THIS AUCTION At the John Smith’s Stadium, Stadium Way, Huddersfield, HD1 6PG. Thursday 12th October 2023, commencing at 7pm.

AUCTION NOTES

· The public are advised to time their arrival at the venue at least half an hour before the auction to secure appropriate car parking at the stadium and access to the auction room.

· The auction will commence promptly at 7.00pm and will be conducted in Lot order.

· The Auctioneers will not be able to answer questions from the rostrum once the auction has commenced. All queries to be addressed to the appropriate Auctioneer’s office before 4.00pm on the auction day and between 6.00pm – 7.00pm at the auction venue.

· A copy of the contract and supporting legal pack will be available for inspection, from the appropriate office, 7 days prior to the auction for each Lot. Copies may be available for collection, post or fax at a cost of £40 inclusive of VAT (payable in advance). Where available documents may be emailed at no charge (with the exception of documents larger than A4 size).

· Bidders are required to register with the Auctioneers upon arrival; a numbered “Bidding Card” will then be issued. Bidders are obliged to show this clearly to the Auctioneer and appropriate staff upon request. Registration facilities will be available from 6.00pm on the day of the auction.

· Completion will take place 28 days from the auction date, unless alternative arrangements have been made with the Auctioneers prior to the auction.

· Keys for vacant properties will not be released prior to the auction or until completion has taken place.

· Please remember; this is a property auction, the purchaser will be the highest bidder, subject to any reserve price set by the vendor. The fall of the hammer represents exchange of contract. The successful purchaser will be approached by a member of the Auctioneer’s staff to supply; name, address and details of their solicitor or legal representative. The successful purchaser will be required to pay a 10% deposit of the realised bid price and sign

the contract prior to leaving the venue. Cash deposits will not be accepted. Cheques should be made payable to Boultons Harrisons Ltd, the Auctioneers as Agents. Deposit cheques once cleared will be used to satisfy our invoice for selling the property. If you intend to pay the deposit by debit card please notify your Bank prior to avoid any transaction failure.

· Most Lots are subject to “block viewings”. Additional accompanied viewings may be arranged upon request.

· Purchasers are advised to insure the property at the earliest opportunity following exchange of contracts. Vendors are also advised to retain the buildings insurance, until completion has taken place.

· Illustrated catalogues should also be available at the auction. An addendum may have been prepared itemising any additional information which may have come to the Auctioneer’s attention after the catalogue has been printed.

· It is against the law to smoke in public buildings. Mobile phones should also be turned off or set on silent during the auction.

· Successful bidders will be required to pay an Auctioneer’s Administration Charge of £900 inclusive of VAT for each Lot purchased at the fall of the hammer on exchange of Contracts – cheques payable to Boultons Harrisons Ltd.

· Please note if you are an unsuccessful in bidding and wish to offer after the auction, please speak to the auctioneer only before leaving the venue.

TERMS AND CONDITIONS FOR BIDDING BY TELEPHONE OR BY PROXY

A prospective purchaser wishing to make a telephone or proxy bid (a “Bidder”) must complete, sign and date the form included in this catalogue. A separate form must be completed for each Lot on which a bid is to be placed.

The Form must be delivered to the Auctioneers’ Huddersfield Office at least 72 hours (3 days) before the start of the Auction together with the appropriate payment as mentioned below. Each form must be accompanied by an Auctioneers Administration Charge cheque for £900.00 including VAT (payable to Boultons Harrisons Ltd) together with a deposit payment of either:

a. 10% of the Bidder’s maximum bid in the case of a bid by proxy, or

b. 10% of the Auctioneers’ guide price for the property in the case of a bid by telephone. (Subject in either case to a minimum deposit of £3000.00).

The deposit payment should be made by bankers draft. If you intend to pay the deposit by debit card please notify your Bank prior to avoid any transaction failure.

Cheques will only be accepted if given to the auctioneers in sufficient time for them to clear through the banking system prior to the Auction to include special Clearance Fee of £50.00. The deposit cheque must be made payable to “Boultons Harrisons Ltd” as Agents for the Seller. The deposit will be used by the Auctioneers to satisfy their commission due upon the fall of the hammer. The balance will be paid over to the seller’s solicitor upon completion.

In the case of a proxy bid the Bidder hereby authorises the Auctioneers and their staff to bid on his behalf as his agent up to the maximum amount of the authorised proxy bid. If successful the Bidder will be notified as soon as possible. If the Bidder is successful at a figure which is less than the maximum of the authorised proxy bid the whole of the Bidder’s deposit will be used as a deposit towards the purchase price. If the Bidder is unsuccessful the full amount of the Bidder’s deposit will be refunded to the Bidder promptly after the Auction (without interest).

In the case of a telephone bid a member of the Auctioneer’s staff will attempt to contact the Bidder by telephone before the Lot in question is offered for sale. If contact is made the Bidder may compete in the Bidding through the Auctioneers’ staff. However if telephone contact cannot be made or the link breaks down the Bidder hereby authorises the Auctioneers and their staff to bid on his behalf up to mid point of the guide price for the Lot in question. If the Bidder is successful at a price which is higher than the Auctioneers’ guide price the Bidder must within 24 hours of the Auction provide the Auctioneers with the additional funds to make the amount of his deposit equal to 10% of the Purchase Price. If the Bidder is successful at a price which is less than the guide price the whole of the Bidder’s deposit will be used as a deposit towards the purchase price. If the Bidder is unsuccessful the full amount of the Bidder’s deposit will be returned to the Bidder promptly after the Auction (without interest).

If the Bidder is successful the Bidder hereby authorises the Auctioneers to sign the Memorandum of Sale on his behalf.

If the Bidder wishes to withdraw or alter his instructions or to attend the auction to bid personally it is his Responsibility to notify the Auctioneers in writing before the Auction and also to notify the Auctioneer in charge of the Auction before the Lot in question is offered for sale.

The Auctioneers will not be liable for any failure to bid due to inadequate or unclear instructions being received or for any other reason. The Auctioneers have absolute discretion as to whether or not and in what manner to bid.

The Bidder is deemed to have full knowledge of the Common Auction Conditions the General and Special Conditions of Sale and the Notice to all Prospective Buyers herein. The Bidder is also deemed to have full knowledge of any addendum produced by the Auctioneers at or prior to the Auction; the Bidder is therefore advised to check whether any relevant addendum has or will be produced, but the Auctioneers will not be liable to the Bidder if he fails to so check.

GUIDE PRICE The guide price is an indication of the seller’s current minimum acceptable price at auction. The guide price or range of guide prices is given to assist potential buyers in deciding whether or not to pursue a purchase. It is usual, but not always the case that a provisional reserve range is agreed between the seller and the auctioneer at the start of marketing. As the reserve is not fixed at this stage and can be adjusted by the seller at any time up to the day of the auction in light of interest shown during the marketing period, a guide price is issued. This guide price can be shown in the form of a minimum and maximum price range within which an acceptable sale price (reserve) would fall, or as a single price figure within 10% of which the minimum acceptable price (reserve) would fall.
