On Sunday at approximately 12:45 PM, Suffolk County FRES sent an alert that the Eastport Fire Department was requesting the Fire Marshal’s Hazardous Material Response Team for an overturned fuel oil truck in the median of eastbound Sunrise Highway and the Service Road between Eastport - Manor Road and Moriches - Riverhead Road.

Fuel Tanker Overturns During Snowstorm on Sunrise Highway on the tank. The fire department took some initial actions to slow the leaks with equipment on hand.

The Town of Brookhaven Fire Marshals responded immediately in the face of challenging weather conditions. They drilled the side of the tank, which was facing the sky, inserted two specialized pumps and off loaded the oil into two other trucks from the company that were brought in. The Fire Marshals cleared the scene at approximately 5:00 PM.

The DEC was on site and an environmental company was brought in to clean up any soil that was contaminated.

As per procedure and Town Code, Chief Fire Marshal Chris Mehrman will be billing the spiller (fuel oil company) for all expenses incurred by the Town, including personnel, equipment and materials.

Groundhog Day Virtual Ceremony Canceled Due to Weather; Holtsville Hal Predicts an Early Spring in Brookhaven Town

Following the snowstorm that battered Brookhaven Town earlier this week, the 2021 virtual Groundhog Day ceremony had to be canceled.

However, that didn’t stop Suffolk County’s most famous weatherman from revealing his prognostication. In the early morning hours of Feb. 2, Holtsville Hal awoke from his slumber, brushed the snow aside to emerge from his burrow and did not see his shadow, predicting an early spring for the snow-covered Town of Brookhaven.

According to tradition, if a groundhog sees its shadow on Groundhog Day, there will be six more weeks of winter weather; if not, spring should

arrive early.

“After this week’s storm, I’m sure we are all looking forward to an early spring and keeping our fingers crossed that our resident weatherman maintains his accuracy,” said Superintendent of Highways Daniel Losquadro. “Regardless, the Brookhaven Highway Department remains ready to handle whatever else Mother Nature decides to send our way.”

“While we were disappointed that we couldn’t hold our usual family-friendly event, due to COVID, and then had to cancel the virtual ceremony, we hope to see big crowds next year for Groundhog Day 2022,” Losquadro continued.

Celebrating Dr. Martin Luther King Jr. In honor of Martin Luther King Jr. Day on Jan. 18 and February’s Black History Month, Vanessa Gordon’s fourth grade students at Frank P. Long Intermediate School in the South Country Central School District celebrated the teachings of Dr. King.

Long Island ABATE Board and Officers Installed by Suffolk County Legislator Kennedy goals and plans for 2021. She also noted that this group has been very successful in raising almost $1 Million during its existence, supporting veterans’ posts and other worthy veterans’ organizations throughout the greater Long Island community.

Legislator Kennedy starts off the New Year by administering the oath of office to the Board and officers of the American Bikers for Awareness, Training and Education (ABATE).

On a chilly January night, a dedicated group met to reaffirm their commitment to promote safe motorcycling, and to advocate for education, awareness, and equity among the motoring public for those who enjoy two wheeled vehicles.

Long Island ABATE, originally a chapter of NY ABATE voted in 2012 to become an independent organization. This group, not limited to motorcyclists, is an organization that promotes rights for bikers and drivers alike. Additionally, the group promotes education as well as positive socialization through many bike runs, campouts, concerts and travels around the United States.

Legislation Approved to Combat Reckless Biking The Suffolk County Legislature has approved legislation sponsored by Legislator Rudy Sunderman to address the issues surrounding reckless biking in Suffolk County.

Introductory Resolution 1767-2020, a Local Law to Prevent Reckless Biking in Suffolk County, was approved at the February 2 general meeting of the Legislature.

