Dr Richard C. Black of El Paso (right) is this year’s recipient of TDA’s highest honor. Dr Black, an orthodontist, has held countless leadership positions throughout his career and has been a member of numerous councils and committees since joining TDA in 1978. He is the current chair of the Council on Legislative and Regulatory Affairs and served as TDA president from 2005 to 2006. He is also the current vice chair of the American Dental Association Council on Governmental Affairs and is a member of the ADA House of Delegates. He is a past member of the ADA Council on Ethics, Bylaws and Judicial Affairs. He continues to practice dentistry full time in El Paso, and remains involved in the community. He served as president of the Sun Carnival Association which puts on collegiate football’s annual Sun Bowl, and also served on 2 of El Paso’s largest cleft palate rehabilitation teams. Dr Black and his wife Beth have 2 daughters, Allyson and Lauren, as well as 3 grandchildren. In his spare time, Dr Black enjoys whitewater rafting, fly fishing, and golf. New Dentist Leadership Award – Dr Chad Allen Dr Chad Allen of Corpus Christi (left) is TDA’s outstanding new dentist leader of the year. A third-generation dentist, he graduated from Baylor College of Dentistry in 2004. He initially remained in Dallas, working on his prosthodontic residency and completing his Masters in Oral Biology in 2007. He then moved back to his hometown of Corpus Christi where he opened his private practice specializing in prosthodontics. Dr Allen is extremely active with the Nueces Valley Dental Society, serving in many offices including president (2012). He is currently chair of the New Dentist Committee and an alternate delegate to the TDA House.

His community involvement includes volunteering at Timmon’s Ministries Dr William M. Allen Dental Clinic, which is named after his grandfather and was started by his father, Dr Charles M. Allen Sr. He is also a board member of the Annapolis Christian Academy, and mentors pre-dental students and trains dental assistants at Texas A&M Corpus Christi and Del Mar College. Dr Allen and his wife of 15 years, Amy, have 2 daughters, AnnMarie and Allie. In his spare time, Dr Allen regularly attends church Bible studies, and enjoys windsurfing, having twice placed in the top 10 at the U.S. Open Windsurfing National Championships.

Texas Dental Program Medicaid/CHIP HHSC Cancels Xerox Medicaid Contract In early May 2014, the Texas Health and Human Services Commission (HHSC) announced that it terminated the state’s Medicaid claims administration contract with Xerox. HHSC is finalizing a 3-year agreement with Accenture, the largest subcontractor under Xerox, as lead vendor until HHSC is able to competitively rebid the contract. Accenture will take over the work performed by Xerox on August 1 after a transition period during which improvements are made to the prior authorization process and other functions are reviewed. Accenture has been responsible for the Texas Medicaid & Healthcare Partnership (TMHP) data center since 2004 and has extensive knowledge of TMHP services. To the extent possible, Accenture will continue to use the same business processes so changes for dentists and clients will be minimal.

Claims payments, prior authorizations, dentist enrollment, encounter data processing and other TMHP functions will continue as usual without disruption. Toll-free numbers and websites associated with TMHP will remain the same, so dentists should continue to use their regular points of contact.

HHSC Develops New Provider Marketing Guidelines Over the last couple of years, the Texas Dental Association (TDA) worked with the legislature, HHSC, and Office of Inspector General staff to develop guidelines to help dentists comply with the marketing prohibitions under Medicaid fee-for-service, Medicaid Managed Care, Children’s Medicaid Dental, and CHIP Dental included in Senate Bill 8 (83rd Legislative Session, 2013). HHSC’s marketing rules to implement SB 8 (1 Texas Administrative Code §354.1452 and amended 1 Texas Administrative Code §353.405) are scheduled to go into effect June 2014.

SB 8 prohibits dentists from disseminating material or engaging in any other communication that (1) involves unsolicited personal contact with a client or a parent whose child is enrolled in Medicaid or child health plan program; (2) is directed at the client or parent solely because the client or parent’s child is receiving Medicaid or child health plan benefits; and (3) is intended to influence the client or parent’s choice of provider.

However, exceptions to the marketing prohibition include making oral health information available during community-sponsored educational events, health fairs, outreach activities, or similar community or non-profit events. At these events, dentists and their staff may wear identifying scrubs, use identifying table drapes, and make available toothpaste, toothbrushes, pamphlets, etc., that include the name of the dentist and/or dental office as long as the materials are not disseminated to Continued on page 4

Then, September 20, 2014, Ft. Stockton will host its very first TMOM, and we are also very excited to bring this life-saving dental care to the citizens of West Texas. Dr Paul Stubbs of Georgetown received a President’s Award from Dr David Duncan for his outstanding work on behalf of the TDA. Dr Stubbs retired this April as TDA Building Committee chair, a position he has held since 2003.

Ms Sandy Blum of Austin received a President’s Award from Dr David Duncan for her outstanding work on behalf of TDA. She has served as director of the TDA Annual Session and Meeting Services Department since 1998.

Mr Jess Calvert of Austin received a President’s Award from Dr David Duncan for his outstanding work on behalf of TDA. Mr. Calvert has served as director of the Legislative and Regulatory Affairs Department since 2008.

Dr Mark Nichols, vice president of Clinical Affairs for the Bering Omega Dental Clinic of Houston (left), accepts a Certificate of Merit on behalf of the clinic. Bering Omega’s dental clinic offers a full range of oral and dental health care services to those living with HIV/AIDS in the Southeast Texas region. Many of Bering Omega’s patients live at or below the poverty level. Services offered include basic oral hygiene, general dentistry, oral medicine/oral pathology, prosthodontics, periodontics, endodontics, and oral surgery. Funding comes from individuals, corporations, foundations, faith organizations and community groups. Presenting the award is Dr William Nantz.

