Suffolk County Legislature 53rd Organization Meeting January 3, 2022

After 16 years of Democratic control, Republicans took control of the Suffolk County Legislature. Kevin J. McCaffrey (R-Lindenhurst) was sworn in as Presiding Officer, and Steven J. Flotteron (R- West Islip) was sworn in as Deputy Prrsiding Officer. Kevin McCaffrey and Steve J. Flotteron were both voted in unanimously in a bipartisan 18-0 vote. Also selected were Bill Duffy as Legislative Council Republican from Coram, Frank Tassone,as Clerk of the Legislature, and Brett Robinson, as Chief Deputy Clerk.

The complete Legislature was installed by Judge Andrew Crecca and Suffolk County Clerk Judy Pascale. New Republican Legislators include Dominick S. Thorne, (R- Patchogue), Trish Bergin, (REast Islip), Manuel Esteban,Sr. (R-Commack) and Stephanie Bontempi (R-Huntington).

Presiding Officer Kevin McCaffrey wishes to move forward in an Independent and bipartisan manner. His biggest priorities are to stabilize and improve the County budget, improve county services and enhance police protection.

Suffolk Cop Nearly Killed in Line of Duty to be Surprised with $128,000 Donation from Fellow Cops & Long Islanders Before Christmas Holiday Fellow law enforcement officers to surprise children of Suffolk officer hit by drunk driver with toys for holiday Suffolk County Police Benevolent Association Vice President Lou Civello will be joined by fellow Suffolk County cops to present Suffolk County Police Officer Timothy Thrane, who was nearly killed after being struck by a drunk driver in the line of duty, with a donation of

$128,000, raised by fellow officers, friends, and other generous Long Islanders, before the Christmas holiday, on Wednesday, Dec. 22, 2021, at 4 p.m., at Thrane’s home in Mastic Beach. Officer Thrane was released from the hospital earlier this month after spending three weeks in a medically induced coma, after a Nov. 2 incident where he was hit by a car on William Floyd Parkway. Thrane’s children will be surprised with Christmas toys

from Santa and fellow members of Suffolk law enforcement.

The $128,000 donation is a result of a “Fund the First” crowdsourcing effort led by the Suffolk PBA and LEOWeekend.

The goal was set at $25,000 and within a week surpassed $100,000.

The funds will help offset costs associated with Officer Thrane’s continued recovery from his lifethreatening injuries.

Legislator Mazzarella took an opportunity to meet with Suffolk County Probation Officers and their families at his District Office in Mastic to show his appreciation to them for organizing and participating in a charity bike ride to commemorate the 20th anniversary of September 11, 2001, and to benefit the Tunnel to Towers Foundation.

“I am always happy to recognize Suffolk County Employees who go above and beyond for charities such as these,” said Legislator Jim Mazzarella. “What makes this recognition especially gratifying is that the money raised went

to the Tunnel to Towers Foundation in support of true national heroes.”

This event, which Supervising Probation Officer Daniel Buckley organized, originated with a group of Probation Officers who annually participated in the Babylon Town Wounded Warrior Soldier Ride. Due to COVID restrictions, they were forced to change plans and organized their own ride at the Veterans Memorial Park in Calverton.

Between the Probation Officers and their families, there were roughly 60 participants.

Through the money raised by donations for riding, a generous

check from the Probation Officers Association, and contributions from people who did not attend, this event raised $4,250 for the Tunnel to Towers Foundation. Additionally, this year, an anonymous benefactor tripled all donations and boosted the Probation Officer’s contribution to $12,750.

The Tunnel to Towers Foundation is a non-profit organization that honors the sacrifice of Firefighter Stephen Siller, who laid down his life to save others on September 11, 2001. They also honor our military and first responders who continue to make the supreme sacrifice of life and limb for our country. They host several fundraising events throughout the year and offer many programs that support the families of victims of September 11, 2001, and our men and women in the armed forces.

One participant who overcame much adversity to complete his ride and support his fellow riders was seven-yearold Ricky Taylor of Moriches.