This legislation was proposed in response to community concerns regarding a large number of bicyclists who ride in a dangerous manner that threatens the safety of cars, pedestrians and themselves. Reckless bicycling has become an issue in Suffolk County, with some bicyclists weaving in and out

“Public safety is our first priority as elected officials,” said Legislator Caracappa. “As a co-sponsor to this legislation, I am pleased to have the support of my colleagues on this

A resolution attempting to address the issue of reckless biking in Suffolk County was first introduced by the late Legislator Thomas Muratore, who met with residents and members of the Suffolk County Police Department to draft a bill to give law enforcement the tools they need to combat this difficult issue. After Legislator Muratore passed away in September 2020, the bill would have expired if another legislator did not sign on as sponsor. To help address this important safety issue and to ensure that Legislator Muratore’s final resolution was seen through to the end, Legislator Sunderman took on the resolution and became its new sponsor.

“I am proud to have carried this legislation in honor of Legislator Tom Muratore,” said Legislator Sunderman.

“This was the last resolution introduced

by Legislator Muratore, and I am happy to see it through to the end.”

This resolution will protect riders and motorists alike and I am proud to cosponsor it, both in honor and memory of Legislator Tom Muratore and as Chair of the Legislature’s Public Safety Committee.”

Minor amendments were made to the original version of the bill, including the addition of an educational component that Legislator Sunderman saw as an important factor when addressing this serious issue.

As some residents may not be well versed in the current laws surrounding bicycle equipment requirements, the issuance of a warning and providing educational information to the violator was worked into the bill as a way to promote fairness in enforcement of the law.

“This legislation also seeks to educate residents on bicycle safety laws and provide education awareness and safety for all those on the road,” said Legislator Sunderman. “If you are bicycling safely and legally, there will be no concerns.”

Senate Democrats Reject Motion to Issue Subpoenas in Nursing Home Scandal For months, Senate Republicans have been calling on Senator Skoufis and the Senate Majority to take action and issue subpoenas as the Executive Branch continued to stonewall and withhold critical data.

Investigations Chair James Skoufis Refuses to Consider Motion, Mutes Microphone of Ranking Republican Member Senator Tom O’Mara In an effort to compel an independent investigation into bombshell allegations unveiled by the Attorney General’s nursing home report last week, Senator Anthony Palumbo today joined Senator Tom O’Mara, ranking member of the Senate Committee on Investigations and Government Operations, in advancing a motion calling on the Committee to issue a subpoena to the New York State Department of Health for the nursing home data and related communications.

Instead of considering the motion before the committee, Senator James Skoufis, Chair of the Committee on Investigations, dismissed it on a questionable procedural argument, even going as far to mute Senator O’Mara’s microphone during the meeting.

“For months, my colleagues and I in the Senate Republican conference have been calling on the Senate’s Investigations Committee to use its subpoena powers to get answers for New Yorkers who lost loved ones to COVID-19 in nursing homes

and adult care facilities. Today, the Senate Majority once again refused to take action, blocking our motion in committee to compel the use of subpoenas for an investigation. This partisan decision in the wake of the AG’s report is a dereliction of duty on their part and a grave injustice for the families of the deceased. This is the sole committee equipped with the power to fully investigate state government, and their failure to act is shameful,” said Senator Anthony Palumbo.

“It is time for the Senate Democrat Majority to stop stonewalling and protecting Governor Cuomo on the nursing homes crisis. In the wake of the attorney general’s report, the failure of the Investigations Committee to immediately issue subpoenas and demand testimony from Governor Cuomo and his administration once again completely abandons legislative responsibility. It makes the Senate Democrats complicit in this tragedy. Every step of the way, the Senate Democrat Majority has been willing to give the Cuomo administration every opportunity to keep trying to cover its tracks and rewrite its false story on nursing homes,” said Senator Tom O’Mara.

Backdoor moves by Gov. Cuomo to borrow $13 billion and raise the state’s debt by 20 percent has Assemblyman Joe DeStefano renewing his call to return the emergency powers granted to the governor during the COVID pandemic back to the elected legislature.

