It was a historic moment Thursday as hundreds of officials and local residents broke ground for the Forge River Watershed Sewer Project to protect the region’s water quality and stimulate economic growth.

“It was an unprecedented display of governmental and community cooperation as more than 50 people were recognized for their direct involvement in making this project happen, not to mention the many more who worked behind the scenes to make this once-in-a-lifetime dream a reality,” said Assemblyman Joe DeStefano, who shoveled a symbolic pile of soil to kick off the massive construction effort.

The $223.9 million project, expected to be completed in 2025, will bring sewer services to nearly 1,900 homes and businesses in the Mastic-Shirley

Community and Officials Breaks Ground for Forge River Sewer Project area. A state-of-the-art wastewater treatment plant in Mastic capable of processing sewage at the rate of a million gallons a day will keep cesspool waste out of the Forge River and Moriches Bay, a goal that has been on the drawing board for nearly a half century.

While it had a devastating effect on the Bay Area, Hurricane Sandy became the impetus for government funding from many disparate sources culminating in the $408.8 million Suffolk County Coastal Resiliency Initiative, a far-reaching effort to protect Long Island’s water resources and steel the region for future flooding and severe storms. Another major aspect of the initiative is sewerage for 4,000 parcels in Babylon Town and upgrading the systems that serve them.

In addition to town and county

support, and working through the federal Division of Homeland Security and Emergency Management and the Governor’s Office of Storm Recovery, Peter Scully, Deputy County Executive noted the complexity of funding sources: •

Appearing at the groundbreaking along with County Executive Steve Bellone and dozens of officials from the federal, state, county and town levels was Brookhaven Supervisor Ed Romaine who summed up the efforts of the many people involved in the effort when he said: “It’s the sign of a great society when old men plant trees under which the shade they will never see.” Romaine promised to push for

federal infrastructure funds to extend the sewers south of Meadowmere Avenue to serve the Mastic Peninsula, especially the Neighborhood Road business district.

“As someone who grew up and still lives in this great, local community, I can personally attest to the fact that the Forge River Sewer Project is critical to our quality of life,” Congressman Lee Zeldin said. “I was honored to do my part to save this project with legislation I got passed by Congress and signed into law in December 2020. This is a great day for an amazing Suffolk County community.”

Legislator Jim Mazzarella noted the support of local residents in voting for the project in a special referendum.

“Today’s groundbreaking enables us to write a new positive environmental and

economic chapter for our communities.

It is the collective work product of so many whom deserve credit including all the levels of government who worked cooperatively. Ultimately the residents who voted to invest in their community are those who are truly deserving of thanks. I will be honored to see this project to fruition.”

“Forge River is one of the most polluted waterways in the state and now it will be protected thanks to the concerted efforts of so many,” Assemblyman DeStefano concluded.

“We are fortunate that everything came together after so many decades of trying. Everyone involved should be proud that we are leaving the heritage of clean water and economic opportunity for generations to come.”

At the Organizational meeting of the Suffolk County Legislature on Monday, January 3, Jim Mazzarella was officially sworn in for his first full term as Suffolk County Legislator of the Third District.

In an official ceremony, Legislator Mazzarella took the Oath of Office, administered by Suffolk County Clerk Judith Pascale and signed the Public Official Ledger of Suffolk County marking the official start of his new term.

“I am humbled that the residents have once again placed their trust in me to serve as their Legislator for the next two years,” stated Legislator Jim Mazzarella. “I take this position of trust very seriously, and I promise to work tirelessly for the betterment of the Third Legislative District and all of its

residents.”

This new Legislative term also brings with it new responsibilities, as Legislator Mazzarella is now a member of the Majority Caucus.

These responsibilities include being appointed to serve as the new Chair of the Education and Labor Committee, as well as the Economic Development, Planning and Housing Committee. In addition to serving as Chair of these committees, Legislator Mazzarella has also been appointed as Vice Chair of the Public Safety Committee and is a member of the Government Operations, Personnel, Information Technology and Diversity Committee.

Mazzeralla Kicks Off 2023 Re-election Legislator Jimmy Mazzeralla kicked off his re-election campaign last week at a special cocktail party at Porters on the Lane.

Mazzeralla was elected in a special election to serve the remaining term of the former legislator who resigned.

He then defeated former Legislator Kate Browning and was elected to a full term in last November’s election.