At 14.5 miles, Ricky took a hard fall off his bike while coming down a steep hill, but he got back on his bike and completed

the ride while bleeding from his leg. When asked what inspired him to keep going, Ricky Taylor stated – “Those Firefighters didn’t give up.” Ricky’s parents both participated in the 20-mile ride with him; his mom, Desiree, is a Probation Officer.

Komosinski Retires The Training Center’s coordinator Ellen Komosinski retired, December 30, 2021, after serving 22 years with the Suffolk County EMS Division. Ellen has trained many CPR instructors. SUFFOLK CLOSEUP

BY KARL GROSSMAN “So now we’re stuck here in paradise,” Victor J. Yannacone, Jr., the colorful, feisty attorney from Suffolk County, was saying from the Hawaii island of Maui the other day.

Mr. Yannacone and his wife, Carol, had gone to visit their son, Victor J. Yannacone III, for Thanksgiving 2019 “and then we were going to stay to April or May.” And then “the epidemic hit” of COVID-19 “and we were quarantined.”

“We never got home.”

And, at 85 with serious arthritis, “I don’t want to get on an airplane” with this underlying condition, and fly back. So, they remain in paradise.

Mr. Yannacone, with a long career in the law in Suffolk, remains involved in legal matters. “I’ve been doing civil rights law” from Hawaii, including working with attorney Cory H. Morris whose practice is in Melville.

It was here, notes his website, https://yannalaw.com/, that he “coined the phrase and created the field of Environmental Law during the litigation over DDT during the 1960s.”

from Patchogue where his law practice was based, was elected Patchogue village justice. He remained on the bench through 2002 and “adjudicated more than 8,000 cases,” says his website.

Some five decades ago, Mr. Yannacone brought a lawsuit in the name of his wife, Carol, joined in by a group of prominent Suffolk environmentalists including Art Cooley, Dennis Puleston, Dr. George Woodwell, Dr. Charles Wurster, Dr. Robert Smolker and Anthony Taormina to stop the then Suffolk County Mosquito Control Commission from spraying DDT. The result was an end to DDT use in Suffolk and later it was banned across the United States. The Suffolk group behind the lawsuit became a national organization, the Environmental Defense Fund.

“It was June 1966 in the New York State Supreme Court, Suffolk County, in Riverhead, when the first round of what later would be called the DDT wars began,” Mr. Yannacone has recounted to me.

“The suit was aimed at prohibiting the county commission—and the words years later still spilled off his tongue—“from any further use of DDT, an action brought individually and on behalf of all those entitled to the full benefit and use of the unique natural resource treasures of Suffolk County, without degradation from the impact of broad spectrum persistent

chemical biocides like DDT.” The judge in the case, the late Justice D. Ormonde Ritchie of Brightwaters, “was asked by the attorney for the county, ‘What’s the basis for this lawsuit?’” Mr. Yannacone said.

Then “the judge turned to me and asked, ‘Where should your adversary look this up?’” Mr. Yannacone recalled. “I said, ‘Try environmental law.’”

In their accounts of the case, The New York Times and other newspapers described it as involving a new concept of law.

Mr. Yannacone was to go on and write the two-volume treatise Environmental Rights & Remedies, to establish the Environmental

Law Section of the American Trial Association, and to give presentations through the years on environmental law around the U.S. and the world.

Among his presentations was what became known as his “Sue The Bastards Speech” delivered in 1968 at a convention of the National Audubon Society. “I called on National Audubon to follow in the footsteps of the civil rights movement and knock on courthouses across the land and seek justice for the environment: the air we breathe and the water we drink, and diverse populations of plants and animals on which human life and society depend,” said Mr. Yannacone.

Moreover, he was an attorney in litigation involving the Long Island Lighting Company’s Shoreham nuclear power plant—a failed project he challenged—and was an attorney in the lawsuit brought by veterans who were victims of Agent Orange, the toxic defoliant used by the U.S. military during the Vietnam War. The class action suit was settled in 1974 for $180 million, the highest settlement in the history of U.S. jurisprudence at the time.

