New York Sports Gambling Online Goes Live Saturday

By Tom Barton New York has mobile sports betting! The state announced on Thursday afternoon that Saturday at 9 am mobile sports betting would be launched for four handles in the Big Apple. Caesars, DraftKings, FanDuel, and Rush Street Interactive all were ready to be operational by this past weekend. Five other sportsbooks including MGM and Fox Bets will soon follow and launch shortly.

This is a huge win for New York. Senator Joe Addabbo has been pushing for the legalization of sports betting for years and many feel this is a long time coming. Addabbo citied the new incoming Governor as a pivotal reason that this was pushed through. Over the years many, including myself on LI News Radio and Wanna Bet!?

Part-Time Security Guard Allegedly Stole Nearly $4K of Assorted Tools A Town of Huntington security guard was arraigned today for stealing tools from the town and selling them for profit, announced Suffolk County District Attorney Ray Tierney.

“Instead of safeguarding town property, Mr. Chura allegedly took advantage of his position to steal items from the town to financially benefit himself,”

said Tierney. “Thanks to the work of the Suffolk County Police Department, this individual will now have to face the consequences of his actions.”

“The arrest of Robert Chura is a reminder that no one is above the law,” said Suffolk County Police Commissioner Rodney Harrison. “While working as a security officer for the Town of Huntington, Chura took advantage of his position by burglarizing town property and stealing tools to make a profit at

the taxpayer’s expense. I commend Second Squad detectives who worked collaboratively with the Town of Huntington and the Suffolk County District Attorney’s Office to quickly make this apprehension.”

Robert Chura, 29 of Selden is charged with burglary in the third degree (D Felony); grand larceny in the third degree (D Felony) and official misconduct (A misdemeanor). His next court date is Jan. 26.

Chura allegedly broke into a tool room that he did not have access to, or permission to be in while he was on duty to steal three hedge trimmers, two chainsaws, and two leaf blowers worth $3,700 and sold them to Leonel Hernandez of Patchogue.

Hernandez, 34, is scheduled to be arraigned on Jan. 24 for Criminal Possession of Stolen Property in the Fourth Degree (E Felony).

The case is being prosecuted by Assistant District Attorney Sean

Public Integrity Bureau.

Michael Murphy Naval Sea Cadet Division, and Mila,” said Gutierrez. “Wreaths Across America is just one way to partake in the celebration of our heroes during this holiday season, and it was an honor for all of us to do it.”

Losquadro and Panico Announce Completion of Two Paving Projects in Mastic and Mastic Beach

Brookhaven Town Highway Superintendent Daniel P. Losquadro and Councilman Dan Panico have announced the completion of two paving projects in Mastic and Mastic Beach.

In the first project, Mastic Beach Road was paved from Mastic Road to Whittier Drive in Mastic Beach. This $288,777 paving project was funded in part by a $250,021 Community Development Block Grant (CDBG). In addition to the resurfacing of Mastic Beach Road, the Brookhaven Highway Department entered into an intermunicipal agreement with the Mastic Beach Fire District to install concrete curbing at the corner of Mastic Beach Road and Whittier Drive, surrounding the Mastic Beach Fire Department.

The second project, which included the paving of Mastic Boulevard, Hawthorne Street and Cumberland Street, cost $359,165 and was also funded in part by a CDBG grant in the amount of $294,997. In addition to the resurfacing of the roadways, this project involved the installation of drainage between Mastic

Boulevard and Clinton Avenue. As part of this drainage project, several trees were removed and a 30’ by 60’ retention area was excavated.

In addition, two sections of Cumberland Street that were previously dirt roads were graded, widened and paved.

“Mastic Beach Road is a critical artery in Mastic Beach used by many motorists traveling to and from William Floyd High School, William Paca Middle School and Tangier Smith Elementary School,” said Superintendent Losquadro. “And, the drainage

project completed in the vicinity of Mastic Boulevard and Clinton Avenue will help to eliminate flooding concerns in the area. Both of these projects were funded in part through Community Development Block Grants, enabling us to complete these critical infrastructure improvements. In addition, identifying shared services and consolidation opportunities with the Mastic Beach Fire District was a win/win for taxpayers in that district.”

