Suffolk County 4th District Legislator Tom Muratore passed away on September 9. He was 75.

Muratore had a lengthy resume of public service that included a 34 year career in law enforcement. He served in the Suffolk County Police Department, including 18 years as Vice President of the Suffolk County Police Benevolent Association. In 2002, at age 56, Muratore graduated New York Institute of Technology, earning a Bachelor of Science Degree in Hospitality Management. He was an alumnus of Central Islip High School's Class of 1963.

By James Emery Looking to go back to school full time with extracurricular activities and sports, Mastic Beach teen Maverik Stow has taken to the streets in protest following his suspension and arrest for illegally entering school grounds.

Stow’s desire to return to class has set up a battle with the William Floyd School District which had him arrested for trespassing after he insisted on coming in when he wasn’t scheduled due to the school’s COVID restrictions. The showdown had the district threatening to close the high school and force its 3,000 students into taking all classes online if the senior continued his attempts to enter school grounds when he’s not supposed to.

After national news coverage and both students and parents taking sides, Stow said on Monday: “Having the William Floyd School District close down the high school to all in-person learning for all students has never been my objective and this is of primary concern to me. I would like to assure the student body, the parents, the school district and the general public that I will not continue to gain entry into the high school to go to

Eastport Resident, Mike Torres Elected Suffolk County Conservative Party Chairman

The Conservative Party of Suffolk County, the state’s largest county minor party, has elected a new Chairman: Michael Torres. Torres was elected unanimously to the position on Tuesday night, to become the first Latino-American Chair in the Conservative Party’s history.

The Suffolk Conservative party is powerful and yields influence in local, state, and federal elections, as well as elections of Judges. Ranking on the third ballot line, a coveted location on the ballot, their membership is often the deciding vote on whether a candidate is elected or defeated on Election Day. Michael Torres has been on the executive board of the Suffolk County Conservatives for several terms, serving as the Party’s Secretary in the administration of outgoing-Chairman Frank Tinari, who is vacating the post to take on a Vice Chair role with the state party. Tinari endorsed Torres to succeed him. The vote was taken at the Party’s socially-distanced 2020 Party Convention, hosted this year at the I.B.E.W. Local 25 in Hauppauge, with approximately 75 of their 800 active members in attendance.

In his new role, he will simultaneously hold the positions of County Chairman and Chairman of the Brookhaven Conservative Party.

The Suffolk Conservatives are a party of constitutionalists, who take a pro-law enforcement stance, and support limited

“Our members are supporters of the President and believe that he has been unfairly treated by members of the press with a left-tilt. Our nation was poised with the strongest economy in history prior to the global pandemic’s dawn -- Trump has proven once he can build a thriving economy. He, not Vice President Biden, is best equipped to help our nation recover,” said Torres.

When asked what the election means to him, Torres said it means more than just a title or a position.

“Plain and simple: I see my new role as both an honor and a responsibility to the members of the Conservative Party. The main, and most fervent, goal we share is to elect Conservatives to all levels of government, and help provide a checkand-balance on those in power,” said Torres.

Goroff in Hot Water Over $25 Million Fortune

Nancy Goroff found herself in hot water last week in her

campaign against Congressman Lee Zeldin for not properly reporting her $25 million fortune

as required by campaign rules, the South Shore Press has learned.

Compounding her violations, the Democrat loaned her campaign more than $1 million, a possible violation of House Ethics Rules designed to safeguard against potential conflicts of interest.

According to reports, Goroff indicated that she is worth between $5-$25 million, but did not list the underlying holdings in those accounts. House rules require congressional candidates to disclose the “specific stocks, mutual funds, or other assets” within an investment account.

“Nancy Goroff likes to tell us that we should live by the rules, but has difficulty following them herself,” said Suffolk GOP Chairman Jesse Garcia. “If she intends to buy her way into Congress, at least she can tell us where the money is coming from.”

Calls to Goroff’s campaign for comment went unanswered.

She has spoken out against giving police the proper gear to respond to riots, while she has not said anything about the violence towards police. “Nancy Goroff’s anti-police policies and rhetoric are far too extreme and dangerous,” Zeldin’s camp said.

