Genera PR launches bid for large-scale battery system

enera PR, a subsidiary of New Fortress Energy, has opened a call to procure a large-scale battery energy storage system.

The firm Wood McKenzie is managing the tender, which opened on Jan. 5.

Genera PR wants to buy about 1,722 megawatt-hours (MWh) in storage capacity distributed across nine power plants -- Vega Baja, Jobos, Daguao, Cambalache, San Juan, Palo Seco, Costa Sur, Aguirre and Yabucoa -- according to information provided by the private operator of the Puerto Rico Electric

Power Authority’s legacy power plants.

Battery capacity must meet or exceed the respective capacity in the guaranteed degradation curve for 20 years and the minimum capacity of 430 MW for four hours (1,720 MWh) through the 20 year-mark.

The contractor must also provide a minimum 20-year warranty for all transformers, breakers, switchgear, battery management systems, batteries, power conversion systems and controllers.

Proponents have until Feb. 2 to submit notices of intent to participate in the tender.

The prequalified proponents will be selected on Feb. 9.

Ban on electricity bill changes is among a slew of measures signed into law

ov. Pedro Pierluisi Urrutia has signed a package of 16 legislative measures into law, including Senate Bill (SB) 1218, which would eliminate certain charges in the electricity bill.

Pierluisi has signed into law 55 of over 100 measures sent by the Legislature earlier this month that lawmakers had approved in the session that concluded in November.

SB 1218 immediately prohibits charging customers of the electrical energy system for administrative calculation errors or estimates, if the collection is made 120 days from issuing invoices. The provisions cover commercial, industrial, residential and institutional customers.

On health-related issues, the governor enacted SB 76, which amends the Health Insurance Administration Law and the Puerto Rico Insurance Code so that people who suffer from a chronic or high-cost illness, as defined by the Department of Health, do not need referrals from their primary doctor to treat the disease.

Meanwhile, Pierluisi also signed SB 671, which provides that every patient will have access to clinical laboratory services and specific tests without a medical order as

long as the patient covers the costs.

Pierluisi also signed House Bill (HB) 1307, which makes it viable and gives legal certainty to rental housing projects for low-income families. The law also reestablishes the exemption from paying taxes on real property under the Rural Development Program that operates under the provisions of Section 8.

Likewise, it establishes an exemption from paying Municipal Revenue Collection Center taxes to properties that the Housing Department manages and are assigned to homeless

people and for other related purposes.

With regard to community issues, the governor signed SB 880, which establishes as a permanent fund the Special Fund for Social Equality to continue paying for public works, and to increase allocations for nonprofit and community self-management entities that offer direct services to citizens.

The governor also signed HB 1909, which sets the base salary for School Lunch Division employees at $12 per hour. Currently, the base salary is $8.66 an hour.

With the governor’s signature, SB 791, the Law for the Care of Students with Type 1 and Type 2 Diabetes in Public and Private School Institutions of Puerto Rico, is amended to establish additional responsibilities for school institutions and parents, guardians, or tutors of students with diabetes. The bill notes that training on diabetes knowledge will be theoretical and practical and that a pediatric endocrinologist will be responsible for writing the student’s Diabetes Medical Management Plan.

Meanwhile, Pierluisi signed into law Senate Bill 1040, which would regulate the Traffic Regulation Corps of the Department of Transportation and Public Works (DTOP) to intervene with violations related to illegal parking, as well as those connected to intelligent traffic lights and enforcing provisions related to vehicle weight and measurements.

The governor also signed House Joint Resolution 498 for the Highways and Transportation Authority and DTOP to conduct an analysis on traffic between Highway PR-19 (Luis Vigoreaux Avenue) in Guaynabo and the intersection with Highway PR-17 (Jesús T. Piñero Avenue) in San Juan, to identify viable alternatives aimed at decongesting motor vehicle traffic.

Ortiz González lauds enactment of cybersecurity legislation he authored

ep. Jesús Manuel Ortiz González thanked his colleagues in the island House of Representatives and Senate for the approval and Gov. Pedro Pierluisi Urrutia for the signing of House Bill (HB) 1530, which creates the Cybersecurity Law for Puerto Rico.

The law, broadly speaking, proposes to establish, as a principle of public policy, security provisions for government data, and support for innovation processes while promoting the development and sustainable economic growth of all sectors in Puerto Rico.

“I am pleased that my bill has become a law to reduce the number of cyberattacks to which government agencies are exposed since, by creating the Office for the Evaluation of Cyber Incidents, attached to PRITS [Puerto Rico Innovation and Technology

Service], it will be monitoring, identifying, and responding to irregular security events, which can impact the information of all citizens,” Ortiz González said. “This allows us to continue moving the government into the future.”

The chairman of the House Government Committee, who is seeking the Popular Democratic Party nomination for governor in the fall elections, noted that Puerto Rico suffered 737 million attempted cyberattacks in the first half of 2022, an increase of 294% compared to the same period in 2021.

“With this breakthrough law, Puerto Rico will have the minimum security requirements for both public and private entities so that we can assure our citizens that their information is safe,” Ortiz González said. “With the signing of this law, we are confident that Puerto Rico will soon be at the forefront of cybersecurity in the [region] and that it will

be able to provide our citizens with greater security and confidence in digital government processes.”

Among other things, the Cybersecurity Law proposes the following: * Establishes as a policy the prohibition of making any type of ransom payment in response to ransomware, with some exceptions such as critical infrastructure, imminent risk of loss of life or in the event that any federal or state agency requests it; * Elevates to the rank of law the position of chief information security officer under PRITS, and establishes his or her powers and duties, in order to guarantee the execution of the public policy established in HB 1530.

The cyber security officer will be appointed by the Governor of Puerto Rico for a term of 10 years with the advice and consent of the Senate of Puerto Rico. * Establishes the parameters related

to the contracting of technology services companies with the government.

PIP candidate sees ‘deep changes’ in Puerto Rico’s future

P

uerto Rican Independence Party (PIP) gubernatorial candidate Juan Dalmau Ramírez says he is finding a new feeling on the campaign trail.

Dalmau, who has been the PIP’s candidate for governor on two occasions before, says he’s feeling a different kind of enthusiasm this time around, “as if there is hope for change; that there is a possibility that the unimaginable is possible; that it’s possible that there is a new political force that can displace the bipartisanship that has ruled Puerto Rico.”

The feeling, Dalmau told the STAR in an exclusive interview, comes from the alliance the PIP has forged with the Citizen Victory Movement (MVC by its Spanish initials), an upstart party of independence advocates and other left-leaning leaders, which garnered nearly 14% of the vote in 2020 elections, and which when combined with the more than 13.5% received by the PIP in those elections puts the alliance within striking distance of the 32% recorded by the winner of that year’s elections, the New Progressive Party.

Dalmau said the public had developed a certain conformism with the status quo that has been broken by the PIP/MVC union, which is going by the name “Patria Nueva”

(New Homeland).

Dalmau is running under the PIP insignia as coalitions are banned under Puerto Rican law.

“There is an electoral mass of 28% of the voters who have turned their backs, lost the custom, the habit, of voting for the two parties,” Dalmau said.

Puerto Rico could be on the cusp of a historic change of direction, he added.

“I’m hopeful that we are at the point of writing a glorious page in the history of Puerto Rico,” the pro-independence candidate said.

Dalmau said the point of convergence of the two parties in the alliance is the proposal by both of them to promote a process of decolonization through a status convention that would be aimed at undoing the current “colonial status.”

The Puerto Rican people would have to be included through the election of delegates, he said.

The convention would require the meaningful participation of the U.S. Congress, which would have to determine and tell the Puerto Rican people definitively what political status is possible under the Constitution, obviating the “beauty contest” referendums that have been conducted in the past, Dalmau said.

“It is a bilateral process,” he said.

“Congress has to respond to questions about

the options suggested, which are viable and which are not, and secondly, what would be their consequences and what would be the transition to them.”

Dalmau said that the PIP’s platform is still being drafted, but in general terms, his government’s emphasis would be centered on human rights and human dignity, In those terms, he would view health as a right and try to wrest health care from the control of the insurance industry, which he said excludes whole sectors of the island and drives doctors abroad.

Similarly, education should be accessible to all and Dalmau said he would stop closing public schools and university campuses.

In the economic arena, the candidate said Puerto Rican companies should enjoy equality in taxes with foreign companies, which now enjoy tax incentives to move to Puerto Rico.

“There are foreign companies that pay zero taxes, while there are Puerto Rican companies that pay more than 33% in taxes,” he said.

The three-time candidate for governor said incentives should be created to keep young people from migrating off the island.

With people leaving the island, the elderly population is left without anyone to care for them, he said.

“We need policies to attend to the needs of that population,” Dalmau said.

The candidate said further that he would seek the removal of the Financial Oversight and Management Board, through an act of the U.S. Congress.

He noted that the oversight board was established as a political act as opposed to economic bankruptcy, which could have been legislated in Congress, so it is up to Congress to disband the board.

Given that, doing away with the oversight board would require political action by the island government accompanied by a public outcry by all sectors of the populace on the island and in the diaspora.

“The board, being the product of a political act on the part of Congress, [getting rid of it] requires political action on the part of the Puerto Rican government, which needs to seek ample points of consensus in Puerto Rico so that Congress has to reexamine PROMESA [the Puerto Rico Oversight, Management and Economic Stability Act, which created the oversight board], and eliminate the fiscal control board,” Dalmau said. “Secondly, Puerto Rico has demonstrated that at times when there

has been great abuses [the citizenry] has been able to unite for the purpose of demanding and achieving change.”

