Health Insurance Exchanges This is the seventh in a series of articles to keep you informed about the Health Insurance Exchange (HIX) in Texas. The HIX is an online marketplace tool enabling consumers to shop, compare, and enroll in a health insurance plan. Future articles will focus on helpful reference websites and other information about the HIX. In August, the Texas Dental Association (TDA) participated in a legislative briefing and a Texas Department of Insurance (TDI) public forum on Essential Health Benefits (EHB). It was apparent during the TDI forum that Texas does not appear any closer to choosing an EHB benchmark plan by the September deadline.

The current requirements of the EHB include dental benefits for children only. It is difficult at this stage to determine how this “essential pediatric dental benefit package” will be designed and administered in a manner that balances comprehensive care, affordability, and flexibility. This is further complicated by the lack of an appropriate benchmark within the private insurance market that includes a pediatric‐only dental benefit.

Few examples of child‐only dental coverage exist in the market, which adds to the unique challenge of defining the EHB’s oral health component.

The TDA believes the benchmark plan chosen by Texas must include an appropriate pediatric dental benefit or be supplemented to include an appropriate pediatric dental benefit with both preventive and therapeutic treatment codes. TDI’s recent analysis of the possible 10 benchmark plan options shows that Texas will very likely have to supplement the chosen or default benchmark plan with a pediatric dental benefit through a process prescribed by the US Department of Health and Human Services.

The TDA continues to be involved in this process and will publicize new information as it becomes available.

An initiative by TDA Perks Program that gives select district societies an opportunity to share in Perks’ profits kicked off in beta test mode on Sept. 1st. The goal of Promote Perks Program (PPP) is to effect growth in Perks’ income through bolstered promotion of Perks and its programs. The additional promotion will be provided by and take place in local societies, with the goal of increasing TDA-member participation in Perks programs. Eight societies will participate in the year-long beta test. If after a year Perks’ profits are increased as projected, societies participating in the beta test will receive a share of the increase in profits. If the trial is deemed successful, PPP will be opened up to all TDA component societies.

Rio Grande Valley Dental Society (RGVDS), one of the 8 societies participating in the beta-test, got an early start kicking off PPP at its annual Dentists Who Care meeting in August.

Dr Jeff Hancock, Lubbock TDA Member Spotlight

ust the thought of these 3 races are enough to tire most people, but Dr Jeff Hancock of Lubbock completed his second Ironman in August 2012, and he’s already training for his third.

The Ironman triathlon is undoubtedly one of the most grueling and exhaustive races that requires mental and physical skills and months of training. Dr Hancock was among 2,227 athletes who completed the Ironman Louisville in Kentucky, finishing in just over 11 hours (most Ironmans have a 17-hour completion limit). Ironman Louisville is ranked as the fifth most difficult Ironman in the world, according to RunTri, a non-profit organization that provides statistics and information for tri-athletes.

Dr Hancock grew up in Lubbock and received his Bachelor of Arts in chemistry at Texas Tech University in 1999. He earned his Doctorate of Dental Surgery from the University of Texas Health Science Center at San Antonio Dental School in 2003 and began practicing with Dr Joe Harkins in Lubbock. He and his wife, Starr, have a daughter and a son, Hope and Braxton.

He says the support of his family is necessary when training for an Ironman.

“They’re very supportive! Starr and the kids love going to the events.” Starr commented on their feelings regarding Dr Hancock’s races, “We are very proud of Jeff! He is teaching the kids, by example, that it is important to take care of your body through exercise and how rewarding it is to set a goal, work hard, and see it all come to fruition. Jeff is a wonderful husband, a great father, and a talented dentist who knows it is wise to take care of himself so that he can give his best to others.”

Michael L. Stuart, DDS, TDA President As I write this communication to you, I am preparing, as are all members of our ADA Delegation, to attend the ADA Annual Meeting in San Francisco. Many important issues will be decided at this House of Delegates meeting. Including governance restructure and consideration of dental anesthesia becoming a specialty of the ADA, there will be many important decisions facing the delegates.

I want all of our TDA members to know how seriously each member of our delegation takes the responsibility of representing you in these important issues.

Texas has a great legacy of leadership in the ADA, and our voice is heard in the House with much influence. In other words, we take the trust you place in us very seriously. We want Texas to always be placed in the best light and be held in high esteem. We will have the results of decisions made by the ADA House in future issues of TDA Today. Be watching for this important news!

I want to give a big shout-out to Dr Thomas Oates and the University of Texas Health Science Center at San Antonio Dental School (UTHSC-San Antonio) for recently being awarded a $4.5 million grant. The 7-year grant from the National Institute of Dental and Craniofacial Research will be used to develop a network of dental practitioners and dental hygienists across 5 states. You can read more about it in this edition. Way to go!