“The governor’s latest borrowing spree will have an enormous impact on the taxpayers and saddle generations for years to come with political spending that they had no part of,” DeStefano said. “The backhand way he put us even further in hock is another cause for concern.”

Acting on his own without legislative oversight, Cuomo circumvented the state’s statutory debt cap and Debt Reform Law in his latest attempt to prop up his financially bankrupt administration. “Putting such power in the hands of one man has always been a bad idea and this man’s latest actions prove it yet again,” the Assemblyman said.

In a scathing report by the Empire Center’s E.J. McMahon, it was exposed that Gov. Cuomo’s Executive Budget for fiscal year

2022 “authorizes an enormous increase in state-supported debt, all in the form of non-voterapproved backdoor borrowing— and all of it pointedly excluded from the state’s statutory debt cap.”

The budget also includes language excluding all debt issued over the next two years from the provisions of the state’s 2020 Debt Reform Law, which caps outstanding state supported

Brady’s ‘GOAT’ It All!

BY TOM BARTON As the confetti dropped after Super Bowl 55 one thing that was clear ... there was only one GOAT, and that was the old goat. For all the hype and build up the Super Bowl fell flat, but the outcome was historical. In a year of so many uncertainties and question marks, we all got the ending to the NFL season that we’ve seen before. Tom Brady holding the Super Bowl trophy and MVP award.

Now we look to next season with the 44 year old Brady. The GOAT has said he is returning, as is Gronk, and much of this championship core. With that said there is already talk of this team being underappreciated because they aren’t the favorites

to win it all in 2022. In fact they aren’t even the favorites in the NFC, but they certainly are among the top dogs once again.

Can I Disinherit My Spouse (in a Nice Way)?

My wife and I are both married for a second time and have children from prior marriages. We have always maintained separate assets and would like to leave those assets to our respective children and not to each other upon each of our deaths. Can you prepare a Will with these provisions?

While you can certainly execute a Will that disinherits your spouse, unless your spouse consents to being disinherited, either in writing prior to your death or by choosing not to exercise the right of election upon your death, it will not be honored. In New York, pursuant to the New York State Estates Powers and Trust Law §51.1A, the surviving spouse is entitled to elect against the estate of the deceased spouse in an amount up to $50,000 or one-third (1/3)

of the estate, whichever is greater. The elective share not only applies to the estate (those assets that are in the deceased spouse’s sole name and pass according to his or her Last Will and Testament or through intestacy) but also to “testamentary substitutes.”

Examples of testamentary substitutes are assets owned jointly with other individuals, assets in trusts or real property with a retained life estate. Life insurance is not included in the calculation and debts are deducted. It is best to have an experienced attorney advise on the

calculation of the elective share as it can be complex.

The surviving spouse must exercise the right of election

by filing documents in the Surrogate’s Court within

six months from the date letters testamentary or of

administration are issued or no later than two years from the date of death of the deceased spouse if no estate proceeding is filed with the court.

Although you can each agree not to elect against the other’s estate and sign a Last Will and Testament that memorializes the distribution that you wish to accomplish, the only way to legally waive the right of election and ensure that the surviving spouse is bound by the waiver is by executing a post nuptial agreement whereby each of you waive the right of election in

writing. If you wish to accomplish your goal and have your assets pass to your respective children instead of to the surviving spouse, you should consult with an experienced attorney who can properly draft such an agreement as there are certain requirements that must be followed. Those entering into a marriage who know that they wish to disinherit a spouse can also execute a prenuptial agreement before the marriage is legalized.

As stated in our previous articles, the current restrictions used to limit the Covid19 virus has resulted in increasing depression not only to our veterans, but also to the general population. Not only has depression increased but so have suicides. The suicides of veterans have increased by 20%, and there is also an increase of suicides among the civilian and teen populations due to these restrictions. Unfortunately many of those suffering from this stress try to self medicate by turning to alcohol or drugs that not only increases the depression, but can lead to other very serious problems.

