Continuing Education SB 455 established a maximum 12-hour continuing education (CE) requirement for dental assistants who hold more than two certificates of registration (radiology, pit and fissure sealant, and coronal polishing). Dental Assistants holding one certification of registration must complete 6 hours of CE each year.

All CE must be in subjects covering dental assistant duties and be taken from a Texas State Board of Dental Examiners (TSBDE) approved CE course provider.

DENPAC — Organized Dentistry’s Political Action Committee (PAC)

When organized dentistry speaks, legislators listen.

TDA’s PAC (DENPAC) and your grassroots involvement are key reasons why. Your contributions to DENPAC provide support to political office-holders and candidates and ensure organized dentistry’s voice is heard – and heard loudly. With health care reform at the forefront of issues facing lawmakers, your continued support of DENPAC is now more important than ever.

The regulations regarding contributing to a PAC can be confusing. The following article will provide you with an overview to contributing to DENPAC. There are limitations to whoº can make political contributions to DENPAC. Generally, corporations, including non-profit corporations, are prohibited from making political contributions. This applies to “C” corporations as designated by sections of the Internal Revenue Code, or Subchapter “S” corporations referred to in the Tax Code. DENPAC is not able to accept contributions from these corporations, except in very limited circumstances.

Partnerships, limited liability companies (which do not have corporate members), professional corporations, professional associations, and sole proprietors can make political contributions to DENPAC, so long as such entities do not have a corporation as a partner or owner.

For instance, professional corporations organized under Chapter 303 of the Business Organizations Code and its predecessors are permitted to make political contributions.

Please note that the contribution must clearly indicate that the entity is a Texas professional corporation. Similarly, professional associations organized under Chapter 302 of the Business Organization Code and its predecessors are allowed to make political contributions. Again, contributions from such associations must clearly indicate that the entity is a professional association.

Substantial penalties could result if state laws regarding political contributions are not followed. DENPAC carefully examines each contribution and will not accept one until it is clear that the contribution is made by a legally permitted entity, such as an individual, professional corporation or professional association. DENPAC reports contributions as required by state law. Contributions are entirely voluntary and a TDA member is not favored or disfavored by reason of the amount of contribution, or a decision not to contribute. Political contributions are not tax-deductible as either charitable contributions or business expenses for federal income tax purposes.

The Freedom-of-Choice Dental Insurance Plan Endorsed by the TDA Perks Program Questions and Answers about DentalQuick Part 1 of 2

by TDA Perks Program, DentalQuick is offered to TDA members who wish to participate, but none of our programs is mandatory.

Excitement has been generated by DentalQuick, the new freedom-of-choice individual/family dental insurance plan recently endorsed by the TDA Perks Program. Here are answers to questions about this newly endorsed TDA Perks Program.

Q. Does the TDA endorse the DentalQuick insurance program?

A. No, the TDA, upon the advice of its attorney does not endorse any services, products, or companies. TDA Financial Services, Inc. has been the designated endorsement affiliate of the TDA for over 20 years. This wholly owned affiliate of the TDA manages the TDA Perks Program.

Q. Why does the TDA have a for-profit endorsement affiliate?

A. The TDA Perks Program‘s mission is to raise non-dues revenue for the TDA. Q. Who comprises the corporate board that decides TDA Perks Program endorsements?

A. These dentists comprise the board that evaluates and grants endorsements of products and services beneficial to TDA members: Dr. W. Kenneth Horwitz, president; Dr. Terry Watson, vice president; Dr. Jerry Katz, treasurer; Dr. Tana Busch; Dr. Thomas Harrison; Dr. Dan McCauley; Dr. John Stovall; Dr. Michael Vaclav; and Dr. David Woolweaver.

Q. Why did the TDA Perks Program board approve the endorsement of an individual/family dental insurance program?

A. Because many patients do not have access to group plans at their workplace and are looking for assistance in paying their dental bills. The promotion of Direct Reimbursement, only available as group dental plans, generated hundreds of dental office calls to the TDA. These calls were made on behalf of patients looking for dental insurance that could be purchased by an individual for themselves and for their families.

Q. Why would TDA Perks Program be interested in helping patients secure dental insurance?

A. According to ADA statistics, those who have dental insurance are more likely to visit a dentist and because they have financial assistance available through their dental insurance, they are more likely to purchase the dental care they need.

Q. Is the DentalQuick program an employer sponsored group dental insurance benefit?

A. No, DentalQuick offers dental insurance to individuals and families separate from their workplace.

Q. Can a person who purchases a DentalQuick policy use it to supplement a group dental plan that an employer provides?

A. Yes, DentalQuick claims can be filed to help a patient attain maximum reimbursement by combining a group plan claims payment with DentalQuick supplemental insurance.

Q. Is participation in the DentalQuick insurance plan mandatory for TDA members?

A. No, just as all of the other 25 endorsed products and services endorsed

Q. To participate in the DentalQuick plan is a TDA member required to discount fees or join a discount network?

A. No, DentalQuick is a freedom-of-choice plan that allows a covered patient to visit any dentist and encourages patients to stay with their dental home. Dentists bill their full fees by balance billing the patient the difference between DentalQuick reimbursement and the normal fees charged for services.

Q. Is a dental office required to pay any fees to participate in the DentalQuick program?

A. No, dentists do not pay any fees or discount any fees to serve a patient covered with a DentalQuick policy.

Q. Does DentalQuick require pre-determinations of treatment and submission of radiographs?

A. No, predeterminations are not required and by eliminating the submission of radiographs, claims payments are not delayed as with some other dental insurance policies.