“The Mastic Beach Fire District is continually striving

to find ways to be fiscally responsible and to operate as efficiently as possible for the benefit of our community,” said Wally Greene, one of the commissioners of the Mastic Beach Fire District.

“Partnering with the Town of Brookhaven Highway Department to install curbing around the firehouse was just one example of a way we can consolidate services and realize savings that would not normally be available to us, for which we would otherwise pay a premium.”

SUFFOLK CLOSEUP

BY KARL GROSSMAN John V.N. Klein, an extraordinary Suffolk County executive, has died at 90.

Mr. Klein held the top post in Suffolk County government between 1972 and 1979.

A huge achievement of his—which had national impact—was the Suffolk County Farmland Preservation Program, now emulated across the United States. And it has kept Suffolk still among the top farming counties in New York State.

The program’s inspiration was a ride in a helicopter heading east from western Suffolk County. As he looked down, Mr. Klein, who grew up in a bucolic Fort Salonga in the Town of Smithtown, viewed western Suffolk, so much of it covered in subdivisions and shopping centers, crisscrossed with highways, a stark contrast from when he was young. Then eastern Suffolk appeared below, green and verdant, with many farms, made more unusual by their placement juxtaposed with water—the Atlantic, the Long Island Sound and numerous bays.

And he began thinking: how could this be saved?

The solution was what was then a first-in-the-nation concept: purchase of development rights. Suffolk County would pay the owners of the farms the difference between what

Both were open and frank. Their warmth for each other was palpable. Mr. Klein would succeed Mr. Dennison as Suffolk’s second county executive.

the farms were worth in agriculture and what they could be sold for as sites for subdivisions. In return, the owners would sign binding legal papers keeping the land remaining in agriculture in perpetuity.

Since the program began in 1974, wineries have been added to Suffolk’s agricultural mix. And farming continues to provide a base for tourism in Suffolk—and fresh food close by.

Mr. Klein stood strong against the scheme to turn Suffolk into a “nuclear park”—in the parlance then of nuclear power promoters.

They planned seven to 11 nuclear power plants here. Under Mr. Klein, Suffolk County government declared its opposition to nuclear power in Suffolk and waged a battle that would continue for many years and ultimately won.

Mr. Klein was the leading critic of the plan of the U.S. Army Corps of Engineers to construct groins— rock jetties—on the Westhampton Beach oceanfront. It was folly, said John V. N. (for Van Nostrand—his descendants were early Dutch and German settlers on Long Island) Klein. It would be, he said, “handwrestling with God.” And, it would be “robbing Peter to pay Paul” with the groins catching sand moving in the ocean’s westward “littoral drift” along the south shore but robbing it

Unfortunately most veterans seek a job as soon as they are discharged from the service. Why do I say unfortunately is because it’s just that, something you have to work at for money. Years ago I had the opportunity to help the hard core unemployed find employment for the CETA program. One of the things I did was to bring in speakers to tell them about the different opportunities available. I had the group try to determine whether the speaker was happy with their job or not. Correctly they found over 50% of the speaker were not happy working. That figure is even higher today. Those unhappy came from the labor areas, whereas the others were career people.

John V.N. Klein Extraordinary County Executive Dies

A career is a long-term endeavour, something you build towards and work upon every day. Actually the difference is that you have to go to work, but with a career you want to go.

As veterans we have a better opportunity of getting into the career field of your choice. Most of us, as children, grew up with the idea of what we wanted to do as adults. Those dreams were career not a laborious job. Why not seek it now? As a veteran you have assistance through the bill.

He lost that fight but was proven correct. The Corps is now moving ahead with its Fire Island Inlet to Montauk Point project of which the Westhampton construction decades ago was a part—but without any groins for the reasons Mr. Klein cited.

He led the county in challenging the plan of the oil industry to drill off our coast, pointing to the routine oil spillage from offshore operations and the impacts of spills on Suffolk.

A Republican, he began in government as town attorney of Smithtown, then was elected town supervisor. He was the last chairman of the centuries-old Suffolk County Board of Supervisors, replaced by the Suffolk County Legislature in 1970. So committed to Suffolk, he gave up being a supervisor to run to be a legislator on the new panel and became its first presiding officer.

