Brookhaven Creates New Commercial Redevelopment District Code

The Brookhaven Town Board has enacted a new Commercial Redevelopment District Code designed to revitalize existing commercial parcels that have fallen into disrepair or hard times.

Brookhaven Town Supervisor Ed Romaine and Brookhaven Town Planning Commissioner Beth Reilly explained in a conference telephone interview this week what prompted town officials to enact the new code. “What we’re beginning to increasingly see is that some commercial properties (in Brookhaven) are going vacant,” Romaine said. “This code was put in place to reverse underused and underutilized commercial shopping centers, and commercial properties that have fallen into disrepair, and we want to see them revitalized and utilized,” Romaine said.

The plan is for the town to bring together property owners and developers wherein developers, rather than building out new commercial properties, would instead invest to redesign and bring existing properties into the 21st Century in the long-term. “So many of our commercial properties in Brookhaven were built out over 50 years ago and longer, and what worked for Brookhaven then, doesn’t necessarily work today,” Romaine said, citing numerous now-defunct businesses that have since been erased from Brookhaven Town’s and Long Island’s landscape.

Once thriving, prominent businesses that provided much of the financial heartbeat to the area such as Grant City, Grants Department Stores, Robert Hall, Billy Blake to Brookhaven’s east, and further west, Korvette’s Department Stores, are long defunct. “Businesses and

shopping centers that were built 50 and 60 years ago were not designed to meet the growing need that exists in Brookhaven now,” Romaine said, “So we want to take large stores or shopping centers that either have vacancies or are underutilized, and ask the owners of some retail (establishments) that are not doing well, and outside developers, to come together and reimagine what will work today and in the future.”

Both Romaine and Reilly cited the new 40,000 square foot Amazon Distribution Center in Shirley’s industrial park location as a prime example of the newer commercial demand.

The Commercial Redevelopment District Code does not target specific areas, and “can be applied anywhere in Brookhaven,” Romaine said. Reilly explained that business owners who want to revitalize their businesses can make applications to

Romaine underscored, however, “Only the Brookhaven Town Board can review the applications and vote on them.”

Reilly noted that a multitude of factors will come into play when considering applications including sewer districts that would support density for restaurants and commerce, and location of businesses in relation to public transportation. Reilly said, for example, mixed uses such as apartments above retail would be considered if both density and criteria with infrastructure to support any proposals are met, and are in compliance with Suffolk County Department of Health guidelines.

“So we’re looking to give businesses a shot in the arm where vacancies, supermarkets, and retail are suffering by bringing current business owners together with investors to make a deal,” Romaine said. “We’re looking to make what’s old, new again.” Reilly underscored, “We’re not looking for shopping centers to go vacant. Brookhaven Town is more interested in redevelopment rather than new development.”

The transformation won’t happen overnight. But with careful, well thought out planning, Romaine stated: “I don’t see this happening in the short run. In the long run, however, this code has the ability to renew the face of Brookhaven Town.”

DeStefano Calls COVID Detainment Bill Unconstitutional Pledges to Rally Colleagues and Public Against it

By Jim Emery A bill submitted for the 2012 legislative session in Albany that would give the governor unmitigated power to detain people for health reasons was deemed “Unconstitutional” by Assemblyman Joe DeStefano who pledged to rally his colleagues and the public against it.

“I am adamantly opposed to Assembly Bill 416 that would give the governor the power to remove and detain people he thinks are a health risk,” DeStefano said. “The bill leaves it up to the governor to decide how long they would be detained, the location and the criteria upon which they would be released.”

According to the Assemblyman, “The measure is both incredibly unconstitutional and frightening in its scope. It is unimaginable to think that a society would grant such dictatorial power to one man and I will rally my colleagues and the public against it.”

Under the bill, “the governor or his or her delegee…may order the removal and/or detention of such a person or of a group of such persons by issuing a single order, identifying such persons either by name or by a reasonably specific description of the individuals or group being detained.”

“This language is both chilling and unsettling and

would give Governor Cuomo the authority to indefinitely detain people in our state without recourse,” DeStefano said. “A single person cannot be vested with such unmitigated power over our individual freedom.”

The Assemblyman, who is headed to Albany this month for his second term, added, “While we must remain vigilant in protecting our health during the COVID pandemic, granting any person the power to indefinitely detain his fellow citizens in any manner he so chooses is not the answer.”

