“Unwarned, unannounced and unexplained” is how Bev McArthur MP reacted to the news the changes the Andrews Government has made to the Environmental Protection laws. “This Labor Government has snuck through this change and it is hard to overstate how cavalier this approach is,” she said. The new regulations (Gazetted 1 July 2020) apply only to tunnel boring machine spoil material containing low levels of contaminants, and mirror what will be available under the new environment protection legislation that was delayed via the Omnibus bill that passed Parliament in April 2020. Currently, the West Gate Tunnel Project spoil has potential to be brought, by 230 truck movements per day, to the Maddingley Brown Coal site. A DELWP spokesperson told the Moorabool News the Environment Protection Authority was consulted throughout the development of these regulations. “The new regulations put a framework in place to appropriately manage spoil that has low levels of contamination ensuring the process is safe for the community and the environment,” they said. The EPA will consider the potential impacts on human health and the environment before spoil is permitted to be received at any facility. “We are outraged to have our basic democratic rights taken away,” a spokesperson for the Bacchus Marsh Coalition Group (BMCG) said. “We are dismayed Lily D’Ambrosio Minister for Energy, Environment and Climate Change would be the responsible Minister for this Act and, that toxic PFAS contaminated tunnel soil has also been exempted from the protections provided by the EP Act 1970 to permit the dumping of West Gate Tunnel soil,” they said. continued page 5