Long Island Community Foundation Awards $20,000 to Provide Long Term Care Planning for Veterans

The Association for Mental Health and Wellness (MHAW) announced the awarding of $20,000 from the Long Island Community Foundation for the purpose of attending to the unique physical and mental health issues of older Veterans. Funding will assist aging Veterans living in Suffolk County United Veterans’ permanent supportive housing and those Veterans identified as at risk through the Joseph P. Dwyer Veterans Peer Support Project with co-morbid mental health and physical health problems. It will help connect them with long term supports that will help prepare them for a successful transition from independent living to an acceptance of added supports that may include home care and personal assistance, assisted living, or nursing home placement.

“This grant will stabilize and improve the health of 23 high-risk Veterans from our seven permanent supportive houses as well as the Joseph P. Dwyer Veterans Peer Support Project who present with mental health barriers that negatively impact appropriate level of self-care,” said Marcelle Leis, Director of Veteran Services for MHAW. “We are honored to be selected to provide these vital services to these Veterans.”

Suffolk County United Veterans, a project of the Association for Mental Health and Wellness, operates seven permanent supportive housing sites for formerly homeless Veterans. Of these residents, many are older Veterans that have been living in our housing for over five years, their bodies badly damaged from years of abuse or neglect.

The majority are over the age of 60.

Launched in 2012 as a pilot partnership between MHAW and the Suffolk County Veterans Services Agency, the Joseph P. Dwyer Veterans Peer Support Project takes a confidential, one-on-one, peer-to-peer approach that has rapidly captured the attention and support of Veterans and mental

Under the direction of former teacher and art department chairperson Suzette Fandale, Anna was recognized for her excellence in media arts and for academic achievement.

Additionally, senior Caitlin Saliba was one of 20 recipients who received an Award of Merit for portfolio work completed under the direction of teacher Devin Auricchio.

To be considered for these prestigious designations, students

must be nominated by their school for representing the highest level of artistic talent in media arts, visual arts, music, dance or theater.

The student must also submit a portfolio of their work for consideration by the selection committee and must hold an unweighted grade point average of 90% or above.

As a scholar-artist, Anna’s profile and photo will be published in Newsday in December.

The district congratulates both Anna and Caitlin and extends best wishes for success with their future artistic interests.

The William Floyd Statue - A Monument to L.I.’s Founding Father

“We hold these truths to be self-evident, that all men are created equal and they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.”

The Declaration of Independence was and remains remarkable - it was something new - it set forth a universal declaration of liberty. It inspired hope not just in the American Colonies but around the world, even to this day. In 1861, newly elected President Abraham Lincoln called it the nation’s “Birth Certificate.”

Today, freedom protesters in Hong Kong hold up copies of the Declaration.

William Floyd was the only Long Islander who signed the Declaration. That act placed his life, his family and his property at severe risk. Yet today, there are those who want to tear down the Statue that stands on the busy Shirley intersection of William Floyd Parkway and Montauk Highway.

He was the first Congressman elected to the new congress from the 1st Congressional District, from 1789 to 1791. As a sign of respect the other founding fathers had for Floyd, on June 14, 1791, after a long journey, Thomas Jefferson and James Madison joined Floyd for breakfast at Mastic (now Mastic Beach), at his estate. Thomas Jefferson used the visit to compile a list of 200

employing freemen (slaves who were emancipated) on his farm estate, he also owned slaves. But like all of us, he was born into a society which he did not create.

It is a rarely discussed fact that from Floyd’s birth till his death in 1821, slavery was legal in New York State. Slaves were brought to New York City (New Amsterdam), first by the Dutch and then by the English. In 1746, 12% of New York’s population were slaves. In the 1800 census, 17.8% of Suffolk households had at least one slave, and in Kings

William Floyd was born into a wealthy family in Brookhaven Province in 1734. However, by the age of 20, his mother and father had died and he had to take over the running of the family farm. He was elected a delegate to the First Continental Congress in 1774 and was the first New Yorker, of just four, to sign the Declaration of Independence on August 2, 1776. Many of the signers paid a high personal price.

Unlike most other members of the Continental Congress, William Floyd was neither a lawyer or a politician, but he always put duty first. He was first a Colonel and eventually became a General of a New York militia unit and when the British captured Long Island and New York City, his wife and children fled and had to be rowed across Long Island Sound to Connecticut by fishermen.

