he Financial Oversight and Management Board (FOMB) said that while the Puerto Rico Electric Power Authority’s (PREPA) debt adjustment plan would preempt some laws, it would not impede the transition to renewable energy or preempt the rate-setting authority of the Puerto Rico Energy Bureau (PREB), the island’s energy regulator.

The Plan of Adjustment to reduce more than $10 billion of total asserted claims against PREPA by about 80% identifies certain laws, rules and regulations preempted by the Puerto Rico Oversight, Management and Economic Stability Act (PROMESA), the oversight board said in a statement Tuesday.

“Preemption does not mean those laws, rules, or regulations would be entirely invalidated or changed,” the oversight board said. “Preemption means that to the extent certain laws, rules, and regulations of the Commonwealth of Puerto Rico, or portions thereof, are inconsistent with PREPA’s obligations under the debt restructuring, and thus inconsistent with PROMESA, the Plan shall prevail. The preemption is limited to what is sufficient for implementation of the Plan of Adjustment.”

The oversight board said the debt adjustment plan does not nullify Act 17-2019, does not impede the transition of PREPA’s power generation to renewable energy sources as defined by Act 17, and does not seek to preempt the rate-setting authority of the PREB. The plan calls for a legacy charge or fee that would be added to customers’ bills to pay bondholders.

“The plan specifically states that PREB must approve the Legacy Charge in accordance with Act 17,” the oversight board said. “Under existing Puerto Rico law PREPA’s electricity rates must be sufficient to allow PREPA to meet its obligations, including the significantly reduced debt payments,” Certain provisions of Act 101-2020 are preempted to the extent that they subject PREPA’s issuance of bonds under the plan to the approval of entities other than the oversight board as the representative of PREPA in the proceedings under Title III of PROMESA. Certain provisions of Act 4-2016 are preempted to the extent that they are related to restructuring agreements between PREPA and certain creditors before PREPA filed for proceedings under Title III of PROMESA. Similarly, certain provisions of Act 106-2017 are preempted to the extent that they affect PREPA’s retire-

ment system. Under the debt adjustment plan, PREPA will provide funding to pay retirees all pension benefits earned through the plan’s effective date, and active employees will be moved into defined contribution accounts. PREPA’s defined benefit pension system will be frozen and cost of living adjustments will be eliminated.

“The plan is a significant win for the people of Puerto Rico, reducing the principal and interest payments to financial creditors from about $20 billion under their asserted claim, to about $5 billion,” the oversight board said. “Puerto Rico’s energy system cannot fully improve with PREPA in bankruptcy. The plan provides a path to end PREPA’s bankruptcy. PREPA will remain a sustainable utility, continue critical investments, and complete the transformation of Puerto Rico’ energy system to provide reliable energy and support Puerto Rico’s economic growth and fiscal stability.”

Lawmaker demands probe into possible misuse of CARES Act funds

given to tourism-related entities that did not qualify for the emergency funds.

The lawmaker raised the alarm about the finding, emphasizing that the action could have resulted from government corruption.

“This matter must reach its final consequences and that the protagonists, both of the Tourism Company and the Disbursement Supervision Committee, and the recipients of these benefits acquired illegally, be prosecuted and forced to return up [the funds] to the last cent,” Rivera Madera said. “The governor must do the right thing, establish responsibilities, and not become complicit with his silence.”

The acts, committed in 2020, arose after former governor Wanda Vázquez Garced created the Disbursement Supervision Committee, a group charged with establishing strict controls to ensure that all expenses and disbursements met the requirements and conditions established in the CARES Act. The commonwealth comptroller report shows that some $1.9 million were made to three individuals and six entities, whose identities were not revealed. The alleged payments are equivalent to 12% of the funds allocated to the program.

The group was chaired by Fiscal Agency and Financial Advisory Authority Executive Director Omar Marrero Díaz, who chaired the group, according to the report; then-Treasury Secretary Francisco Parés Alicea; and top officials at the Office of Management and Budget.

“At a time when Puerto Rico’s recovery after natural disasters had not yet begun, the possibility that those close to the government have illegally benefited is a reprehensible act and another example of the government’s inefficiency in granting and supervising recovery funding,” the lawmaker said.

Rivera Madera said he would give special priority to the allegations and that he hoped that both the governor and his team would be accountable to the public for what “clearly constitutes the commission of a crime due to corruption.”

Marrero Díaz in a statement clarified several of the points expressed in the report, which he said was not shared with the AAFAF for comments prior to its publication, as is customary.

Specifically, the report, approved on Jan. 25 with notification provided to the AAFAF on Feb. 2 by the Office of the Comptroller of Puerto Rico, seeks to verify whether federal funds for the tourism industry in Puerto Rico were distributed in accordance with the Program Guidelines for the Assistance of the Tourism Industry (Guides).

The process established by the Disbursement Supervision Committee set the criteria for the entities to receive funds, Marrero Díaz said. After the Puerto Rico Tourism Company confirmed the eligible entities under its jurisdiction, each eligible organization had to apply through the SURI platform, accepting the terms and conditions of the Guides and also certifying that they met the requirements

established for the emergency grant. Once the disbursement was approved, the contracts were signed by the parties.

“The Report in question speaks of ‘contracts,’ when in reality they are transfer agreements or Transfer Agreements,” the AAFAF chief indicated. “The Transfer Agreement referred to is a document in which the recipient entity agrees to comply with all the terms and conditions of the federal grant.”

The supervision committee believed that the transfer agreements did not have to be registered in the comptroller’s office, he added.

“It should be noted that, during the emergency caused by the COVID-19 pandemic, the priority and public policy established was to expedite the disbursements of funds to impact the citizens and the country’s economy positively,” Marrero Díaz said. “In this way, we sought to quickly mitigate the adverse effect that the closure orders caused on Puerto Rican companies.”

“The Committee was an administrator of the funds,” the head of AAFAF noted.

“Once the funds reached the recipient or beneficiaries, they entered into contractual relationships with different suppliers and others to meet their different needs. The purpose of the document, the transfer agreement, is to expressly establish the primary compliance responsibility of the person who received the funds, not through a contractual relationship, but as an acceptance that they must comply with regulatory requirements.”

CPAs to offer workshop on fraud next week

n view of data that points to an increase in acts of fraud, as well as the diversity of such act at both the private sector and government levels, the Certified Public Accountants Association of Puerto Rico (CCPA by its Spanish initials), at its headquarters in Hato Rey next Tuesday, Feb. 13, will host a conference where tools will be provided to accountants and auditors, as well as managerial leaders and administrative personnel, so that they can prevent and identify corruption in businesses, agencies and corporations, among other places.

“In recent years, cases of fraud and embezzlement have shaken Puerto Rico and

the entire world, with an adverse impact on finances, credibility and reputation,” CCPA President Edmy A. Rivera Colón said. “With artificial intelligence and technology on the rise, these acts are becoming easier to perpetrate. In this conference we will present a survey that will help accountants, administrators and managers to prevent potential cases of fraud and, just as important, identify those illegal acts in their operations.”

The conference is titled “Fraud Dresses Up for Real. How to Deal with It?” and is the second part of a conference offered last December, Rivera Colón noted.

Among the specific topics at the forum, which will be held from 9 a.m. to 1 p.m., are money laundering, tax fraud; and the

defense of suspicious employees. It will also present the anatomy of a scam, how it works, the identification of vulnerable groups, social engineering tactics, manipulation techniques, psychological tricks of employees, the emotional impact on victims and a survey of outstanding cases in recent times.

The conference will feature experts from various areas in the field, including staff from the Treasury Department, and José G. de Córdova Figueroa and Rolando López Rivera, both of whom are CPAs and attorneys. They will be joined by Osvaldo Carlo, founder of Carlo Law Office; Jorge Andújar Rosado, and U.S. Special Agents Pedro J. Ruiz and Peter López.

Measures filed to end judicial discretion for monitoring devices in some domestic violence cases, increase judges’ salaries

ov. Pedro Pierluisi Urrutia announced on Tuesday the filing of three legislative measures to eliminate the discretion of judges in some instances of the Domestic Violence Law, and to increase the salaries of judges.

Administration Bill 104 amends several articles of Law 54 of Aug. 15, 1989, as amended, and Law 99-2009, as amended, known as the Law to Create the Domestic Violence Surveillance, Protection and Prevention Program, to establish that the court will not have discretion in imposing electronic ankle bracelets in cases related to bail (awaiting trial) in cases of abuse, aggravated abuse, abuse through restriction of liberty and spousal sexual assault.

The bill also includes the most recent judicial order to the effect that appeal hearings -- in cases of domestic violence -- are scheduled for a date that will not exceed three working days and establishes the obligation that the Pretrial Service Program (PSAJ) clearly establish the exclusion zones in its report, which are the places to which the person whose freedom of movement is restricted due to being under electronic supervision cannot go.

González Colón: Gov’t still lacks a defined plan to address electricity crisis

esident Commissioner Jenniffer González Colón on Tuesday once again attacked the governing administration of her New Progressive Party (NPP) for, in her opinion, letting the plan to address Puerto Rico’s energy situation drift.

González Colón said that, in addition to the issue of energy costs, which will finally be clarified in federal court with the Puerto Rico Electric Power Authority (PREPA) debt adjustment plan, it is not known what has been done, if anything, regarding energy generation.

