are Mayor Ray Fell, and trustees Robert Rosenberg and Michael Ferrigno. The petition filing deadline is May 11. Polls will be open on Election Day, June 15, from 7 a.m. until 9 p.m. at the Bellport Village Community Center.

Long Island Senate GOP Delegation Joins Congressman Zeldin in Calling on Governor to Fund Critical Veterans Program

Elected Officials are Demanding a Restoration of Funding after Governor Zeroes Out Funding in Budget Proposal As the April 1 deadline for approval of New York State’s Budget nears, Senators Phil Boyle, Alexis Weik, Mario Mattera, and Anthony Palumbo, Long Island’s Republican Delegation to the New York State Senate, joined Congressman Lee Zeldin in calling on Governor Andrew Cuomo to restore funding for the PFC Joseph P. Dwyer Program. The Dwyer Program, initiated in 2012 by then State Senator Zeldin, provides essential peer-to-peer mental health support to veterans across New York State and has been immensely impactful in providing veterans with much-needed emotional assistance during reintegration into civilian life. The Dwyer program is especially a priority to Long Island, as Suffolk County is home to the largest population of veterans in New York State. In fact, Suffolk County has one of the largest populations of veterans of any county in the United States.

“The Joseph P. Dwyer Program has been a resounding success, beginning in Suffolk County and expanding to

counties across the State. I look forward to the Legislature fully restoring this critical funding in the Enacted Budget.

Our veterans sacrificed for us—we owe it to them to ensure they are provided the services they need when they return home,” stated Senator Weik.

“In Fiscal Year 2021, the funding for the Dwyer program totaled $4.5 million. This year, Governor Cuomo proposed completely eliminating funding for this life-saving program.

We demand the Governor restore funding to this critical support resource for our heroes,” stated Senator Boyle.

Joseph P. Dwyer was a United States Army combat medic in the Iraq War who was portrayed in an iconic photo carrying a young Iraqi boy away from danger. Congressman Lee Zeldin, a veteran himself, was instrumental in the creation of the Dwyer Program during his time as a New York State Senator.

“The PFC Joseph P. Dwyer Veteran Support Program saves lives, and at a time when so many of our communities’ veterans feel more isolated than ever before, funding for this critical program has never been more important. This effective,

efficient and tailored program has always received bipartisan support from our local governments up to the State Capitol. However, year after year, this veterans program has been cut off and used as a political ploy in Albany’s budget negotiations, and playing games with our veterans’ lives is unacceptable.

Not only must full funding for the Dwyer Program be restored in this year’s final budget, but this program’s funding must become a permanent component of all future state budgets,” said Congressman Zeldin.

The New York State Senate Majority recently released its one-house bill with a proposal of $4.5 million for funding the Dwyer program, and the New York State Assembly’s one-house bill proposed $6.05 million. In light of this development, the elected officials are demanding that Governor Cuomo approve the Assembly proposal and make permanent the Dwyer Program, which would be, quite literally, lifesaving.

Last year’s Final State Budget included $4.5 million in funding for the Dwyer Program, although a large portion was withheld by the Executive for months on end. The Governor’s budget proposal this year left out the Dwyer Program entirely.

Local Legislators in Budget Fight with Tax and Spend Democrats

Governor Cuomo include the funding needed to maintain and build this invaluable program in the final budget so that those who have been there for our nation when called know that we stand with them when they need us,” stated Senator Mattera.

“The numbers are frightening,” said Assemblyman Joe DeStefano in reporting on what he called a “political statement,” rather than a budget proposed by the Democrats who control state government. “They want an unprecedented 10.9 percent increase in operating expenses and a whopping $6.8 billion in new taxes on a population that already pays the highest taxes in the nation,” the Assemblyman noted. “They are also looking for another $7.8 billion in new taxes in the following year.”

“New York taxpayers just can’t take it anymore and are leaving in droves,” said Assemblywoman Jodi Giglio, who pointed out that the Empire State leads the nation in population loss. “Instead of sharpening their pencils and giving people a reason to stay, they’re choosing to sock it to those left behind with outrageous spending increases and tax hikes.”

The poor fiscal health of New York is even more troubling when you compare the out-of-control spending to other large states. The proposed $208 billion price tag puts New York in the same ballpark as California, which has an annual budget of about $227 billion, but twice the population, according to DeStefano. Texas, with 10 million more residents than New York, spends $96 billion less while Florida with two million more spends $111 billion less.

“What makes these figures even more disturbing is the fact that New York is receiving $12.7 billion in federal funding as part of the COVID bailout. As much as $10 billion of the federal dollars have not even been earmarked for specific purposes leaving everyone to wonder where all the money is going,” Giglio said, noting that higher taxes are being called for even as revenue is coming in at a higher rate than previously expected.

