Five things San Juan should know this week Hotel Capistrano Project Gets Greenlight from City Council THE LATEST: The City Council chamber erupted in cheers and applause as the Hotel Capistrano by Kimpton received its final approval from the Council Tuesday night. The Council upheld the Planning Commission’s approval of the Hotel Capistrano project with a 4-1 vote, Mayor Pam Patterson dissenting.

In July, the Planning Commission approved two hotel projects—Hotel Capistrano by Kimpton, a 102-room hotel to be constructed between the Egan House and the Esslinger Building along Camino Capistrano, and the Inn at the Mission, a 124-room hotel to be operated by Marriott International’s Autograph Collection and constructed at the corner of Ortega Highway and El Camino Real. Both approvals were appealed by the Aug. 10 deadline, so the projects had to go before the City Council for final approval.

WHAT’S NEXT: The appeal for the Inn at the Mission project will be heard by the Council at a future meeting. The hearing was continued due to a request by Dan Friess, Mission Commercial Properties principal, for more time to “regroup” and “address the issues raised by the appellants.”

City’s Annual Creek Cleanup Set for Sept. 17 THE LATEST: The city’s annual San Juan Capistrano Creek Cleanup is set for Saturday, Sept. 17 from 9 a.m. to noon.

Each year, the city hosts a cleanup for San Juan Creek and Arroyo Trabuco Creek in conjunction with California Coastal CleanUp Day. Registration starts at 8:30 a.m. at Descanso Park, located at 32400 Paseo Adelanto. Participants are encouraged to wear sturdy shoes and sunblock. Parking is available for all volunteers.

241 Toll Road Extension Proposals Reappear THE LATEST: After the Transportation Corridor Agencies (TCA), the board overseeing The Toll Roads in Orange County, was unable to extend the 241 down through Trestles and San Clemente a few years ago, a new development proposal is in the works.

During Tuesday night’s San Clemente City Council meeting, officials discussed proposals on which the TCA is working.

Two major proposals concerned Council members. One would extend the project through Avenida La Pata and connect to Avenida Pico. Another would construct a toll road around the eastern portions of San Clemente and into Cristianitos. The primary goal is to get the 241, which ends

at Ortega Highway in San Juan Capistrano, connected to the I-5 freeway.

Another alternative would extend the southernmost part of La Pata to Cristianitos.

Most of the concerns the Council had regarded the increase in traffic and construction through the rest of the city.

Councilwoman Kathy Ward brought this discussion to light, as she is the city’s liaison to the TCA. “La Pata is open. We’re hearing great comments from all our residents; even people who do not live in Talega are saying they’ve noticed a change,” Ward said.

“Some are saying it’s cut down 30 minutes on their commute.”

Ward asked Tom Bonigut, deputy director of public works, if La Pata would continue to be a road without tolls despite the extension, but he said he wasn’t sure.

The proposal has not yet been through an environmental review.

Past city councils have opposed proposals for the connection.

Additionally, the proposal to seek funding for a “double track,” another train track, through the San Clemente area to San Juan was proposed, but the Council wasn’t keen on that idea either.

The Council voted unanimously to pass a resolution to oppose the ideas to connect La Pata and Cristianitos to the 241, but did seek to explore some of the other alternatives. There were more than a dozen different ideas. The main reason the extension is highly sought by stakeholders in the area is to alleviate as much traffic as possible from the I-5 freeway.

Councilwoman Lori Donchak said she wanted to have a traffic study on how La Pata has alleviated traffic in the area.

“My hypothesis is the traffic need for the 241 extension has shrunk because La Pata is in place now,” Donchak said.

Mayor Bob Baker said there are traffic studies from 10 years ago that prove the 241 extension is a “road to nowhere.”

According to the TCA website, collecting tolls was the main revenue source until state funding was depleted and revenue bonds were sold to make up the difference.

South Coast Water District Holds Desalination Workshop to Discuss Risks THE LATEST: Directors of the South Coast Water District held a workshop with GHD,

Inc., an engineering firm, on Aug. 30 to discuss risks with the potential Doheny Desalination Plant.

According to a report, the project’s specific risks include mainly the slant wells— tubes that run from the on-shore facility, under the beach, to a point in the sea from which to collect water. Concerns for the slant well include structural integrity, longterm viability and water quality.

Mark Donovan with GHD, which is providing engineering services to the Poseidon desalination project in Carlsbad, told the district the company believed the slant well construction issues will have a low probability and that the consequence to the district is low. The mitigation strategy would be to complete the off-shore geophysics work.

“It will help pinpoint where these wells should be drilled and give us more details of how the construction will be moving forward,” Donovan said.

An environmental impact study still needs to be done on the project to assess risk to common detriments posed by desalination, include potential destruction of wildlife habitat, brine discharge and energy consumption.

CUSD Students Improve with California Smarter Balanced Assessment Results THE LATEST: Recent California Smarter Balanced Assessment result scores show student performance in Capistrano Unified School District has improved overall.

According to district officials, 69 percent of CUSD students met or exceeded the standard in English Language Arts (ELA)/Literacy and 59 percent met or exceeded the standard in math.

The Smarter Balanced Assessment system uses computer tests and performance tasks to allow students to show what they know and what they are capable of doing. The test is based off the Common Core standards for English language arts, literacy and math.

In the elementary schools, 65 percent of CUSD students met or exceeded the standards in ELA/Literacy (a 3 percent increase from last year) and 60 percent met or exceeded the standard in math (a 6 percent increase).

San Juan Capistrano Greek Festival Returns Sept. 23-25 Saint Basil Greek Orthodox Church is set to host the annual San Juan Capistrano Greek Festival on Friday, Sept. 23, Saturday, Sept. 24 and Sunday, Sept. 25. The free weekend-long event invites the public to celebrate all aspects of Greek culture and cuisine—from dancing and live Greek music to wine tasting, Greek pastries and Byzantine art.

Guests will have the opportunity to try a range of savory and sweet Greek treats, including gyros, lamb chops, souvlaki, Greek salad and pastries like baklava made with old family recipes.

Al fresco dining will be accompanied by Greek wine, beer, spirits, soft drinks and traditional Greek coffee and iced coffee frappe. A taverna will also be set up with big screen televisions, Greek music and games like tavli and backgammon.

