Another example of the commitment to the growth of our Association is the TDA Externship Program, which builds student awareness of organized dentistry. This innovative program, created in 2007, offers students the opportunity to gain insight into the different components of organized dentistry including legislative and regulatory affairs, membership, governance, continuing education, and charitable dentistry and to gain a better understanding of their role as future leaders of the dental team. The program is open to dental students from each of the three dental schools in Texas. This year the externship program will take place June 20 – June 27 in Austin at the TDA central office.

Medical Device Excise Tax The medical device excise tax (2.3%) is scheduled to go into effect on January 1, 2013. At this time, dentists and dental laboratories are not exempted from the tax.

The tax is placed on the vendor of the device, and may be passed on to the dentist as the consumer. The definition of “medical device” as provided by the Internal Revenue Service (26 USC § 4191 — MEDICAL DEVICES; Section 201(h) of the Federal Food, Drug, and Cosmetic Act (FFDCA) (21 U.S.C. §321(h)) includes dental devices. The tax is expected to raise more than $20 billion by 2019 and will be used to help fund costs incurred through Patient Protection Affordability and Accountability Act. According to the proposed Internal Revenue Service (IRS) rules, the medical device excise tax (MDT) is a manufacturer’s excise tax and the manufacturer or importer of a taxable medical device is responsible for reporting and paying the tax. The National Association of Dental Laboratories issued an advisory stating, “Each lab has the option of including the MDT in their charge to the dentist or separately itemizing the MDT on their invoice to the dentist.”

The American Dental Association’s (ADA) Washington Office reported (November 8, 2012) that the proposed rules also indicate that dental equipment and material and supply purchased by a dentist for use in the office will be subject to the tax (eg, restorative materials, hand instruments, surgical instruments, etc.). Furthermore, it appears that completed dental prosthetics (eg, crown or denture) will not be taxed, but the materials used to make the dental prosthetic will be subject to the tax (eg, metal alloys, acrylic, and porcelain). However, the ADA cautions that these interpretations await clarification from the IRS when it publishes the final rule.

The ADA is determined to do everything possible to see the MDT repealed. However, there has been no further action on House-passed repeal legislation (HR 436) since June 2012, and with the re-election of President Barack Obama it is unclear whether there will be an opportunity to address the tax before it goes into effect.

TSBDE Rule Update

The use of electronic health records is dramatically affecting the dental profession. Although increasing numbers of dental offices are making the transition from a paper dental office to an electronic one, the transition to “paperless records” is often not seamless. To help Texas dental offices in making the transition, the Texas State Board of Dental Examiners (TSBDE) offers the following guidance.

It is important to keep in mind that in whatever format these records are stored they must be retrievable on request of the patient or the Board. Thus, if records are stored electronically, it is advisable to maintain a back-up copy on paper or have an electronic back-up system enabled for the dentist’s protection, should the original electronic records be compromised.

Is your practice receiving calls from people telling you that your credit card terminal is not PCI-compliant, not EMV or NFC ready, and/or not receiving Durbin debit rates? Unless the caller is your processor and knows your merchant account number, these are underhanded marketing calls, and the caller has no idea whether or not your practice is compliant. Is your practice being told that its credit card processing account is set up for retail, but should be set for healthcare? Know that MasterCard, Visa or Discover do not differentiate their rates based on retail vs. healthcare. Only American Express offers a 2.55% rate for dental offices and 2.89% for retail merchants.

Evidence-Based Practice Tip of the Month

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

The TSBDE states that no prohibitions currently existing within the Dental Practice Act (statute) or TSBDE rules prohibiting a dentist from, “…migrating the paper records into an electronic format.” In order for the TSBDE to accept scanned electronic copies of paper records as the “original” patient record, it must be legible and not altered.

Confused By Credit Card Processing Calls?

A 2008 article in the Journal of Oral and Maxillofacial Surgery compared autotransplantation of third molars into extraction sites vs. surgically prepared sockets (1). Within 62 patients, 64 immature third molars were transplanted, 22 into sockets prepared using burs (experimental group) and 42 into fresh extraction sites (control group). The autotransplanted third molars were either in root development stage 3 (one half of root, n=27) or stage 4 (three quarters, n=37).

Radiographs and photographs must be of diagnostic quality in the digital form if converted from film to digital copies. All TSBDE record keeping requirements remain the same. For example, the dentist licensee would be required to maintain the digital records for at least five years (TSBDE Rule §108.8 Records of the Dentist).

“No significant intergroup differences were observed at root development stage 3. In contrast, at root development stage 4 transplantations to surgically created sockets showed a significantly lower final root length (P = .025) and root length increment (P = .038) than transplants in the control group.”

