Zeldin Secures Vital Extension in Congressional Spending Bill to Save 3 Local Sewer Projects

In the past two weeks, as Congressional funding was being negotiated, Congressman Lee Zeldin (R, NY-1) worked closely with House and Senate leadership, as well as White House Chief of Staff Mark Meadows to secure an extension of the September 30, 2022 deadline for the use of Community Development Block Grant Disaster Recovery (CDBG-DR) funds to September 30, 2023. This will save three local sewer projects in Suffolk County: Carlls River, Patchogue River and Forge River.

“The coronavirus outbreak has impacted so many aspects of our way of life, and our response must include saving local infrastructure projects that have experienced unexpected delays as a result of the pandemic,” said Congressman Zeldin. “These local projects are critical to our quality of life in Suffolk County, and I’m honored to deliver this huge win to ensure these projects get across the finish line. I’m grateful for the help of White House Chief of Staff Mark Meadows and Senate Minority Leader Chuck Schumer for doing their parts as well to make this a reality.”

The CDBG-DR program was established by the Disaster Relief Appropriations Act of 2013 to provide billions of dollars to improve disaster preparedness in communities in the aftermath of

SuperStorm Sandy. Under current law, there is a hard deadline of September 30, 2022 for the expenditure of CDBG-DR. Several of the projects funded through these programs broke ground, while others were expected to begin construction soon, according to the timelines that existed prior to the onset of COVID-19. Many of these projects were on track to meet the requirements to utilize federal funds in full by the 2022 deadline.

However, COVID-19 resulted in unexpected delays. Labor contracts and supply chains have further complicated the long lead times needed to implement these large-scale infrastructure projects, putting the funding of these projects at risk because they are unlikely to be able to meet the current deadline.

In Suffolk County, the Forge River, Patchogue and Carlls River sewer projects are part of the Suffolk County Coastal Resiliency Initiative (SCCRI), which has been allotted $67 million in CDBG-DR funds in addition to $243 million in Federal Emergency Management Agency (FEMA) Hazard Mitigation Grant Program (HMGP) funds.

While the Forge River project itself is to be constructed with FEMA/HMGP funds, the Forge River, Patchogue and Carlls River sewer projects that are part of

the SCCRI are tied together and interdependent because the Benefit Cost Assessment (BCA) that justifies use of HMGP funds for the Forge River project relies on the higher BCA rankings of the Carlls River and Patchogue projects.

Those projects rely in significant part on CDBG-DR funds, but their higher BCA ranking elevates the cumulative BCA ranking of the three projects, making the use of HMGP funds for the Forge River

project possible. For this reason, it is critically important to the Forge River project that the CDBG-DR funding for the other 2 projects be protected.

In July, Congressman Zeldin and

Congressman Bill Pascrell (D, NJ9) urged the House Committee on Appropriations to extend the use of funds for CDBG-DR, which was subsequently passed by the House in H.R. 7617.

Gas Station Owner Arrested for Allegedly Exploiting Workers

Suffolk County District Attorney Timothy D. Sini and the New York State Department of Labor today announced the arrest of a gas station owner for allegedly exploiting workers and threatening to retaliate against immigrant employees to deter them from reporting the alleged labor violations to authorities.

“Every single worker in this state – no matter what their immigration status is – has the right to be paid for their work and has the right to report unfair working conditions without fear of retaliation,” District Attorney Sini said. “It is unacceptable for an employer to exploit that fear and take advantage of their workers. I commend Governor Cuomo for enacting this critical legislation to hold predatory employers accountable and protect workers, particularly those in the immigrant community who are more vulnerable to these abuses, and I thank the Department of Labor for their continued partnership in rooting out workplace crimes.”

“Not only did this employer cheat these New Yorkers out of wages they were entitled to, but his inhumane treatment of his workers was unconscionable,” said New York State Department of Labor Commissioner Roberta Reardon. “All workers have rights under the labor law and thanks to Governor Cuomo’s leadership, we

have the tools to go after bad actors who trample on these rights. New York State has zero tolerance for employers who violate the law, and the Department of Labor’s Division of Worker Protection will do what it takes to hold employers accountable and obtain justice for New Yorkers.”