The 3rd Legislative District encompasses the majority of southern Brookhaven Town.

Jim Tullo Appointed Planning Commissioner

The Brookhaven Town Board recently Appointed Jim Tullo as the new Commissioner for Planning and Environment and Land Management, (PELM). Tullo officially took the helm on January 6, 2022. He previously served as the Town of Brookhaven’s Deputy Director for the Industrial Development Agency, (IDA).

Tullo is a familiar face to town politics and constituents alike. He was elected to the Brookhaven Town Board in 2003 as councilman for the 4th Council District after qualified voters of the Town of Brookhaven approved a council district referendum which resulted in the implementation of councilmanic districts. Tullo held the elected position until 2006.

As the newly appointed Commissioner of PELM, Tullo oversees the Planning Department’s day-to-day operations including site plans, subdivisions, and zone changes. In an interview this week,

Tullo noted that the Engineering Division “handles inspections on development projects that receive site plan approvals as well as land use and subdivisions so that all applications are in compliance.”

Under the umbrella of the Building Division, Tullo explained, are consideration for permits and certificates of occupancy on commercial, industrial and residential applications.

Tullo said the Environmental Division handles all wetlands and shellfish programs, where most projects come before the environmental staff for SEQRA (State Environmental Quality Review Act) declaration decisions.

Most SEQRA determinations come from the Environmental Division and are specific to development actions within the Town of Brookhaven.

Tullo reported that the Town aggressively seeks grants to address environmental issues. Asked whether the Town employs a grant writer, Tullo explained, “We

have qualified in-house staff who write grant applications which we prudently implement when we actually receive the grant.” A number of sensitive land initiatives

Jim Tullo are presently underway and are a work in progress. Explains Tullo: “We’re always working closely with the Army Corps of Engineers on

erosion control to maintain the integrity of the dunes along Fire Island and waterfront properties, and on the environmental side, we handle special districts such as dock and erosion districts, and other sensitive waters like the Forge and Swan rivers.”

Under Land Management, open space acquisitions remain a priority. “We look to purchase lands to be preserved, and for this,” Tullo explained, “we work closely with the Law Department.”

With seemingly little availability of undeveloped land, Tullo was asked if there are any parcels left for the Town to purchase.

“There’s definitely land to acquire, particularly for preservation, and the Law Department works on a daily basis on these issues,” Tullo explained.

Asked about the direction the Town is taking on land use moving forward, Tullo told South Shore Press, “We’re looking closely at commercial revitalization and revitalizing existing commercial

and retail centers and industrial buildings.” Tullo said the Town will be closely considering sub divisions on single family homes as well.

Asked how he prepared for, and what he brings to the table in his new position, Tullo explained, “My level and depth of experience, not only while I was a Town Board member, but my time in the Industrial Development Agency gives me a well-rounded approach toward development and land preservation; and the fact that I served on the Town Board, I recognize that we must hear residents’ feedback while recognizing what the Board goes through dealing with constituents.

I work very closely with Supervisor Romaine and each of the six (council members) for each of their districts. We have a great Town Board, each of whom are very involved in the communities they serve which help shape the face and direction of Brookhaven Town, and I am excited and proud to serve the people of this Town.”

William Floyd Boys Basketball Beats Patchogue-Medford Last Weekend added, “It feels pretty good because this is what I always dreamed of. I used to want to play on the Varsity Team since I was younger and I just worked hard ever since and that’s how I got here now and I’m never going to stop.” When asked, “how does it feel to make playoffs for the first time in 5 years?” McLaurin went on to say, “It is a great feeling.

As William Floyd Boys Varsity Basketball Team leads second in their league, they continue to play strong. This past Saturday, January 22nd, William Floyd versed Patchouge-Medford High School.

WF proved why they are nothing less than the best. Joseph McLaurin (age 15), number #11, had an exceptional game with 6 assists and 15 points. Joseph McLaurin, being one of the youngest on the team, is a top leading scorer for William Floyd Team and a powerful opponent.

Jermaine King (age 14), number #5, held the most points that morning.

King scored six 3-pointers, proving no one can stop him. King being the youngest on the team continues to show his strength in leading the team despite his age. With the team also working together providing a strong defense Patchogue-Medford could barely make a score. Mikey Smith (age 17), number #23, had an outstanding morning with 9 points plus a strong defense. Smith has been a top player this season and someone to keep an eye out for.