He pointed to the protests that led to the 2003 departure of the U.S. Navy from the offshore island municipality of Vieques and the 2019 protests that drove then-Gov. Ricardo Rosselló Nevares from office over an online chat scandal.

“The governors have limited themselves to taking their complaints before [U.S. District] Judge [Laura Taylor] Swain [who is overseeing Puerto Rico’s Title III bankruptcy cases under PROMESA], the judge rules in favor of the board and they say, ‘Well, we tried,’” Dalmau said. “No, they haven’t tried.”

As governor, he would bring together political, civic and religious leaders on the island and in the diaspora to demand a change from Congress.

In the area of public security, Dalmau said he would demilitarize the police and create a “community police force” in greater contact with the people they serve.

He would also decriminalize the consumption, but not the sale, of narcotics, treating consumption as a public health problem.

He would also seek reform in the island’s correctional institutions so that rehabilitation prevents prisoners from leaving prison as hardened criminals and potential repeat offenders.

He said that contrary to what many have alleged, his government would not reject federal law enforcement assistance on the island.

Meanwhile, when it comes to U.S. domestic politics, Dalmau said he anticipates little change from the winner of the November presidential elections.

“Biden has so far ignored Puerto Rico, saying when asked that the issue is up to the U.S. Congress, and Trump has limited himself to insulting Puerto Ricans, calling them ‘corrupt’ and saying the U.S. should trade Puerto Rico for Greenland with Denmark,” he said.

“The prejudice that Trump has shown against Puerto Rico could bring its consequences; [in] what [way], I don’t know,” he said.

But in sum, Dalmau expects Puerto Rico will be forgotten, no matter which of the two wins the presidential vote, leaving it up to Puerto Ricans to carry forward the status issue before Congress.

As for the long-shot candidacy of Robert F. Kennedy Jr., who participated in the civil disobedience over the Navy’s presence on Vieques, he said the status issue would be decided by a political process and not be imposed by any political authority.

Most overdoses in Puerto Rico caused by fentanyl

A

bout 84% of the 1,071 deaths from overdoses in Puerto Rico between Jan. 1, 2022, and Sept. 15, 2023 were caused by fentanyl, according to data from the Institute of Forensic Sciences.

The information was provided last week

by Health Secretary Carlos Mellado López after he announced the allocation of over $15 million to mitigate the opioid situation on the island.

Mellado López said the funds are available for three years, or until June 30, 2027.

“These funds are for initiatives, institu-

tions, for-profit and nonprofit organizations, entities, and agencies, among others, that address opioid issues on the island,” Mellado López said in a press release.

The Health chief noted that during 2023, the Advisory Committee of the Opioid Recovery and Restitution Fund, supported by the Opioid and Health Substances Program, worked on a survey to understand the problem of substance abuse.

In the United States, the proportion of deaths from overdoses of fentanyl combined with stimulants increased more than 50 times between 2010 and 2021, going from 0.6% of deaths to 32.3%, according to research

published in the journal Addiction.

Deaths from this mixture during the socalled “fourth wave” of the opioid overdose crisis jumped from 235 to 34,429 in that period.

Fentanyl is a synthetic opioid 50 times more potent than heroin and 100 times more powerful than morphine. This synthetic drug was developed more than 50 years ago.

There are two types of fentanyl, as reported by the Centers for Disease Control and Prevention. There is pharmaceutical fentanyl, prescribed by doctors to treat intense pain in cases such as post-surgery or cancer treatments, and the illicitly manufactured fentanyl, or IMF, Health Secretary Carlos Mellado López distributed in illegal drug markets.

Lawmakers file bill to include P3s under electoral ban

ublic-private partnership (P3) project operators would not be able to allude to achievements and goals under a law restricting the use of public funds for election-related advertising if a bill to that effect becomes law.

Popular Democratic Party Reps. Edgardo Feliciano Sánchez, Jesús Hernández Arroyo, Jorge Alfredo Rivera Segarra and Luis Ortiz Lugo, along with House Speaker Rafael Hernández Montañez, have introduced House Bill 1986, which seeks to include public-private partnerships (P3) under the

advertising restrictions that go into effect in an election year, also known as the “electoral ban.”

The bill would add any entity contracted by the government of Puerto Rico to manage or operate under the P3 model to the list of agencies, public corporations, and municipalities covered by the electoral ban, which went into effect on Jan. 1. The ban prohibits the use of public funds to promote the governing administration’s image in an election year.

“Currently, we have several companies operating under the PPP model that receive hundreds of millions of dollars in public funds to finance their operations, and the electoral

ban does not apply to them,” Feliciano Sánchez said.

The lawmakers noted that the electoral ban establishes that the disbursement of public government funds to expose achievements, projections, plans or messages and content for political purposes is prohibited during an election year.

“With this bill, we ensure that all entities that receive public funds are completely outside the electoral and political-partisan process, which has always been the intention of the electoral ban,” Hernández Montañez said.

The director of the Legal Division of the Electoral Comptroller’s Office (OCE by its

Spanish initials), Sarah Rodríguez de Jesús, has concluded that the OCE lacks jurisdiction to regulate the advertising of P3s. Rodríguez de Jesús said this creates a regulatory vacuum that must be addressed through legislation to guarantee transparency and legality in executing P3 contracts.

“With this measure, we correct this deficiency and give greater strength to the OCE so that it can supervise all P3s with a clear and solid legal basis, and we guarantee that the spirit of the prohibition established in Law 222-2011 is complied with,” said Hernández Arroyo, who will take up the bill in the committee he chairs.

Trujillo Alto high school to be first to implement ‘Pet Awareness Day’

he Madero Carazo High School in Trujillo Alto will be the first in Puerto Rico to start an awareness program on the treatment of animals as part of the parameters of the new Law 5-2024, which establishes a series of activities in observance of the second Sunday in February as “Pet Awareness Day.” The new program will also feature a robust dog and cat food drive for abandoned pets on the island. It is estimated that around 400,000 to 500,000 dogs roam the streets, while the population of stray cats exceeds one million.

The announcement was made by Carolina District Sen. Marissa “Marissita” Jiménez Santoni after a meeting with Education Secretary Yanira Raíces Vega and staff and a student from Madero Carazo High School.

“I thank the secretary for accepting our request that the new awareness program on the good treatment of animals, pets, according to Law 5-2024, begin in this important high school, which already has a pilot program for assistance to real animals,” said the senator, who authored the law.

“The Madero Carazo school group, led by exceptional students, including [10th

grader] Paola [...] suggested a food collection campaign, which we supported and the secretary authorized to begin now, in February,” Jiménez Santoni said.

The school has an enrollment of 350 students.

Law 5-2024 amends Articles 1 and 2, and adds a new Article 4, as well as renumbering Article 4 as Article 5 of Law 166-2019.

The state and education secretaries “will have a leading role in the new framework,” the senator said. The former will develop the proclamation for the commemoration of the new pet awareness day, while the latter will implement activities related to the care and treatment of the animals.

Attacks intensify before Tuesday primary as Trump stokes VP talk

n the final weekend before the New Hampshire primary, former President Donald Trump and former Gov. Nikki Haley of South Carolina were escalating their attacks on each other in a contest that may determine whether Trump faces any meaningful opposition to his effort to capture the nomination.

Haley launched her most pointed attacks yet Saturday, taking direct aim at Trump’s mental acuity and fitness to serve another term as president a day after he appeared to repeatedly confuse Haley with Rep. Nancy Pelosi, D-Calif., the former House speaker, during his rally. He falsely said Haley was in charge of security during the Jan. 6, 2021, attack on the Capitol.

Haley has never served in Congress and left her last government role six years ago.

“My parents are up in age, and I love them dearly,” she told reporters after her event in Peterborough, New Hampshire. “But when you see them hit a certain age, there is a decline. That’s a fact — ask any doctor, there is a decline.”

In recent days, Trump has directed increasingly caustic barbs at Haley, his most formidable opponent in Tuesday’s primary. He used his rally Saturday night in Manchester, New Hampshire, to try to show that she lacks support in her home state, as several leaders

“Almost every politician from South Carolina is supporting me,” Trump boasted.

He was interrupted by a protester as he accused President Joe Biden of being a threat to democracy. The protester shouted, “Dictator,” as security escorted him out.

Trump later heaped praise on Viktor Orban, the prime minister of Hungary whose attacks on democratic norms have been widely condemned.

“It’s nice to have a strong man running your country,” Trump said.

His campaign has sent a series of surro-

gates to New Hampshire to press his case and stir speculation about whom he might pick as his running mate, a way of signaling to voters that he is on a march to the nomination.

Trump and his aides are eager to bring the primary to a rapid conclusion and avoid a drawn-out and costly battle for the Republican Party’s nomination.

Recent polling indicates that Trump remains the commanding front-runner in New Hampshire, consistently leading in the state by a double-digit margin.

Gov. Ron DeSantis of Florida, who left New Hampshire on Friday, is spending the weekend campaigning in South Carolina.

Here’s what else to know: — The South Carolina ad reservation announced by Haley’s campaign is a $4 million buy across television, radio and digital that will begin the day after the New Hampshire primary, as she seeks a one-on-one contest with Trump.

The Senate and the House approved the stopgap measure Thursday; funding was to run out at midnight Friday. The six-week deal was passed over the opposition of hard-right Republicans in the House but with bipartisan majorities in both chambers. It will allow Congress to negotiate and pass bills totaling $1.66 trillion to fund the government through the fall.

White House press secretary Karine Jean-Pierre said in a statement Friday that the new measure “prevents a needless shutdown, maintains current funding levels and includes no extreme policies.”

She indicated that the White House was prepared for fights ahead, as the new resolution was the third time since

the start of the fiscal year Oct. 1 that Congress had temporarily extended funding.