The family had to hide in Middletown, Connecticut for seven years. During that time, his wife died, in 1781. When the war was over, in 1783, he gathered his children and came back to the

Floyd helped to rewrite the NYS Constitution in 1801, as a delegate to the NYS Convention. Slavery in New York

The recent animus against William Floyd’s statue centers on the fact that aside from

In 1817, state legislation was finally passed creating a date certain deadline to end slavery on July 4, 1827, years after the death of William Floyd.

Although records are difficult to verify for the early years, records show that William Floyd owned 6 slaves in 1810, 6 slaves in 1820 and 2 slaves at his death.

Over the years most slaves were emancipated.

Summary

Thomas Jefferson saw slavery as “a fire-bell in the night.” The desire to create one union of the 13 colonies highlights the conflict between the Founding ideas and the founding reality of slavery. But the Founding Fathers did create a society that could and did abolish slavery.

Frederick Douglass, in 1848, observed “what is morally right is not always politically possible.”

The Civil War stands as a defense of the Founding Fathers and the words of the Declaration of Independence. William Floyd’s great-grandson fought for the Union in the Civil War and watched his cousin die at the Battle of Chancellorsville. The Thirteenth, Fourteenth and Fifteenth Amendments should be understood as an absolute implementation of the opening provision of the Declaration of Independence.

So, to abandon the record of the past is dangerous to our future. It is dangerous if we have a lack of appreciation for historical records and knowledge. Every generation is seeking and should seek to “create a more perfect union.” The statue should be looked at as a monument to maybe an imperfect but indispensable person, who in his lifetime advanced human liberty. It is our turn to advance liberty and close the gap between American principles and American reality.

We have an obligation, just like William Floyd, to change the world for the better. But that goal is not advanced by the tearing down of a statue devoted to our local community’s founding father and patriot, who helped build this nation. Elected officials all take an oath of office whereby they pledge to support the Constitution of the United States and of New York State. As citizens we should also support the Declaration of Independence and continue to defend the American project.

County Budget Delayed

COUNTY The Republican Caucus of the Suffolk County Legislature is demanding that County Executive Bellone release his proposed 2021 Operating Budget by end of day Tuesday, October 6.

“The Budget is more than two weeks late at this point,” said Republican Leader Tom Cilmi. “In order to fulfill our responsibility to the taxpayers of this County, to the towns and villages, to all the contract agencies and to our employees, the Legislature must have ample time to review the County Executive’s proposed Budget. The timing, which is set forth in the County Charter, is tight under normal circumstances, as tax levies and warrants must be set and delivered to the towns so that tax bills can be prepared. I will have no choice but to ask Legislative Counsel to commence legal action to compel its release.”

Legislator Kevin McCaffrey said, “The law is clear, the County Executive must present his budget to the County Legislature so Government can continue to function. Nassau County, which faces the same impacts of Covid-19, has found a way to present its budget to the Legislature as the law requires. The Suffolk County Executive must do the same.”

Legislator Rudy Sunderman stated, “The County Executive is using the COVID-19 pandemic as a scapegoat to manipulate his budget and cut services to the most vulnerable populations in Suffolk County. The residents of the third Legislative District rely on services such as public transportation, public health, and public safety to get through their everyday lives. The longer the County Executive delays providing the Legislature with a copy of his budget, the less time the Legislature, as an independent body of government, has to review that budget and make amendments. By delaying the release of the budget, he is denying the residents of Suffolk County the checks and balances that are in place by having separate branches of government.

Sound Beach Man Sentenced to Prison for Conducting a Human Trafficking Operation Out of His Parents’ Basement

Suffolk County District Attorney Timothy D. Sini today announced the sentencing of a Sound Beach man to prison for conducting a human trafficking operation out of the basement of his parents’ house over the course of several years.

Raymond Rodio III, 49, pleaded guilty on Feb. 4 to one count of Sex Trafficking, as a B violent felony; four counts of Sex Trafficking, as a B felony; one count of Criminal Sale of a Controlled Substance in the Third Degree, a B felony; one count of Promoting Prostitution in the Second Degree, a C felony; and one count of Promoting Prostitution in the Third Degree, a D felony.