Sean Piazza (age 17), number #4,

had scored a layup and a 3-pointer assisted by Jermaine King. Piazza has been a skillful player this season, providing many points and a great defense. Jawuan Smith (age 15), number #10, scored a 3-pointer plus 4 points and provided strong defense to force turnovers. Smith has showed remarkable defense and offense throughout this season so far. The entire team showed unbeatable offense and defense the entire game all the way up to the last minute. The game ended with William Floyd winning 70-47 against Patchogue-Medford.

William Floyd will be closing the regular season February 9th, versing Sachem North. The playoff games will proceed after this date.

Keep a look out for the playoff schedule on Section 11. After the game when Joseph McLaurin and Jermaine King were asked “how does it feel being one of and the youngest on a Varsity Team that’s second in the league?” McLuarin stated, “It feels great to know that such a young group of kids have worked hard all season to be in the position we’re in now.” King

All the hard work we’ve put in for years is finally paying off.” King joined in and said, “It feels great because we’re finally seeing that what we have been working for is finally paying off.”

The boys concluded the questions with saying they are not worried or nervous about what is coming

for them in the playoffs. They are only looking forward to their first ever playoff game and growing as a team because they are far from done. Keep your eyes open because the William Floyd Boys Varsity Basketball Team is coming to play hard and win. For upcoming games check Section 11.

Romaine, Bonner and Loguercio Swear-in Coram Civic Association Officers On January 24, Supervisor Ed Romaine, Councilwoman Jane Bonner and Councilman Michael Loguercio attended the Coram Civic Association (CSA) meeting held at the Coram Fire Department headquarters.

During the meeting, the elected officials met with the members and participated in the swearingin of the officers. The Coram Civic Association is a group of community members from varied backgrounds who are working together toward a common goal as reflected in their mission statement: “To offer a unified voice while working toward bettering the quality of life in Coram.”

Supervisor Romaine said, “It was my pleasure to swear in the officers of the Coram Civic Association. They are an important part of the community and their members always engage in a lively and informative discussion. If people want to make

a difference, I encourage them to get involved and join their local civic associations.”

Councilwoman Bonner said, “The Coram Civic Association has a long history of community service that has helped make it a great place to live. I congratulate all the current officers and look forward to working with them in

the future.”

Councilman Loguercio said, “The members of the Coram Civic take great pride in their community.

Meeting with these folks provides an excellent perspective of the issues that are important to them, and I look forward to our continued partnership.”

South Country CSD Athletic Director Named

The South Country Central School District Board of Education has appointed Bellport High School Assistant Principal John Frankie as the district’s athletic director, effective Feb. 1. He replaces Robert McIntyre, who retired earlier this year.

“We are pleased to promote John Frankie to the position of athletic director,” said Superintendent of Schools Dr. Joseph Giani. “He has the knowledge and skills to oversee the department.”

The athletic director position is not new to Frankie. He served as the district’s athletic director from 2003-2010 before taking on the role of assistant principal at the middle school. He held that position for 11 years before becoming an assistant principal at the high school in 2021. He first joined the district in 1995 as a leave replacement physical education teacher at the high school. While in the district, he has also held the roles of physical education teacher and dean of students.

Frankie holds a bachelor’s degree in physical education from Lamar University, a master’s degree in education from Dowling College and educational leadership certification from Queens College.

Of his appointment, he said, “I am looking forward to going back to my roots and getting back to normalcy, where kids can play with each other and be kids again.”

A Day of Civics As part of their role as a NYS Civic Readiness Pilot School, Bellport High School hosted their first Civics Day on Jan. 21. The informative and engaging event was part of a project known as Generation Citizen that teaches students how to advocate for civic change. All government class students at Bellport High School completed the project.

During the event, held in the school’s library, Generation Citizen students presented projects they have been working on that involved researching an issue in their community, devising a solution to the issue and then asking community stakeholders to implement a solution. Projects

a sizable donation to the Child Life Department at Stony Brook Children’s Hospital to help support the great work that they conduct each and

every day through therapeutic, educational and recreational activities for children during their hospital stays. This year, through a mix of online and in-person collections, the Medical Club raised $1,235, nearly matching their previous three-year total. Over the past four years, the Medical Club has raised and donated $2,905 to support the Child Life Department’s mission.