“While restraint and fiscal prudence are still necessary, the immediate budget crisis is not as severe as we thought,” said Will Barclay, the leader of the assembly Republicans. “Raising taxes permanently on New Yorkers still

reeling from one of the worst economic collapses in a lifetime while sitting on $10 billion in cash is both illogical and insulting.”

Thanks to years of mismanagement by the embattled Governor Cuomo, aided and abetted by the tax-and-spend Democrats who rule Albany from their New York City power base, the state was already facing a $7 billion budget deficit even before the COVID pandemic struck. Long Island legislators lead the fight statewide to rein in the poor economic policies that have led New York to ruin.

“My colleagues and I have repeatedly called for more fiscal responsibility when it comes to state spending and managing the budget,” DeStefano said. “Incredibly, a major economic crisis has emboldened Democrats to spend billions more and raise taxes accordingly. This year’s budget could have been an opportunity to reduce waste, use the federal money to bail out the taxpayers, and put New York back on the right economic track.

Instead, the Democrats refuse to face reality and are making a bad situation even worse.”

Browning Release Acknowledges Term Limits

Back in 2016, then-Legislator Kate Browning publicized the fact that she was getting sworn in for her “6th and Final Term.”

Fast forward five years and Browning is at it again, trying to get her old seat back despite being barred from doing so by the Term Limit Law approved by voters in 1993. After already serving 12 years, Browning is challenging community activist Jim Mazzarella to get back on the county payroll in an effort that the attorney who wrote the Term Limit Law said would be illegal.

The former Counsel to the Suffolk Legislature, Paul Sabatino II, said a lawsuit knocking her off the ballot would be a “slam-dunk case.”

The New York Attorney General has also setup a site where you can determine whether the company offering to provide assistance is reputable and also a way to report those that are not. Their site is available at Homeownerhelpny. com.

It is important for Suffolk County residents to utilize these tools to increase the likelihood that they avoid foreclosure.

Browning Can’t Circumvent the Law Dear Editor: As a long-time Shirley resident, I must say I’m disappointed with exlegislator Kate Browning trying to get back in office after running out the clock on term limits. The law is clear: no one can serve in the Suffolk Legislature for more than 12 years. You cannot leave and then come back. The voters said so in a special referendum back in 1993 which I voted on.

The intent of the term limit law was to make sure we had new people with fresh ideas representing us. The county legislature is not meant to be like Congress where you have politicians holding onto their seats for life. Forward-thinking legislators proposed the term limits for our county government and the voters agreed. I don’t think Kate Browning is entitled to circumvent the law and go against the will of the people.

The event, which is co-sponsored by the Town of Brookhaven’s Department of Recycling and Sustainable Materials Management, TEACHERS Federal Credit Union and Keep America Beautiful, Inc., will be held on Saturday, May 15 at various locations throughout Brookhaven Town. All participants must follow New York State COVID-19 guidelines including social distancing and face masks.

The Great Brookhaven Clean Up is part of a national effort that draws over 5 million volunteers in more than 20,000 communities across America who come together to pick up litter and clean miles of roadway, rivers, lakes, and more. Last year, the Great Brookhaven Clean Up was canceled due to the COVID-19 pandemic. In 2019, the event drew over 3,000 residents.

Supervisor Romaine said, “The Great Brookhaven Clean Up is back after being canceled last year, so there’s much to be done in 2021. Keeping Brookhaven clean is a top priority of my administration and this is a great opportunity for people to do their part and make a difference in their community. sponsorship and I look forward to working with our residents on May 15 to help make Brookhaven a cleaner, greener place to live.”

Free gloves, trash bags and t-shirts will be provided by the Town for the Great Brookhaven Clean Up volunteers. The supplies will be available for pick up by appointment only at the Department of Recycling and Sustainable Materials Management’s third floor office at Town Hall from May 3 to May 14 during regular business hours of 9:00 am to 4:30 pm. Evening pick-ups are scheduled for May 11 and May 12 from 4:30 pm to 8:30 pm. Brookhaven Town Hall is located at 1 Independence Hill in Farmingville. An appointment for pick up must be made during online registration. Masks are required at all times during supply pick up at Town Hall.

SUFFOLK CLOSEUP

BY KARL GROSSMAN “Long Island Solar Roadmap” is the title of a just-released report on how solar power has “the potential to generate more electricity than Long Island uses each year.”

The report was “spearheaded” by The Nature Conservancy and Defenders of Wildlife and involved a “consortium” of “38 local stakeholders,” says a statement issued with it.

This included people from the Sierra Club; Renewable Energy Long Island; Long Island Regional Planning Council; Suffolk Legislator Bridget Fleming; Peconic Land Trust; Clean Energy of New York; Sustainability Institute of Molloy College; Long Island and New York State power authorities; Suffolk Community College; Long Island Farm Bureau; Land Trust Alliance; and from individual Long Island towns.