“The reality is that no upgrades are being made to any plant,” said the resident commissioner, who is seeking to become the NPP candidate for governor in this year’s elections, at a press conference. “You saw that a week ago, what was announced was that FEMA [the Federal Emergency Management Agency] is going to pay for the generators of the San Juan plants that burn fuel, so we are running again with generators as if we were in a hurricane after six years. And we have not made a single ‘upgrade’ to any of the plants.”

The resident commissioner wants to meet with the executives of LUMA Energy, the private operator of the electricity transmission and distribution system; Genera PR, the generation assets manager; and PREPA. “We have not converted any [plants] to natural gas, we have not used new technologies, we have not built a new plant and that is where my questions are directed,” she said.

Resident Commissioner Jenniffer González Colón “We can’t wait. These processes take longer than the permit process. How much longer does Puerto Rico have to wait to remodel or upgrade plants that are from 1970 and 1960 or the ’80s? [Until] we have a massive blackout? That people

have to get used to living in Puerto Rico with blackouts twice a week in Guaynabo, Ponce or the rest of the towns? That is not acceptable to me.”

“People in Puerto Rico pay the most expensive electricity [rates] in the entire United States and yet we do not have it on a constant basis,” González Colón added. “We are not certain that we will have it and it is not clean energy and I agree that we use renewable energy. Puerto Rico has to diversify its basket to make them, which is constant, safe and obviously economical as well. I do not see the Government of Puerto Rico making proposals or moving in that direction.”

The resident commissioner was invited as a speaker at the third edition of the annual conference of the Puerto Rico Pharmaceutical Manufacturing Summit 2024, held at the La Concha hotel in Condado.

In her message, she emphasized the importance of electrical service reliability for the industry.

“While in other jurisdictions the manufacturing industry pays between 6 and 8 cents per kilowatt-hour, in Puerto Rico it is between 25 and 30 cents … not including any increase that will be approved as part of the bankruptcy or the fiscal adjustment that is promised would be [in place] for the month of March,” González Colón said. “These do have an impact, not just on residents. This has an impact on small and medium-sized merchants, but it will also have an incremental impact on the industrial phase because they are the most likely to be taxed and that, in my opinion, has not yet been studied.”

Fiscal board overrules Legislature, approves funds for cruise ship P3

he Financial Oversight and Management Board (FOMB) overruled the Puerto Rico Legislature earlier this week and approved a budget resolution appropriating $350 million to fund a settlement agreement between the Puerto Rico Ports Authority (PRPA) and the Puerto Rico Government Development Bank Debt Recovery Authority (DRA), paving the way for a cruise ship port public-private partnership.

Last week, the island Senate rejected a House concurrent resolution appropriating $353 million to fund the debt and other transportation needs. Using its powers under the Puerto Rico Oversight, Management and Economic Stability Act (PROMESA), the oversight board approved the budget resolution on Monday afternoon.

“Governor Pedro R. Pierluisi submitted a proposed budget resolution to the FOMB on January 16, 2024, to include the appropriation, but one chamber of the Legislative Assembly failed to adopt a compliant budget resolution,” the oversight board said in a statement. “Every delay results in additional costs and postponement of the capital improvement plans.”

Therefore, pursuant to Section 202(d)(2) of PROMESA, the oversight board developed and certified a budget resolution

compliant with the Fiscal Plan for Puerto Rico.

The board said the concession agreement signed in 2022 between the Puerto Rico Public-Private Partnerships Authority and a Global Ports Holding PLC subsidiary for the repair, improvement, operation and maintenance of the San Juan Bay Cruise Terminals stipulates that the PRPA must deliver the pier assets to the concessionaire “free and clear” of liens.

“The financial closing of the concession agreement has been extended several times,” the oversight board noted. “Further delays pose a real risk to the settlement and the improvement project overall, as well as Puerto Rico’s reputation as an investment destination.”

On Jan. 11, the oversight board informed the government that it had approved the proposed transaction to settle six legacy credit facilities owned by PRPA to DRA, as successor in interest to the Government Development Bank. The proposed settlement is critical to complete the development of the cruise terminals, which aims to transform Puerto Rico into the Caribbean’s main cruise ship destination by modernizing and expanding nine docks in San Juan.

Online enrollment for 2024-25 public school year opens next week

ducation Secretary Yanira Raíces Vega announced Tuesday that on Feb. 14 the online enrollment process for the next school year 2024-2025 will begin.

“My call to parents and guardians is to complete the Online Enrollment application process as soon as possible,” the Education secretary said in a written statement. “This gives Education Secretary Yanira Raíces Vega us a clearer picture for the identification of the

resources needed for the start of school. We have metrics, but it is imperative to know the number of students who will be part of the public system for the next school year.”

Online registration begins next Wednesday and ends on March 14. The process is the same as it has been for the past few years and will allow parents and guardians to request transportation services for students. Those interested should access mimatricula.dde.pr.

Parents will be able to select the three

schools of their choice and will need to complete the required documents. To complete the process, the applicant must have their access account available or, in the case of being a new student, register by creating a user profile.

In the case of students who want to take courses at specialized schools, Montessori, occupational and technical schools, or for the Special Education Program, parents/guardians will need to contact the school for specific requirements.

$12 million invested in public housing upgrades in northwest & west

ublic Housing Administrator Alejandro Salgado Colón announced Tuesday that, with an approximate allocation of $12 million, repair work will be carried out at the Alturas, Guarionex and Manuel Román Adames housing complexes in Isabela, Mayagüez and Camuy, respectively.

The official said in a written statement that “the allocation, from funds from the Federal Emergency Management Agency (FEMA) and the Post-Disaster Community

Economic Development and Revitalization Program, is to perform roof sealing and exterior painting work on residential buildings and administrative offices, among other upgrades.”

For the Alturas de Isabela residential complex, which has 104 units, $5.2 million was allocated. Besides the roof coating and painting, reconstruction work also will include the repair of an indoor basketball court and a playground.

The Guarionex residential complex in Mayagüez has 100 units and will see an investment of $3.8 million.

For the 64-unit Adames Housing Project in Camuy,

$3.1 million was allocated. Along with the roof sealing and exterior painting, a community center and basketball court will undergo repairs.

Work will begin in the coming weeks and will last around nine months, Salgado Colón indicated.

Central Office for Recovery, Reconstruction and Resilience (COR3) Executive Director Manuel Laboy Rivera, meanwhile, reaffirmed his office’s commitment, noting that the reconstruction projects in the northwestern and western regions of the island received advances from the Working Capital Advance pilot program of some $4 million.

Trump couldn’t shut down the border. Can Biden?

resident Joe Biden is pleading with Congress for new authority to shut down the nation’s overwhelmed southern border, declaring that he has done “all I can do” and urging lawmakers to “give me the power” to fix it.

“We don’t have enough agents. We don’t have enough folks. We don’t have enough judges,” Biden said Monday.

“Why won’t they give me the help?”

A Senate bill introduced over the weekend tries to do just that. But it is fiercely opposed by House Republicans, who insist the president has simply failed to wield the power over immigration that he already has.

Who’s right?

Although it is true that there are some steps Biden could take without Congress, the idea that he has unfettered power to seal the country off is far too simplistic. The United States also has laws that require the government to consider asylum claims from people fleeing persecution. Any attempts to circumvent that would almost certainly face legal challenges.

The proposed legislation would clear away legal, practical and financial roadblocks to stiffer enforcement at the border that both parties say they want.

Veterans of decades of political and policy debates over immigration said the bill would give Biden explicit new authority to deny asylum claims, expel people from the country more quickly and keep track of migrants while they are in the United States.

It would also provide the resources that Biden has been asking for over the past three years, including thousands of new Border Patrol agents, asylum screeners and immigration judges.

“The idea that the president could accomplish most or all of this through executive authority is just flatly wrong,” said Ben Johnson, executive director of the American Immigration Lawyers Association. “By every measure, constructive solutions using executive authority alone just don’t exist in this particular moment.”

The biggest change in the bill would require the government to declare an immigration emergency if the average number of migrants exceeded 5,000 over the course of a week or 8,500 on any given day.

Once that emergency is declared, the government would be barred from considering asylum claims from people who cross into the United States between official ports of entry.

Most would be quickly turned back across the border into Mexico.

House Speaker Mike Johnson and other Republican critics of the Senate bill say it is unnecessary because of a long-standing section of immigration law known as 212(f), which says that presidents can suspend, by proclamation, immigration for anyone they determine would be “detrimental to the interests of the United States.”

Donald Trump used that authority to impose a Muslim travel ban during his presidency.

On Monday, Johnson declared the bill “DEAD on arrival” in the House and said Biden had refused to use “his

But immigration lawyers said courts had ruled that the government’s power under 212(f) must be balanced against other immigration laws, including the legal requirement to consider asylum for anyone who asks for it.

Without specific legislation like the Senate bill, they said, Biden’s attempts to shut down asylum consideration could quickly be mired in court challenges.

Biden could also try to use a different immigration provision, known as Title 42, that allowed Trump to declare a public health emergency at the border during the COVID-19 pandemic. But Biden lifted Title 42 after the pandemic receded, and the legal pathway for using it again would be uncertain without an ongoing public health crisis.

During Trump’s tenure, his administration repeatedly sought to reduce the number of people granted asylum by reducing resources and changing the interpretation of existing asylum laws. But the Senate bill would create an entirely new review process for those seeking asylum, and would for the first time write tougher standards into immigration law.

