Congressman Lee Zeldin, (R, NY1), announced last week he is actively seeking a run for New York Governor against Andrew Cuomo in the November 2022 election. Cuomo’s exercising of his emergency powers during the pandemic to place infected patients in nursing homes, coupled with recently escalating allegations of sexual harassment, are what in part, prompted Zeldin to take a serious look into the possibility of replacing Cuomo, should he seek reelection in November 2022. Zeldin reported in an interview last week “I am actively exploring a run for Governor of New York against Andrew Cuomo in 2022. I am upset with the Governor and I can’t sit back and watch Cuomo’s attacks on our freedoms, our wallets and our safety.”

Asked whether Cuomo should step down immediately or remain in office to finish his third term, Zeldin promptly asserted the Governor should resign: “I believe Cuomo should resign for a number of reasons, and the nursing home cover-ups are grounds for his resignation.” Zeldin added, “After his nursing home coverup, bullying, abuse and harassment have come more to light in recent days and weeks, it’s clearer now more than ever that he’s been in the Governor’s office too long, and it’s time for Cuomo to go.”

Zeldin said his decision to explore a run against Cuomo came after receiving “many messages of encouragement” and after “discussing it at length” with his wife and the couple’s two daughters.

“Over the course of the past few weeks,” Zeldin said, “I have received many calls, texts and emails across New York State, where so many people are passionately and emotionally asking me to run. So I have actively started exploring a run after seeing the state of our state and the people’s desire for Cuomo to leave office,” Zeldin said.

Speaking to the Governor’s policies on the handling of nursing homes at the height of the pandemic and accountability measures that are being called for, Zeldin said, “The families of thousands of dead New York seniors deserve accountability and justice for the true consequences of Governor Cuomo’s fatally flawed nursing home policy. It has been reported that over 9,000 infected patients were placed in nursing homes with healthy residents as a result of Cuomo’s directive.”

Addressing the Governor’s manner of handling emergency powers that prompted New York State Attorney General Letitia James to launch an investigation into Cuomo’s policies and actions, Zeldin said, “We have witnessed the Cuomo cover-up go off the rails, with the state’s Attorney General revealing his administration underreported nursing home deaths by 50%, one of his top advisors admitting that nursing home death information was withheld to thwart a Department of Justice investigation, and, most recently with Governor Cuomo doing his dirty work

For far too long, Andrew Cuomo has run amok, wreaking havoc across the State of New York, using intimidation to cover up his rich history of bullying, threats, intimidation and harassment. Within his administration, Cuomo institutionalized widespread abuse, which silenced many of his victims and allowed him to continue preying on those around him not just under the cover of darkness, but openly as well, in a way that underscores the arrogance that has become the hallmark of his reign.” Zeldin continued, “If there’s one thing we’ve learned about his three terms in office, it’s that Andrew Cuomo will not accept responsibility for just about anything willingly.” Zeldin said New York legislators, voters and the media “must do everything they can to hold Cuomo accountable.”

Asked about Cuomo’s handling of the pandemic, alleged sexual harassment scandals, and his actions as the occupant of the State’s highest elected position, Garcia stated in direct correlation to the handling of nursing homes: “Cuomo lied and people died. Tens of thousands of seniors lost their lives - they were someone’s grandfather or grandmother, mother or father, aunt or uncle, and now this is under investigation by the Federal Department of Justice.”

Garcia continued, “Mr. Cuomo is well renowned for his bullying, he is an alleged predator, and he is going to go down as the most incompetent and inept governor in the history of this state.” In contrast, Garcia defined Zeldin as methodical. “Congressman Zeldin can balance the ability to serve and be successful in delivering to the families and constituents, and now he is actively exploring a gubernatorial run talking with all the different interests to determine if there is a successful path to answer that call.”