Mulling Sober Living Homes Federal, state and local officials discuss issue of sober living homes

H

undreds gathered the evening of Thursday, Sept. 1, at the San Clemente Community Center to listen to a panel of experts and representatives discuss issues surrounding sober living homes. Some people had to stand along the walls as all available seats were filled by the start of the discussion.

U.S. Rep. Darrell Issa (R-Vista) hosted the event along with local officials. Issa is running against Democratic candidate Doug Applegate for the 49th U.S. Congressional district election this year.

“This evening is about a crisis going on not just in Orange County, but around the country,” Issa said. “We have a drug and alcohol crisis, and we have millions of people who are in need of help. That problem is not going away.”

State Sen. Patricia Bates (R-Laguna Niguel), who was a social worker before her political career, said she has dealt with sober living issues personally in her neighborhood. Both Bates and State Assemblyman Bill Brough brought legislation to their respective health committees during the 2016 session, but those bills did not make it to the floor.

“Current state and federal laws allow (sober living providers) to stay in typical households in typical neighborhoods to reenter and integrate with the larger drugfree community,” Bates said. “Sober living homes that don’t operate as intended

have become a burden for places like San Clemente.”

Bates told a couple stories where she came across patients from sober living homes who had been kicked out and had nowhere to go.

San Clemente Councilman Tim Brown said his neighborhood experienced an increase in sober living homes in the last few years.

“They had a guy come in from Chicago and he signed a lease and opened a sober living home, and it was not run really well,” Brown said during a phone interview on Tuesday. “Immediately we started having tons of problems. There was a stabbing in the home, and then last year, early in the year, there was one overdose death in the house.”

Compliance Services, he learned that another death that took place earlier this year was the operator of a sober living home.

“What ended up happening was the house was completely unsupervised with no lessee and everyone was still there getting medication and treatment,” Brown said, adding the operator was already on the verge of eviction.

Todd Leishman, an attorney with Best, Best & Krieger, which is contracted with the city of San Clemente, said the rise in the number of sober living homes can be traced back to 2000 when California passed Prop 36. This allowed people with drug-use convictions to seek probation and treatment instead of incarceration.

On top of that, the Affordable Care Act allowed insurance companies to cover more people for various ailments, including recovery.

“You’ll notice people come from all over the country to get sober here,” Leishman said. “When it comes to local regulations, there are a number of constraints.”

People in recovery are considered a protected class of citizens under the Fair Housing Act and the Americans with

Disabilities Act. Therefore, cities are not allowed to ban sober living homes outright.

“I gotta say, it’s a tricky labyrinth,” Leishman said. “Think what you will, if you’re in recovery, as a matter of law… you (are) disabled. That makes sense to a lot of us who know someone in recovery. On the state level, the health and safety code says any facility that is trying to help people that are in recovery … has to be licensed by the state. The policy concern is we have a vulnerable population and we want to make sure the services are legitimate.”

Leishman said many sober living home operators say they’re not providing services at the home; instead residents are treated at an off-site facility.

He said the law is very broad regarding the facilities that do and do not need licensure.

“There’s a big disconnect between the state law and the providers,” Leishman said. “If your (home has fewer than) six people, then you’re considered to be a single family. If you have a license for six and fewer and you’re violating the license, then it’s not as hands-off. It’s a very narrow protection.”

T. Peter Pierce of Richards, Watson & Gershon, which represents public entities throughout California, said his law firm is representing the city of Newport Beach, which currently has a case against the proliferation of unlicensed and non-compliant sober living residences. Currently the outcome of that law is in U.S. Ninth Circuit Court limbo, as the court put an injunction on the city’s law.

“There’s a kind of discrimination that courts look to, and at the time they’re occurring, you wouldn’t think they are,” Pierce said. “You may have someone who comes to a public meeting or a city councilman makes a remark against sober living homes. Under the law as it now exists, and as the Supreme Court interprets it, courts can use those comments as a basis to conclude that any regulation that is adopted after those comments are made is discriminatory.”

Jaque Saulpaw of Interfaith Community Services in San Diego County, which oversees some sober living homes, said when sober living homes are run properly, they can be successful and help people. Saulpaw said every time they open a sober living home, they check to make sure it’s amenable to the neighborhood and city officials.

“The community is as important, and that’s what I’ve been taught, and that’s how we run our business,” Saulpaw said, adding the organization is a nonprofit.

“As these individuals go through sober living … the ones who make it are productive members of society, and it’s less costly to the community.”

We asked the candidates: The city has several significant development projects in the review process, and the issue of balancing responsible development with the preservation of the city’s history and character is on the minds of many residents. What’s your vision for development in San Juan Capistrano? What do you want the city to look like?

“I think it’s important to point out that 42 percent of what’s left developable here is open space,” Banda added. “So the residents already set that standard of what we can do. Now it’s working with the property owners to make sure that it fits in with the character of the town.”

Banda said he likes the Hotel Capistrano project and was “glad the [Urban Village] project did change to what it is today.”

“If we don’t have these hotels, we’re going to be in some trouble,” he said. “We definitely want to increase public safety with those funds. The TOT is going to be a game changer.”

When asked about incoming development, Farias said “our city’s history and culture needs to be a central piece of whatever is built,” adding that developers also need to take infrastructure limitations into consideration. “You can only rezone and restripe our main arteries so much,” he said.

Farias said he believes in property rights, giving the example of the Vermeulen Ranch owners, who he said “have every right to go forward with their project.”

Continuing on the subject of property rights, Farias said: “I think we’ve been very lucky, for instance, with the Kimpton [hotel], where the property owner has really listened to the community and what their wishes are. I hope that everyone does that.”

Farias said it’s important for developers to come to public forums to “get the pulse of the community.”

“I think it shows goodwill, and it shows that they’re taking the community’s input into their projects,” Farias said.

Schneider said, however, that the city needs to compete for business. He said he is against raising taxes “in any way shape or form,” including parking meters.

“We can’t be a downtown like that, that’s not who we are,” he said.

In order to keep San Juan attractive to businesses and tourists, Schneider recommends finding a way to keep the city bikeable and walkable, while supporting small business owners—all of which would create appropriate growth for San Juan, he said.

Kramer emphasized that development “in most areas of town” should fit in with the city’s history.

