Court overturns Council decision A ruling by the NSW Land and Environment Court has overturned a decision by Cobar Shire Council to refuse a development application (DA) to expand the mining camp east of Cobar. Council had originally refused the DA made by the camp’s owner, Rovest Holdings P/L, in June 2020, to extend the camp to accommodate another 20x 4-bed units (for 80 occupants) and the upgrade of associated infrastructure and minor alterations to the existing communal areas. Rovest commenced proceedings in January this year appealing to the Land and Environment Court against Council’s refusal. According to the Court documents, “The issues raised by the Council are principally that the economic and social impacts of the proposal warrant the refusal of the DA.” Council’s refusal came from a raft of negative local feedback which they received when the DA was put on public exhibition. The Court also heard evidence from two experienced town planners, including Mr D Walker, who said “there is no evidence of any significant detrimental social impacts apart from those perceived to arise from competition with other forms of accommodation within the town”. Following the court hearing on September 29, 2021, Acting Commissioner P Clay handed down his decision last week that Rovest Holdings’ appeal be upheld. Cobar Shire Council’s general manager Peter Vlatko said it was disappointing that Council’s decision has been overturned and that “the social and economic reasons we presented for the refusal were rejected.”

Looking pretty in pink
The staff at the Cobar Primary Health Care Centre are decked out in pink all this week in support of Breast Cancer Awareness Month, an annual campaign to raise awareness about the impact of breast cancer. The centre has a donation tin on the front counter for anyone who would like to donate. All of the proceeds will go to the McGrath Foundation for McGrath Breast Care Nurses who provide invaluable support and care to women and men experiencing breast cancer. From diagnosis right through treatment, these nurses are available to help individuals and their families for free and with no referral.