Rodio was sentenced today by Suffolk County Supreme Court Justice Mark Cohen to nine and one-half years in prison with five years of post-release supervision on the top count of the indictment. He was also registered as a sex offender.

“This defendant had a sex dungeon in his parents’ home and forced women into sex slavery,” District Attorney Sini said. “He

pleaded guilty because the evidence was overwhelming thanks to the team who investigated and prosecuted this case, and today he met his fate. As we’ve made clear, my Office, the Suffolk County Police Department and all of our law enforcement partners are committed to ending the scourge of human trafficking here in Suffolk County. This case sends a clear message to those who are trafficking women and girls in this County that we will not stand for it.”

DA Tim Sini: Defendant Used Narcotics, Threats of Violence to Coerce Victims into Prostitution

In August 2018, the Suffolk County Police Department identified a suspected victim of human trafficking during a routine traffic stop. An investigation by the Police Department’s Human

Trafficking Investigations Unit revealed evidence that the victim had been forced into sex trafficking

by Rodio in the spring of 2018.

Further investigation by the Human Trafficking Investigations Unit and the District Attorney’s Office’s Human Trafficking Team revealed that Rodio had been conducting a human trafficking operation out of the basement of his parents’ residence, located on Lower Rocky Point Road in Sound Beach, since as early as 2014. The investigation identified more than 20 victims of Rodio’s sex trafficking operation.

Rodio would post advertisements on websites, including Backpage and Craigslist, promoting prostitution by the victims and would keep either a large percentage or all of the profits of their prostitution.

The investigation also revealed evidence that Rodio would occasionally keep victims in the basement for extended periods of

time and force them to use a bucket as a toilet because the basement does not have a bathroom. The door to the basement has an exterior lock to which Rodio had the only key.

In addition to the house, Rodio also forced the victims to perform prostitution at various motels throughout Suffolk County.

Rodio coerced his victims into performing prostitution by providing them with heroin and crack cocaine to impair their judgment as well as subjecting one victim to threats of physical violence.

The Suffolk County Police Department’s Narcotics Section, in conjunction with the Human Trafficking Investigations Unit, began a subsequent investigation that revealed Rodio was also engaged in selling drugs.

This case was prosecuted by Assistant District Attorney Daniel Cronin, formerly of the Enhanced Prosecution Bureau and currently assigned to the Vehicular Crimes Bureau.

NYS Inspector General & Suffolk DSS: 3 Individuals Arrested for Alleged Welfare Fraud, Theft of More than $197k in Benefits Suffolk County District Attorney Timothy D. Sini, New York State Inspector General Letizia Tagliafierro and the Suffolk County Department of Social Services (“DSS”) today announced the arrest of three individuals for allegedly committing welfare fraud, resulting in the combined theft of more than $197,000 in benefits from the Suffolk County Department of Social Services.

“It is the theft of taxpayer dollars, and it is theft from people who are truly in need,” District Attorney Sini said. “I want to thank the Suffolk County Department of Social Services and the NYS Office of the Welfare Inspector General for their continued partnership with my Office to investigate and prosecute anyone who tries to take advantage of these social services and steal public funds.”

Mohammed U. Farooq, 57, of Dix Hills, is charged with Welfare Fraud in the Fourth Degree, a class E felony. On or about and between Oct. 1, 2012, and April 30, 2018, Farooq allegedly failed to report more than $650,000 in income to DSS, resulting in his receiving $89,366.64 in Medicaid benefits to which he was not entitled.

Rhonda Quick, 49, of Coram, is charged with Welfare Fraud in the Fourth Degree, a class E felony.

While collecting welfare benefits from DSS, Quick was employed as an unlicensed home aide for an elderly couple. She allegedly did not report the income she received, resulting in overpayment of $38,371.26 in Medicaid benefits from January 2014 to December 2016; overpayment of $29,285.20

in Public Assistance benefits from January 2014 to January 2017; and overpayment of $12,357.00 in Supplemental Nutrition Assistance Program (“SNAP”) benefits from March 2014 to January 2017. In total, Quick received $80,013.46 in benefits to which she was allegedly not entitled.