“I’m very concerned that both hotels will maintain that history downtown, and I think they will, from what I’ve seen so far,” Kramer said.

Kramer would like to see a monument of some kind at “the entryway of the city as you come off onto Ortega Highway,” and would like to make the area in front of the Mission “become more walkable than it is right now.”

Kramer added that he thinks the city needs “to take another hard look at the Historical Town Center Master Plan” so that it reflects “what people truly want for the downtown.”

“What I’m gathering is that people don’t really care for that master plan,” Kramer said. “It was viewed by a lot of people, they said this is what we want, but it looks like in trying to implement it, that it’s not what people want.”

Schneider said a key to future development in the city is to keep a focus on what makes it unique, and to reinforce regulations that ensure that character.

“In the downtown district, I think we have enough regulations in place, codes and otherwise, that we are going to continue to protect the downtown area,”

Parks said he’s in favor of the two incoming hotels and developing the Vermeulen Ranch property.

“It needs to be developed; it can’t just sit and look like it does,” Parks said of the Vermeulen property.

“San Juan was an old city, but San Juan is becoming a young city,” Parks said.

“We’ve got to develop everything we’ve got for the young people. We have to build our city for the young people. We have to expand so they have something to build on and look to the future for.”

“I’m tired of the City Council holding back the city,” Parks added. “They’re destroying our city.”

Lawrence Adams says what sets her apart is her experience as a city planner for San Juan Capistrano and Laguna Niguel. In those roles, she sid she’s learned to take input from others to determine how development proceeds.

“Vision for a city isn’t what my vision is, it’s what the people that helped incorporate this city and put it on a path for its buildout set out for it to be,” Lawrence Adams said.

Lawrence Adams noted that San Juan is special for its commitment to historic preservation as well as the city’s role in keeping ridge lines preserved. Neighborhoods, history and the city’s residents should hold developers to high standards to ensure projects fit in the city.

Juan Capistrano, we have to be vicious protecters and clear communicators of that with the development community,” she said. “The minimum isn’t acceptable.”

“Naturally, San Juan Capistrano is considered the Jewel of Orange County because it’s so unique in its cultural heritage,” Mottl said. “I would want to preserve that.”

Mottl said as a Republican, she’s not for raising taxes. In order to “make sure we don’t go into a deficit,” she is in favor of “reasonable development that is within the cultural specifications of our city and that fits into the city’s unique heritage.”

“I know there have been some challenges with past lawsuits,” Mottl said. “I am an advocate of listening to our city attoreny, who knows best, so we don’t get into these lawsuits that are costing our taxpayers so much money.”

Mottl said she believes reasonable development will benefit the city overall, despite infrastructure or congestion problems along the way.

“I’m definitely hoping that we can see a benefit from the taxes from the hotels that will help our city,” Mottl said.

Maryott said the key to any development in San Juan—and “there isn’t a ton left out there to be developed,” he points out—will be a commitment to collaboration.

“I think the more collaborative we are with development from the get-go, the better,” Maryott said. “We have an outstanding Planning Commission, I’ve watched them in action, they’re terrific. I think with all our commissions, but particularly Planning, we have to put a lot of stock in what they have to say and how they feel about proposed developments.”

Maryott said he’s neither in the “pro-growth camp nor the anti-growth camp” even though he’s perceived strong factions being formed. He added that it’s important to learn from the past, and trust specialists and staff to keep future development with the scope of the general plan.

ix candidates are running for three seats on the Capistrano Unified School District’s Board of Trustees in Areas 1, 2 and 3, which cover schools in South Orange County. Each area has two candidates vying for a seat, and in Area 3, both candidates are newcomers, as incumbent John Alpay is running for a seat on the South Orange County Community College District Board of Trustees.

There is also a fourth seat up for election in Trustee Area 5, which covers schools in Aliso Viejo and Laguna Niguel.

Incumbent Gary Pritchard is running against three candidates: Jorge Velastegui, Monica Maddox and Jake Vollebregt.

The Capistrano Dispatch asked the six candidates running in Areas 1, 2 and 3 to submit a statement on who they are

and why they’re running for a seat on the CUSD Board of Trustees. Candidates’ responses are listed below in the same order that they’ll appear on the Nov. 8 general election ballot.

Additionally, the CUSD Board of Trustees voted in August to call a school bond election within the newly formed School Facilities Improvement District #2, which encompasses the entire district except for Rancho Mission Viejo. If 55 percent of voters approve the $889 million general obligation bond measure on Nov. 8, residents living within SFID #2 will be taxed $43 for every $100,000 of assessed value on their homes to help the district leverage state funds to pay for over $800 million in deferred facilities maintenance. championed fairness in management of Mello-Roos tax districts. This has produced tax reductions of $81 million, while ensuring that CUSD’s credit rating remains solid.

Meet the Congressional Candidates Issa, Applegate discuss South Orange County’s big role in close Congressional race

f polling and primary results are reliable indicators, the race for the U.S. Representative for California’s 49th Congressional District is the tightest it’s been in over 15 years.

The 49th spans from South Orange County to North San Diego County, including Camp Pendleton, Dana Point, San Clemente and San Juan Capistrano.

Congressman Darrell Issa (R-Vista) has served as the district’s representative since 2000*, winning eight elections—all but one by more than 20 percent.

This year brings a new challenger in Doug Applegate, a retired Marine colonel and lawyer, who has lived in San Clemente since 1981. The two were separated by just over 5 percent in California’s primary voting. Some recent polls have the race closer than that margin.

The Capistrano Dispatch sat down with the candidates for over an hour each at our office to discuss federal issues, local concerns and the race itself. In our print edition, we’ve included our discussions about several key issues, but our conversations included points on immigration, water security, the military, marijuana legalization, gun control, SONGS and more. ON THE CONGRESSIONAL RACE: SC Times asked Congressman Issa if changing demographics in Orange County might affect voting in the district, and how, after serving the district for nearly two decades, he might “compromise with (his) constituents when maybe (he has) something they’re not expecting from (him).”

“I didn’t plan on being here 16 years,” Issa said, “but 9/11 happened and something else happened, and instead of going back to my business career, I’ve stayed with doing what I’m doing. Now I’m very involved in some things that I want to get done, and I’m asking the district to consider are they better off with somebody with my experience and the things that I plan to accomplish, and I’m hoping they say, ‘Yes.’ “Sixteen years ago all I had to do was

health and sanitation,” Issa said.