While the Governor’s nursing home policies and allegations of sexual harassment scandals have positioned Cuomo’s popularity ratings in a downward spiral, Zeldin’s popularity appears to be trending upward. A Quinnipiac University poll conducted last week found that 55% of New Yorkers think Cuomo should remain in office, while 40% assert the Governor should resign. In a closer look between party lines, however, 74% of Democrats believe Cuomo should remain in office, while 50% of Republicans believe he should resign. But in starker contrast, the margin by which voters are signaling Cuomo should not seek reelection is markedly wider: 59% to 36% assert they would not like to see Cuomo run for a fourth term.

Suffolk County and Brookhaven Town GOP Chairman, Jesse Garcia, weighed in on the state of Cuomo’s governing policies, and Zeldin’s exploring a 2022 run for New York State’s top office. “For some time now, I have been fielding calls throughout New York State that includes party leaders, elders, stakeholders and community activists, in an attempt to draft Lee Zeldin in a possible run for governor,” Garcia said. Citing a statistic from a non partisan political think tank, Garcia reported that Zeldin is labeled as the 12th most bipartisan member in the House of Representatives, which in total comprises 435 congressmen and congresswomen. “This demonstrates that Lee will fight for the principles of Long Island and New York with his

hundreds of millions of dollars of state education aid for local school districts over and above that which Cuomo proposed in his executive budgets. Zeldin led the successful effort to repeal the MTA Payroll Tax, and was instrumental in the effort that led to the repeal of the Saltwater Fishing Licensing Fee. He was the architect of the law that protected fallen veterans and their families from protests at military burials.

Suffolk County Democratic Chairman Rich Schaffer suggested in a prepared statement that the process should play itself out, citing “the presumption of innocence until proven guilty.” Schaffer stated, “Let me start by condemning sexual harassment and abuse of power in the workplace and say that the allegations against Governor Cuomo are disturbing and must be fully investigated by an independent investigator,” Schaffer said.

“There is never a time for Party politics when it comes to allegations of sexual harassment and this investigation must be thorough, unbiased, and complete.

Sexual harassment is always wrong, and it is a crime.” While citing the presumption of innocence principle, Schaffer added, “This does not mean I don’t take the underlying crimes that people are accused of seriously, and once those crimes are proven, those people must be removed from positions of public trust.”

In his statement, Schaffer said, “This is an incredibly difficult situation for far too many people, who have too often faced similar circumstances,” then offered support of the Democratic Committee, and listed a series of resources for anyone experiencing sexual harassment, assault, or abuse to contact.

Zeldin was elected to the House of Representatives and took office in 2015.

Prior to his election to Congress, Zeldin served in the New York State Senate after winning election in 2010, where over the course of his tenure in the State Capitol, he championed securing

Zeldin was sworn in to the New York State Bar at age 33, making him the youngest attorney in New York State at that time. Zeldin currently holds the rank of Major in the United States Army Reserves. He served four years active duty as a Military Intelligence Officer, Federal Prosecutor and Military Magistrate.

Zeldin was deployed with an infantry battalion of paratroopers in support of Operation Iraqi Freedom from 2006 until 2007 while assigned to the United States Army’s 82nd Airborne Division.

Tate’s Bake Shop Accused of Illegal Threats, COVID-19 Violations, and Workplace Harassment

Hundreds of Employees Move to Unionize After Deplorable Factory Conditions and Abuses by Management

Workers at Tate’s bake shop in East Moriches are moving to unionize as the factory’s leadership is being accused of making illegal threats, forcing employees to work in violation of COVID-19 safety protocols, and subjecting them to harassment from superiors. The actions are targeting undocumented workers who have been allegedly threatened with immigration enforcement if they support the March 26 vote.

The rights of immigrants are taking center stage in the battle between Tate’s and Amalgamated Local 298, a union that represents more than 30,000 workers on Long Island and across America. Management tactics to defeat the union vote have been called into question and an atmosphere of intimidation and fear has come over the bake shop which employs 500 workers at the Pine Street facility, employees have reported.

“We want to explore our options for union representation and need to have all of the facts. We have issues that need to be addressed,” said one worker who did not want to give his name. “Telling employees they will be deported if they vote for a union is terrifying and we hope that the vote can take place without the fear of retribution.”