He established a close relationship with Suffolk’s first county executive, Democrat H. Lee Dennison, elected

It looked for years like Mr. Klein was headed for statewide or national office. “His horizons are unlimited,” said Suffolk GOP Chairman Edwin M. (Buzz) Schwenk in the 1970s of the articulate, highly-intelligent Mr. Klein. Said then New York Attorney General Louis Lefkowitz: “I think he is one of the most outstanding men I have ever seen in public life.”

Then in 1979 the controversy over the county’s $1 billion Southwest Sewer District scandal included a challenge in a GOP primary to Mr. Klein’s renomination, and he lost.

Mr. Klein went on to decades of prominence as an attorney on Long Island. He and his wife, Audrey—they lived in St. James in Smithtown— were to move to Virginia where he had received undergraduate and law degrees from the University of Virginia in Charlottesville. She predeceased him. They were married for 62 years. Mr. Klein died in Virginia on December 22.

In my last two articles I laid out my Fantasy Baseball New Year’s Resolutions. And we went into the first 4 of the 5 resolutions in some depth for my last two articles. This week we will continue with the last of the resolutions and start to lay out the principles of positional scarcity and roster construction. It’s important to remember that Resolution 5 doesn’t change over time. The names change over time but the circumstances don’t.

And what was true in the spring of 1996 can often still look the same in 2022. So, let’s look at the 5 New Year’s Resolutions one more time.

1.

Recognize that we are in a Dead Zone Era as far as the baseball is concerned and adjust accordingly.

2.

Fantasy Over-hype is very real. BUYER BEWARE! 3. Forgive myself for not winning the whole league in 2021.

4. Remind myself that rookies still need 400 at bats and 140 innings pitched under the belts to become dependable.

5.

Take a deep probing look at what I do own in my fantasy mixed dynasty league, and get to work

Resolution #5 is a huge and important task for every player in a dynasty league. And what makes it so important is that you have to balance it alongside positional scarcity in preparing your spring draft lists. Though I play in a highly competitive mixed dynasty league, I would have to say my hardest league I play is a draft from scratch NL-only league so I make up lists every winter for that league. It is just as important to compare the lists I make up for the dynasty league as I do the redraft league. In my dynasty league I am returning with Mike Trout and Trea Turner as 2 of my 20 Keepers.

In that league, we also maintain a Minor League Supplemental Roster of 5 players. I have 5 catchers on my Supplemental Roster. This is a golden age of sorts at the catcher position as no less than 14 catchers are ranked as either their respective organization’s #1, #2 or #3 prospect as ranked by Baseball America. What is the correct way to play this golden age of catchers? If you are in a format which only uses a single catcher I would argue this is not much to concern yourself with. With 14 highly rated prospects on the way and a decent number of capable major league catcher out there already, the

impact in a 12 team league won’t factor in much. But if you play in a format which requires you to play 2 catchers this is highly important you get 2 quality catchers because a host of teams will be able to just given the

depth at this time. Keeping up with the Joneses is a big concept in fantasy baseball and if you miss this boat, you could get left out in the cold with a huge deficit at the catcher position.

Going into this season, the Baltimore Orioles catcher Adley

Rutschman is the #3 ranked prospect in all of fantasy baseball. He is compared as being a cross between Buster Posey with more power, and Mike Piazza with a little less batting average. Those are 2 Hall of Famers at the catcher position. Rutschman’s hit tool is projected to be so good that scouts see Baltimore using him as their DH on days that he is rested from catching chores. This could even happen as early as 2022. This could even make him a draft pick as early as the 5th round in an AL-only format and a premium player in a dynast format. I grabbed him in 2019 in my dynasty league as he was the #1 overall pick in that year’s MLB draft.

Lots of options, but the depth of the position should be your guide. I can only play 2 catchers each week, and even if I keep a 3rd to have injury depth, I do have an extra 2 guys I can hold on to as trade bait. Going into a redraft league, I should prioritize Rutshcman and Moreno in an AL format, and consider drafting Bart and Keibert Ruiz in an NL-only format. Room has been made for both to be full time players for their teams. Get to work on your lists.

Waves can be the most beautiful and the most fearsome aspect of the sea. Whether you float above them or dive beneath them, you had better understand them and most certainly respect them. This column is about that.