Both Issa and Applegate said there could be a solution in amending the ADA to include reasonable regulations on sober living homes.

“You have to figure out something that still honors the intent (of the ADA), because I believe in the ADA, there’s nothing in the ADA that I find problematic, but it’s in its application in residential neighborhoods like (in South Orange County), it’s a problem,” Applegate said.

Darrell Issa (R) A former member of the U.S. Army and businessman, Issa has served numerous roles in his 16 years in Congress, currently serving on the House Judiciary Committee and the House Foreign Affairs Committee.

Issa lays claim to having played integral parts in several matters of national and state importance. He touts voting against “bailing out” banks via the Troubled Assets Relief Program (TARP) in 2008, and in 2009, initiated a later-approved bipartisan commission to investigate the “root causes of the financial crises.”

In 2012, Issa launched an investigation into the 2012 attack on the U.S. Embassy in Benghazi. As member and chairman of the House Oversight and Government Reform Committee, Issa led investigations involving Fannie Mae and Freddie Mac, ACORN and the “politicization of science at the Environmental Protection Agency.”

The richest member of Congress, according to filing data compiled by the Center for Responsive Politics, Issa earned much of his wealth as CEO and founder of Directed Electronics, which notably, manufactured anti-theft devices for automobiles. Issa’s current total assets, according to 2015 filings, ranges from $299 million to $768 million.

The Capistrano Dispatch asked Applegate why he wanted to run for Congress, his first quest for elected office.

“I was concerned about the leadership in Congress because every time I hear somebody talking about the use of military force or combat operations, I’m hearing somebody talk that’s never really seen the trials and realities and the fog of war,” Applegate said, adding that according to his calculations, only about 5 percent of Congress members have “served in a combat zone ever in their lives.”

Applegate said he believes “South Orange County might decide the Congressional race.” Acknowledging the area’s historic political bent to the right, Applegate says he tells questioning Republicans, “You’re going to be able to get through my office door if I’m elected to Congress a lot easier than you’ve ever been able to

This is Applegate’s first foray into running for elected office, however, he says he hopes his experience in the military and in the law profession will be enough to convince voters of his readiness.

“As far as my experience level, procedural rules I’ll have to get up to speed on, but that isn’t the first I’ve had to do that because I’m a member of the bar in five states, so I’m used to getting used to new rules,” Applegate said. “But I don’t have any learning curve concerning the military, foreign affairs, particularly in certain parts of the world, or the criminal justice system, the civil justice system or the penal system.”

Applegate’s platform includes reform of mandatory sentencing laws, a path to citizenship for undocumented immigrants and increased regulation of the financial sector. He would also call for a second look at the Trans-Pacific Partnership and retooling Veterans’ Affairs.

On Applegate, Issa says he knows “not much” about the Democrat, and had only met him once.

ON SOBER LIVING HOMES With the proliferation of sober living facilities—homes, often in residential areas, that serve as alcohol and drug abuse recovery centers—local municipalities are hamstrung to enact regulations on them, as the Americans with Disabilities Act (ADA) protects people in recovery.

Issa said the first step of any solution would be to look objectively at sober living facilities.

“Well I think what we do is we maintain (that) you can’t discriminate based on somebody being handicapped, including being a recovering alcoholic or recovering drug abuser, but we recognize that cities should have the ability to take care of

ON THE ENVIRONMENT As climate change is poised to affect South Orange County in myriad ways from rising sea levels to wildfires to water shortages, the candidates were asked various questions about the environment and the impact of human activity on a rapidly warming planet.

“I come from the party that believes in science, so this is kind of easy for me,” Applegate said, adding that the U.S. Navy and Marines have been pushing Congress for 10 years to invest in renewable energy as a matter of military expediency.

Applegate said the U.S. “should have a Manhattan-type project with renewable fuels.

“And guess what? This part of Southern California has all these natural synergies in research for so many things,” Applegate continued. “It’s stupid that our Congressmen haven’t been pounding the table on that. … If you think this is some grand liberal conspiracy or whatever, it’s not.

This is a real issue.

“I don’t know why a guy that had an electronics firm and likes to portray himself as at the cutting edge of technology, why he can’t see science in other areas,” Applegate said of Issa.

Issa said he “reject(s) anyone wanting to say I’m not an environmentalist.”

Issa received a zero percent rating from the League of Conservation Voters last year, a nonprofit that grades members of Congress based on how they vote on what they classify as bills that concern the environment.

“If you look at zeroes, you look at zeroes by people who start off figuring out what they’re going to score and they score it,” Issa said of the rating.

Issa said he supports “more research,” “intelligent ways to reduce our carbon footprint,” and nuclear energy “because it has zero emissions and it can be an interim path.

“Do we try to have an intelligent pathway, regardless of what the timeline is— and there is disagreement on the timeline within the science community?” Issa said.

“Do we kind of find a way to get as quick as possible to sustainable ecology, including weaning ourself off burning things that come from the ground? Absolutely.”

As for a concrete timeline to implementing such initiatives, Issa said, “There’s nothing concrete in environmental scientists who have missed their timelines for things they said were going to happen.” CD www.thecapistranodispatch.com

IN SUPPORT OF THE SCHOOL BOND —Ruth Clark, San Juan Capistrano Most of the public schools in San Clemente, Dana Point and San Juan Capistrano are 50 years old or older and there was a lot of deferred maintenance due to the recession in 2008-2009. Mission Viejo and Santa Margarita are much newer and paid by all of us. It’s important to keep our taxpayer-owned properties in good repair, such as leaky roofs, bad plumbing, unsafe electrical, etc. If not, this could cause more expensive damage, as anyone who owns a home knows. There are many benefits to passing a bond now: 1. Interest rates are very low, so money is cheap and available with state matching funds, keeping our tax money here, which benefits all of us.

2. Employs many workers and suppliers.

3. Employs people with wages to pay taxes, pay rent, mortgages, buy clothes and cars, take vacations, eat at restaurants and spend money at local businesses, which helps our local economy.

Most people want to work and be a productive part of society with a basic lifestyle, which is much better than receiving unemployment payments and welfare that are also paid for by our taxes. Unemployment and poverty create a lot of stress on families—misery, depression, divorce and unstable, unhappy children.