“The COVID pandemic has put a heavy strain on workers and they have reached out to us for representation,” said Joseph Giovinco, secretarytreasurer for Local 298, which is part of the 8,500-member Eastern States Joint Board and its affiliate, the AFLCIO. “The workforce at Tate’s is about

98 percent Hispanic and they are raising a number of issues as we move through the unionization process. The decision to be represented by our local is entirely up to the employees and this will be decided in a vote this month.”

According to Giovinco, employees

are concerned over workplace safety in the COVID age, as well as wage issues and benefits. “They have the right to vote in a free and fair election without fear of deportation and reprisal from management.”

The right of employees to unionize was elevated to the White House this week as President Biden weighed in on a vote to organize Amazon workers.

“Today, and over the next few days and weeks, workers in Alabama and all across America are voting on whether to organize a union in their workplace,” the President said. “It’s a vitally important choice—one that should be made without intimidation or threats by employers. There should be no intimidation, no coercion, no threats, no-anti-union propaganda.

The choice to join a union is up to the workers.”

“Right now, Tate’s employees work without a contract and no representation,” said Cosmo Lubrano, the Joint Board’s business agent.

“Management has the right to change the rules whenever they want, fire people at will, and simply ignore

ideas and concerns from the workers.

This leaves these minimum wage employees in a bad situation and they are terrified. We’re talking about mostly immigrants who are willing to work for the American dream just like anyone else.”

Issues the union said they would address in contract talks include COVID-safe working conditions, wages, benefits, paid time off, work rules, seniority, and a grievance process to work out employee issues.

“Our offer to the employees is simple and straightforward,” Lubrano said. “Let us represent you in contract negotiations alongside the fellow workers that you choose. We will use our expertise and experience to win the best deal possible and then each and every employee will have an opportunity to vote on it. If you don’t believe it’s a better deal than the

arrangement you have now, you can reject it and we will walk away.”

If the workers vote to unionize in a secret ballot, National Labor Relations Board Rules will require the company to negotiate a contract in “good faith” and the union has one year to get a deal done. Being part of a union and working under a negotiated contract, typically about three years, will cost employees a little over a dollar a day in dues. “In addition to a contract, the union will be there for them in whatever issues come up on the job,” Giovinco said, noting that the union has created outstanding working relationships between their members and other companies in the manufacturing, airline, hotel, and healthcare industries.

“Companies have long recognized that an employee working under a fair and agreeable contract is a happy and productive employee,” Lubrano concluded. “Our role is to help companies have better relationships with their workforce and become more profitable. With workplace issues out of the way, our members operate more effectively and turnover rates are lower; they’re not miserable.

Tate’s started as a one-woman operation in Southampton and has grown to provide products across the U.S. and internationally with the local plant cranking out over 1.5 million cookies a day. It was bought out for $500 million in 2018 by Illinois-based Mondelez International, which also owns the Nabisco, Oreo and Ritz brands. Many of its operations are unionized. The company did not respond to a request for comment.

First Responder Status Bill Advances In The State Legislature

A bill put forth by Assemblyman Joe DeStefano to grant First Responder Status to 911 operators and other emergency dispatchers has advanced in the state legislature during the current session.

“We wish to express our support for this legislation as it accomplishes our long-time and highly sought-after goal of having emergency dispatchers, which include our members in the Public Safety Dispatcher, Emergency Complaint Operator, and Emergency Services Dispatcher titles, formally recognized as “First Responders,” the Suffolk County Association of Municipal Workers said in a statement.

“This legislation would qualify emergency dispatchers for both federal and state benefits and protections including important training opportunities, in addition to benefits to help cope with both the mental and physical symptoms suffered as a result of on-the-job incurred trauma,” Assemblyman DeStefano explained.

“These highly-trained individuals work on the front line of emergency services and have certainly earned this recognition,” DeStefano said. “They have performed their duties remarkably well, especially during the COVID crisis.”