He established the Brookhaven Town Council on the Arts and also the Brookhaven Town Symphony Orchestra. And on top of everything else here, Mr. Yannacone was an active baritone saxophone musician performing with it and other musical groups among them The Symphonic Band of Suffolk and Big Band East. Indeed, the “only thing I miss getting old,” commented Mr. Yannacone from Hawaii, is that “my arthritis has gotten so bad I can’t play any longer.” As for his baritone saxophone, “I’ve passed it on to my grandson.”

BY TOM BARTON The Brooklyn Nets are sitting atop the Eastern Conference with the best record and Kevin Durant is leading the way. Somehow though with Steph Curry’s historical season and the love affair writers have with players like the Joker and the Greek Freak, Kevin Durant is still being somewhat overlooked. Turn on any talking head sports show and you have heard comments from Curry for MVP as the “obvious choice”, to “Curry is the best player of this generation”. It’s all nonsense, when you compare it to Durant.

This is taking nothing away from Curry, but Kevin Durant is the clear cut MVP. Coming into the weekend Curry was +130 to win the

award, with Durant almost double behind him at +250.

This should be flipped.

Durant leads the league in points at nearly 30 per game.

He has nearly 2 field goals made per game more than Curry, while they have the same attempts per game. His field goal percentage is nearly 10% higher, and his rebounds and blocks nearly double up Steph. Steph has the 3 point shot, granted, but there is only a 1% difference between them there and assists, which should be a guard’s specialty, is even.

Durant’s team is in first place, and he has done so by putting the team on his back, despite injuries, bench problems and Covid. It’s possible that writers will look at James Harden and

In my last piece I laid out my Fantasy Baseball New Year’s Resolutions. And we went into the first 3 of the 5 resolutions in some depth. This week we will continue with the last of the resolutions and start to lay out the principles of positional scarcity and roster construction. It’s important to remember that Resolutions 4 and 5 don’t change over time. The names change over time but the circumstances don’t. And what was true in the spring of 1996 can often still look the same in 2022. So, let’s look at the 5 New Year’s Resolutions one more time.

1. Recognize that we are in a Dead Zone Era as far as the baseball is concerned and adjust accordingly.

2. Fantasy Over-hype is very real. BUYER BEWARE! 3. Forgive myself for not winning the whole league in 2021.

4. Remind myself that rookies still need 400 at bats and 140 innings pitched under the belts to become dependable.

5. Take a deep probing look at what I do own in my fantasy mixed dynasty league, and get to work on good solid lists for my re-draft leagues.

you witness people need to take a refresher on time and time again.

Patience and a steady hand are two of the most important traits of the successful fantasy sports player. And while there are certain successful indicators that manage to work most of the time, they won’t prevent you from stubbing your toe on Carlos Febles, Peter Bergeron, Colby Rasmus or Cameron Maybin, those guys all have one thing in common. Their at bats from 001 to 400 were filled with struggle. And so every spring many of the leading publication in the business love to put out Top 50, Top 100 and Top 10 prospect lists. And the lists are hungrily digested and consumed.

Many of these prospects are drafted way too high, get overbid on, and you watch other owners pay a lot for these cats in trades. And yes, many of them stuggle in their few hundred at bats to go on and have All-Star and even Hall of Fame careers.

Look no further than the 2011 call up of Mike Trout at the end of the season. After tearing up the minor leagues in 2011, the Angels called up Mike Trout and gave him 40 games played at the end of the season. In 123 at bats Trout hit .228 with 9 walks and 30 strikeouts. His on base % was .281 and his slugging

knock Durant because he is a scorer as well, but if you have watched this team there is no doubt who the alpha is, and

why this team is winning.

Curry will turn heads, and maybe writers’ minds, in this MVP vote. But, if you want to

see the most valuable player in the league, who right now is also the best player, look no further than Brooklyn.

My Fantasy Baseball New Year Resolutions, Part II % was .390. Was Trout lost? Hell no. Were smart owners like me encouraged? Oh, hell yes. Trout was all of 20 years old and he was in the major leagues. The very next year in 2012, Trout hit 30 home runs

with 49 stolen bases and a Fantasy Baseball God was on the scene rewriting the landscape.