“Instead of wasting more time on partisan appropriations bills that violate the budget agreement two-thirds of them voted for last spring, House Republicans must finally do their job and work across the aisle to pass full-year funding bills that deliver for the American people and address urgent domestic and national security priorities by passing the president’s supplemental request,” Jean-Pierre said.

Under the stopgap legislation, funding for agriculture, veterans programs, transportation, housing and other federal operations would be maintained through March 1. Funding for the rest of the government, including the Pentagon, expires March 8.

With the additional time, members of the House and Senate Appropriations committees are aiming to push through the dozen bills funding the government. But far-right conservatives in the House are demanding measures Democrats will not accept, including restrictions on abortion and other limits on government.

At an event at the White House with mayors from across the country Friday, Biden poked fun at the dysfunction that preceded his signing of the bill.

“We have some good news: We just signed a bill to keep the government open,” he said. “Some days that counts as progress.”

With deal close on border and Ukraine, Republican rifts threaten to kill both

en. James Lankford, R-Okla., a staunch conservative, last week trumpeted the immigration compromise he has been negotiating with Senate Democrats and White House officials as one shaping up to be “by far, the most conservative border security bill in four decades.”

Speaker Mike Johnson, in contrast, sent out a fundraising message Friday denouncing the forthcoming deal as a Democratic con. “My answer is NO. Absolutely NOT,” his message said, adding, “This is the hill I’ll die on.”

The Republican disconnect explains why, with an elusive bipartisan bargain on immigration seemingly as close as it has been in years on Capitol Hill, the prospects for enactment are grim. It is also why hopes for breaking the logjam over sending more U.S. aid to Ukraine are likely to be dashed by hard-line House Republicans.

The situation encapsulates the divide cleaving the Republican Party. On one side are the right-wing MAGA allies of former President Donald Trump, an “America First” isolationist who instituted draconian immigration policies while in office. On the other is a dwindling group of more

mainstream traditionalists who believe the United States should play an assertive role defending democracy on the world stage.

The two wings coalesced in the fall around a bit of legislative extortion: They would only agree to President Joe Biden’s request to send about $60 billion more to Ukraine for its fight against Russian aggression if he agreed to their demands to clamp down on migration at the U.S. border with Mexico. But now, they are at odds about how large of a price to demand.

Hard-right House Republicans, who are far more dug in against aid to Ukraine, have argued that the bipartisan border compromise brokered by their counterparts in the Senate is unacceptable. And they bluntly say they do not want to give Biden the opportunity in an election year to claim credit for cracking down on illegal immigration.

Instead, with Trump agitating against the deal from the campaign trail, they are demanding a return to more severe immigration policies that he imposed, which stand no chance of passing the Democratcontrolled Senate. Those include a revival of the “Remain in Mexico” policy, under which migrants seeking to enter the United States were blocked and made to stay elsewhere while they waited to appear in immigration

court to plead their cases.

While Senate GOP leaders have touted the emerging agreement as a once-in-ageneration opportunity for a breakthrough on the border, hard-right House members have dismissed it as the work of establishment Republicans out of touch with the GOP base.

“Let’s talk about Mitch McConnell — he has a 6% approval rating,” Rep. Marjorie Taylor Greene, R-Ga., said of the Senate minority leader. “He wouldn’t be the one to be listening to, making deals on the border.”

She said that after Trump’s decisive win in the Iowa caucuses, “It’s time for all Republicans, Senate and the House, to get behind his policies.”

As for the proposed aid to Ukraine, Greene is threatening to oust Johnson from the speakership if he brings it to the floor.

“My red line is Ukraine,” she said, expressing confidence that the speaker would heed her threat. “I’m making it very clear to him. We will not see it on the House floor — that is my expectation.”

The situation is particularly fraught for Johnson, the novice House speaker whose own sympathies lie with the far right but who is facing immense institutional pressures — from Biden, Democrats in Congress and his fellow Republicans in the Senate — to embrace a deal pairing border policy changes with aid to Ukraine.

Johnson has positioned himself as a Trump loyalist, quickly endorsing the former president after winning the gavel, and said that he has spoken regularly to the former president about the Senate immigration deal and everything else. After infuriating hardright Republicans on Thursday by pushing through a short-term government funding bill to avert a shutdown, the speaker has little incentive to enrage them again and defy the wishes of Trump, who has disparaged the Senate compromise.

“I do not think we should do a Border Deal, at all, unless we get EVERYTHING needed to shut down the INVASION,” Trump wrote on social media this week.

Democrats already have agreed to substantial concessions in the talks, including making it more difficult for migrants to claim asylum; expanding detention and expulsion authorities; and shutting down the intake of migrants when attempted crossings reach a level that would overwhelm detention facilities — around 5,000 migrants a day.

But far-right Republicans have dismissed the compromise out of hand, saying the changes would still allow many immigrants to enter the country each year without authorization.

Election-year politics is playing a big role. Rep. Bob Good, R-Va., the chair of the hard-right House Freedom Caucus, said passing the Senate bill would give “political cover” to Biden for his failures at the border.

“Democrats want to look like they care about the border, then run out the clock so Biden wins reelection,” Good said. “It would be terrible for the country to give political cover to the facilitators of the border invasion.”

Rep. Tim Burchett, R-Tenn., said that while Johnson broke with the right on federal spending because he feared a government shutdown, “I think on the immigration issue, there’s more unity.”

Sen. John Thune of South Dakota, the No. 2 Senate Republican, warned that the immigration compromise was a “unique opportunity” that would not be available to Republicans next year, even if they were to win majorities in both chambers of Congress and win back the White House.

“The Democrats will not give us anything close to this if we have to get 60 votes in the U.S. Senate in a Republican majority,” he said.

Many mainstream House Republicans believe that Johnson would be making a terrible mistake if he heeded the advice of the most far-right voices and refused to embrace an immigration deal. They argue that doing so would squander an opportunity to win important policy changes and the political boost that would come with showing that Republicans can govern.

“Big-city mayors are talking about the same thing that Texas conservatives are talking about,” said Rep. Patrick McHenry, R-N.C., a close ally of former Speaker Kevin McCarthy. “Take the moment, man. Take the policy win, bank it, and go back for more.

That is always the goal.”

But for some Republicans, taking the policy win is less important than continuing to have a political issue to rail against in an election year.

“It’s worse than doing nothing to give political cover for a sham border security bill that does nothing to actually secure the border,” Good said.

As Trump treats trials like rallies, judges study how to rein him in

D

onald Trump doesn’t change. Judges do.

Two weeks ago, a New York judge, Arthur Engoron, permitted Trump to personally deliver a closing argument in his civil fraud trial as long as he stuck to the facts and avoided a courtroom “campaign speech.” Trump bulldozed through the restrictions, repeated his familiar claim of a “political witch hunt” and assailed the judge to his face.

Then last week, after a lawyer down the street at the E. Jean Carroll defamation trial complained that Trump was grumbling “con job” and “witch hunt” loud enough for jurors to hear, Judge Lewis Kaplan sternly warned him that, although he had the right to be present, “that right can be forfeited — and it can be forfeited if he is disruptive.”

Carroll’s lawyers did not find reason to complain again.

The judges’ different approaches to the tempestuous storm that entered their courtrooms — and the different results — could offer lessons beyond the two New York cases.

They may provide guidance for the judges set to oversee Trump’s four potential criminal trials, who will want to keep the 45th president from transforming his legal proceedings into political spectacles.

“The thing you’ve got to do primarily is set rules and enforce them,” said John S. Martin Jr., a former U.S. District Court judge in Manhattan.

“I think if the judge is tough and doesn’t back down, Trump will back down.”

Trump, 77, often finds himself in courtrooms these days, alternating those appearances with campaign stops — and using both for political purposes as he seeks the Republican presidential nomination. On Tuesday, after attending jury selection in Carroll’s case, he flew to New Hampshire to begin campaigning.

He then returned to court Wednesday, when she testified, before heading back to New Hampshire.

Judges regularly confront defendants who are powerful public figures, like politicians or CEOs, who are used to dominating a room.

But judges do not easily surrender their authority. Typically, threats of financial sanctions, contempt or jail sentences calm the most unruly of disrupters.

What has made Trump’s appearances challenging is that he may be making the calculation that disobeying a judge or perhaps even losing a legal argument could be politically advantageous. In Carroll’s defamation trial,

After his two confrontations with the judges, Trump held news conferences in front of cheering supporters in his building at 40 Wall St. He repeated his themes of personal persecution. He called the state attorney general, Letitia James, who had sued him in the civil fraud case, “deranged” and “a political hack.” A week later, he labeled Kaplan “a Trump-hating guy,” and brushed aside Carroll’s claims. “I, frankly, am the one that suffered damages,” he said.

Both of Trump’s Manhattan trials are still pending. There is no jury in James’ civil fraud case in New York Supreme Court; Engoron’s ruling on whether Trump and his company are liable for a $370 million penalty being sought by the state is expected toward the end of this month.

Carroll’s defamation trial is being heard by a nine-person jury in U.S. District Court,

with Kaplan overseeing the proceedings. The only issue is how much money, if any, Trump must pay Carroll, 80, for defaming her after she accused him in 2019 of sexually abusing her decades before, and for his persistent attacks in statements and social media. Testimony is expected to continue through at least Monday, when Trump has indicated he might testify.

Kaplan, 79, was appointed to the federal bench by President Bill Clinton in 1994. He is known for his command of the courtroom and, at times, his impatience with lawyers who seem to be unprepared. He has presided over trials involving such boldface-name defendants as Sam Bankman-Fried, the tousle-haired cryptocurrency mogul convicted in November, and Sulaiman Abu Ghaith, a son-in-law and adviser to Osama bin Laden whom the judge sentenced to life in 2014.