To mitigate an ever-growing list of risks, and to combat the ongoing staffing shortage, it is crucial to formally recognize 911 telecommunicators as first responders, according to the SCAME. Experts predict that in the coming years there will be thousands of job openings to fill within the industry, with not enough qualified and willing participants to fill them. This staffing shortage is largely due to failure to recognize dispatchers as first responders, resulting in inadequacies in wages, working environments, training, and high-risk benefits.

“Dispatchers are the nucleus of any emergency event, they send out the first wave of help while simultaneously providing life-saving instructions,” said the association’s president, Dan Levler. “In our opinion, there should be no question that dispatchers are first responders.”

Leveler concluded: “Suffolk AME commends Assemblyman DeStefano for his willingness to work on behalf of our members in a bi-partisan and selfless manner by allowing Assemblyman Abbate to carry this important legislation. We will continue to work with public officials to rally on behalf of our AME brothers and sisters.”

The son of an Italian immigrant whose family settled in Shirley in the 1960’s, Mazzarella served as a Trustee of the Mastics-Moriches-Shirley Community Library for 10 years, with five years as president, and has been a member of the Rotary Club of Shirley and the Mastics since 1998. He has been active with the Crystal Beach Property Owners for 15 years and is well known for his involvement in many civic, charitable, and education initiatives in the Third Legislative District. He also serves as a member of the Brookhaven Town Board of Zoning Appeals and is the Secretary-Treasurer of Local 342, a public services union that represents 1,500 sanitation, highway, library, fire, water district and other municipal employees on Long Island.

“Jim Mazzarella is the right person in the right place at the right time to lift up this South Shore district and keep it moving in the right direction,” said Jesse Garcia, the GOP leader of Brookhaven Town and the county who endorsed Mazzarella during a special event on Tuesday. “We have a powerful group of elected leaders committed to delivering the services this area needs and getting projects done. Jim will be a welcome member of this team.”

Suffolk County Legislature Presiding Officer Rob Calarco, alongside his colleagues and county officials, stood with families on Monday to mark the opening of a memorial project dedicated to Suffolk County residents who have lost their lives to COVID-19.

The Suffolk County COVID-19 Memorial is currently located outside the legislature’s William H. Rogers Building in Hauppauge.

Ribbons with the names of Suffolk County residents who have died of COVID-19 will be tied to the memorial. Those who have lost a loved one to COVID-19 are encouraged to visit www.scnylegislature. us/CovidMemorial for information on how to include their loved one’s name and tie a ribbon in that person’s honor.

“Nearly a year ago when the first case of COVID-19 was detected here in Suffolk County, we could not imagine how much life would change, how deep our collective sacrifice would have to go, and how much loss we would have to endure,” said Presiding Officer Rob Calarco. “The Suffolk County COVID-19 Memorial is our way of honoring the loved ones we have lost and offering grieving families a way to find comfort in community at a time when we have been unable to mourn in the ways we are used to. Each ribbon placed on this memorial represents a Suffolk County resident who tragically lost their fight to COVID-19.

We will never forget those we lost and hope that their memory will serve to remind us how precious life and community truly is.”

County officials and families marked the start of the project by tying the first few ribbons onto the memorial in honor of four county employees who lost their lives to COVID-19: Investigator Sergeant Keith Allison from the Sheriff’s Department, Suffolk County Auxiliary Police Captain Anthony DeNoyior, Parks Supervisor II Russell E. Shive and Suffolk County Police Lieutenant Robert Van Zeyl.

As of March 2, 3,095 Suffolk County residents had died of COVID-19.

After the county receives a submission, staff members will write the loved one’s name on a ribbon and tie it to the memorial. If family members prefer to write their loved one’s name on a ribbon and tie it themselves, they can fill out the online form and then visit the memorial in Hauppauge.

Residents on the East End may tie ribbons on a structure set up in the lobby of the Evans K. Griffing building, located at 300 Center Drive in Riverside.