The waiting length can be even longer for pitchers and much more variable. Blake Snell is a great example. Blake Snell was a highly touted prospect coming up with the Tampa Bay Rays. And he got 89

IP in his rookie season of 2016 with mediocre results. His 1.62 WHIP was a bad number although his 3.54 ERA was not terrible. Still, his 54 walks in only 89 innings pitched was a telling warning sign and

many fantasy teams steered clear of this pitcher who lacked command.

Well, I added Blake Snell in August of the 2017 season, and on the final day of the 2017 season Blake Snell went out and struck out 13 batters with no walks and I locked up a championship on the final day of the 2017 season. What did I see that

others didn’t. We had a character in that league that we will refer to as “Spiteful Bob”. Spiteful Bob hated owners who got all of the breaks in his diseased outlook on the world.

He was a curmudgeon crank who could only focus on the negative.

Any person who stood between Spiteful Bob and a window was clearly putting themselves at risk because Spiteful Bob could jump at any minute.

So what did I see that Spiteful Bob missed? Well, on August 20th that year I noticed that Blake Snell struck out 8 batters in 7 shutout innings. He followed that up on 8/26 with a 7 strikeout performance. I took notice of Blake Snell’s sudden emergence as he had been dominant twice in a row. He now had over 140 innings pitched on his resume and he had once been highly touted. I exercised a waiver pick on Blake Snell and his next start on September 1st he struck out 13 batters. So when he came back on October 1st, the final day of the 2017 season it was no surprise he struck out 13 batters yet again.

Was I surprised? Not in the least, nor was I surprised when he won the 2018 Cy Young Award. Spiteful Bob was outraged as this proved his theory that he had no luck. No, his eyes just weren’t open.

BY REV. FREDERICK MILLER. PH.D. Agent Orange was used during the Vietnam War as the herbicide to clear the forests leaves and vegetation for military operations. The military sprayed Agent Orange over more than 20 percent of South Vietnam between the early 1960s and early 1970s in an attempt to flush out their enemies. Agent Orange is colorless, named because of the orange band painted on the drums used during storage and transport.

The compound in Agent Orange most commonly linked to medical or health effects is dioxin. This was not intentionally added to Agent Orange, but rather a byproduct formed during the manufacturing process. Dioxin is a known carcinogen that’s toxic in even small doses.

Not really – when the “victim” isn’t wearing proper shoes – when he stepped on the gunwales and not into the boat – and when the wake of a passing boat (who shouldn’t have been making a wake!) rocked the vessel strongly. In other words, things just go wrong at all the wrong times. Are you ready to deal with it?

As a case in point, when I take young boaters out for seamanship exercises, I start the man-over-board drills with an example. I bring the boat up to 20 knots and ask one of the youngsters to throw a fender over board – and then count to 10 before yelling “Man Overboard!” During those ten seconds, two things happen.

The fender disappears behind the boat, well over a full football field behind, and the faces of the youngsters turn white and their jaws drop.

Don’t Fall Overboard!

Clearly, the best defense is not falling overboard. That means: 1. No “bow riding”, i.e., sitting up on the bow with your feet dangling over the side (btw, violation of Federal regulations – no limbs outside the boat while underway). Assuming the prop misses you as the boat whizzes over you, you could very likely be rendered unconscious by the boat passing over you. That is assuming the propeller misses you.

2. No sitting on the gunwales – the edge of the boat – even if you are holding on tight. The skipper takes a wake too hard and you are airborne. If you land in the boat, it is a small miracle. If you were sitting on the transom, unless the boat is in reverse, physics demands that you end up in the water. That is if you are lucky enough that the boat is going fast enough for you to land behind the propeller. You could be unlucky enough to land on the prop instead of in the water. A variation of sitting on the gunwales is holding the taff rail (railing around the stern of the boat) and jumping up and down with the swells as the boat passes over them. This is swell fun until the boat gets sluiced to one side or the other by those same swells pushing the bow around. Instead of coming down inside the stern of the boat, which a moment ago was just below you, you come down in the water.

3. The failure to use the “3 point system” while working the boat can get even the most seasoned mariner.

Always have 3 parts of your body in contact with the boat at all times, i.e., 2 hands, 1 foot; 2 feet, 1 hand. Try toppling over a 3-legged stool and you can see how much more stable this is than a 2-point system.

