Fight in New Lisbon ends in stabbing On Saturday morning, at 2:37 a.m., the Sheriff’s Office received a report of a fight at Tuesday’s Bar in New Lisbon in which a subject was stabbed. Both subjects involved in the fight were transported to Hess Memorial Hospital. A 25 year old male from Hustler received a laceration to his face and leg. The other party, age 30 of New Lisbon, received a concussion. The Wisconsin State Patrol, New Lisbon Fire Department and First Responders, and Camp Douglas Ambulance responded to the incident. The matter remains under investigation. The Messenger will report any charges resulting from the incident and the identities of the subjects as authorities release them.

Kendall man charged in hit and run BY EVA MARIE WOYWOD According to a November 8th press release from the Kendall Marshall's Office they, along with the Norwalk/Wilton Police Department, assisted the Monroe County Sheriff's Department in locating a suspect in Kendall of a hit and run accident. That suspect, 31 year old Matthew J. Sweatt, was located at 216 W. South Railroad Street and was taken into custody on numerous charges including a felony warrant. The release goes on to state that during the arrest Sweatt became combative with law enforcement. On Monday, November 11th, Sweatt was charged in Monroe County with felony first degree reckless injury, and felony hit and run. Additional misdemeanor charges include criminal damage to property, resisting an officer, disorderly conduct, and operating while revoked. On the day he was charged Sweatt, in custody, appeared in Monroe County Circuit Court and was placed on a $2,000 cash bond. He remains in custody of the Monroe County Police.

Injuries reported in car v. train accident Sheriff John B. Spears reports a vehicle versus train accident that occurred Thursday evening November 7, 2013 at approximately 10:38 p.m. on State Highway 35 near Mundsack Road in the Town of Genoa. Danyel R. Smith, age 33 of Stoddard, was traveling southbound on State Highway 35 North of Mundsack Road when she lost control of her vehicle, went off the road, overturned and came to rest on the railroad tracks. A northbound Burlington Northern train struck the vehicle. Danyel R. Smith was transported to Gundersen Lutheran Hospital by Tri-State Ambulance. The Conductor and Engineer in the Burlington Northern Train were not injured. Alcohol was a factor in the crash. Smith was wearing her seatbelt at the time of the crash. Assisting at the Sheriff’s Office at the scene were the Genoa First Responders, Genoa Fire Department, and Tri-State Ambulance. The accident remains under investigation by the Vernon County Sheriff’s Office.

Rural Elroy man charged with false imprisonment, assault BY EVA MARIE WOYWOD A rural Elroy man, Randall D. Lueck, has been charged in Monroe County with second degree sexual assault, false imprisonment, and battery. The charges against the 51 year old were filed on October 31st for an incident that is alleged to have occurred at his County Highway WW residence on October 28th. According to the police report, a female victim accused Lueck of raping her after she went to his property to retrieve some items. Upon leaving she claims Lueck grabbed her from behind pulling her right arm back and forcing her into the bedroom. He then is alleged to have tied her to the bed with baler twine, and removed her clothing without her permission. Lueck is then accused of assaulting her with Icy Hot and ignoring her repeated order to stop before continuing to sexually assault her. The female told police that before untying her and allowing her to leave, Lueck threatened her. The report goes on to state that the female sought medical care at a hospital where a family member contacted the police. Photographs of the female's injuries were taken documenting swollen wrists, several lacerations, and bruises. Police executed a search warrant on Lueck's property and recovered Icy Hot and baler twine in a bedroom and adjacent bathroom. Lueck was taken into custody, however, refused to speak further with police after stating that the female had set him up. On November 1st, Lueck was placed on a $500 cash

Randall D. Lueck bond which was posted on November 4th. On Monday, November 11, he was in court for an initial appearance before Monroe County Circuit Court Judge David Rice. Lueck waived his rights for time limits for a preliminary hearing and a pre-trial offer was scheduled for November 25th. He was represented by defense attorney Bernardo Cueto. Lueck does have a previous criminal history with convictions in Monroe and Vernon counties including disorderly conduct, forgery, and battery.

Plea hearing postponed for Cholka Steven Cholka, 48, of Mauston appeared in Juneau County Circuit Court on November 6th for what was scheduled to be a plea hearing. Due to a recent change of defense attorneys, the plea hearing was postponed and a pre-trial conference has been scheduled for January. Cholka, who is out on a $2,500 cash bond was charged in June of 2012 with maintaining a drug-trafficking place along with manufacturing/delivering cocaine and felony possession of a firearm after local law enforcement conducted an under-cover investigation which resulted in the arrest of 10 individuals. Since his arrest and charges were filed, he has been represented by five different defense attorneys including the most recent assigned to his case, Jon Wilsnack. Following the pre-trial conference scheduled in January, a status hearing is scheduled for February 4, 2014. His bond, including conditions, has been continued.