Under the new system, asylum officers would be required to determine whether there was a “reasonable possibility” that migrants would face persecution in their home country, rather than just a “significant possibility.” Supporters of the bill in both parties said that change would make it far more likely that an asylum claim was rejected and the person expelled.

Immigration experts said Biden probably could have taken some steps without the legislation. For example, the bill dramatically expands the number of migrants who are made to wear ankle bracelets while their immigration case is processed. Biden could have done that without the legislation.

The bill also requires that children 13 and younger who are detained at the border are provided lawyers. That is a change the administration could have made at any time.

But all of those changes require money. Biden had originally requested $14 billion in border funding that would have helped to pay for those kinds of programs, but Republicans rejected the request out of hand. Several immigration advocates said approval of nearly $20 billion in the Senate legislation would help pay for programs that the government could not afford without it.

Biden threatens to veto bill that would help Israel but not Ukraine

resident Joe Biden earlier this week vowed to veto a House Republican bill that would provide $17.6 billion in aid to Israel, calling it a “cynical political maneuver” intended to hurt the chances of passage for broader legislation that would provide money for Israel, Ukraine, Taiwan and the U.S. border.

House Republicans fiercely oppose the larger bill, which was unveiled by a small, bipartisan group of senators over the weekend. It calls for $118.3 billion in spending and would overhaul some of the nation’s immigration laws to deal with recent surges of migrants at the southern border.

Speaker Mike Johnson on Saturday said Republicans would instead offer the Israelonly funding bill instead.

In its official response Monday, the Biden administration said the president would veto the House bill if it came to his desk.

American synagogues, mosques and vulnerable places of worship, and denies humanitarian assistance to Palestinian civilians, the majority of whom are women and children,” the White House’s Office of Management and Budget said in a statement.

Johnson called Biden’s veto threat an “act of betrayal” toward Israel.

“Israel is at war, fighting for its very right to exist, while our brave men and women in uniform are in harm’s way on his orders to deter Iran,” Johnson said. “In threatening to veto aid to Israel and to our military forces, President Biden is abandoning our ally in its time of greatest need. I urge friends of Israel and opponents of Iran to call the president’s bluff and pass this clean aid package.”

If neither bill passes, Biden will be forced to find a new approach to supporting Israel’s war against Hamas, the armed group in the Gaza Strip that launched a terrorist attack inside Israel on Oct. 7 that killed about 1,200 people.

Israel has traditionally been one of the largest recipients of foreign aid from the United States, and support for that aid has generally been supported by majorities in both parties.

Nikki Haley, facing rising threats, requests Secret Service protection

ikki Haley, who has been the target of at least two hoax calls that have sent the authorities rushing to her home, has applied for Secret Service protection as the number of threats against her has increased, a campaign spokesperson confirmed Monday.

After losses in Iowa and New Hampshire, Haley, a former governor of South Carolina and a United Nations ambassador under former President Donald Trump, is now his only rival left in the race for the Republican presidential nomination. The two have been clashing fiercely on the campaign trail and are headed into a heated primary in her home state on Feb. 24.

Trump’s supporters have been known to attack his political opponents with racist messages, death threats and “swatting” calls, or fake reports of emergencies at their homes.

But officials with Haley’s campaign would not release any more information about the number or kinds of threats she has received.

Haley could also be a target because of her work in Iran as a U.N. ambassador.

In an interview with The Wall Street Journal, which first reported the move, Haley said only that her team had seen “multiple issues.” “It’s not going to stop me from doing what I need to do,” she said.

Presidential candidates typically receive Secret Service protection around the time they win their party’s nomination. In 2007, Barack Obama, then a senator, was assigned protection nine months before voting began in the primaries.

Haley has increased security at her events in recent weeks. In South Carolina, reports filed with the Charleston County Sheriff’s Office show that deputies have responded to at least two bogus reports at her home on Kiawah Island since December.

In the first, near 2:40 p.m. on Dec. 30, a caller told authorities that he had shot his girlfriend dead inside the house, that there were children at the location and that he was threatening to harm himself, according to the

incident report. Deputies said they showed their weapons when they arrived on the scene and told the three people inside to raise their hands. They soon discovered the call to be a hoax and the people inside to be Haley’s parents and a caretaker.

In the second episode, near 1 p.m. on Jan. 1, a caller claimed to have shot her daughter at the home and that she was “lying in a pool of blood,” but authorities recognized the address and held off on sending multiple units, according to the report.

Haley called the experiences “traumatic” on the popular radio show “The Breakfast Club,” in speaking with the hosts, Charlamagne Tha God and DJ Envy. She was not home at the time, she said, adding that authorities burst into the home after they spotted her mother, Raj Randhawa, and her father, Ajit Randhawa, through a window.

“We take care of my parents. They’re 87 and 90,” she said. “And when you have 25 people show up with guns drawn to them — what’s happened to our country, c’mon. I

mean, we can’t keep living like this. It’s not normal. It’s not healthy.”

The details took weeks to emerge and have been part of a series of high-profile “swatting” attempts targeting politicians and government buildings in late December and early January. State capitols in Connecticut, Georgia, Hawaii, Kentucky, Michigan, Minnesota, Mississippi and Montana have been evacuated or placed on lockdown after receiving bomb threats that authorities later described as false and nonspecific. Other prominent Republicans have also been swatted, including Rep. Marjorie Taylor Greene, a right-wing provocateur and Trump ally from Georgia.

The episodes have added to a heightened climate of intimidation and violence since Trump and his allies first fueled lies and conspiracy theories that the 2020 election was stolen. In October 2022, Paul Pelosi, the husband of former Speaker Nancy Pelosi, was gravely injured when an intruder entered their home and attacked him with a hammer.

Federal appeals court rejects Trump’s claim of absolute immunity

A

federal appeals court on Tuesday rejected former President Donald Trump’s claim that he was immune to charges of plotting to subvert the results of the 2020 election, ruling that he must go to trial on a criminal indictment accusing him of seeking to overturn his loss to President Joe Biden.

The unanimous ruling by a three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit handed Trump a significant defeat, but was unlikely to be the final word on his claims of executive immunity. Trump, who is on a path to locking up the Republican presidential nomination, is expected to continue his appeal to the Supreme Court.

Still, the panel’s 57-page ruling signaled an important moment in U.S. jurisprudence, answering a question that had never been addressed by an appeals court: Can former presidents escape being held accountable by the criminal justice system for things they did while in office?

The question is novel because no former president until Trump had been indicted, so there was never an opportunity for a defendant to make — and courts to consider — the sweeping claim of executive immunity that he put forward.

The panel, composed of two judges appointed by Democrats and one Republican appointee, said in its decision that despite the privileges of the office he once held, Trump was subject to federal criminal law like any other American.

“For the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant,” the panel wrote. “But any executive immunity that may have protected him while he served as president no longer protects him against this prosecution.”

A spokesperson for Jack Smith, the special counsel who brought the case against Trump, declined to comment on the decision.

Steven Cheung, a spokesperson for Trump’s campaign, said the former president “respectfully disagrees” with the court’s decision and would appeal it.

“If immunity is not granted to a president, every future president who leaves office will be immediately indicted by the opposing party,” Cheung said. “Without complete immunity, a president of the United States would not be able to properly function.”

The panel’s ruling came nearly a month after it heard arguments on the immunity issue from Trump’s legal team and from prosecutors working for Smith. While the decision was quick by the standards of a normal appeal, what happens next will be arguably more important in determining not only when a trial on the election subversion charges will take place, but also on the timing of Trump’s three other criminal trials.

In addition to the federal indictment charging him with seeking to overturn his election loss in 2020, he faces similar charges brought by a district attorney in Georgia.

Smith, the special counsel appointed to oversee the federal prosecutions, has also brought a case in Florida accusing Trump of mishandling highly sensitive classified documents

after leaving office and obstructing efforts to retrieve them.

And in New York City, Trump faces trial on charges related to hush-money payments to a porn actor during the 2016 campaign.

The scheduling of the three other trials depends in part on the timing of the federal election case.

In a significant part of their decision about presidential immunity, the three appellate judges circumscribed Trump’s ability to use further appeals to waste more time and delay the election case from going to trial — a strategy the former president has pursued since the indictment against him was filed in August in U.S. District Court in Washington.

The panel said, for instance, that if Trump appeals its decision to the Supreme Court, the underlying case, which was put on hold by the trial judge in December, would remain suspended until the justices decided to hear the case themselves and issued their own order freezing the proceedings.

But the panel imposed a rule designed to discourage Trump from making an intermediate challenge to the full court of appeals. It said that if Trump took that route, the underlying case would not remain on hold as the full court mulled whether to hear the case and issued its own order pausing it.

If the question does reach the Supreme Court, the justices will first have to decide whether to accept the case or to reject it and allow the appeals court’s ruling against

Trump to stand. If they decline to hear the issue, the case will be sent directly back to the trial judge, Tanya Chutkan, who scrapped her initial March 4 date for the trial last week, but has otherwise shown every sign of wanting to move the charges toward trial as quickly as possible.

If, however, the Supreme Court does accept the case, the crucial question will become how quickly the justices act in asking for briefs and in scheduling arguments. Should they move rapidly to hear the case and issue a decision, there remains the chance that a trial on the election charges will occur before the general election in November.

But if the justices take their time, it is possible a trial could be put off until after the election. And were that to happen and Trump were to win, he would be in a position to ask his Justice Department to dismiss the case or even seek to pardon himself.