Jernail Singh, 64, of West Hempstead, is charged with two

Singh is the owner of MH One Enterprises, Inc., a gas company that operates the Sunoco gas station located at 793 Suffolk Avenue in Brentwood. Singh is alleged to have paid employees at the Sunoco station wages as low as $3.30 per hour and deprived employees of overtime pay for working 70 to 100 hours in a week.

In addition, Singh is alleged to have threatened to file false police reports or to call immigration authorities in retaliation against any employees who filed complaints about working conditions or cooperated in any investigations by the NYS Department of Labor. In one instance, Singh

allegedly confiscated an employee’s passport and threatened to call U.S. Immigration and Customs Enforcement and file false charges when the victim requested the passport back.

In furtherance of Singh’s alleged scheme to defraud his employees, he submitted falsified wage reporting forms to avoid paying Unemployment Insurance Fund contributions. A NYS Department of Labor audit determined that Singh owes approximately $9,000 to the Unemployment Insurance Fund and owes approximately $275,000 in wages, illegal deductions, and penalties for underpayments to 18 employees over a three-year period.

Singh was arraigned on the charges today in Suffolk County First District Court and was released on his own recognizance.

He is due back in court on Jan. 28, 2021. If convicted of the top count, Singh faces a maximum sentence of two and one-third to seven years in prison.

The District Attorney’s Office’s ability to prosecute Singh for these alleged crimes was furthered

by Governor Cuomo’s efforts to protect all vulnerable workers, regardless of immigration status.

The case was investigated by the State Department of Labor’s AntiRetaliation Unit, which Governor Cuomo created in October 2015 to investigate retaliation against those

who file complaints about wage theft, misclassification, and other labor law violations. In addition, the criminal complaint leverages a change to §215 of New York State’s Labor Law that Governor Cuomo signed in July 2019, which strengthened the law by clarifying that contacting or threatening to contact immigration authorities is included in the definition of discriminating or retaliating against an employee.

District Attorney Sini and the NYS Department of Labor urge anyone who believes he or she is a victim of wage theft; harassment, discrimination or threatened retaliation from an employer; or any other labor-related crime to contact the NYS Department of Labor at 1-888-4-NYSDOL. This case is being prosecuted

by Assistant District Attorney Shaun McCready, of the Financial Investigations & Money Laundering Bureau’s Labor Crime Unit.

A criminal charge is merely an accusation and the defendant is presumed innocent until and unless proven guilty.

Calarco Appoints Coram Pastor to County Ethics Board Suffolk County Legislature Presiding Officer Rob Calarco has chosen Rev. Dr. Beresford Adams to serve as his appointment to the county’s ethics board.

Rev. Dr. Adams, of Coram, will join the five-member Suffolk County Board of Ethics for a term that will expire March 26, 2024.

His appointment was approved by the legislature in a 17-0 vote at its general meeting on Tuesday.

“It is my honor to appoint the immensely qualified Rev. Dr. Adams to the Suffolk County Board of Ethics,” said Presiding Officer Calarco. “He is a humanitarian, an accomplished intellectual, and a man of faith who will bring a

tremendous heart and a strong moral compass to the agency.”

Rev. Dr. Adams has been the senior pastor of Faith Baptist Church of Coram since 1987. An internationally recognized figure in religion, he is a former assistant commissioner for community affairs at the Suffolk County Police Department. He serves as a board member of the Brookhaven Town branch of the NAACP and the Suffolk County Anti-Bias Task Force.

“I am honored to serve in such an important appointment,” Rev. Dr. Adams said.

At Faith Baptist Church, Rev. Dr. Adams has spearheaded

several initiatives, including a senior nutrition and Meals-OnWheels program, before- and after-school programs, youth programs, chapter formations of Narcotics Anonymous and Alcoholics Anonymous, a housing development group geared toward low-income families, an emergency food pantry, and participation with the RESPITE Program, which aided homeless families.