The First Senatorial District is truly a special place.

Geographically, it is one of the largest and most beautiful Senate districts in the state, spanning from Brookhaven in the west, to Montauk and Fisher’s Island in the east. But the true beauty of this district lies in the heart of its people. I have been privileged to represent these hard working, impassioned and compassionate individuals, who have stood side-by-side with me to ensure that we preserve our quality of life and advance the goals so important to individuals and families in our region.

Early on in my career I set goals, and to the people who elected me, I made promises. I did not rest until these goals were achieved.

I promised to protect our quality of life and was successful in advancing so many environmental measures, most importantly preserving over 100,000 acres of Pine Barrens for future generations.

I promised to deliver meaningful property tax relief and was able to put in place the successful STAR tax-relief program. I promised quality, affordable, and accessible healthcare and now Stony Brook Medicine has come to our hospitals on the east end and throughout the region. I promised to fight for quality education and state aid allowing our schools to thrive. As Chairman of the Senate Higher Education Committee for four decades, I worked to grow and enhance our State University system. I have fought tirelessly for the developmentally disabled population to ensure their needs are met and I have made mental health services a priority, especially on the east end which was dramatically underserved.

Dear Editor, I sit to write this statement with a heart full of gratitude to the residents of the First Senatorial District for their unwavering trust in me, and their commitment to the many goals we have achieved together throughout the years. A famous proverb teaches us that “A journey of a thousand miles begins with a single step.” Your support from the beginning of my tenure allowed me to take that first step. But just as every journey has a beginning, it must also have an end and today it is with a tremendous sense of pride and accomplishment that I complete my final term in office as your State Senator.

It would take a lifetime to thank all the people who have guided me along this journey. We have been a team made up of the multitudes of constituents who have taken the time to meet with me and share their stories and concerns, diverse groups who have educated me on the importance of their causes, college officials and school superintendents who have passionately advocated for students, volunteers who give up their time to serve our community in so many important ways, first responders who put the safety of others before their own, scientists from Brookhaven National Lab who make cutting edge discoveries, fishermen and farmers who put food on our tables, and my partners in government who work tirelessly to ensure that we are meeting the needs of all these individuals and groups. The initiatives we advanced were successful because they were rooted in the ideas and efforts of our local people who set out to make a difference in their community.

statewide significance are put before members of the legislature and a state budget of over $100 billion is negotiated. While this work is incredibly important, as I reflect on my career, it was the small victories not the major successes that are foremost in my memory. It was the fight to get housing for the medically fragile, developmentally disabled child who no one would house. It was getting the power turned back on for the senior citizen on a fixed income who had to choose between their prescription medication and paying their utility bill. It was watching a staff member help a constituent who could not read, sort out his bills once a month.

And the list goes on. I am blessed to have been given your trust and the opportunity to serve in a job that I have loved for more than 40 years. Working together we have accomplished so many goals important to residents of the First Senatorial District. While I know this has been a challenging year, I am heartened by the spirit of our friends and neighbors who have answered the call. Thank you for allowing me to serve our community and work with you over these past four decades. Wishing you all a happy, healthy, and prosperous new year.

This year, because of the global pandemic, we chose to do the event virtually, and asked Santa to deliver the toys ahead of time and ‘Zoom’ in from the North Pole.

The children were once again ecstatic to participate in this special, and memorable, holiday event. While it is not the same, we are happy to keep the children and their families in the holiday spirit and healthy ahead of Hanukkah, Christmas, and the New Year -- and that is what matters most.”

Kevin McCaffrey selected by the Republican caucus to be GOP Minority Leader for 2021 Suffolk County Legislator Kevin McCaffrey today announced that he has been selected by the Republican caucus to be GOP Minority Leader for 2021. The announcement comes after Legislator Tom Cilmi, who has held the title for the last three years, declined to seek the leadership position for a fourth year.

Cilmi, who is term-limited out of the office at the end of this year, said “It has been a privilege leading my Republican colleagues for the last three years. Synthesizing a variety of perspectives and finding consensus is not always easy, but I look back proudly on what we’ve been able to accomplish.

We were able to put the brakes on borrowing, reducing the debt burden on our taxpayers by tens of millions of dollars. We were able to successfully address a multitude of district-specific concerns for our members.