Ms. Randall and members of the Medical Club recently met via Zoom for the ceremonial check presentation and to learn more about the Child Life Department from guest speaker Michael Attard.

Brookhaven Highway Superintendent Daniel Losquadro invites high school seniors residing within Brookhaven Town to apply for one of two $1,000 Highway Superintendent’s Association scholarships.

WFHS Wrestling Puts Forth Strong Performance at Annual Kujan Brothers’ Memorial Tournament Planning Commissioner

The William Floyd High School varsity wrestling team recently put on a great performance at the 36th annual Kujan Brothers’ Memorial Tournament, a competition featuring eight teams from across Nassau and Suffolk counties vying for the overall tournament title, individual championships and other awards. The Colonials, led by head coach Tony Mecca, finished the tournament in an impressive third place behind powerhouse teams Plainedge and Bellport, the latter only edging out William Floyd by 10 points. Other competitors this year included student athletes from Smithtown East, Hall Hollow Hills West, Westhampton Beach, Glen Cove and Newfield.

The Colonials also had 14 wrestlers place in the top six including one overall champion.

The Annual Kujan Brothers’ Memorial Wrestling Tournament is a storied tradition that features a full day of wrestling with competing programs from Long Island and sometimes beyond. It is held in honor of two former William Floyd wrestlers, Kevin and Steve Kujan, who tragically passed away in a motorcycle crash in 1984. This event, for the past 36 years, has brought the wrestling community together and helped to keep Kevin and Steve’s memory alive.

As you are the Project Director of the FIMP, I would like to share our Association members’ concerns. As priority in FIMP’s initial phases is being given to beach restoration, I am concerned that our voice be heard: - Mastic Beach has been described as having the lowest elevation of communities impacted by FIMP projects. Regular flooding of our southernmost streets poses serious safety issues and negatively impacts access by residents, mail delivery and Police, EMS and Fire services in emergencies.

- Mastic Beach was the most impacted by Hurricane Sandy of Suffolk County south shore communities.

Flooding caused the loss of nearly 80 houses. The 3 million dollar NYS’ GOSR funding to develop flooding resiliency drainage projects is not even a drop in the bucket in making any real difference as it is limited to 4-5 projects in a small section of MB. The Town of Brookhaven has proposed a Habitat Restoration project affecting a small area of Mastic Beach but the issue of shoreline restoration and resilience to flooding of our bay front community can only be planned for and funded by FIMP. We in Mastic Beach are concerned that the elevation of houses and stabilizing of the shoreline/flood resiliency projects are not being given the priority urgently needed, or worse may in the end be eliminated, as money is used for other less flooding impacted and less populated communities.

We’re ready to run,” said Brookhaven Town Councilman Neil Foley in an interview last week about the possibility of him being the Republican candidate for the House of Representatives in November running for the lst Congressional District seat that has been held by Lee Zeldin.

Foley, a Blue Point resident, said that his “social media team, my headquarters team” are all set for a campaign. He stressed that “communications” is a strong point. He has been committed as a councilman, he said, to listening to and communicating with constituents. He was first elected to his town position in 2014.

Zeldin, of Shirley, is seeking to be the Republican candidate for New York governor this year thus needing to leave the House position he has held since 2014 because the election for governor comes as all seats in the House are also up for election.

Also seeking to run for the seat on the GOP ticket is Anthony M. Figliola, a former deputy Brookhaven Town supervisor, who announced his candidacy last month.

“I’m ready to win in November,” said Figliola. He said he would be a “fighter and champion” for the people of the lst C.D. A native of Rocky Point, he now resides in East Setauket and is executive vice president of Empire Government Strategies, a government relations firm.

Also seeking the GOP nomination to run in the lst C.D. is Robert Cornicelli of St. James, whose campaign website notes that he “is a decorated veteran of two branches of this country’s military,” the Navy and the Army National Guard.

“While overseas,” it says, “Robert sustained an injury that is 100% service-connected.

During his recovery, Robert witnessed conditions veterans were experiencing upon their return home. It was during his recovery that he founded Veterans Recovery Coalition,” an organization “leading the fight to eradicate veteran homelessness on Long Island.” He is a sanitation inspector for the Town of Oyster Bay. BY REV. FREDERICK MILLER. PH.D. Every year, American Legion posts nation-wide commemorate the selfless acts of the Four Chaplains on or near Feb. 3, designated Four Chaplains Day by Congress in 1948. Through interfaith services, memorial ceremonies and other solemn events, members of the American Legion Family lead their communities in honoring the chaplains and 668 other men who died when the ship Dorchester sank.