Even though Trump put three of the justices on the bench, the Supreme Court has not shown much of an appetite for wading into issues related to his efforts to tinker with the mechanics of U.S. democracy.

But the court could end up considering Trump’s immunity challenge and on Thursday is scheduled to hear arguments about another momentous question related to the former president: whether he can be disqualified from the ballot for having engaged in an act of insurrection by encouraging his supporters to storm the Capitol on Jan. 6, 2021.

What business leaders are saying about the Red Sea attacks

The attacks in the Red Sea, which handles about 12% of global trade, have forced companies to make tough decisions.

ecent attacks on commercial ships in the Red Sea by the Iranian-backed Houthi militia have forced companies to pay higher insurance rates or reroute goods around Africa, adding costs and delays that could put a dent in companies’ profit margins and, ultimately, push up prices for consumers.

Many executives whose companies ship goods through the Red Sea and Suez Canal have said the effect so far has been limited, in part because of lessons they learned from the more severe, worldwide supply chain disruptions during the worst of the COVID pandemic.

“Moving forward, disruption will hit companies,” said David Simchi-Levi, a professor at the Massachusetts Institute of Technology. “Today it is the Red Sea, tomorrow it will be something else.”

Going through the Red Sea would mean risking an airborne strike, and paying more for insurance. Avoiding the route adds costly delays.

Maritime freight prices have soared since mid-December, more than tripling on the Asia-to-Europe route and more than doubling between Asia and the East Coast of the United States, according to the analytics firm Xeneta.

For now, analysts expect the effect on consumers to remain limited. Shipping makes up a small portion of a product’s total cost, analysts at Goldman Sachs noted. They estimate that the disruptions will add only one-tenth of a percentage point to the global inflation rate this year.

Still, it’s a concern for analysts and investors, who have raised questions on earnings calls with company executives.

Here’s what business leaders have been saying.

European companies will feel it first The Red Sea is a particularly important route for companies moving goods from Asia to Europe. Those goods now cost more to ship and take longer to arrive.

It could also affect manufacturing in the region. The disruptions caused Tesla and Volvo to suspend production in Europe. Automakers rely on just-in-time production, in which parts arrive at an assembly line shortly before they are needed, which leaves little room for shipping delays.

— Doc Martens The British shoemaker’s CEO, Kenny Wilson, said it faced

major delays in Europe, but felt almost no effect in Asia or in the United States. Businesses in Britain were hit hardest by shipping delays in January, according to S&P Global.

“There is obviously a cost implication to that,” Wilson told analysts on an earnings call on Jan. 24. “And then I think, really, it’s more about what would be the impact next year if this were to continue.”

— Bang & Olufsen Nikolaj Wendelboe, chief financial officer of the Danish audio equipment company, told analysts on a Jan. 10 call that the company was shifting some shipping to air or rail.

“There will be a slight cost increase and some longer lead times, but it is nothing compared to what we saw during the COVID crisis, at least not what we see at this point in time,” Wendelboe said.

— Logitech Chuck Boynton, chief financial officer of Logitech, a Swiss maker of computer keyboards, mouses and other accessories, said the company would be shipping more of its products made in Asia by air instead of by sea. While that is more expensive and could eat into profits, it’s better than running low on inventory, he said.

“We will eat some margin to take care of customer satisfaction,” Boynton told analysts on Jan. 23.

American companies are less exposed Goods imported to the United States don’t rely as much on crossing the Red Sea. Still, U.S. companies and consumers are subject to the general rise in global shipping rates.

Not all industries are affected equally. Analysts at Bank of America said retailers were particularly exposed, with companies like Target and Dollar Tree facing a higher risk of a hit to profits than their main competitors because they get more of their products from Asia. Those retailers have not yet reported their quarterly earnings, but other consumer-focused companies have discussed the effect to their bottom line.

— Amazon Brian T. Olsavsky, Amazon’s chief financial officer, said the disruptions had not yet had a “material impact” on the ecommerce giant’s forecast for profit in the current quarter.

“We’re vigilant on that and we’ll work to take steps where we need to, to make sure that customer experience is not impacted,” he said.

— 1-800-Flowers Bill Shea, chief financial officer of 1-800-Flowers, said the company wouldn’t start to feel the effects unless the disruptions continued into the summer.

“The bigger unknown is how long the issues in the Red Sea persist and whether that affects future negotiations and next year’s holiday season,” Shea told analysts on Thursday.

— Ethan Allen Farooq Kathwari, CEO of Ethan Allen Interiors, told analysts that the furniture manufacturer was not as exposed to the turmoil as others because most of its products were made in North America.

“But if we had most of our products coming through from offshore, it would be an issue,” he said on a Jan. 24 earnings call.

US stock buyback plans picking up in earnings season, EPFR says

.S. stock buybacks are picking up, with corporate announcements this earnings season trending above the prior two quarters and above the average of the past 12 earnings periods, according to EPFR. Companies have announced an average of $6.9 billion worth of buybacks daily through the first three weeks of the fourth-quarter reporting season, according to EPFR Liquidity Offerings, which tracks buyback announcements from companies listed on U.S. exchanges.

That is the highest amount at this stage in an earnings season since the $8.2 billion daily average from the first-quarter 2023 reporting period, while it is also above the $6.5 billion daily average of the past 12 periods.

The volume of buyback announcements is showing “signs of life,” EPFR said in a note.

Goldman Sachs and other strategists have projected a rebound in buybacks this year after a down 2023, which can help support the stock market in 2024.

Meta Platforms last week announced a $50 billion increase in its stock repurchase authorization, as the Facebook owner also initiated a quarterly dividend. Other recent buyback announcements include $1 billion repurchase plans from each of Altria Group, DuPont and Corteva.

Private equity firm KKR & Co Inc said on Tuesday its fourth-quarter distributable earnings rose 4%, buoyed by strong growth in income from asset sales in addition to management and transaction fees.

After-tax distributable earnings, which represents the cash used to pay shareholder dividends, rose to $888.5 million from $851.9 million a year earlier. That resulted in distributable earnings per share of $1, which was higher than the mean Wall Street analyst estimate of 91 cents, according to LSEG data.

KKR said its net profit from asset sales surged 85% to $359.6 million during the quarter, with divestments across its private equity and infrastructure portfolios.

Fee-related earnings jumped 21% to $675.4 million, driven by higher management fee income and stronger revenue from transaction fees that KKR generates mainly by arranging financing for its own deals.

KKR’s private equity funds gained 3% in the fourth quarter, infrastructure funds were up 5%, while leveraged credit funds rose 3%. The value of its opportunistic real estate portfolio, however, fell 1%.

Blackstone Inc, the world’s largest private equity firm, also reported a 4% rise in its distributable earnings last week, as well as a 3.5% gain in the value of its corporate private equity funds and a 3.8% decline in its opportunistic real estate portfolio.

KKR’s net income under generally accepted accounting principles (GAAP) soared to $1 billion, up from $121.1 million a year earlier, driven by investment income from its asset management business.

KKR raised $31 billion of new capital, made investments worth $16 billion, retained nearly $100 billion of unspent capital, and had $553 billion of total assets under management. It

declared a dividend of 16.5 cents per share.

JPMorgan Chase said on Tuesday it was embarking on one of its most aggressive bank branch expansions in recent years, with plans to add more than 500 new U.S. locations by 2027 to broaden its footprint in areas where it is under-represented.

The multi-billion dollar investment will see it open new branches in places including Boston, Charlotte, the area surrounding Washington D.C., Minneapolis and Philadelphia, the bank said.

It did not specify the exact amount of the investment.

JPMorgan’s aggressive expansion strategy comes as some other lenders have been shrinking their presence. The number of active branches in the U.S. totaled 77,690 after 123 closures and 80 openings in the month of October, according to S&P Global Market Intelligence.

JPMorgan had the largest network at the end of 2023 with 4,897 branches. Rival Bank of America, which has also been adding new branches, had 3,845 at the end of December.

Buoyed by resilient consumers while bringing in more income from clients’ interest payments as the Federal Reserve raised borrowing costs, JPMorgan made a record annual profit in 2023.

More than a fifth of hostages in Gaza are dead, Israel finds

ore than one-fifth of the remaining hostages being held in the Gaza Strip are dead, according to an internal assessment conducted by the Israeli military.

Israeli intelligence officers have concluded that at least 32 of the remaining 136 hostages captured by Hamas and its allies Oct. 7 have died since the start of the war, according to a confidential assessment that was reviewed by The New York Times. The families of 32 hostages, whose deaths are confirmed, have been informed, according to four military officials who spoke anonymously in order to discuss a sensitive matter.

The four officials said that officers were also assessing unconfirmed intelligence that indicated that at least 20 other hostages may have also been killed.

The figure of 32 is higher than any previous number Israeli authorities have publicly disclosed of hostages who are dead.

In an answer to a request for comment, the Israeli military said that most of the dead were killed on Oct. 7.

The news is likely to worsen a furor

More than 240 hostages were captured

by Hamas and its allies during the Oct. 7 Hamas-led raid on southern Israel, prompt-

ing Israel to retaliate with massive airstrikes and then a ground invasion.

Roughly half of the hostages have been freed, almost all during a temporary truce in November, when they were exchanged for 240 Palestinian prisoners and detainees held in Israeli jails.