Q. What insurance company underwrites the DentalQuick dental insurance program?

A. A-(Excellent) rated Assurant Health is the financially solid company that underwrites DentalQuick. The policies offered by the DentalQuick program are established, successful policies that have been on the market for over 6 years.

Q. Do the policies offered in the DentalQuick program have standard Type I (preventive), Type II (basic), and Type III(major) procedure designations?

A. No, DentalQuick policies are “fee schedule” policies that list all procedures covered with an accompanying dollar reimbursement for each procedure, making it easy to determine value of benefits compared to premiums charged for the purchase of a policy.

Q. How does having a clear, definite fee schedule help a prospective purchaser of a DentalQuick policy?

A. The value of the DentalQuick plan is transparent. The monthly premium quoted for a DentalQuick policy can be weighed by a potential purchaser against a list of dollar benefits for each procedure covered. The patient compares projected use of benefits against the premiums required, thus making an economic decision easy and logical. The DentalQiuick website has a benefit calculator to assist a potential DentalQuick policy purchaser with this decision.

Q. Many dental insurance policies have the same $1000 annual maximum benefit limit they have had for many years. What about DentalQuick?

A. Dental Quick has a $1500 annual maximum benefit plus $150 additional annually for preventive care supplement, a total of $1650 of benefits available each year.

Fluoride Fest!

That’s Our Mission!

On October 3, 2009, your TDA Smiles Foundation (TDASF) strengthened its educational offerings by hosting its inaugural Fluoride Fest in Atlanta in conjunction with that community’s Tall Pines Festival and the help of Northeast Texas Community College (NTCC) School of Dental Hygiene.

Components of the United Ways of Texas-funded Cavity Free Corral program, along with nutritional counseling, face painting, and other activities were available to attendees to stress the importance of fluoridated water to a community’s dental health.

Attendees received free milk, fluoridated bottled water, and healthy snacks, along with toothbrushes, paste, and floss. Children received free fluoride varnishes and free dental sealants.

Sixty-nine children received over $10,000 in charitable dental care, and an estimated 200-300 children participated.

Our thanks to the town of Atlanta, NTCC’s School of Dental Hygiene, Dr. Mike Giesler, and everyone who helped make the TDASF flagship Fluoride Fest such a wonderful event!

“Aloha!”

I am penning this message on the return flight from the American Dental Association’s 150th Annual Session.

Now, before you think this was just a vacation, let me tell you that my feet never hit the sandy beaches of Waikiki.

Your ADA delegation represented Texas extremely well and the work put in on behalf of your TDA was exemplary.

Many, and I mean many, problems associated with the running of the ADA came to light through the strong leadership of our own Dr. John Findley this past year. The transparency of our parent organization has never been better and was strengthened through the actions of this ADA House of Delegates. Dr. Glenn Hall, TDA speaker of the house, ran for the speaker of the ADA and lost that election in a close run-off to the sitting speaker. The ADA’s loss continues to be our gain here in Texas.

The ADA delegates once again left our annual session with no dues increase to our membership. In these tough economic times, the leadership did everything they could to help keep the financial impact on our practices to a minimum. I will say however that future dues increases, in my mind, are not far off. Look for more information in upcoming publications and on our website regarding actions taken in Hawaii.

Now, let me briefly update you on my travel over these past few weeks. I have attended the 7th, 12th, and 16th district dental society meetings. In addition, I represented the TDA at Texas House of Representatives Speaker Joe Straus’s fundraiser and delivered a DENPAC contribution to State Representative Chuck Hopson (D-Jacksonville) who carried our dental legislation in the Texas House during the last session of the Texas Legislature. By the time you read this, I also will have spent 2 days in Dallas delivering DENPAC contributions to many of the friendly incumbents that represent us in Austin. The schedule required is hectic and exciting, and I continue to thank you for allowing me to represent and lead the TDA. Until next time, you are In the Loop.

Avulsed Teeth

After entering pubmed.gov, search for “avulsed teeth.” There are many articles on this topic. I noticed interesting information about storage of the avulsed tooth, surface treatment of the root surface, and surveys of various groups of people about their knowledge of how to manage this traumatic event. Also, research using experimental root surface treating agents can be found. There seems to be a difference of opinion regarding whether endodontic treatment should be done extraorally on all teeth, only on those teeth with closed apicies or not done until a later time depending upon the outcome of initial treatment.

Just for fun, you might like to narrow the search by clicking on “limits” tab just below the search box. To narrow the search, click the categories you would like to include; such as English, human, or clinical trial before you activate the search. This will reduce the total number of citations listed by excluding papers in other languages, animal studies and those other that clinical trials. In the case above, we still get many papers but this approach can be helpful when a search lists a smaller number of papers.

TSBDE Rule Update This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

At its regular meeting on August 28, 2009, the Texas State Board of Dental Examiners (TSBDE) gave its final approval to a new rule which establishes a reference to the recordkeeping standard of care relating to dental hygiene practice. The new rule — §115.6 — reads as follows: §115.6. Records.

A Texas dental hygiene licensee practicing dental hygiene in Texas shall record treatments delegated by a Texas licensed dentist and performed for and upon each dental patient for reference, identification, and protection of the patient, the dentist, and the dental hygienist.

Such recordings shall be entered in the dental records maintained and kept by the delegating dentist.

This new rule went into effect on September 20, 2009.