On the run: Dr Jeff Hancock of Lubbock competes in the Ironman Louisville in Kentucky on August 26, 2012. He completed the race in just over 11 hours.

In addition to having a family busy with gymnastics, ballet, and tennis in the evenings and a successful cosmetic dentistry practice during the day, Dr Hancock squeezes in time to train. “I do most of my training early in the morning, so I’m not away from the family,” he says, explaining how he wakes up at 4:00 a.m. to swim for 1.5 hours. He’ll then work a full day and go run or bike at night.

But, the race day environment is something you can’t duplicate. It is an amazing feeling, and I have usually barely crossed the finish line before I am considering which one I want to do next.”

With 2 Ironmans, 6 half-Ironmans, and multiple marathons under his belt, he’s not hanging up his running shoes, wetsuit, aerodynamic helmet, or triathlon bike anytime soon. “Running keeps me sane. It’s my stress reliever.”

His hobby has also proved to be good for business, as several of his training buddies are now patients. Beginning triathlons has improved his health, his mental stress, and his practice.

Dr Hancock hopes to compete in the Ironman Coeur d’Alene in Idaho in June 2013 and the Ironman Cozumel in November 2013.

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

Texas State Board of Dental Examiners Approves Rule Changes The Texas State Board of Dental Examiners (TSBDE) recently adopted 2 new rules and 5 rule changes as published in the September 21, 2012 issue of the Texas Register. The effective date for the rules is September 30, 2012.

A brief summary of the new and amended rules follows.

22 Texas Administrative Code §107.19 Denial of a License: The new rule clarifies an applicant’s rights and obligations following the denial of his or her application for licensure or registration. The new rule grants the applicant twenty (20) days from the date of the denial, during which he or she may request a hearing to appeal the denial.

22 Texas Administrative Code §107.26 Failure to Attend Hearing and Default: The new rule clarifies the outcome should a party to a matter before the State Office of Administrative Hearings (SOAH) fail to appear.

Specifically, the new rule directs SOAH to issue a default proposal for decision if a party who does not have the burden of proof fails to appear at a contested case hearing at SOAH. The new rule also directs SOAH to dismiss a case for “want of prosecution” if a party who does hold the burden of proof fails to appear at a contested case hearing. Finally, the new rule indicates that if a party who has the burden of proof fails to appear, the relevant application will be withdrawn from consideration and a future application may not be considered by the board until a year has passed following the date of the dismissal of the case before SOAH. 22 Texas Administrative Code §101.8 Persons with Criminal Backgrounds: The amended rule addresses the TSBDE’s discretion when considering criminal offenses as the basis for license/registra-

tion suspension or revocation. The amendments clarify which criminal offenses directly relate to the practice of dentistry and establish a process for determining the appropriate disciplinary action following a criminal offense. They also require written disclosure of criminal convictions or deferred adjudications.

22 Texas Administrative Code §107.24 Respondent’s Answer in a Disciplinary Matter, §107.25 Formal Proceedings, §107.69 Alternative Informal Assessment of an Administrative Penalty: TSBDE Rules §107.24 and §107.25 address the formal hearing process at SOAH. TSBDE Rule §107.69 addresses the process that allows an Informal Assessment of an Administrative Penalty for certain violations.

The amendment to §107.24 simplifies the default process by eliminating filings and considerations that impede the resolution of a case.

The amendment to §107.25 requires pagination of exhibits entered into evidence by any party at a hearing before SOAH. The prior rule suggested pagination, but did not mandate it.

The amendment to §107.69 addresses the process that allows an Informal Assessment of an Administrative Penalty for certain violations. This informal process was initiated in the 2009 legislative session. The amendment modifies the process to allow the final appeal that initiated the informal assessment process be heard at SOAH for a possible sanction.

22 Texas Administrative Code §110.9 Anesthesia Permit Renewal: The amended rule establishes requirements regarding renewal of minimal, moderate and deep/general sedation anesthesia permits every two years. The amendment clarifies the frequency at which renewals must occur. The rule now states “every two years” instead of biannually.

UTHSC-San Antonio Dental School Receives a Dental Practice Based Research Grant The University of Texas Health Science Center at San Antonio Dental School (UTHSC-San Antonio) was awarded a 7-year, grant from the National Institute of Dental and Craniofacial Research (NIDCR) to lead the Southwest Region as 1 of 6 regions forming the National Dental Practice-Based Research Network (NDPBRN). The Southwest Region includes Texas, Oklahoma, New Mexico, Arizona, and Kansas. Overall, this will be a network of dental practitioners and dental hygienists interested in collaborating on research will be headquartered at the University of Alabama at Birmingham.

Thomas W. Oates, DMD, PhD, is director of the NDPBRN Southwest Region. He serves as assistant dean for clinical research at UTHSC-San Antonio and is a professor and vice chair in the Department of Periodontics.