Rev. Dr. Adams serves as president of the boards of Middle Island Alliance Inc., East End African American Baptist Clergy, and Youth Awareness, Inc. He also serves as a board member of the Retired Senior Volunteer Program and Stony Brook School of Social

Welfare Geriatric Ministry. He has served on the Suffolk County Girl Scouts National Evaluation Committee, Pilgrim Psychiatric Hospital Board of Visitors, and Board of Visitors of Central Islip Psychiatric Hospital, of which he was appointed president by the Governor of New York State. He studied religion and theology at Princeton and Drew universities and is a guest lecturer at Stony Brook University’s School of Social Welfare.

The Suffolk County Board of Ethics was established by Local Law No. 56-2011 to oversee and enforce conflict of interest rules and financial disclosure requirements.

by the County Executive, and the County Legislature’s Presiding Officer, Majority Leader and Minority Leader appoint one member each. Under new training requirements put forth by Presiding Officer Calarco and approved by the legislature earlier this month, members of the ethics board must complete at least two hours of training annually on provisions of law relating to conflicts of interest and ethics at the federal, state and county levels, as required for them to discharge their duties.

Suffolk to NYIT, Next Stop: Department of Defense Cyber Sleuth

Zach Singleton, a 2018 Suffolk County Community College graduate with an associate degree in Cybersecurity, and 2020 New York Institute of Technology (NYIT) graduate was recently awarded a prestigious Department of Defense (DoD) Cyber Scholarship. The scholarship is part of the DoD’s student recruitment program aimed at generating the next generation of national security professionals. In exchange for a full scholarship, Singleton will perform a service obligation with the DoD as a civilian employee.

Destefano Joined by Assembly Republicans in Questioning State Pension Fund Divestment

Assemblyman Joe DeStefano was joined by his colleagues across the state last week in criticizing the decision by Comptroller Thomas DiNapoli to strip the New York State Common Retirement Fund (Pension Fund) of investments based on his own climate change assessments, rather than profitability. The Pension Fund is currently worth $226 billion and funds the retirement benefits for approximately one million public employees, retirees and their beneficiaries.

“Using the state pension fund as a tool to manipulate the energy markets in the name of environmental activism is a bad idea,” DeStefano said.

“The Comptroller’s primary responsibility is properly investing the retirement fund and protecting interests of retirees and taxpayers, not to advance a political agenda. The scary part is that the taxpayers will be forced to pay more to meet the state’s pension obligations if his decisions do not pan out.”

Comptroller DiNapoli recently announced that over the next four years he will begin the process of

reviewing investments in oil, gas and pipeline companies. If, in his determination, those institutions do not have a plan to transition away from fossil fuels they will be removed from the Pension Fund. This action is part of the Comptroller’s overall goal for the Pension Fund investments to reach “zero-emissions” by 2040. Right now, the Pension Fund contains roughly $2.6 billion in assets from fossil fuel investments.

“By using the contributions of public employees to threaten the energy sector, the Comptroller is not only jeopardizing the retirement system, but he is also affecting the markets and the price we pay for home heating oil and gas,” said Assemblyman Anthony Palumbo, who was elected in November to the seat long held by Senator Ken LaValle.

“Not only could we see our energy costs go up, but our taxes might increase since taxpayers are on the hook to fund state pensions.”

“We have plenty of state and federal agencies responsible for guiding New York’s environmental policy,” said Assemblywoman Melissa Miller of Atlantic Beach. “The Comptroller’s office isn’t one of

them. It is disappointing that this decision effectively bends to the will of activists, rather than prioritize the needs of the taxpayers and the well-being of the countless public employees and retirees who have worked to build the Pension Fund into what it is today.”

“For years, investments in the energy sector provided stable returns and were part of a diverse portfolio that invested in the basic needs of our economy,” said Bethpage Assemblyman John Mikulin. “Now, one million state employees and retirees are forced to watch their hard-earned retirement investments move away from a profitable approach, and into a politically-motivated uncertainty.”

“New York liberals have long targeted U.S. energy companies as an enemy, when the fact is energy is the life blood of our economy,” said Assemblyman Michael Montesano of Glen Head. “We have finally become energy independent and no longer have to rely on foreign entities for this essential resource.

The benefits of controlling our own energy agenda are invaluable and the Comptroller’s decision is sending us in the wrong direction

when important strides that have been made.”

“The Comptroller is not investing his own money here,” Assemblyman Doug Smith said.