The judge also presided last spring in a previous case that Carroll brought against Trump. In that trial, a jury awarded her $5 million in damages after finding him liable for sexually abusing her in the 1990s and defaming her in a different statement than those that prompted the current case before Kaplan.

“This is not his first rodeo,” said Katherine B. Forrest, a former colleague of Kaplan’s on the Manhattan federal bench. “He is going to be quite careful and thoughtful about how he handles this situation.”

“I’m sure he’s thinking about when he draws lines, how he draws lines, what the lines mean and what agenda it plays into,” Forrest added.

Kaplan already ruled Trump and his lawyers may not contest the jury’s finding in May that Trump sexually abused Carroll or that his statements about her were defamatory.

But if Trump is again disruptive or even

removed from the courtroom, the trial should be able to continue, said Michael B. Mukasey, who was a Manhattan federal judge for nearly two decades. Mukasey said Kaplan would have an obligation to ensure the jury is not influenced by any extraneous matter.

“He would want to make sure that they understand that neither Trump’s antics, nor whatever results from them, is evidence,” Mukasey said, “because they take an oath to decide the case based only on the evidence and his instructions on the law.”

In the state court, Engoron, 74, also has long experience. A former cabdriver and aspiring musician, he makes frequent jokes from the bench and maintains a cordiality with lawyers and witnesses alike.

He is a character outside the courtroom too: He submitted a story to The New York Times about approaching singer Art Garfunkel, informing him “My name’s Art, too.”

But Trump and his lawyers have appeared to test Engoron’s good humor as the judge seeks to determine whether the former president is liable for violating state laws by inflating his net worth, as James, the attorney general, has argued.

When one of Trump’s lawyers, Christopher Kise, said that the former president wanted to speak during closing arguments this month, Engoron said he would permit that as long as Trump agreed to the conditions that bind any lawyer: to stick to the facts and the law.

The former president did not agree to do so. In open court, Kise renewed his request, prompting a sigh from Engoron. “This is not how it should have been done,” he said.

Still, he let Trump speak, and the former president used his five minutes to attack James and the judge.

Crypto funds have arrived. But who needs them?

E

xchange-traded funds come in many shapes and sizes. Some are plain vanilla, diversified index funds that let you invest in the entire stock and bond markets, and are excellent core holdings for the great majority of people.

Then there are the quirky, narrowly focused ETFs like the Inverse Cramer Tracker, which enables you to bet against the stock picks of CNBC television host Jim Cramer. The fund is legal, approved by the Securities and Exchange Commission — and a money-loser since its inception last year. Betting against Jim Cramer just isn’t a great investing strategy.

Neither is fear of missing out. Yet FOMO is the main reason for putting money into bitcoin, which remains highly speculative, difficult to categorize and without an immediately identifiable economic function.

The SEC this month approved 11 new ETFs that track the price of bitcoin, and the decision has been heralded by promoters of bitcoin — and of the new funds — as an important event, legitimizing bitcoin as an asset class.

I don’t think so.

The SEC’s action, in itself, doesn’t give bitcoin any new stature. It merely adds bitcoin funds to a long list of ETFs that are perfectly legal and simple to buy, but that don’t belong in anybody’s core portfolio. I’d put the Inverse Cramer Tracker in this category, as well as ETFs that track a single stock like Tesla, PayPal or Nvidia, or that use leverage to triple a bet on energy prices or quadruple one on the S&P 500. I could go on and on.

Simply being legal doesn’t make a strategy sensible for most investors. In fact, while approving the bitcoin ETFs, the agency also issued an explicit warning against FOMO investing in so-called digital assets — as it has done many times before.

“Just because others around you might be buying into these kinds of opportunities, it doesn’t mean you have to,” said Lori Schock, director of the SEC’s Office of Investor Education and Advocacy.

The agency’s approval of the new bitcoin funds does change things in one important sense, though. Until now, it was easy for me to avoid discussing bitcoin in the context of investing. Why bring attention to something that isn’t right for most people? But now that major financial services companies like BlackRock, Fidelity, Franklin Templeton,

Invesco and Wisdom Tree are beginning to operate bitcoin ETFs, and make them available to their clients, silence seems unnatural and, maybe, irresponsible.

So here goes.

Making sense of bitcoin I don’t want to dismiss bitcoin entirely.

Granted, it’s possible to make — and lose — a great deal of money buying and selling it. And bitcoin is a serious proposition, in terms of its underlying structure. The use of blockchain, the decentralized, peer-to-peer structure and the complex mathematical code demand respect. Concepts embedded in bitcoin and other so-called cryptocurrencies could have real-world importance at some point, and in some way, though perhaps not as bitcoin.

As Bryan Armour, who directs research into strategies based on index funds at Morningstar, told me, “Not believing that bitcoin ETFs are a good investment doesn’t mean that blockchain isn’t a good or useful technology.”

But bitcoin itself? He put it politely. “I’d say bitcoin is still in the price discovery stage.

We’re still trying to figure out what it might be worth.”

For large corporations or other big institutional investors interested in getting some bitcoin exposure, the new ETFs may be a better and more convenient option, said Samara Cohen, chief investment officer of ETF and index investments at BlackRock. “It’s the start of a journey,” she said.

But for ordinary people investing for important things like retirement or a house or a child’s education, I’d be very careful. The collapse of the FTX trading platform in 2022 and the fraud and conspiracy conviction of Sam Bankman-Fried only a few months ago are reminders that bitcoin is extremely risky.

Its future is uncertain, and so is its very definition.

Defining terms Just to start, I find the term cryptocurrency to be a misnomer. These things aren’t currencies because they can’t be widely exchanged for products and services in the real world. But even if they were currencies, it wouldn’t make sense for ordinary people to invest in them. Major corporations hedge against fluctuations in currency values, but most of us invest in assets that at least have the potential of producing income and cash flow — assets that can be purchased with currency.

Then we get to the central claim for the new ETFs — that they are helping to create

“an asset class,” one that “protects you” in times of uncertainty, much as gold did “for thousands of years,” in the words of Laurence D. Fink, the chair of BlackRock. This comparison, I think, is strained.

Gold has a historical cachet, has actually served as money, is still held by central banks, has commercial uses in jewelry and industry and has an important cultural role in countries like India. Bitcoin has none of those attributes.

But in one sense I agree with the comparison. Gold is not an important part of a modern diversified investment portfolio, which contains stocks, bonds and cash.

A Morningstar study last year by Madeline Hume found that as little as a 2% holding of bitcoin can transform a conservative stockbond portfolio into a far riskier one. Investors may be tempted by bitcoin when its price is rising, but beware: “Compared with other assets, though, bitcoin’s volatility is more kerosene than kindling,” the report said.

Already exposed In a very small way, even without the new ETFs, there’s a good chance that you already have exposure to bitcoin in your portfolio.

Most of the new ETFs rely on Coinbase, which calls itself “a trusted and easy-to-use platform for accessing the broader cryptoeconomy,” for important functions: converting cash into bitcoin and bitcoin into cash, storage and safekeeping of bitcoin, assistance in monitoring the fund’s operations and sometimes all of these.

Coinbase is a publicly traded company, and the largest holders of most such companies are mutual funds and ETFs run by giants like Vanguard, BlackRock, State Street and Fidelity. I checked: My Vanguard workplace retirement accounts include broad, diversified stock index funds that hold Coinbase.

And that’s not all. They also include small shares of companies like MicroStrategy, which owns a lot of bitcoin. Then there are firms like Riot Platforms and CleanSpark that call themselves “bitcoin miners” — entities that run the computers that generate new bitcoin and keep the bitcoin universe spinning.

I don’t see a great social purpose for bitcoin mining. A 2022 White House report said global electricity consumption for “crypto assets” was greater than “the total annual electricity usage of many individual countries, such as Argentina or Australia.” That’s hard to

I’m not happy about this, but I have a stake in them, and you probably do, too.

That’s the way index fund investing goes. You hold part of the entire universe of publicly traded companies. On the positive side, if it turns out that I’m wrong about bitcoin, and that it really is the next big thing — and, somehow, is needed to save the planet — well, these companies will grow in size, and my portfolio will swell, too. That would be a winwin, though I’m not counting on it.

Vanguard, I should point out, has taken a principled stand against bitcoin. Its broad index funds own the companies involved with crypto because those funds own all companies. But if you want to buy the new bitcoin ETFs — or, as of Jan. 12, older ones that tracked bitcoin futures markets — you can’t do it at Vanguard.

In short, although the new ETFs may help the companies involved with them and may well cause interest in bitcoin to grow, bitcoin still isn’t important for serious individual investors.

Nothing the SEC has done this month has changed that.

That doesn’t mean you should avoid bitcoin. Owning some might be fun and profitable. But I’d make the same statement about buying lottery tickets, spending evenings at a casino, making online bets on your favorite sports team — or purchasing shares of the Inverse Cramer Tracker.

If you can afford to spend your money on entertainments like these, by all means, enjoy yourself. But don’t kid yourself that you’re making a solid long-term investment.

Maligned US real estate sector draws buyers eyeing rate cuts

alling inflation and expectations of an economic soft landing are buoying hopes for U.S. real estate stocks in 2024, even as the sector continues to lag the broader market.

Real estate investment trusts (REITs) were among the worst performing sectors over the last year, with share prices weighed down by factors ranging from high interest rates to tepid demand for office space in an era of remote work. The Real Estate sector (.SPLRCR), opens new tab of the S&P 500 fell 3.4% in 2023, while the broad S&P 500 index soared more than 24% last year and hit a record high on Friday.