The Dorchester was a civilian liner converted for military service in World War II as a War Shipping Administration troop transport. She was able to carry slightly more than 900 military passengers and crew. The ship left New York on January 23, 1943, en route to Greenland, carrying approximately 902 others, as part of a convoy of three ships escorted by Coast Guard

Cutters. During the early morning hours of February 3 the vessel was torpedoed by the German submarine U-223 off Newfoundland in the North Atlantic. The hit was decisive, striking the ship, far below the water line. The initial blast killed scores of men and seriously wounded many more. Others, stunned by the explosion were groping in the darkness. Panic and chaos quickly set in! Men were screaming, others crying or franticly trying to get lifeboats off the ship. Through the pandemonium, four men spread out among the soldiers, calming the frightened, tending the wounded and guiding the disoriented toward safety. They were four Army chaplains, • Lt. In announcing her candidacy in May, Fleming said, “I have always considered the people who put me in office first.” She was an assistant DA in Manhattan, a member of the Sex Crimes Prosecution Unit, before moving to Noyack and being elected to the Southampton Town Board.

In 2015, she was elected to the county legislature and re-elected in 2017 and 2019.

Her campaign website says: “As an elected official, Fleming has championed tax relief, environmental protection, and

was a steady presence for residents throughout the COVID-19 pandemic and its aftermath….

Bridget is running for Congress to ensure that every child, no matter their race, religion, or gender, has the opportunity to succeed and live out the American Dream.

Kara Hahn of Setauket has been a member of the Suffolk Legislature since first being elected to it in 2011. She has been its Democratic majority leader and deputy presiding officer.

Her campaign website says “Kara is now running for Congress to make an even greater impact for the community where she grew up and continues to raise her family today. She knows that we must provide tax relief for Long Island’s homeowners and small businesses by removing the cap on state and local tax deductions and increasing access

to affordable child care for working parents….Whether it be investing in our infrastructure or bringing down the cost of life-saving prescription drugs, Kara knows that, above all else, it’s time our community has a member of Congress who shares their priorities.”

Seeking the Democratic nomination, too, in the lst C.D. is John Atkinson of Farmingville whose website declares that he “is running as a progressive Democrat and has refused to take any campaign donations from corporations or political action committees. John is only beholden to the people and their interests....It is John’s opinion that it is time the corruption that has entrenched Washington for decades must be removed from American politics altogether.”

He works at Independent Support Services which aids the developmentally disabled.

The lst C.D. includes all of the Town of Brookhaven, most of Smithtown, a slice of Islip and all five East End towns. However, redistricting that is to happen in coming months could change its configuration.

Quickly and quietly, the four chaplains worked to bring calm to the men. As soldiers began to find their way to the deck of the ship, many were still in their underwear, where they

opened a storage locker and began distributing life jackets.

When there were no more lifejackets in the storage room, the chaplains simultaneously removed theirs and gave them to four frightened men.

As the ship went down, survivors in nearby rafts could see the four chaplains – arms linked and braced against the slanting deck. Their voices could also be heard offering prayers and singing hymns.

When the news reached American shores, the nation was stunned by the magnitude of the tragedy and the heroic conduct of the four chaplains.

The Distinguished Service Cross and Purple Heart were awarded posthumously December 19, 1944, to the next of kin’s’ in a ceremony at the post chapel at Fort Myer, VA. A one-time only posthumous Special Medal of Heroism was authorized by Congress and awarded by President Eisenhower on January 18, 1961. The special medal was intended to have the same weight and importance as the Medal of Honor.

BY TOM BARTON The New York Giants are making changes to their team and culture. A new GM is in place, a new head coach on the way, but the same signal caller will remain under center for the 2022 season. With the new hirings around the Giants front office, Big Blue has made it pretty clear that they intend to roll into next season with Daniel Jones as their quarterback.

One of the first things we were told after the Giants hired new General Manager Joe Schoen was co-owner John Mara making it publicly known that they would not be trading for Deshaun Watson, “We’re not trading for Deshaun Watson”, Mara stated. “There are so many reasons why we wouldn’t do that. Cap-wise, we couldn’t

afford it, but more importantly, with the allegations that are out there right now, that is just not the right fit for us.”