Dogs can play an integral part in your emotional well-being. They can contribute to your happiness.

Studies show that dogs reduce stress, anxiety, and depression, ease loneliness, and improve your all-around health. For example, people with dogs have lower blood pressure and are less likely to develop heart disease. Just playing with dogs has been shown to create

positive feelings and bonding for both the person and the dog.

Someone living in depression has so much to gain from having a dog.

You have more than likely heard the statement, “Dogs are mans best friend.” Actually the American Heritage Dictionary defines pet as; “an animal kept for amusement or companionship.” Having a dog as a companion can prevent depression from worsening, especially therapy and service dogs who are constantly in tune to your needs. Caring for an animal gives you a purpose, makes you feel wanted and helps take focus away from your depression.

Just petting a dog or running your hand through its hair can relax and give you pleasure.

In the past, service dogs were used only by people with physical disabilities. However, now their use has expanded to helping those suffering from anxiety, post traumatic stress (PTSD) and depression. Today dogs are allowed in hospitals and senior citizen

ON THE SEA

When we were kids, it was all about readin’, ritin’ and ‘rithmatic. On the sea, especially in cold water environments, it is all about rescue, recovery and rewarming. I don’t expect that there are many boaters out there on our bays, creeks and littoral areas of the ocean now.

But some are out there. And the waters are cold now and will still be cold once April 1 comes around and the moorings go back in. This column is about that.

He Fell In And Can’t Get Out- Rescue

We’ve written about the new NYS law that requires PFDs on all boaters in boats under 21’ between November 1 and May 1 of the following year and about hypothermia. When I wrote about hypothermia, I suggested that you conduct a little experiment with the kids (or yourself!) to demonstrate the power of water to draw heat out of you - 25x faster than air of the same temperature.

To prove it, try this experiment with the kids… get a glass of water to room temperature and drop an ice cube in it; at the same time, lay an ice cube on a napkin next to the glass of water. When the ice cube in the glass has melted away, there will still only be a small amount of dampness around the ice cube sitting on the napkin… But, upon further research

conducted by cold-water specialists in Canada (where the water is cold all the time, when it isn’t frozen), exertion – such as thrashing or swimming – can increase that heat-stealing mechanism up to 10x – that’s 250x now!

So, if someone falls in, it is critical to get them out ASAP.

Rescue, Recovery and Re-warm – The Maritime 3 R’s into the body, which is the biological intent, but it also stops air from getting to the lungs. The person bobs back to the surface (their lungs are full of air) and they suffocate in the open water, unable to breathe due to a blocked air passageway. This is what is now called “dry drowning.” There is no water in the

When Rescue Become Recovery

By USCG standards, a rescue becomes a recovery when the victim has died from the circumstances. So, if someone just falls in, it is still a rescue, right? Well, hopefully, but there are circumstances when death can come almost unbelievably quickly. As has been pointed out here before, cold water – sudden cold water – can be a killer long before hypothermia gets to you: 1. A splash of cold water in your face can cause you to involuntarily inhale water, which is a killer. Not swallowing it down your throat into your stomach but inhaling it into your lungs. This is the “gasp reflex.”

2. In some people, the reaction doesn’t get that far into their bodies. They hit the cold water and, as soon as it touches the back of their throat, it closes up.

4. Even something as simple as a racing heart from shock and fear can create hyperventilating on the part of the victim. Dizziness followed by unconsciousness results as the ratio of oxygen/carbon dioxide changes in the victim’s blood system.

If you are the victim, remember this: an initial deep and sudden gasp followed by hyperventilation that can be as much as 600-1000% greater than normal breathing can be deadly. You must keep your airway clear or run the risk of drowning. Cold Shock will pass in about 1 minute. During that time concentrate on avoiding panic and getting control of your breathing. Wearing a lifejacket during this phase is critically important to keep you afloat and breathing.