Real estate’s pain has continued into 2024, pushing the sector down 3.4% in January against a 1.4% gain for the S&P 500. Yet some investors are growing more confident the trend will reverse - especially if the Fed cuts rates as aggressively as many investors expect. REITs benefit from lower rates which reduce the cost of capital and fuel revenue growth.

“REITs were crushed by the fastest rate hiking cycle in 40 years, and are going to move in line with expectations of rate cuts,” said Justin McAuliffe, a research analyst at Gabelli Funds who remains bullish on REITs such as American Tower (AMT.N), opens new tab.

Investors have been wading back into the sector. Global fund managers increased their exposure to REITs by 15 percentage points in December, pushing allocations to 12-month highs, according to the latest survey from BofA Global Research.

At the same time, the Schwab U.S. REIT ETF (SCHH.P), opens new tab - the largest US REIT-focused exchange traded fund- saw approximately $35 million in net inflows over the last week, its largest since October, according to data from analytics firm VettiFi. Historically, the end of a Fed hiking cycle has been supportive for REITs. Since 1995, public REITs have gained 20.1% in the year following the last rate increase of a cycle, according to data from CenterSquare Investment Management. The S&P 500, meanwhile, gained an average of 10% in the 12 months after the Fed finished the last hike of a cycle since 1980, according to data from Putnam Investments.

“If central banks have truly turned more dovish, the setup for REITs is favorable,” CenterSquare wrote in its 2024 outlook.

Of course, the sector’s sensitivity to interest rate expectations can cut both ways: while real estate stocks rallied along with the rest of the market in 2023 on expectations that the Fed would pivot to rate cuts this year, they have been hit this month as some investors recalibrated bets on how aggressively the Fed might ease.

Jeff Doerfler, director of investment management at Huntington Private Bank, said the declines make some of the stocks in the sector, such as warehouse owner Prologis (PLD.N), opens new tab, more attractive over the long term.

“We’re at the start of a cycle where lower cost of capital will drive revenue growth and you’ll get an increasing amount of M&A,” said Doerfler, who is overweight REITs overall.

Investors will get readings on the pace of inflation and the economy next week with manufacturing PMI data released on Thursday and personal consumption expenditures data released on Friday, in addition to earnings from 3M, United Air-

lines and Abbott Laboratories.

Many REITs do not report earnings until later in the quarter, with retail-focused company Simon Property Group (SPG.N), opens new tab scheduled to report its quarterly results Feb. 5 and American Tower (AMT.N), opens new tab scheduled for Feb 21. Prologis missed analyst estimates when it reported results Jan. 17 and cited weakness in freight demand.

Of course, plenty of obstacles remain for the sector chief among them an oversupply of office space that is unlikely to be absorbed anytime soon.

The shift to hybrid work policies will likely erase $800 billion from the value of office buildings in major ciites worldwide by 2030, consulting firm McKinsey said in July.

Gaza’s women are bearing brunt of war’s toll, aid groups say

nternational agencies, aid workers and physicians are giving a harrowing picture of what they say is the disproportionate burden and risk of war borne by the women of the Gaza Strip.

With a barely functioning health care system, extreme shortages of food and clean water, and repeated displacement, pregnant women, mothers and newborns are particularly vulnerable, the groups say.

Out of every 10 people killed in Gaza since the Oct. 7 attack in Israel that prompted the war, seven have been women or children, a “cruel inversion” compared with the previous 15 years, when roughly the same proportion of civilians killed in the territory were men, according to U.N. Women, the United Nations’ women’s rights agency.

The agency said in a report released Friday that two mothers were being killed every hour. The agency extrapolated that figure by comparing demographic data on marriage and motherhood in Gaza with the total number of

women reported to have been killed. The report also said that nearly 1 million women and girls had been displaced by the fighting.

On Sunday, health officials in Gaza updated the overall death toll, saying that more than 25,000 Palestinians had been killed in the war.

Separately, an official with UNICEF who recently visited Gaza and met with mothers at a hospital in Rafah, the southern city that has become the refuge of last resort for civilians fleeing the fighting, said Friday that the situation for pregnant women and newborns was “beyond belief.”

Tess Ingram, a communications specialist with UNICEF, gave a briefing in Geneva and described speaking with a midwife who said she had performed emergency Csections on six dead women in the past eight weeks and seen more miscarriages than she could count. A woman told her that her fetus had gone still inside her womb but wondered out loud whether it was for the best that “a baby isn’t born into this nightmare,” Ingram recounted.

“Becoming a mother should be a time for celebration,”

she said. “In Gaza, it’s another child delivered into hell.”

The report and Ingram’s remarks echoed the warnings of a letter published in the most recent issue of the British medical journal The Lancet, in which five public health experts said “urgent protection” was needed for Gaza’s pregnant women. The World Health Organization has estimated that there are about 52,000 pregnant women in the enclave, with about 180 births each day.

“Women who are pregnant and exposed to armed conflict have higher rates of miscarriage, stillbirths, prematurity, congenital abnormalities and other adverse outcomes,” they said. “What we are currently witnessing will most probably create long-lasting generational effects.”

U.N. Women has faced a storm of criticism for being slow to address the sexual violence committed during the Hamas-led assault in Israel on Oct. 7. On Friday, the agency’s executive director, Sima Bahous, said in a statement that the organization condemns “all acts of sexual and gender-based violence wherever, whenever, and against whomever they are perpetrated” and called for accountability.

US troops in Iraq injured in attack linked to Iran-backed militias

A

t least two U.S. service members stationed in western Iraq were injured Saturday when their air base came under heavy rocket and missile fire from Iran-backed militias, as the ripple effects of the Israel-Hamas war in the Gaza Strip continued to roil the Middle East.

Ever since Hamas, also an ally of Iran, charged into Israel and carried out terror attacks on Oct. 7, Israel has retaliated with an overwhelming and ferocious offensive, and groups sympathetic to Hamas’ cause have attacked Israeli and U.S. targets.

A U.S. official cautioned that initial information was sketchy and that the number of injured could grow as damage reports from officers in Iraq are passed up the chain of command. A number of U.S. military personnel were being evaluated for traumatic brain injuries. An Iraqi soldier was injured,

said Brig. Gen. Yahya Rasool, the military spokesperson for Iraqi Prime Minister Mohammed Shia al-Sudani.

The attack against the Ain al-Asad air base in Iraq, which came at 6:30 p.m. local time, were the latest and the most serious of roughly 140 such rocket and missile strikes against U.S. troops based in Iraq and Syria since the Israel-Hamas war started. At least 10 rockets and seven short-range ballistic missiles were fired at the base, with two making it through air defense systems, in the most successful attack the militias had carried out so far. The attack was another example of the region being pulled into a broader conflict.

Israel and Hezbollah, another Iranian ally, have traded fire across the Lebanese border. A Houthi militia in Yemen, also backed by Iran, has fired missiles and drones at commercial ships in the Red Sea and Gulf of Aden, calling it a retaliation for the Israeli

bombardment of Gaza. The United States and its allies have fired back, striking inside Yemen multiple times.

The hostilities have spread from there.

In recent days, Iran fired missiles into Iraq, Syria and Pakistan, calling it a defensive strike against terrorist groups, but also claiming to have gone after an Israeli intelligence base. Pakistan said it had swiftly struck back with airstrikes inside Iran.

Then on Saturday, Iran accused Israel of launching an airstrike on the Syrian capital, Damascus, that killed five Iranian military figures. Soon after, the missile and rocket barrage hit U.S. troops at the air base in Iraq.

The Ain al-Asad air base, in Iraq’s western desert, is now primarily used by Iraqi forces but still has a U.S. contingent. In all, there are 2,500 U.S. troops in Iraq and 900 in Syria, helping to support Iraq and Kurdish Syrian forces in the fight to tamp down the

remains of the Islamic State group. U.S. officials in Washington said Saturday that it was not immediately clear if the militia attacks in Iraq were related to the earlier strikes in Syria.

There have been 140 militia attacks on U.S. troops in Iraq and Syria in the past three months, with 57 in Iraq and 83 in Syria, Sabrina Singh, a Pentagon spokesperson, said Thursday.

Nearly 70 U.S. personnel have suffered injuries in the attacks, including traumatic brain injuries, but all but a handful of the troops have been able to return to duty relatively quickly, Pentagon officials have said.

Iranian-linked militias in Iraq, known collectively as the Axis of Resistance and who count themselves as part of Iran’s network of allies across the Middle East, claimed in a statement that this latest attack was a response to Israel’s war in Gaza.

There was no mention of the strike in Syria.

As missiles strike, a radio station broadcasts the rage of a battered city

I

t was the middle of the night in early January when a Russian missile streaked in and exploded in the center of Kharkiv,

blasting down walls and shattering windows.

The next day, people went shopping and to work, ate out in restaurants and clogged the streets with traffic jams, almost as if nothing had happened.

But behind the business-as-usual veneer, residents of Kharkiv have been seething. Over the past month, Ukraine’s second-largest city has taken the brunt of Russia’s missile campaign, which has killed and wounded dozens of people, blown up buildings and unnerved everyone.

It’s an almost daily torment. To vent, Kharkiv’s residents have a dedicated outlet: Radio Boiling Over, a new FM station.

“This is Boiling Over in the Morning,” Volodymyr Noskov, the host of the morning call-in show, said on a recent broadcast.

“What are you boiling over about today?”

In Kharkiv, a sprawling city of universities and factories, coping has taken many forms.

Nearly two years into the war, the city is opening schools underground. Psychologists visit strike sites to calm residents. Plywood goes up immediately over blown-out windows.

“Keep Calm and Carry On Studying,” reads a sign at the entrance to one university.