The Holbrook Republican added: “He has been a sound steward of the Pension Fund, but his focus must remain on profitability and investments that translate into financial stability for the men and women who have spent decades in public service. Public employees deserve to know that their retirement contributions are secure and being managed the right way. Advancing a political agenda has no place in the decision-making related to the Pension Fund.”

New York’s Pension Fund is the third-largest in the United States, responsible for the investments of more than one million public employees, retirees and their beneficiaries.

DeStefano and his Republican colleagues make up the Minority Conference in an assembly dominated by Progressive Democrats. They frequently speak out against policies and legislation that do not have the best interests of the taxpayers at heart.

Town Demolishes “Zombie House” on Baldwin Road in Sound Beach

On December 14, Councilwoman Jane Bonner (left) was on hand to watch the demolition of a vacant and abandoned “zombie house” at 14 Baldwin Road in Sound Beach.

The long-abandoned house was the source of resident complaints leading to numerous Town of Brookhaven housing code violations. It was demolished in accordance with Chapter 73 of the Town Code which provides a “fast track” to rid neighborhoods of unsafe structures. The cost of demolition and debris removal is the responsibility of the property owner, and the Town places a lien on the property that is then placed on the tax bill. The County reimburses the Town and then

they collect the money from the property owner.

Councilwoman Bonner said, “The neighbors have lived with this dangerous eyesore for too long and I am happy that the Town has been able to get it cleaned up.

I commend our Law Department for their efforts to remove this zombie house, and many more in the Town of Brookhaven, making our community a better place for the residents who take pride in their homes.

Town Fire Marshal’s Hazardous Material Response Team Cleans Up Residential Mercury Spill in Stony Brook At 7:07 am on December 14, the Stony Brook Fire Department (SBFD) was alerted about a hazardous material spill at a home on Whitford Road in Stony Brook. Upon arrival of the SBFD, it was reported by the homeowner that he accidentally spilled approximately one quart of mercury on his driveway. A request for the Town of Brookhaven Fire Marshals Hazardous Material Response team was then made. Upon arrival, Chief Fire Marshal Christopher Mehrman assessed the scene and determined in addition to the clean-up of the mercury, precautionary testing within the home was necessary to ensure that mercury was not brought into the house on the resident’s shoes or clothing after the spill

occurred.

While dressed in protective clothing and respiratory protection, the Fire Marshals meticulously removed the hundreds of globules of mercury from the driveway employing a specialized multifiltered mercury vacuum.

Utilizing specific testing equipment for mercury vapor, the interior of the home was found to be void of any contamination. At 12:15 pm, mitigation was complete. The mercury was removed from the site and brought to an appropriate facility for disposal.

Mercury is a toxic substance that people can be exposed to by swallowing or touching.

However, inhalation of mercury vapor is far more

dangerous and can cause ill effects, especially to young children. Mercury is a heavy metal that is in a liquid state at room temperature but will slowly transition to a gaseous state when open to the atmosphere.

During this pandemic crisis, where municipal revenue shortfalls are widespread and unemployment remains at seven percent, Brookhaven Town has taken the necessary, but never easy, steps to reduce the financial burden facing its residents. While municipalities across the nation look to substantially raise taxes to offset COVID-19 induced deficits, Brookhaven Town has chosen to limit spending and reduce its workforce. Furthermore, they are introducing creative ways to generate additional revenue by looking to repurpose abandoned and/ or tired commercial properties that may harm the surrounding community. The establishment of “floating zones” will spur economic development, leading to job creation, improved home values and, most importantly, provide a means of reducing the tax burden for the residents of Brookhaven. As Town Hall creates a Long Island model for others to follow, a hat tip is in order.

The Passing of John Mullen

BY KARL GROSSMAN John J. Mullen, a leading wordsmith of the anti-nuclear power movement on Long Island, died last month. Working pro bono with attorney Tom Twomey, who passed away in 2014, Mullen used his great gift of language and brilliance at advertising and direct-mail to challenge the scheme of the Long Island Lighting Company to turn Suffolk County into a “Nuclear Power Park.”

Yes, “Nuclear Power Park.”