We influenced legislation put forth by our Democrat colleagues, perhaps none more remarkable than recent changes to Article 6, which ultimately passed unanimously. We passed Republicansponsored bills that were important to our caucus. Finally, we raised tens of thousands of dollars to help Republicans, including freshman Legislator Anthony Piccirillo, get elected.

“Equally as important to me is the manner in which we conducted our work, opting for productive compromise and collaborative give and take as opposed to the combative, antagonistic approach which characterizes

The County continues to be in desperate financial times. While we have been able to force the County to cut back substantially on borrowing, Steve Bellone and the Democrats have mismanaged the County’s finances for more than a decade. Our finances are ranked dead last in New York State, number 62 out of 62 counties according to NYS Comptroller Tom DiNapoli.

It’s going to take some time to dig out of this mess. While we continue to pressure our colleagues on the other side to make smarter fiscal decisions, I will be equally focused on regaining the Republican majority in this year’s elections. Officer Evacuates Homeowners from Burning House A Suffolk County Police officer was treated for smoke inhalation after he entered a burning home to evacuate a man and woman in Selden Saturday evening.

Suffolk County Police Sixth Precinct officers responded to a 911 call reporting a fire at a home located at 57 Abinet Court at approximately 4:55 p.m.

Officer Sean Kalletta entered the burning home and found two residents attempting to rescue their two dogs.

Officer Kalletta escorted Robert Baker, 55, and his wife Debra Baker, 51, out of their home and attempted to rescue the dogs. One of the dogs bit the officer.

Officer Kalletta was transported to Stony Brook University Hospital for treatment of smoke inhalation and a dog bite.

The Selden Fire Department responded to the scene to extinguish the fire. First Assistant Chief Keith Kostrna and Farmingville Fire Department Firefighter Richard Piccirello rescued a dog from the residence. Units from the Centereach, Coram, Setauket, Terryville and Medford fire departments also assisted.

Police officers transported the dog to Animal Emergency Service in Selden for treatment. The dog is expected to recover.

A second dog exited the home on its own and was uninjured.

Suffolk County Arson Section detectives are investigating the cause of the fire.

BY KARL GROSSMAN The Long Island Power Authority will decide in March whether to continue having an outside private company provide electric service— so far it has used KeySpan, National Grid and now PSEG—or become a true public power utility and supply the electricity itself.

Eyed as a model for LIPA when it was established by the Long Island Power Act of 1985 was the Sacramento Municipal Utility District in California. SMUD is a well-run true public power utility, “the nation’s sixth-largest community-owned electric utility,” it notes. It serves 1.6 million customers, a customer base comparable to LIPA’s. And, importantly, it not only provides electric service itself but SMUD has locally-elected trustees in charge.

It’s high time for a return to that original vision of LIPA—to provide electric service itself with elected trustees responsible for its management and the charting of Long Island’s electric future in harmony with the will of Long

Islanders.

But after the Long Island Power Act was passed, having the people of Long Island vote for LIPA trustees was pushed aside by then Governor Mario Cuomo and subsequently formally eliminated by his successor, George Pataki.

Instead, a scheme was imposed of having the governor, the speaker of the State Assembly and leader of the State Senate—the oft-criticized “three men in a room”—appoint LIPA’s trustees. From Albany, they have had a huge hold over LIPA. Citizens to Replace LILCO was the key grassroots organization that pushed for creation of LIPA—with strong support of Long Islanders and the island’s government officials.

“THE PROBLEM ISN’T JUST SHOREHAM. THE PROBLEM IS LILCO!” was the headline of a fullpage advertisement that Citizens to Replace LILCO placed in many newspapers in the early 1980s.

Returning to the Original Vision of LIPA the nuclear power plant that the now defunct Long Island Lighting Company, LILCO, was building, one of many nuclear power plants it sought to construct on Long Island.

A state-created Long Island Power Authority, said the ad, “would protect our safety. Here’s the plain fact: LILCO’s life depends on opening Shoreham…And this despite Shoreham’s safety problems.

That’s why they’re [LILCO] spending a fortune on propaganda while we put up with terrible service. A Long Island Power Authority would close Shoreham… and supply dependable, safe power.”

It continued: “If you’ve had it with incompetence and arrogance… if you’re fed up with one of the country’s worst utilities—join us now.”