Since that truce, the Israeli government has said that its military operations in Gaza would pave the way to further hostage releases. Officials have argued that every Israeli military success places Hamas under more pressure to negotiate another exchange, and makes the military better able to rescue the remaining captives by force.

But scores of survivors and families of the hostages have said that the military campaign is endangering their loved ones’ lives.

They want the government to make it a priority to reach a new hostage deal instead of pressing ahead with the invasion, lest their relatives be killed in crossfire. Only one hostage has been freed by an Israeli military rescue operation. At least three were accidentally killed by Israeli soldiers.

Amnesty International accuses Israeli military of killing Palestinians in West Bank

mnesty International said Monday that Israeli forces were killing Palestinians in the West Bank with “near total impunity” as the world’s attention focused on the Gaza Strip, demanding in a new report that the International Criminal Court step up its investigation into Israel’s conduct in the Israeli-occupied area.

In the West Bank, Israeli forces have used live fire to disperse Palestinian protests, attacked people trying to help the injured and carried out deadly arrest raids that have spread fear throughout Palestinian communities, Amnesty International said in its report. It said the Israeli forces’ actions add to the country’s “well-documented track record of using excessive and often lethal force to stifle dissent and enforce its system of apartheid against Palestinians.”

The human rights organization said that Israel’s use of unlawful force in the West Bank had sharply escalated since Oct. 7, when a Hamas-led attack from Gaza killed more than 1,200 people in Israel, according to Israeli authorities. Israel’s retaliatory campaign has killed more than 27,000 Palestinians in Gaza, according to health officials there.

The Israeli military has described its actions in the

West Bank as counterterrorism efforts necessary to prevent further attacks. Israel has strongly denied prior accusations that it has committed the crime of apartheid.

Israeli military operations have raised alarms from several human rights groups, including the United Nations human rights office, which called in December for Israel to “end unlawful killings” of Palestinians in the West Bank and to immediately stop the use of “military weapons and means during law enforcement operations.”

Since Oct. 7, Israeli forces in the West Bank have killed at least 360 Palestinians and injured 4,270, the United Nations Office for the Coordination of Humanitarian Affairs said Sunday. Last year was the deadliest for Palestinians in the West Bank since the office began recording casualties in 2005, and about 70% of those killings were reported during Israeli military operations, OCHA has said.

Amnesty’s report detailed its investigations into four incidents that it said were emblematic of the recent escalation, and renewed its call for the prosecutor of the International Criminal Court, Karim Khan, to take action.

In 2021, the ICC opened an investigation into allegations of war crimes committed by Israel and Palestinian militant groups in Israeli-occupied areas, but many Palestinian groups have criticized the pace and focus of the inquiry.

Amnesty’s director for global research and policy, Erika Guevara-Rosas, called for Khan to investigate the killings in the West Bank as possible war crimes, saying in the report that “an international justice system worth its salt must step in.”

Among the incidents investigated by Amnesty was an Israeli raid that began Oct. 19 and lasted more than 24 hours in Nur Shams, an area that originated decades ago as a refugee camp for Palestinians displaced in the wars surrounding the founding of Israel. Israeli forces killed 13 Palestinians during the raid, including six children, according to Amnesty and Wafa, the official Palestinian news agency.

One of those killed during the raid, Amnesty said, was Taha Mahamid, an unarmed 15-year-old shot by Israeli forces when he peeked out of his house to see if they had left the area. His father was shot and seriously injured when he went to retrieve Taha’s body, and the family’s home was raided by Israeli forces about 12 hours later, Amnesty said.

One of Taha’s sisters told Amnesty investigators that her brother was shot in the leg, then in his stomach, then in his eye.

“They did not give him a chance,” the human rights group quoted her as saying. “In an instant, my brother was eliminated.”

Tragedy, resilience and a miracle at Chile’s burned botanical garden

riday afternoon, several hundred people were roaming the idyllic grounds of Chile’s national botanical garden, mostly unaware that, just across some hills and a highway, a raging wildfire was galloping toward them.

The danger quickly became clear.

Rangers began racing around the park on motorbikes, shouting for visitors to flee to the exits. But by the time many got there, the fire had already arrived.

“Thick black smoke was billowing above us, so we laid down on the grass just inside the gate,” Alejandro Peirano, the park’s director, recalled Monday morning.

“One of my rangers turned to me and said, ‘Director, are we going to die?’ ” Elsewhere, three other rangers were trying to rescue a colleague, Patricia Araya, 60, a greenhouse keeper who lived in the park and was caring for her two grandsons and 92-year-old mother. They reached her cabin’s gate, but the fire was closing in. “I could feel the heat searing my back. I realized it was burning chunks of bark falling on me,” Freddy Sánchez, 50, said Monday, standing guard at the park entrance.

“We had to turn around,” he said. “All your body wants is to find a way out of the heat.”

The crowd that huddled on the front lawn survived — a miracle of sorts, given that 98% of the nearly 1,000-acre garden was destroyed.

Araya, her mother and two grandsons did not, becoming four of the 122 confirmed deaths in one of the deadliest wildfire outbreaks in modern history.

Monday, authorities with cadaver dogs continued the search for bodies across the nearly 40 square miles scorched by Friday’s fast-moving wildfires in Valparaíso province, a popular resort area near Chile’s central coast.

They also took stock of the broader destruction, including some 15,000 homes and one of Chile’s national gems: the 107-year-old National Botanical Garden of Viña del Mar. The botanical garden, stretching across 1.5 square miles, is one of the world’s largest, and is also a crucial conservation and research center for the region. Over decades, staff have built and studied a diverse

Because of Chile’s isolated geography, sandwiched between the Andes Mountains and the Pacific Ocean, the country is home to many endemic plant species, meaning they do not appear elsewhere in the wild.

The garden was instrumental in the preservation of those species, including many rare cactuses. It has also had medicinal plants, exotic plants from Europe and Asia, a large collection of species from the remote Juan Fernández Islands in the Pacific, and some of the world’s last known Sophora toromiro trees, which are native to Rapa Nui, or Easter Island, but are now extinct in the wild.

“It’s a horrible loss. Years and years of research that lots of people have done in that garden, growing special collections,” said Noelia Alvarez de Roman, the Latin America specialist at Botanic Gardens Conservation International, a global network of botanical gardens.

Peirano said the park had been damaged by fires in the past, including in 2013 and 2022, with about a quarter of the grounds burned. “We’re used to it. We patrol the most sensitive areas every day, we clean the areas and educate people,” he said.

“But this fire was completely unexpected,” he added. “We’ve never seen anything on this scale.”

Peirano stressed that the lives lost were far more devastating than the physi-

cal damage. Araya had worked in the park for about 40 years, and this week, she and her longtime partner had planned to hold a new marriage ceremony and then go on vacation together, Peirano said in a television interview.

She had already taken Friday off from work, and her grandsons, aged 1 and 9, came to stay with her earlier that day, he said.

Authorities reiterated Monday that they believed the fires were sparked intentionally.

Rodrigo Mundaca, the governor of Valparaíso province, told reporters that authorities had determined at least one major fire began about 2 p.m. Friday in four different spots, just a few meters from each other.

“Does it seem to me that this could be spontaneous, natural? No,” he said, adding that national forest workers had put out intentionally set fires a day prior. “Therefore, today, I say there’s a clear intention here and we hope that the authorities can find those responsible.”

Two people were arrested Sunday on suspicion of attempting to start fires near the botanical garden, but they were later released because the police said they did not have enough evidence. Authorities said they would keep nighttime curfews in place as they continued their investigation and recovery from the fires.

High temperatures and dry conditions before the fires made for dangerous conditions in Chile. The cyclical climate phenomenon known as El Nino has contributed to heat and drought across parts of South

America, and global climate change has also broadly pushed temperatures higher.

Strong winds Friday caused fires to spread quickly, surprising authorities and leaving many people trapped trying to escape hillside settlements. By Monday, firefighters had largely contained the blaze.

At the botanical garden, smoke from the burned eucalyptus forests still hung in the air, while workers carved fallen trees with chain saws and helicopters carrying enormous buckets of water flew overhead.

Peirano was clearly saddened, calling the charred gardens behind him “a treasure for Chileans,” but he also was resolute that the forest would regrow.

“The native plants will flourish again, but we will need rains to come, and we won’t get those until May,” he said. He added that some of the garden’s exotic species also survived the inferno, much like the historic 150-year-old banyan tree in Lahaina, Hawaii, which began sprouting leaves just weeks after a wildfire destroyed much of the city.

Some of the surviving plants included a few of the nearly extinct Sophora toromiro trees, as well as Ginkgo biloba trees from the park’s “Garden of Peace,” which is made up of plants that survived the atomic bomb in Hiroshima, Japan.

“They had the strength to sprout after Hiroshima,” he said in a television interview Monday. “Now they will have double the strength if they overcome this stage, because the fire passed through them. The trees and what they represent will be twice as strong.”

El Salvador’s president claims election victory in a landslide

ayib Bukele, the millennial president who reshaped his country by cracking down on both gangs and civil liberties, claimed a resounding victory in El Salvador’s election Sunday that would extend his dominion over every lever of government for years.

Official results had not been announced as of midday Tuesday, but polls had telegraphed Bukele’s landslide win for weeks, showing that voters were almost certain to hand him another five-year term and extend his party’s supermajority in the legislature.