Chaniesa Simmons, 45, of Central Islip, is charged with Welfare Fraud in the Fourth Degree, a class E felony. While collecting welfare benefits from DSS, Simmons was employed as a licensed home health aide. She allegedly did not report the income she received, resulting in overpayment of $15,550.52 in Medicaid benefits from January 2014 to December 2016 and overpayment of $12,148.00 in SNAP benefits from March 2014 to January 2017. In total, Simmons received $27,703.52 in benefits to which she was allegedly not entitled.

Farooq was arraigned on Sept.

30 and was released on his own recognizance. He is due back in court on Nov. 4. Quick was arraigned on Sept. 22 and was released on her own recognizance.

Key elements of the Play it Safe program for the hotel rooms include: • Guests are asked to adhere to social distancing protocols.

• All incoming guests are required to present identification as a record of their visit for contract tracing purposes.

The Play It Safe program encompasses Jake’s 58’s new operating procedures, which have been reengineered to minimize contact risk. It includes bolstered hygiene protocols to meet or exceed best-practice guidelines of the U.S. Centers for Disease Control and Prevention (CDC).

Contracting Company Pleads Guilty in Connection with Labor Crimes; Ordered to Pay $85k in Restitution Suffolk County District Attorney Timothy D. Sini today announced the guilty plea of a contracting company in connection with several labor-related crimes, including failure to pay prevailing wage supplements to a benefit fund and unemployment insurance contributions.

“Let this be a lesson to anyone doing business in Suffolk County: if you are not paying your fair share to your workers, or to the programs and agencies that make sure workers are safe and protected, we will be coming for you,” District Attorney Sini said.

“We will not tolerate greedy corporations gaining an unfair advantage by not paying their dues. I want to thank Assistant District Attorney Shaun McCready and the team who investigated and prosecuted this case for obtaining a great result that ensures the full repayment of stolen funds to Laborers Local 66, the New York State Department of Labor and the New York State Insurance Fund.”

Richard Hall, 58, of Northport, pleaded guilty yesterday to Disorderly Conduct and was sentenced by Suffolk County Court Judge Stephen Braslow to a conditional discharge.

His company, Regal Contracting, Inc., pleaded guilty to Scheme to Defraud in the First Degree, a class E felony, and was issued a fine of $10,000. Pursuant to the plea, Hall and Regal Contracting, Inc., were required to pay restitution in the amount of $7,406.64 to Laborers Local 66; $28,935.18 to the New York State Department of Labor (“NYSDOL”); and $48,853 to the New York State Insurance Fund (“NYSIF”).

An investigation by the Suffolk County District Attorney’s Office, NYS DOL, NYSIF and the Suffolk County Police Department revealed evidence that in the summer of 2018, Hall and Regal Contracting, Inc., failed to pay $7,404.64 in benefits to the Laborers Local 66 Benefit Fund for multiple workers on five different projects.

The investigation also revealed that Regal Contracting owed more than $28,000 in unpaid Unemployment Insurance Fund contributions to the NYS DOL and owed more than $48,000 in unpaid workers’ compensation premiums to the NYSIF, therefore making Hall ineligible to take out any new policies. Hall then incorporated a new company, Triangle Enterprises of Long Island, Inc., and fraudulently omitted his ownership of the company in order to obtain a new workers’ compensation insurance policy.

Hall and his companies were charged as part of a multi-agency crackdown on labor-related crimes conducted by the Suffolk County District Attorney’s Office in collaboration with the NYS DOL, NYSIF and the Suffolk County Police Department in March 2020. Several of the cases were referred by members of the Suffolk County District Attorney’s Office’s Labor Advisory Board. The Labor Advisory Board, which

was launched by District Attorney Sini in June 2018, consists of approximately 35 union and non-union labor representatives who meet with the District Attorney’s Office on a quarterly basis to collaborate on matters of mutual concern for law enforcement and the labor community. The Board also serves as a conduit for the labor community to refer allegations of criminal activity involving labor law and other violations to the District Attorney’s Office.

Long Island Caterers Appeal to Governor to Reopen at 50 Percent Capacity, Fate of Industry at Stake

Catering business owners from across New York gathered at an urgent meeting in Hauppauge Friday to appeal to Gov. Cuomo to let them open to 50 percent capacity and let weddings, sweet 16’s, ceremonies and other activities that were put on hold during the COVID pandemic to take place.