Brothers Phillip and Victor Ramirez, owners of JDL Laboratories in Port Neches, receive a Certificate of Merit in recognition of their efforts to serve the dental health and welfare of the disadvantaged population of Southeast Texas. JDL is a dental lab that partners with local dentists, organizations, and programs such as the TDA Smiles Foundation, Texas Mission of Mercy, and the Texas Department of Aging and Disability.

JDL donates its time, materials, and resources to provide dentures, denture repairs, and acrylic partials for the less fortunate. JDL recently worked with local dentists and the Texas Department of Aging and Disability to provide over $20,000 worth of probono work. Presenting the award is Dr William Nantz.

Dr David Bright, dental clinic volunteer at the Bethesda Health Clinic of Tyler (left), accepts a Certificate of Merit on behalf of the clinic. Bethesda Health Clinic is a Christ-centered ministry whose mission is to provide affordable, high-quality care for those in need in Smith County. In 2005 the dental clinic was launched, and provides treatment to patients experiencing pain or discomfort, as well as dental hygiene, fillings, and restorative care for a fixed, nominal cost. In 2013 the dental clinic served 2,400 patients with its small staff and 20 volunteer dentists. Funding comes from community organizations.

Ms Melanie Matthews (left), director of the Health Services Department for the San Antonio Southwest Independent School District (SWISD), accepts a Certificate of Merit on behalf of the department. For over 10 years, SWISD has worked with the San Antonio District Dental Society (SADDS) to promote oral health care for the more than 11,000 students in the district.

Through this partnership, the team of school nurses has been instrumental in the success of SADDS’s annual Give Kids a Smile and National Children’s Dental Health Month campaigns. This year, pre-kindergarten through 5th grade students on each of the district’s 11 campuses will gain access to on-site dental screening, preventive care, and referrals to local dentists for those who have unmet dental health needs. Presenting the award is Dr Josh Austin.

Ms Khushbu K. Patel (right) of UT School of Dentistry at Houston is presented the TDA Outstanding Senior Dental Student award for her student leadership, academic accomplishments, professionalism, ethical conduct, and volunteer activities promoting dentistry.

Presenting the award is Dr H. Phillip Pierpont, the associate dean for student affairs.

May Runoff Sets November Ballot Primary runoff voters in late May selected their candidates for the general election in November. On the republican side, voters continued the recent trend of selecting candidates who campaign as most conservative including Dan Patrick for lieutenant governor and Ken Paxton for attorney general.

Republican voters ousted several veteran incumbent lawmakers including Senator Bob Deuell and Representative Stefanie Carter both of Dallas.

Democrats selected Leticia Van de Putte to challenge Patrick for the lieutenant governor post in hopes of winning a statewide seat – something a democrat hasn’t done since 1994. The general election will take place on Tuesday, November 4.

Mrs Karen Cox of San Antonio received recognition for serving as president of the Alliance of the Texas Dental Association, 2013-2014.

During the May 2014 TDA annual session in San Antonio, the Alliance of the Texas Dental Association (ATDA) met congruently.

ATDA is a group of dental spouses who collaborate, volunteer, and contribute to the dental profession.

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

2014 Lawsuit Against the Texas State Board of Dental Examiners — Specialty Advertising On March 5, 2014, the American Academy of Implant Dentistry (AAID), the American Society of Dental Anesthesiologists, the American Academy of Oral Medicine, and the American Academy of Oral Facial Pain filed a lawsuit in federal district court challenging the constitutionality of 22 Texas Administrative Code §108.54 — Advertising of Specialties. The Texas State Board of Dental Examiners rule allows dentists to advertise as specialists or use the terms “specialty” or “specialist” to describe professional dental services in recognized specialty areas that are: (1) recognized by a board that certifies specialists in the area of specialty; and (2) accredited by the Commission on Dental Accreditation of the American Dental Association. The plaintiffs argue that the rule severely restricts dentists from advertising their “bona fide” credentials in dentistry. Additionally, the lawsuit contends that the rule delegates the authority to determine “specialties” and which dentists can call themselves “specialists” to the American Dental Association, a private trade association over which the state of Texas has no control.

At this stage, the outcome from the lawsuit is uncertain. In the meantime, dentists need to pay close attention to compliance with the state board’s business promotion rules — 22 Texas Administrative Code (TAC) §§108.50 – 108.63. Despite the passage of SB 8, confusion remains about permitted marketing activities. To address the confusion, HHSC recently announced guidelines to educate dentists and other affected entities about the rules and to implement a process allowing providers to submit marketing materials to HHSC for review and approval prior to use.

Information about the process for submitting marketing to HHSC for review and approval will be made available on the TMHP website. Specific information on the new marketing requirements, including examples of permissible and prohibited activities, will be included in the guidelines. Providers are first encouraged to assess their intended marketing based on the guidelines to determine if it is permissible or prohibited. If the provider is still unsure of their compliance with the new rules, they may submit provider marketing to HHSC for review and approval. Each marketing submission must be accompanied by a completed form, which will be available on the TMHP website.

Providers will be required to include on the form a description of the provider marketing being submitted for review and a description of its intended use, including date and location of the planned marketing activity. HHSC will review submissions and provide a written response within 30 business days. HHSC will contact the provider if additional information is needed. If HHSC denies an approval, the provider may revise and re-submit as a new submission.

HHSC’s approval is not extended to any deviations or modifications made to the marketing following the issuance of HHSC’s approval.