Amid the carnage, Radio Boiling Over, which went on the air a year ago, is becoming one of the most popular local media outlets. It serves as a megaphone for the fears and frustrations that simmer within

a population under near constant assault.

“Despite all Russia is doing, the city is still living,” said Yevhen Streltsov, founder of Radio Boiling Over. But, he said, “people are getting tired because their nerves are not made of iron” and they want to complain.

While there are occasional complaints about local bureaucrats and inefficiency, most of the anger is directed at Russia, especially after strikes.

“Burn in hell until the seventh generation. Curse the unwashed Russians,” a listener, Tetyana Arshava, wrote on the station’s Instagram page after one high-casualty missile attack.

The station broadcasts hourly news updates and talk shows in the morning and evening, with a focus on missile strikes; interviews with soldiers on the front line 100 or so miles east; investigations of Russian war crimes, and of course the anger of hundreds of thousands of people forced to worry daily about their safety. The station’s name, Radio Nakypilo, can also be translated as Radio Fed Up. It receives funding from the National Endowment for Democracy, an American Continues on page 13

14 From page 13 nonprofit financed by the U.S. government, and the European Endowment for Democracy, with the mission of covering local news in a community that, even by the standards of Ukraine’s battered cities, has endured a harrowing 23 months.

Just 24 miles from the Russian border, Kharkiv was an early target of invading Russian ground forces and was partly encircled. People fled. Of the pre-invasion population of about 2 million, 1.2 million remain today.

Barrages of ballistic missiles fly in anywhere from once a week to daily, arriving so quickly that alarms can provide no more than 40 seconds of warning.

Parents rush children into bathtubs or, at the least, away from windows.

Over the past three weeks, Russian missiles ravaged two hotels, Kharkiv Palace and Park Hotel; blew out windows in popular restaurants, which quickly reopened; and hit apartment blocks. The predawn strike on the apartment building early this month injured 17 people.

“This is our everyday life,” Streltsov said.

Yet despite the mortal threat, ballistic missile strikes have become so common in Kharkiv that Radio Boiling Over does not interrupt its music programming if only one missile has landed, Yevhen said. Announcers will cut in only for volleys or a catastrophic strike.

Kharkiv is handicapped because the military’s best air defense systems, including U.S.-provided Patriots, are mostly reserved for the capital, Kyiv. So it endures the regular mayhem that comes with being the closest large city to the Russian border.

“Nobody has this experience anywhere in the world,” the mayor, Ihor Terekhov, said in an interview. He said people were generally coping well. “There are strikes, yes, but no panic.”

Terekhov has been promoting a program of building schools underground, to protect them from missiles. The school district has built five in corridors of subway stops, called MetroSchools, and is close to finishing a purpose-built subterranean elementary school for 450 students, with only the soccer field on the surface.

Radio Boiling Over’s mission is to capture that reality, and give people an outlet to let off steam, as well as provide useful practical information. On a recent evening, it was reporting on a missile strike in the Kharkiv region, but not in the city. One woman was killed. The station was taking calls.

One such story involved hibernating bats. The missile strikes disturb the bats, and sometimes send them fluttering down in huge numbers through broken windows into apartments below.

After one recent strike, noteworthy for being one of the first suspected deployments by Russia of a North Korean ballistic missile, one man found a creepy scene of hundreds of bats clinging to the furniture in his damaged apartment.

A local animal shelter collects them, Korobenko reported, and it now has 5,000 bats in a heated storage area; it plans to release them in the spring. That was a positive story, he said.

Some people are annoyed with the constant wail of ambulance sirens, he said. Some are just continually gripped by anxiety.

In Davos, Israel’s hostages get a hearing

T

he annual meeting of the World Economic Forum in Davos, Switzerland, is largely an opportunity for the powerful to mingle with the even more powerful. For the most part, I’ve spent my time here listening to government leaders — Iran’s foreign minister struck me as an exceptionally talented dissembler — and schmoozing with business leaders, think tankers and officials at Davos’ famous private dinners and after-parties.

But the most moving stories I heard last week came from some of the least powerful people here.

“I open my eyes and feel my throat close,” Rachel Goldberg said, describing her mornings over the previous 100-plus days. “I say a Jewish prayer and ask, ‘Let today be the day.’ And then I say, ‘Pretend to be human.’ And I put on this costume because if I’m a ball on the floor, I can’t save him.”

She is speaking — with extraordinary self-composure — of her 23-year-old son, Hersh Goldberg-Polin. On Oct. 7, he was attending the Nova music festival with a friend when terrorists from Hamas, arriving in paragliders and vans, murdered 364 people in cold blood. Hersh and nearly 30 others tried to hide at a small roadside bomb shelter. Terrorists attacked it with hand grenades, then a

Hersh survived the assault, barely. Goldberg showed me video footage, taken by Hamas, of him being put into the back of a truck and driven off to the Gaza Strip. The lower half of his left arm has been blown off, leaving a bloody stump. It’s stomach-churning to watch.

Goldberg is in Davos to talk to anyone who can help save and return the remaining 132 hostages, including Hersh.

So is Noam Peri, who works for Google in Israel. Peri’s father, Chaim, a welder and artist from the kibbutz Nir Oz, near Gaza, was taken from his home on the morning of Oct. 7.

He was hiding with his wife, Osnat, in the safe room of their house when Hamas broke through. Chaim heroically shoved a terrorist away, giving Osnat time to hide in a corner of the room. When Hamas returned, he walked out with them, losing one of his sandals along the way. They never thought to go back to check the room for additional people.

“He saved my mother,” Noam said. She last had proof of life nearly two months ago, when Hamas shot a video of Chaim and two other elderly hostages, looking frail and afraid. He’s without his glasses, hearing aid and medication, most likely in an airless tunnel deep underground, sustained, according to the testimony of hostages who have been released, on a starvation diet: typically, two dates in the morning, a half-pita and some rice, another half-pita.

He will turn 80 in April, assuming he’s still alive.

Another elderly resident of the Nir Oz kibbutz was Eli Margalit, who was murdered that day. Hamas took his corpse with them to Gaza — presumably as a negotiating chit, cruelly denying his family the chance of a burial and a place to mourn.

Also taken by Hamas that morning was his daughter, Nili Margalit, a pediatric nurse in a hospital in southern Israel that largely serves the Bedouin community. She was taken alive at knifepoint.

“On Friday morning, the day before the attack, I was on shift in the hospital, and I was telling a friend of mine,

‘You know, tomorrow is a holiday, and our tradition is to fly white kites for peace on the border to show solidarity for Palestinians,’” she said. “That was my intention.”

She spent the next 54 days with 20 other hostages in a tunnel that, according to her captors, was 130 feet underground. “There’s no air. You feel like you’re suffocating. No running water. There was a toilet but no running water; we flushed it once a day. The hygiene conditions are terrible.”

She was repeatedly told by her captors that “nobody cares about us; the government isn’t looking for us.”

As a nurse, she took it upon herself to care for the other hostages — some of whom had arrived in the tunnel with heart conditions, kidney and respiratory diseases, diabetes and other afflictions. Worse than the physical deprivation, she said, was the psychological terror. “When your spirit is not strong, you can’t survive,” she said. “The mind will make the body shut down.”

I asked her what her homecoming — which came about as part of a temporary truce in which Israel released Palestinian prisoners — was like. “My house was burned down; I don’t have a house to go back to,” she said. “It’s not about the clothes. It’s memories. Photos. My entire life on two hard drives, all gone. No sense of how my father died.

“I want to give my father a proper burial,” she added.

“To say the prayers.”

In my talks with Goldberg, Peri and Margalit, they took care to stay away from expressing any political opinions. Smartly so: The powerful in Davos take sharply different views about the war.

But I struggle to imagine how anyone of good conscience can take any view except to desire — and loudly demand — that Hersh come home to his parents, and Chaim to his daughter and wife; and that Nili be able to bury her father; and that all the hostages, irrespective of every other consideration, be freed and brought home now. It bears repeating everywhere, every day, until the day finally comes.

La inversión se aproxima a 283.7 millones de dólares, de los cuales 90 por ciento los provee FEMA y 10 por ciento se obtienen mediante los fondos CDBG-DR. “Durante los pasados tres años hemos dado énfasis al

uso eficiente y correcto de fondos federales y a la agilidad en los trabajos de reconstrucción. Esta es la obligación más cuantiosa que ha recibido la UPR para atender los daños ocasionados por el huracán María. Con estos fondos asignados se realizarán reparaciones en el edificio Guillermo Arbona Irizarry que fue construido en el 1972 y que consiste en 12 pisos y un sótano, donde ubican oficinas administrativas, aulas donde se ofrecen programas académicos en Medicina, Salud Pública, Odontología y Farmacia, así como aproximadamente 200 laboratorios de investigación científica. Agradecemos a FEMA por asignar esta significativa cifra que dará paso a la transformación de este importante recinto universitario que alberga operaciones importantes para los estudiantes de medicina y donde se ofrecen diversos servicios de salud a

Es un deber de todos cumplir con las leyes ambientales y la protección de nuestra vida silvestre diversa. La Ley 176 del 1 de agosto de 2004 prohíbe la importación y posesión de cualquier especie de mono o simio en los hogares puertorriqueños. Mientras, el Reglamento 7399 del Departamento de Agricultura de 7 de agosto de 2007, designa como animales perjudiciales a los monos patas, macacos rhesus y monos ardilla y prohíbe la introducción, importación, posesión, adquisición, venta o traspaso de dichas especies.