Winds Are Known From Whence They Blow, Currents

By Where They Go

A northerly wind means a wind FROM the north, thus blowing you south. A northerly current means a current heading TO the north, setting you in the same direction – north. What does that have to do with waves? Largely, waves are the off-spring of the wind. Ignoring for the moment that wave action can be created by tidal forces sluicing through a narrow channel, waves are created by the wind. When the water is fairly still, as you’ll often see early in the morning, and the wind starts to pick up, those little over-lapping wavelets, called the Cat’s Paws, will eventually build into something significant. The greater the distance that the wind has blown over the water unhindered by land (called its “Fetch”), the greater the size of the waves. If you ever wondered why mariners for centuries have feared Cape Horn at the bottom of South America, it is because the “fetch” there is essentially infinite. Wind can blow continuously, unimpeded by land, around the entire planet in

your sleigh ride, and more than likely multiplies the sea sickness aboard the boat. Another way to gauge what awaits you at sea is a Severity measurement. This indicates the amount of energy carried by each bit of wave and is proportional to the energy of a wave (the square of its height) divided by its wavelength (how much distance the waves are apart, measured from peak to peak.)

As you can probably do in your head, 6’ waves that are 6’ (distance, not time) apart are more severe than 6’ waves that are 12’ apart. We don’t need the Cray computer for that one…

Packing a Punch

The “sea state”, which can be characterized as the sum of the height, frequency and direction of waves, is the key to understanding comfort – and safety – of any passage over the water, even more so than the strength and direction of the wind.

Anyone that has ever been caught in 6’ seas that are but 6 seconds apart in frequency would gladly trade them for 10’ waves that are 30 seconds apart. The first is a kidney-busting beating; the latter is a sleigh ride. Of boats that sink at sea, slightly more than 1 in 20 of them sink because they break apart from the pounding of the waves upon the hull. BTW, for very different reasons, four times as many boats sink at their dock than sink at sea.

So, I’m Heading Out To Sea – How Are the Waves?

One of the unsung heroes of our maritime services is NOAA (www. noaa.gov) and their National Ocean Service (http://oceanservice.noaa. gov). They, along with the Army Corps of Engineers, understand how important wave action is and maintain 70 wave-gauging stations placed around the coastline of the U.S. (including the Great Lakes) collecting data on wave height and direction in

near-shore areas. Now you can get an access to NOAAs fixed buoys, on your cell phone. I get Buoy #44017, which is 23 nautical miles south southwest of Montauk. Go to https:// www.ndbc.noaa.gov/station_page. php?station=44017 access it. Oh, and it is your favorite price. Free.

“Surf Happens” – But How Do I Gauge It?

For the more scientifically inclined, the energy within a wave is proportional to the square of the wave’s height. Like many things in nature, a 4’ wave isn’t four times as powerful as a 1’ wave. But things are rarely equal. A long, slow, four-foot sea is one of life’s great pleasures at sea. What matters is how close together and how steep those waves are. A good way to compare waves for steepness is the wave height divided by the square of the frequency period. This is essentially how fast your sleigh ride is going to be – or the beating you are going to take. Halving the frequency period (from, say, 10 seconds to 5 seconds) of a wave quadruples the acceleration of

“My Child Thinks He’s/She’s the Boss!”

In this era, where both parents/ single parents need to work fulltime, there are periods of time where the oldest child will have the responsibility of caring for younger siblings until at least one parent returns home from work. During the time when no adult is present, the child left in charge is in control of the household and assumes the pseudorole of authoritarian.

Some older, mature, responsible children take on this leadership role naturally without incident. The daily routine of what is expected of them is carried out as requested by the parent/s.

Then there are other children who lack the maturity and balance to properly handle the level of control caring for siblings requires.

They are unsure as to what their level of authority is. They become empowered by being the boss of the family while no adult is at home. They do not know how to shut that power off once the parent does come home.

They want to continue to call the shots in the house. They do not know how to separate what’s expected of them when parents are not home and when parents are home. They become bossy, domineering and controlling due to their lack of maturity and lack of parental behavioral clarity.

behaving that way just diminishes your authority. No. You do not have a lot of energy after working all day.

No. You are definitely not perfect. No. You do not have unlimited patience.