When the difference between your body temperature and the water temperature is greater than 30-degrees, the chance of a heart attack from the sudden immersion goes up dramatically.

Believe it or not, if you apply heat directly to the arms and legs of a hypothermic person you just pulled from the sea, you can kill them. It is called the “After Drop” – you force cold blood that has pooled in the arms and legs (constricted blood vessels) back toward the heart and brain and that lowers their body temperature. Apply heat (hot water

bottle, towels that have been microwaved, heating pads, your warm, dry hands) to the head, neck, chest and groin. Of course, you need to get them into a warm or at least dry environment as part of the rescue. Lie them on their back or side (not face down.) This person is dying so there is no time to be squeamish or bashful. Lie on top of them and wrap a blanket around you both. There are two schools of thought on getting them out of the wet clothes. Some believe that the little bit of water than you can warm with your body can aid in their recovery. My own experiences lead me to believe that, if the alternative is wet clothes or just a blanket around a naked body, go with the wet clothes and cover them up with blankets and your warm body. If they are conscious, give them warm – not hot – liquids. Add sugar for energy. No alcohol and avoid caffeine if possible.

Bring ‘em back alive, captain.

BY DON STERLING Do you walk your dog or does your dog walk you? Does your dog jump on people, run out the door, bark at every passing car, dog, cat or person passing your front window? Does your dog growl at you when you go near his food or you try to take something away from him, does he jump on the furniture, go into the garbage or “counter surf”?

These are all common problems and generally easily corrected with the proper training.

But what is training? It is the somewhat complex application of common sense. The common sense part is the easy part, simply follow the rules nature has laid down for all social animals while the complex part is understanding the personality of your particular dog.

So what are natures rules?

That’s nature’s way and as much as we have domesticated our dogs, they are still dogs just as we are still just human as we have been for millennia.

Even the best children will rarely do their homework rather than open their i-pad without some sort or guidance.

If you are considering single motherhood, it’s very important to ask yourself some questions, since this style of parenting may not be for you!

However, just because you can’t answer every question the way you would like, doesn’t mean you won’t do a good job!

If you haven’t resolved the following issues, now would be a good time to work on them.

Have you decided how you will explain your choice to be a single mother to your son or daughter? You should be able to present a positive view of your family situation.

Have you decided what the role of the father will be, or, how to navigate through the selection of a sperm bank.

Have you considered the financial and emotional aspects of the father’s involvement, if any, with the child?

Does he want to transparent in the child’s life, or does he not even want his name on the birth certificate? LEGAL

ADVICE should be sought in many circumstances.

Are you aware of the physical and emotional changes you will go through, before, during, and after childbirth?

You should arrange to have a friend or family member be your labor coach and help you out the first few weeks after birth. Keep in mind that you won’t always have a partner to share feelings with you or comfort you during the hormonal shifts that go along with pregnancy.

Have you thought about what you will tell family and friends, and are you prepared for negative remarks?

Knowing how to handle people’s offhand comments is important, but be sure you are not simply trying to shock or hurt someone, or to prove that you can do something on your own!

Have you resolved any issues about men and relationships, and are you sure that you are not angry at men or trying in some way to get even with a particular man? It’s important to place a high value on male and female relationships in order to give your child a realistic perspective of the world. No matter what the sex of your child, it is important not to have negative feelings toward men.

Are you choosing to have a baby because you are lonely and need someone to fill the void? Hopefully,

your life is already rich and satisfying, and you have the ability to mother yourself when needed.

Do you think that having a baby

will preserve the bond between you and a man you love even after the relationship is over? THINK AGAIN! Having a child is not a guarantee that the relationship will continue.

Do you have a strong support system?

Just because you have lunch with your female co-workers doesn’t mean they will be there for you in the middle of the night. Don’t mistake work friends for real friends, and don’t overlook those friends you normally would shy away from because professionally you have little in common. You need to create an extended family.
