have also attended Adequacy Committee meetings, Retirement Committee meetings, Educational Cooperative meetings, conducted Tier 1 and 2 trainings, and conducted financial training in our computer lab. We have had several meetings with the Division of Elementary and Secondary Education, the Governor’s office, and numerous legislators.

It has been busy! But, for all of us, the work is important and necessary to continue moving Arkansas forward. There are some very important meetings coming up that we will be monitoring, One of these

expenditures for these funds, then the funds go away.

ESA (formerly NSL) dollars have been a great source of funds to help schools address areas that were not included in the matrix and to help under achieving students.

Another area we will be monitoring will be the Retirement Committee hosting public meetings around the state. These meeting have been good and provided a lot of conversation between members and legislators. We want to continue to make our system sound with quality policy decisions and we feel the best policies would be delivered by the ATRS board. So, pay attention and let’s keep the communication door open with our legislators.

Vaping issues continue to evolve, and if it is not a problem in your school yet….it will be. We are monitoring this issue and encouraging legislators to help curb the behavior of our youth. There are many thoughts about how this can be accomplished, but we want to give legislators the courage to take this issue on and come up with some positive policy.

rriving on the scene as a teacher during one of Arkansas' most infamous education cases, Lee Smith retained an enduring lesson. “I began my career at the onset of Lakeview and experienced the changes it brought about while, at the same time, implementing NCLB,” he recalls. “The bureaucracy that grew out of this area was part of the impetus for my desire to lead for change.”

Time went by, and possibilities in technology grew.

Lee, who is also Vice President of the Arkansas Association of Career and Technical Education Administrators, saw boundless opportunities. “Online learning and Schools of Innovation have facilitated some of the things I envisioned when I first began using technology in my classroom,” he points out.

“One of my statements concerning schools and technology is ‘Proximity is no longer a problem,’ meaning that your location does not determine as much about your opportunities as it used to.”

Lee graduated high school in Foreman and entertained the idea of going into journalism.

However, at the suggestion of a professor, he opted to enter the field of Agriculture Business. “After a year in school, I changed my major to Agriculture Education due to the fondness of memories I had in Agriculture Ed and FFA.” After graduation, Lee joined the faculty at Acorn High School in Mena, teaching Agriculture Science & Mechanics and a career orientation course. Three years later, he took the same position at Mena High and Middle Schools until 2009. “After the Mena tornado, I was hired as the DeQueen-Mena Educational Cooperative Career and Technical Education Coordinator,” he explains.

At some point during his career, before he became superintendent of Horatio School District, Lee became a student again. "As I became more reflective about my learning and experiences as a student, I became interested in Leadership and changing education,” he recalls. “Therefore, I began my administrative degree in 2003 and completed my doctorate in 2016.”

One challenge about his job, Lee says, is avoiding “cookie cutter” solutions to complex problems.

“Getting the populous to go along with something different can wear you out," he admits. “So discerning what is worth the effort can be difficult, but that is why mission and vision are so important.”

What goals are you still working toward?

“I would still like to offer more career content in my school with the required academics embedded. This has happened to some degree here at Horatio, but I think it needs to be more prevalent. I believe that if we keep working together, we can create fewer courses that are much more meaningful and meet greater overall objectives.

I consider this type of singularity in that we work with different leaders to find more and more similarities in human endeavors, we create fewer and fewer isolated organizations.”

“Quiet, patient, and kind. Skilled in technology and a visionary for its use.”

What is the best advice you have ever received?

“Support in public but critique in private. Another version of this is the be loyal to the absent. I was also encouraged to start my graduate degree right away after getting my first teaching job. I followed that advice, and it has paid off very well.”

What’s something that amazes you?

“The future with machine learning, artificial intelligence, blockchain, and quantum computing. We won’t be doing clerical work much longer. We’ll all be creative thinkers or worthless.”

What is the most daring thing you have done?

If you weren’t in your current position, what would you be doing?

“Getting on the backs of more than 50 of those bucking bulls and horses.”

“If I had to change careers, I would probably be involved in some type of computer programming.”

What do you enjoy during your time off?

“I enjoy traveling the most but don’t get to do it as often as I’d like. Most of my time involves reading of nonfiction for enjoyment or watching a classic film.”

What is one of the things on your bucket list?

“An actual ‘Bucket List’ item of mine would be to have a conversation with Elon Musk.”

How do you want to be remembered?

“I would like to be remembered as a person who cared about others and found the very best within them. I would also like to be remembered as a leader whose tiny, little, futile efforts actually made things a little better.”

What have you done that you are most proud of?

“Sustained a Godly and faithful marriage and family with children who are now faithful adults, but this is a daily effort that never ends.”

Disability Insurance, Part 2

Short-Term Disability Policies Short-term disability insurance is designed to provide income to employees who become disabled due to sickness or an accident and are unable to work. Government statistics show that these benefits typically replace about 50 percent to 67 percent of an employee’s income.

Benefits Period The benefit period is usually expressed in terms of a maximum number of weeks of coverage for a single period of disability (Duration). The most common duration of short-term disability insurance is 13 and 26 weeks.

Waiting Period Generally, an employee will be required to satisfy a waiting period (Elimination Period) before disability payments will begin. During this period, employees may use sick leave, vacation, or personal leave. If an employee uses the full duration of short-term disability the following would happen.

•The employee might begin collecting under a long-term disability plan (if one is offered).

•Benefits would terminate.

Long-Term Disability Policies Long-term disability policies take up where short-term policies leave off, covering employees who become disabled and unable to work for longer periods of time.