“Catering facilities have been brought to the brink of bankruptcy with no cash flow since March and living on loans; they must be allowed to open at 50 percent capacity,” said the event’s organizer, Riverhead Councilwoman Jodi Giglio. “They make up a large portion of our economy, and secondary businesses, including invitations, bakeries, bridal and tuxedo shops, hotels, DJ’s, florists, photographers and videographers, live music and transportation businesses supporting the industry are suffering also. The trickling down effect of these restrictions on the industry is immense.

Restrictions decimated the summer tourism season when they should have been allowed to operate safely.

According to Assemblyman Joe DeStefano, the weddings, and other events that catering halls count on to stay in business were cancelled at a rapid rate as the state’s economy was shut down. “Caterers were put out of business for months and now are being told that they can only have up to 50 guests. This doesn’t make sense for the majority of facilities that can safely host many more people than that.”

BY TARA D’AMATO The Community Library is excited to announce we are continuing our participation in the Suffolk County Libraries’ partnership with SUNY Stony Brook to bring social work interns to local libraries.

The interns are supervised by professional mentors at the college and are working towards their Master’s degree and certification as Licensed Clinical Social Workers. Each intern spends a semester working within one local public library, providing confidential free counseling services on a one-on-one basis.

Social work counselors can provide valuable assistance to those experiencing mental health issues, everyday stress, and those needing someone to help refer them to assistance

programs like housing, food, and medical help.

This semester, our social work intern is Sheila. She is a community resident who is bilingual (English/ Spanish). Participants can meet confidentially with our social worker to discuss mental health issues, coping with stress, and everyday problems like applying for government benefits, or to help get referrals to community assistance programs. Sheila is available for 1 hour appointments on Mondays and Wednesdays at 5, 6, 7, and 8 o’clock and Thursdays at 12, 1, 2, 3 and 4 o’clock.

BY ROBERT CHARTUK It really was a cold and rainy night and I was holed up in an old Howard Johnson’s hotel off Narragansett Bay in Rhode Island. The wind was blowing so hard it was rattling the doors of the rooms and I couldn’t sleep. I was there for another airline disaster: Egyptair Flight 990 had disappeared into the Atlantic 60 miles south of Nantucket and the NOAA Ship Whiting, was on the scene looking for the pieces.

Thank God I’m not out there tonight, I thought, reliving the purple milkshake I hurled during the Flight 800 mission. My immediate problem was a peaceful night’s sleep and I knew I would be miserable if I was dragging ass all day. I came up with a solution that was inspired by my days living in the dorm at Oswego College. If you jam enough pennies in someone’s door, the pressure keeps them from unlocking it and they’re trapped.

More than one co-ed was late for class thanks to getting “pennied.” So I crept out into the hall with a handful of change and was able to silence the doors that were making the racket.

Flight 990 created an international stir between Egypt and America with both countries conducting their own

investigations. Egypt concluded it was mechanical error and fixed the blame on the Boeing Corp for the 767’s demise. But the U.S. came up with a more sinister cause,

Rushdy was the first pilot on the doomed plane.

Last week, we talked about “ESD” – Electric Shock Drowning.

Now, let’s talk about “POD” – Plain Old Drowning!

Obviously, the most top-of-mind danger that all mariners face is drowning. We live, work and play in a marine environment – a hostile marine environment, if one is not careful. And, even you are careful, things happen. This column is about that.

An Ounce of Prevention

is better than a pound of cure so bear the following in mind. First, we must all be wary of hypothermia.

The symptoms to look for in others or you are the actions of someone who seems to have been drinking heavily – except they haven’t been.

Clumsiness, slurred speech, poor fine motor skills, crankiness…

Actions you can take to prevent getting hypothermic are: 1. Keep dry, spare clothes aboard.

They can even be added on top of wet clothing if need be…

2. How’d your clothes get wet?

Could be from “working the boat” in foul weather or, worse, you fell overboard. The only thing worse than falling overboard is not getting back aboard! More on this below…

3. To help yourself immeasurably, always wear your life jacket.

Inhaling cold water is a killer and that will be very hard NOT to do if you are under water…

4. Stay away from booze, period.

Unlike the St Bernard rescue dog stories, booze doesn’t help you survive hypothermia.