The initiative was supported by a grant from the Doris Duke Charitable Foundation.

The report not only covers what can be done but recommends strategies for “implementing” the roadmap. It describes specific solar power potentials in areas throughout Suffolk and Nassau— including, in detail, in the Town of Brookhaven.

Also, “public opinion research… found that 92 percent of Long Islanders surveyed endorse the use of mid-tolarge-scale solar, and the technology is especially popular when sited on parking lots and rooftops and when projects are developed and installed by local companies.”

It quotes Ms. Price declaring: “Solar power offers incredible benefits. This report shows that in scaling up solar, we don’t have to choose between one ‘green’ good—clean energy—and another— undisturbed forests, open spaces, and farmland. Even on densely populated Long Island, with the right approach we have room for it all.”

Fog!

Anybody notice the intense fog we had on several days this season? “Can’t see my hand in front of my face” kind of stuff… For those of a more scientificbent, fog that forms when water is warmer than the air is called “steam” fog (Fall). Think of that pot of spaghetti water you are boiling. Fog that forms when the water is colder than the air is called “advection” fog (Spring). There is a third kind of fog called “radiation” fog. That is the fog that you see float in across the backyard or linger in a dip in the country road…

But fog is fog. You can’t see the land or the buoys or, worse, the bow! What to do?

Well, with the dropping price of radar, boats in the mid-20’ range can now be found to have radar aboard.

If you do have radar aboard, read the manual and get familiar with gain controls. I won’t waste space in this newspaper lending advice to a skipper that already has a state of the art system aboard on how to use it. Not surprisingly however, the advice below holds for the 65’er with radar and

chart overlay capabilities as well as the skipper in the 17’ open boat with a 90hp Merc on the stern. When the fog rolls in…

Slow down to “a slow bell”, that is, with forward propulsion necessary to maintain steerage, but no greater. Put on life jackets.

While underway and making way, that is, engine in gear, give 1 “prolonged” blast on your whistle (4-6 seconds). This is specified in the Navigation Rules, Rule 35(a). In fact, the Rules say “not more than 2 minutes apart.” Let me make it plainer. No LESS than every 2 minutes.

While underway but not making way, that is, dead stop on the engine but not at anchor, give 2 “prolonged” blasts, separated by a couple of seconds apart, no less than every 2 minutes. This is Rule 35(b).

If necessary to anchor due to visibility (none!), “boats less than 39 feet 4 inches (12 meters) in length may make an efficient sound signal at intervals of not more than two minutes.” In short, it is not specified for boats under 12 meters.

Listen. Bring your engine to dead stop from time to time and listen. Listen for the sound of surf (move away from that!), buoy whistles/horns/bells (move towards that, carefully) or other engines (sound danger whistle right away and take all way off – but don’t turn off the engine!)

So, now you are properly communicating with other boats but you do want to get in out of the fog if you can. How? Don’t, as some old chestnuts might advise, hug the shore.

As the fog intensifies and you draw closer and closer to shore, you know what will happen. Of far more danger, don’t “hug the shore” when you are outside the Inlet. If you get caught in the surf line (see 5 above), you will be capsized and now there is imminent threat to life.

If you can’t see, you must stop, drop the hook, sound your warning horn as specified and wait out the fog. If due to electronics (GPS, Loran) you realize that you are in a heavy traffic lane, get

out - at a slow speed and just enough to be out of the traffic. But if you can’t see past the bow and you are underway and making way, you are in extreme danger of having a collision at sea.

run out of fog. Think about getting a simple whistle. Get the “pea-less” kind in case you have to worry about your spittle freezing one cold and foggy day… and blow, baby, blow…!

If you have some visibility, see #’s 1 and 2 above. The slower speed will help in another way as well – you can hear better. Lastly, if you have those canisters of compressed gas as your boat’s horn/whistle, you will likely run out of compressed air before you

Can You be Removed from a Deed without Your Consent?

Q: Can you be removed from a deed without your consent?

A:

In general, a person cannot be removed from a deed without his or her consent and signature on a deed. Absent legal action with a court order, such as a foreclosure or a partition action, the only way an owner’s interest in real property can be transferred is by a properly executed, acknowledged and recorded deed conveying that owner’s interest to a new party. If two or more people own real property jointly as tenants in common, a co-owner is unable to remove the other co-owner by executing a new deed – a person can only convey what they own. A title company will search all transfers to certify the record owners and those

with an interest in the property will be required to execute the deed to the purchaser.