This might be a Watson thing, but it certainly gives us an indication that it’s more than just that.

New York has some high draft picks, but this is a weak QB draft. As much as Giants fans want to turn the page on Jones, using very high draft capital this soon after the Jones mistake will be a hard sell. So that leaves the uber talented guys who might jump ship, or the less appealing dice rolls like Mitch Trubisky.

They won’t go with a dice roll, because Jones is already here for that. There has been no indication that Aaron Rodgers would ever come to New York, and while Russell

I have been of the opinion that two weeks of spring training are going to get sacrificed to bring the owners and players together on a collective bargaining agreement.

Though the owners and players have finally begun meeting with an increased frequency and urgency we are finally seeing substantive conversations taking place and we are seeing the two sides exchanging thoughts. Fantasy baseball owners need to add to their planning for this upcoming season just what precisely any delay to spring training’s length will mean to their players returning in a dynasty format. It will also change thoughts on draft from scratch leagues and people’s thoughts on rookies.

A hot button and divisive issue in between owners and players is the rampant manipulation of service time by the owners. This procedure has been used to delay the accrual of arbitration eligibility and it even prompted one player, Kris Bryant, to file a complaint through his greedy agent, Scott Boras. The Cubs wanted nothing to do with discussing a contract with Bryant this summer and is a free agent this off-season. I clearly think the two events are connected. The Seattle Mariners got off to a rocky start with prized prospect Jared Kelenic last season over the issue as well.

Though frankly, Kelenic’s 8-for86 start last season did serve as a confirmation that he in fact was not ready to go from spring training to the majors last year.

One of the expected outcomes from any new collective bargaining agreement was expected to be a reworking of the math in these circumstances to remove the incentive financially for owners to delay the start of a young prospect’s career. It can get the start of any player’s relationship with the club that develops him off to an extremely awkward start. I do think the process will be changed in order to achieve labor peace. But if the process is removed, wouldn’t that make it easier for players to make their teams out of spring training? On paper, it would look that way, but if spring training is shortened this year, all bets may be off at least for 2022.

Fantasy baseball players are going to watch each of these situations very closely but a host of players that were going to spring training with an opportunity to win a job this spring might be catching a bad break for this spring of the 2022 season. A few interesting situations.........

Jones was without most of his receivers and Barkley for the past two seasons, but at the end of it all you can’t expect anyone to have confidence in the 31st ranked offense in the league.

New York fans seemed done with Jones before last season ended and now will have to endure one more year. The odds for the Giants show that the line makers aren’t buying into any great change in New York either. The G-Men sit at the 6th worst odds to win the Super Bowl next season.

If you have faith you can buy them at +6500.

I place the odds in favor of Rutschman making the team despite any potential delay, and I

would place the odds at 70/30 that he starts the season in the major leagues. If you own Rutschman in a dynasty format you sit tight and wait for him patiently. If you are playing in a re-draft league, your thoughts on where to take him in your draft could be a gamble if he starts off in Triple-AAA • Julio Rodruez, OF-Seattle Mariners. Rodriguez is discussed as also being the top prospect in the sport by some publications and no lower than #3 overall. Rodriguez was ranked as the #1 prospect for the major leagues of all players in

the Summer Olympics last year.

His bat is viewed as the most potent in the minor leagues at this time. However, he has yet to play at Triple-AAA but is discussed as being talented enough that he may be ready right now. Rodriguez batted an obscene .362 in 174 Double-AA at bats last summer.

He walked 29 times alongside 37 strikeouts showing uncommon mastery of the strike zone for such a young player. He will play the entire 2022 season at the tender age of 21. There is another Rodriguez that he would appear to be drawing comparisons to and they seem completely appropriate as well. I put his odds of making the team out of spring training as the exact opposite of Rutschman’s. So I am predicting his odds as being 30/70.

It would be a mistake to overdraft him in a redraft league but pat yourself on the back for taking him in a dynasty league • Bobby Witt Jr., SSKansas City Royals. Witt exploded last spring and nearly made the team last spring. He hit some tape measure home runs and looked too good to be true. I think he will make the Royals this spring and make the team as the starting 3B. His ADP numbers have been outrageous for any rookie to justify, but he will play this year.

ON THE SEA

All of us are familiar with registering our vessels with the State Department of Motor Vehicles.