Delivering a speech to thousands of supporters who gathered in the central square of San Salvador, the capital, Sunday night, the president claimed that he won more than 85% of the vote and that his New Ideas party had captured almost every seat in the legislature, brushing aside concerns about repressive practices and the deterioration of democratic norms under his watch.

“This will be the first time where one party rules a country in a completely democratic system,” Bukele told the crowd. “The entire opposition has been pulverized.”

Problems with the recording of the vote count stalled the transmission of preliminary results Sunday night, and by Monday morning polling stations had switched to recording the votes by hand, the electoral authority said. The website with the preliminary results showed that with 70% of the ballots processed, Bukele had 83% of the vote.

On Monday afternoon, the electoral authority said that about 30% of the presidential election ballots and every single legislative ballot would be recounted “to maintain the integrity of the electoral results.”

Legal scholars say Bukele violated the El Salvador Constitution by seeking a second consecutive term, but voters made it clear they supported him anyway.

Since imposing a state of emergency in the spring of 2022, the Bukele government has arrested tens of thousands of people with no due process, filled the streets with soldiers and suspended key civil liberties. But the gangs that once ruled over much of the country have been decimated — making the 42-year-old leader enormously popular.

“The majority of Salvadorans are in agreement that Bukele should stay,” said David Lobato, 38, outside a polling station in San Salvador, the capital. “He’s turned the country around. Things are different now.”

The five opposition candidates for president gained almost no traction in the polls.

On Monday, U.S. Secretary of State Antony Blinken congratulated Bukele in a post on the social media platform X, formerly known as Twitter. “We look forward to continuing to prioritize good governance, inclusive economic prosperity, fair trial guarantees, and human rights in El Salvador,” he said.

Ricardo Zuniga, a former special envoy to Central America for the Biden administration, said Bukele’s decision to seek a second term was “a demonstration of power.”

“They want to show that they can do this,” he said. “They want to show they have popular backing for doing it — and they want everyone to just live with it, regardless of the constitution.”

Critics said they worried that the vote Sunday would only embolden Bukele to deepen his attacks on the media, civic groups and anyone else he views as posing a threat to his control.

Bukele’s vice-presidential running mate, Félix Ulloa, recently told The New York Times that they were “eliminating” a broken democratic system that had benefited corrupt politicians and left tens of thousands of dead.

“To these people who say democracy is being dismantled, my answer is yes — we are not

dismantling it, we are eliminating it, we are replacing it with something new,” Ulloa said.

On Sunday, at a news conference, Bukele said, “We are not replacing democracy, because El Salvador has never had democracy,” adding, “this is the first time in history that El Salvador has democracy.”

The main selling point of Bukele’s campaign was the state of emergency his government has imposed for nearly two years, since the gangs that had long dominated the streets went on a killing spree in March 2022.

Since then, the authorities have arrested roughly 75,000 people, including 7,000 who were eventually released and thousands more who are not gang members but remain jailed, human rights groups say. They have documented reports of prisoners being tortured and deprived of food.

But El Salvador’s transformation has been undeniable. The three biggest gangs that made the country one of the most violent places on Earth appear to have lost any semblance of power.

“The main pillar on which he has built his popular backing is what the government has done on security,” said Omar Serrano, vice chancellor for social outreach at José Simeón Cañas Central American University. “The state of emergency is what people value most.”

Bukele, a descendant of a family of Pales-

tinian migrants who arrived in Central America in the early 20th century, was one of 10 siblings and half siblings raised in Escalón, an upper-middle-class neighborhood in San Salvador. He studied at an elite, bilingual high school.

After working as a publicist on political campaigns, Bukele moved into politics in 2011 and quickly rose to prominence. At the age of 30, he became mayor of Nuevo Cuscatlan, a small town on the outskirts of San Salvador, representing the Farabundo Martí National Liberation Front, the leftist party.

Three years later, he became mayor of San Salvador, a post considered a steppingstone to the presidency.

In the lead-up to the 2019 presidential elections, Bukele created his own party, New Ideas, but ran as a candidate of a small rightwing party, GANA, to meet the legal requirements to compete. He sailed to victory on a vow to break with the corrupt politics of the past.

Once in office, though, he turned to tactics that many viewed as a return to the autocratic leadership the country had fought a 12-year civil war over, ending in 1992.

He marched soldiers into the legislative assembly to pressure lawmakers to pass government funding and later replaced an attorney general who was investigating corruption in his administration.

In 2021, after winning a supermajority in Congress, his party replaced top judges on the Supreme Court, who within months reinterpreted the constitution to allow Bukele to run again for the presidency.

There remain some sources of resistance to Bukele, especially among those who say their family members were unfairly imprisoned.

“We as citizens were obliged to come and demonstrate that there is a contingent that does not agree with the policies that are being carried out,” said Nelson Melara, 41, who voted in the capital Sunday afternoon.

“There are good things with this government, but there are also bad things that deserve many questions,” he said.

Overall, though, Bukele’s appeal has hardly wavered at home — and for a remarkable contingent of fans across the hemisphere. Politicians from Colombia to Ecuador have vowed to emulate him.

“Those from my generation think that even though power is being concentrated in one person, I feel that it would be worth it,” said 27-year-old Natalia Pérez. For the first time in a long time, she said, she can walk at night and feel safe. “We have seen actions and changes,” she said.

Immigrants make America stronger and richer

odern nations can’t — practically or politically — have open borders, which allow anyone who chooses to immigrate.

The good news is that America doesn’t have open borders, and there is no significant faction in our politics saying we should. In fact, immigrating to the United States legally is fairly difficult.

The bad news is that we’re having a hard time enforcing the rules on immigration, mainly because the relevant government agencies don’t have sufficient resources. And right now, the reason they don’t have those resources is that many Republicans in Congress, while fulminating about a border crisis, appear determined to deny the needed funding.

Their position is rooted in extraordinary political cynicism, and they aren’t even trying to hide it: Donald Trump has intervened with Republicans to block any immigration deal because he believes that chaos at the border will help his election prospects.

While blatant sabotage explains the current immigration impasse, however, there’s something else lurking behind it: Trump and those around him are profoundly hostile to immigration in general.

L CAPITOLIO – Como parte de las actividades de la celebración de los 95 años de fundación de El Capitolio, el Senado de Puerto Rico conmemoró los 72 años de la Convención Constituyente con la revelación de los audios de los delegados de 1951 a 1952.

El Capitolio fue la sede del debate de ideas de la Convención Constituyente, donde se desarrolló y aprobó la Constitución del Estado Libre Asociado de Puerto Rico para asegurar los derechos y dar forma al gobierno.

“Hoy, volveremos a escuchar en estos pasillos, después de 72 años, las voces que retumbaron en este Capitolio defendiendo los derechos humanos, garantizando representación digna a las minorías en el gobierno, una educación gratuita, salud, vivienda, trabajo y sobre todo el valor del voto que es la máxima expresión de la democracia en nuestro país”, sostuvo el presidente del Senado, José Luis Dalmau Santiago, en un mensaje para los presentes.

Durante años, las voces de estos delegados han sido custodiadas por el Instituto de Cultura Puertorriqueña (ICP) en discos de vinil que fueron preparados y trabajados por el señor Néstor Salomón. En un acuerdo establecido entre la Asamblea Legislativa y el ICP, a través de la Oficina de Servicios Legislativos (OSL), se digitalizaron estos debates para preservar y divulgar los audios de la Convención Constituyente.

Entre los audios presentados, se destacó el momento en el que se aprobó la Constitución de Puerto Rico en las voces de los delegados Fernós Isern y Berríos Berdecia.

AN JUAN – La Corporación Pública para la Supervisión y Seguro de Cooperativas (COSSEC), publicó el Informe Estadístico Trimestral del mes de diciembre del 2023, el cual refleja la solidez del sector cooperativista, informó el martes, la presidenta ejecutiva de COSSEC, Mabel Jiménez Miranda.

“El informe del cuarto trimestre confirma lo que anticipamos y es que nuestro sector continuaría destacándose con números sólidos y con un fortaleci-

miento continuo. El sistema cooperativo se mantiene en gran medida estable en su rendimiento y es relativamente resistente frente a las situaciones económicas que en la actualidad vivimos”, indicó Jiménez Miranda en declaraciones escritas.

Explicó que, según el informe, el total de préstamos de las cooperativas de ahorro y crédito, ascendió a 7,033 millones de dólares, un aumento de 676 millones de dólares (10.63 por ciento) comparado con el año anterior. Los activos totales aumentaron un 3.24 por ciento durante el mismo periodo. Las acciones y depósitos ascienden a 10,725 millones de dólares lo que representa un aumento de0.96 por ciento con respecto al 2022. Asimismo, en el cuarto trimestre de 2023, la proporción de reserva de capital indivisible a total de activos mostró un aumento de .09 por ciento con relación al 2022.

El informe del cuarto trimestre del sistema cooperativo de ahorro y crédito ofrece una visión general de los resultados financieros de las cooperativas de ahorro y créditos aseguradas por COSSEC, basada en la información comunicada a la agencia en el cuarto trimestre de 2023. Al 31 de diciembre de 2023 en Puerto Rico operan 96 cooperativas de ahorro y crédito aseguradas por COSSEC y un total de 1,143,067 de socios.

The ballet roots of a Broadway star

also started going to the Palladium Ballroom, the midtown dance hall, for its Latin Nights.

Soon she was, as she writes, “out on the dance floor fusing my ballet training with the salsa, mambo and rumba steps I was learning.”