Mt. Pleasant and Atlanta TMOM and Atlanta Fluoride Fest TDASF staff and volunteers pulled double duty this month, with 2 Texas Mission of Mercy (TMOM) events taking place in Mt. Pleasant and Atlanta on November 2 and 3. Dr. Don Lutes chaired the Mt. Pleasant event and Dr. Michael Giesler chaired the Atlanta event. Atlanta also hosted a Fluoride Fest for kids on November 2. These were TDASF’s final charitable events of 2012.

In Mt. Pleasant more than 64 dentists and volunteers treated 43 patients and provided $100,966 worth of charitable care at the Northeast Texas Community College Dental Hygiene School. Without the help from all the volunteers, and the outstanding school staff, this 12-chair TMOM would not have been such a great success. Residents in this small, rural community received the pain relieving care they so desperately needed, and could not afford or access otherwise.

In Atlanta, on Friday, the amazing staff and community at the First United Methodist Church hosted a Fluoride Fest. Dental hygiene volunteers provided oral health education, and lay volunteers helped with activities such as face painting, sports and games, and arts and crafts, for over 80 710 children. Dentists and hygienists provided exams, sealants, and fluoride treatment to 33 children, 580 which translated to more than $9,000 in preventive dental care.

On Saturday, the church hosted a 14-chair TMOM, and more than 129 dental and lay volunteers worked together to put on one of TDASF’s most successful 1 day events ever, treating 165 patients, providing $140,500 worth of charitable dental care.

Roger Macias, DDS San Antonio TDA Member Spotlight

President’s Prose

Make of our hands, one hand, Make of our hearts, one heart.

W

hen Dr Roger Macias of San Antonio held his wife Esther’s hands and sang these song lyrics at their wedding, he thought, “Dear Lord, let me sing this without crying.”

At that moment, something magical happened — music sang in his heart, the Lord heard his prayer, and Esther agreed to marry him.

Dr Macias is a general dentist by day and moonlights as a magician and a musician. If that’s not enough to keep him busy, he’s also studying to become a deacon of the Roman Catholic Church and will hopefully be ordained in 2016.

He received his doctorate of dental surgery degree from the University of Texas Health Science Center at San Antonio Dental School in 1983. Dr Macias a former Red Coat with the TDA Council on Annual Session and was chair of the 2011 TEXAS Meeting.

Give Thanks As you read this, Thanksgiving has come and gone. The turkeys have been carved, leftovers eaten, and the last of the pumpkin pie has been finished. The first feast occurred at Plymouth in the autumn of 1621, but President George Washington declared the first nationwide thanksgiving celebration in 1789. As a country, we have been celebrating this holiday and the current season of giving for hundreds of years.

I really enjoy Thanksgiving! Personally, I have much to be thankful for this year, and likewise, professionally, too.

First, I am thankful or the Texas Dental Practice Act and the opportunity to practice in this great state. Our state’s dental practice act is one of the strongest in the country, allowing us to provide the best care to our patients. The 83rd Texas Legislature convenes early next year, and our leadership including our in-house legislative consultants and staff will do their best to keep this sacred act in place.

He and Esther have 2 grown-up children. Twenty-three-yearold Devin is following in her father’s medical footsteps by studying at UT Southwestern Medical Center at Dallas. Trey, 21, carries on Dr Macias’ musical traits. A percussionist, he’s studying at the Berklee College of Music in Boston.

Second, I am thankful for my family. I trust you are able to spend some extra time with your family this holiday season. Nothing in our lives is more important than the relationships we have with family.

Dr Macias says music is something his father taught him to in his pockets for sleight of hand tricks for his patients. love. “I grew up in the 60s, the era of the Beatles,” he says.

“I thought, ‘Whoa! Guitar! The Beatles! This is me!’” He began to play the guitar at his Catholic church, and that continued through high school, into college, and then dental school.

Third, I am thankful for my faith. As many of you know, I am currently receiving chemotherapy for melanoma. While the treatments are incredibly difficult, it is my faith that keeps me going. Thank you for the prayers on my behalf during this time!

Faith in my God will see me through!

His father also influenced his interest in magic, particularly sleight of hand. On Saturday mornings, he and his father would watch the “Magic Land of Allakazam”. He learned how to manipulate cards and coins and is now a member of the International Brotherhood of Magicians. He says it allows his patients to see a different side of him, and they’re quick to ask for a trick. “I always have coins or cards with me. It breaks the ice for patients, especially kids.”

Earlier this month, the couple celebrated 25 years of marriage with an anniversary trip to Rome, especially fitting for Dr Macias as he completes his training as a deacon. They visited Vatican City, St. Peter’s Basilica, and various other churches and museums. At each altar, he touched a 3”x3” tatted lace cross that he keeps in his pocket.

