Texas Medicaid Electronic Health Record (EHR) Incentive Program This is the 10 th in a series of articles to keep you informed of the Texas Medicaid Electronic Health Record (EHR) Incentive Program and continuing efforts to implement health information exchange initiatives across Texas. The incentive program provides incentive payments to eligible Medicaid providers for the adoption and meaningful use of certified EHR technology. Future articles will focus on helpful reference websites, health information exchange, meaningful use for dentists, certified EHR technology for dental practices, and other relevant topics of interest to dentists.

The American Recovery and Reinvestment Act of 2009 specifies three main components of Meaningful Use: 1. The use of a certified EHR in a meaningful manner, such as e-prescribing.

2. The use of certified EHR technology for electronic exchange of health information to improve quality of health care.

3. The use of certified EHR technology to submit clinical quality and other measures.

Simply put, “meaningful use” means eligible professionals (EP), such as dentists, need to show they’re using certified EHR technology in ways that can be measured significantly in quality and in quantity.

The criteria for meaningful use will be staged in three steps over the course of the next 5 years: • Stage 1 (2011 and 2012) sets the baseline for electronic data capture and information sharing.

• Stage 2 (expected to be implemented in 2014) and Stage 3 (expected to be implemented in 2015) will continue to expand on this baseline and be developed through future rule making.

What are “Clinical Quality Measures”?

For the Medicaid EHR Incentive Program, dentists do not report meaningful use measure during their first payment year. However, in their second payment year, EPs will need to demonstrate meaningful use successfully. EPs are required to report clinical quality measures (CQMs), in addition to meaningful use measures. EPs must report on six total CQMs: three required core measures (substituting alternate core measures where necessary) and three additional measures (selected from a set of 38 clinical quality measures).

In August 2011, the Texas Dental Association’s Committee on Access, Medicaid & CHIP gave feedback to the Texas Health and Human Services Commission (HHSC) regarding the federal CQMs as they relate to dentistry. Although, at this time, there are no National Quality Forum -endorsed or other nationally accepted CQMs for dentistry, dentists interested in participating in the Medicaid EHR Incentive Program do have options (1).

According to the Centers for Medicare & Medicaid Services (CMS), “In the event that none of the 44 clinical quality measures applies to an EP’s patient population, the EP is still required to report a zero for the denominators for all six of the core and alternate core CQMs. If all of the remaining 44 CQMs included do not apply to the EP, then the EP is still required to report on at least three of the additional CQMs of their choosing (other than the six core/alternative core measures)…” (2).

To help dentists understand and report QMS, HHSC plans to offer web-based training opportunities in early 2012. The training will include direction on attestation and utilization of the MU portal.

Money Matters Ron Collins, D.D.S., M.A.G.D., TDA Secretary-Treasurer

August of each year begins the TDA budgeting process. As treasurer, I meet with the various departments for our first round of budget talks. TDA finance director Ms. Dee Dee Delagarza asks each department to develop a budget based on its anticipated costs for the fiscal year 18 months in the future. Every aspect of the TDA’s operations and programs are taken into account with a zero based approach as a starting point. We must plan a year and a half in advance because of the timing of the annual meeting in May when the House of Delegates approves the budget. Planning the budget becomes an educated guess because of the uncertainty of items such as travel, hotel expenses, convention space rental, sold exhibitor space, insurance needs, membership numbers, unanticipated contingencies, participation in favored vendor programs, building maintenance, taxes, and a myriad of other considerations.

After meeting with all TDA departments, I meet with the TDA Budget Committee to review initial figures and compare previous years’ experiences to the proposed budget revenues and expenses.

By the final Budget Committee meeting in February, we have finalized the current year’s proposed budget. If we are fortunate enough to have a surplus of funds, the committee may recommend using the surplus to balance the proposed budget. The Board of Directors makes adjustments and approves the proposed budget and submits it to the House of Delegates for final approval.

At the annual meeting in Reference Committee A, any member may and is encouraged to ask questions or make comments about the proposed budget. The reference committee then makes a final report to the House of Delegates with recommendations on the proposed budget. If the House passes new resolutions with additional financial implications, then the budget must be reconsidered in the light of these changes. This entire process ultimately drives the dues structure of the Association.

There are basically four areas from which funds can be derived in this lengthy process: budget surplus, member dues, assessments, and reserves. The accumulative surpluses from year to year are now held in a savings account entitled Surplus Savings and a report tracks the funds. Membership dues help achieve a balanced budget, and assessments are usually used for large, occasional projects. The reserves represent 35 percent of the current year’s budget and are generally considered to be the last place to seek funds, using them only for large and unexpected circumstances which insurance would not cover.

The process can seem daunting at times but is necessary as a planning tool to maintain the financial strength of the Association. The budget is only a planning tool. Every attempt is made to be as prudent with our expenditures and aggressive in our alternative income streams in order to minimize our dues structure.

Evidence-Based Practice Tip of the Month Stephen R. Matteson, D.D.S., F.I.C.D., TDA Editor Root Resorption with Orthodontics A 2011 abstract on the Cochrane Library describes a systematic review on the subject of root resorption associated with orthodontic treatment. Thirteen articles were identified for analysis. They report, “Evidence suggests that comprehensive orthodontic treatment causes increased incidence and severity of root resorption, and heavy forces might be particularly harmful. Orthodontically induced inflammatory root resorption is unaffected by archwire sequencing, bracket prescription, and selfligation. Previous trauma and tooth morphology are unlikely causative factors. There is some evidence that a 2- to 3-month pause in treatment decreases total root resorption” and state support the use of light forces particularly with incisor intrusion (1).