Ribbons and markers will be available at both locations Monday through Friday between the hours of 10 a.m. and 4 p.m. for the entire month of March. The two structures will ultimately be combined into one and put on permanent display in Hauppauge.

Joining Presiding Officer Calarco, legislators and families were Suffolk County Deputy County Executive Jon Kaiman, Suffolk County Sheriff Errol Toulon, Jr. and representatives from the Sheriff’s office, Suffolk County Police Commissioner Geraldine Hart, Suffolk County Parks, Recreation and Conservation Commissioner Jason Smagin, Suffolk County Comptroller John Kennedy, Suffolk Association of Municipal Employees (AME) Executive Vice President Thomas P. Moran and Government Relations Specialist Ryan McGarry, and Suffolk County Police Benevolent Association President Noel DiGerolamo and 1st Vice President Lou Tutone.

“The last year has been filled with an incredible amount of loss, grief and tragedy,” said Suffolk County Executive Steve Bellone. “Our frontline heroes and essential workers are the ones who carried us through this pandemic and this memorial is a way to honor every life lost to COVID-19 and lets their family, friends and loved ones know they will not be forgotten.”

Suffolk County Sheriff Errol Toulon spoke about his own experience with loss and offered comfort to the families in attendance, saying, “Through all your darkest hours and days, there will come a time when despair turns to acceptance, when feelings of hopelessness are replaced by optimism, and when the memories of your loved ones more often lead to smiles than tears.”

“COVID-19 will forever be imprinted in our lives and while this virus claimed too many lives it also highlighted the dedication of our essential workers, including Lieutenant Robert Van Zeyl and Auxiliary Police Captain Anthony DeNoyior, who both died of complications of COVID-19,” Suffolk County Police Commissioner Geraldine Hart said. “I hope this memorial will provide solace to those who lost loved ones to the pandemic and let it serve as a reminder of the sacrifices individuals made to help others.”

Suffolk County Police Benevolent Association President Noel DiGerolamo added, “The Suffolk County PBA offers our deepest condolences to all of those who have been affected by and lost loved ones to this disease. It is with unity and compassion for each other we will prevail as a stronger society together.”

Suffolk County Parks, Recreation and Conservation Commissioner Jason Smagin said, “This county has seen

devastating loss of lives from the pandemic. It is important for the families and friends of loved ones that were lost to COVID-19 to know that their memories will live on in the hearts and minds of all residents here in Suffolk. I know those individuals who lost their lives in the parks department will always be remembered.”

Suffolk AME President Daniel C. Levler said, “While we remember and mourn the lives of our Suffolk County residents lost to COVID-19, including our own AME members like Russell Shive, we know this crisis is still far from over. We continue to fight to protect our frontline essential workers and remain committed to their health and safety, just as they remain committed to serving our greater community.

Our hearts are extended to the families impacted by this devastating pandemic. We thank Presiding Officer Calarco for organizing today’s memorial event and for his ongoing efforts to protect Suffolk’s workers and residents.”

The memorial in Hauppauge and the structure in Riverside were built by Boy Scout Troop 888, who designed the structures, donated the supplies, and spent a weekend building them. Perino’s Canvas & Awning in Bay Shore donated the paracord that hangs between the structures’ stanchions.

House calls by doctors had been a thing of the past, but with an increased community need for personalized care in the wake of the COVID pandemic, Dr. Kumar S. Mandal has renewed this traditional service for the Bay Area.

“Our patients started having difficulties getting to the office, so we decided to come to them,” said Dr. Mandal’s office manager Anna Filoso, who is coordinating the new service, Suffolk Home Care. “Many of our seniors were afraid to come in and transportation became an issue. Having the doctor make house calls is the perfect solution.”

Nick Caracappa Welcomes Lidl Grocery Store to the Community Today, Suffolk County Legislator Nick Caracappa joined other community leaders in welcoming Lidl Grocery Store to the Selden community at their Grand Opening-Ribbon Cutting Ceremony.