I would much rather have our taxes pay for repairs and maintenance for our schools, which is a positive for our community, while poverty and welfare, are not. It is our responsibility to educate our children and provide suitable school buildings. We are going to pay one way or another. Let’s decide for the benefit of all, especially our children.

TRAGEDY ON ORTEGA HIGHWAY IS AVOIDABLE IF WIDENED —Shelly Welcome, San Juan Capistrano In response to Councilman John Perry’s Guest Opinion “Ortega Highway—To Widen or Not,” Dear Mr. Perry, Our public high school, San Juan Hills High School, is located out the Ortega in case you weren’t aware of this. The majority of San Juan Capistrano’s high school-aged children go to San Juan Hills High School and the majority has to travel on the Ortega through the narrow choke point to reach this high school.

drive that road every day to get to school with huge trash trucks, produce trucks and commuters? I am sorry I am redundant, but I want you to understand this portion of the Ortega, because maybe you don’t drive it very often. The road is extremely narrow at some points and a slight error could cause a head-on collision with one of those trash trucks or produce trucks. One accident involving one of our high school students would be too many.

This kind of tragedy on a narrow road is avoidable if you widen it.

It seems like this Council is fighting against our local high school students.

Our City Council removed the public parking on a public road near the school. San Juan Capistrano students who drive only have one option, and that option is to drive up the Ortega to their school.

Are you aware that it floods every time it rains at the narrowest part of the choke point? I am aware of this because when it floods, I call the school so that they can warn the student drivers. Hydroplaning, inexperienced drivers and trash trucks are not a good combination.

If an accident occurs there, the city of San Juan Capistrano will be liable just like they have been in the past when the public tells them something is unsafe and the City Council does nothing about it.

The two-lane portion of the Ortega is still beautiful and lined with trees. The speed limits are low and well regulated by police officers so what concrete speedway to the freeway are you talking about? I feel strongly that the Council’s decision was political and had nothing to do with what is best for the citizens and children of San Juan Capistrano.

I have lived in San Juan Capistrano for over 20 years. I love it and wish to preserve the small town feel. But I feel that there has to be compromise with traffic and growth. Our children did not choose their high school to be built out the Ortega, nor did they choose for thousands of homes to be built out there. But they must get to the high school. And our Council should be doing everything in its power to ensure that this occurs. It seems to me the most important job of a Council member is to keep our children safe. You and your fellow members have failed our children because of your decision not to widen the Ortega. Our children’s safety should come first over the political warfare in this small town.

DISTRICT VOTING TAKES AWAY VOTERS’ RIGHTS —Ivy Sims Damon, San Juan Capistrano I have been a resident of this community since 1947 and have seen many changes over the years. I was lucky enough to grow up here in this “quaint” little town. It is no longer “quaint” or little. I could go on and rant about many issues, but the one that is

bothering me right now is the voting.

Please tell me how I am getting equal representation by my City Council when I am only allowed to vote on a very few. I reside in Mission Flats, which is in District 1. The City Council is supposed to represent all the people, but if there is a person or persons running in another district that I am very much against or very much for, I cannot voice a vote. Is that not taking away from my equal rights as a voter? I understand that minorities want to get into the picture also, but I do not see what was stopping any minority from running before.

The City Council members should all be elected by the whole voting population, not just the people in the area of which they reside. I am sure that one of the District 5 candidates who has been in this city for just a few years will be able to explain this to me. It looks like that is where the majority of candidates are coming from.

OSTOMY AWARENESS DAY IS ABOUT RESILIENCE, FIGHTING STIGMA —Carol Brinkman, San Juan Capistrano October 1 is national Ostomy Awareness Day. At least 750,000 Americans of all ages live with an ostomy. Many readers may not know what an ostomy is. An ostomy is a type of surgery that creates an opening (stoma) in the abdomen that allows for the removal of bodily waste into a pouch or ostomy bag outside the body. This surgery occurs when a person has lost the normal function of digestive or urinary systems due to birth defects, cancer, Crohn’s disease, ulcerative colitis, trauma (such as a military service injury or accident), and other medical conditions.

Education is needed to fight stigmas and misinformation about ostomies. Many patients fear undergoing this surgery. This day serves as a reminder to the American public that this is a life-saving and liferestoring surgery. People living with an ostomy should be accepted as the active and healthy individuals they are.

This year’s theme is resilience, “Bouncing Back into Life,” and is all about finding your inner strength to bounce back from this surgery. he summer movie season is over, and the autumn film festival circuit is just beginning.

One of the first movies to debut this season is Derek Cianfrance’s first official studio film, The Light Between Oceans. Based on the 2012 novel by M.L. Stedman, the movie premiered at the Venice Film Festival to a lukewarm reception, and general audiences might feel the same way.

In 1918 Australia, Tom Sherbourne (Michael Fassbender) returns from World War I alone and emotionally numb. He is hired as the new lighthouse keeper off the coast, where he meets Isabel Graysmark (Alicia Vikander). Quickly, they fall in love, get married and move into a house next to the lighthouse. After Isabel experiences two miscarriages, a baby,

The take on adobada at La Tiendita is slightly sweet and spicy, with a thick rub of spice and extra tender meat. What makes it exceptional is the addition of warm spices like cinnamon, and what could be the phantom associations of nutmeg and clove. It’s almost like the meat is marinated in horchata.

The tostada is piled high, with abundant meat, fresh lettuce and tomato, cheese, sour cream and guacamole. Here’s to hoping these show up on every corner. —Matt Cortina

At the Movies: ‘The Light Between Oceans’ is a Bit Dim

Only years later, Tom discovers Lucy’s mother, Hannah Potts (Rachel Weisz), actually lives in their town.

The Light Between Oceans had a lot of potential and might have been a moderate hit a few decades ago. It has that soapy sentiment you see in movies like Peyton Place (1957) or Endless Love (1981). But while Cianfrance perfected the depressing tone of romance in Blue Valentine (2010), he somehow misses the mark here. The dramatic music score by Alexandre Desplat alongside a stoic Fassbender and weepy performances from Vikander and Weisz make the feature overly melodramatic. Unless you’re a huge fan of the filmmaker or cast, you could wait for Sully at the movies. CD

t would appear to be a convoluted route that merged and mashed up Def Leppard, Stone Temple Pilots, TLC and the Pope into a band. But Phil Collen (lead guitarist of Def Leppard) says the marriage began at a logical start: a wedding.

