OSHA Revises Hazard Communication Standard The Occupational Safety and Health Administration (OSHA) revised its Hazard Communication Standard (HCS) to align with the United Nations’ Globally Harmonized System of Classification and Labeling of Chemicals. The revised standard requires (1) the use of new labeling elements for chemicals and (2) a standardized format for Safety Data Sheets, formerly known as, Material Safety Data Sheets (SDSs). These new requirements will help employees better understand the hazards associated with chemicals in their workplace.

Employers must train employees on the new labels and SDS format by December 1, 2013. OSHA published an OSHA Fact Sheet on the new requirements including a list of the minimum required topics for the training. You may view the Fact Sheet at osha.gov/Publications/OSHA3642.pdf.

Texas Dental Program Medicaid/CHIP In early September, the Texas Dental Association (TDA) met with the Health and Human Services Commission (HHSC) and the dental plans (DentaQuest and MCNA Dental) to discuss the dental provider incentive plans (DIPs) that will be implemented later this fall. TDA’s comments included that Texas’ DIPs must have at their core incentivizing the delivery of quality dental care to the Medicaid/Children’s Health Insurance Program (CHIP) population with the goal of making the Medicaid/CHIP population healthier. DIPs must not interfere with the dentist-patient relationship by injecting factors unrelated to the patient’s needs into treatment decisions.

Dental-Supplies Buying Group Is a Potential Flagship Program By leveraging the group buying power of more than 7,400 TDA members, a new TDA Perks program is projected to save TDA members an average of more than 35% on dental supplies.

On October 1, TDAPerksSupplies.com will launch with more than 40,000 products from more than 200 dental brands— most available through dealers. The online dental supplies store will also sell product lines of more than 60 direct manufacturers that don’t sell their products through any dealer.

Before ordering, TDA members are encouraged to obtain a price estimate from TDA Perks Supplies. To receive one, send a list of items (using SKU or distributor item numbers) via email, phone or fax.

MARKETING Medicaid/CHIP dentist providers are prohibited from engaging in any marketing activity or dissemination of information (1) intended to influence a Medicaid/CHIP client’s choice of dentist provider, was (2) directed at the Medicaid/ CHIP client solely due to their enrollment in Medicaid or CHIP, and (3) involves unsolicited personal contact. Unsolicited personal contact includes door-to-door solicitation, solicitation at a child-care facility or other type of facility, direct mail, or telephone with a Medicaid client or the parent of a Medicaid client.

Dentists need to evaluate their marketing activities under each of the 3 elements to determine whether a marketing activity is permissible. For example, if a Medicaid/CHIP dentist is direct mailing office information only to the homes of Medicaid/CHIP clients that would be considered a marketing violation. However, if a Medicaid/CHIP dentist sends the same mailing to EVERY person in a specific zip code, that is not targeting Medicaid/ CHIP clients and it would be permissible.

Medicaid/CHIP dentists are allowed to engage in marketing activities that involve the general dissemination of information, such as by television, radio, newspaper, or billboard advertisement.

Medicaid/CHIP dentists may also participate in a community-sponsored educational event, health fair, outreach activity, or similar community or non-profit event if the dentist does not engage in unsolicited personal contact or promote their dental practice. For example, a Medicaid/CHIP dentist could participate in a local elementary school health fair as long as the materials disseminated (eg, toothpaste, toothbrush, pamphlets, etc.) did not include the name and/or contact information for the dental practice.

HHSC is currently in the process of developing the rules necessary so that Medicaid/CHIP providers may submit proposed marketing activities for review and approval or denial by HHSC before engaging in the marketing activity. The review process will most likely not be in place until 2014.

Medicaid/CHIP dentists are also prohibited by Medicaid/CHIP regulations from offering gifts or other inducements designed to influence a client’s choice of dentist provider. Items such as backpacks, school supplies and similar items are not permissible. Items such as cash, cash equivalents and gift cards, regardless of the amount, are never permissible. However, HHSC’s Office of Inspector General will allow Medicaid/ CHIP dentists to give tooth decay prevention items (a toothbrush, toothpaste, floss and similar items) each visit as long as the value of the tooth decay prevention items do not exceed $10 individually and $25 in the aggregate annually per patient. * Information for the above marketing article came from SB 8, 83rd Regular Session, and an HHSC bulletin titled Offering Gifts and Other Inducements to Beneficiaries.

The TDA Way

A month ago, I underwent surgery for prostate cancer. Since then, my pathology report has thankfully returned clean. I spent the next couple of weeks recuperating at home, and much to my surprise and delight, I received more texts, emails, and calls than I could have imagined — many of them from you.

Thank you. Thank you for reminding me what a great organization this is. I joined for the professional support the TDA provides, but at the end of the day, it’s the personal support that I receive from my friends and acquaintances that I will remember. A battle with cancer is just that … a battle. And, what better way to defeat it than with an army of supporters. It’s the TDA way, to lift those up who need it most. We are all the same in one way or another. As dentists, we care for others, and that has been evident to me these last few weeks.

Hugh Patton, DDS, of Pearland is passionate about philanthropy, specifically his involvement in the Lions Club.

Dr Patton is a 1997 graduate of the University of Texas School of Dentistry at Houston (formerly the University of Texas Dental Branch in Houston). He and his wife Maria have been married 16 years and have 3 sons, 14-yearold Harrison, 12-year-old Liam, and 10-year-old Reis.

Dr Patton says he always wanted to serve his community, and years ago a friend told him, “I’ve got the club for you.”