The head of Citizens to Replace LILCO, Maurice Barbash, in explaining its strategy, said with creation of LIPA the aim would be to stop the Shoreham plant from going into operation and having “an elected non-partisan board” of

LIPA that “would be, unlike LILCO, accountable to the people.”

A Newsday survey at the time found a solid majority of Long Islanders in favor of a public power utility here. The Long Island Power Act began: “The legislature hereby finds and declares that an economic emergency exists in the Long Island Lighting Company service area.” It cited “mismanagement and imprudent decisions by LILCO.” The governmental effort was bipartisan. Mr. Cuomo voiced his backing saying “I very much like the idea of public power” pointing to how it takes the profiteering out of supplying electricity. And he signed the act.

“This is a movement of the people by the people for the people,” said Leon Campo, a member of the steering committee of Citizens to Replace LILCO and chairman of the Suffolk-based Peoples’ Action Coalition.

And LILCO, a terribly run private utility, indeed in the

1930s and 1940s on the brink of bankruptcy, was replaced by a Long Island Power Authority.

But LIPA wasn’t allowed to become a public power utility like SMUD. LIPA’s system of jobbing out electric service has faced enormous criticism—justifiably.

BY TOM BARTON Before the season began, lines makers set the usual suspects as the betting favorites. In a year of uncertainty and problems, when the dust has all settled we have two of the top 3 favorites back battling for the chance to call themselves National Champions.

Preseason #1 Alabama will face off against Ohio State at Hard Rock Stadium in Miami Gardens, Florida, on Jan. 11 for the College Football Playoff National Championship. This will be a rematch of their Sugar Bowl national semifinal matchup following the 2014 season, the first matchup under the four-team playoff format.

The Crimson Tide are coming in as hot as anyone after beating up and destroying Notre Dame as the biggest favorites in the new college football format 31-14. The Buckeyes were more than a touchdown underdog against Clemson and likely #1 overall pick Trevor Lawrence, but they looked like championship material shutting down Clemson and running away with a 49-28 win.

The Crimson Tide opened up as a 7 1/2 point favorite and that quickly fell to just -7.

What is shocking is the total is set at a record number with a huge 76 spot posted. We can see why though because

Do My Bank Accounts Go Through Probate?

Like most lawyers will tell you when it comes to legal questions, “it depends.”

Probate is the process in which a Will is submitted to the Surrogate’s Court with a petition signed by the Executor asking the Court to admit the Will so the estate can be administered according to the decedent’s wishes. In New York, the Executor must either submit waivers and consent forms from the distributees, that is, all the people who would have inherited had the person died without a will, or the Executor must serve the distributees with notice of the probate proceeding and wait to see if they object.

If there is no will, a similar process called an Administrative proceeding must be initiated.

Whether property must pass through probate depends on how the property is owned. Like real property, bank accounts

can be owned in many ways. If a bank account is held jointly between two or more parties, there is usually a right of survivorship. This means that if two people are co-owners of an account, and one owner dies, the surviving owner inherits the account, without the need for probate.

Similarly, if an account is held in an individual’s sole name, but has a beneficiary designated, the beneficiary can go to the bank and complete a claim form to inherit the account without any Court intervention upon the account holder’s death. However, if the account is held in an individual’s sole name without a co-owner or designated beneficiary, the funds in the bank account will pass through the decedent’s probate estate.

For most families leaving assets to their spouses, children or siblings, probate is not a concern. It does cause some delay since the Executor must wait

This process known as a Will Contest can drag on for years and cost tens of thousands of dollars in legal fees. Similarly, if you do not have any close relatives, the Executor of your Will must hire a genealogist to find your next of kin and serve them with notice of the probate proceeding – causing additional cost and delay.

Chance Meetings on the Road to the Beach

BY ROBERT CHARTUK Mowing lawns and working odd jobs as a kid, I always saw to it that I had a surfboard and a decent wetsuit, but most of the time I had to scramble for a ride to the beach. This was no problem for an adventurous lad living on Montauk Highway, the main road all the way to the end of Long Island.

One October morning, I put my suit in a black garbage bag, grabbed my board, crossed the street, and stuck my thumb out heading east. As luck would have it, a beat-up Volkswagen Beetle came along with boards on top and two hippy surfers heading to the beach. They strapped my board on top of theirs and off we went.