“She’s my wife’s godmother, and she sung at our wedding,” Collen said of Debbi Blackwell-Cook, who has led a Motown group, sung backup vocals for Michael Buble and, yes, performed for the Pope.

Collen says he and Blackwell-Cook soon found their musical styles matched, and out came a deep bluesy sound. The later editions of Robert De Leo (Stone Temple Pilots) on bass, and Forrest Robinson (TLC, India Arie) on drums rounded out Delta Deep, who will be performing at the Coach House on Monday, Sept. 12.

“They just kind of completed the whole thing,” he said. “It went form this very bluesy soulful thing to this aggressive, soul-funk, bluesy thing.”

Collen said merging the varied backgrounds is helped by the members’ shared appreciation of Motown and solid songwriting. In fact, Collen said adhering to rules in the studio has provided a vehicle through which the members combine their talents.

“The two things you have to do with a song is respect the groove and the melody. It’s amazing how many people veer off and get caught up in themselves and something else comes in. I think that’s a problem, a lot of us love those boundaries,” Collen said.

ore than 8,300 spectators gathered in San Juan Capistrano Aug. 27-28 for the 16th annual Rancho Mission Viejo Rodeo, which took place at the Rancho Mission Viejo Riding Park at San Juan Capistrano.

Heralded as “America’s richest two-day rodeo,” the annual event has been hosted

by Rancho Mission Viejo’s O’Neill-AveryMoiso family for the past 16 years in celebration of the golden age of early California rodeo and the heritage of the land.

This year’s purse increased nearly $50,000 from past rodeos to a total of $295,000.

Organizers said more than $110,000 was raised for charities this year. The proceeds from each rodeo benefit a number of South Orange County charities, such as The J.F. Shea Center for Therapeutic Riding in San Juan Capistrano and CHOC at Mission Hospital.

Starting the Conversation San Juan-based grassroots group Green Ribbon Club aims to destigmatize mental illness

I

t began as an idea 23-year-old Brian McInerney had in June. The San Juan Capistrano resident wanted to make a positive change in South Orange County communities that over the years have been left reeling after suicide- or addictionrelated deaths of young adults.

That was the case two years ago, when the San Juan Hills High School alum lost a family friend to suicide. A year later, the boy’s brother committed suicide as well.

McInerney said with each death, a devastated community came together and mourned the loss of the young men, but it wasn’t long—maybe weeks, or a month—before the issue of mental health faded away. McInerney, who suffers from bipolar disorder, took personal note of his friends’ deaths.

“There were no red flags, no warning signs, nothing,” he recalled.

It was after a conversation with his boss at Western Youth Services in Lake Forest that McInerney had the idea to start The Green Ribbon Club. McInerney said that, while in a bit of a manic state, he began buying domain names and rallying people, without really knowing what he was doing.

McInerney’s actions have resulted in an advocacy organization and aspiring nonprofit that aims to break the stigma surrounding mental health in Orange County.

Comprised of South Orange County students and recent graduates who have lost friends to either suicide or addiction, the club’s hope is to begin reducing the number of suicides and overdoses within the community by making mental health a household discussion.

With the support of local organizations such as Western Youth Services and the Mariposa Center in San Juan, McInerney and members meet each Tuesday from 7-9 p.m. to discuss the developing group’s foundation and best practices for spreading their message.

Megan Habel, 21, of San Clemente, said she became involved with the club via her stepsister, who was also a part of the club before heading to Baylor University as a freshman. Her sister is now starting a chapter at Baylor, and McInerney said chapters are also cropping up at Chapman University and UC Davis.

“For me personally, struggling with mental illness as well, I’m more comfortable going to a group this age, sharing my story and encouraging people my age,” Habel said.

generation, and we need to stick around for each other and help each other out.”

McInerney acknowledged that organizations normally set a foundation before spreading their message, but the last two months have been a whirlwind of community interest—from San Clemente and Dana Point, to San Juan and Mission Viejo.

“For better or worse, what’s happened for us is, we haven’t quite solidified [our foundation] yet, and people have come to us saying, ‘I love the idea. I’m going to start a chapter,’” McInerney said. “Those people have gone out of their way to do that. So there’s a lot of passion behind it.”

The group held its first public meeting on July 28 at the San Juan Capistrano Community Center, where three speakers addressed the importance of discussing the reality of mental illness, the stigma surrounding illnesses such as depression and addiction, and the rising number of suicides and accidental overdoses in Orange County.

With overwhelming positive response

from over 60 participants, many in their early 20s, club member Mishayla Jones, 21, of Dana Point, said she personally hopes to begin developing strong relationships with local high schools, where depression and mental illness are prominent.

McInerney said another one of the club’s goals is to develop a simple, userfriendly resource sheet with contacts of local organizations, as well as facts about mental illness.

“There’s an abundance of resources here in Orange County for mental health, but no one is going to those resources.

So we’ve come to the conclusion that obviously they’re being deterred from those resources,” McInerney said. “Why? Because it’s not cool to say you have mental illness. There’s fear in being shamed or alienated or stigmatized.

“What we’ve seen is, a lot of times, people want to seek behavioral health services like counseling or support groups, but they don’t really know where to look,” McInerney said. “And furthermore, if they

do find it, they don’t know if they have the right insurance. How much is it going to cost? Are their parents going to know? Is their work going to know?”

McInerney said a resource sheet, which the club could pass out at public events or high school campuses, would answer such questions and eliminate misconceptions youth have about seeking help.

n my most recent column, I featured Brenda, a widow, 68, who had soured on men and the overall dating scene for women age 60-plus.

In the article, I suggested she soften her opinion regarding the single men she is meeting, which brought some eye-opening responses from single women.

Joan said, “Your advice is generally very helpful but you can’t possibly see the reality of the dating world from the eyes of a 68-year-old woman. I am generally an optimist as well as I love men.

“However, I am also a realist, and what I have concluded is that finding a decent compatible ON LIFE AND man over 65 is a case of LOVE AFTER 50 a needle in a haystack. I

Joan is right. I cannot see the world through the eyes of a 68-year-old woman.

Nor through the eyes of any single man or woman who has lost a spouse or a loved one later in life. I can only try to understand and be compassionate.