Like a car, DMV wants to know her horse-power, fuel type (gas or diesel) and the Hull Identification Number, or HIN#. This is the on-the-water equivalent of a car’s VIN#. You are required to display on each side of the bow the state registration numbers, followed by the expiration sticker itself. But is your boat eligible for documenting with the USCG and, if so, should you? This is what this column is about.

Whither the HIN?

The HIN is the unique 12-digit identification number of the vessel. It is emblazoned on the starboard side of the transom and it is, as you would expect, illegal to alter it, paint over it, obscure it or in any way make it seem like you’re trying to make it look like a different HIN#! This number indicates the boat manufacturer, its serial number, and the month and year of production.

This one item is of critical importance during any vessel safety check or exam. If the HIN# on your State registration doesn’t conform to the vessel’s physical HIN#, you would be required to resolve that immediately.

So Why “Document” the Vessel?

First, for the USCG to permit documenting the vessel, it must adhere to a certain formula for its “admeasure” – not what it weighs but really what it can carry in cargo. Its “admeasure” must be at least equal to 5 net tons by the USCG formula.

As a rule of thumb, boats less than 25’ in length are unlikely to measure up. But, there is a simplified formula that the USCG provides (Form CG5937, Application for Simplified Measurement) that you can access online (or email me below and I will send you the e.form) that can determine if the boat qualifies. She must be less than 79’ to fit into the simplified window but I expect that this isn’t a problem for most of us!

Documentation numbers need to be permanently attached to a structural portion of the hull, and the vessels’ name and home port need to be listed on the hull--usually the transom. Recreational vessels must have the name and hailing port listed in 4 inch letters. Commercial vessels must do the same, but they must also have the name on both sides of the bow.

So, if the boat is already registered with the State, why do skippers have their vessel federally documented – or registered with the US Coast Guard? Documentation has several advantages, but its primary uses are to provide a “paper trail” that

Tons, Tonnes, and Tuns

Tons come in many shapes and sizes – short tons, long tons, metric tonnes, gross tons, net tons, displacement tons, deadweight tons, register tons, US and international

regulatory tons – and tuns. A tun, going back in history, was a wooden cask full of wine. To be precise,

it had to hold four “hogsheads” of wine – which is 252 gallons. Vessels were measured and taxed by how many tuns of wine that they could transport. Guess that a tun of wine weighs..? About 2,200 pounds – and this is where it starts to get interesting or complicated, depending on how your brain works!

The “ton” we all learned about in

school is 2,000 pounds. In maritime parlance, this is a “short ton”, with a “long ton” being, yup, about 2,200 pounds. It is 2,240 pounds to be precise or just about what a tun of wine weighs. Of course, most of the world is on the metric system so a metric ton – or a tonne - is 2,205 pounds but, as best as I can determine, this is coincidentally about what a tun of wine weighs. The reason that they are so close is because the metric ton, or tonne for short, is the weight of 1,000 liters of fresh water – and wine is mostly fresh water!

Displacement tons and deadweight tons can come in all three flavors – short, long and metric. Suffice it to say that it is complicated.

One last tidbit… Above, I referenced that tuns were used to measure and tax vessels “back in the day” of sailing ships and bootleggers.

The agency that Alexander Hamilton created to police these policies on US waters was the Revenue Cutter Service. This service became, over the centuries, what we now know as the United States Coast Guard.

While anxiety is a normal human response to uncomfortable situations, it can become a problem when it starts to disrupt our ability to participate in daily activities and do things that we enjoy. If you feel your child struggles with anxiety, the following strategies will help them understand why they feel the way they do, and how to manage their worries with mindfulness.

Young children may not be able to effectively verbalize how they are feeling. Some indicators that they are struggling with anxiety are an upset stomach, especially around specific situations; increased irritability; difficulty falling asleep or staying asleep; avoiding activities or people that they used to enjoy; unexplainable crying spells; changes in motivation; emotional meltdowns; or changes in appetite.

Mindfulness is the practice of being present in each moment.

It means paying attention fully to what’s going on in our bodies, inside our heads, and around us in our environment. Mindfulness can sometimes be hard when we notice something that we do not enjoy. This is where the set of skills we already have right in our mind come into play.

But when we slow down to notice what our bodies are feeling, we realize that we are full of sensation. Slowing down and doing a quick scan of your body helps you be more aware of what

you are feeling. You realize that your body is full of sensations that you might not have noticed.