To illustrate, if A and B own a property together as tenants in common, each owning a fifty percent interest and A executes a subsequent deed transferring the property to C without B joining the deed, A only conveyed what she had, a fifty percent interest to C. B remains the owner of the other fifty percent interest, and is now a co-owner with C. In contrast, if property is owned as tenants by the entirety, customarily between spouses, then a co-owner cannot transfer his or her half without the consent of the other. In New York State, if a couple divorces, the joint

BY ROBERT CHARTUK As a youngster, it made sense that if you could ride a skateboard and surf, you should also be able to ski. There were no snowboards back in the 1970’s and the closest we got was a Snurfer, a crude piece of wood that I tried out on the little slope leading down to Neville Park and fell flat on my face. Even though it had a rope you could hold on to, it seemed impossible to ride, similar to the straight plank surfboards that the early shapers were putting out at the time.

The moment of truth in my skiing life came in the 10th grade during a school trip to Hunter Mountain.

Beginners were sent to the bunny hill and I remember the skis they rented us were so pathetic the wood underlay was showing and the boots were attached by rudimentary clamps. After numerous enthusiastic attempts, I just couldn’t do it and repaired back to the bus to drown my shame with some of the beverages we had smuggled aboard. There were still a few hours to go when one of the chaperones, Mrs. Roach, asked if anyone wanted to use her all-area pass. I summoned up the courage and attached it to my coat. My disposition told me to skip the bunny slope and I jumped on the lift heading straight to the top. I did not understand the signs indicating Black Diamond or

Green and found myself staring down the sheer face of the Double Diamond known as Upper K2, named for the second highest mountain in the world.

There was no turning back now.

Similar to getting thrown off the dock to learn how to swim, I made my move and found myself accelerating much faster than I ever wanted to go. I was resigned to the fact that I was going to die and then a miracle happened.

The slow speed of the bunny hill was what was holding me back. There, I couldn’t go fast enough to turn like I would speeding down the big hill at the Shrine on a skateboard or cranking across a wave. Flying down K2, I channeled my inner Speed Racer and could make turns to bleed off the speed.

On my very first trip to a mountain, I was skiing! That is, until I was introduced to Mr. Mogul and wiped out in spectacular fashion. Nothing broken and encrusted with snow like a Yeti, I was able to regroup and give it another go. I eventually got down the face and promptly went back up, this time going down a single diamond trail aptly named Hell Gate. It wasn’t as harrowing as its nasty cousin and soon I was skiing like I was born there.

Many mountain adventures followed, the most memorable of

which were under the lights at Song Mountain when I attended Oswego College. One of the kids in the ski club was local to the area and knew how to get into a private lodge nearby where we would hang out between sessions. I had one of those Bota skin flasks filled with Jack and we were on the top of the world. By then I could ski rather well and one night while racing down the slope, some guy cut across my grille and I nailed him. Myself and my skis ended up further down the mountain and I quickly got back on the horse and split, leaving the guy to cuss and moan like it

was my fault. At the bottom, I let the ski patrol know they had a victim up there.

Song Mountain set the stage for one of the strangest episodes I’ve ever known involving the affairs of the heart. My roommate didn’t ski, but his girlfriend did and we would be the last to get off the bus when it reached Oneida Hall. They were destined to be married, having passed muster with each other’s family, and it was all planned out that after graduation they would live happily ever after as Mr. and Mrs. It was in college when I first heard of a special degree that

young ladies would seek at institutions of higher learning. It wasn’t a BA or a BS diploma they wanted, but an Mrs. I’m not sure what the girlfriend was thinking at the time, though I was quite taken aback when she told me she wasn’t getting off the bus. “I’m going to spend the rest of the night with Frank,” she told me as a matter of fact.

It turns out that while I was speeding down the hills and reposing with my buddies in the secret lodge, she was having a grand ole time skiing with the bus driver. She was a 19-year old coed and he was a married bus driver with three kids. “Just tell him I’m not getting off the bus,” was all she said to help me explain the situation to my roommate who would sit looking out the secondfloor study hall window every Friday night awaiting our return. Her dad was a psychiatrist and if you were to invent the exact opposite person a shrink would want his daughter to marry, you couldn’t have found a more perfect candidate than Frank. My roommate was devastated and so was his family, his mother of which flew up to Oswego the next day to console him. Incredibly, the girlfriend and the bus driver got married—I was even in the wedding party—and they ended up having a couple of kids. I think they’re still living happily ever after.

Some 2,709,918 Americans served in Vietnam. Less than 1/3rd that served are alive today and they are estimated to be in their 60s. Some 9,087,000 military served on active duty during the war. Of them 7,484 were women of which 6,250 were nurses.

The Vietnam Veterans of America (VVA) was founded in 1978 with a small group of Vietnam veteran activists going to Washington, D. C. looking to support the creation of an advocacy organization devoted exclusively to the needs of Vietnam Veterans. They initially became known as the Council of Vietnam Veterans. In the summer of 1979 they transformed into Vietnam Veterans of America, a veterans service organization made up of,

The VVA is chartered by the United States Congress and dedicated to Vietnam veterans and their families.