Psychedelic rock music was coming from the 8-track and I was in heaven. We checked Shinnecock first, the Bowl on the west side, and climbed the great tower to check the east, Flys, which we judged to be breaking better, so we headed

there via the long ride around Southampton to the other side.

To get to Flys from the Bowl, you could have paddled across the inlet like my friend Richard and I did during that epic winter session when we almost died coming back across, or you could head back over Ponquogue Bridge to the mainland, drive down Tuckahoe Lane past Southampton College, get back on Dune Road and head west again to the inlet past the Southampton mansions, including the gothic St. Andrew’s Dune Church.

We did just that and were paddling into some nice waves at long last. We surfed for a few hours and on the way home the hippies bought me pink snowballs and a grape soda at the Katrinka Deli in Hampton Bays. Oddly, though I surfed up and down the coast for many years after that, I

never saw them again.

Thirty years later, a few buddies organized a surf trip to Costa Rica and we were joined by friends of friends, eight of us all together.

Once at our destination in Tamarindo, five split off to visit the rain forest and three, including myself, focused on the surf. The first day there, we hit the waves right out in front of the hotel, not the best break in the vicinity, but certainly the closest. The city is an embarkation point for ecotours and excursions north and south to the better breaks.

The next day the trio hit the road first heading north to Playa Grande and then, in a quest for the absolute best break, south to Langosta and then to Avellanas and Junquillal, a four-hour quest that would have been like riding from Smith Point to Montauk and back, except on the worst roads you can

imagine. The roads were so bad that drivers created new paths to get around potholes and then when another pothole formed, they went around it again. There was a presidential election going on and the main issue was who was going to fix the roads. On a back road to Playa Negra, we encountered a full highway construction crew paving a dirt road into the jungle. Not sure if they were just practicing, but they were certainly in the wrong place by our estimation.

To be frank, I would have paddled out at any of the spots we checked, but the majority wanted to keep searching for the best of the best, even if it took all day. We ended up going in at Negra to ride some sweet Pacific waves on the incoming tide. Thankfully, we had an early start because, since I didn’t have a watch, woke up at four in the morning

to get the crew going. By late afternoon, we were pretty hungry and to our glee there was a restaurant on the side of the road right by the ocean and we dropped in for a large jamon and pina pizza which we took out to eat on the beach under a driftwood lean-to someone had built right at the break. We were stuffed with a slice left in the box which we gave to an old man walking by who was extremely happy to have received it.

In the water with us was a photographer from Spain and on the beach, there was another lensman from California. After the session, they showed us the images on a laptop and for a few bucks to make it worth their while, burned us a CD. On one of my waves, as serendipity would have it, the two photographers snapped my picture almost simultaneously and it is interesting to see the ride

from different perspectives.

We lazed about the rest of the day trading surf stories and enjoying life in the shade by the ocean in a warm, friendly country. I revealed that I was a surfer from the time I was a little kid, mowing lawns to buy wetsuits and boards, paddling across Shinnecock Inlet in the dead of winter, losing boards and finding them again, and getting to the beach any way I could, even if it meant hitchhiking and riding bicycles with a board tucked under my arm all the way from Center Moriches to Westhampton Beach. I told them about the time two hippies picked me up in an orange Volkswagen beetle and took me to Flys to surf after climbing the tower and stopping by Katrinka’s Deli on the way home. It was pretty mind blowing when one of the pair said to me, “That was us.”

CARING FOR THE SELF The Inner Supervisor -

We have all had the supervisor or mentor, or someone else in our life who was the source of wisdom and inspiration when we were stuck.

The wisdom can still be with you, even when that individual is not present in person.

Bring to mind a session that didn’t go as well as you’d planned Notice any resistance in your body, heart, or mind as you recall the memory?

If you were channeling that favorite supervisor, what might you say to that individual after a tough session? What Tone? What words or sounds? What facial expression

and body language?

Try embodying this stance now, but directing that constructive energy toward yourself!

Walking the High-Wire

We don’t move about in our work, beyond a frantic run out the door between clients. But movement can allow us to reembody ourselves and become more present for ourselves and our clients.

The next day you find yourself hurried or stressed, feel your feet as you walk in the hallway or waiting room between clients.

Allow your breath to anchor your step, intentionally dropping in to connect with sensations in your