Lidl’s history dates back to 1973, when the first modern Lidl store opened in Ludwigshafen, Germany.

With only three employees and about 500 products, this small store became the foundation of Lidl’s farreaching expansion. During the

Woman Killed in Motor Vehicle Crash

Suffolk County Police Seventh Squad detectives are investigating a motor vehicle crash that killed a woman in Shirley last Thursday night.

Kerry Probst was driving a 2012 Toyota Camry westbound on Neighborhood Road, when the vehicle crossed over the center line and collided with a 2003 Ford Econoline being driven eastbound on Havenwood Drive by Santos Punay-Vargas at 8:22 p.m.

Probst, 46, of East Moriches, was transported to Long Island Community Hospital in East Patchogue where she was pronounced dead. Punay-Vargas, 30, of Mastic Beach, was not injured.

Both vehicles were impounded for safety checks. Detectives are asking anyone with information on the crash to contact the Seventh Squad at 631-852-8752.

BY KARL GROSSMAN “The model for contracting out LIPA’s responsibilities to a private company is a two-time loser,” says Fred W. Thiele, Jr., a leader in calling for true reform of the Long Island Power Authority.

LIPA, says Assemblyman Thiele, whose district includes southern Brookhaven Town, needs to return to “the vision of its sponsors” and be a “public utility accountable directly to Long Islanders.”

LIPA is about to make a decision later this month on going back to that vision— to be a true public power utility operating Long Island’s electric grid itself, not contracting that out to a private company.

London, England-based National Grid which earlier operated the grid for LIPA was fired after its massive failures in Superstorm Sandy in 2012. Governor Andrew Cuomo intervened and pushed for National Grid to be replaced by Newark, New Jersey-based PSEG. In last year’s Tropical Storm Isaias, PSEG repeated National Grid’s storm failure with about half of LIPA customers left in the dark without electricity.

After these two big utility strikes, “There is no reason to think it would be any different a third time,” says Mr. Thiele of Sag Harbor.

$70 million and charging “corporate mismanagement, misfeasance, incompetence and indifference, rising well beyond the level of simple negligence” for PSEG’s terrible Isaias performance, is now considering a return to the original vision of it being a full public utility.

LIPA describes that, in a report issued in December, as the “Municipal Management Model.” This, says the report, “is an alternative to LIPA’s present arrangement with PSEG Long Island.” LIPA lists economic advantages.

“Rather than paying PSEG Long Island $77 million in management fees and $20 million in affiliate service charges annually, the LIPA management team would design, integrate, and bear the costs of the entire delivery chain.” It notes the “municipal management model” has “been successfully executed by numerous public power and cooperative utilities, many of whom are ranked among the best utilities in the country for customer satisfaction and reliability.”

Indeed, a good chunk of electric utilities in the United States are public power utilities, not private utilities with profit central often at the cost of public service. Public power utilities are in a better position to underground electric lines, a key to enhancing the reliability of

The original model for LIPA was the Sacramento Municipal Utility District providing electric service to an area California with a comparable number of ratepayers as in LIPA’s territory. SMUD

has an elected board of seven trustees, and LIPA was to have elected trustees, too. But Andrew Cuomo’s father, then Governor Mario Cuomo, undid that provision after LIPA’s formation in 1986 and replaced it with having LIPA’s nine trustees appointed, five by the governor

and two each by the State Assembly speaker and State Senate president. Year after year, Mr. Thiele has introduced legislation restoring having LIPA trustees elected by Long Islanders.

The December LIPA report says under the “Municipal Management Model”

and “given its direct accountability for operations, LIPA would be equipped to be far more transparent and responsive.”

Important for this to be a reality would be having trustees of a strengthened LIPA elected. They would have to run for office, as do those at SMUD. And this

way, electric service would be under the control of the people of Long Island.