“El Proyecto del Senado 1357, busca que la Oficina de Servicios a Ciudadanos Extranjeros en Puerto Rico, adscrita al Departamento de Estado, establezca y mantenga un catálogo actualizado de entidades públicas, tanto estatales y federales; así como entidades del tercer sector, locales e internacionales, que brindan servicios y apoyo a las personas inmigrantes, independientemente del estado migratorio de las per-

sonas servidas”, expuso el legislador, quien preside la Comisión de Servicios Esenciales y Asuntos del Consumidor.

Agregó, que “así también, el Proyecto del Senado 1358 busca crear la Ley de Sensibilización hacia la Comunidad Inmigrante en la Prestación de Servicios del Estado Libre Asociado de Puerto Rico; definir la política pública que implantará adiestramientos en las tres ramas del Gobierno para mejorar la prestación de servicios a la comunidad inmigrante, sin considerar su estado migratorio.

The legal question at the center of the Alec Baldwin criminal case

ow that a grand jury has indicted Alec Baldwin on a charge of involuntary manslaughter for the fatal shooting of a cinematographer on the set of the film “Rust” in New Mexico in 2021, the contours of the looming legal battle are coming into focus.

If the case reaches trial, the challenge prosecutors face will be convincing a jury that Baldwin was guilty of either the negligent use of a firearm or of acting with “total disregard or indifference for the safety of others” — even though investigators found he was told on the day of the shooting that the gun he was rehearsing with contained no live rounds, and even though the film set was not supposed to have any live ammunition at all.

The challenge Baldwin’s defense team faces will be to explain why the gun fired.

Baldwin has maintained all along that he did not pull the trigger that day as he rehearsed a scene in which he draws a revolver, saying that the gun discharged after he pulled the hammer back and released it. A forensic report commissioned by the prosecution determined that he must have pulled the trigger for the gun to go off, a finding that contributed to its decision to revive the criminal case against Baldwin.

Legal experts were divided on the merits of reviving the case, noting that traditional gun safety rules — such as never pointing a functional gun toward someone — do not always apply on film sets, and that investigators found he had been assured by the film’s safety crew that the gun did not contain live ammunition.

“The notion that you never point a gun at someone would sort of undo Westerns for the past 100 years,” said Nancy Gertner, a retired federal judge.

The outcome of the case at trial — the State of New Mexico vs. Alexander (Alec) Rae Baldwin — would hinge on how jurors view two key questions: Should Baldwin have known of the danger involved in his actions that day? And, using a term of art in criminal law, did he act with a “willful disregard for the safety of others”?

The grand jury indictment required that at least eight out of 12 jurors found probable cause that Baldwin committed a crime. The standard at trial is much higher: A jury must

“I think it’s an uphill battle,” said Steve Aarons, a veteran defense lawyer in New Mexico. “There is no reason for live rounds to be there. It’s a little different than other situations where you have a firearm and you assume any bullet that is there would be a live round.”

There is a complex web of factors that would quite likely come up at trial, including the condition of the gun, which broke during FBI testing, and Baldwin’s responsibility as a producer on the film.

(Baldwin has asserted that even though he was a producer, he had no involvement in hiring crew members, including the movie’s armorer, Hannah Gutierrez-Reed, who was responsible for guns and ammunition on the set. She has pleaded not guilty in the involuntary manslaughter case against her.)

But the prosecutors will probably take the straightforward position that anyone who agrees to handle a gun is responsible for what happens next, said Joshua Kastenberg, a criminal law professor at the University of New Mexico and a former prosecutor.

“You could make the argument that regardless of the condition of the weapon, there was an independent duty of every person that was going to put their hands on that weapon that day to ask and make sure that it was either safe or unloaded,” he said, though

he said that proving that kind of argument to a jury is often challenging.

After the grand jury indicted Baldwin on Friday, his lawyers — who have called the revived prosecution “misguided” — said that they looked forward to their day in court. Kari T. Morrissey, one of the special prosecutors handling the case, declined to elaborate on the case that was presented to the grand jury.

It was the second time Baldwin found himself facing a criminal charge in connection with the shooting. In an earlier case that was dropped in April, prosecutors had accused him of “extremely reckless acts” in the shooting. In a statement of probable cause last year they had accused him of getting insufficient firearms training, of failing to deal with safety complaints on set in his capacity as one of the film’s producers, of “putting his finger on the trigger of a real firearm when a replica or rubber gun should have been used” and of pointing the firearm at the film’s cinematographer and director.

Baldwin has maintained all along that

he was not responsible for the tragedy, noting that someone else had put live ammunition in the gun and that the cinematographer, Halyna Hutchins, had been directing where he pointed the gun. “I know in my heart that I’m not responsible for what happened to her,” Baldwin told a detective following the shooting.

The new case, said Marc A. Grano, a lawyer and former prosecutor in New Mexico, will most likely become a back-and-forth over what is “standard practice” in the film and TV industry, a battle that may include conflicting opinions and examples.

After the original criminal case was brought against Baldwin last year, the Screen Actors Guild-American Federation of Television and Radio Artists, the union representing film and TV actors, opposed the prosecutors’ contention that actors were responsible for ensuring that the guns they were handed on set were safe to handle, saying, “an actor’s job is not to be a firearms or weapons expert.”

The most widely used written protocols around gun use on sets are outlined in documents called Safety Bulletins No. 1 and No. 2, which were created by a team of representatives from the unions and the major studios, and which will most likely be used as evidence in court.

The fatal shooting of Hutchins prompted the first revisions to those safety guidelines in two decades. The new guidelines, published in December, are longer and more detailed than the old ones, and stress that safety meetings should include instructions on how to distinguish between blank ammunition, which have gunpowder but not projectiles, and dummy rounds, which are inert and cannot be fired.

As before, they make it clear that live ammunition is not supposed to be used on sets. “Live ammunition,” the bulletin says, “is never to be used on set nor brought onto any work location, including any studio lot, stage or location” except in rare cases if it meets specific exceptions.

Diving into the Dominican Republic’s springs and rivers

T

he tree-ringed lagoon glowed a color you usually see only in the mouthwash aisle, and under the surface of its glassy water, fallen branches looked like open hands ready to make a catch. The boulders at the bottom were either a few feet down or impossibly deep — the clarity of the water made it impossible to tell.

Hoyo Claro, a spring-filled pool known as a cenote in the Dominican Republic, was just a few miles inland from the luxury all-inclusive beach resorts of Punta Cana, but it felt like a different universe.

If sandy Caribbean beaches are the face of the Dominican Republic, its streams, rivers and cenotes are its veins, arteries and heart. The capital, Santo Domingo, is framed by three rivers, the Haina, the Isabela and the Ozama, upon which the conquering Spaniards built their fort, the first in the Americas, in 1496. The country, which shares the island of Hispaniola with Haiti, to the west, is laced with waterways and peppered with those irresistible neon-blue cenotes.

Dominican friends balked at my plan to rent a car and visit the rivers and cenotes alone last summer. The country has a reputation for being a little rough, an idea bolstered by a U.S. Department of State advisory, which warns U.S. citizens to exercise increased caution while traveling in the Dominican Republic. And with 65 of every 100,000 Dominicans dying in road accidents every year, the country also has the highest rate of traffic fatalities in the Americas, according to World Bank data.

Instead, I joined two of those friends, Hogla Enecia Pérez and Manuel Herrera, on a journey over some rugged dirt roads that are better hiked than driven. Hogla rented a car for us to visit one river. And using a cousin’s SUV with four-wheel drive, Manuel ferried me and, on one day, his family to other swimming holes. In the Dominican Republic, small, rural pools such as Hoyo Claro are marked only with a small plastic sign, barely visible from the road, so finding them is a great way to sample Dominican warmth and hospitality: Invariably, you’ll have to pull over and ask directions from a local.

Once you find a swimming hole and immerse yourself in the cool, clear water, you may feel, as I did, ducking under the water, that you’re feeling the heartbeat of the Dominican Republic itself.

I was in up to my chest and could still see my toes, which I wiggled into the sand. I wanted to root myself there forever, but Hogla waved me out of the water.

A barefoot local led us into a lush forest where we followed a wild-orchid-lined path for a few minutes before arriving at a trio of pools, places where thickets of trees, fallen trunks and other natural barriers had cordoned off the river into smaller parts: the first nicknamed Love, the second Children and the last Divorce.

The pools had mystical properties, our guide claimed. If you want to find true love, jump in the Love pool. More children? Immerse yourself in the second pool. And if you’re looking for a divorce … — he cracked a smile.

To enter the Love pool — a circle of emerald green fringed with the shaggy gray shoots of mangrove trees — we first had to balance precariously on a tangle of roots and branches.

We both hesitated. As I looked down, it was impossible to tell just how deep the water was or whether the riverbed was soft. Were there rocks? Finally, we took the plunge. It was cool and fairly shallow, and luckily, the bottom turned out to be sandy.

white sand bank gradually sloped into a shallow lagoon tinged a crisp light green that reminded me of Roman glass. Without the shade of the first pool, the sun heated up my head, even though beneath the surface, I had goose bumps.

Hogla and I warmed up on the trunk of a fallen tree that sliced the lagoon into two, and I felt that delicious sensation of shrugging off a sweater on the first warm day of spring.

The bright aquamarine water of the Divorce pool was the clearest, and with both shade and sun, it was the most inviting of the three, but superstition kept us from taking a swim. Even though Hogla and I were both already divorced, we didn’t want to doom ourselves to going through that ordeal again.

Instead, we headed to nearby Rincón Beach, where a neat row of tiny, colorful shacks offered an array of local dishes prepared on clay hearths. We had fresh lobster and octopus served alongside two plates of homemade tostones, and a heaping mound of rice with pigeon peas prepared the Samaná way, with coconut milk, all for 1,500 pesos (about $26). We sipped fresh coconut water, spiked with local rum, straight out of the shell of green coconuts, the top lopped off with a machete (300 pesos).