An email from Ann, 70, described the dating challenges she faces.

Ann said, “I was widowed eight years ago. After about a year, I decided that I could lessen my grief if I had a male friend. I decided to try a couple of online dating sites. I found the men to be rude.

One widower said his wife had received a prestigious award from the governor. Was I of that caliber?

“Another man made himself available for conversing only at 6 a.m. His ‘story’ was that he was married, but his wife was disabled. He asked in his emails, ‘Do you dye your hair?’ Do you wear a lot of makeup?’

Ann stated she did volunteer work, took master gardening classes and joined a gardening group, but not one available man showed an interest in her at these events.

She added, “I admit I am an introvert, but I have accepted that in myself, and like that about myself, and a man would have to accept that in me as well.

“I have limited my social activities now.

I walk my dog in the park often, and I see men my age there walking their dogs or just walking for exercise. I’m sure some of them are married, but some of them must be single. I smile at everyone I walk near, but only one man has stopped to talk briefly.

“I am not looking for a man with money to support me. I also am not looking for a husband. I am looking for a friend, a man to be friendly and nonjudgmental.

“Tom, don’t advise me to get out more and be more outgoing. I am who I am.

Realize that women my age do not want to spend all their time knitting and making casseroles for church potlucks. We still want a relationship, and we still want sex.

The ‘invisible woman syndrome’ is not a myth. It is a very painful reality.”

Despite splitting into voting districts, residents should remember what has been accomplished when citizens band together

an Juan Capistrano is entering a new election cycle. As a community, we have always been very involved in our city. But in this election cycle, only two-fifths of us will have a voice as to what is going to happen in our city. The overwhelming majority can campaign, speak and work on this election, but only a portion of our city will actually determine the outcome. In our politically correct world, this is the new definition of democracy.

Our town became a city in 1961 because residents saw that our way of life was in jeopardy of being taken over by San Clemente, and in order to preserve our history, we needed to incorporate. Once we were a city, the new City Council quickly made sure that our history was protected by establishing a historic district around Los Rios Street and the Mission area. This designation is still in effect today.

To solidify our history further, historian Ilse Byrnes has spent the last 40 years placing structures on the National Registry of Historic Places to insure their place in our history. All of Los Rios Street was listed in 1983 as the oldest residential neighborhood in California.

Forty percent of all land in San Juan Capistrano is designated Open Space. In 1989, the City Council passed an ordinance for the purpose of codifying land use restrictions as to grading and construction activity within certain hillside areas in the city. What became known as the Ridgeline Law keeps developers from building ocean view homes on the top of our hillsides. We are the only community in South Orange County that has this ordinance.

In 1990, the citizens of this community voted to enable the city to incur bonds for acquisition of lands for parks, agriculture, open space and related uses. The preservation of approximately 140 acres included what is today South Coast Farms, The Ecology Center, the Boys and Girls Club, an elementary school, soccer fields, baseball diamonds, a future skate park site and a dog park.

In 2008, the citizens passed Measure X and Measure Y. Measure X stated that any proposed General Plan change for any acquired Open Space designation must be voted on by the community through a general or special election. Measure Y gave the city the ability to sell $30 million in bonds for the purchase of additional Open Space. Measure Y gave us Reata Park and the Rancho Mission Viejo Riding Park at San Juan Capistrano.

he 2016 fall high school sports season has begun, and several San Juan Capistrano-based teams are primed for big seasons. In our annual preview, we get you caught up to-date on programs from all five schools in town.

San Juan Hills High School

BOYS WATER POLO Now that head coach Ivan Buich has had a full calendar year to work with the San Juan Hills boys water polo team, the second-year coach is beginning to see signs of progress. The program has had difficulty finding wins in the pool in recent years, but Buich has instilled a disciplined, year-round approach to the sport that his team is embracing.

The Stallions doubled their win total from the previous year in 2015, raising the number from two to four wins. The Stallions went winless in the Sea View League again, which it has done every year since joining the league, but Buich described how the games were much closer than in previous years. Rather than lose by double-digit points like they did in 2014, the Stallions hung close in several contests. Three of the Stallions Sea View League losses last year were decided by five or fewer goals.

With a large group of players returning in 2016, Buich believes the team is poised for more incremental improvements this season.

The Stallions return their leading goal scorer from last season, senior Brent McClain. McClain is a talented utility player that can score from and defend any position, Buich said. Returning seniors Austin Silveria, a versatile distributor, and lefty wing Trevor Wise return to bolster the Stallions field positions.

Freshman two-meter center Max Miller has impressed Buich this offseason and has the potential to contribute right away.

Miller provides the team with a 6-foot-2inch, 170-pound presence down low.

“Everyone has gotten better and contributing a lot more than they did one year ago,” Buich said. “The practice time is there, the comraderie is there, and everything is aligning.

Because they were such a senior-heavy team last season, the Stallions played in a lot of matches to better prepare themselves for the playoffs. This year, Taylor decided to tone the number of games on the schedule back a bit, so the team can focus on their own games and doubles partners can learn to play alongside each other.

Taylor has also been telling the young team to embrace the challenge of a new league, but to not let it distract them. After winning back-to-back league titles, the Stallions’ new league opponents will want to see what they’re made of.

“We’re talking about how to rebuild and just keep it calm and not overreact. People are watching us and want to see how we do,” Taylor said. “You’ve got to want it, and it won’t be until we play in our first

GIRLS TENNIS

After enjoying so much success in the Sea View League the previous two seasons, the San Juan Hills girls tennis team has been moved up to join the highly competitive South Coast League in 2016.

The Stallions were crowned back-to-back league champions in 2014 and 2015, and will enter a new league filled with perennial playoff contenders and a new head coach.

Amy Taylor assumed head coaching duties this offseason, and inherits a young team that lost eight seniors to graduation.

It would be hard for any program to top a league title and a semifinals appearance in the CIF-SS playoffs after graduating a majority of its starting lineup. But St. Margaret’s girls volleyball coach Joaquin Acosta believes his young team has the chance to reach those same lofty heights for a second consecutive year in 2016.

The Tartans return a solid core of players in outside hitters Gracyn Bank and Kaitlyn Kao, and returning starter Erica Mendel and setter Annie Eales. They were all members of the dominant Tartans team that went a combined 22-6 last season, including a 12-1 record in Academy League play.