Unfortunately they were not respected when the returned from the war by the communities who were against the war from the start.

The communities were not aware that the government sent them to the war and that they had no choice, but had to go or go the jail.

In 1983 they took a significant step by founding Vietnam Veterans of America Legal Service to provide assistance to veterans seeking benefits and services from the government. By working under the

OBITUARY

On March 12, 2021, Sheila D. DiMaggio, eighty-seven, who was a long time resident of our community passed from this world for her eternal reward in Heaven. She had been living in Mastic Beach since 1959. In addition to being a devoted wife to her late husband Vincent, and raising her seven children, she owned and operated DiMaggio Outerwear from 1976 to 1996 and was the head seamstress.

Sheila learned early on that she could manage all the challenges in her life with great efficiency. She

Sewing Together a Family was a businesswoman, a seamstress, wife, mother, and eventually a grandmother. While she wore many hats, each one not only fit her well, but enhanced her beauty. She loved all the roles she played. Much like her ability to stitch pieces of fabric together and create a seamless article of clothing, Sheila was able to juggle all the obligations in life seamlessly.

Sheila loved flowers and gardening. She loved being outdoors and watching the birds was a great pastime she enjoyed.

She was predeceased

SHEILA D. DiMAGGIO, 87, of Mastic Beach since 1959, passed away on March 12, 2021 at Long Island Community Hospital. She was born in Brooklyn to Paul and Dorothy Malloney. She was a homemaker, loving wife, mother, and grandmother. Sheila is survived by her seven children Cathleen DiMaggio , Domenick (Kim), Vincent (Linda), Daniel, Donna DiMaggio Russello (Frank), Terri Anne Schill (Thomas) and predeceased by Paullette Francine DiMaggio (Lorraine), she was the beloved grandmother of seven.

Family and friends were received at Roma Funeral Home of Shirley on Monday with burial on Tuesday at Calverton National Cemetery. by her beloved spouse Vincent who passed away in 2010. She was the loving mother of her daughter Paullette Francine who also

predeceased her and leaves behind her spouse Lorraine. She is survived by her children Cathleen DiMaggio, Domenick (Kim),

Vincent (Linda), Daniel, Donna DiMaggio Russello (Frank), Terri Anne Schill (Thomas) and was the cherished grandmother of seven.

Now, reunited once again, Vincent and Sheila, will thread the fabric of their lives forever.

LEGAL NOTICES • LEGAL NOTICES • LEGAL NOTICES PUBLIC NOTICE AMENDED APPLICATION OF SUNRISE WIND LLC WITH THE NEW YORK STATE PUBLIC SERVICE COMMISSION FOR A CERTIFICATE OF ENVIRONMENTAL COMPATIBILITY AND PUBLIC NEED FOR THE CONSTRUCTION OF THE SUNRISE WIND NEW YORK CABLE PROJECT PLEASE TAKE NOTICE THAT, on December 9, 2020, pursuant to Article VII of the Public Service Law of the State of New York, Sunrise Wind LLC (the “Applicant”), a 50/50 joint venture between Orsted North America Inc. (“Orsted NA”) and Eversource Investment LLC (“Eversource”), filed an application (“Application”) with the New York State Public Service Commission (the “NYSPSC”) for a Certificate of Environmental Compatibility and Public Need (“Certificate”) to construct, operate, and maintain the Sunrise Wind New York Cable Project (the “Project”). The Applicant plans to file an amendment to its Application on or about April 12, 2021 (the “Amendment”).

DESCRIPTION AND PROPOSED LOCATION OF THE PROJECT The Applicant executed a 25-year Offshore Wind Renewable Energy Certificate (“OREC”) contract related to the Sunrise Wind Farm (“SRWF”) and the Project with the New York State Energy Research and Development Authority (“NYSERDA”) in October 2019. The Project will deliver power from the SRWF, which will be located in federal waters on the Outer Continental Shelf (“OCS”), to the existing electrical grid in New York (“NYS”). The Project includes offshore and onshore components within NYS that are subject to Public Service Law Article VII review and will interconnect at the existing Holbrook Substation, which is owned and operated by the Long Island Power Authority (“LIPA”).

The Project’s electrical transmission facilities will be comprised of both onshore and offshore cable systems. Specifically, power from the SRWF will be delivered to the existing mainland electric grid in the Town of Brookhaven, Suffolk County, New York via distinct Project segments: the submarine segment of the export cable (the “SRWEC”), which will be located in both federal and NYS waters (the NYS portion of the cable is referred to as the “SRWEC–NYS”); the terrestrial underground segment of the transmission cable (the “Onshore Transmission Cable”); the new Onshore Converter Station (the “OnCS–DC”); and the underground segment of interconnection cable (the “Onshore Interconnection Cable”). The Onshore Transmission Cable, the OnCS–DC, and Onshore Interconnection Cable will be located in the Town of Brookhaven, Suffolk County.