He’s been a member of the Pearland Lions Club since 2010. “The Lions do a lot for the communities,” he says, explaining how the organization is set up similarly to the American Dental Association’s tripartite organization. “On the local level, we give scholarships to local high schools, and on the state level, we contribute to the Texas Lions Camp.”

She will also soon take over coordination of the Texas Donated Dental Services Program.

Where did you grow up?

I was born and raised in Corpus Christi as an only child to a single mom. I’m very grateful to her, for teaching me to be independent, strong, and resourceful. People always ask me if I miss living there, because of the beach…but I actually hate the beach!

Where did you go to school and what did you do before you came here?

I went to a small community college in Corpus before I moved to Austin and transferred to Texas State in San Marcos in 2004, where I earned a BA in English in 2006. I started working for the Coastal Bend AIDS Foundation (CBAF) in Corpus when I was 19, and it was there that I fell in love with the nonprofit sector. I also worked for the Corpus PBS/NPR affiliate before moving to Austin, and began working for Any Baby Can (ABC) when I moved here. In addition to writing grants for ABC’s programs, I was a database administrator there and coordinated events for our client families, including 5 years acting as Camp Director for ABC’s Camp Grey Dove, a summer camp for siblings of childhood cancer patients and survivors. My passion for helping others drives me and will always be a part of my career and life.

Why did you decide to come to the Texas Dental Association?

I worked very briefly as a grant coordinator for the Travis County Juvenile Probation Dept. just before coming to work for TDASF. I was longing for more direct involvement in nonprofit work that I wasn’t getting in my job with the county.

What is your favorite thing about the job?

I really appreciate the opportunity to see, first-hand, the amazing work TDASF does for people all over the state, as a part of my job. I’ve always worked in a clerical or fundraising capacity for nonprofits, so I love that I get to go to Texas Missions of Mercy to witness the care we provide to people who need it most. I’ve also never worked with better people — I love the foundation team so much.

What is one thing about you that might surprise people?

I am a huge fan of horror films. On the surface, I’m such girly girl, so my love for this genre surprises most people. The darker, creepier, and more disturbing, the better! Among my favorites are ‘60s and ‘70s films like Rosemary’s Baby and the original Texas Chainsaw Massacre…which is still the only movie to ever really, truly scare me. I also love slasher films with lots of gore and dark humor.

The Texas Lions Camp is a camp for children with disabilities, type 1 diabetes, and cancer. Dr Patton and other Lions donate their time each May to work around the camp, which is located in Kerrville. “On Workday, we’ve done different things like paint the rodeo arena, build out the medical equine center, or we’re given an assignment based on how many volunteers are available.”

Members of the Pearland Lions Club donate their time at the Texas Lions Camp in May 2012. The camp, which is free of charge, gives children with disabilities and diseases the chance to explore in the Hill Country.

Dr Patton says the Texas Lions Camp is the Lion’s Club best kept secret. The camp is free of charge; it runs solely on funding and volunteerism from the state branch of the Lion’s Club. Children with special needs and medical conditions are given the opportunity to explore and challenge themselves for a week in the Hill Country. According to its website, the camp was created in 1949 in response to the polio outbreak and has since changed to include children of all disabilities.

In addition to operating his own general cosmetic dentistry practice and being involved in the Lion’s Club, Dr Patton sits on the boards for the 100 Club of Pearland, Keep Pearland Beautiful, and Business Development of Texas First Bank.

As a dentist, Dr Patton says it’s natural to want to help others and be involved, which is why the Lion’s Club has been such an important philanthropic cause to him. “It’s in our nature. We have to pass it on.”

Another Election POCKET CHANGE FOR POLITICAL CHANGE Every legislative session brings change. Change in legislation, policy, and regulation. DENPAC exists to promote positive and productive change for dentistry in Texas. This year DENPAC is looking for a new kind of change — the kind that jingles! We are challenging all TDA members to use their small change to promote big change through what we are calling the DENPAC CHANGE EXCHANGE. How does this Change Exchange work? Simply find a container of your choice and collect your pocket change throughout the year. Members can either contribute individually or combine their collection with members of their local component. Each component society will receive an official Change Exchange container, compliments of DENPAC. Components will compete to see who can collect the most “change for change.”

TSBDE Rule Update

This recurring section is designed to help TDA members keep up with important Texas State Board of Dental Examiners (TSBDE) rules, other regulations, and state law affecting their practices.

Clear communication with the dental patient is very important. Especially, when discussing treatment options. Texas State Board of Dental Examiners (TSBDE) regulations require the dentist to obtain a patient’s written informed consent for all treatment plans and procedures where a reasonable possibility of complications exists (1).

As an integral part of the informed consent process, a dentist should discuss with the patient the specific procedure(s); alternative treatments, including delaying treatment or non-treatment; and the risks and complications of the procedure(s) that could influence a patient’s decision to give or withhold consent. Be sure to document the discussion in the patient’s chart along with the signed informed consent form.

Polite communication with a patient is also helpful in avoiding a situation in which a patient files a complaint with the TSBDE. The dentist and staff should demonstrate respect for patients, be sensitive to patient dissatisfaction, and attempt to resolve complaints at the office level. Although dentist and staff communication style with patients is not a jurisdictional issue for the TSBDE, a significant number of TSBDE complaints start as a complaint about staff rudeness and then result in the TSBDE identifying violations (eg, recordkeeping) through the investigation process.