A strong group of freshmen and sophomores have helped replenish the skill on the roster in the offseason. Outside hitter Grace Colburn and middle blockers Emmy Flornes and Tatum Westendorf are all freshmen that have earned spots in the starting lineup.

“Our experience is not high, but they’re high-level kids,” Acosta said. “They play high-level club and they don’t play like freshmen. … If (the team) develops, we have the ability to possibly play at the same level (as last year) and maybe even beyond” The Tartans did well competing against larger programs at the Foothill Queen of the Court Tournament in August, compiling a 4-3 overall record. Acosta said the team’s effort at the tournament was excellent, considering they hadn’t had many summer practices leading up to it.

The Academy League is usually competitive, and this year is no different. The Tartans will battle Sage Hill and Crean Lutheran for the title. –SB

BOYS AND GIRLS CROSS COUNTRY The St. Margaret’s boys and girls cross country squads advanced to the CIF-SS finals last year, and are gearing up for another successful season.

The girls team lost its top runner from last season in Katherine Adelman, but return a handful of strong runners. Leading the Tartans will be junior Daisy Sellas and sophomore Julia Martain. Martain finished second in the sophomore race of the Cool Breeze Invitational in Pasadena on Sept. 3.

The boys team returns nearly every runner from a team that qualified for the CIF-SS Championships last season.

This year the squad has three seniors to lead the team, a group that includes twin brothers Nic and Luke Gitter and Charlie Smith. Having some seniors on the squad this year will provide the leadership that is needed to return to the postseason and place well in league, Bendzick said.

“The front trio of Nic, Luke and Charlie should help put the three runners in the top5 of the Academy league,” Bendzick said.

Aside from these upperclassmen, standout sophomore Matthew Colglazier has proven to be one of the better 800-meter runners in the Academy League. Bendzick believes he has the ability to parlay a successful track and field season into a solid cross country venture this fall.

GIRLS VOLLEYBALL

Three weeks into the season, the JSerra girls volleyball team has been racking up match wins and placing in tournaments at a high clip. The Lions already have a 10-6 overall record and placed second at the Foothill Queen of the Court Tournament’s varsity division on Aug. 21.

The high finish at the Queen of the Court was engineered by several returning starters and a few newcomers.

The Lions return junior setter and team captain Kate Gonzalez, who is responsible for setting the Lions 5-1 formation that requires her to be on the court at all times.

The team also returns junior outside hitter and captain Caroline Kennedy, senior middle blocker Bianca Hawlish and senior libero Alexis Cuff.

The Lions have good size at the middle blocker position, and are relying on freshman Kylie Pries and Hawlish’s abilities at the net. Outside hitter Shayne Francisco, a sophomore transfer from Dana Hills, is also contributing early in the season.

“I wasn’t sure what to expect (at Queen of the Court). We only have four seniors, and it’s a young team,” coach Mike Murphy said. “I think that our showing and our result there was pretty impressive.”

Since the tournament, the Lions picked up wins over Capistrano Valley and Saddleback Valley Christian, the defending CIF-SS Division 3A champion.

The Lions’ busy schedule continues this week with an appearance at the Dave Mohs Tournament at Edison High School.

GIRLS VOLLEYBALL The Capistrano Valley Christian girls volleyball team is off to one of its best starts to a season in recent years. As of Sept. 8, the Eagles, who return all but one starter from last season, are 8-1 overall.

The team is already one win away from matching last year’s win total.

A main reason for the hot start is the Eagles’ team chemistry. A large portion of the team is made up of returning juniors, who have played alongside each other since middle school. OBITUARY

Harold Loyd Dunegan

(1931-2016) Harold Loyd Dunegan, a former resident of Orange County, born in Eufaula, OK on Feb 25, 1931 passed away on July 3, 2016 in Midland, TX. He was 85.

After high school, he enlisted in the US Coast Guard and was honorably discharged in 1954. Mr. Dunegan received his BS degree in Materials Science in 1961 from San Jose State College, and was hired by the Lawrence Radiation Laboratory in Liver-

more, CA. His work there led him to his lifetime vocation of studying the science of acoustic emission (AE). He ultimately became a respected worldwide leader in the field.

“Hal” eventually formed his own company to design and manufacture AE systems. This company; Dunegan Corporation, was ultimately purchased by Endevco of San Juan Capistrano.

Known worldwide as an innovator, pioneer

and champion of the technology, there were many other unique components to his life.

He was a musician, a cattle rancher and a yachtsman in the beautiful waters off Dana Point. And he never lost sight of the importance of family.

Mr. Dunegan is survived by his wife Alice, and daughters Kathleen Poor and Lizann Dunegan.

A celebration of his life will be held at the Miramar National Cemetery in San Diego on September 21, 2016 at 2:00 PM.

The Eagles picked up six straight wins to start the season, highlighted by a second-place effort at the Cal Lutheran Tournament last week, where they went 4-1 overall.

The Eagles also benefitted from a strong incoming freshmen class, which has produced several impact players like Dafne Pluhar and Lily Kelso. Sophomore Keara Rutz is also earning considerable court time.

The mix of players has given head coach Kelle Bond plenty of rotation options to choose from.

“It’s awesome that this group of juniors has stayed together and we have this additional group joining them. I have not seen that in my five years coaching here,” Bond said. “It has really made our team unite and has allowed

The pressure is the highest it has ever been for returning three-time defending CIF-SS Division 3A champion Saddleback Valley Christian girls volleyball team. The Warriors, who also advanced to the second round of the CIF State Division III tournament in 2015, are eyeing a rare fourth consecutive title this season, a feat that has not been accomplished in CIF-SS history.

SVC head coach Carmen Stratton has only four seniors returning to the lineup, but still has a positive outlook on how they stack up this year.

“Only two of our seniors are starters, but we have very talented young team this year,” Stratton said. “Despite the loss of some seniors, I think we are incredible for our (school) size.”

The Warriors road to a fourth CIF-SS title might be trickier this time around. Because of their recent success, SVC was promoted up from Division 4 to Division 3 in the CIF-SS. Returning seniors Sklyer Stratton, Lily Dyer and Celine Hoyle will anchor the Warriors rotation, and are providing veteran leadership in the early going, Stratton said. SVC