Mr. Twomey obtained—and Mr. Mullen brought to public attention—a four-inch-thick “Nuclear Power Park Report” put together by LILCO. Nuclear power plants would be built throughout Suffolk under LILCO’s plan to become a major distributor of nucleargenerated electricity on the U.S. East Coast—with the people of the county undergoing the enormous risks of having the counterparts of the Chernobyl and Fukushima nuclear power plants here.

Four nuclear power plants would be built along the Long Island Sound in

Jamesport. It was during the U.S. Nuclear Regulatory Commission hearings on the LILCO Jamesport project that Mr. Twomey secured the “Nuclear Power Park Report.”

And, three nuclear power plants were supposed to rise 30 miles to the west of Jamesport, at Shoreham. The first, what was referred to in NRC licensing proceeding papers, as Shoreham Nuclear Power Station 1, was completed and underwent problem-plagued low-power testing. It was stopped from going into commercial operation by opposition at the grassroots and by Suffolk and New York State governments. It now sits, a cement hulk, its nuclear innards removed, with its demolition deemed too expensive by the Long Island Power Authority, to which LILCO turned it over for a nominal $1. There would be no Shoreham Nuclear Power Stations 2 and 3 nor were there to be any of the other nuclear plants LILCO planned elsewhere in Suffolk.

Mr. Mullen had been advertising

director of the Long Island TravelerWatchman in Mattituck when the big nuclear power push and resulting strong resistance —a veritable energy “Battle of Long Island”—was erupting. He would later work for other newspapers in Suffolk.

Newspapering was in John’s family.

His father, also John J. Mullen, was circulation director and a board member of Newsday. The elder Mr. Mullen, John would recount, was the “right-hand man” to Alicia Patterson, the daughter of the founder of the New York Daily News, as she struck out on her own to found and run on Long Island her own newspaper, Newsday. The Mullens lived, and John grew up, in Garden City, where Newsday was long published.

Indeed, part of Mr. Mullen’s strategy in challenging nuclear power on Long Island was to put together a broadsheet newspaper, New York State Against Jamesport, on which he is listed as Publishing Director and Editor In Chief.

John utilized a blunt “in-your-face” approach to taking on LILCO and its nuclear power scheme. For example, in an old yellowed copy I have kept of New York State Against Jamesport, there is a half-page declaration that John wrote titled: “TO THE SHAREOWNERS OF LONG ISLAND LIGHTING COMPANY, SHOULD YOU SELL NOW?” It began by speaking of the big nuclear push by LILCO, “the possibility of 20 nuclear power plants.” And, the LILCO shareowners were advised, “LILCO’s ambitious nuclear program could represent a bad investment for the company and a financial loss for its shareowners. There is growing resistance to nuclear power plants not only with the public but in financial institutions and shareowners.” And it went on with critical information.

John met the love of his life, Mary Ann McCaffrey, in 1979. Together, they would move to Manhattan and John would work at Oglivy & Mather where

he was an executive in its direct response division. But they returned to Suffolk in 1984 establishing Mullen & McCaffrey, which since 1984 has been a crackerjack agency doing direct mail, fundraising, advertising and PR for a wide range of clients here, especially environmental organizations.

“Johnny is dead at 73 which is too soon, but he is kept alive for me by all the family and friends who are sharing their Johnny stories with me,” Mary Ann wrote after Mr. Mullen’s death. “He told the truth—sometimes offending people—but was always forgiving and loving, and caring.”

John Mullen of East Hampton was a Suffolk environmentalist of whom we should all be proud and indebted to for his superb work in preventing Suffolk from becoming a “Nuclear Power Park,” and, on the positive side, along with Mary Ann assisting so many good groups and people here.

The Knicks had their runs but then ran into Jordan and the Bulls dynasty. Since then it’s been sporadic at best for the Knicks but while they continue to rebuild their franchise it’s the new kid in town that has the city that never sleeps abuzz.

Immediate Need Medicaid: The Fastest Route to Homecare Services

What is immediate need Medicaid and how does it differ from regular Medicaid?

I m m e d i a t e need Medicaid is an expedited application process to receive long term care at home paid for by Medicaid.

Unlike the standard Medicaid application process, which can take approximately 6 months to receive services, those applying for immediate need Medicaid tend to receive care at home within one month of applying.