We can tune in to our bodies and understand what is going on in our brains.

Angels in Art

The Second Nicaean Council decreed in 787 A.D. that depicting angels in both paintings and sculpture was legal. This decision of the early Church changed the total evolving of Christian angelic imagery. It left much of the responsibility for expressing angelic form in the hands of artists. This brought with it a surprising side effect. The role of artists during the Renaissance was to explore the world through a new point of view. The painters and sculpturers of this time were a catalyst.

They challenged all the traditional ways of perceiving life and time and space long before the theologians and philosophers.

Eventually the Church realized that the tangible, solid, and realistic images that donned their walls and ceilings were bringing down the old traditional order.

However, if we look at the

8th century as the original thoughts on angels were coming together, we see that the primary sources were not Christian at all, but pagan. The two major images which intrigued artists were the classic Greek examples of Nike, the winged Victory, and depictions of a winged Eros. It is fitting that Eros as Love, or his Roman counterpart Cupid, should encompass the image of later angels of mercy and love.

The Renaissance was full of paradoxes. While angels became less important in the eyes of theologians and Church thinkers, they became more real and human in the interiors and exteriors of church buildings.

Michelangelo depicted them without wings in his masterpiece the Last Judgment in the Sistine chapel. But Michelangelo was ahead of his time in giving his angels corporeal

form. The Church rebelled against the idea that angels had gender. The clergy clung to the concept of sexless angels. The Curia went as

new philosophers. During this extraordinary period in Europe and especially in the courts of the new trading and banking Princes

Since the Renaissance the continuing evolution of the depiction of angels has been abruptly halted. The way we view them today is basically the way they were depicted during the height of the cultural rebirth which started in 14th century Florence. Our current perceptions of angels come from angelic folklore as well as official Church teachings.

Whether it be the depiction of Michael and his powerful sword subduing Satan, or Gabriel and his horn leading the choirs of angels, art has been an important contributary component of the body of angelic knowledge and the way in which we perceive the way angels look.

Q: What makes a will valid in New York?

A:

A Last Will and Testament allows you to direct where your assets go at your death and who will be legally in charge of the estate.

New York law sets forth specific requirements for a legally valid will. Failure to follow such requirements will result in the Surrogate’s Court rejecting the will as invalid. In such a scenario, it is as if you never made a will.

Your estate would be distributed in strict accordance with New York’s intestacy statute. This means if you are married with children of any age, your spouse gets the first $50,000 of your assets and shares the rest 50/50 with your children. This is usually not the desired outcome especially when you have minors or children from a previous relationship.

In New York, pursuant to Section 3-1.1 of the Estates, Powers and Trusts Law, anyone

at least 18 years of age and of “sound mind and memory” can create a Will. Unlike some other states, New York requires a Will be in writing. A will must be signed by the testator (drafter) and witnessed by two individuals who are at least 18 years of age.

The witnesses cannot be a beneficiary under the will. The wrong witness will irretrievably invalidate the will. Depending on how the will is written, blood relatives rarely qualify as legally sound witnesses.

Under all circumstances, a testator must have had testamentary capacity at the time the will is made. This does not mean that individuals suffering from mental or memory defects cannot make wills. Having testamentary capacity means the person knows the extent of their property and recognizes who would be the “natural objects” of their bounty. An attorney gauges a testator’s capacity by asking

pertinent questions designed to test capacity. If there is any chance of a challenge, a good attorney takes detailed notes to substantiate their opinion of capacity.

Although you do not need an attorney to draft a Last Will and Testament, it is a good idea to

at least consult an experienced trust and estates attorney.

Besides running afoul of the formal requirements for a valid will under New York law, there are other pitfalls with the DIY route. A mistake we often see with homemade wills is that the testator didn’t take into

consideration non-probate assets.

Non-probate assets are those that do not pass through Surrogate’s Court but pass directly to a named beneficiary. Such assets include joint bank accounts and real estate held with rights of survivorship.

The most common such assets are retirement accounts and life insurance policies. For instance, a father drafts a will dividing his assets between their three children equally - believing he is being fair to all. However, he neglected to consider that he had named one child as beneficiary on his life insurance policy. Since the life insurance policy was his only asset, the other children received nothing.

Accordingly, the planning, drafting, and executing your Last Will and Testament should be handled with an experienced estate planning attorney.
