Shall the following resolution be adopted to wit:

Resolved that the Board of Education of the Prattsburgh Central School District is hereby authorized to undertake certain capital improvements consisting of addition to, and construction and reconstruction of the Main School Building and facilities, site and athletic field improvements and the acquisition of certain original furnishings, equipment, and apparatus and other incidental improvements required in connection therewith for such construction and school use, all at an estimated maximum aggregate cost of $22,200,000; and to appropriate and expend from the existing capital reserve fund $1,000,000 for such costs, and that the balance of such cost, or so much thereof as may be necessary, shall be raised by the levy of a tax to be collected in annual installments, with such tax to be offset by state aid available therefor; and, in anticipation of such tax, debt obligations of the school district as may be necessary not to exceed $21,200,000 shall be issued.

AND FURTHER NOTICE IS HEREBY GIVEN, that a copy of the statement of the amount of money which will be required to fund the School District’s budget for 2024-2025, exclusive of public monies, may be obtained by any resident of the District during business hours beginning May 8, 2024 at the Prattsburgh Central School business office.

AND FURTHER NOTICE IS HEREBY GIVEN, that petitions nominating candidates for the office of member of the Board of Education shall be filed with the Clerk of said School District at her office in the Prattsburgh Central School, not later than April 22, 2024 at 5:00 p.m. Each petition shall be directed to the Clerk of the District and shall be signed by at least 25 voters of the District, or two (2) percent of the voters who voted in previous elections whichever is greater, must state name and residence of the candidate and shall describe the specific vacancy for which the candidate is nominated.

AND FURTHER NOTICE IS GIVEN, that the qualified voters of the Prattsburgh Central School District shall be entitled to vote at said annual vote, election, and Free Library vote. A qualified voter is one who is (1) a citizen of the United States of America, (2) eighteen years of age or older, and (3) resident of the School District for a period of thirty (30) days preceding the annual vote and election.

FURTHER, qualified voters may apply for absentee or early mail ballots at the district clerk’s office from April 23 through May 20, 2024. (Ed. Law section 2004 (7)). The application for an absentee ballot must be received by the district clerk at least 7 days before the election if the ballot is to be mailed to the voter. Upon receipt of an application of an absentee ballot, the district clerk will review the application to determine if the applicant is a qualified voter and is otherwise entitled to vote by absentee ballot. The school district may require all persons offering to vote at the budget vote and election to provide one form of proof of residency pursuant to Education Law Section 2018-c. Such form may include a driver’s license, a non-driver identification card, a utility bill, or a voter registration card. Upon offer of proof of residency, the School District may also require all persons to provide their signature, printed name, and address.

BUDGET HEARING - A budget hearing for the inhabitants of the Bath Central School District qualified to vote at School District meetings will be held in the Library of the High School Building, 25 Ellas Avenue, in the Village of Bath commencing at 5:30PM on May 8, 2024 where there shall be presented the proposed School District budget for the following school year.

DATE OF VOTE - The vote upon the appropriation of the necessary funds to meet the estimated expenditures or for any propositions involving the expenditure of money or the authorizing of levy of taxes, as well as the election of members of the Board of Education shall be held on Tuesday May 21, 2024 in the Bath CSD District Office building on the campus of the Bath Central School District located at 25 Ellas Avenue in the Village of Bath, NY between the hours of 12:00 PM until 8:00 PM.

STATEMENT OF MONEY REQUIRED FOR NEXT SCHOOL YEAR - A copy of the statement of the amount of money which would be required for the next school year for school purposes shall be completed seven days before the budget hearing and may be obtained by any resident of the District at each schoolhouse during the period of 14 days immediately before the annual meeting and election, between the hours of 9:00 AM and 3:00 PM, except Saturday, Sunday or holiday.

VOTE FOR BOARD MEMBERS:

Petitions nominating candidates for the office of member of the Board of Education must be filed with the Clerk of the District between the hours of 8:00 AM and 4:00 PM not later than April 22, 2024. The following vacancy is to be filled:

One five-year term ending June 30, 2024

• Each petition must be addressed to the Clerk of the District, be signed by at least 25 qualified voters of the District, shall state the residence of each signer, and the name and address of the candidate. Vacancies upon the Board shall not be considered separate specific offices. The individuals receiving the highest number of votes shall be elected to the vacancy. The following propositions shall be voted upon at the same time as the vote upon the appropriation of monies for the coming school year and for Board members:

II – BUSES

PROPOSITION

Shall the following resolution be adopted to wit: Resolved that the Board of Education of the Bath Central School District is hereby authorized to undertake the acquisition of one (1) wheelchair bus and three (3) 72-passenger school buses, all at the estimated maximum aggregate cost of $748,842, less trade-in value, if any, and that such costs, or so much thereof as may be necessary, shall be raised by the levy of tax to be collected in annual installments; and, in anticipation of such tax, debt obligations of the school district as may be necessary not to exceed $748,842 shall be issued, or the School District may enter into an installment purchase contract if the Board of Education determines that it is in the best interest of the School District to finance the purchase in that method.

ADDITIONAL PROPOSITIONS -  Any proposition that is required to be included for vote shall be submitted in writing by means of a petition signed by at least 25 qualified voters, stating the residence of each signer, which proposition shall be filed with the Board of Education not later than 30 days before the date of the election as set forth in this notice unless a greater number of days is required by statute. Any proposition shall be rejected by the Board of Education if the purpose of the proposition is not within the powers of the voters or where the expenditure of monies is required for the proposition, and such proposition fails to include the necessary specific appropriation.

ABSENTEE BALLOTS -  AND FURTHER NOTICE IS HEREBY GIVEN that applications for early mail and absentee ballots will be obtainable and are returnable no earlier than April 21, 2024 between the hours of 8:00 AM and 4:00 PM Monday through Friday, except holidays, from the District Clerk. Completed applications for early mail and absentee ballots must be received by the District Clerk at least seven (7) days prior to the vote if the ballot is to be mailed to the voter, May 14, 2024; or the day before the election, if the ballot is to be delivered personally to the voter, May 20, 2024. Early mail and absentee ballots must be received by the District Clerk no later than 5:00 PM on May 21, 2024

A list of all persons to whom early mail and absentee ballots shall have been issued will be available in the office of the District Clerk from 8:00 a.m. until 4:00 p.m. prevailing time on each of the five (5) days prior to the day of the election, except weekends, up to the day set for the election. Any qualified voter may challenge the acceptance of the ballot of any person on such list, by making his/her challenge and reasons therefore known to the Inspector of Election before the close of the polls. A challenge against an early mail ballot cannot be based on the reason that the voter should have obtained or applied for an absentee ballot.

The Education Law makes special provisions for absentee voting by “permanently disabled” voters of the District and any questions regarding these rights should be directed to the Clerk of the Board.

The Education Law also makes special provisions for absentee voting for “military” voters of the District. Specifically, the law provides a unique procedure for “military ballots” in school district votes. Whereas early mail and absentee ballot applications and early mail and absentee ballots must be received by the voter by mail or in person, a military voter may elect to receive his/her absentee ballot application and absentee ballot by mail, email or facsimile. The military voter must, however, return his/her original military ballot application and military ballot by mail or in person.