The SRWEC–NYS is a direct current (“DC”) electric cable (320 kilovolt [“kV”]) that will deliver electricity generated by the SRWF. The SRWEC enters NYS waters at a point 3 nautical miles (“nm”) offshore from Fire Island and will consist of one submarine export cable bundle up to 6.2 miles (10 kilometers [“km”]) in length in NYS waters to the landfall location on the eastern portion of Smith Point County Park on Fire Island in the Town of Brookhaven, and a segment up to 1,575 feet (480 meters) located onshore and underground up to the transition joint bays (“TJB”) within the parking lot for Smith Point County Park.

The transition of the SRWEC–NYS and Onshore Transmission Cable will occur where the cables will be spliced together at colocated TJBs and link boxes that will be installed in the parking lot within Smith Point County Park. The Onshore Transmission Cable will consist of one underground DC transmission circuit (320 kV) up to 17.5 miles (28.2 km) in length that will be located within existing developed rights-of-way (“ROW”) to the extent practicable in the Town of Brookhaven.

From the TJB, the Onshore Transmission Cable will run parallel to Fire Island Beach Road within the paved Smith Point County Park parking lot, crossing the William Floyd Parkway to a recreational area located to the west of William Floyd Parkway. The Onshore Transmission Cable will then be routed across the intracoastal waterway in a northwest direction to a paved parking lot within the Smith Point Marina along East Concourse Drive. From here, the Onshore Transmission Cable will be routed north and east along East Concourse Drive to the intersection at William Floyd Parkway. The Onshore Transmission Cable will then extend north along William Floyd Parkway to the intersection with Surrey Circle. The Onshore Transmission Cable will be routed along Surrey Circle and will continue north along Church Road crossing under the Long Island Rail Road (“LIRR”) to Mastic Boulevard. The Onshore Transmission Cable will travel west along Mastic Boulevard to the intersection with Francine Place and then turn north on Francine Place to the intersection with Montauk Highway.

The Onshore Transmission Cable will cross Montauk Highway to Revilo Avenue and will continue north along Revilo Avenue crossing Sunrise Highway and continuing north to the intersection with Victory Avenue. The Onshore Transmission Cable will continue west on Victory Avenue, crossing Carmans River, to Horseblock Road. The Onshore Transmission Cable will continue northwest along Horseblock Road to Manor Road. The Onshore Transmission Cable will turn north onto Manor Road and cross the LIRR to Long Island Avenue. The Onshore Transmission Cable will then be routed west along the Long Island Expressway (“LIE”) South Service Road and continue to Waverly Avenue where it will turn south to Long Island Avenue. The Onshore Transmission Cable will then follow Long Island Avenue west to Union Avenue to the OnCS–DC. Power from the Project will be delivered to the NYS electric grid via a new OnCS–DC to be constructed in the Town of Brookhaven. The purpose of the new OnCS–DC is to support the Project’s interconnection to the existing electrical grid by transforming the Project voltage to 138 kV alternating current (“AC”). Interconnection to the electric grid will occur at the existing Holbrook Substation, which is also located in the Town of Brookhaven, via the Onshore Interconnection Cable.

The Onshore Interconnection Cable will consist of two underground 138 kV AC circuits, approximately 1 mile (1.6 km) in length, which will connect the new OnCS–DC to the existing Holbrook Substation. The Onshore Interconnection Cable will be routed west along Union Avenue from the OnCS-DC and then continue north within utility owned or controlled properties to the existing Holbrook Substation in the Town of Brookhaven.

This State of Emergency has been declared because there is a reasonable apprehension of transmission of COVID-19 cases in the Town of Brookhaven. From the date of this Executive Order until April 30, 2021, the Town Board of the Town of Brookhaven hereby authorizes and permits the use of outdoor areas on private parcels of existing businesses in the Town of Brookhaven as drive in movie theaters subject to the following: 1. All areas designated for drive-in movie theater use must be situated at least one thousand (1000) feet from any residential property lines in the Town of Brookhaven. 3. The permissible event hours shall be daily, including weekends, commencing from sunset with the last movie commencing at 11:30 p.m. 4. At all times, all employees and guests shall strictly adhere to social distancing guidelines and occupancy restrictions imposed by the Governor of the State of New York, including but not limited to maintaining a distance of six (6) feet from other individuals and/or wearing a face mask or cloth face covering that covers your nose and mouth when six (6) feet of social distancing cannot be maintained. 5. The Host/ Applicant is responsible for implementing all necessary cleansing/ disinfecting procedures for any on-site restroom facilities. 6. The Host/ Applicant is responsible