Both immediate need and regular Medicaid have the same eligibility requirements and fall within the Community Medicaid guidelines.

A Community Medicaid applicant can have up to $15,750 in their sole

name, own their primary residence with an equity value of less than $898,000 (equity limit disregarded if spouse or disabled child in the home), and continue to maintain all tax deferred retirement accounts so long as they are in payout status.

Any additional assets must be transferred out of the applicant’s name, either to a spouse, third party, or an asset protection trust.

Immediate need is a great option for those who have limited resources to cover the cost of care during the pending application process.

Applicants, or their representative, must attest to the fact that the applicant is in immediate need of care, is not or will not continue to

receive informal or professional homecare services, and that the applicant’s current insurances does not cover the cost of care. A determination of eligibility must occur no later than seven calendar days after a completed application is

received, and a nursing assessment to determine the number of hours the applicant is entitled must occur within 12 calendar days. It is important to note that under immediate need Medicaid, the applicant is automatically assigned an agency to provide the care, whereas under regular Medicaid, an applicant can shop amongst various agencies to determine which agency is right for them.

After 120 days of receiving services, the applicant will receive a notice from Medicaid to either sign up with a Managed LongTerm Care plan (MLTC) or be auto-assigned a MLTC within 60 days of the date of the notice. If

the applicant likes their aides and is looking for a smooth transition, it is a good idea to determine which MLTC contracts with their current agency so that the aides can continue the care. The MLTC must provide the same number of hours for at least 120 days, at which point they can re-assess the applicant and determine new hours.

Due to the complexity of the Medicaid process, families interested in long-term care planning should consult an Elder Law attorney to assist in navigating the system to ensure the get the right type of Medicaid in place.

I was crewing with a new captain for the first time and, when the Chief Medical Officer Marty Boorstein grabbed the scotch because there was no alcohol in the medical kit, I started to worry that more was at work here than Alberto. Such a product would be Band-Aid’s Advanced Healing Blister Cushion. Not all burns come from fire – think about putting your hand on a hot exhaust pipe or having a line run through your ungloved hand at a high rate of speed… Allevyn and Duoderm have similar products and all can last for several days in place if need be.

What do you do if someone needs artificial respiration? First, I hope you’re up to date on your Red Cross First Aid training. If not, “Google” it and get into a class.

In addition to getting good solid training on medical “tech”, you’ll be properly trained in CPR, including artificial respiration. And when you train for that, one of the key items is something between your mouth and the victim’s. Only when “in extremis” do we bypass modern day sanitation and body-fluid control – and one device you might want to have aboard is the NuMask.

It fits inside the victim’s mouth like a snorkel rather than over the face like a mask.

In summary, you don’t have to stop at the over-the-counter medical kit. You can take your skippering skills to the next level.

Remember, you are responsible for the crew, the boat and the boat’s wake.

“It is just a Band-Aid”

When someone wants to say that something hasn’t really been fixed, they often say, “They just put a band-aid over it.” Band-Aid, which is a brand name, realized that they could do better themselves and the new water-proof Band-Aids, on the market now for years, are dramatically better than the old version. There is a semi-permeable membrane over sterile gauze.

This makes them waterproof and breathable. Wounds need that in order to stay clean and yet be warm and moist enough to promote circulation and healing. These new Band-Aids, and 3M’s “NexCare”, are roughly 2x as expensive but worth every penny in healing and prevention from infection.

• When in doubt, keep quiet.

• Never discuss someone’s age, weight or income.

• Remember, when the brag books start flowing, all babies and brides are beautiful – so part with a compliment.

• Don’t come to the table late because the football game is tied in overtime; family trumps sports teams always.

• For those that are on their second marriages, be sure to refer to their partners by their correct names, not by their ex’s name.

• It’s not OK to give teenagers “just a taste” of alcohol, especially when they don’t belong to you.

• It’s rude to fall asleep after dessert; get up and go for a walk.

• Ask if it’s OK to bring leftovers home, before you break out your own ziplock bags.

• Always compliment the chef and everyone who brought something to eat.