Students at the school didn’t aspire to Broadway: “We turned up our noses,” she wrote. But when word spread that Collins was making her Broadway debut in a show staged

by Agnes de Mille, Rivera’s mind started to shift.

While she was drawn in another direction, her ballet training never left her body. It made her one of the most refined dancers in musical theater: A 1962 appearance on “The Ed Sullivan Show” demonstrates not just the expressive agility of her flickering legs (and her flickering is extraordinary), but also a fullbodied commitment to moving through a step rather than pausing in a position.

There’s nothing static about Rivera as a dancer, but she doesn’t blur any edges either.

Her finesse comes in the gracious way she shows every angle of her body, the attention to épaulement — the carriage of the arms and shoulders — all the while taking up space.

Dancing big and with intention. Air doesn’t escape her; she chases it down. You can hear Balanchine’s famous dictum in her body: “What are you saving it for?”

It wasn’t just ballet training that set Rivera apart. Plenty of dancers have that. It was where she was trained. Rivera danced as if she knew that now was all there is — another Balanchine saying — a way of being that remained with her for her entire career. Her body may have left the ballet world, but ballet never left her body. She saved nothing.

hita Rivera grew up to be a Broadway queen, but you can’t leave out that she was a ballet kid. Her training began after a botched jump at her family home in Washington, D.C. Rivera — still Dolores Conchita Figueroa del Rivero at the time — landed on the coffee table. It shattered.

Her energy needed to be more than merely contained; it needed to find a release. It was her mother’s idea that the release might come in the form of dance, specifically ballet. She took Rivera to the Jones-Haywood School of Ballet, where she was introduced to Doris Jones, the esteemed teacher who became like a second mother. Jones, she wrote in her memoir, changed her life. “Are you willing to work hard, Dolores?” Rivera recounted Jones asking her at that meeting. “Harder than you’ve ever worked before?”

She was. And she did. Rivera, who died Tuesday at 91, always considered herself more a dancer than a musical-theater star. (She even called her 2005 musical revue “Chita Rivera: The Dancer’s Life.”) “The natural inclination of dancers is to keep to themselves,” she wrote.

“It’s the work that matters.”

And a dancer is never satisfied. Broadway may be where Rivera flourished, but her foundational home was ballet. She and another Jones-Haywood student, Louis Johnson — who went on to have a spectacular career as a choreographer and dancer — were taken to New York for an audition at the School of American Ballet. They both got scholarships.

The School of American Ballet, formed

by George Balanchine and Lincoln Kirstein in 1934, is the training ground of New York City Ballet.

Rivera didn’t know it at the time, but the man auditioning her was Balanchine himself. “Something about the instructor made me want to please him,” she wrote.

At first joining City Ballet was her dream, but that changed when she became aware of Janet Collins, then the only Black teacher at School of American Ballet.

Tight on time? How to make the most of a short workout.

hen it comes to exercise, there’s a difference between what’s ideal and what’s, well, possible.

Maybe in a perfect world, you’d devote an hour a day to fitness, a finely tuned program of strength training and cardio. In the real world, it can be difficult. That’s OK, experts say: Even shorter bouts of exercise can have health benefits.

“There are certainly ‘optimal’ ways to train,” said Barb Puzanovova, a Nashville, Tennessee-based personal trainer and behavior change specialist, “but you can see increased mobility, better sleep, better strength and increased bone density with shorter, simpler workouts.”

Here’s how to make the most of your exercise time — even if you only have 15, 20 or 30 minutes.

Focus on strength training.

Jessie Mundell, a fitness trainer in Ontario, said she prioritizes resistance training when time is short. “Strength training is so effective at elevating the heart rate, and then bringing it down a bit during rest periods, and then back up again,” she said.

A 2021 analysis of 45 studies on resistance circuit-based training found that it improved not only muscle mass and strength but also several important markers of cardio-respiratory fitness, especially among people who were new to it.

Hit the major movement patterns.

“Working through movements you do in everyday life gives you better spatial awareness, coordination and overall strength to reduce your chance of getting hurt,” said Joe Holder, a personal trainer in New York. (If you are pregnant or have an injury or other condition, check with your doctor about which exercises are safest.)

— Squatting Squat exercises involve bending at the hips, knees and ankles, and can strengthen your quadriceps, glutes and lots of small stabilizing muscles around the working joints. They help you with an essential daily activity: sitting down and standing back up. Examples include traditional squats (using weights or just your body weight), wider-stance sumo squats and lunges (forward, reverse and lateral).

A kettlebell swing, a strength-training exercise that can double as cardio when performed for high reps,. Combining resistance training and cardio will get your heart pumping fast, even if you only have 15 or 20 minutes to spare, fitness experts say. They can help strengthen your back, your rotator cuffs and even your grip. If your goal is to move through the day with less back pain, Holder said, pulling exercises are key.

into three pairs. For example: — Superset 1: Squats and pushups — Superset 2: Glute bridges and single-arm rows — Superset 3: Wood chops and bird dogs Do each exercise for 45 seconds to one minute, or for eight to 12 reps. Do the second exercise in the superset immediately after the first to keep your heart rate elevated, then take a short break before repeating the superset or proceeding to the next one. Try to complete at least two rounds of each superset.

Warm up first and stretch after — if you want.

Puzanovova said it’s a good idea to fit in a short warm-up beforehand to increase your heart rate and prepare for some of the more challenging movements. Consider three to five minutes of marching or jogging in place to raise your heart rate, shoulder and hip circles to warm up your joints, and body-weight squats and lunges to get ready for your weight workout.

But “if the warm-up is a barrier mentally or time-wise, just get into the workout right away and take that first round of the superset at a lighter weight,” Mundell said.

If you love to stretch after you exercise, go ahead, she added. “But you can also skip it, and just let good enough be good enough on that day.”

After a couple of weeks, take stock of how your body is feeling: Are you less stiff?

Is it a little easier to lift an object onto a high shelf? Are you noticing improvements in your sleep, stress or energy levels? You’re on the right track, Puzanovova said.

Suspiro a la limeña, a Peruvian dessert to leave you thunderstruck

he origin story of one of Peru’s most popular desserts is almost as romantic as its name — suspiro a la limeña, or “the sigh of a lady from Lima.”

More than a century ago, the story goes, the wife of poet José Gálvez Barrenechea made him a custard similar to dulce de leche and topped it with meringue. He loved the dish so much that he gave it its evocative name.

It refers to the sound you might make “if your teenage heartthrob walks by, and you sigh,” said Charles Walker, a history professor at the University of California, Davis. “It’s a thunderbolt strike of love.”

The dessert, also known as suspiro de limeña, is considered by many the poet’s way of showing his deep admiration for the capital of Peru; it is now a staple on restaurant menus and for home cooks. It’s made with a can each of evaporated and sweetened condensed milk, and the meringue is flavored with red port.

“It’s an exquisite dessert that could become a guilty pleasure because it’s so rich,” said Martin Allen Morales, a cookbook author and the former owner and chef of several Peruvian restaurants in Britain, including Ceviche in London. The dish most likely has international influences, including from the Moors, North Africans and Italians, he said. “It’s so seductive in terms of the aromas it carries.”

But the details of this dessert’s origins get lost in countless retellings. The first reference to the story was published in a 1994 Peruvian cookbook, “El Perú y Sus Manjares,” said Rosario Olivas Weston, a Peruvian food historian. The book was a compilation of recipes from the author’s family and friends, who included the famous poet and his wife.

Pastry chef Rocio Pereira was a teenager in Lima when she started experimenting with the dessert, adding more egg yolks to tone down the sweetness. In 2009, she met the owner of a Miami restaurant group and started selling suspiro a la limeña for its restaurants. She has since upgraded from her home kitchen to a commercial operation, where she makes about 400 cups of suspiro a la limeña daily for the group and other restaurants in the area. Before serving, she said, the dessert is topped with fresh meringue.

“The suspiro is our flagship dessert,” Pereira said in Spanish. She also prepares pickup orders through her Miami bakery, Delizzia.

At his Kousine restaurants in Boca Raton and Fort Lauderdale, Florida, the chef and co-owner, Danny Kou, likes to add other flavors to the suspiro with fruits such as passion fruit. He even once added chicha morada reduction, a Peruvian drink made with purple corn, to the meringue.

“It’s a dessert I learned to make at home,” Kou said, “and it brings back good memories of standing on a chair to reach the kitchen counter and make the suspiro with my grandmother.”

Suspiro a la limeña (caramel pudding with port meringue) Recipe from Gastón Acurio Adapted by Christina Morales Suspiro a la limeña, sometimes called suspiro de limeña, is one of Peru’s most popular desserts. The dessert may have originated in Lima, Peru, more than 100 years ago. According to lore, the wife of José Gálvez Barrenechea, a Peruvian poet, made him a custard dessert topped with fresh meringue that was spiked with port. The story goes that he loved the dessert so much that he decided to name it “suspiro a la limeña,” which translates loosely to the sigh of a lady from Lima. This recipe, adapted from “Peru: The Cookbook” (Phaidon, 2015) by Gastón Acurio, a renowned Peruvian chef who opened restaurants such as La Mar and Tanta, uses evaporated and condensed milks to make a sweet base that’s reminiscent of dulce de leche.

The dessert takes some patience, but the results are sublime.