2. Someone else throws a cushion, fender, life-jacket – anything and everything – towards the victim to give them something to swim towards and hold onto.

3. The boat driver brings the boat to neutral. The skipper then determines what side the victim is on and turns the boat to the same side as the victim is on. It keeps the victim inside the turning radius of the boat – and keeps the propeller moving away from the person in the water.

The knife is to cut me away from the line I am tangled in that is dragging me below the water. Secondly, if the boat continues to steam way, start saving yourself – and that starts with conserving energy and heat.

Eventually, someone will start to look for you. Don’t panic and waste life-sustaining energy. Assume the HELP position or at least float with your arms across your chest and your legs crossed. If you slip below the water, don’t thrash and waste energy.

Lie there for a few seconds and then dog paddle up. Get back in the prone position and start over. If the water isn’t too cold, you can do this for hours.

Someone Has Fallen Off The Boat!

Train your crew in the following:

1. The first person who sees someone fall overboard does two things simultaneously. First, shouts at the top of his lungs “MAN OVERBOARD” and, second, NEVER takes his eyes off the person in the water and points at him constantly. I tell my crew, “Even if you have to watch him drown in front of you, never take your eyes off him.”

Why? If you lose sight of him, we may never see him again. It is unbelievably difficult to find a head sticking up out of the water. This is why the USCG often sends helicopters first to look for people in the water.

4. Call the USCG and tell the watch stander you have a “man overboard!”

Your crewmate may be injured, have swallowed a lungful of water or having a medical emergency (how about a heart attack?) Get the “rescue starts now” clock started ASAP! 5. Once you get alongside the victim, turn off the engine. Those props are potentially dangerous. Stop the engine entirely – especially if you are getting him back aboard via a swim platform.

Try the 10-second exercise one day with your crew. And watch their faces as the fender disappears astern…

Medicaid Income Eligibility in 2022

Q: Does my income qualify me for Medicaid long-term care?

A:

Medicaid provides long term care coverage to eligible individuals who meet certain asset and income requirements. Many people do not realize that they can become eligible for Medicaid and preserve assets - even when their assets and income seem too high. There are two types of Medicaid long-term care: Nursing Home Care (“Chronic Medicaid”) and Home Care (“Community Medicaid).

Under either program, you can still qualify for long term care regardless of income.

This does mean you can keep your income, but high income will not disqualify you from receiving Medicaid. Moreover, there are ways to retain all your income if receiving Community Medicaid. If married, there are ways to keep

a portion of your income when receiving Chronic Medicaid.

When examining Medicaid eligibility, it is important to distinguish between income and assets. An individual applying for Community or Chronic Medicaid in New York can have only $16,800 in assets, as well as a pre-paid irrevocable burial fund and certain exempt assets (e.g., an IRA, car, etc.). If married, the community spouse can keep up to $137,400 of the couple’s assets. If the community spouse is over the asset level, they can sign a spousal refusal. Spousal refusal is a declaration that the community spouse will not contribute to cost of care because they need the assets.

As to income, a Chronic Medicaid recipient must turn over all income above $50 per month to the nursing home.

Medicaid pays the rest of the cost of care. There is no way around paying income to the nursing home, unless the applicant is married. If married, the community spouse can retain $3,435.00 in income.

A portion of the Medicaid applicant’s income may be

transferred to the community spouse to reach that $3,435.00 limit. If the community spouse’s total monthly income exceeds $3,435.00, it must go toward the nursing home bill unless using spousal refusal.

Income guidelines are different for Community

Medicaid. This is because to “Age in Place” seniors need to use their income to live in the community. In 2022 Community Medicaid recipients can keep $934 per month of their income. Excess income is technically available to Medicaid. But those in the know use a Pooled Income Trust to capture the excess income. All excess income is deposited in the trust, run by a nonprofit, which pays the Medicaid recipient’s bills using that excess amount.

Eligibility for Medicaid is complex due to the strict income and asset guidelines.

Anyone with assets exceeding $16,800 or income over $934 should consult an experienced elder law attorney.