“My mother made the cross. She passed away last year, and my father gave it to me when I was elevated to Deacon Candidate,” remembers Dr Macias. “I’ll have it sewn into my vestment, so she’ll always be with me.”

APPOINTMENTS 45-2013-B: Submitted by: TDA Editor: Approved Dr Daniel L. Jones be appointed as associate editor of the Texas Dental Journal to serve a concurrent term of the current TDA editor. Dr Jones’ duties pertain to the oral cancer edition of the Journal.

BUDGET 36-2013-B: Approved items over budget: Consultants, HOD 5-year life luncheon.

Financial implication is $4,095.

38-2013-B: Submitted by: Assets Oversight Committee: Approved the transfer of up to $265,000 from the Reserve Division Emergency account into the Operation checking account before Dec 31, 2012, to reimburse Operations checking for overbudget payment of the renovation of the TDA building elevators.

CORRESPONDENCE 44-2013-B: Approved the TDA, in collaboration with the San Antonio District Dental Society, send a letter to Dr Kathleen O’Loughlin, American Dental Association (ADA) executive director, nominating Dr Rise’ L. Martin to serve as the general chairperson for the ADA’s 2014 Committee on Local Arrangements.

MISCELLANEOUS 32-2013-B: Approved tax survey language in the 2012 tax survey to be administered by the Council on Legislative and Regulatory Affairs in October 2012.

33-2013-B: Submitted by: Future Focus Committee: Approved editorial changes to the TDA 2014 strategic plan.

39-2013-B: Submitted by: Committee on Access to Dental Care in Medicaid and CHIP: Approved that the TDA become a sponsoring organization for Smoke-Free Texas.

40-2013-B: Submitted by: Council on Annual Session: Approved a one-time $75 registration fee be offered to non-members of the TDA for attendance at the 2013 TEXAS Meeting in an effort to encourage TDA membership. Course fees would still be required for participation in continuing education sessions. Auxiliary staff of the non-member, who registers in the $75 discounted category, are assessed a $50 registration fee.

42-2013-B: Submitted by: Building Committee: Approved funding to repave the parking lot of the TDA Conference Center. Total of $10,700 (Building Fund).

46-2013-B: Approved the TDA to prepare information for its members on the current Medicaid services provided to children; provide information to its members on its actions regarding the Medicaid issues, and continue to discuss with state and federal officials TDA concerns on how Medicaid-eligible children may continue to receive ongoing dental treatment.

UTSD Dedicates Mobile Dental Clinic The University of Texas School of Dentistry at Houston (UTSD) and Ronald McDonald House Charities of Greater Houston/Galveston unveiled the Ronald McDonald Care Mobile, a mobile dental care unit, on October 5, 2012.

The mobile care unit will provide preventive dental care and treatment to children and teens in the Houston/Galveston area. UTSD will provide personnel and supplies for the unit.

“We are thrilled with this new partnership, as it is a perfect match with our commitment to children’s oral health and expansion of our community outreach efforts. The new Ronald McDonald Care Mobile will also provide a unique learning opportunity for our students,” UTSD Dean Dr John Valenza says.

UTSD and Ronald McDonald House Charities of Greater Houston/Galveston unveiled the Ronald McDonald Care Mobile on October 5, 2012.

The school has offered mobile dental services since 2002, traveling more than 60,000 miles and treating more than 24,000 patients in remote locations, at health fairs, and to those affected by natural disasters.

The Ronald McDonald Care Mobile has 3 patient care bays for treatment and x-rays can be taken with hand-held units. The van has space for a dental hygiene student, faculty dentist, 2 dental students, and 2 dental assistants.

UTHSC-San Antonio Dental School Breaks Ground on New Facility Center for Oral Health Care & Research to Open mid-2015 The University of Texas Health Science Center San Antonio broke ground on October 26, 2012, on the Center for Oral Health Care & Research, a $95 million dental school facility. The building will be located on Floyd Curl Drive in the South Texas Medical Center.

The Center for Oral Health Care & Research will serve as a modern venue for oral health care, education, training, and research.

The UT System Board of Regents in August approved a design of 4 stories covering 198,000 gross square feet, along with a parking garage of more than 400 spaces. The current dental school building is almost 40 years old and will be repurposed as existing clinical activities are moved to the new facility.

“The delivery of oral health care is changing, and changing rapidly,” said Dr Kenneth L. Kalkwarf, president ad interim of the UT Health Science Center, who served as dental dean for 24 years from 1988 until 2012. “The Center for Oral Health Care & Research will allow the dental school to be flexible to accommodate new technologies as they emerge.”