Yield: 6 to 8 servings Total time: 1 hour 10 minutes Ingredients: 1 (12-ounce) can evaporated milk 1 (14-ounce) can sweetened condensed milk 8 large egg yolks, plus 2 egg whites 1 tablespoon vanilla extract 1/2 cup plus 2 tablespoons cup/120 grams granulated sugar 1 cup/250 milliliters red port Ground cinnamon, to garnish Preparation: 1. Pour the evaporated milk and condensed milk into a medium heavy saucepan over low heat. Cook, stirring frequently with a flexible spatula, until the mixture has thickened to the texture of the condensed milk, darkened and the bottom of the pan can be seen when you draw your spatula across it, about 30 minutes. Remove from the heat.

2. Add the egg yolks and vanilla extract to a medium bowl; whisk to combine. Whisking as you go, slowly add a steady stream of the hot milk mixture until combined. Divide among 6 to 8 dessert glasses; refrigerate until needed. (The custard base can be refrigerated for up to 4 days before serving, but the meringue topping is best prepared just before eating.)

3. Place the sugar and port in a small pan over medium heat and cook, without stirring, until liquid reduces by about half and a syrup forms, about 15 minutes.

4. Meanwhile, whisk the egg whites in a bowl until stiff and tripled in volume; they’ll get foamy then start to look shiny and creamy. Drizzle the port syrup into the egg whites in a thin stream, beating all the while, until the inside base of the bowl is no longer warm to the touch.

5. Top the chilled custard with the port-infused egg whites. Dust with ground cinnamon to finish.

Will Taylor Swift cry if Kansas City loses? You can bet on it.

he Super Bowl always draws crowds to betting windows and online sportsbooks, but some of the most talked about action this year will leave a blank space in Las Vegas.

With in-person sportsbooks limited to action on the field, Adam Burns, the sportsbook manager for BetOnline.ag, found himself capitalizing on the moment by preparing odds for a flood of unusual wagers: What sort of outfit will Taylor Swift wear to the game on Sunday? Will the CBS broadcast show her holding a beverage or giving high-fives? Will she cry if the Kansas City Chiefs lose to the San Francisco 49ers?

For some much-needed assistance, Burns turned to a reliable source: his teenage daughter.

“Friends are like, ‘Come on over and watch the game with us,’” Burns said in a telephone interview from his home in Montreal. “I can’t. I have to watch Taylor Swift.

You can ask me the next day who won the game, and I won’t even know. But I’ll know how many times Taylor Swift was shown on TV.” Swift, who won two Grammys on Sunday night and announced the release date for her next album, was a phenomenon long before she started dating Travis Kelce, Kansas City’s star tight end. But her regular appearances at his team’s games this season — clad in red, celebrating Kelce’s touchdowns, and even sharing a luxury box with his bare-chested, beer-swilling brother — have produced crossover magic with the NFL. BetOnline.ag, which is based in Panama,

has so many Swift-related Super Bowl prop bets — 89, a reference to her album “1989” — that Burns had to plumb the depths of the absurd, including: What shade of lipstick will Swift choose for the game? (Red, a signature color for Swift, is favored, followed by “any other color.”)

Bet U.S., an online casino based in Costa Rica, also has a smorgasbord of Swift-related bets.

“If it’s something that’s going to attract some attention and we can make legitimate odds on it, there’s a good chance that we’re going to do it,” said Tim Williams, the director of public affairs for Bet U.S. He added: “We expect to see as much interest, if not more interest, in all of these Taylor Swift bets compared to bets related to the halftime show, and that’s really unprecedented.”

The Swift-related bets will almost entirely be online because most sportsbooks, including those in Nevada, are required by their local gaming commissions to limit sports wagering to what happens on the field of play: receptions, rushing yards, interceptions.

“Anything that can be found in a box score,” said Jeff Benson, the director of operations for Circa Sports, a Las Vegas sportsbook.

That means novelty bets are out. No betting on the number of backup dancers during Usher’s halftime show. No betting on the length of the national anthem. And no betting on Swift’s choice of game day attire, assuming she makes the trip to Las Vegas from Tokyo. Of course, none of that has prevented people from trying to place the bets in person.

“I wanted to put an over/under on how

many times we’re asked about them,” said Jay Kornegay, the executive vice president of race and sports operations at Westgate Resorts. “Customers and even some of our own executives are unaware we can’t do them. So we have to tell them, and they’re like, ‘Oh, really? That’s too bad.’”

A few casinos have gotten creative. One has a wager called “Shake It Off,” which involves betting on a player to score a touchdown after fumbling earlier in the game. But that is about as far as Las Vegas can go, since novelty bets are difficult to regulate. Some people, for example, will be apprised of Swift’s plans ahead of time and could conceivably make wagers. Gambling sites that do offer novelty belts tend to guard against bad actors by setting low limits — $100 to $250 in most cases.

“It’s more for fun,” Burns said. “We’re not trying to make a buck off this. Honestly, we’ll probably lose on a lot of these because it’s a real challenge for us to keep up with this stuff. Like, I don’t know what color lipstick she’ll wear.”

Sports betting typically comes with a host of disclaimers. Don’t bet where it’s illegal.

Don’t bet more than you can afford to lose.

And, as it pertains to Swift’s involvement in Super Bowl LVIII, don’t bet without seeking input from experts.

Want to throw a few bucks on Swift wearing a championship hat if Kansas City wins?

“It depends how cute the hat is,” said Julia Bennet, the president of the Taylor Swift Society at Eckerd College in St. Petersburg, Florida.

On a video conference call last week, Bennet and three other club leaders —

Kathryn Brown, Kinsey Perkins and Mara Lytle — offered some insight. No, they don’t think Swift will cry if the Chiefs lose. (“She’s tough,” Brown said.) Yes, they think she will be in red at the game. (“I’m thinking red top, black bottoms,” Bennet said.) And no, they don’t think there will be an on-field proposal.

“If my friend married someone after six months, no matter how great they are, I would be like, ‘Are you sure?’” Bennet said.

“She’s in her 30s, and I’m a human development major, so I know your brain’s developed a little more by then. So I would trust her decision. But I still think it’s too soon for a proposal.”

While Bennet and her friends acknowledged that they were not huge football fans — Perkins said the only reason she had watched Kansas City’s victory over the Baltimore Ravens in the AFC championship game was because Swift was in attendance — they were planning to watch the Super Bowl.

“It’s really sweet to see how many Swiftie fans are bonding with their football friends,” Brown said.

NFL’s rapid embrace of gambling creates mixed signals

his week, the NFL’s players, coaches, fans and executives will gather for an event that was virtually unthinkable just 10 years ago: the Super Bowl in Las Vegas, the gambling capital of the United States.

Since the Supreme Court struck down, in 2018, a federal law that effectively banned sports betting outside Nevada — a prohibition once backed by the NFL’s commissioner, Roger Goodell — the NFL has embraced the gambling industry. It has forged partnerships reportedly worth nearly $1 billion over five years with sports betting companies, and permitted a sportsbook to operate inside one of its stadiums. Now it even has a team in Las Vegas, which the league shunned for decades because any affiliation was seen as a threat to the integrity of the game.

Yet the embedding of sports gambling so quickly into the culture of the league has resulted in jarring contradictions. The NFL is pushing to popularize and benefit from sports betting while still guarding against the potential pitfalls that it long condemned.

While the league donates money to promote responsible gambling, its broadcasts are peppered with advertisements for sports betting companies. The NFL is part of a growing apparatus that encourages casual fans to regularly place wagers on games, while punishing league employees — most notably players — who might do the same.

The NFL and other sports leagues “have moved into this area quickly, fully considering the revenue-related benefits to engagement in sports gambling, but not necessarily thinking about everything that could go wrong,” said Marc Edelman, a law professor and director of sports ethics at Baruch College in New York.

“Even if it makes complete sense to disallow employees from sports teams from betting on the games,” Edelman added, “there’s undeniably a level of cognitive dissonance” when NFL players and staff frequently come across content encouraging gambling, including signage in stadiums and betting odds on NFL telecasts, while doing their jobs.

The league’s partnerships also give gambling companies the right to use the NFL logo in their marketing and be a part of major NFL events.

The NFL says that its stance on sports betting, which is in step with the other major American sports leagues, changed with the shifting legal landscape, and that working with gambling operators allows it to better protect the game’s integrity. As with many

More than simply responding to the landscape, the NFL is helping to shape it.

Americans legally wagered more than $115 billion on sports in 2023, according to the American Gaming Association, the national trade group for the gambling industry.

Nearly 25 million more Americans bet on sports last year than in 2018, the group said, and the number of states where betting on sports is legal will reach 38 this year.

While numbers for the NFL specifically are harder to parse, because not every state reports by sport or league, the gaming association referred to a market analysis from the investment firm Citizens JMP Securities.

The report projected that about $1.5 billion would be legally wagered on next Sunday’s Super Bowl, more than 1% of the money bet legally on all sports last year.

There is scant data on whether the legalization of sports gambling has increased addictive behavior. But those who track the effects of gambling have worries. The National Council on Problem Gambling said its survey data pointed to a rising risk of gambling problems for adult Americans in the three years after the federal ban on sports betting was overturned.

Dr. Marc Potenza, a psychiatrist and director of Yale’s Center of Excellence in Gambling Research, described “a perfect storm” that could lead some people to develop a gambling problem. He cited factors including loosening regulations, the accessibility of mobile betting, heavy advertising and how much free time is spent on sports. Particularly vulnerable are young men who place high value on sports, Potenza said.