An outrageous example of the kind of utility governance that should never be is an entity called the Electric Reliability Council of Texas. It operates 90 percent of the electric grid in Texas. How are the 15 members of the ERCOT board chosen? “Board members are appointed by a nominating committee made up of current members,” noted the Austin American-Statesman last month. An investigation by the Texas state capitol’s newspaper also found “one-third of its board lives out of state.”

With frigid weather hitting Texas and freezing the blades of wind turbines, the anti-environmental governor of Texas blamed green energy for the weeks for electric outage that impacted 4.5 million ERCOT customers. But, as Forbes magazine (not known exactly for a green commitment) reported, for dealing with cold weather, wind turbines “are typically equipped with de-icing and other tools.”

That simple fix was beyond the insiderboard of ERCOT. Ah, anti-freeze!

Ah democracy! LIPA should decide to operate the Long Island electric grid itself—with the people of Long Island overseeing LIPA by electing the members of its board.

Asking who you were a fan of Willie, Mickey or the Duke, was akin to asking where you were from in New York back in the 50’s and 60’s. Then it was Keith Hernandez or Don Mattingly, which raged for years, and now we are in another big debate. Who is the best starting pitcher in New York? Oh, by the way that also means who is the best pitcher in baseball, because the answer to one is the answer to the other.

First of all, age has to be mentioned because deGrom will be 33 before the All Star break, an age where pitchers usually start to slow down, whereas Cole will pitch almost the entirety of 2021 at age 30, the prime of his career. So who then is the best pitcher in New York? or for that matter all of baseball? Well, last season neither finished with the Cy Young award. deGrom coming in at 3rd place in the NL and Cole with a 4th place finish in the AL. This year Cole is the odds on favorite to win the award with his +350 odds being above his competition Shane Bieber and Lucas Giolito. Jacob deGrom is also the favorite at +500 to win the award for the NL, just above Trevor Bauer, Walker Buehler and Max Scherzer.

These two are as close as can be and arguments can be made for both. It’ll be a fun summer as fans back their guy and we get the first full season of Cole against deGrom. Maybe it doesn’t turn

into Willie, Mickey or the Duke ... or even Hernandez vs. Mattingly, but it’s nice to have the heated debate back in this baseball city.

An Estate Plan for Singles

Q: I am not married and do not have children, do I still need estate planning?

A:

Yes, you should still need estate planning if you are single. Regardless of your marital status, it is important to plan for incapacity and death. Incapacity can be short term or long term. A complete estate plan often includes a power of attorney, health care proxy, living will, and last will and testament. For many single clients, choosing who to give certain responsibilities to can be an extra challenge.

Planning for incapacity includes signing advanced directives for health care. A health care proxy allows a person to appoint an individual to make medical decisions for them if they are deemed incapacitated by a physician. For married couples, the spouse is often the first choice to serve in this capacity. However, as a single person, the first choice may not be

as obvious, and signing a health care proxy makes it clear who will be in charge of those decisions. A living will is a statement of wishes regarding end of life decisions.

Having a clear roadmap for physicians and individuals making decisions in the case of incapacity is crucial. These decisions can include, but are not limited to, cardiopulmonary resuscitation, dialysis, cancer treatments, antibiotics, artificial nutrition and hydration. Taking the time to think about this in advance and put it on paper helps make certain your directions are followed if the situation arises.

Beyond decisions about health care, empowering someone to make financial decisions is also a vital part of an estate plan. Most single individuals hold all assets in their sole names, not joint with anyone else. For this reason, having an agent named under a power of attorney will be crucial to making sure an individual’s

This is because the probate process requires notice to the legal next of kin. This includes your spouse and children, then parents, then siblings, and the list continues. A single person that does not have a spouse or children may not have living parents or siblings or may not want them involved in their estate. To avoid this probate process, a living trust may be the best option.

Unmarried individuals need an estate plan just as much if not more than their married counterparts. Seeking the advice of an attorney to complete your plan is incredibly important to see that it is done correctly and your wishes are followed.