BY ROBERT CHARTUK Just after sunset, The Took and I heard a rustling in the bushes across the street and we sidled over to our weapons. We watched as a man emerged with camouflage paint on his face and grass sticking out of his clothes. “Police,” he shouted, “It’s okay.” He was on a stakeout hoping to catch the Christmas Sniper and was lucky we didn’t shoot him. He told us the area was being watched and not to worry. When he suggested that we close up shop, we hightailed it out of there thinking the trees were in good hands for the evening.

The morning paper gave us another fright: “Christmas Sniper Strikes Again!” This time the target was shot through the window of his house shortly after he answered a knock on the door with nobody there. He was wounded in the shoulder. The police said the weapon was the same shotgun fired the night before. Our new advertising campaign, “Christmas Trees ½ Price,” drew zero customers and we called it quits early. Sometimes you expect bad news and the next morning paper confirmed our intuition: “Sniper Rampage Continues; Fourth Man Shot.” The gunman had another busy night and our dream of extra cash for the holidays evaporated with

the headlines. This time he shot a man in the jaw with a .22-caliber bullet as he sat in his home. While we skulked in the shadows of our idle trees, the gunman got bolder.

He called the police and said the cops

were crooked and his victims were drug dealers who had it coming. The police responded by saying there was no evidence the shootings were drug related and the gunman was only trying to mislead the authorities.

Great comfort in that, we thought.

After the fourth incident, the sniper took a recess, but the community remained on edge. Terror kept the buyers away. Our misfortune meant a bonanza for our friends and family who were the recipients

The Christmas Miracle: Part 2 of ridiculously cheap trees, okay, free, which we even delivered, and we donated a few to the Historical Society thrift sale.

It had been 17 days since the sniper

last struck and on Christmas Eve, Flanders wouldn’t be denied a happy holiday. They came out in force and bought up everything we had left.

“Was that the miracle?” my friends would asked when I told the story of the Christmas Sniper. “No,” I would tell them. “Just hold your horses.”

It was the wee hours of New Year’s Eve when the sniper returned. After calling in a bogus accident report, he blasted out the emergency lights of the responding officer’s patrol

car and disappeared. Flanders went back into panic mode and the year kicked off in fear. Later that month, police were alerted to a cache of guns hidden in a car and were able to trace them to the shootings. Six days later, 21-year-old Yusef Abdullah Rahman was arrested as the Christmas Sniper.

Fascinated with guns since he was a kid, Rahman fancied himself as a commando. Wearing a bullet-proof vest and military clothing, he rode around on a bicycle looking for people to shoot. In a confession to the police, the sniper said he started playing army combat games when he was six years old and bought his first real gun at 14. He killed someone four years later. ‘’It appears that he enjoyed killing,’’ said Timothy Mazzei, deputy chief of the district attorney’s homicide bureau, now a state Supreme Court judge. ‘’He got his kicks out of playing army and shooting people.’’

Rahman liked to practice combat training maneuvers and the day we heard his first shots, he said he was crawling around the woods when he encountered a dog, which he shot. He said he then saw the dog’s owner, and shot him. His defense lawyer contended that he was suffering from the delusions of a

paranoid schizophrenic and believed he was on a combat mission with Tall Man, Radio Man, Blaster and five other soldiers. He said he was part of a secret government task force assigned to special missions and got his orders over a military radio. He was facing extradition to Missouri where, as Joseph Davis, he was wanted for murder. ‘’He wanted to kill all the drug dealers in Kansas City,’’ a police sergeant said, and was suspected of an execution-style killing of a youth. He lived for about two years in a shack in the woods and detectives knew him as “Rambo.” He was also facing auto theft charges and was wanted for questioning in four other fatal shootings. ‘’I don’t know why I shot this man,’’ Mr. Rahman said describing the third attack. ‘’I just wanted to shoot someone.’’ Rahman’s insanity defense didn’t hold up and he was sentenced to 42 years to life.

The Took and I remain utterly amazed that the sniper didn’t pick off the easiest of his potential targets— two hustlers huddled around a fire in an open lot trying to sell Christmas trees. “That’s not a very happy ending,” my friends tell me. “Four guys and a dog got shot, and one guy died. What kind of miracle is that?”

“The miracle is we didn’t get shot.”