Bring your cooler and chill Not far away on the Samaná Peninsula, nestled between two mountains carpeted with green, the golden sand of Valley Beach offered a spot to while away the hours watching the sun dance across the cerulean stage of the Atlantic Ocean. At the beach’s western end, the small but pristine Río San Juan — not to be confused with the municipality of the same name several hours’ drive northwest — attracted locals to lounge in its waters, their coolers full of drinks and snacks.

Edged by a dramatic rock wall that gives way to a soft fringe of trees, the water provided a cool, calm retreat after being tossed about by the intense shore break of the Atlantic. Jutting trees shaded the narrow, shallow river, which gracefully curved its way into a thicket of emerald green. I followed Manuel, his wife and their two children into the water and was surprised to find that they knew the other family hanging out there, despite the fact that we were some distance from Santo Domingo. The group chatted, catching up on gossip, as the kids raced between the river and the sea.

On a Sunday morning, the place was empty save for one family, and the air was quiet. I eased myself into the cool water from a sandy bank, although there are stairs, and once I was immersed, minnows swam around me. I dunked my head, and suddenly, the water didn’t seem all that cold.

TIP: Black sesame seeds are sold raw or roasted. Both work here, but roasted ones will toast more quickly. The seeds taste bitter if they’re rancid, so be sure to check the expiration date and taste a few seeds before using.

An Olympic champion goes in search of a new identity

T

here is a shelf at Carissa Moore’s home in Honolulu where she keeps her journals. She has carried blank pages around the globe since she was a little girl, scribbling her thoughts and worries and goals as she became one of the best surfers in the world.

She still does it.

This year, knowing that she was going to retire from competition, she wrote a new goal: Face your fears.

Moore is 31. She is a five-time world champion and current defender of an Olympic gold medal. Now she wants to start a family with her husband, Luke Untermann. She wants to extract herself from the loose structure and warm cocoon of her sport’s global tour, to redefine success on her own terms and in her own mind.

She wants to be challenged in a different way, even though the easiest thing might be to stick around.

“All those wins, the competitive part that’s so much of my identity, I’m taking that away, and I’m facing myself this year,” she said. “And that’s scary. Like, who am I? Am I going to be OK? Will I be able to love myself and think that I’m worthy without this?”

Moore reflects a newer generation of athlete that openly discusses mental health and self-care. The super-

hero mystique placed upon the best athletes is a veneer, we all know.

She sees vulnerability and relatability as more honest traits to model. Maybe those are her superpowers.

There is no single path for those who have been defined so singularly, who become the best at something, famously, and then walk away from it in their prime. When most top athletes retire, the discussion is in the past tense, an assessment of accomplishments and legacies.

For Moore, this is about what she wants, not what she did. It is about the eternal, universal search for something more — more challenges, more unknowns, more meaning.

“I’m excited to see what else there is, outside the jersey,” Moore said.

Few have explained it so thoughtfully, so rawly, on their way out. Surfing as a metaphor for life is obvious and apt. Nothing is static. Position yourself for the best wave, but know that there will always be another. Be patient. Be decisive. Be bold.

“My favorite rides, the greatest thrills have come when I’ve paddled over the ledge even though my heart or my head is telling me not to, you know?” she said.

“The anxiety comes from ‘am I going to show up?’ I just want to be proud of myself. I want, at the end of the day,

to be like, ‘OK, I did my best. And I rose to the occasion.’

You know?”

Has that been an issue?

“My whole life — my whole life,” she said. “It’s something I have to work at every day, looking in the mirror and being, like, ‘You’re good enough, Riss. I’m so proud of you. And you can do this. You can do the things that you dream of.’ I think it’s the beauty and the beast of me, because it guides me to keep pushing and going for more, but at the same point, I struggle with just internal peace sometimes.”

She caught herself. “Not sometimes. All the time.”

She plans to compete in two major events this year on two of the world’s fiercest waves. The first is the World Surf League’s season-opening event at Banzai Pipeline, on Oahu’s North Shore in Hawaii, starting Jan. 29. Moore is the reigning champion, and she will surf in front of close friends and family.

The other is the Paris Olympics, where surfing will be held in Tahiti, at Teahupo’o, in July.

In both places, women have competed only sparingly, largely because the waves were considered too challenging. The two waves scare Moore. That is the point.

“When I’m in these positions, at these waves, am I going to go?” she said. “When I’m at the peak, and it’s my turn, and I have to face that fear, am I going to run away from it or am I going to embrace it? Am I going to trust myself? Am I going to trust my ability? Am I going to lean into it? Am I going to go?”

Sometimes it can be hard to know if she is talking about waves or life. Or both.

A child star Moore was in a car, driving toward the big waves on Oahu’s North Shore, as she explained her decision.

She has known it for a year, but has kept it from all but her closest confidants until now.

“I don’t like the word retirement,” she said. “I like to say a departure from the tour, or just stepping back, or switching gears, or, like, evolving.”

She stopped there. “Evolving.” That feels right. “Retirement” evokes leaving something; “evolving” means growing.

She was a child star in surfing, famous in Hawaii since she was little. Her parents, Chris and Carol, divorced when Carissa was in grade school. Her father guided her surfing career. She dominated youth competitions. At 16, she was on the cover of Surfer magazine.

At 18, she was a world champion.

She was also struggling with body-image issues and an eating disorder — and talking about them, with a nudge from her father.

“He encouraged me to own my story,” she said.

“He encouraged me to say, ‘Hey, I’m struggling. You see this but there’s so much else going on.’ And I’m a work in progress. We’re all a work in progress.”

From page 27 Since joining the championship tour in 2010, Moore has finished the season outside the top three only once. She has won five world titles, the last in 2021, when she also won the gold medal at the Tokyo Olympics.

“I felt really, really content, really satisfied with everything I achieved, and I was starting to ask the questions: What more do I want? What more do I need here?” she said. “I’ve kind of exceeded my expectations. When I was a little girl, I really only dreamed of that first world title. I didn’t dream about five or being in the Olympics, you know? So it’s actually been a bit harder for me to find the motivation to keep going the last couple of years.”

Still, she led the tour championship standings in both 2022 and 2023 until the last day, losing head-tohead championship matches. It was a new format that the league introduced to build excitement. It likely kept Moore from being a seven-time champion and winning four in a row on her way out.

“I would have loved to have won a world title and then dropped the mic and walked away,” she said. “I would have loved the fairy tale ending.”

Moore arrived at Pipeline. The waves were pumping, and she excused herself.

“I’m human — I don’t have everything figured out,” she said. “I’m flowing and feeling and learning as I go. I’m following my heart. And the unknown is freaking scary. But I’m also excited. There is no such thing as the end until you’re in the ground.”

And then she was gone, into the ocean.

‘It was hard to give myself that praise’ It can be a cliché, a public-relations volley, an accomplished athlete starting a foundation. But it can also signal an internal reversal, a private acknowledgment that championship success can come with diminishing returns. Most famous athletes do not like to admit it.

Moore started Moore Aloha in 2018 when she was in the mental and motivational doldrums, coming off her worst season and searching for meaning. Six years later, Moore Aloha may be a post-career landing pad.

It is about “wellness, mindfulness and friendship” through events and workshops.

Each month, Moore Aloha solicits essays through a prompt. The current one: “Think about the most prominent challenge ahead of you in 2024 and how you plan to embrace it.” The best essay will be rewarded with $200.

The prompts sometimes serve as two-way therapy.

“One of the essays was for them to write a letter of love to themselves,” Moore said. “And I was really struggling. I was in Australia. I was looking at myself in the mirror every day, just picking myself apart and just — just sad at myself.”

She wrote an essay. She put herself in the position of the girls she was trying to motivate.

“It was really, really difficult,” Moore said. “It was really difficult to be, like, hey, you have great arms — they’re great for hugging people. And you have a smile that brightens your room. It was hard. It was hard to give myself that praise. I don’t know why I struggle with it. But I think I’m trying to find those things that are just real and truthful, the things that people can’t take away.”

Stepping away from the structure of an international surfing tour probably means receiving less direct adoration or affirmation. The sports world is filled with famous champions who struggled to find purpose or capture what they left behind in their youth.

Moore and Untermann were walking their two dogs recently in Honolulu, when Untermann wondered aloud about Moore returning to competition after having children. Moore is open to the idea, not knowing how she will feel in the years ahead.

She named Serena Williams, Ashleigh Barty and Allyson Felix, who all stepped away at the top of their sports to start families, as inspirations. A closer connection might be to Kimi Werner, a free diver who grew up on Maui. She is also a champion spearfisher, a chef, an

environmentalist and public speaker.

“One of her overarching themes is being authentic, and following your authentic journey,” Moore said.

“It often turns out better than you could have ever imagined and brings you more opportunities and success than you would have had if you kept staying in one space.”

In October, after her disappointing second-place finish and the missed opportunity to “drop the mic,” Moore kept her plans secret from all but those closest to her. She held an event for Moore Aloha in Hawaii, talking to girls about goals and fears and being vulnerable. Moore wants to give permission for all of that, in a world where it is not always encouraged.

“I had three or four girls come up and cry to me, in tears, saying ‘I really needed this day. I had no idea you were going through the same things that I’m going through,’” Moore said.

She added: “If that’s what comes of this, to help someone else know that they’re not alone — oh my, gosh, that’s the biggest success. That helps them know that they can keep going, that they can face their fears or they can overcome and create a life that they envision for themselves. That’s the dream, really.”

Soon, Moore was back on her surfboard, at Pipeline, wondering what the next wave would bring and whether she had the courage to catch it.