What Counts as “Disabled” Long-term disability coverage generally defines disability in one of the following two ways:

The call generally starts like this, "I have received an FOIA request for (fill in the blank). Is this requested employee personnel record exempt from disclosure?"

Under certain conditions, the FOIA lists exemptions for two groups of records normally found in employees' personnel files. These items can usually be divided into "personnel records" or "employee evaluation or job performance records." The test for whether these two types of documents may be released differs significantly.

When school districts assess whether either of these exceptions applies to a particular record, they must make two determinations. First, they must determine whether the record meets the definition of either exception.

Second, assuming the record does meet one of the definitions, the custodian must apply the appropriate test to determine whether the FOIA requires that record be disclosed.

The first exception is the one for "personnel records," which the FOIA does not define. The AR Attorney General's Office has consistently opined that "personnel records" are all records other than employee-evaluation and job performance records that pertain to individual employees.

Whether a particular record meets this definition is a question of fact that can only be determined by reviewing the record itself. If a document meets the definition of a personnel record, then it is open to public inspection and copying except "to the extent that disclosure would constitute a clearly unwarranted invasion of personal privacy."

The second exception is for "employee evaluation or job performance records," which is also not defined by the FOIA. However, the generally accepted legal view is that the term refers to any records created by the employer to evaluate the employee and detail the employee's performance or lack of performance on the job . This exception includes records generated while investigating allegations of employee misconduct that detail incidents that gave rise to an allegation of misconduct. A document defined as an employee evaluation or job performance record cannot be released unless all the following elements have been met: (1) The employee was suspended or terminated, (2)There has been a final administrative resolution of the suspension or termination proceeding, (3) The records in question formed a basis for the decision made in that proceeding to suspend or terminate the employee, and (4) The public has a compelling interest in the disclosure of the records in question.

In general, a call to your attorney for their advice would be wise!

The One With “Mr. Math”

I

often think of my high school math teacher. Why? Because his name is the answer to the security question “Who was your favorite teacher?” I will call him Mr. Math since my technology coordinator reminded me that I should not give out my security answers! Mr. Math made his classes interesting by engaging his students. At least two or three times a week, he would present us with a bonus problem. You know the ones that begin “If a train leaves the station heading east at 50 MPH…” I loved the challenge of finding the answer! What made Mr. Math a teacher ahead of his time was his acceptance of various ways to solve a problem as long as you answered the problem correctly and could explain your reasoning.

I wanted to engage students and help them learn so I majored in education.

My teaching career started as an elementary teacher, but after a few years, I took the opportunity to become a middle school math teacher. That is where I found my spot.

Without conscious thought, I used the engaging strategies that mirrored Mr. Math’s lessons from my high school classes. It is also where my path again crossed with my role model. Mr. Math had passed away, but his widow was the high school library media specialist.

At the district back-to-school meeting, I made a point to tell her how excited I

was to be following in her husband’s footsteps. A few days later, she came to my classroom with a notebook of all the problems he used in his teaching. I incorporated what I could in my own classes and told my students the story of how I got the notebook.

The problems were a hit again.

Fast forward to two years ago and one of my former students sent me a friend request on Facebook. She was now a teacher too! One of her first messages to me was an apology for saying “$#!+” in class. I did not remember it, but she remembered the entire story. I commented that I wish I had written down all the things that happened while I was in the classroom. Her response was “Trust me, I am writing down everything but changing names and dates!”

I wish I could say I was looking forward to reading her book, but she has since passed away. I do know that she has made a huge impact on her students and I will not be surprised if there are future teachers who will model their practices after her. There are times you do not realize the impact you have on others until years later. Even if you did not set out to be a role model, you are one. Be the role model you needed when you were younger!

Benny Weston Named 2020 Arkansas Superintendent of the Year Congratulations to Benny Weston, Mena Superintendent, for being named 2020 Arkansas Superintendent of the Year!

Benny has served as Superintendent at Mena since July 2012. Prior to that he was Superintendent of the Mount Ida School District for 14 years. He has been a long-time member of AAEA and is in his third year serving on the AAEA Board of Directors. He has served on AAEA legislative committees and the Commissioner of Education Advisory Counsel. He is currently President of the Rural Education Association and Vice President of the Arkansas Activities Association.

Dr. Richard Abernathy, AAEA Executive Director, stated, “It is an honor to be able to come back to my hometown and recognize a great educational leader in Benny Weston. I have known Benny for many years, and he has always impressed me by his leadership style and putting kids first. Benny has been not only an educational leader in Mena but for the state as well.”

The Arkansas Association of School Business Officials (AASBO) has scheduled six sessions of certification classes for Thursday, November 7, and Friday, November 8 at the Hilton Garden Inn West located at 10914 Kanis Road, Little Rock, AR. Plan on attending the classes and learn valuable information and updates in public school finance as well as meeting and networking with other school business officials from throughout the state. The AAEA Job Board is a calendar-year subscription that assists districts with the ever-increasing challenge of recruiting quality staff. It is a significant resource for educators, both in-state and out-of-state, seeking employment in Arkansas’ schools.

Over 165 school districts are participating in the program in 2019, which has been extremely helpful to schools and educators over the years. The site is used year-round and is accessed extensively during the second semester. It is not unusual to see over 400 jobs posted on the Job Board at one time.

With an account, school districts may post unlimited job vacancies throughout the year. Subscription renewals will be sent to superintendents this fall regarding 2020 renewal.