As we often pine to be afloat with a deck beneath our feet, we might even feel compelled to venture out with proper planning. If so, the Float Plan, oft spoken of and more often ignored, can be key for you and those closest to you.

That’s what this column is about.

Float Plan

The Float Plan is nominally known as a mechanism for ensuring that missing vessels are indeed missed in time for action to be taken that might otherwise lead to the rescue of the crew rather than the recovery of their bodies.

So, in a nutshell, float plans are all about SOLAS - Safety Of Life At Sea. However, as the title infers, the development of a float plan delivers nothing but upside to the boat’s master and thus to the crew who are fully the master’s responsibility.

Charting

The ideal float plan involves the detailed analysis of getting to your destination and returning safely. The float plan provides the opportunity for the skipper to sit with his or her charts, in the calm of a kitchen, den or study, and literally walk through the passage

with parallel rulers and dividers.

What is the goal of such detailed analysis? The net effect is to create your own Pilot Guide for the entire passage and to be able to assign predicted times to each leg. Deviation from predicted times is an early warning to the skipper that something is up – working against (or with!) a current, cross winds creating additional work effort for the engines to hold course, etc. All of this translates into fuel consumption “deltas” which ultimately leads directly to SOLAS issues – Safety Of Life At Sea… If you have made an error in the development of your pilot guide, the rest of the guide is likely to be suspect and you’ll have to do what every skipper has done for centuries untold – improvise carefully… If the chart is generally consistent but winds and tides have done the inevitable, then the overall pilot guide is likely to still have integrity but, once again, you’ll have to do what every skipper has done for centuries untold – improvise carefully...

Weather

With respect to predicting the weather, I use the Weather.com website – www.weather.com - and the reason I do is because I can get weather prediction by the hour. If the chance of

precipitation for a particular day is 50%, but it is 10% in the morning and 90% in the afternoon, I want to know that. Put in your zip code or city name and click go…

Tides

Nothing is more likely to surprise you and more potentially perilous to happen than running aground – and understanding the tide is all about that.

There are several good services to use but there is something very subtle about tide analysis that no chart gives you.

Tides change at different rates at different places (watch for a column here soon where we’ll talk Time and Tides.)

Knowing the tides at an inlet while spending the next 6 hours transiting from cove to bay “on the inside” could require major mental gymnastics in order to keep pace with the pace of the tide as it works its way through that inlet and across the bays and into the coves…

Why do that if the internet can do it for you?

Teaching the “Come” Command

BY DON STERLING Ever call your dog on a cold winters night and the dog says “turn on the late show, I’ll be in in an hour”? One of the most frustrating and dangerous things any dog can do is to refuse to come when called, yet it is the easiest thing to teach your dog. Teaching your dog to walk at your side without pulling (heeling) requires certain skills on the part of the handler as well as the dog whereas “come” requires no skill on the part of the dog and very little on the part of the handler.

There are several aspects that one must keep in mind to accomplish this response. As always, the personality and the age of the dog will dictate the training. Now, one can teach (train) a dog with food reward, but should there be an event

that exceeds the dog’s desire for food, the dog will not respond consequently one is left with the need for obedience as obedience supersedes training. Obedience means the dog must respond whether it wishes to or not. Some dogs will be perfectly willing to come regardless of distraction as their desire to be with the handler exceeds any distraction and little if any training or obedience is necessary. But for the dog that refuses to recall obedience training becomes necessary. The key is to apply as much correction as necessary to accomplish the desired result.

With a slip collar, (nylon) and a long lead, (rope) attached to the dog let him run around until he is distracted then call his name. If he does not respond in your direction jerk the rope

with just enough force to get his attention and headed in your direction. As he comes towards you, kneel down and praise him. Should he stop returning jerk the lead again until he once again comes towards you. This exercise should be repeated three times, three times a day for a total of nine sessions each taking about a minute. Most likely you will have attained a guaranteed recall before the end of the day. Continued practice may be required so the long lead should remain on the dog for the following week or so until your dog comes to you EVERY time you call him without having to be corrected.