But one thing you do have is the responsibility to parent well under any set of circumstances. Discussing the consequences from now gives you and your children clear punishments that will be executed if necessary.

If this sounds familiar to you, it is time to take the power out of the bossy child’s hands and put it back into your hands – where it belongs in any healthy family structure.

Here are some ideas to regain a healthy household balance: 1.

Talk with your child and clearly lay out a plan of expectations for both you and your child. Perhaps, in the first place, you did not express all the details of what you expected from your child when you are not home. Sit with this child and the younger siblings so that all the rules are clearly and calmly communicated. Ask the children if they understand the rules. Prompt your children to ask questions about the rules and responsibilities. Answer the questions in a respectful manner giving importance to their feelings.

Let your children know why it is important that you work. Let them know what your job is all about so that they understand how you spend your day.

2. Do not over-negotiate with your children. You are the parent. You are responsible for the safety and well-being of your children. Some rules must be followed while some others can be modified. Let your children feel like they had some say in the modified

rules.

Motivating. Bargaining is a sign that your child has worn you down and that you are just giving in to their demands to keep them quiet. This is not effective because it erodes your legitimate authority in your home.

In contrast, a reward system for good behavior clearly shows that you are the parent with final authority. Set daily or weekly goals for the children to reach. Use a reward system that you find appropriate and that your children find worthy to want to work

Write it down. Review, step by step, what was just discussed. Write it down after each point. Complete the list and hang it somewhere for all of you to see.

Change the routine. If your oldest child continues to be bossy with you, he just may not be emotionally mature enough to care for the younger siblings in your absence. And you need to accept this.

Babysitters can be costly but hiring another adult to be in your home with your children is one idea. Perhaps a family member or a neighbor can step in. Perhaps your children can go to someone else’s home until you pick them up. Perhaps your school district offers after-school programs.

Research your options. It would be a healthy decision for all.

5. Consequences. The next part of this conversation is to let the children know of the consequences that are involved should the rules not be followed. Hitting a child is NEVER an option. Yelling and screaming at your child just shows that you are out of control and

The Rights of a Surviving Spouse

Q: What rights does a surviving spouse have in New York?

A:

Pursuant to New York law, you cannot completely disinherit a spouse. A surviving spouse at the time of a decedent’s death has a statutory right to inherit an “elective share” of the deceased spouse’s assets.

A surviving spouse may elect against the deceased spouse’s estate in an amount up to $50,000 or one-third of the net estate, whichever is greater. If the estate is less than $50,000 in total, the elective share is the value of the entire estate.

New York State Estates Powers and Trust Law § 5-1.1A (“EPTL”) sets forth the right of election for a surviving spouse. The EPTL overrides whatever the deceased spouse’s Will may say (e.g., completely disinheriting the surviving spouse). When a married

individual dies without a Will, the surviving spouse is entitled to $50,000 plus one half of the estate when there are children.

When the decedent had no children, the spouse inherits 100% of the estate.

The right of election applies to probate assets and “testamentary substitutes.”

Testamentary substitutes include joint bank accounts, jointly held real estate, gifts made in the year prior to death, and retirement accounts.

Testamentary substitutes are included in the total amount of the net estate used to calculate the surviving spouse’s elective share. Notably, life insurance is not considered a testamentary substitute.

The elective share amount is reduced by the value of any interest which passes outright to the surviving

spouse. A spouse’s elective share is satisfied with property that passes “absolutely” from decedent to surviving spouse.

Under the EPTL, if the surviving spouse exercises their right of election, such election negates any interest that passes or would have passed to the spouse (other than outright

or absolutely), as though the surviving spouse predeceased.

The use of elective share trusts, such as a Qtip trust do not satisfy a surviving spouse’s elective share.

The surviving spouse must exercise the right of election within six months of the

Surrogate’s Court issuing letters testamentary or letters of administration. If letters are not issued, the spouse has two years after death to make the election. There some are exceptions to these deadlines and judges can provide an extension. However, it is important to act quickly to avoid missing the deadline.

Moreover, you want to avoid beneficiaries spending any assets that would contribute to the elective share.

If you feel that you received less from your spouse’s estate than anticipated, consult an experienced estate administration attorney.

There are several factors that affect the right to an elective share, such as a prenuptial or separation agreement waiver.