for the designation of appropriate parking stalls which are at least six (6) feet apart in order to adhere to social distance guidelines imposed by the Governor of the State of New York. 7. Food trucks and mobile concessions in specifically designated and approved areas are permitted provided that all queue lines have floor markings at a distance of six (6) feet apart in order to ensure that individuals maintain a distance of six (6) foot distance. 8. The sale of alcohol Is strictly prohibited. 9. Attendees shall remain within their vehicles at all times except to utilize the restrooms or make purchases from food trucks/mobile concessions. 11. No fee shall be charged for drive-in movie theater applications. 12. The Host/ Applicant is permitted one (1) advertisement sign per street frontage not to exceed thirty-two (32) square feet in area and shall not be placed in the Town’s right of way or in a location that will obstruct or impair vision or traffic in any manner or create a hazard or disturbance to the health and welfare of the public. 13. The Host/ Applicant is responsible for maintaining the events/parcels free of trash and other debris and provide trash receptacles in accordance with Chapter 49, Property Maintenance, code of the Town of Brookhaven. 14.

All paved areas, including but not limited to parking spaces, must conform with Chapter 49, Property Maintenance, code of the Town of Brookhaven, in

order to afford safe passage for pedestrian and motor vehicle traffic in order to prevent hazards to public health, safety and welfare.

Motor vehicle wash facilities shall be permitted to maintain an Outdoor Accommodation Area limited to a customer waiting area only.

COVID-19 Social D i s t a n c i n g Accommodations may be granted via administrative review and shall be subject to any conditions the Commissioner of Planning, Environment and Land Management, or his/her designee, deems appropriate. Submission of applications shall be on a form provided by the Commissioner of Planning, Environment and Land Management.

Said application form shall replace current application forms used for land use applications, building permits and tent and membrane structures, as may be applicable. D. The application must be for a legally existing permitted use with a valid Certificate of Occupancy.

2. Parking spaces may be used without penalty for loss of parking stalls, however, a physical barrier or separation to protect customers from vehicle traffic, such as bollards, substantial planter boxes or similar barrier, must be installed.

The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, may request a parking analysis to ensure that adequate parking for facility is always provided.

COVID-19 Social D i s t a n c i n g Accommodations must meet Fire Code standards, including points of egress, access to fire extinguishers, and tent and awning ratings, if applicable.

Nothing herein shall permit outdoor bars, taverns or nightclubs.

Nothing herein shall be construed as to amend, repeal, supersede, override or alter the Alcoholic Beverage Control Law. G. If a tent or canopy is to be used, New York State and Town Code requirements for tent and membrane structures must be complied with.

H. Handicapped/ADA parking stalls may not be used for Outdoor Social D i s t a n c i n g Accommodation Areas.

The blocking of handicapped/ADA routes (path from ADA parking stalls to sidewalk curb ramps to store entrances) is prohibited. Do not reduce sidewalk widths to less than 36”. I. Removal of existing natural areas or required buffers is prohibited.

J. Outside loudspeakers or exterior live entertainment COVID-19 Social D i s t a n c i n g Accommodation Areas shall be prohibited within 1,000 feet of any structure used for residential purposes.

Town Code Chapter 50 must always be complied with.

K. Installation of barriers,

bollards, planters or other portable structures to prevent vehicles from entering the COVID-19 Outdoor Social Distancing Accommodation Areas if said area is located within a parking lot or grass area.

L. The submission of a plan meeting the following requirements: 1. Depict the location of proposed tents, other membrane structures, and canopies, inclusive of support ropes and guy wires, outdoor seating, display areas, public assembly areas, equipment or other items.

Plans can be hand drawn on existing survey, site plan or aerial map from Google Maps/Earth, Bing, etc. 2. Depict the location within the COVID-19 Social Distancing Accommodation Areas, and the dimensions of, outdoor or indoor seating tables and/or chairs, display racks and/or tables, equipment or other items, service/customer aisles, and pathways from business to outdoor or indoor seating/area. Those occupying separate dining tables within COVID-19 Social Distancing Accommodation Areas must be spaced at least six (6) feet apart. All spacing within the outdoor or indoor areas must meet any other applicable current social distancing requirements. 3. Indicate the total number of seats for take-out restaurants, restaurants, or major restaurants thereon. The County of Suffolk Guidance Memorandum for Outdoor Seating in Food Establishments must be complied with.

Depict or provide a narrative of the steps to be taken to ensure overall site circulation is safe for vehicles, occupants and staff which may need to traverse drive aisles to access accommodation areas i.e.: pedestrian markings or signage. M. The Commissioner of Planning, Environment and Land Management, or

his/her designee, shall take existing improvements into consideration and determine whether or not additional on-site improvements are necessary and/or appropriate, including but not limited to drainage, parking, curbs and walks, landscaping and fencing, and may require such improvements as part of his/her approval of said.