Going Down for the Third (and Last) Time Years ago, while training with my son to be part of a USCGAux Cold Water team, we all received a workshop on a developing understanding of something called “Cold Shock” or the “Gasp Reflex.”

Scientists and doctors were just becoming aware of why someone could drown “instantly” upon hitting the water. Basically, in water below 70-degrees F, which we are certainly boating in during the early months of the Spring and late months of the Fall, a number of nearly instant and deadly things can go wrong, even if you fall just a few inches from the dock to the water: 1. Even with your head above water, a splash of cold water in your face from a boat’s wake as it cruises by you can cause you to involuntarily inhale water, which is a killer. Not swallowing in down your throat into your stomach but inhaling it into your lungs. This is the “gasp reflex.”

2. In some people, the reaction doesn’t get that far into their bodies.

They hit the cold water and, as

soon as it touches the back of their throat, it closes up. The spasm stops the water from getting into the body, which is the biological intent, but it also stops air from getting to the lungs. The person bobs back to the surface (their lungs are full of air) and they suffocate in the open water, unable to breathe due to a blocked air passageway. This is what is now called “dry drowning.”

There is no water in the lungs.

Nor is there any oxygen. I’ve seen a BoatUS report that stated that 15-20% of all drowning are “dry drowning’s.”

3. When the difference between your body temperature and the water temperature is greater than 30-degrees, the chance of a heart attack from the sudden immersion goes up dramatically.

4. Even something as simple as a racing heart from shock and fear can create hyperventilating on the part of the victim. Dizziness followed by unconsciousness results as the ratio of oxygen/carbon dioxide changes in the victim’s blood system.

So, if you survive all this, then you will have to deal with the potential effects of hypothermia. Remember, despite all our advances in science and technology, our bodies can survive only in a pretty narrow range of internal core temperatures.

How about those aches and pains you feel in your muscles when you get cold? A drop of only 1.5 degrees from good ol’ 98.6 is all it takes. A few more degrees, say 5 or 6, and you’ll stop shivering because now your body can’t shiver anymore – there isn’t enough energy in your body to shiver, much less climb into a boat or onto a dock. Another 4 or 5 degrees from there and the heart is now struggling to gather enough energy from your internal core to beat…

So, if you fall in, get out!

What are the Steps in a Residential Real Estate Transaction?

My husband and I are considering putting our house up for sale, can you give us an overview of what to expect?

Selling or purchasing real property can be one of the most significant transactions in your life. Below are the basic steps of a residential real estate transaction.

As the seller, your first decision is whether to list your property with a real estate broker. If you decide to do so, you will first need to sign a listing agreement.

Although most sellers do not ask an attorney to review the listing agreement, it can be beneficial to do so. The broker will help you establish a sales price, stage and

show the property.

Once you receive an acceptable offer on the house, you and the purchaser provide contact information for yourselves and your attorneys. Next, the broker provides the attorneys with a memorandum of sale listing all the details in the contract of sale, including the sales price, down payment amount, mortgage amount, and closing date. If there is no broker involved, you and the purchaser would have to provide this information to the attorneys.

The purchaser will schedule

an inspection of the property. At that point the purchaser may insist on certain repairs. If you agree to any repairs, they are added to the contract. You are tasked with giving your attorney the deed, survey, previous title policy and any certificates of occupancy.

If you are unsure if you have certificates of occupancy for all improvements you’ve made over the years, you should request this information from the municipality ahead of time.

Your attorney will draft the proposed contract of sale and provide it to the purchaser’s

attorney. This means you have entered the contract negotiation stage. Once you reach an agreement, the purchaser signs the contract and provides the down payment check and you sign the contract. After your attorney provides the signed contract to the purchase, you are “in contract.”

The purchaser’s attorney will then order a title report. It is your responsibility to clear any title issues, as governed by the contract.

In the meantime, the purchaser should work with his or her bank to provide the necessary documentation for a mortgage

commitment. Once the title is clear and the purchaser’s bank is ready to proceed, you are ready to schedule a closing date.

The attorneys prepare a closing statement listing the monetary adjustments and checks. Your attorney will prepare the new deed and transfer documents. Finally, all parties (or their attorneys-infact) attend the closing to complete the sale.

Complex issues may arise during a sale, so you should retain an experienced real estate attorney to represent you.