TDASF’s Donated Dental Services Program Gives Grandmother Reason to Smile Kitty Walford, a mother of three grown sons and grandmother to one “amazing” 6-year-old granddaughter, lives in Austin at a low-income apartment complex. Kitty was in constant pain due to her poor oral health. She had a post exposed in a root canal tooth and was missing most of her teeth in the back, leaving her unable to chew many foods.

Without any disposable income, Kitty had resigned herself to the fact that she would be forced to live with the pain and eat soft foods for the rest of her life. Then, she heard about TDA Smiles Foundation Ms. Kitty Walford shows her (TDASF) and the Donated Dental Services (DDS) new smile. 36-2012-B (BP): Approved a one-time $75 registration fee be offered to non-members of the TDA for attendance at the 2012 TEXAS Meeting in an effort to encourage TDA membership. When you think of Great Expectations, Charles Dickens’ autobiographical novel might come to mind. However, another type of Great Expectations is certainly making a name for itself. Similar to Pip’s revelation of the effects of his good intentions, the Great Expectations mentor program’s secret to success is serving the students in their quest to enter the dental profession. It allows established practicing dentists, dental school faculty, and upper class dental students to provide advice and guidance to young dental students.

The program was the 2007 brainchild of Dr. Moody Alexander of Dallas and originated at the Texas A&M Health Science Center--Baylor College of Dentistry as a collaborative effort of the Baylor College of Dentistry, upper-class students, faculty, and Dallas County Dental Society practicing dentists. In 2008, the American Dental Association gave a Golden Apple Award to the Dallas County Dental Society for its work in the mentoring program.

In 2010, a group of leaders in the program developed a strategic plan defining the long term mission and core values. The mission is to: “Mentor professionalism by building relationships between dental students, faculty and practicing dentists”. The core values are: Integrity, Personal Accountability, Trust and Respect, Leadership, Professionalism, Camaraderie, Commitment to the Profession, Service to Community, and Lifelong Learning.

The Great Expectation Program has spread to all of the Texas dental schools. Teaching ethics in the classroom preserves the integrity and trust of the dental profession.

Teaching professionalism by example of the participating faculty and private practicing dentist is the goal of Great Expectations. To date, the program has paired dozens of dental students with mentoring teams of faculty members, practicing dentists, and senior dental students.

In June 2011, I had the opportunity to attend a Great Expectations meeting with the University of Texas Health Science Center at San Antonio Dental School (UTHSCSA).

You’ll read in this issue of the TDA Today that Dr. Rise’ Martin of San Antonio received the American Dental Association Golden Apple Award for Outstanding Leadership in Mentoring for her work on the Great Expectations program at UTHSCSA.

On August 20, 2011, I visited Baylor College of Dentistry in Dallas as the Great Expectations program welcomed the new class of dental students. Dr. Mark Gannaway, program director, moderated the meeting and explained the program, Baylor College of Dentistry Dean Dr. Lawrence E. Wolinsky was introduced and spoke, and I shared my thoughts on the characteristics of the “Greatest Profession.” Then, the mentoring groups broke out to discuss their future plans.

As the profession evolves and changes with each generation, it is important for us to remain connected and share our experiences and ethics with each other and especially our new candidates. It’s even more important for us to have a serving heart that’s evident in the Great Expectations program. Serving others is a testament to integrity of our profession.

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

This TSBDE Update will address Texas State Board of Dental Examiners (TSBDE) Chapter 110 — 22 TAC §110.5 — Moderate Sedation (Level 2) Permit. The TSBDE defines Level 2 Moderate Sedation as, “Drug-induced depression of consciousness during which patients respond purposefully to verbal commands, either alone or accompanied by light tactile stimulation. No interventions are required to maintain a patent airway, and spontaneous ventilation is adequate. Cardiovascular function is usually maintained. A Level 2 Permit is required for moderate sedation limited to enteral routes of administration…

(1)”. A Level 2 Permit automatically qualifies an applicant for Nitrous Oxide, Level 1 and Level 2 Permit privileges (2).

TSBDE Licensure Processing Delays

Ethics and Professionalism Survey

The Texas State Board of Dental Examiners (TSBDE) recently began implementing a new computer system that is causing significant unforeseen delays in processing new licenses and license/certification renewals. The TSBDE is aware of the backlog and is taking steps toward recovery. In the meantime, applicants are encouraged to submit their application/renewal as far in advance as possible. Application/renewal may be completed online at: hpc.state.tx.us/message.htm.

Because many licensees are required to submit proof of current licensure to organizations such as insurance companies, Medicaid, hospital credentialing departments, etc., the TSBDE is offering a temporary solution until the backlog is resolved. Once a licensee submits fees to activate or renew a license/certification, they may print a copy of the TSBDE’s “notice” and attach it to the expired annual license/ certification, or in the case of a new license, to the letter of authority to practice. The notice, when attached to the renewal paperwork, serves as temporary proof of authority to practice in Texas until the new license/certification is received.

Licensees not willing to accept this solution may request by e-mail a verification of initial licensure or renewal by contacting information@tsbde.texas.gov. A copy of the TSBDE’s notice may be accessed from the homepage of the TSBDE’s website at tsbde.state.tx.us.

In May 2011 the Texas Dental Association requested your feedback and participation in a survey about ethics and professionalism.

Eighty-seven members responded, and the August 2011 issue of the Texas Dental Journal featured several members’ responses, along with their photographs, providing a great snapshot of what members across the state believe about ethics and professionalism.

The Council on Ethics and Judicial Affairs (the council) would still like to hear from you. The survey remains open and available on the TDA website. Please take a few minutes to share your thoughts. The council plans to collect and publish the responses and make them available on the TDA website and as a supplemental handout for ethics and judicial affairs trainings which occur several times throughout each year.