N. The applicant shall provide any additional information and documentation which the Commissioner of Planning, Environment and Land Management, or his/her designee, deems necessary and appropriate for his/her review of the application.

O. The Commissioner Planning, Environment and Land Management, or his/her designee may, at his/her discretion, refer any COVID-19 Social D i s t a n c i n g Accommodations to the Planning Board as s/he deems appropriate. P. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, is hereby authorized to review and approve COVID-19 Social D i s t a n c i n g Accommodation Pick-up Windows subject to the following: 1. The Commissioner of the Department of Planning, Environment and Land Management, or his/her designee, approval shall be for the façade changes only. Nothing herein shall be deemed to supersede, amend or otherwise affect the authority of the Chief Building Inspector as a Code Enforcement Official for compliance with all New York State Uniform Fire Prevention and Building Code requirements.

2. The application must be for a legally existing permitted use with a valid Certificate of Occupancy. 3. If located within an Historic District or Historic District Transition Zone, the

The applicant shall provide any additional information and documentation which the Commissioner of Planning, Environment and Land Management, or his/her designee, deems necessary and appropriate for his/her review of the application.

V. All COVID-19 Social

D i s t a n c i n g Accommodations approvals shall expire on April 30, 2021 and all items located in said area shall be removed no later than May 12, 2021. W. Approval for a COVID-19 Social D i s t a n c i n g Accommodations shall not negate or permit any violation which may exist on the subject premises at the time of approval of such accommodation. X. I hereby temporarily suspend or modify, for the period from the date of this Executive Order through April 30, 2021, the following: 1. Town Code Section 3-1(1) is hereby suspended to the extent that a take-out restaurant, restaurant or major restaurant with an authorized COVID-19 Social Distancing Accommodation area shall be permitted to serve alcohol in a place open to the general public limited to the COVID-19 Social D i s t a n c i n g Accommodation area only.

2. Town Code Section 163(L) is suspended to the extent that permits issued for said accommodation shall be valid until March 31, 2021. 3. Town Code Section 16-4(C) is suspended to the extent that debris affidavits shall not be required to obtain a Certificate of Occupancy, Certificate of Compliance, or their equivalent. 4.

Town Code Sections 85113 and 114 are hereby suspended to the extent that applications for a COVID-19 Social D i s t a n c i n g Accommodation shall not require an amended site plan application or new site plan application or change of use application or special permit application and shall not be subject to a public hearing.

COVID-19 Social D i s t a n c i n g Accommodation applications shall be on a form approved by the Commissioner of Planning, Environment and Land

Management, or his/her designee. Said application reviewed and approved via an administrative approval of the Commissioner of Planning, Environment and Land Management, or his/her designee. Building permits and Certificates of Compliance shall be required. 5. Town Code Section 85-107 is hereby suspended and shall not apply to a COVID-19 Social Distancing Accommodation Area. 6.

Town Code Section 85190(A) is hereby suspended to the extent that outdoor places of worship shall be permitted. 7. Town Code Sections 85-190(A) and (B) are hereby suspended to authorize a COVID-19 Social Distancing Accommodation area to be used in conjunction with legal pre-existing nonconforming permitted uses.

Town Code Sections 85-190D(1), (2), (3) and (6) are suspended to the extent that a Board of Appeals special permit shall not be required and is subject to administrative review by the Commissioner of Planning, Environment, and Land Management, or his/her designee, pursuant to this Order as a COVID-19 Social Distancing Accommodation Area. 9.

Town Code Section 427(H) and (K) are hereby suspended to the extent that Alternate Indoor Dining Spaces shall not require a Planning Board special permit and are instead subject to administrative review by the Commissioner of Planning, Environment and Land Management, or his/her designee, as a COVID-19 Social D i s t a n c i n g Accommodation Area. 10.

Town Code Section 85430(E) and (F) are hereby suspended to the extent that outdoor display and outdoor seating as an accessory use to a restaurant, take-out restaurant or major restaurant shall not require

a Planning Board Special permit and is instead subject to administrative review by the Commissioner of Planning, Environment and Land Management, or his/her designee, as a COVID-19 Social Distancing Accommodation Area. 11.

Town Code Section 85849A is hereby suspended to the extent necessary to permit COVID-19 Social D i s t a n c i n g Accommodation areas. 12.

Town Code Section 85461 and 85-464 are hereby suspended to the extent that outdoor display shall not require a Planning Board special permit and is instead subject to administrative review by the Commissioner of Planning, Environment, and Land Management, or his/her designee, as a COVID-19 Social D i s t a n c i n g Accommodation.
